Capital Requirements Regulation (Market Risk Transitional Provision) Regulations 2026
Regulation (EU) No. 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms (“the Capital Requirements Regulation”) provides, among other things, for capital requirements relating to market risk. Some of these capital requirements were revoked by the Financial Services Act 2021 (Prudential Regulation of Credit Institutions and Investment Firms) (Consequential Amendments and Miscellaneous Provisions) Regulations 2021 (S.I. 2021/1376). Remaining provisions are revoked by section 1 of, and Schedule 1 to, the Financial Services and Markets Act 2023 (c. 29). This later revocation comes into force on 1st January 2027 by virtue of the Financial Services and Markets Act 2023 (Commencement No. 12 and Saving Provisions) Regulations 2026 (S.I. 2026/45 (C. 5)).

Data (Use and Access) Act 2025 (Consequential Amendments and Transitional Provision) Regulations 2026
These Regulations make various amendments to legislation in consequence of sections 117, 118 and 119(1) of the Data (Use and Access) Act 2025 (c. 18) (“the 2025 Act”). Those sections establish the Information Commission as a body corporate, abolish the office of the Information Commissioner and transfer the functions of the Information Commissioner to the Information Commission. These Regulations also make minor amendments in consequence of sections 67 and 91 of the 2025 Act, and contain transitional provision (to maintain pension arrangements) in respect of the person who holds the office of the Information Commissioner and is first chair of the Information Commission pursuant to paragraph 2 of Schedule 14 to the 2025 Act.

This Order amends the Financial Services and Markets Act 2000 (Regulated Activities) Order 2001 (S.I. 2001/544) (“the Regulated Activities Order”). The Regulated Activities Order specifies certain activities and investments which are to be regulated activities for the purposes of section 22(1) of the Financial Services and Markets Act 2000 (c. 8) (“the Act”). Section 19 of the Act prohibits persons from carrying on any regulated activity in the United Kingdom, unless they are either authorised or exempt.
