I entirely understand the basic premise of the right hon. Lady’s point, which is that we should seek to reassure EU nationals here in the UK and British citizens in other EU countries. On that broad premise, we are not poles apart. The question is about how we achieve that objective, which raises several complex issues. She will understand that we are talking about not only the right to reside, but employment rights, the right to study, entitlement to benefits, access to public services, and the ability to be joined by family members.

This is not, as the right hon. Lady seeks to characterise it, about viewing people as bargaining chips in some way; it is about getting the best possible outcome for EU citizens who are here and for the 1.2 million British citizens who are elsewhere in the European Union. The Government are absolutely focused on getting the best possible solution through discussions with the European Union. She and other EU nationals who are here and contributing to our society can be assured that that is absolutely at the forefront of what we are seeking to achieve in the negotiations that will follow.

I am sure that everyone on both sides of the House wants to see no disadvantage given either to EU citizens living in this country or to UK citizens living in other European countries. I detect the faint whiff of synthetic indignation over this entire urgent question process. What judgment has the Minister made about the best way to protect the interests of the more than 1 million British citizens living, and in many cases working, in other EU countries, so that no one is disadvantaged at the end of this process?

We need to ensure that there is an overall balance and that all the issues are given careful consideration. We have to view things in the round. That is why it would be a mistake to view this in a narrow way and to make statements now that could impede broader discussions about the position of British nationals in other European countries. That is the right approach and is precisely why the Prime Minister set out that we need to consider things very carefully.

We are very clear that Border Force has sufficient resources in place to carry out its mandated duties at ports across Humberside and to mount effective operations to identify and intercept smuggled contraband goods and clandestine migrants. What Border Force has done is to ensure that there is a greater flexibility in the workforce, so it can be managed rather better according to risk and need.

One thing that makes Border Force more effective in protecting the border in Kent is the ability to operate in Calais rather than in Dover as it used to do. Does my right hon. Friend agree that anything that gave the French the temptation to move our border back to Dover would serve to weaken our borders?

My right hon. Friend is absolutely right. As not only a former Immigration Minister but a Kent MP, he is aware of the importance of our juxtaposed controls in France. I am very clear that those juxtaposed controls are a significant benefit. They help us to secure our border and we wish them to stay in place.

The right hon. Gentleman and his Committee have been consistent in raising this issue, and I am sure that he welcomes the fact that we are now removing record numbers of foreign national offenders. We are taking a number of steps in relation to the identity and identification of foreign national offenders. In most cases, passports will be taken away, although some individuals will have destroyed their documentation. That is one of the difficulties involved in returning people to countries when they have no documentation; getting the correct identity is one of the challenges faced by the recipient country, regardless of where in the world it is.

The Home Secretary will be as aware as anyone of how difficult it is to deport a foreign criminal to any country and that it is all but impossible to do so to some countries. Does she agree that the EU prisoner transfer framework directive gives us a much better chance with those countries than with any other country, including Commonwealth countries; that, if my hon. Friend the Member for Stone (Sir William Cash) has his way in the referendum, that would make it more, not less, difficult to deport foreign prisoners and that our prisons’ problems would therefore continue; and that that would be, by any standards, a perverse outcome?

I entirely agree with my right hon. Friend, who has experience of these issues from his time as the Immigration Minister. Membership of the European Union gives us access to information sharing and instruments that help increase our ability to deal with foreign national offenders and criminals. Crucially, as I indicated earlier to my right hon. and learned Friend the Member for Rushcliffe (Mr Clarke), the prisoner transfer framework decision gives us the ability to return people on a compulsory basis, rather than requiring the prisoner themselves to agree to that return.

This is going to be a slightly different question from the one you were expecting, Mr Speaker. I am delighted that the Office for National Statistics has published this report to bust the myth that these national insurance numbers expose something about the immigration system. The report states explicitly that the main contributors to these national insurance numbers are people who are here for less than a year and will therefore not be included in the Government’s immigration targets and have nothing whatever to do with them. To be kind to those who are arguing the case for Brexit, I think they believe that short-term migrants are as bad as long-term migrants in many cases. That being the case, will the Minister acknowledge that many groups of short-term migrants—including 27,000 teachers, 28,000 care workers and 60,000 seasonal workers in the farming industry—do tremendous things for this country, both in our public services and in the private sector?

I am grateful to my right hon. Friend for making that clear point. He recognises, as I do, the benefit that we gain from the short-term migration of EU workers. Others who fall into that category include students on short-term courses, short-term contractors and, as he has pointed out, seasonal workers. The point is that this migration is short term: those people leave and therefore do not contribute to the long-term pressures.

Before we begin, I will briefly outline the procedure. It is always a pleasure to serve under your wise guidance, Mr Turner.

The Commission published its communication, “The European Agenda on Security”, in May 2015. It sets out a shared agenda for the period 2015 to 2020, to support member states in fulfilling their

“front line responsibility for security,”

with a focus on organised crime, terrorism and cybercrime. The proposed agenda is intended to replace the EU’s first internal security strategy, which expired at the end of 2014. Although they broadly welcomed the communication, the Government made it clear that the renewed EU internal security strategy would be owned and implemented by the Council and based on a number of key strategic aims set out in conclusions agreed by the Justice and Home Affairs Council in December 2014 and June 2015.

The European Scrutiny Committee considered the Commission communication last July at its first meeting of the new Parliament and recommended that it should be debated before the Commission brought forward further measures to implement its European agenda on security. Despite that clear request for a timely debate, it has taken the Government nine months to schedule one. During the intervening period, there have been two devastating terrorist attacks in Paris and Brussels, which have resulted in the loss of 160 lives. At the same time, conflict and crisis in the EU’s neighbourhood have generated unprecedented migratory flows to the EU and undermined confidence in the security of the EU’s external borders. A number of member states have responded by reintroducing temporary internal border controls. How member states and EU institutions and agencies work together to manage security at their external borders, respond humanely to the refugee crisis and tackle the terrorist threat is the most important challenge facing the EU today.

How have the EU and member states responded to those threats to internal security and stability? Since July, the Council and European Parliament have concluded negotiations on a directive on passenger name record data and a new Europol regulation, a counter-terrorism centre has been established within Europol and new data protection rules have been agreed. The UK is participating in a revamped Schengen information system and has also decided to re-join the so-called Prüm measures, which provide for the exchange of DNA profiles, fingerprints and vehicle registration data to combat terrorism and other serious cross-border crimes. In addition, the Commission has put forward proposals to strengthen existing EU terrorism laws, tighten the rules on civilian firearms and expand the European criminal records system.

In short, much useful work has been done at European level and by Ministers, and it is important that we recognise and applaud the good work that has been done by both the British Government and our European partners. However, at a time of heightened terrorist alerts in many member states, does the Minister agree with the European Scrutiny Committee that the renewed EU internal security strategy merits the exposure and scrutiny of a debate? If he does, what justification can there be for the nine-month delay in scheduling such a debate?

I reiterate the request made by the European Scrutiny Committee last July for an explanation of the key differences between the renewed EU internal security strategy agreed by the Council last June and the Commission communication. The Commission’s communication identifies greater

“transparency, accountability and democratic control”

as a key principle underpinning “The European Agenda on Security”. The conclusions agreed by the Council last June make no reference to the role of national parliaments. What assurance can the Minister give us that Council ownership of the renewed EU internal security strategy will promote transparency and openness? What are the Government doing to promote greater transparency, accountability and democratic control by this Parliament of EU internal security policies and laws, including through the timely scheduling of debates? Finally, will the Government tell us what progress has been made since last June to implement the renewed EU internal security strategy, what role is being played by the Standing Committee on Operational Co-operation on Internal Security—the so-called COSI committee—on which senior member state officials sit, and how our national Parliament is being informed of that committee’s work, as required by the EU treaties?

The hon. and learned Lady refers specifically to the issue of threat and to safety and security across the whole of the United Kingdom. As I have said and as she will know, the threat level from international terrorism is not set by Ministers; it is set independently by the joint terrorism analysis centre. It has maintained the threat level at severe, which means that an attack is highly likely. Against that background, as I also said in my statement, the police have increased their presence at certain key locations, notably at certain transport hubs, and we have increased the action taken by Border Force at various ports, and that is right. We will obviously keep those levels of activity under observation and monitor them according to the nature of the threat that we see.

It is for us all to be vigilant. I think the public should be alert, not alarmed. We do everything that we can to keep the public safe and secure. Underlying that, however, is of course the need for us to ensure that in particular our intelligence services—our security and intelligence agencies—are able to access the intelligence that enables plots to be disrupted. That means having the powers that we believe are right for them to have to be able to do that role.

The hon. and learned Lady talked about the counter-narrative. It is absolutely right that, as part of the work we do, we should deal with the poisonous ideology that is leading people to violence. That work is being done. We do such work through the counter-terrorism internet referral unit to ensure that pieces are taken down from the internet. The speed at which that happens—the number of items taken down—is now something like 1,000 pieces a week. That has increased significantly in the past year or so. We led on the establishment of an internet referral unit at Europol, which is now enabling that capability to be available not just in the United Kingdom, but across the European Union.

One of the most effective weapons that the police and security services have in fighting Daesh terrorism is a constant flow of information and intelligence from within the various Muslim communities in this country. Will the Home Secretary assure the House that she and the Government will continue to make every effort to ensure that, in all those communities, there remains the instinct and habit of co-operation with the police and the security services so that this vital flow of information is maintained?

My right hon. Friend is right to refer to this as a “vital flow of information”, which it is. From time to time, we look at how to make sure that opportunities are available for people to come forward in a variety of different ways with information that they feel is important. For example, the Metropolitan police have on occasion undertaken campaigns to encourage people to come forward with information. We did that, in particular, in relation to people who might be travelling to Syria. We of course continue look at how to make sure that every opportunity is available for people in Muslim communities and others who feel they have concerns that they need to express to government in various forms to do so. As my right hon. Friend says, that intelligence is absolutely vital.

We do take our responsibilities seriously, as I indicated in the statement that I made to the House. On the level of alternative accommodation, I mentioned the welcome centres that are available around other parts of France, which now number more than 100. Around 2,500 people have left those camps to go to the reception centres. I stress the importance of getting asylum claims into the system in France.

The right hon. Lady highlights, rightly, the interests of children in and around the camps. We are obviously aware of the containerised accommodation adjacent to the Calais camp. Priority, we understand, is being given to women, children and other vulnerable migrants. This is in addition to the 400 places in heated tents already available for women and children.

In response to the right hon. Lady’s point about close family members, I can tell her that we remain committed to our obligations under Dublin III. The UK and France are running a joint communication centre at the camp, which informs individuals of their rights to claim asylum in France and gives them information on family reunification.

Equally, to assist in the handling of such cases, the UK and France have established a senior-level standing committee and agreed single points of contact with respective Dublin units, and the UK is about to second an asylum expert to the French administration to facilitate the improvement of all stages of the process of identifying, protecting and transferring any relevant cases to the UK.

The right hon. Lady referred to a period of nine months, but it should take nowhere near that amount of time. We remain committed to seeing an efficient and effective process for what we judge to be a small number of cases that might have that direct connection to the UK. She will also be aware of the broader family reunification provisions, over and above Dublin, that would allow children to be reunited with their parents, with direct applications not only from France, but from elsewhere in Europe and, indeed, from the region, where there is that direct link. The Government have also committed an additional £10 million through the Department for International Development to support better reunification and to assist children in transit in Europe, but we are very cautious not to make an already difficult situation even worse.

Therefore, the emphasis is on giving practical support to the French Government, who are leading in this regard, and providing expert support. Equally, there is the support that we are giving in Greece, Italy and countries in the region so that such children are more easily identified and helped at the earliest opportunity.

My right hon. Friend is right that the best way to protect the maximum number of vulnerable children is by minimising the number who are taken to live in squalor in the camps outside Calais in an attempt to make a dangerous and illegal crossing to this country, and the way to do that is by maintaining our close co-operation with the French authorities and doing what we can to strengthen the Dublin convention. Does he agree that the worst thing this country could do is anything that would disrupt our close relationship with the French authorities on this matter?

I agree with my right hon. Friend. We have established a very close working relationship between the UK and French Governments, and between the Home Secretary and Bernard Cazeneuve. There are regular meetings at that level and at operational level, highlighting the exchange of expertise to which I have already referred. My right hon. Friend is right; we will need to maintain that sort of support in the months and years ahead.

There are examples across the country of excellent collaboration between the emergency services, particularly the H3 project in Hampshire, where collaboration between the emergency services has driven efficiencies and a better service for the public. Police and crime commissioners will have a duty to collaborate when the Policing and Crime Bill currently before the House becomes law.

I had the honour and privilege of being in Hampshire recently and saw for myself the brilliant work being done between the emergency services. That is a result of the collaboration between the chief fire officer and the chief constable, as well as the police and crime commissioner doing excellent work to see that we have the right sort of emergency service for the 21st century.

I have seen what Matthew Scott is proposing to do when, as we on the Conservative Benches all hope, he becomes the police and crime commissioner. We need to ensure that we spend taxpayers’ money efficiently and well, and collaboration is the best way forward for that.

I thank the hon. Gentleman for the way in which he raises his concerns. Like him, I pay tribute to the work and the approach that Middlesbrough, as an authority, has taken for many years in seeking to accommodate asylum seekers. He will be aware that a number of discussions have taken place between my officials, Home Office officials and Middlesbrough Council on the concentration of asylum seekers, as Middlesbrough is the only place in the country where our threshold of one in 200 is exceeded. I have asked my officials to look at that closely and at a plan to bring it back within the appropriate standards we have set.

On the report in The Times today and on the experiences of some people being accommodated in housing in Middlesbrough, I condemn absolutely any crimes of hate, any actions that sow divisions within communities and any actions that seek to intimidate or mark out asylum seekers in any way. We have been in contact with the local police this morning to underline any issues of community reassurance. They are actively considering appropriate steps. Complaints about hate crime should be made to the police, so they can be followed up and appropriate action taken.

The hon. Gentleman asks me about the urgency of response. As soon as I heard about the matter, which was late last week when The Times first contacted us, I instructed officials to look into it urgently because of my very serious concerns about what I was hearing. I expect the audit to be concluded on the Home Office side quickly, and completed at the latest by the end of this month.

On G4S, we have an ongoing regime of inspection of the maintenance and condition of properties. G4S has met standards where maintenance issues have been identified as requiring remedial action. It has followed through on them, but the audit will look at that closely. The chief executive officer of G4S underlined to me, in a conversation this morning, the seriousness and urgency of the issue. He underlined the sense of urgency that he and G4S attach to repainting doors to make sure there is no predominant colour. I said that I expected that to be done quickly. That was the message I got back from G4S.

This is a matter of utmost concern. The Home Office is working on it closely. We will look at it carefully and rigorously. It is not simply a question of looking at the contract. If there are issues that need to be brought to the attention of the police, and criminal action taken thereafter, that will be a matter for the police. I urge those with evidence to come forward and ensure it is reported appropriately.

I echo the plea for urgent action on the ground. Throughout the past 15 years, when the number of asylum seekers has been a hugely controversial and sensitive public issue, one of the best things has been that on the ground in communities there has been very little tension and very little violence. At a human level, the policy has been handled very well. It would be tragic if that were to end with some of the actions in Middlesbrough we have heard described. Obviously, the Minister will have to take a number of actions that will take some time, but on the immediate, on-the-ground action, if what is required in the short term is to repaint 150 front doors, then frankly this should not be taking three months or three weeks. The painters should be out now and it should be done by the weekend. I hope the Minister can assure the House that that kind of urgency will be shown.

I am grateful to my right hon. Friend for his comments. He has understanding and experience as a previous holder of the office I now hold as Immigration Minister. I can assure him of the urgency I have impressed on G4S in respect of resolving the issue quickly. The chief executive officer underlined that he recognised and understood that clearly. We will be monitoring the situation closely. I have asked officials to go to Middlesbrough tomorrow to assess the situation on the ground and to start work on the audit. I hope that that reassures my right hon. Friend of the urgency that I, my officials, and, from what we are hearing, G4S attach to this matter.

I support the Government’s proposals, partly as a result of my own Home Office experience of seeking to fight not just criminality, but, specifically, cross-border criminality. Members on both sides of the House have made the powerful argument that taking this decision will actually make our streets and citizens safer. I cannot think of a better use of parliamentary time, particularly at this moment. The Government’s decision could not be more timely, given the terrible events not just in European countries, but around the world, in recent weeks and months. It is well worth this House doing everything we can to protect our citizens and to reassure them that everything is being done to make our streets as safe as possible.

It is relatively unusual for the Home Office to be able to invite the House to take such a decision on the basis of hard evidence. When adopting a new policy, it is often the case that we have to assume that it is going to work. Sometimes it does and sometimes it does not, but in this case we have had the benefit of the pilot, which has been much discussed, and it seems to me that the arguments cannot be gainsaid at all. Clearly, even the small-scale pilot has already made this country’s streets safer, so extending that so that we can experience the full benefits of the Prüm measures is extremely sensible.

That is why the proposal is supported by people throughout the criminal justice system. The Home Secretary has herself quoted a number of senior police officers, including the Commissioner of the Metropolitan Police, the director general of the National Crime Agency and a chief constable who has been involved in a particularly sensitive case. It is interesting that, further down the criminal justice pipeline, the Director of Public Prosecutions also supports the proposal. She has said that it will

“reduce the number of unsolved crimes, such as murder and rape, committed by foreign nationals, and provide an improved service to the public”

and victims—a group we should always be particularly concerned about.

The advantages are spread across a number of areas. They include not just the simplified processes to request information and data, though they are vital, but efficiency gains in international searching, which will allow simultaneous searches to take place in a number of countries at once. That is a significant step forward in practical crime fighting.

Speaking as one of the forces of darkness referred to earlier, I abhor giving more power to any other body, but I accept my right hon. Friend’s argument about the international element; it is not just about the European element. In that case, I support the sharing of data, because it makes our streets safer. What I object to is that it is framed in this European way, but we are where we are, unfortunately.

I can only say to my hon. Friend that it would be absurd to let the best be the enemy of the good. It would be wonderful if 185 states all had the technical capacity and ability to exchange information in this way, but they do not. In fact, I think only 21 of the current member states of the European Union can actually do this. I know that this is not true of my hon. Friend, but I sense that other hon. Friends want to use that as a reason not to sign up to the proposal, but that is nonsense, because it would continue to leave our streets not as well protected as we would all wish them to be.

For me, the problem of cross-national justice is that countries are sometimes very keen to convict foreigners, and there is therefore a propensity to miscarriages of justice. We saw that with the plane spotters in Greece, as my right hon. Friend may remember. He has of course been in the position of suffering a politically driven miscarriage of justice. What is interesting for me is that the Home Office has done a very good job in preventing the false positives and miscarriages of justices. Does he agree?

As so often, I do agree with my right hon. Friend. He is right that, for obvious reasons, I am not an uncritical admirer of everything that the police do. I regard myself as a candid friend of the police. It is extremely important that the technical measures that can be taken to minimise false positives and possible miscarriages of justice are taken at all times. I agree with him that the reassurances the Home Secretary has been able to give on that matter are extremely important.

Before I move on to the potential risks, I want to mention one advantage: access to Eurodac, to which my hon. Friend the Member for Christchurch (Mr Chope) referred. Eurodac is the EU-wide database of the finger- prints of asylum seekers and illegal migrants. This change will allow it to be used in criminal investigation searches. It will be precisely aimed at potential criminals, not at innocent people who may have been caught up in something. That underpinning safeguard is absolutely key.

The overwhelming advantage is the straightforward one of speed. Anyone who looks at practical law enforcement will know that speed of response is hugely important in making police operations more effective, particularly internationally. Regrettably, it is topical to say that this is particularly true when the police are attempting to deal with a terrorist outrage. The fact that it may take minutes or 24 hours, rather than months, to get evidence is absolutely vital. The advantages are therefore clear cut and widespread.

People have expressed two areas of risk associated with this system. One is genuine and the other is the result of applying some wrong-headed ideology. Let me deal with the genuine one first: the fear that the measure will intrude on our privacy or damage our data protection and therefore adversely affect our civil liberties. I take that very seriously. It is extremely important to deal with security alongside other civil liberties. I agreed with a lot of what the shadow Home Secretary said, but I do not agree—I may have slightly misunderstood him—when he said that we must have security, and once we have security we can worry about civil liberties. I think that security is one of the important civil liberties that Governments should guarantee, but other civil liberties are extremely important. We must try to defend them all in parallel and, if necessary, strike the right balance. I think that the measure does that.

There will be stringent safeguards. I return to the point that the key safeguard is to ensure that the measure is used to target convicted criminals. It seems to me that if we use large-scale databases, particularly on an international basis, we want to target people convicted of a crime, not just to trawl the records of innocent people. That is absolutely essential at a national level, and it is even more essential at a European level. The proposals before the House pass that test. I imagine that that is why the National DNA Database Ethics Group has given this a “wholehearted welcome”, which is quite a good badge of respectability for the Home Office.

Like other hon. Members, I have read carefully what Big Brother Watch has said about the measure. It is an organisation that does a lot of good and helps to hold Governments to account. I confess that I was slightly surprised at the tone of the response from Big Brother Watch, which welcomed the safeguards that the Home Secretary has introduced. It did say that there were areas of concern, but against the normal standards of comments by civil liberties groups on Home Office proposals, that is warm approval. That should be taken seriously.

I echo the words of the hon. and learned Member for Edinburgh South West (Joanna Cherry) and hope that the Minister deals with the vehicle registration database and the specific worries that Big Brother Watch has raised. It asks:

“Will searches only be for serious crimes or will they include offences such as speeding or driving in a bus lane?”

It also asks:

“Will foreign police forces have access to ANPR cameras or historical ANPR data?”

The House ought to be reassured on those points.

All those civil liberties issues pose a genuine risk, but I think that they have been dealt with. The other line of criticism, which appears in the amendment, says that we should not use these procedures because they are procedures of the European Union. That is a damaging ideology. These measures help the police to catch criminals, prevent terrorist attacks, save lives and keep our streets safer. In those circumstances, it is irresponsible to say that we should not sign up because of an anti-European ideology and a fear of the European Court of Justice. The British people know that we live in a dangerous world and, frankly, will not forgive politicians who make it more dangerous by indulging in anti-European gesture politics in this field.

It has been argued that there are other ways to achieve the same effect, but it has been amply demonstrated in the course of the debate that nothing that is available is as efficient as this measure.

Will my right hon. Friend assist me by saying whether Iceland, for instance, should be encouraged to join?

Iceland is not a member of the European Union. If Iceland wished to sign some kind of deal with the European Union, I assume that it would be open to Iceland to do so, but I have seen no sign that it does. It is not within the purview of this House to dictate to the Icelandic Government and people what they should do. I imagine that they want to keep their streets safe as well.

I take my right hon. Friend’s point about the European Court of Justice, but the fear in respect of some of the protections he has talked about, such as the extreme case of whether the database is used for speeding offences, is that the Court could change the guidelines in a way that is outside our control. I do not think that it is true that that could happen in this case, but I think that he should address the point, rather than just dismiss it.

I do not dismiss it, although my right hon. Friend is right that it is not true in this case. The Prüm measures specifically say where the European Court of Justice has jurisdiction, and it is quite limited. One thing that the Court seeks to do is to defend individual citizens against over-mighty states.

My right hon. Friend knows that. The idea that everything that the European Court of Justice does is bad or somehow goes against civil liberties and freedoms is simply wrong, as I am sure he would acknowledge.

It is worth putting it on the record that the Prüm decisions are caveated by national law. Article 12 states that the searches must be conducted

“in compliance with the searching Member State’s national law.”

I may be the first Member to do so on this side of the House, but I am sure that I will not be the last.

In this case, I want to refer to a concept that Lenin introduced: that of the useful idiot. It refers to people who do something by accident that gives comfort to those whom they normally oppose. I am afraid that some arguments against this proposal fall into that category. I know that my right hon. and hon. Friends who are advancing these arguments are not idiots, so I urge them to think hard, and possibly not to press the amendment.

This kind of European co-operation in fighting serious crime and terrorism is essential in today’s dangerous world. It is to the European Union’s credit that it has devised a practical system to help keep people safer, and to the credit of the British Government that they have agreed to sign up to it. I hope that tonight the House will agree on that significant step forward in fighting terrorism and serious international crime.
