Lords ChamberMy Lords, this has to be not only across government but across the whole of civic society and public authorities if we are to enhance the environment. I have plenty of examples of where other government departments are working very constructively and successfully, whether it is the MoD, the MoJ, HMRC, DWP, the Environment Agency, the Forestry Commission, Natural England or county councils; all of them are working very strongly on biodiversity. We have clearly got to do more, but I reassure the noble Baroness that this has to be across government because that is the only way we will actually enhance the environment.
My Lords, I was a member of the House of Lords Select Committee on the Natural Environment and Rural Communities Act 2006. In our report, we supported strengthening the biodiversity duty. We also recommended that it was combined with a reporting duty. Will the Minister say what plans the Government have for improving the transparency of the way in which the duty is carried out?
My Lords, the noble Countess is right that, as the Government implement, with others, our 25-year environment plan, we will build on existing reporting mechanisms to drive further improvement. Some of the priorities set out, including the condition of our protected sites and the creation and restoration of wildlife-rich habitats, are already under a reporting duty, but we will work on how we can take forward an enhanced reporting mechanism.

Lords ChamberThat is precisely why we are working on it. The noble Lord is right: we want to have a consistent, clear and easy to understand range of products—the widest range of products—that are recyclable. It all goes back to the need to enhance our environment, and that is part of that work.
My Lords, does the Minister agree that the state of the verges on our major roads and motorways and on railway embankments is something that we should all be ashamed of, particularly when a lot of tourists use these routes? When I asked previously, I was told that health and safety stopped people from picking up litter on major roads. Is there any way that we can overcome this and ensure that our roadsides are kept clean?
I agree with the noble Countess that our roads are not a good advertisement. That is why we have been working with Highways England. Highways England has been working on 25 particular hot spots that are really bad—indeed, nearly 20,000 bags of litter were picked up in the Great British Spring Clean. We need to do more on that and more on working with the highways network and the railways. That is why I am pleased with the Keep it, Bin it campaign. It is all to do with working with many different bodies to ensure that the message gets about that it is not acceptable to drop litter.

Lords ChamberMy Lords, in a number of earlier replies I suggested that work on this is ongoing. A considerable number of farmers across the land are involved in tests and trials, which will be rolled out. In providing public money for public benefits, we need to ensure that they hit the optimum. Obviously, the farmers want the optimum, but in the investment of public money, we also need an optimum in terms of the restoration and enhancement of the environment.
My Lords, the Minister mentioned minimum till in an earlier answer. This frequently involves the extensive use of roundup. Can he tell the House what research is being done on the effects of roundup on the micro-organisms, which are so important to the development of good soil?
The noble Countess is right that part of min-till or no-till is that glyphosate is required because of the accumulation of weeds. We in the department will always act on the best independent scientific evidence available, and glyphosate is on the market because it is deemed safe.

Lords ChamberMy Lords, I declare my interests as an honorary associate of the British Veterinary Association and as someone who has been breeding animals—and every now and again a dog.
I take it that this legislation will prevent anyone other than a breeder from selling an animal under six months. That will tidy up many of the pet shop problems which we all regard as serious.
I hope my noble friend the Minister will be able to clear up a couple of matters. He and the Secondary Legislation Committee have said that local authorities will have to enforce these regulations, and my noble friend Lady Byford asked whether they would get any financial assistance to do so. The BVA is asking that anyone using a dog for breeding should be registered with the local authority. What is the Government’s view of this proposal? Will it be left to local authorities to enforce?
The 2018 regulations are to do with animals as pets. Can my noble friend clarify whether this could also include working dogs? We have had to go through the question of the docking of dogs’ tails, and in Scotland it has been allowed that working dogs do not have to have their tails docked. I am thinking particularly of working dogs—shepherding dogs, and possibly shooting dogs too, but I am more familiar with shepherding dogs. They are often bred by a working shepherd who does not want the job of rearing them. Some people are well known as good-quality rearers and will take the young dogs and bring them on. The dogs will be outside the scope of the regulations because they will be over six months old, and at that stage they will go to somebody who will train them. It is possible that someone could be hired to do that job but at present there is a turnover of animals in this area. I would be interested to hear whether there is any possibility of the regulations covering working dogs.
My Lords, what is the position regarding inspectors? I ask that because I was approached by a young man in our local authority who has birds of prey and various wild animals that he takes to shows. He applied for a licence and was told that it would cost him nearly £1,000, but friends of his in neighbouring local authority areas are being charged between £150 and £400. I inquired of the chief executive of our local authority why this was and he told me that it was because it had no inspectors up to level 3 and that a veterinary inspection would be required. I then checked and was told that there were very few training facilities taking inspectors up to level 3—in fact, there is only one—and the courses are fully booked months ahead. In addition, they cost £900, according to the chief executive. Will the same thing apply to people who want a licence for puppies and kittens? Will they be charged for a veterinary inspection because there are no level 3 inspectors? If not, what will happen?
My Lords, perhaps I may comment very briefly. First, I commend these regulations, along with the deep personal commitment that my noble friend has always shown to improving the welfare of our country’s cats and dogs. Secondly, is progress being made towards the legislation that will raise the maximum penalty for animal cruelty from the present derisory six months to five years? Northern Ireland has already introduced five years as the maximum penalty, and I think that England needs to be brought into line as fast as possible with that other magnificent part of the United Kingdom. My noble friend is aware of the deep importance that the wonderful organisations that work for the welfare of our country’s cats and dogs attach to the raising of the penalty. If he has some progress to report, I know that they will be very pleased to hear it.

Lords ChamberMy Lords, I declare that I have also had some losses on rape crop this year due to flea beetle, so I understand the noble Lord’s point. We have supported tough restrictions on neonicotinoid pesticides, for instance, following scientific advice. The overriding principle is that we have to sustain the environment, because it is the environment from which our food is grown. We will always act on the best scientific advice. We have a UK Expert Committee on Pesticides. Research is important, as it helps us to find better alternatives.
My Lords, does the noble Lord agree that it is not just farmers who should look after insects? Every single person who has a garden should do so, by planting plants which attract insects and stopping concreting or tarmacking their front gardens.
My Lords, I entirely agree. That is why the department has supported the Bees’ Needs campaign and why Carnaby Street was renamed “Carnabee Street” last year. The owners of the street put up 720 window boxes to attract pollinators to our capital city. We all need to do something like that, whether with allotments, gardens or window boxes, or on large estates and the state estates. We need to do more to encourage the insect populations.

Lords ChamberCertainly, the “polluter pays” principle is very current, and this is obviously why we are consulting on the environmental principles and governance issue. The draft legislation on that will be published before Christmas, along with consultation results. It is important that everyone, wherever they are, concentrates on reducing pollution. That is of course one of the great advantages of riparian buffer zones of a certain dimension, because you get an enhanced advantage from that.
My Lords, I declare my interests, as in the register. While I entirely endorse what the Minister said about improving the environment, could he please make sure that the waterways themselves are kept clear to prevent flooding? When riverbeds become swamped with weeds and things, the water will not flow through and away, which causes flooding.
The noble Countess raises an interesting point about pollution and the growth of algae and so forth in watercourses. Clearly, there is a balance to all of this, because part of the use of natural capital is indeed slowing the flow. The noble Countess is absolutely right that we need to ensure that watercourses are positioned so that there is a proper flow of water, but we also need to be mindful of the slowing of flow and the use of natural capital.

Lords ChamberThe noble Lord has again highlighted why they should be properly used. I have the instructions for Roundup, which should be properly adhered to in order to ensure the safety of people using it. It is really important for coping and dealing with Japanese knotweed, which is one of the most invasive plants. That is why in many instances, when used properly, we need this material.
My Lords, I remind the noble Lord that glyphosate was initially registered as a very powerful chelator, which means that it blocks out essential minerals and elements from plant systems. Secondly, it was registered as an antibiotic, so it kills off micro-organisms in the soil. Thirdly, it was registered as a weedkiller. All those factors have an effect on what we eat every day. Finland, which has a no-till policy using glyphosate, has found that over the last three years crop levels have fallen, and that there has been an increase in infertility in men and women. Will the noble Lord bear that in mind when recommending the ubiquitous use of Roundup?
We all need to use pesticides responsibly and carefully—all farmers are conscious of this—and we want to move to a position where we use them less, but we do need to use them. I say again that the EU, the European Food Safety Authority, the European Chemicals Agency and our own, very well respected agencies, have all said that glyphosate is considered safe to use.

Lords ChamberMy Lords, on this side of the House we believe in localism; we believe that local communities and local authorities are the best people to look after these matters. But we think that there should be consistency, precisely to ensure that as much as possible can be recycled and that there is clarity for residents and businesses about what can be recycled. It is in all our interests that we reuse and recycle more; I do not believe that that symbolises the nanny state.
My Lords, there is a serious problem with the recycling or disposal of larger household items, such as carpets and furniture that have had flame-retardant chemicals put on them. Many of these chemicals have now been banned, but the furniture is still in use or needs to be disposed of. The current flame retardants contain organophosphates, and I know quite a lot about them. What advice is given to people who own these items of furniture and carpets about disposing safely—I repeat, safely—of their materials?

Grand CommitteeMy Lords, I was about to refer to the noble Baroness, Lady Byford, as my noble friend—we have been friends for such a long time, even though I am independent and she is a Conservative. She touched on something that is absent from this statutory instrument, which is the breeding of cats. Just as with the dogs that the noble Lord, Lord Trees, mentioned, you are getting cats with flat faces, because they are attractive to people who think that they look like babies. It is a real menace in the cat world and should not be allowed. Many people acquire cats—we have two farmhouse-bred moggies. Cats living on farms have litter after litter, and I feel that there needs to be some regulation on spaying or castrating them so that we can reduce the overall number of cats and breed nice, healthy animals—like ours.
My Lords, I just want to say a few words. First, I declare that I am a member of a local authority. I welcome the new regulations on minimum welfare standards. I hope that we will have tough customs checks when puppies come into the UK. I also welcome the important provisions on streamlining, enforcement and full costs for local authorities. As previous speakers have said, this is an opportunity to stamp out unscrupulous, back-street puppy farms, which should be banished as soon as possible.
My second declaration is as a dog lover: I have dogs and I love them dearly. I agree with the comments made by the noble Earl, Lord Cathcart, on the breeding of dogs, under Part 5 of Schedule 1. I acknowledge the move from five to three litters, but I think that if something is a business it should be licensed, even if there is only one litter. It is a commercial enterprise and obviously it is going to make a profit. Instead of having it go down to three, it should be one. If it is a commercial enterprise it should breed a litter to sell. It is a business. Could the Minister clarify that for me?

Lords ChamberMy Lords, I have just come back from Kew; I presented the Bees’ Needs awards to primary schools and many other organisations, including large landed estates. The National Pollinator Strategy and the national plan on pesticides are designed to include the sustainable use of pesticides. The most important message of all is on the sustainable use of pesticides. Pesticides used in the right way are very important for agricultural production and for many of the things we want to do in urban areas, too.
My Lords, I readily acknowledge the improvements that have been made in pesticide applications over recent years. However, does the Minister agree that pesticides are effective not only on the day that they are sprayed but continue to off-gas for quite some time, especially in hot summer weather? People living in the locality of fields that have been sprayed have not been consulted—there has been no bystander consultation. Is he aware that with Roundup, for example, there is no check on the soil or water effects?
Again, my Lords, the regulations are strong, as it is essential that there is no harm to people or the environment. One thing we are working on in our 25-year environment plan, which is all about enhancing the environment, is the importance of soil health and fertility. It is very important that pesticides are used sustainably and that, wherever possible, we can reduce their use.
