My Lords, it is a pleasure to follow the noble Baroness, Lady Randerson. I congratulate the Prime Minister on publishing the White Paper, which could at last enable us to talk meaningfully with the EU. We all recognise that the White Paper is a compromise, designed to ensure that the UK position is more realistic than the previous strict red lines, often mutually exclusive, which seem to have been imposed upon the Prime Minister by the extreme wing of our party.

As a starting position, the White Paper is an achievement, but Cabinet reticence and changes to legislation forced through in the other place last week undermine even that position. I am afraid that it becomes clearer by the day that there are some, such as members of the ERG, who will never accept any reasonable deal with the EU. The ideologues have no plan of their own, just threats, obstructions and impossible demands. Indeed, the UK’s approach to Brexit has been rather like Gareth Southgate going to FIFA during the World Cup and saying, “We would like to continue playing in the competition but some of our players don’t want to participate any more as they don’t like the rules. However, the players have agreed that they will play in a few matches as long as England can choose its own referees, ditch the offside rule and play with 12 men sometimes if they want to”.

Such unreasonableness is not helpful. Therefore, I believe that if the Prime Minister wants to make progress in our Brexit negotiations—and I believe she does—she must accept that some in the party will never agree to any position that the majority in Parliament recognise to be vital to protecting our national interest. She needs to proceed with the more sensible, softer approach that this White Paper alludes to—no more fudge, no more bluff, no more stringing everyone along and hoping it will be all right; no more threats against our partners and fighting among ourselves. To thrive in the 21st century requires open arms, not raised fists. The time has come to face down the fantasy of cake and eating it. In the words of Abraham Lincoln:

“You cannot escape the responsibility of tomorrow by evading it today”.


Some key issues of concern have already been brilliantly exposed by previous speakers. Many noble Lords have insisted that democracy requires that the 2016 vote is sacrosanct. We must of course respect the will of the British people, but Parliament has respected the result of the referendum. It has triggered Article 50 and is now trying to negotiate a good outcome for the whole UK from a new EU relationship. However, the referendum did not specify a date on which we must leave, nor did it give a direction of travel.

This is about the ordinary people of this country who are trusting us to look after their future as best we can. Therefore, the current threats of no deal fill me, like so many other noble Lords, with horror. I fear that some are determined to obstruct progress in the negotiations for the next few months just to get to March 2019 when we will be out, due to the two-year limit, no matter the consequences.

People did not vote for no deal. By countenancing this, we are betraying most of the 17.4 million people who voted to leave in order to be better off, as the leave side promised, and all of the 16.8 million people who did not want Brexit at all. The referendum did not ask whether people wanted to leave the single market, the customs union, ECJ jurisdiction, all the agencies, and abandon the Good Friday agreement. People did not vote for that. The impact of no deal would be catastrophic. Indeed, the light at the end of the Brexit tunnel that so many leavers have told us about is really, I fear, an oncoming train.

The Japanese embassy has said that no deal is impossible for it to accept—the normally polite, understated and inscrutable Japanese have expressed their outrage with unusual forcefulness. London is a hub for European, Middle Eastern and African banking, but this would be at risk. The Chinese embassy itself has said that London risks losing its status as a banking hub if there is no deal.

No deal would mean the end of our manufacturing success, as integrated supply chains collapse, with workers’ jobs at risk. Car manufacturers have profit margins between 3% and 10%. Under WTO rules, car exports to the EU face 10% tariffs and car parts a 5% tariff. Indeed, the WTO has 135 different tariff rates on imports from third countries and 150,000 goods classifications to determine those tariffs. How do we think UK firms will cope with that? Much of our manufacturing is of intermediary goods: 70% of UK goods exports are intermediate inputs for manufacturers in the EU, which they then sell to the rest of the world. If the UK does not count in the EU rules of origin, EU firms will have to go elsewhere and will look to EU firms for their inputs.

Even in trying to negotiate new trade deals with other countries, the benefits have been overblown. The UK is no longer a hub to the rest of the globe as it was in the days of our Empire. We are a medium-sized country, dwarfed by the US, China, Russia, India and the EU. Countries of our size cannot define their own terms of trade when negotiating with whole continents. Those who naively hope for a trade deal with the US should wake up. The US has a vested interest in weakening the EU. Encouraging the UK to break away will increase American power and, once the UK is out, the US will be in a stronger position to give us a deal that is much more in its interest than ours.

Leaving the customs union and single market are acts of economic vandalism against both our own industry and that of the EU. Our negotiating position has asked the impossible. The EU cannot and will not give us the advantages of being in the EU, including security co-operation and membership of all the agencies that are so important to our way of life, while we do not have to obey its rules. It seems that many Brexiteers are willing even to put peace in Northern Ireland at risk—surely the Conservative and Unionist Party cannot accept that.

Something hardly mentioned is the enormous cost we have already imposed on the EU and on other EU countries. Domestic firms have also had huge costs imposed on them, and so have UK taxpayers. Our Government have taken no responsibility for this, and there has been no acknowledgement of the impacts of our decision. This has already resulted in a loss of respect for the UK on the international stage.

British values of decency, fair play and tolerance have been subsumed in the Brexit mania. If we do not retain EEA membership and a customs union or partnership, British people will be poorer as a result of the vote they were told would make them better off. To quote Cicero: “the welfare of the people is the highest law”.

My Lords, I am grateful to the Minister and his colleagues for what he has said and for what the Government have done. I could not have improved on what he said. It is an important day for child refugees. We have tried to keep the campaign on behalf of unaccompanied child refugees on a cross-party basis. We saw that in this House and there are some Conservative MPs who are very supportive in the Commons as well. Without that, we would not have got to where we have. I believe that there will be quite a number of child refugees in Europe who, through this amendment, will, I hope, be able to have a better life in this country.

I have always argued that we should not take responsibility for all child refugees, but this amendment deals with those who have a connection through family members and relatives in this country, just as there are child refugees in other countries who, under the present system, have the right to join their relatives there—for example, a Syrian boy in France could join an uncle in Stockholm. This would safeguard the position as regards that agreement when we leave the EU. I am very grateful to the Minister and to all those in all parties who have supported this. I believe the cause of child refugees is, by and large, supported by most people in this country—although not by everybody. I think that if one puts it to people in this country they will say that, in terms of our humanitarian traditions, it is right that we should give support to child refugees. Public opinion is on our side and I am grateful that the Government have been so helpful in what they have done today.

I am really pleased to welcome the Government’s changes and of course I congratulate the noble Lord, Lord Dubs, on his persistence on this issue of child refugees, an issue for which I think there is much support across the House. My Lords, I think the humanitarian aspect of Brexit, especially in so far as it affects children, is something, as the noble Lord, Lord Dubs, mentioned, that the general public feel very strongly about. I am delighted to be able to congratulate the Government and the noble Lord, Lord Dubs, on reflecting that very important view.

I was asked to join this House so that my many years of experience in business could help shape the laws of this land, and it hugely pains me to be on a different side of the argument from many of my noble friends. However, I firmly believe that I am present in this Chamber today for the experience that I bring from the business sector, particularly the services world, of which I am extremely proud to be a part. It is with that experience in mind that I ask noble Lords to consider the EEA as a way of respecting the will of the people and ensuring that British business can continue to thrive once we leave the European Union.

My Lords, I support this important amendment. The EEA offers a way out of the impasse our negotiations are in. I am therefore disappointed that many in this House seem opposed to the amendment. I urge my noble friends to recognise that there are many Conservative and Labour MPs who wish us to pass this amendment tonight and send it back to the other place for reconsideration. My noble friend Lord Forsyth mentioned this, and I urge him to recognise that there is a strong and growing feeling in the other place that it would like to reconsider the EEA. Seeing the problems facing the country, and seeing businesses large and small increasingly explaining how vital it is not only to have a customs union—or partnership, or whatever we wish to call it; perhaps fish and chips, as my noble friend Lord Patten suggested —MPs increasingly realise that it is not enough to protect British manufacturing and the vital services sector.

It is crucial to keep EEA membership as an option and I ask for your Lordships’ indulgence to explain why the EEA is consistent with the referendum vote and how the analysis of the noble Lord, Lord Howarth, omits important elements. Being in the EEA would ensure that we are protected in a no-deal scenario, which could otherwise be catastrophic for the UK economy and would necessitate a hard border in Ireland. EEA membership has an emergency brake on free movement of workers so that we could limit the numbers coming into the UK if needed. Articles 112 and 113 state that if there is serious economic, societal or environmental difficulties immigration can be curtailed.

Being a member of the EEA means that regulations can stay aligned with the EU, so our exports of goods and services will not face new barriers. There is no more risk of ever-closer union as the EEA is strictly an economic union. EEA disputes are settled by the EFTA court using the English language, not the ECJ. EEA membership does not include the common agricultural and fisheries policies, as we have heard, but it also does not cover many other areas which the British people may be concerned about as EU members, such as VAT, justice and home affairs or commercial policy. Decisions require unanimity, not qualified majority voting, so there is not the same risk to our sovereignty. There are already negotiations and free trade agreements with 27 countries and negotiations are under way with India, Indonesia and Vietnam. The EU agencies that we already voted for earlier this evening are open to EEA members in most cases. Surely the value of protecting the Northern Ireland border and continuing close trading relationships with the EU in both goods and services far outweighs the possible benefits of imaginary trade deals with third countries. The Government’s analysis shows that, even if we get a free trade agreement with the US, India, Australia and others, it would boost GDP by only 0.7%.

Unlike EU law, EEA law does not have direct effect, but has to be incorporated into national legislation in accordance with each state’s constitutional requirements. EU legislation is not imposed on non-EU EEA states. The final decision on whether rules will be implemented is made by the EEA Joint Committee, which compromises of EU and non-EU EEA states, so decisions are taken on the basis of unanimity. That means that, in extremis, a non-EU EEA state could veto proposed rules, as Norway has done in the past. I urge noble Lords to vote for the amendment as a protection for the UK, its people and its democracy. Being in the EEA respects the referendum result. We would not be in the EU but we would minimise damage to our wonderful country and its citizens.

My Lords, this has been an informative, interesting and passionate debate on a key element of our future relationship with the EU. Unlike the noble Lord, Lord Forsyth, I think that it is entirely appropriate for us to discuss this here and in the context of the Bill.

It has long been the judgment of the Official Opposition that the Prime Minister made a grave mistake at the very opening of negotiations in sweeping certain options completely off the table. Her red lines, which closed down the possible positive and constructive development of a new partnership with the EU, were irresponsible, short-sighted and aimed more at her hard Brexiteers than at the interests of every part of the UK. Whether one is thinking about Ireland, Scotland, the regions, Welsh farming, manufacturing, the City, aerospace, automobiles or any other sector of the economy, those options were off the table before we had even had the impact statements.

It is not the way that we would have opened discussions on our post-Brexit status. Nor would we have written our own red lines. Instead, Labour set out the objectives for, rather than the particular architecture of, any new relationship. One of the problems with the specifics of these amendments is that they define the structure, not what we want to achieve. Indeed, on the objective, I agree wholeheartedly with my noble friend Lord Alli. We urgently need a deal on services if the UK economy is ever to thrive—but the particular model defined may have some shortcomings, some of which the House heard about in the debate on the amendment of the noble Baroness, Lady McIntosh, and which the noble Lord, Lord Kerr, touched on. Not only might EFTA, with its 14 million people to our 66 million, not want us and not suit us, but, because EFTA is not in the customs union, it cuts across the major amendment passed with a majority of 123 in this House on 18 April that was in favour of us being in a customs union. It also does not mention agriculture, which is so important in Ireland. At the moment, we cannot have both a customs union and EFTA.

I am grateful, but I am not surprised by the reception because this House is of course a cosy cabal of remain.

As your Lordships have heard from my noble friends Lord Lamont and Lord Howard, this is a wrecking amendment, designed to delay, frustrate and ultimately block Brexit. For all the protestations of my noble friend Lord Hailsham and others, it is a wrecking amendment in substance. Those proposing and supporting it are playing the role of a fifth column for Monsieur Barnier and the EU negotiators. I am sure he is very grateful; they are doing his job for him, as my noble friend Lord King pointed out.

The amendment would tie the Government’s hands in the negotiations, in both time and content. It seeks by disguised means to overturn the referendum result and would make our negotiators’ already difficult job even more difficult. It is therefore against our national interest. There are many in Germany and elsewhere in the EU who would like us, as they see it, to come to our senses and reverse Brexit, not least because they see us as one of the few sensible people in the room with them. The proposed new clause would work towards that goal.

Of course, its proposers will deny any such intention. It would be more admirable if they were transparent about their intentions, even if they cannot accept the referendum result. At least, the Liberal Democrats are open about their intentions; not so the Labour Party. But the 17.5 million people who voted to leave, including many Labour voters, are watching and noting the manoeuvres in this House.

The proposers and supporters of this new clause are perfectly entitled to do as they are doing, but we are perfectly entitled to call them out for what they are doing: acting as a fifth column for Brussels by undermining the Government from inside.

My Lords, I support this amendment. I feel that several of my noble friends have exaggerated its aims and intent. This is not about frustrating Brexit, nor is it about overturning the referendum; it is merely about fulfilling our role, which is to ask the other place to reconsider. It is about asking the other place to ensure that there is a meaningful vote on whatever the Government manage to negotiate. It is not intended to undermine the negotiations. We are asking the other place to consider whether the vote being offered is meaningful. If the other place is satisfied and it comes back to us, that is another matter, which we will not overturn.

I underline my noble friend’s point about the enthusiasm with which the Minister told us in Committee that there would be no dilution of these rights and that it is the Government’s intention that these rights would be the foundation for an ever-developing family-friendly agenda that they want to advance. Yet the Minister did not give my noble friend or any of us involved in that Committee any idea why the Government do not want to monitor evolving EU law in this area. Surely, if we want to be in the vanguard of EU law we have to be able to monitor it. Why can we not do that? It is such a modest ask.

I shall speak to the amendment, to which I have added my name. I urge my noble friend the Minister to give us the reassurances that we seek. I believe that the Government want this country to be at the forefront of equality rights, work-life balance, improvements for parents and carers and family-friendly employment. I hope he can reinforce the commitment to aspire to the race to the top in these protections for what are such important rights in terms of equality.

My Lords, the contributions from my noble friends Lady Lister and Lady Crawley and the noble Baroness, Lady Altmann, have made the case quite clearly for why we need this proposed new clause, as laid out in Amendment 17. It explains in detail the importance of including this in the Bill, and would require the Minister to report to Parliament whenever there are new or amended EU laws in the area of family-friendly employment rights, gender equality and work-life balance for our parents and carers.

As the other noble Baronesses have explained, there is concern that the UK could fall behind the EU on gender equality and employment rights if we do not automatically, in a sense, have to follow EU laws. The amendment would allow Parliament to be informed on EU laws and consider whether to incorporate them into UK laws. I am sure the Minister, like the noble Baronesses who have spoken, believes that there should be no weakening of maternity or paternity rights, adoptive parental rights or the rights of pregnant and breast-feeding women, which we discussed in Committee.

I hope that the Minister will give guarantees tonight in relation to the amendment. Equality rights need continual progress and amendment. That is why it is essential that we look at what the EU is doing and whether that is something we could, and would want to, incorporate into our laws. We are asking tonight for reassurance from the Minister that equal rights, which have been hard fought for over many years, will not be watered down in any way. The amendment would continue to offer protection, as well as ensuring that women’s equality rights do not fall behind those in future EU laws. I hope the Minister will give a positive reply.

We have undertaken extensive consultations with industry and businesses. We are doing it all the time. I do it myself. We have undertaken more than 500 recorded DExEU organised engagements with businesses and civil society to find out what the concerns of businesses are. We are of course taking the feedback that we have received from them to the negotiations with the EU.

Does my noble friend truly believe that the British people voted to leave the EU with no deal, with all the implications that that has for the livelihoods and business prospects of this country? That was not on the ballot paper. We have respected the British people’s vote by triggering Article 50 and negotiating with the EU but, if it comes down to the point where we cannot get a deal, surely Parliament must be in control of what happens to the interests of our country in that scenario.

I believe that the British people voted to leave the EU and we are trying to negotiate the best possible deal to ensure that we leave the EU. To go back to our original argument for all the reasons against the amendment, I hope that the noble Lord, Lord Jay, will consent to withdraw it.

I wonder if I might remind the noble Lord, Lord Higgins, that the first referendum passed by this Parliament was in 1881 when Gladstone’s Government passed the Sunday Closing (Wales) Act. Wales was dry as a result of that until a Conservative Government decided in 1961 that the only way in which you could reverse that decision was to hold a series of referendums throughout Wales. Every five years or so there were repeat referendums in the various counties of Wales until ultimately, in 1996, it became wet again. So there is the precedent; I am a lawyer and I seek precedent. The Liberals introduced a referendum and the Conservatives decided in 1961 that you could deal with that by holding referenda.

My Lords, I think the House wants the Minister to reply, so I was thinking that we are probably ready to end this debate.

I have just heard the first case against referendums, which is that a referendum made my country of Wales dry—and that argument was in support of them. It was certainly dry on a Sunday when I was growing up; and this is the ex-director of Alcohol Concern confessing this.

We have considerable sympathy with one part of these amendments: that the Government cannot be allowed to mark their own homework regarding the outcome of the withdrawal negotiations, be that on Gibraltar, which is mentioned in one of them, our future relations with the EU or the withdrawal deal itself. We discussed last week, as a number of noble Lords have said, the need for a meaningful vote by Parliament on the deal and indeed on what should happen if the deal fails to win approval by the British Parliament. We also considered then the desire of some for a future referendum on the terms of the deal.

As the Committee knows, and as the noble Lords, Lord Wigley and Lord Newby, have said, we see it as essential that there is a proper, meaningful vote on the terms of our withdrawal. We trust that the amendment we will table on Report will find favour in this House and later, we hope, at the other end. As to what should happen if that deal is rejected, surely that must be decided at the time, in the full knowledge of the situation, by the House of Commons. It could be, as in a later amendment in the name of my noble friend Lord Campbell-Savours, by extending the Article 50 period. It might be by revoking the Article 50 notification. It could indeed be by a referendum, though perhaps the wording would be a matter for then, rather than by amendment today. But the first judgment on the terms must surely be for this sovereign Parliament and, if it says no, it must then be Parliament that takes responsibility for what should be the next step. That means nothing is ruled out, which therefore means nothing is set in stone at this moment.

My Lords, this has again been an excellent debate and let me say at the outset that I note that support for the amendments comes from noble Lords on all sides of the House. I am not trying to imply that this is a partisan issue, but it is one of principle. I hope that the noble Lord, Lord Butler, the noble Baroness, Lady Wheatcroft, and the noble Lords, Lord Newby, Lord Wigley and Lord Foulkes, who have tabled Amendments 226, 227BH and 357, will believe me when I say that I respect their positions. But this debate has been held many times before, and I therefore hope that noble Lords will forgive me if my argument sounds familiar. The referendum question, agreed by Parliament and presented to the people, was whether we wished to leave or remain in the European Union. Parliament attached no conditions or caveats to that vote.

It was clear in the campaign that a leave vote could lead to a range of outcomes and that not all of us advocating leave agreed about the way to do so. People knew this at the time, it was extensively debated and, in the biggest democratic mandate for a course of action ever directed at any UK Government, voters instructed the Government to leave the European Union.

My Lords, it is that very term—“instructed” the Government or “instructed” Parliament—that is the subject of the amendments. I am not a fan of referenda, but it is clear that what the British people were led to believe, and what they voted for in the referendum, needs at least mostly to be delivered. The question is, if what they voted for—more money, no change to the borders, very easy trade deals; never mind that nobody mentioned ending of roaming and a potential Brexit surcharge on their flights—is not what is on offer, what should this Parliament do? It is questionable that this House should agree that the British people have instructed us to do whatever the Executive manage to negotiate with the EU, irrespective of whether it resembles even closely what the leave campaign told the British people it would achieve.

My Lords, the noble Baroness says that she is not in favour of referendums but is supporting a campaign to have another one. I think we all know what her agenda is: she did not like the result of the referendum, and she does not like the result of the policy. She is entitled to have her view, but we are entitled to disagree with her.

I am not in favour of another referendum. I am in favour of parliamentary democracy and parliamentary sovereignty. The concern here is that Parliament seems to have handed over its power to the people by believing that there is an instruction from the people. If the Government were to say that there will be a free vote and a meaningful vote on whatever is negotiated, we would not need to go back to the people, because Parliament should be able to represent the national interest. I would prefer no final referendum or vote for the people, but if that is required it may be appropriate or prudent to leave it as an option.

I will do my best. I was not and am not a supporter of any Government—I am a Cross-Bencher—but the Government the noble Lord is talking about had a majority in the House of Commons at the time; the Government who are negotiating our withdrawal from the European Union do not have a majority of their own in the House of Commons.

May I point out to my noble friend that we are implementing the will of the British people as expressed in the referendum? That is what we have been debating all these many hours and days. The British people voted for us to negotiate a withdrawal from the EU and that is what this Bill is about. It is not about not respecting that, or indeed honouring the promise that was given to the British people.

My Lords, I support Amendment 150 and I have nothing to add to the memorable speeches that were made this morning, save to say to my noble friends on the Front Bench that if an amendment in similar form comes before your Lordships’ House on Report, I will, notwithstanding, vote for it.

I also ask the Minister to address the circumstances set out in Amendment 199, proposed by my noble friend Lord Cormack. Will the Minister tell us how the Government would react to the circumstances set out in that amendment? In particular, can he confirm positively that in those circumstances, the Government will give active consideration to requesting an extension of the period under Article 50? Indeed, I would submit that, given the difficulties which are becoming more apparent every single day, perhaps it would be wise to ask for that extension now and be honest with people by making it clear to them why we are asking for it. We could then reflect upon the wisdom of seeking to maintain the red lines with which we have managed to bind ourselves into an impossible straitjacket.

My Lords, I rise to support this group of amendments and I commend all those noble Lords who have tabled and spoken so eloquently to them. I too deeply regret that they are even necessary. It is hard to believe that in purporting to respect the referendum result, which the Government have portrayed as wanting to take back control, this legislation does not ensure that it is our Parliament rather than one group of Ministers that will have proper control over the future EU relationship. There must be a meaningful vote for Parliament.

We cannot accept a Bill which fails to respect the sovereignty of Parliament on an issue of such magnitude. That is how our democracy works. I support in particular Amendments 199, 216 and 217, tabled in the names of several of my noble friends, which relate to the no-deal position. We are trying to deliver what the British people voted for and they trust us to do that well. Surely, we know that the will of the people is not a no- deal outcome. Indeed, we were given in detail in the debate this morning on the first amendments a snapshot of the many disasters that could befall our country and its citizens if we lose all the benefits of the EU safeguards, protections and agencies on which their daily lives depend, as well as our industrial success.

These amendments are about parliamentary control and guarding against a no-deal outcome—just in case that is the outcome which is envisaged. Enough of the bluster and bravado; enough of those who are still saying that no deal is okay; and enough of seeming to rely on the EU to rescue us from the cliff edge before we jump because they assume that Europe does not want the damage that the no-deal outcome would do. I say this to my noble friend the Minister: please accept these amendments or bring forward an appropriate government version on Report which puts our Parliament properly at the centre and in control of protecting our national interest in this Bill.

My Lords, it may have changed since I was in the House of Commons, but can my noble friend explain to me why she thinks it necessary for this House to amend the Bill in order for the House of Commons to have a vote on anything it chooses?

It is indeed our job to make recommendations to the other place if we believe that there are issues in this Bill which go to the heart of some of the constitutional matters relating to it.

Will my noble friend remind my other noble friend that the Bill has gone through all its stages in another place? It is now before us. We have to amend it as and when we think, and the other place has to pronounce on our amendments. It is our duty to say to it, “Please think again”, if we feel that is necessary. At the end of the day, the other place will have the final word.

It is an incompatibility. There is no point in replacing one incompatibility with another. I am simply saying that if you are in the customs union and the single market, you are in the European Union. If you are out of the European Union, you are not in the single market or the customs union. It is an inevitable consequence. We are arguing for two different things.

Let me point out the scale of the problem we face. The border is not confined to the land border; it is also between the Republic and Great Britain. That side of it is ignored because if you have separate arrangements between Dublin, Holyhead, Fishguard, Rosslare and so on, and you have separate arrangements for us, that is incompatible with the core element of the Good Friday agreement—the principle of consent.

Let us follow the concept in the amendment. In addition to the negotiations with the 27, I see no good reason why we should not have negotiations involving the European Union, ourselves and the Irish Republic, in parallel with or as part of the process. With the European Union as an integral part, in that way we could perhaps narrow down and explore some of the solutions, which I hope and pray exist. I will leave it at that and thank Members for listening to me.

My Lords, I support Amendment 198, so excellently spoken to by the noble Lord, Lord Hain, to which I have added my name. I also support Amendments 215, 218 and 219. I commend the many excellent speeches made in this debate.

The Good Friday agreement was premised on a balanced approach to healing and rebuilding three sets of broken relationships. The noble Lord, Lord Murphy of Torfaen, and my noble friend Lord Patten have outlined these three groups: first, the communities within Northern Ireland; secondly, the north-south relationship; and thirdly, east-west. These three groups of relationships are intertwined and the reality is that it is a whole. If you impact one part you affect the balance of the whole thing.

There is of course an economic dimension to this but it also has an important social dimension. We have signed an international agreement committed to repairing, rebuilding and protecting the people on the island of Ireland, and to co-operation among the communities, north and south. The open, frictionless border is a crucial part of this and it simply cannot be squared with leaving the single market and the customs union unless there is full regulatory alignment.

Protecting the Good Friday agreement should be the reddest of the Government’s red lines. The Good Friday agreement is essentially about co-operation and partnership. As the noble Lord, Lord Empey, said, it has developed over time—it is not exactly the same—but that was always the aim of that agreement, and those developments need to be protected if our Government are to continue to honour our commitments and obligations to the people of Northern Ireland.

The common regulatory standards mean that business in goods and services can operate freely on the whole island. Six areas of co-operation are identified: education, agriculture, environment, health, transport and tourism. This covers pretty much everything. EU regulations govern north-south co-operation, and the noble Lord, Lord Hain, mentioned the 142 areas of co-operation which would be impacted if there were not regulatory alignment or belonging still to the single market and the customs union. When summing up, can the Minister confirm to the Committee whether this is the final number of areas identified, and how many of those have the Government identified solutions for if we leave the single market and customs union and do not have full regulatory alignment?

This is an Achilles heel of Brexit. The Prime Minister has already committed to full regulatory alignment. We have heard that the opportunity to remain, for example, in the European Economic Area would solve the east-west issue as well as helping the north-south. As we have already committed, and the Prime Minister’s words reflected, that there should be no hard border, and to reassure the people of Northern Ireland and Ireland that we are a country which upholds its commitments to international agreements, I hope my noble friend will support the amendment or bring back an equivalent on Report.

My Lords, this has been an interesting debate. I hope it has been helpful for the Minister.

I made a comment at Second Reading that in preparing for Brexit we should look at the detail—that the fine print was too important to be left to those who had no doubt—and I expressed the hope that Ministers would recognise the expertise in your Lordships’ House. Indeed, Members in the other House said exactly the same.

At Second Reading, the response of the noble Lord, Lord Callanan, expressed optimism in that regard. If ever there was a time to listen to the expertise in your Lordships’ House, it has been tonight in this debate. We have heard from a former Secretary of State, the noble Lord, Lord Hain, the noble Lord, Lord Murphy, the noble Lord, Lord Patten, with his vast experience of Northern Ireland, and the noble and right reverend Lord, Lord Eames, who made a powerful speech. We heard from my own colleagues, including my noble friends Lord Browne—he and I were Ministers together—and Lord Dubs. I feel somewhat nervous seeing my two former Secretaries of State for Northern Ireland sitting together, watching over me and looking at my back.

Noble Lords have raised pertinent issues tonight that go to the heart of what Brexit is about. The Northern Ireland Good Friday agreement was hard fought and hard won and no one in the House should doubt the importance of how well it has served us. We have had a long debate and issues have been raised tonight purely through people’s knowledge and their concern for what could happen if there is a hard border. I appreciate the points made by the Government about the protection of the Good Friday agreement. I welcome to his place the Minister who is responding tonight but at Second Reading the response of the noble Lord, Lord Callanan, did not refer once to Northern Ireland although the issue was raised several times. Clearly that was an error, a mistake, because there were a great deal of issues which had to be talked about. However, I am sure the Minister will understand the frustration at the lack of detail from the Government on what happens next.

The point was made earlier that these amendments should not be necessary. My noble friend Lord Browne of Ladyton said that we were holding the Government to account for the solemn commitment they have made and to do what they have promised to do. The Government and the noble Lord at the Dispatch Box have been clear on Northern Ireland: they support frictionless trade, they want a soft border and they support the Good Friday agreement. The noble Lord has been clear that that is the Government’s objective. What has never been clear, and has led to the debate tonight, is how that is to happen.

We heard from my noble friend Lord Hain, when he opened the debate, that there is over 300 miles of border. My noble friend Lady Kennedy said that 30,000 commuters cross the border daily—including for schools and hospital visits—over 400 commercial vehicles cross each month, and 40% of container movements to the Republic of Ireland go through Northern Ireland. There is a huge issue to address and a commitment is required—not, “We want this to happen” or “We believe this will happen”; it has to be an explanation of how we can make it happen.

My noble friend Lord Browne and the noble Baroness, Lady Suttie, referred to paragraphs 49 and 50 of the joint report produced in December, which are quite clear about why there should be no hard border, but that contradicts government commitments. The Prime Minister has referred several times to her red lines—no single market and no customs union—yet here we are talking about full regulatory alignment. The two are contradictory and that is why some of these concerns have arisen.

Most of the points have been covered in the debate and there is little of great substance that I can add, but I would like to make two points. I do not know if the Minister is aware of the follow-up letter to Karen Bradley signed by noble Lord, Lord Boswell, chairman of the House of Lords European Union Committee, on UK-Irish relations. In paragraph 52 the noble Lord accepts that,

“a degree of constructive ambiguity can be helpful during negotiations”.

He understands that, but he goes on to indicate that we need clarification from the Government of their understanding of what is involved in that December agreement. The European Union has come forward but we have not seen what the Government’s understanding is of how it will work. What does “full regulatory alignment” mean? I think I understand what it means, but the Government seem to believe something different.

The letter also refers to technology. The Government have said several times that they can deal with the border issue by using technology. There are grave doubts about that, as we have heard from other noble Lords in this debate. The letter from the EU Committee reminds the Secretary of State that,

“there is a need for realism … There is also a distinction between identifying solutions that are theoretically possible and applying them to a 300-mile border with hundreds of formal and informal crossings”—

a situation similar to that between Sweden and Norway—

“and the existence of which is politically divisive. Any physical infrastructure at the border would be politically contentious and, in the view of the PSNI, a security risk”.

In our long debate today we have not talked about the security issues, but the Minister who is to respond has to understand that unless he can provide a solution to how there will not be a hard border in Northern Ireland, there remains a security risk to those who fought the hardest to secure peace, a point made very powerfully by the noble and right reverend Lord, Lord Eames.

Finally, the ideological position on Brexit must be put to one side. In the Mansion House speech made by the Prime Minister just a couple of weeks ago, she showed that she is prepared to take what I suppose is a pragmatic eraser to some of those red lines and smudge them a bit—make them slightly pink—as she has done on the agencies. The time has come when I hope the noble Lord can give the Committee some confidence that the Government understand why these concerns have been raised. It is not good enough simply to say that this is what the Government want; they have to show the intent of how it can be achieved.

I can only apologise for disappointing my noble friend. Of course, we take very different views on the issue of our EU withdrawal, so perhaps he will forgive me on this occasion for not agreeing with him.

I thank my noble friend for giving way. Can he confirm that he said that the Government want to remain flexible about belonging to the rapid response and alert system which governs public health, public food safety and feed standards? It would seem to me that that is not something that the country or Parliament would think was an issue one could be flexible about. We need to be in that arrangement, as the noble Lord, Lord Rooker, so vividly explained.

I apologise to the noble Baroness, but I do not think I used the word “flexible” in respect of that agency. I said that the agency does some valuable work, as do a number of other EU agencies, and that is one matter that we need to discuss.
