Claimants who receive certain benefits for caring or for a severe disability or health condition will not have their benefits capped. This ensures that the most vulnerable people are protected. Universal credit households are exempt from the cap if the household earnings are at least £604 each month. Households may also be exempt for a period of nine months, if they have a sustained work history.

My Lords, advances for universal credit claimants have to be repaid when claimants finally receive their benefits—after at least five weeks, and often very much longer than that. But their benefits will be well below subsistence level, due in part to the benefits cap, but also to the two-child limit, and to very tough rent and council tax rules. Could any Minister maintain their mental health in these circumstances? I absolutely could not—and I mean that. Will the Minister plead with her colleagues for urgent further changes—I understand that some have been made—to protect the mental health of universal credit claimants?

The noble Baroness makes an excellent point: these are very difficult times. People are struggling in all sorts of ways, and we are mindful of the impact of mental health issues. I am afraid that I am unable to make any commitments around the points that the noble Baroness made, but I will say that, in these very difficult times, nobody has to wait five weeks. Since 16 March, we have issued 700,000 advances, and the majority have received their money within 72 hours.

My Lords, a vast, hidden nightmare has developed for those who have suddenly found themselves penniless. I have five questions for the Minister.

First, what is the average waiting time for the very first advances to arrive from the date of application? Secondly, in these exceptional times, does the Minister agree that entitlement to universal credit should apply from day one of the application? Thirdly, in her letter, the Minister referred to the DWP addressing “system bottlenecks”. Will these simplifications of the system continue after Covid-19? Fourthly, the Digidentity system was identified by the Commons Select Committee as an absolute disaster that is delaying everything. Can the Minister assure the House that the issues will be addressed? Fifthly and finally, will she please inform officials that tax credit recipients who suddenly have no income should nevertheless continue to claim tax credits, or they could finish up with nothing?

My noble friend makes a very important point. I understand all too well that energy costs are an issue for single parents: my niece is a single parent, and the amount she pays for electric on a key is out of kilter with other methods. My noble friend’s point about energy costs is well made. I will go back to the department—they are going to love me when I get back—and then write to him to answer the specifics of his question, placing a copy in the Library.

My Lords, the Minister will be aware of the number of universal credit claimants who commit suicide every year, and of course these are the poorest people in our society. What steps will the Government take to improve the administration of universal credit and reduce the huge stress levels involved in trying to make a claim in the way required at the moment?

Suicide is a terrible thing in any circumstances. We have all been reminded recently of its impact on various groups in our society. I can tell the noble Baroness and the whole House that the administration of universal credit is reviewed on a daily basis. We have a terrific director, Neil Couling, who looks after the system, and I know for a fact that he is trying to do everything he can to simplify the process without losing the administrative needs within it.

My Lords, I draw the Minister’s attention to recommendation (e) in the report, which I hope is less contentious. It mentions the importance of the Government getting the new fairer funding review correct, as it affects every council’s ability to plan and provide for services for the most vulnerable and poorest in society. Can she update the House on progress with that important review, because at the moment, councils do not know how much funding they will get from 2020, how it will be distributed and the means of delivery?

Thank you, Chief Whip. One of the causes of abject poverty of the most vulnerable is of course the work capability assessment. One of the creators of that assessment has declared it unfit for purpose. It denies severely disabled people benefits when they have no—but no—prospect of work. What plans do the Government have to review the model of the work capability assessment?

I am pleased to report that we are looking at that very point at the moment and are about to carry out a pilot for a much easier work capability assessment, which will mean that people do not have to have repeats or assessments for different things. That is something we are taking on board very seriously.

My Lords, a very important point in relation to universal credit is that when somebody is homeless, the first thing our work coaches do—through support, understanding and signposting as necessary—is ensure that that person and their children are properly housed. We then go to the next stage, to see how we can support them to ensure they can manage both in work and in looking after their children.

My Lords, the Minister will be aware that disabled children and their families are particularly penalised under universal credit. Does she accept that the lifelong prospects of those disabled children will be severely damaged by the loss to their families of something like £1,000 a year?

My Lords, I do not accept that disabled children in such families are penalised by universal credit. We spend more than £50 billion a year on benefits to support those with disabilities, including children. Let me be clear: we are making sure we do all that we can to support people, particularly children, through the introduction of the severe disability premium.

My Lords, under universal credit, claimants with mental health problems who are waiting for their work capability assessment and who may, therefore, be proved unfit for work, are nevertheless being required to look for work during that waiting period, and will be sanctioned if they fail to do so. Does the Minister accept that this is an entirely unacceptable and grossly unfair system? Will she assure the House today that the Government plan to take action to bring this system to an end? If she cannot do that today, will she write to me to explain what action the Government will take to give fair treatment to mentally ill people waiting for their work capability assessment?

I thank the noble Baroness for her question; I know that she has great interest in this area. As I have said before, we are continually working to improve the work capability assessment. As a result of our Budget announcements last autumn, it is now possible for people to have a 100% advance on their universal credit while they are waiting for that assessment. I emphasise that those with severe disability do not now have to go through further work capability assessments. I assure the noble Baroness that we are constantly looking at this, working to improve the training of our work coaches and all the professionals involved in work capability assessments, to make sure that we minimise the number of people for whom we fall short in terms of support and protection.

My Lords, I have some sympathy with the amendment moved by the noble Lord, Lord Stevenson, which reflects the concerns expressed by StepChange. I understand that the SFGB is to carry out its commissioning function by setting standards for advice, whereas I think the Bill casts the body in the role of a kind of second regulator. That is also made clear by the amendments of the noble Lord, Lord Sharkey, which deal with the same thing. I worry whether the SFGB will become too like the FCA in terms of its culture. I had understood that it would set the standards which would enable the right partners to be commissioned, but if it has too many powers to act as a regulator, I am concerned that it will become more like the FCA and less sympathetic to consumer concerns.

My Lords, I thank noble Lords for Amendments 57 to 61. Clause 7 requires the single financial guidance body to monitor and ensure compliance with its standards. It requires the Financial Conduct Authority to periodically review the standards, and how the body is monitoring and enforcing those standards. After completing its review, the FCA is required to provide a report for the single financial guidance body and the Secretary of State. Once again, I reassure the Committee that the standards will not apply to all debt advice providers. These standards will apply only to the body itself and its delivery partners.

First, I shall address the Amendments 57 and 59, tabled by the noble Lord, Lord Stevenson. I have made the argument previously that the framework set out in Clauses 6 and 7—for the body to set and monitor compliance with quality standards—is the right mechanism for assuring the quality of the services provided by or on behalf of the body. I refer the noble Lord to our discussion on Clause 6, where we discussed the proposed commissioning framework for the procurement of services. There I made the point that it was unnecessary specifically to require the body to publish a commissioning framework, since we would already expect the new body to publish its requirements and expectations, with adequate time for prospective delivery partners to prepare their propositions. I also pointed out that, when contracts are above a certain value, the body will be required to comply with the public contracts regulations, including the requirements to advertise its requirements and undertake a competitive tendering exercise. We hope that those expectations and requirements on the body meet the spirit of the noble Lord’s amendments.

The noble Lord’s proposed commissioning framework would also have replaced the requirement on the body to set and monitor compliance with quality standards. I made the argument that the standards actually play a different role to a commissioning framework, in that they will assure the quality of the services provided by the body and its delivery partners. The standards therefore play the crucial role of enabling members of the public to have confidence in the services that they receive.

I disagree with my noble friend Lord Trenchard that there is a concern about the possibility of the culture of the FCA becoming similar to the culture of the body—or maybe that would be a good thing. The body would not necessarily be influenced by the culture of the FCA, because it has a statutory duty to put the consumer first, as I said under the last set of amendments.

My Lords, I apologise for not having been present at Second Reading. I rise to express my support for the generation of this new body on condition that it leads to an increase in resources for front-line services. I particularly support Amendment 41, although I also support the comments made about cold calling.

I am sure I am not alone in receiving endless calls from single mums, in particular, with young children, who are desperate because of their debts which are mounting week by week. We all know the burgeoning use of food banks and the interminable queues at citizens advice bureaux of desperate people seeking help.

The breathing space proposal has cross-party support. It is so obviously badly needed, and urgently so. The fact that 60% of people offered this service were enabled to stabilise their debt and begin working towards solving their problems is surely evidence enough that the introduction of a breathing space programme should not be delayed.

Some 2.4 million children are living in families with problem debt in England and Wales. What proportion of these children’s parents have mental health problems? I suggest that an extremely high percentage of those parents are suffering from depression and anxiety or both, yet the services for these disorders remain inadequate to say the very least. Our mental health services are under huge pressure, and they certainly do not need the addition of more clients because of these horrendous debt problems.

In 50 years or so of being quite close to poverty and unemployment, I have never known a benefits system so harsh, so inclined to sanction claimants and to cut or remove benefits and so limited a level of benefits available to people out of work. It is difficult to imagine that those claimants can avoid debt, even at the best of times, but once debt begins to build, resolution of the problem quickly becomes impossible. I urge the Government to take seriously Amendment 41 and the other amendments in this group.

I am sorry the noble Lord does not believe the evaluation that appeared in 2014. A very good evaluation it was, and it produced some very good figures that I do not think the noble Lord himself could question. I have quoted the figures from that evaluation and I will be able to produce further figures in due course when another evaluation appears. However, it is not just about changing the culture, although that is very important; it is also a question, as I am sure the noble Lord will accept, of fairness. We do not think it is right that those in benefit should be receiving incomes higher than those on average earnings.

My Lords, the lower benefit cap is just, of course, one of the many measures that the Government are using to reduce access to welfare benefits, as the Minister indicated in an earlier answer. Another is the repeated assessment of disabled people. Does the Minister believe that it is reasonable to reassess repeatedly people with brain injuries, for example, and life-long disabilities that will prevent them ever getting back to work? Will he assure the House that he will give his personal attention to this matter, with a view to bringing to an end this cruel procedure?

My Lords, is the Minister aware that, according to the most recent survey, rent arrears are a serious problem for 85% of new universal credit claimants, which is, of course, a disaster for children in those families? What plans does he have to cut the six-week average waiting time for families to get their rent when they claim benefits, change the system of payment in arrears, particularly for rent, and enable tenants to have the rent element of universal credit paid direct to landlords to prevent these debts arising?

My Lords, these matters were discussed at some length during the passage of the then Welfare Reform and Work Bill last year, and I do not want to rehearse all those arguments. However, I can assure the noble Baroness that some 90% of work benefits were paid on time. We accept that there can be problems with delays for some, and we will deal with that where appropriate. I do not believe it is right that we should start paying benefit direct to landlords. Just as people in work have to pay their rent to landlords, it is right that people on benefit should have the same opportunity.
