I completely agree with my noble friend. We are most concerned to minimise online teaching and remote learning. Our children have been out of the classroom enough with Covid, and this House knows the seriousness of issues with attendance. We all know that this is the moment in the year when we want children in the classroom—on 4 September, or maybe 5 September if there is an inset day.

In relation to online teaching, perhaps it will reassure my noble friend if I say that we have already worked with 52 schools and mitigated over the last few months, before this change in policy when we identified a critical grade. The average number of days lost for those children was six. Six days is a lot. For some children it was more and for some it was none.

In the vast majority of those cases, the whole school does not have RAAC across all its roofs and floors; it is typically in a small area of the school. I bumped into someone this afternoon who was talking about their secondary school. They are able to reorganise the space in their school. They will miss one day of school tomorrow and then all the children will be back on Wednesday. That is in a big secondary school.

On my noble friend’s second point, in those first 52 cases, we are so grateful to other local schools, some of which have spare space and have bent over backwards to make sure that children do not miss a single day more than they need to.

My Lords, the safety of children in our schools is being compromised not just by RAAC construction. I remind the House of my interests, in particular as an adviser to Charter School Capital and as chair of the E-ACT multi-academy trust. In the trust, there is a secondary school with CLASP construction, meaning it has no foundations, has asbestos and desperately needs replacing. Another has external concrete cladding that is falling off, so we are spending over £50,000 a year just on scaffolding to catch it before it hurts anyone. When will the Government implement a comprehensive condition survey, not just for RAAC schools, and match it with proper investment to ensure the education budget is spent on education and not just on patching and mending the crumbling school estate?

I remind the noble Lord that the Government made a full survey of the school estate. We carried out the first one I think between 2017 and 2019 and we are in the middle of the second one at the moment. That looks at the condition grade across schools. I have the figures in front of me: in the first survey, 95% of individual condition grades—which literally look at the window frames; I am not sure about door handles but the walls, the roofs, et cetera—were graded as good or satisfactory, and 2.4% were poor or bad: 2.1% were poor and 0.3% were bad.

The noble Lord will also know that all our funding to schools for condition is prioritised based on condition need. He also knows that if there is an urgent request we will always consider it. We have already identified some the of so-called system builds, such as Laingspan and Intergrid. Almost all of that has been completely resolved and plans are in place for all of it to be removed. We have a programme of surveys starting later this year looking at the remaining construction types to understand them better and understand whether they might pose a risk.

On the first part of the noble Baroness’s question, we set out the expectations for responsible bodies. I think it is safe to say that the local authorities are pretty clear what their responsibilities are. In relation to academy trusts, those responsibilities are set out in the Academy Trust Handbook. We actually strengthened, clarified and reinforced the language around that before we knew about the three schools; we did that earlier in the summer with a new updated version. This was just to make sure—reflecting the noble Baroness’s point—that there was absolutely no doubt about the practical steps that should reasonably be expected for responsible bodies to take.

I am glad of the opportunity to say that our condition data collection survey, which I referred to, is not in any way a blurring of the lines of responsibility between responsible bodies and the department. However, it allows us both to plan the quantum of funding that we need to give to those responsible bodies to maintain their buildings and to identify areas where there is greater deterioration or less. So we have a broad overview of the school estate, but that should not blur any lines in relation to responsibility.

My Lords, does that inform the quantum of money that the department gets from the Treasury, or does it just inform the quantum that is distributed among responsible bodies once the Treasury has decided what to give to the department?

It certainly informs the second although, as the noble Lord knows, larger academy trusts and local authorities have discretion to judge within their own school estate how they want to use that money. A number of things inform our discussions with the Treasury, of which the condition data survey is one, but it is definitely not the only thing.

My Lords, I thank all noble Lords who have spoken in this debate; I have thoroughly enjoyed it. I have learned a lot—it is not my natural home as a policy area—particularly about the ups and downs of the Turing scheme. I make special mention of my friend, the noble Lord, Lord Austin, and his comments about the importance of universities for community generation. Also, this was the first time I have heard my noble friend Lady Twycross speak from the Front Bench. Clearly, it is her natural home, so I look forward to more of the same from her.

It is good to hear that across the House we are proud of our higher education sector. We want to allow it to continue to pursue excellence, as well as community renewal, and that requires a solid financial foundation. I noticed that in her fine speech, the Minister talked about the seven-year freeze in tuition fees allowing the sector to remain financially stable. I gently put it to her that, having shifted to half the income for the sector being reliant on tuition fees, to then have a seven-year freeze at a time of double-digit inflation is not the best recipe for financial stability.

However, with that note of caution—I do not want to depress anyone—it is still a vibrant sector and is still hugely important, and we are all committed to helping it.

With the permission of the House, I quoted one figure incorrectly and would just like to set the record straight. I said that, according to the HESA data, the increase in the number of low or unknown tariff higher education institutions that were in deficit in 2016-17 was 11 and in 2020-21 it was 21. I quoted earlier the number of institutions, which rose from 47 in 2016-17 to 70 in 2021. I would just like to get that right and not have to put it in yet another letter.

My Lords, I refer your Lordships to my interests in the register, particularly as a member of the board at Century Tech. The Government are splurging £43 million on Oak, which is used by only just over 5% of England’s teachers but which allows Ministers, in the words of Jon Coles, the chief executive of one of the largest MATs, to promote their own preferred curriculum model. I now regularly hear from private equity investors that they are put off investing in education resources in this country because of the distortion caused by the Government clumsily entering the market at scale. Please can the noble Baroness tell the House what competitor analysis the department has undergone and why it thinks this significant investment will aid growth and choice for teachers?

I have to say it sticks in my throat to have private equity investors who are responsible for considerable distortions in the children’s home market lecturing the Government on distortions in the edtech market. More importantly, the Government are not distorting the curriculum. The Government are striving—I know that the noble Lord knows that this is true—to have the best curriculum for children. We know that teachers will make the best judgment on what curriculum their students need. That is why, apart from the curriculum from Oak’s own partners, which will be on the platform, it will also showcase more than 80 other curriculum models for providers so that teachers can make those comparisons.

My Lords, I shall speak to Amendments 35B and 36, which amend Schedule 1. Schedule 1 extends certain provisions in maintained school legislation which currently apply to academies through funding agreements to academies directly.

I thank the noble Lord, Lord Knight of Weymouth, for Amendment 35B. He is seeking to require academies to employ qualified teachers and to be subject to the Secretary of State’s guidance on teacher pay and conditions that applies to maintained schools. However, the provisions in Schedule 1 that the amendment changes relate specifically to special schools and the removal of the power for the Secretary of State to prescribe that special academies employ qualified teachers. The amendment would not have the effect that the noble Lord is seeking to achieve.

However, it is clear that the intended purpose of this amendment and Amendment 36, which is about removing the exemption that academies have for teachers to have qualified teacher status, would provide for a restriction to a core tenet of the academy system, namely that, with the exception of special academies, all academy trusts have the freedom to employ those they believe are suitably qualified to teach in their academies and that all academy trusts can make decisions about pay and conditions of service in their academies.

The academy standards regulations will reflect existing requirements in the funding agreements, including those relating to enrolment in the Teachers’ Pension Scheme or the Local Government Pension Scheme. I have heard the fears expressed about a future Government using these regulations to undermine the freedoms that enable academy trusts to collaborate, innovate and organise themselves to deliver the best outcomes for their pupils, and I am carefully reflecting on those concerns.

On teacher pay and conditions, although all academy trusts have the freedom to set their own pay structure and conditions of service for teachers, we believe the vast majority follow some, if not all, of the guidance in the school teachers’ pay and conditions document. We believe it is right that academies continue to benefit from this freedom because it allows heads and trust leaders to have the flexibility to respond to their local context to support recruitment and retention of teachers. I am reminded of the phrase used by the noble Lord. I do not want to misquote him, but he spoke very powerfully on the first day of Committee about how important and attractive it was to trust our leaders, and that is exactly where these freedoms fall.

Academy trusts are also allowed the freedom to make their own decisions about who they believe is suitably qualified to teach pupils in their academies. However, most schools, including academies, understand the importance of well-trained teachers and choose to employ teachers who have undertaken initial teacher training and gained qualified teacher status. I agree very much with the sentiment expressed by my noble friend Lord Agnew in relation to the quality of the qualification as opposed to just the qualification in its own right. I am slightly baffled at your Lordships’ focus on this, as 96.9% of teachers in academy schools held QTS in November 2021, compared to 97.7% in maintained schools, so there is less than a percentage point difference between the two. The noble Baroness, Lady Morris, seemed to suggest that there are examples where it might be much higher. If that is the case, perhaps she would be very kind and share them with us, so that we can look into that.

The intention behind the amendment is to place additional requirements on academy trusts that would undermine the discretion and flexibility at the front line that fundamental academy freedoms give to heads and MAT leaders. That is not the intention of this Bill. On that basis, I would be grateful if the noble Lord would withdraw Amendment 35B and if the noble Baronesses would not move Amendment 36.

My Lords, I am grateful again for this half-hour debate and for the Minister’s reply. It is important that we have a vision for the whole system, now that we are moving to a single system, and perhaps this is something we will continue to reflect on.

I am grateful to the noble Lord, Lord Deben, for his comments. The core of the argument for having a single national pay and conditions arrangement for teaching relates to the difficulty of recruiting people into the profession. It is a critical profession for the future of our country and any society, and we must make sure that we recruit the finest people to be teachers—as one of their careers. These days, we are going to live longer and work longer. I am not saying that you necessarily have to do 40 or 50 years as a teacher, but would it not be great if, for one career, people wanted to be a teacher? It is easier to recruit people if they know that they have a predictable pay progression with a predictable, quality pension at the end of it, as part of their public service—as part of the motivation and the vocation around becoming a teacher.

I hear and respect very much what the noble Lords, Lord Agnew and Lord Nash, say about the output and the nature of the different routes into the profession. There is of course the assessment-only route. People who have been working for 20 years in the private sector or who are coming in from industry could perhaps have some brief training in some of the pedagogic or behaviour management elements that my noble friend on the Front Bench talked about and can then be assessed against the standards that are set around what we require from qualified teachers. They do not have to go through training; they can just be assessed against those standards. One of the things I pioneered when I was working at TES, with the TES Institute, was a route through the assessment-only process.

I am happy to withdraw this amendment. I hope this brief debate has given us cause and a pause to reflect on what kind of system we want for the teaching profession in the context of every school being an academy.

My Lords, I thank the noble Lord, Lord Knight of Weymouth, for highlighting this very important issue. While the Government agree with the sentiment of the Bill, as the noble Lord, Lord Watson, just suggested, they do not believe that amending the curriculum is the right way to encourage pupils to learn about a sustainable environment. The subjects of citizenship, science and geography all include content on sustainability and the environment, and schools have the autonomy to go into as much depth on these subjects as they see fit.

We are taking action to support schools to develop further pupil knowledge and skills in relation to these very important issues. Our draft sustainability and climate change strategy, which we announced at COP 26, set out two new initiatives: the national education nature park and the climate leaders award. Together, these schemes will build on knowledge gained in the classroom to provide practical opportunities for all pupils to learn more about nature and biodiversity, develop key digital skills that are essential components to solving climate change and be empowered to take positive action. Alongside this, teachers will have access to improved training in climate education, including a primary science module curriculum, science CPD and free access to high-quality resources. We have engaged widely and plan to publish the final strategy in April.

I think my noble friend Lord Watson’s comments about the views of young people that autonomy is not delivering are shared by teachers. If the Minister, or her colleague Robin Walker, had the appetite and the time to meet with me and Darren Jones before the Bill goes to the other place, we would be very grateful.

The Government are working in different areas to address affordability, and I am sure that the noble Lord has seen the recent Ofcom report on this issue. Some 99% of households can access an affordable tariff, but the take-up of that is much lower than we would hope, and Ofcom has recommended more proactive marketing of those tariffs.

My Lords, the pandemic has accelerated the embedded use of broadband for work, learning and leisure, and yet 9 million people are still on the wrong side of the digital divide. It is estimated that 3% of schoolchildren were prevented from accessing learning during lockdowns. Many of these people live in social housing. What efforts are being made to ensure that all registered social landlords include broadband access in the rent and that such an element is then included in housing benefit?

The issues relating to being on the wrong side of the digital divide, as the noble Lord described it, are more complex than simply the tariff or how rent might be set up: they include digital skills and confidence, on which this Government are working very actively, as set out in our tech-savvy nation report.

My Lords, I want to speak relatively briefly in support of my noble friend Lord Blunkett’s Amendment 56A. I find the procedure slightly odd—I am still trying to influence the Minister after she has asked for it to be withdrawn—but I will give it a good go.

The importance of financial education and financial literacy in primary education does not need too much arguing. I recall a friend of mine, Emily, who finished secondary with four A-levels about three or four years ago. She chose to become a successful actress rather than go to university. About six months after she started work—she got work very quickly—she was furious that her education system had not told her about taxation and that suddenly she had to put money aside to pay her taxes as a self-employed actress.

That reinforced for me that we have an education system that is really passive on this. I was delighted a couple of years ago, when I was working for a company called TES, to be involved with the Bank of England and the Beano on producing some financial literacy resources for primary schools, which were very well received. I also endorse the work of KickStart Money.

It has become particularly acute that we must do more in primary education because of the cashless nature of our transactions. According to a survey this month published by, I think, Yahoo, fewer than a quarter of transactions in this country are now paid with cash. Children no longer see and feel money exchanging hands. They are no longer adding it up and making sense of 1p, 2p, 5p, 20p, 50p, £1, £10 and so on because it is not part of what most of us handle any more. There are apps. My stepdaughter will be 10 tomorrow. We use an app for her called RoosterMoney, which helps her with some of these things. But there has been an impact for primary schoolchildren on their numeracy, their understanding of debt, and of how their school is paid for and how their teachers are paid, because it is taxation and public money. These are really important parts of citizenship.

While the noble Baroness, Lady Kramer, was talking I thought that, although the amendment is about resourcing financial literacy in primary schools, I had better quickly check the primary curriculum to see what is in it. There are two mentions of “financial”. One is in respect of what the curriculum requires years 5 and 6 to do in terms of spelling. The noble Baroness asked whether there is something horribly wrong in the Department for Education. It is so obsessed with things such as spelling in English that you have to learn how endings that sound like “shall” are spelled, as in “official”, “artificial” and “financial”. The only other mention is in the context of maths. It says that studying maths is a good idea and “necessary for financial literacy”, so it gets a slight mention but that is it. There is no real requirement, but there is a little bit of a nudge that there is a good reason for studying maths. We have to do better.

This amendment, and putting something in statute, would give some priority and send a positive signal from government that we should do more on this. It would be able to fund some of the teacher training that is important to give primary school teachers better confidence and competence around how to link this in to various parts of the curriculum, because it is not just in maths that you can teach financial literacy. Of course, it could fund more of those resources so that it is not just down to the Beano, the Bank of England, KickStart and others and we have some properly evidence-based resources that help teachers to link across the curriculum in an engaging and interesting way for primary school students.

I urge the Minister to reflect and perhaps have a chat with some of her colleagues in the Department for Education—particularly the Schools Minister, who is obsessed with spelling, punctuation, grammar and maths but, frankly, is not really that interested in very much else in terms of what is specified in the national curriculum. We could do better.

I thank the noble Lord for his remarks. I absolutely do not deny in any way the importance of financial education, but the issue here is not the importance of any individual cause. The challenge we are faced with—or the privilege that we will all have—is to contribute to a conversation about the right cause for this particular stream of money, with its unique features, and that includes the existing causes that are funded. We will be putting the cart before the horse if we focus too much on causes to go into the Bill; rather, we should put the combined intellect of your Lordships and others into making sure that we spend future moneys in the best way possible.

I would guess that the prospects for promotion depend a little on who you support—but I leave it to each noble Lord individually to decide on that. We are clear that the principles of fair competition must prevail as we move forward with the review.

My Lords, the way in which the owners of the big six clubs are behaving is, frankly, a disgrace. They are exploiting the catastrophic impact of the pandemic on the Football League clubs to make a massive power grab. At no point have they consulted fans during this shocking episode, despite these proposals being three years in the making. The Government’s proposed supporter-led review of football governance is now urgently needed, as others have said. The Minister did not answer my noble friend Lord Bassam’s question as to when the Government will commence the review. Will she consult supporters’ groups now on the terms of reference and scope and structure that she mentioned earlier?

The noble Lord is right about the lack of inclusion of supporters’ groups in the proposal that has been discussed widely in the media. On timing, we do not have a firm date, but we are committed to consulting all stakeholders as we prepare that review and, clearly, fans are an important part of that.

The noble Lord is absolutely right to focus on the importance of trust: it is a vital underpinning in the development of AI. I imagine he is aware that we have just published our National Data Strategy, which sets out very clearly the importance of public understanding of both government and non-government data within an ethical framework.

My Lords, back in April my noble friend Lord Darzi told the BBC in respect of Covid-19 that

“AI remains one of our strongest paths to achieve a perceptible solution but there is a fundamental need for high quality, large and clean data sets.”


Much of this data gets siloed in individual companies and universities, so what are the Government doing to unify these data sources to allow researchers to apply machine learning to new solutions for vaccines, monitoring and personalising care within an ethical context?

The noble Lord is absolutely right, although I am sure he would acknowledge that the quality, size and integration of those datasets vary considerably, as the recent report highlights, between different sectors of the economy. Again, the National Data Strategy and the consultation on it will be important mechanisms for addressing the issues that the noble Lord raised, as well as the open data initiatives and pilots that we are already running.
