Commons ChamberThere are huge complexities in this deal, but there is a simple choice before us today: this deal or no deal. As someone who campaigned hard for remain in 2016, I have held two views very strongly since then: not only would it be wrong to try to overturn the result, as many of my hon. Friends believed, but leaving with no deal would be a terrible option for this country. Today, therefore, I will vote enthusiastically for this deal.
I congratulate the negotiating teams on both sides for showing, at the final stretch, the kind of practical pragmatism which, ironically, has always been held up as a positive British contribution to EU proceedings. I am also very grateful that the British negotiators went to the trouble of making some time to share and discuss matters with the One Nation Conservatives caucus in recent weeks.
There is no time today to go into the details. Although today is a triumph for the Government and for the Prime Minister, it is not a triumph for Parliament because this degree of scrutiny is clearly pretty laughable. However, it is worth registering two specific points, both of which are things that need to be built on. The first are the security arrangements. It is hugely regrettable that the UK has had to leave the SIS II regime for exchanging information about criminals. I hope that we can negotiate some equivalent in the future. The second is obviously the need to improve matters for the financial services industry. The arguments have been well rehearsed already. I hope that the necessary rules can be agreed in the coming months to allow the industry to flourish, not just in the City of London but around the UK. That strong likelihood of further talks in the committee structure that the deal sets up is one of the reasons why the deal is worth supporting enthusiastically. With no deal, there would have been no chance of such sectoral deals. There would have been bad blood instead of what I hope will become the habit of close co-operation. I hope that fervently because in recent days my constituents have seen the effects of blockages and delays at the ports, and if this goes on too long they and I will be very unhappy.
What is needed now is a spirit of generosity both in our internal debates—too much of the Brexit debate has been full of bile, hatred and personal attacks—and, even more important, in our attitude to countries that are our neighbours, our allies in democracy and our friends. We can make today the start of a new relationship of good neighbours rather than surly housemates, so let us take the opportunity, support the deal and move on.

Commons ChamberI rise to oppose this motion with some sadness, as I recognise the hugely difficult decisions that Ministers have to make, and the many successes that my right hon. Friend the Health and Social Care Secretary and his team have brought about in recent months. As the first Member from Kent to be called in the debate, however, I would be failing my constituents if I did not register a strong protest about the way that the tiers have been applied, which feels arbitrary to many people.
I should say that I do not, of course, share the views of those who think that any restrictions are unnecessary, and still less those who think this is part of some great conspiracy. I want to see a balanced and effective approach to saving lives and jobs. I reject the idea that we have to choose between lives and livelihoods—of course we will save more jobs if we control the virus as fast as possible—and it is reckless and inhumane to argue that the death of older people is something that we should just put up with.
To be as effective as possible, however, the new tiered system needs wide public consent. In the end, we are all responsible for our own actions, so I want to see a system that encourages the most people to obey the rules for the largest amount of time. I put to the Prime Minister last week the thoughts of a constituent who said that if the Government impose stupid rules, people will stop obeying the sensible rules as well. This was sadly dismissed. Since then, the national debate has moved on to how big a Scotch egg has to be to constitute a substantial meal. I rest my case. I am afraid that what we have before us today fails the test of maximising voluntary public support. To be specific, it certainly does in my constituency, where I have had the most angry emails over a weekend since the Dominic Cummings trip to Barnard Castle.
The problem for us is the sheer size of Kent and the huge disparity of rates of infection between different parts of the county. There are rural areas in the south-west of the county with very low rates, which are many miles from the areas in the north-east of the county, where rates are indeed alarmingly high, and which absolutely need to be in tier 3. I am grateful to the Prime Minister for his indications earlier on this, but they are not yet quite a commitment.
I do not believe in simply whingeing, so we have suggested an alternative route to Ministers. We have said that, instead of putting an entire county or region into a particular tier, we should do it on a borough or district basis. I hope that this idea is being seriously considered in Government now. One advantage of this approach is that it would be more flexible for Ministers to decide to move areas between tiers, so this would give people some hope, given that only 1% of the population is in tier 1, that they might have more of their normal life restored quickly.
I have two more points. First, from my constituency point of view, what was the point of the second lockdown? The national figures are pointing in the right direction, but we entered it in tier 1 and leave it in tier 3. That is a puzzle for a successful policy, but if that is puzzling even more so is why it seems to have worked in every part of the country except north-east Kent. Genuinely, why is that?
Secondly, I urge Ministers to spend a lot of time and effort between now and Christmas urging people to be ultra-cautious in the five-day exemption period. We seem to accept it as inevitable that there will be another spike in January because of Christmas. I very much hope that that will not happen, because if we do we will have exchanged a weekend of fun for a long winter of regret to follow.
We can now see the glimpses of normal life resuming with the vaccine and regular quick testing. For us to reach that promised land as quickly as possible, the public need to give their full assent to the new measures. I very much hope the Government will come forward with some that do reach that public assent, but these proposals, I am afraid, do not achieve that, so I will be voting against them.

Commons ChamberAfter the tremendous news about testing and the encouraging developments on vaccines, may I welcome the news that the blanket national lockdown is ending? In the spirit of a wise constituent who told me that if the Government imposes stupid rules, we will all stop obeying the sensible rules as well, may I ask my right hon. Friend that the new tiers be imposed at a local level—districts, rather than counties or regions? Restrictions that people feel are unfair to their particular community will simply not be respected or obeyed, and that itself will have a damaging effect on our long-term health.
I am grateful to my right hon. Friend and for the wisdom of his constituent, but I respectfully disagree. The people of this country have been obeying the rules to an astonishing degree. It is thanks to the heroic effort of the people of this country in following the guidance and the recent measures that we have the R down in the way that we have and that we have got the incidence down in some of those areas where the disease was really taking off—if we look at the graphs, we see that in the north-west in particular. It is now starting to track down across the country. I have every confidence in the wisdom of the British people to follow sensible guidance and rules. On my right hon. Friend’s point about local versus regional, alas, the disease is no respecter of borough boundaries. We have to have some regions in which to constitute the tiers that are sensible and large enough.

Commons ChamberThe hon. Lady brings formidable expertise to this area, and she is absolutely right to highlight the fact that we need rapid access to both insulin and radioisotopes. That is why the Department of Health and Social Care and the Department for Transport have put in place contingency arrangements should there be any risk of disruption, but we are also confident that the steps we have taken more broadly will ensure that we have freight flowing freely between the UK and the EU, including in this critical area.
First, I should pay tribute to the Under-Secretary of State for Transport, my hon. Friend the Member for Redditch (Rachel Maclean), for her exemplary communications with my constituents who live near the Sevington lorry park; I am very grateful.
I still hope and expect that we will get a deal, but either way, may I ask my right hon. Friend how confident he is that the smart freight system will be fully operational by 1 January, and if it is not, what does he think will happen?
I join my right hon. Friend in praising the efforts of the Transport Minister, who has been incredibly energetic and determined to make sure that colleagues in Kent from all parties are kept informed on the progress of our preparations. The smart freight portal is being shared with hauliers and others as we speak. It is currently in its beta phase and we want to ensure that it is further refined, but the straightforward approach that it should provide should enable us to minimise any disruption that my right hon. Friend or his constituents face. I am absolutely confident it will be in place; if it were not, other measures would need to be taken, but they would not be as helpful as the smart freight system.

Commons ChamberI can assure my right hon. Friend that the so-called Saxon wall on the Ashford site is in fact a myth: it is not Saxon and it is not holding up work.
The prospect of 7,000 trucks queuing to cross the channel will send a chill through my constituents, because we know the disastrous effect that has on all the roads in Kent. I very much support my right hon. Friend in his work to prepare the road haulage industry for the end of the transition period, but may I ask about the Government’s own preparations and specifically the smart freight system that he mentioned, which is essential for the smooth running of traffic across the channel? Can he give a guarantee that that system will be fully up and running and operational from January?
My right hon. Friend makes a number of very important points, and I am grateful to him for clearing up the point about archaeology, which I failed to address in my response to the hon. Member for Leeds West (Rachel Reeves), but his expertise in this area is greater.
My right hon. Friend is absolutely right that we want to avoid the level of congestion that this reasonable worst-case scenario sets out, and he is also absolutely right that that requires people to work together. It requires not just the haulage industry, but in particular those goods exporters who commit goods to haulage to be ready in time. Part of that is the smart freight system, which has been developed and is being shared with business. We want to make sure that people use a relatively simple process to get what will become known as a Kent access permit, which means that they can then proceed smoothly through Kent because they have the material required. If they do not have the material required, through policing, ANPR cameras and other means, we will do our very best to ensure that his constituents are not inconvenienced.

Commons ChamberThe hon. Lady talks about migration. It is the case that Scotland will benefit, as the whole of the UK will, from a points-based system that ensures that we can have top scientists in Scottish universities and gifted clinicians in Scotland’s superb hospitals. She also refers to an opinion poll. Of course, we had a vote on whether Scotland should be independent in 2014. As it happened, slightly more than 54% of people voted for the United Kingdom to stay together and to be stronger together. We were told that was a once-in-a-generation vote, and I know that that promise will be honoured.
My right hon. Friend may be aware that I consider the decision to put an outbound emergency lorry park in my constituency, near where several thousand new homes are being built on one side and with a large hospital nearby on the other side, to be wrong-headed. Can he confirm that when the Transport Minister writes to me that it is not the Government’s plan to develop this area as a permanent lorry park, that is indeed Government policy, and will he let the House know what environmental impact assessment has been done for the site?
I am grateful to my right hon. Friend, who does a brilliant job standing up for his constituents. It is not the case that any specific site has been absolutely confirmed. We are in commercial negotiations with a number of sites, and as and when they are confirmed I will let him know. It is also the case, as he rightly points out, that some of the infrastructure will be temporary and some will be permanent. May I extend to him and to all Kent Members of Parliament an opportunity to come into the Cabinet Office to discuss with me and officials the approach that we are taking? I hope that I can provide him and other colleagues with reassurance in that process.

Commons ChamberThe right hon. Lady knows very well that the Government have invested record sums in protecting businesses, by comparison with any other country. We have done more to protect businesses around the whole of the country, including in Wales. I said that we are proceeding as one UK, and we are. I have my doubts about the 5 mile rule in Wales and wonder whether that might be something that was reviewed. But she makes a very important point about the need to protect against a second outbreak and to make sure that we are in good shape to crack down on flare-ups. I believe that we are and I believe to an extent that perhaps we did not think possible a month ago we are able to do local whack-a-mole in the way that she has described.
May I congratulate my right hon. Friend? This announcement, particularly the reduction of the distancing rule, will save hundreds of thousands of jobs, so he has already done a good day’s work today. May I ask him to ensure the practicality of future guidance? Complex rules about who can do what and where and when they can do it may seem rational when discussed around a table in Whitehall, but if they are too complex and too unclear, people will not obey them, so can he make sure that the rules for the future are as clear, simple and understandable as possible?
My right hon. Friend is entirely right. A message such as, “Stay at home. Protect the NHS” is very simple. Everybody can see what they have to do. Getting into the easing of the lockdown is much more complex, but I think that the guidance that we have set out today is intelligible. People will understand what they need to do. The British people have shown massive common sense so far and I am sure that they will continue to do so.

The short answer to the hon. Gentleman’s question is no. The longer answer is that he, too, should be careful about what he says. If he wants to hand out prizes, perhaps he might look back to the days when Alex Salmond, formerly of this parish, used to routinely exclude journalists from his briefings. There is a tinge here, Mr Speaker, of people who are not willing to look at their own record before they come here and prance around with a few too many adjectives.
The other thing I would add is that we on the Government Benches, like others in other parties, are proud Unionists. We recognise that there are national broadcasters that deal with all parts of our country. Long may that last.
There clearly do need to be better arrangements for lobby briefings than was the case yesterday, but I detect the faint air of fake outrage. When I was a journalist, I regarded it as my job to talk to the people who could tell me what I needed to do to provide the story. Indeed, when I was a Minister, if I wanted to talk to individual journalists, there were ways of doing so that might be useful to me and to the individual journalists. I agree with the Father of the House that there need to be improvements in the system, but does my hon. Friend the Minister agree that what we are seeing here is some fake outrage and a mass outbreak of snowflakery?
I am grateful for that view from a senior Member of the House. My right hon. Friend is correct: what we are seeing here is a very normal operation whereby a specialist briefing is offered. That is a good thing, and we are doing that to support the other ways in which we are already an extremely open and accessible Government, providing briefing and access through a range of channels so that people can be well-informed.

Commons ChamberThank you, Mr Speaker; I hope to give some time back to the House by being very brief. All I want to do is to try to put today’s debate and Bill in their wider context, because they are so hugely important to the future of this country.
I simply want to make two points. The first is that those of us who voted and campaigned for remain should respect the result of the referendum. Some of us tried to do that straight afterwards. We took the view that the British people had taken a decision and that those of us on the losing side of the argument should make the best of that—do what we regarded as the best for our country in the context of leaving. Sadly, many people on whose side I fought in that referendum campaign did not take that decision and have spent the past three and a half years trying to subvert it. I have thought throughout that, sadly, that was the wrong course for them to take.
A lot of the problems that we have faced in politics in this country for the past few years stem from that wrong decision and the desire to continue fighting the last war. To those of my friends on both sides of the House who until now have not accepted the 2016 decision, I make an appeal: now, after the general election result, please accept the decision, please let us move on and please accept that that game is over.
I will of course give way to one of my comrades in arms in that referendum.
I think that the right hon. Member is in danger of rewriting history. Those of us who wanted to go back to the people were not undermining democracy —more democracy does not undermine democracy. What does undermine democracy is a Bill that is essentially an Executive power grab, completely deleting all the provisions that would have allowed for parliamentary scrutiny. If he is standing up for democracy, will he explain why is he happy about a Bill that is reducing democracy?
I do not agree with the hon. Lady’s analysis of the Bill. Furthermore, it is impossible to say that we need a new referendum when we have not implemented the results of the first one; that has been the central problem. I urge her and others to use all the energy and passion at their disposal to help us as a country to forge a new friendly relationship with our fellow democracies in the rest of Europe. They are neighbouring countries, they are friends and they are democracies: we should be able to establish a new and friendly relationship with them. That is my first point—an appeal to those who campaigned to remain.
My second point is an appeal to all those on both sides of the argument. We have to stop defining ourselves and each other simply as remainers or leavers. If we continue to define everyone purely by how they voted in 2016, we will never make progress as a Parliament or a country. The last few years have been miserable for democracy in this country.
My attempt to be brief is clearly being foiled, but of course I will give way.
Does the right hon. Gentleman think that his party’s conduct in the general election is consistent with the test that he just set?
Yes, I do. In a sense, it is less important that I think that than that, as is quite clear as I look at this House today, the British people think that. I do not think that that is a fruitful avenue for the hon. Lady to pursue.
As I was saying, the last few years have been miserable for democracy in this country. The more we hark back and fight the old battles, the longer that misery will persist. I hope that this Bill, this debate and the fact that we will have left by the end of next month mean that Members on both sides of the old European argument and both sides of the House take the chance to move on, so that we can begin the healing process that this country desperately needs.
