Lords ChamberI do not accept the noble Lord’s assertion that the Government’s plans are unambitious, but I do recognise some of the concerns he raises about profiteering, which, as he knows, we would distinguish from being profitable. We are particularly concerned about those larger providers which have complex and sometimes very opaque ownership structures. That is why we want to bring much greater transparency to the market.
My Lords, will my noble friend look very favourably on the work done by local authorities for looked-after children? Will she ensure that in the Autumn Statement sufficient resources are available for the excellent work they do? Have the Government ever looked at the possibility of extending looked-after care beyond 18?
The noble Baroness will be aware that in some cases there is a duty of care up to age 25 for children who have certain special educational needs and disabilities. I share my noble friend’s gratitude for local authorities and the work they do in this area.

Lords ChamberMy Lords, I thank my noble friend for repeating the Statement in this place this afternoon, giving us the opportunity to question her. I declare my interest, such as it is, in that I completed an internship—a stage—in the European Commission, followed by a Bar apprenticeship, both of which counted towards my professional qualification as a Scottish advocate.
Can I just press my noble friend on two small issues? One is that the academic institutions concerned will have sufficient notice of the phasing out of any of the courses concerned and that those who might have applied to them will be given alternatives to which they may be equally suited, with better outcomes for them.
Secondly, my noble friend will be aware that one of the challenges at the moment is obtaining skills and finding those with skills in plumbing, joinery, building, construction and other such areas. Will the new qualifications to which she referred actually plug that gap? That would tick a box because they are among the highest earners at the moment.
In relation to where qualifications might be phased out, I think that my noble friend is referring to the imposition of recruitment limits by the Office for Students. To be clear, that will happen after it has judged that an institution has not met the quality standards known as the B3 standards. The scale of limit will be a judgment for the OfS to make. There could be a limitation on growing a course. At the other extreme, the OfS might judge that it is not suitable to be delivered at all. I am not taking a view on either of those. I am just saying that it would follow an investigation by the OfS into quality.
I hope very much that universities are considering alternatives. Obviously, they are autonomous organisations, but there is a great human opportunity in offering some of the qualifications to which she referred. Also, from their responsibility for the financial viability of their institutions, there is an opportunity as those courses grow in popularity. For building, construction and other areas, from T-levels through to apprenticeships and other higher technical qualifications, the Government are trying to make sure that there is a pipeline of skills to meet the opportunities to which she refers.

Lords ChamberI absolutely agree with the noble Baroness that schools need to use the funding provided for them to feed the children eligible for free school meals. We are monitoring the implementation of our policies, and we are investing in a pilot training scheme for school governors so that they are well equipped to understand what is happening in their schools.

Lords ChamberThe noble Lord, as ever, makes an important point. We really are looking at that closely, not just in a school setting but, as importantly, in relation to early years and nursery settings. He will be aware that, post Covid, many children are arriving at school who are not school-ready in the way that we expected, and we are looking at that.
My Lords, locally sourced food could be served in schools and other local authority institutions such as prisons and hospitals. If 50% of all the food served in school meals was locally sourced, would this not reduce the cost of production?
I am more than happy to take that back to the department to look at. We are very focused on the standard of school food and supporting schools to give children a truly nutritious lunch each day.

Lords ChamberThe noble Baroness will be aware that the Government are committed to improving parents’ access to affordable and flexible childcare. We will set out these plans in more detail in due course.
My Lords, I am a patron of the National Association of Child Contact Centres. Will my noble friend give a big shout out for child contact centres, which play a phenomenal role, relying primarily on volunteers to run them? Cafcass used to provide the service, and the NACCC has not received any money since September, which is obviously putting it in dire straits. Could my noble friend use her good offices to intervene on its behalf?
I will certainly take the point that my noble friend has raised back to the department. I am delighted to express my support for the incredibly important, difficult and sensitive work that child contact centres carry out.

Lords ChamberThe noble Baroness, Lady Coussins, referred to the Mandarin Excellence Programme, but I point out that, as the noble Baroness understands, French and Spanish are very widely spoken outside the EU.
My Lords, the Erasmus programme was reciprocal, so tuition fees were not paid. In my noble friend’s experience, how many European universities have waived tuition fees under the Turing programme to enable UK students to apply without paying tuition fees?
I do not have that data to hand and I am not sure whether it is yet available, given the newness of the Turing scheme, but I will write to my noble friend to clarify that.

Lords ChamberOn the noble Lord’s second point, he will be aware that our call for evidence on loot boxes closed on 22 November. We had over 30,000 responses; we are reviewing that evidence and will set out our response in the coming months. I cannot give the noble Lord an idea of timing for legislation, but we will be publishing our response to the Gambling Act consultation later this year, and we also intend to publish a White Paper.
I refer to my interest on the register, as the chair of the Proof of Age Standards Scheme board. My noble friend will be aware that there are positive economic benefits from betting shops in market towns and on high streets. Are the Government looking particularly at how to balance the contribution that these shops make, in employing local people and to the local economy, while safeguarding the health and welfare of those who gamble?
My noble friend puts it very well. We are trying to balance the harm that gambling can cause in certain instances, while looking also at the economic impact—including in market towns.

Lords ChamberI absolutely agree that a secure and trusted digital ID framework can help reduce data breaches, identity fraud and some of the problems to which the noble Lord referred.
My Lords, I remind the House of my interest as chair of the Proof of Age Standards Scheme board. I congratulate my noble friend and welcome the moves that the Government are making in this direction. However, mindful of the fact that digital identity verification is fiendishly complicated, I urge the Government to consult as widely as they can, to embrace the consequences for rural as well as urban areas and to ensure that any such framework is fit for purpose and will, as my noble friend says, be used safely and appropriately.
My noble friend makes an important point on which I absolutely agree. That is why we have taken this very transparent approach with the publication of the trust framework alpha. A second iteration will be published this summer and then, as I mentioned, further work towards legislation later this year.

Lords ChamberThe Government meet regularly with the Musicians’ Union and find it an extremely valuable stakeholder in this discussion.
My Lords, the UK has benefited from and supported greatly the European Union Youth Orchestra and the Chamber Orchestra of Europe. Will my noble friend look favourably on exchanges such as that developed bilaterally between the UK and Denmark, Praktik i udlandet, where business students on both sides can benefit from business placements? If we are going down the bilateral route, can we proceed as positively and as swiftly as possible?
I cannot comment on the specific that my noble friend cites as an example but, as I have said, the spirit of this is working with the sector to understand what it needs, and we will continue to do so.

Lords ChamberI thank the noble Lord for his additional questions and I apologise to your Lordships. There is a certain irony in my signal not being quite strong enough for this Committee stage.
In answer to the noble Lord’s question about Openreach, what I tried to say in response to the noble Lord, Lord Adonis, when he put this point, is that any sale is a matter for the BT Group, but the department’s understanding, based on further articles in the press, is that the original Financial Times article was inaccurate. We continue to engage with BT and Openreach, but ultimately it is a private company, albeit subject to all the competition laws and wider legislation that might be relevant.
In relation to students, the noble Lord makes a very important point. I spent quite a lot of time recently talking to young people, including students, about the impact of Covid on their lives. The points he makes are definitely reiterated by them. As the noble Lord knows, students will live in a range of different types of accommodation with different arrangements. Where they are occupying accommodation such as an assured shorthold tenancy or an assured tenancy, they will be covered by the Bill.
The noble Lord’s wider point was about thinking through the practicalities, which is what my officials have spent much time doing. This was explored extensively in the other place. The balance we need to strike is between the three parties—the landlord, the tenant or leaseholder and the operator—and that is what this legislation seeks to do.
I thank my noble friend for her very comprehensive reply to the opening remarks on Amendments 1, 3, 4 and 5. She referred specifically to the hardest-to-reach properties and the sum of money that has been allocated. I repeat here a plea that I have made on many occasions, in the hope that it might be listened to sympathetically. By 2025, the 5% hardest to reach properties, which will inevitably be in rural areas, will, in all likelihood, still not have fast, high connectivity or even fibre broadband. Will the Government look sympathetically on a request to reverse the priorities, to ensure that the 5% hardest to reach will be dealt with first? A great number will indeed be leasehold properties, and many will be tenanted; and many will have residents who are hoping to run rural businesses, or people who are having to work from home at this time. I know that this will strike a particular chord with them.
Given that in areas such as North Yorkshire, the Lake District and Devon, or in any hilly area, you have to deal with the terrain and with the geography of being a substantial distance from the exchange, it seems unfair that these properties—I repeat that many will be leasehold properties—are being disadvantaged and discriminated against. They should be fast-tracked, to allow them greater access to all forms of telecommunication.

Lords ChamberMy Lords, I thank my noble friend for repeating the Statement this afternoon. I stress my disappointment at the timetable—it could perhaps be a little more ambitious.
Will my noble friend clarify one remark she made? I understood her to say that commercial mobile phone networks will have access, when this new procedure is in place, to the emergency service infrastructure. I pleaded that the North Yorkshire Police mobile phone communications system could be made available to the commercial phone networks, and I was told that was not possible because of the security implications. Can my noble friend put my mind at rest in that regard? She will appreciate that North York Moors is one of the most sparsely populated rural areas and has now achieved the nomenclature “super sparse”. Much like the noble Lord who chaired this House’s Rural Economy Select Committee, next door we had a number of reports from the EFRA Committee pleading with the Government to improve connectivity. There is a safety aspect: there are now no fixed phones—they have all been removed by BT—so we are entirely dependent, in these rural areas, on mobile phones.
I thank my noble friend for her question. She describes the North York Moors as “super sparse”; I would say they were super beautiful when I was last there. On using the emergency services infrastructure, I will write to my noble friend if my understanding is incorrect, but where she is absolutely right is that the priority in terms of the use of emergency services infrastructure is for emergency services personnel. Nothing we are planning should interrupt that and there should be no disruption to the emergency services network as a result of this proposal, but we believe that, where it is possible and appropriate, that infrastructure should be made available to share with commercial operators to deliver the coverage improvements that are needed.
