Lords ChamberMy Lords, I am absolutely delighted to add my name to this suite of amendments in the name of the noble Baroness, Lady Suttie.
These amendments clearly have a specific purpose. First, I believe that full recognition needs to be given by your Lordships’ House and the UK Government that the Good Friday agreement is the bedrock upon which all institutions are based and out of which they emerged. It includes three strands: the Northern Ireland Assembly and the Executive; north/south; and east/west.
Devolved structures and the power of the MLAs must be recognised, acknowledged and reflected, and their mandate must be so acknowledged. They must be allowed to have an accountability role. If this Bill becomes law and results in the limitation of the protocol, your Lordships should remember, as the noble Baroness, Lady Suttie, said, that a majority of MLAs elected in early May wrote to the then Prime Minister, Boris Johnson, indicating their opposition to the provisions in the Bill.
It is important, as I said, that the UK Government recognise that the majority of Assembly Members support the protocol, with refinements. They believe, as I do, that mitigations are required and, most importantly, they want the restoration of political institutions, particularly after Friday’s very odd press conference, given by the Secretary of State in the middle of Chichester Street in Belfast with onlookers walking past. An election will serve no purpose whatever. We would probably end up with a more polarised outcome in Northern Ireland and it will not have served its purpose.
The view of Assembly Members was also reflected in a recent poll by Queen’s University Belfast, which stated that 51% think that the protocol is having a positive impact on the Northern Ireland economy. Immediately we see the evidence of our divided society in Northern Ireland—63% think that it offers opportunities that could benefit Northern Ireland and 60% think the same about its impact on British-Irish relations. There is a fear that the UK Government are not operating or proposing a consensual approach through this Bill and are recognising only the views of unionists. Arrangements work in Northern Ireland only when they have the buy-in of unionists, nationalists and the non-aligned, and that is not possible under the provisions of the Bill.
We have no political structures operating at the moment, with no impetus from the Government to have them up and running. I hope that this week’s discussions between the Secretary of State, the political parties and the Irish Government will produce better outcomes and a better trajectory of travel. People do not want direct rule; they want their own Government.
Elections will not provide the answer, as the default legal position allows. Designation of Joint First Ministers should have been allowed. That would have obviated many of the problems currently being experienced. I hope that if there are negotiations and there is a review of the institutions, this issue comes back into; the Minister will recall this item being discussed in debates on the Elections Bill. It is worth noting that, very sadly, institutions have operated only at a very low percentage in the last 24 years. There is a need to end the inherent sectarianism that was ushered in by the St Andrews agreement in 2006-07.
It is also important to remember that the poll from Queen’s University told us that 65% of the Northern Ireland Assembly agree that the Northern Ireland Executive should be fully functioning regardless of what happens with the protocol, while 32% disagree. Broadly, these figures represent the political support and opposition in the Assembly in relation to the protocol.
The protocol should not have prevented the restoration of all the institutions. Noble Lords will become very angry when they realise that there are important issues for many people, such as the cost of living, the cost of doing business, and health waiting lists and getting on to these. It is worth noting that, at the evidence session during the protocol sub-committee’s visit to Belfast two weeks ago, young people who were there as community representatives viewed health waiting lists and the cost of living as much more important than the protocol.
The bottom line is therefore that the GFA standard, in all its strands, must be adhered to and protected. The pathway to that includes the need for all-party talks to resolve the outstanding issues. Rather than having a potential election, there must be renewed vigour in the UK-EU negotiations on the protocol, not only on the technical aspects but with the political negotiations that are urgently required. My fear is that any election process could stop the political negotiations. There has been a renewed focus on the technical, and it is important that renewed focus is given to the political.
I support the amendments in my name and that of the noble Baroness, Lady Suttie. I urge the support of your Lordships’ Committee. The accountability mechanisms in the Northern Ireland Assembly must be recognised and adhered to if this Bill is passed. They must be given their say, because the vast majority of Assembly Members elected do not agree with this Bill. They would prefer that it were not on the table and that the Government removed it.
My Lords, Harold Macmillan, that great Tory Prime Minister, had a quotation on his desk or wall—I forget which—by WS Gilbert:
“Quiet, calm deliberation disentangles every knot.”
If there were ever a need for this, it is now, on the issue of the Northern Ireland protocol: a treaty negotiated by a British Prime Minister and one of his colleagues, who is present this afternoon; commended to both Houses of Parliament; and given support—with a degree of reluctance, because many of us realised that it was far from perfect.
I understand why my noble friend Lord Howell of Guildford made the brief point he made before he left the Chamber. I believe that we are wasting our time in a prodigal fashion. To quote the noble Lord, Lord Reid of Cardowan, many years ago, the Bill is not fit for purpose. It never will be, however many amendments we pass on the Floor of your Lordships’ House.
We have all agreed that there will be no call for Divisions in Committee. Colleagues on both sides of the Committee know that I would have liked to have a vote to pause proceedings at Second Reading. However, it was conveyed to me that the Labour Opposition were not prepared to support that, and it would not have been right for me to go ahead when I clearly did not have strong support in all parts of the House.
We are now in an Alice in Wonderland situation where a series of amendments—the noble Baroness, Lady Suttie, moved her amendment eloquently and persuasively—are not going to change the fundamental nature of the Bill; they are not going to make it acceptable. So this charade is going to continue through today and two more days, and then the Bill will go to its Report stage. I beg my noble friends on the Front Bench: for goodness’ sake, pause it there at least, so that negotiations can take place without any implicit threats over our European friends and neighbours. I deliberately and repeatedly call for that. Let us have those negotiations, and let us hope that they are entered into in good faith on the both sides.

Lords ChamberMy Lords, I speak in support of Amendment 152 in the name of the noble Lord, Lord Whitty, and colleagues, and Amendment 254 in the name of the noble Baroness, Lady Bakewell, regarding the use of pesticides and their impact on the environment. I vividly recall similar debates last year in Committee and on Report during the passage of the Agriculture Act.
I believe, like the noble Lord, Lord Carrington, that there has to be a level of proportionality and balance, but I live in a rural area and I know what it is like to be impacted by the use of pesticides. There is a clear need for a pesticide management plan, because there has been an excessive use of pesticides, which have been damaging not only to the pollinators, as expressed through Amendment 254, but to human health and the environment, as conveyed by Amendment 152.
Amendment 152 is a cross-party piece of proposed legislation and is crucial in that its focus is the protection of human health and the environment in rural areas by prohibiting the use of agricultural pesticides near specified areas and the vulnerable groups within them, such as rural residents’ homes, schools, childcare nurseries and other healthcare facilities. As detailed in the UK Pesticides Campaign’s submission to the Public Bill Committee, it is highly noticeable that, although human health and the environment are inextricably linked—particularly when it comes to the use of agricultural pesticides—and the Environment Bill includes priority areas for regulations to be set, including in relation to air quality and the listed air polluting impacts, there appears to be a total omission of any requirements for the protection of human health and the environment from agricultural pesticides. Quite clearly, a level of balance and proportionality is required in the use and the location of pesticides.
As it stands, the Environment Bill does not appear to recognise in any capacity or even have any specific reference to pesticides, when in actual fact they are the biggest contributor of damage, pollution and contamination of the air, soil, water and overall environment in rural areas. The UK Pesticides Campaign asserts that the existing pesticides standards here in the UK fail to protect human health and the environment in rural areas.
Because improving air quality is a major public health issue, long-overdue regulations for the protection of human health and the environment from agricultural pesticides now need to be set in the Environment Bill, most importantly for the protection of the health of rural residents and communities—hence the need for Amendment 152 to be put on the face of the Bill, as the noble Lord, Lord Whitty, outlined.
Furthermore, on Amendment 254, the reality of crop spraying in the countryside is that it involves the dispersal of innumerable mixtures and cocktails of pesticides sprayed on crops, so the critical point about the exposure of any species—whether it be humans or bees and other pollinators—is that it will be to mixtures of different pesticides.
There is also the risk of adverse impacts on bee health from the cumulative effects of multiple exposures to mixtures of different pesticides. The only way to properly protect bees and other pollinators is to prohibit the use of such harmful pesticides in rural areas. Maybe another way to address this issue would be if farmers were allowed to set aside greater areas that were fully covered by all the subsidy schemes.
The Soil Association wants to see a different approach to farming and the use of pesticides. It believes that the Government and society should support UK farmers to transition to whole-farm agroecological systems, ensuring that there is no lowering of environmental or health standards as a result of any new trade deals, and that they should introduce a clear quantitative target for significantly reducing the overall use of pesticides in agriculture.
Therefore, pollinators must be protected from pesticides as Amendment 254 requires. I look forward to the response from the Minister and I hope that he will see fit to accept both amendments to ensure that our environment, our natural life and biodiversity and the human health of individuals in rural areas can be protected from the harmful impacts of pesticides.
My Lords, it is very good to have the noble Lord, Lord Whitty, in the Chamber. He has been very active on the screen but there is no substitute for being here in the flesh. I very much hope that it will not be too long before we see the noble Baroness, Lady Ritchie, here too. She also has been very assiduous in taking part in debates and making her contributions, but I ask her to come here if she possibly can, please, because that is what proper debating is about.
My heart is entirely with those who have moved these amendments, but we owe a great debt of gratitude to the noble Lord, Lord Carrington, for making this a proper debate. I was a Member of Parliament for a rural constituency for 40 years. I got to know many farmers and many of them became close friends. A person I would like to quote is perhaps the greatest countryman I have ever known. Some of your Lordships may remember Phil Drabble and his programme “One Man and His Dog”—he was its originator—but he was far more than an accomplished shepherd. He had his wilderness, about which he wrote books, which was a wonderful corner of Staffordshire with the second largest heronry in the country. I often used to talk to him about these things. He used to say to me, with his inimitable burr, which I will certainly not try to imitate, that it is a question of getting the balance right.
Nobody could dispute that pesticides are indeed poisonous, as my noble friend Lord Randall said, or that their indiscriminate or careless use causes enormous damage. It is right that colleagues in this debate should point out some of the dangers—the noble Baroness, Lady Bennett of Manor Castle, was particularly forceful on this. It is also very important indeed that the dangers to pollinators should be properly recognised. Without pollinators there is only one end, which is extinction, and we have to be conscious of that. But the noble Lord, Lord Carrington, was right when he asked us to consider whether the current regulations are adequate. He came down on the side of saying that they were. I am not absolutely convinced, but we have stringent regulations and, although one case of poisoning through pesticides is one too many, there have not been enormous numbers and we have to bear that in mind.
The Minister, who will reply in a few moments, is, as someone said a little while ago, someone with a good track record in this field. I hope that he will bear in mind that your Lordships’ House—as the noble Lord, Lord Whitty, and several others reminded us—voted for a similar amendment during the passage of the Agriculture Act. I well remember the debate and the graphic and gruesome examples that the noble Lord, Lord Whitty, drew to our attention. But, at the end of the day, farming is there for one overriding purpose: to produce the food to feed the nation.

Lords ChamberMy Lords, I, too, support the amendments of my noble friend Lord Lindsay and the noble Lord, Lord Teverson. I will just add one or two brief points.
First, my noble friend Lord Lindsay talked about clarity and cohesion. I would add another “C”—consistency. If we are to have a landmark Bill—and this must be a landmark Bill—it is clearly important that we get it right as far as we possibly can. During this dreadful year of the pandemic, when the Government—and I am not scoring cheap points—have been fighting something literally unprecedented in the last century, a degree of confusion has been caused by a lack of clarity, consistency and cohesion. I do not want to stray from the Bill into recent events, but we have seen how people have been uncertain, often, about what the Government are really seeking to do.
It is crucial that when this landmark Bill reaches the statute books—as I, of course, hope it will—it is in a significantly better shape than it is at the moment, good as it is. Therefore, while I would like to see the Bill on the statute book by 1 November, what matters far, far more than any artificial timetable is that this Bill is right. Whether it goes on the statute books on 1 November, 1 December or 1 January matters far less than that it is right. You have only to mention the words “Irish protocol” to realise that if you negotiate to a strict and artificial timetable, you often get it wrong.
I referred to my noble friend: he chaired the Environment Sub-Committee of the EU Committee—on which I had the good fortune to sit—extremely well. The noble Lord, Lord Teverson, also made some very telling points. We have to realise that we are in this sixth crisis; we have to realise that many species are on the brink of extinction. This year, in our small but quite attractive urban garden in Lincoln, we have hardly seen a butterfly. Talking to friends around, I have heard of similar experiences. I read in the Times this morning, coming up on the train, about the lack of Arctic terns in Northumbria—an extraordinary bird that commutes 14,000 miles a year. There is a very real danger to its survival as a species. There are so many things that the Bill can help to underline and combat, and it is essential that it does.
With those few words, I endorse both my noble friend Lord Lindsay and the noble Lord, Lord Teverson, in what they are seeking to do. Although in Committee we are mainly probing, it is essential that the Bill finishes Report in this House in as near a perfect state as it is possible for us to make it.
My Lords, it is a pleasure to follow the noble Lord, Lord Cormack. I am speaking in support of Amendment 2 in the names of the noble Lord, Lord Teverson, and the noble Baronesses, Lady Jones of Whitchurch, Lady Jones of Moulsecoomb and Lady Bennett of Manor Castle. Clearly, the amendments in this group seek to improve the Bill’s environmental objectives by statute, and that is laudable of them all. But Amendment 2 sets a tone for the Bill, as outlined by the noble Lord, Lord Teverson, who indicated the need for an assessment and provided a very good assessment of the current state of biodiversity in Cornwall, which could quite easily be mirrored in other parts of the UK.
The Bill needs to have the purpose and declaration of biodiversity and climate emergency specified in it on an equal basis. It is particularly pertinent to set this in legislation if the Government are serious about the need to protect and nurture our unique biodiversity and to mitigate the problems that the climate emergency is bringing to our planet, with increased levels of flooding, the warming of our planet, and the weekend warning that we now have Mediterranean UV levels in the UK. To take the example of Belfast, Department of the Environment statistics show that on 13 June last week, UV levels reached 9 on the solar UV index. This is due to a number of things, including stratospheric ozone depletion, the position of the sun in the sky at this time of year, and the lack of cloud cover. That is one reason why Amendment 2 is so important and why it must be included in statutory form in the Bill in order to give both areas of climate emergency and biodiversity equal status.
I honestly believe that the PM must take charge of the situation. This amendment provides for him—or for whoever is the postholder—to declare that there is a biodiversity and climate emergency both domestically and globally. It will strengthen the governance regime and give strength and toughness to the need for governmental action to protect our biodiversity and to protect our planet from the climate emergency. It is so important that we agree to do this with COP 15 and COP 26 taking place this year.
As the Aldersgate Group—which supplied us with a briefing—stated, the Environment Bill is a vital opportunity to establish a new, ambitious and robust governance framework that protects and enhances the natural environment. What better way to do that than to ensure that the Government accept an amendment to the Bill which provides for the Prime Minister, with statutory effect, to declare that there is a biodiversity and climate emergency both in the UK and globally and, above all, to enhance and strengthen the Bill to ensure that it becomes an even greater landmark Bill with the legislative teeth to act in such urgent circumstances.

Lords ChamberMy Lords, I am happy to support the amendments in this group and will refer particularly to Amendment 156, in the name of the noble Lord, Lord Cameron of Dillington. For me, as somebody from Northern Ireland, this amendment resonates with our whole rural development approach. Through the rural development programme within the European Union, many rural communities benefited from the LEADER programme. It allowed farmers—and farming families—to supplement their income through like-minded industries such as crafts and other types of revenue-making businesses. It also helped the rural community to survive and ensured that those people were retained there, thus creating vibrant farm enterprises. It was a particularly good model. I would like to hear the Minister say how it is to be translated and transposed, through the Bill, into the local economy of England and Wales. What discussions have been held in the ministerial and officials’ group with the devolved regions about how it is to be translated on the ground, so to speak?
It is very important that productivity and employment in rural areas are underpinned so that farming families survive on the land. It is also important that we provide for sustainable farming enterprises, while recognising the difficulties that such households can face during unplanned-for crises, such as the pandemic at the moment or floods. We have witnessed many horrendous floods, which the science would suggest are a consequence of climate change. The amendment from the noble Lord, Lord Cameron, recognises the function of farming households in the countryside. It recognises that they are the pivot in the farming enterprise and of the rural economy.
My Lords, I am delighted to support all three of these amendments. I am probably the least qualified of all in your Lordships’ House to talk about broadband. Even during the previous debate, I lost the picture on my screen and without the Digital Support service would not have been able to regain it. But I accept all that the noble Lords, Lord Holmes and Lord Clement-Jones, have said; they made persuasive speeches and clearly have my support. I hope they will have the support of the Government.
I want to address my brief remarks to the amendments spoken to so eloquently by the noble Earl, Lord Devon, and the noble Lord, Lord Cameron of Dillington. As someone who represented a rural constituency for 40 years in the other place, what they said rang true in every possible way. We must have not only a properly sustained agricultural industry in this country; we also need the rural support industries, of which they both spoke so eloquently and persuasively. I hope that when my noble friend the Minister comes to reply, he will accept the absolute necessity of what they called a ring-fenced rural fund because without it, there will be a bleak future.
We have all seen the devastation already wrought by Covid-19. It will take many in the rural communities much longer to recover than many of those in the urban communities. Businesses will have gone for ever; we need to keep all the businesses we can and add new ones. Most of all, we need young people who feel that there is a future in the rural economy. I give my total support to all three amendments and await with expectation the Minister’s response.

Lords ChamberMy Lords, I support both amendments in the name of the noble Baroness, Lady Jones of Whitchurch; I have added my name to Amendment 29. As the noble Baroness said, the purpose of both her amendments is to introduce requirements on the Secretary of State to build and sustain the UK fishing industry. They would also require the publication of a strategy for enhancing the safety of fishers and providing the necessary legal and training infrastructure. The amendments are supported by fish producer organisations throughout the UK.
For many coastal communities, the fishing industry, both onshore and offshore, is critical to their growth, development, job creation potential and local economy. In that respect, I remind noble Lords of the County Down fishing ports, about which I have already spoken to the Minister, where the fishing villages survive and thrive due to the prevalence of the fishing fleet and the fish-processing industries.
Allied with that, though, is a high level of risk and danger. Deaths of fishermen have occurred in the Irish Sea over the last 20 years. I think of one particular family from Kilkeel where a grandfather, a son and his son all perished on one night about 20 years ago. The fishing industry believes that there is a once-in-a-generation opportunity not only to revive those coastal communities and grow the region’s industry role as leaders in sustainable fisheries management but to ensure that this worthy profession is provided with adequate and up-to-date training; that incentives are provided to those who wish to engage in fishing as a profession; and that they are provided with the necessary qualifications in a safe environment to do so.
Take the example of the County Down fishing ports, where about 1,700 people are employed in fishing. I suppose on a proportionate basis, taken throughout the UK, that is not considered a lot. However, in those communities, it is, because fishing is vital to their revitalisation.
The Bill is about setting the future legal framework for fisheries management, but it is also right that Government, Parliament and industry consider how to grow and sustain the workforce needed if new opportunities are to be realised.
The three central themes of these amendments are to protect and enhance the safety of workers across the industry; to develop that modern legal and training infrastructure that helps to grow our domestic workforce; and to shape an immigration system that allows UK vessels to continue to recruit skilled non-UK nationals. I am mindful of the Minister’s written response on this issue to all of us who participated at Second Reading some three weeks ago, in which he said:
“We will prioritise the skills a person has to offer, not their nationality.”
I note that, through the prospective immigration Bill, Defra is working closely with the Home Office to ensure that there is a long-term strategy for the food, farming and fisheries workforce as part of the immigration policy. I hope that the Government will be able to accommodate skilled non-EEA fishers to contribute to the revitalisation of those coastal communities, as well as protecting and enhancing the legal and training infrastructure of all domestic workforces.
I believe that if our fishing industry is to recover and become the catalyst for economic regeneration in our coastal communities again, there is a duty on all of us, and on the Government, to work in a collaborative way with the industry and other relevant organisations to achieve that objective, which should be placed in legislation. That is why I support both amendments.
I have not participated in these debates, but I wanted to support this amendment because of the emphasis on safety. I do so, my Lords, for personal reasons. I was born in Grimsby just before the Second World War. Grimsby was in those days the largest fishing port in the world. The title was sometimes disputed by our friendly rival and neighbour across the Humber in Hull. Certainly, those two great fishing ports occupied the first and the second positions.
My family had generations in the fishing industry, coming down first from Eyemouth in the Borders of Scotland with smacks when the fishing industry was established around the middle of the 19th century. I was brought up to have great respect for those who went down to the sea in ships. That respect was reinforced by great sadness almost every year, because there was hardly a year when a trawler was not lost, often with the deaths of 20 or 30 men. This brought great grief, either to Grimsby or Hull.
As a young man growing up, I knew all this theoretically. But then, in 1965, I was chosen as the Conservative candidate for Grimsby for the election that in fact took place in 1966. For some 18 or 19 days in August 1965, I went on a deep-sea trawler and lived with the fishermen on board, and got up when the cod end was swung in and the catch was teemed on the deck. Although it was August, we faced at least one force 8 gale; we were also becalmed for a time. I saw the extraordinary skill, courage and resilience of the fishermen. You can understand it only if you have seen it at first hand. They were a wonderful bunch of men, marvellous comrades. The cook was not the most brilliant, but he had been a fisherman until forced to retire in his late 60s and then he became a cook. There was a wonderful spirit of camaraderie and there was great skill, but there was always great danger.
I became very sad when, following our joining what was then the Common Market, the fishing industry was certainly hit—I speak as one who was, as many of your Lordships know, a fervent remainer. If we are to revive our fishing industry, as I hope we will, it is tremendously important that we place emphasis on training and appreciating those who are trained. They have to be immensely strong, resilient and courageous, working at all hours of day and night and rarely getting more than a handful of hours of sleep. A revived fishing industry will depend wholly on those people. It is therefore right that we concentrate for a few moments on this issue and I feel it appropriate to give my words of support in this context.
