Amendment 96, tabled by the noble Baroness, Lady Hayman, would require combined county authorities to notify the Secretary of State of any plans to begin a local travel survey within 30 days of being transferred functions under Clause 19. There is no legal requirement surrounding a combined county authority’s use of local travel surveys. Creating a legal requirement on CCAs for the reporting of their use within 30 days to the Secretary of State would, I suggest, place an unnecessary burden on CCAs, relative to the benefit.
Noble Lords may be interested to know that the Department for Transport conducts a national travel survey. We would expect CCAs to conduct further work locally to gather evidence in developing their local transport plans. However, we feel that mandating the use of local surveys in this way would be disproportionate, so I am afraid we do not feel we can accept this amendment.
I turn to Amendment 97, tabled by the noble Baroness, Lady Taylor of Stevenage. It would allow the Secretary of State to make regulations to confer on a combined county authority a power to designate railways, bus routes and cycle paths as key routes. The purpose of a CCA designating a route as part of its key route network is to enable the mayor to direct local councils in how they should use their powers as the highway authority for that route, if they are not carrying out actions agreed under the local area transport plan. For example, a combined county authority mayor might direct local authorities to build a particular bus lane on part of the key route network, which would have strategic, area-wide benefits for the CCA as a whole.
CCAs will already be able to designate bus and cycle lanes that form part of a highway in their area as part of the key route network under the existing Clause 22. The powers that local authorities have as highway authorities do not extend to railways, so allowing CCAs to designate them as key routes would have no effect on their operation. Given that CCAs will be responsible for the local transport plan for their region, we would expect them to identify their key transport routes and plan how to manage these, including railways.
Amendment 98, tabled by the noble Baroness, Lady Taylor, would enable the Secretary of State to confer a power on a combined county authorities to designate their area’s transport infrastructure as in need of regeneration. I would like to reassure her that, once established, combined county authorities, like existing local authorities, will have multiple means through which to petition the Government for improved transport infrastructure for their region. For example, Network Rail is responsible for maintaining the railway and for any renewals to ensure a safe and efficient-running railway. When it comes to enhancements being sought for railway improvements, we follow the rail network enhancements pipeline policy, which sets out how areas can engage with government on rail improvements.
On local roads, the Department for Transport provides local highways maintenance funding through the highways maintenance block and the potholes fund, which provide annual funding for eligible local highways authorities, including future combined county authorities, to locally prioritise investment in local roads and associated infrastructure, such as bridges and lighting columns. The Department for Transport will also maintain regular contact with combined authority areas, which will provide ample opportunity for areas to make the case for transport infrastructure improvements.
I am grateful to the Minister for what he said about roads and railways, and the control and leadership—if you can call it that—that the Department for Transport has in the pipeline, as he calls it, and everything else. However, I have seen examples of where Network Rail has been unable to paint the railings in one station because it had to go to the Treasury for approval. My noble friend’s amendments are designed to give some local control and accountability, rather than having everything controlled by the Treasury and the Department for Transport, who clearly think that they know best about everything, but some of us have our doubts.
Well, I note the noble Lord’s scepticism, which is long-standing, and can only say that I will relay his comments to the appropriate quarter.
I hope that the explanations I have given will be helpful to noble Lords opposite and that the noble Baroness, Lady Hayman, will feel able to withdraw her Amendment 92. As always, I would of course welcome conversations outside the Chamber if she feels those would be useful.

Lords ChamberMy Lords, I have listened to this debate very carefully. The noble Lord, Lord Scriven, talked about Yorkshire, which he clearly knows well. Apparently, this new director will be based in Leeds. Several times “the north” was referred to—but does “the north” include west of the Pennines or is that a different area? What is the geographical boundary of these things, or is it still fluctuating?
It is open for decision. We want to see local areas taking the initiative themselves. Where there is a functioning economic hub, for example, or a whole county, they may wish to apply for CCA status, but it is up to them to make those decisions. One can talk in general terms of “the north”, but until we know that the appetite is in those northern areas for taking advantage of the opportunities that we are trying to create, I cannot be more specific.

Lords ChamberI am a bit confused because the Minister said that accepting my noble friend’s amendment would divert the sponsor body’s activity from the main activity, which is to build a new Palace, but he also said that it is doing it anyway. If it is doing it anyway, the amendment is surely all right.
The point I was seeking to make is that if you set out in the Bill something that looks quite distinct and separate from the main task that the sponsor body has before it, you risk distracting it. What we are saying to the sponsor body is, “Yes, public engagement is vital, you are already doing it, so you should do it in the best way you can because you know best how to deliver R&R”. That is the position I come from. Therefore, there is no need to change the wording of the Bill. We should not be frightened of leaving the Bill as it is because we know that the sponsor body has its heart in the right place in a way that reflects exactly what noble Lords have been talking about this evening.
The restoration and renewal of the Palace should increase the number of visitors and see that visitors have an even better experience. I absolutely agree that R&R also provides the opportunity to re-engage the public in how democracy functions in the UK. The programme will develop better educational facilities, and it has been suggested that the additional chamber in Richmond House can be used to engage schoolchildren in our democratic process. That would be added value from the R&R process.
I just want to say something about building in a statutory duty to consult. I have talked about the need to avoid being over-prescriptive but, over and above that, the Government are concerned that placing a statutory duty on the sponsor body to consult the public, as prescribed in the amendments tabled by my noble friend Lord Bethell, is a particularly onerous requirement. Public engagement, as I have said, is essential for the works to succeed, but a duty to consult, I would strongly argue, would divert resource and time from the essential job at hand, which is to formulate proposals on the design, cost and timing of the works for parliamentary approval.
Let me turn briefly to Amendment 6, tabled by the noble Lord, Lord Blunkett, requiring the sponsor body to have regard to non-cashable benefits when assessing whether the programme delivers value for money. Clause 2(4) (b) to (h) contains a wide range of non-monetary benefits to which the sponsor body must have regard. They include safety and security, the environment, accessibility, educational facilities and the spread of opportunities to secure economic or other benefits across the UK. These benefits, which are, of course, important, have got to be balanced against the need to ensure that the works represent good value for money, as required under Clause 2(4)(a).
Value for money is core to the programme, and we consider that that has to remain explicit in the Bill. If we go on adding other non-monetary matters to Clause 2(4)(a), we run the distinct risk of watering down the explicit imperative of achieving value for money for the works, which is something that the Bill as drafted ensures the sponsor body must have regard to. Therefore, I think that the amendment of the noble Lord, Lord Blunkett, would be detrimental to the Bill.

Lords ChamberMy Lords, the Defence Secretary published a Written Ministerial Statement on 19 July, as the noble Lord will be aware. It set out the headline conclusions of the modernising defence programme. I know that noble Lords were slightly disappointed with that Statement. We had hoped that it would be informative and reassuring—we had certainly intended it to be so. It confirmed the direction of travel; it described the work done to date; it set out some headline conclusions. Strictly speaking, the matter of the offshore patrol vessels is not part of that but, as I have explained, it is important to prepare now for the contingencies that may ensue from Brexit.
My Lords, how many of these ships will protect our fishing fleet after Brexit at any one time? After all, we are taking back all these waters and presumably clawing back the allocation of catches from the Spanish and everybody else.
As we speak, the Marine Management Organisation within Defra is making a full assessment of the scale and volume of both sea-based and non-seaboard patrol and surveillance capability required after we leave the EU. This is the key point for us to focus on. The Ministry of Defence and other agencies are tracking this work, but it is important to remember that fisheries protection is multilayered. It is not just the Royal Navy that enforces protection. The Marine Management Organisation relies on a lot of other systems to do that very thing.

Lords ChamberNaturally, that is being looked at in the context of the Government’s wider industrial strategy, but the 10-year industrial strategic partnership arrangement we have with Leonardo will act as a driver and influence to ensure that that company focuses on using the skills and expertise available in this country over the medium to long term.
My Lords, when the Government published a statement last week saying that the new aircraft carrier to be launched this year would dramatically increase Britain’s firepower in the defence of the world, did they understand whether there would be any planes to fly on this aircraft carrier, or are they relying on helicopters, machine guns or whatever?
We have already taken delivery of seven F35E aircraft for the “Queen Elizabeth” aircraft carrier. There are more to come. Indeed, we accelerated the procurement programme when we announced the results of the SDSR in 2015. The “Queen Elizabeth” aircraft carrier will be fully manned and fully equipped when she is ready to sail.

Lords ChamberThere is, I am sure, no more elegant way of describing the issue under consideration at the moment. The noble Lord makes a very important point about heredity. I do not think that sufficient is understood about the role of our genetic make-up in the way in which we all differ in our weight and size. However, for those who are obese, there are clear, evidence-based actions that they can take to lose weight if they have a mind to do so.
Does the Minister agree that the link between cycling and the avoidance of obesity is extremely strong? Will he speak to his colleagues in the Department for Transport as his predecessor, whom I met at a conference a few years ago, said that the Department of Health would not encourage cycling because it was a transport matter?
We are straying a little towards obesity in general rather than obesity in children. However, I concur with the noble Lord that cycling has an important place in the way in which we can take exercise, which is beneficial for our general health. I will, of course, take back the noble Lord’s message.

Lords ChamberMy Lords, we are clear that artificial sweeteners are safe if taken as intended. That is the advice of the European Food Safety Authority and we take that advice. However, encouraging people to take low-diet fizzy drinks, for example, in preference to sugary drinks is problematic because all fizzy drinks have an adverse effect on tooth enamel. We need to be balanced in our messages but we think that artificial sweeteners have a role in a proper calorie-controlled diet.
My Lords, are the Government aware of a study by the Dutch Government which links obesity with exercise—in particular, walking or cycling—in inverse proportion? Given that the same study says that we are the most obese country in Europe, will he encourage cycling to be taken up by more children and persuade the Department for Transport to take this a bit more seriously by get moving in encouraging more children to cycle to and from school and for leisure?
