Absolutely, and I am sure I speak for everyone in your Lordships’ House in paying tribute to the late Princess Diana for her incredible leadership on this, drawing attention to the issue of minefields around the world. Of course, we also pay tribute to His Royal Highness the Duke of Sussex on his recent trip to Angola to further highlight and continue the good work of his mother.

My Lords, how helpful have the Argentinians been in the clearing process? Shifting sands were always the difficulty, requiring maps and Argentinian personnel to help identify where the minefields were in the first place to allow a proper clearance programme.

A joint report was done back in 2007, to which the Argentinians contributed, but we are mindful that the sovereignty of the Falkland Islands is that of the United Kingdom. We have taken the lead and sole responsibility for all continued mine clearance.

My Lords, we have been recognised by the UN Secretary-General—among others—for our primary role in building resilience, both in the Caribbean post hurricanes Irma and Maria, and in the Pacific. As the noble Baroness may be aware, the United Kingdom and a number of other countries are leading on the resilience strand at the UN conference that will take place during high-level week later this month in New York.

On the specifics, I assure the noble Baroness and the noble Lord that we were there two years ago and subsequently we have expended a great deal of effort, time, energy and focus on co-ordination in the region, both with our overseas territories and with international partners, including our European partners: the Netherlands and France. It is as a result of that that we have seen the co-ordinated response on the ground.

However, I reflect on the words of the Foreign Minister of the Bahamas yesterday. He thanked the United Kingdom for our support and prayers, but he also said, poignantly, that there is little you can do when Mother Nature takes her course. I assured him that we as a House and a country stand in support of their efforts and we will continue to support the Bahamas, not just in providing immediate relief but in reconstruction.

My Lords, is the Minister aware of the fate of Bimini, a chain of islands in the Bahamas, which has been pulled apart by developers, who have destroyed the ecosystem of dolphins, whales and reefs? Will he take this into account when formulating a future development policy as a result of the hurricane?

My Lords, I assure the noble Viscount that we have been working across the Caribbean, not just on resilience but on the very issue that he raised about protecting natural habitats. That is why the United Kingdom within our own territories has been at the forefront of introducing marine protection areas, with 4.3 million kilometres of them around key habitats, protecting them. I will take the specific issue of the Bahamas back and if there are updates I will write to the noble Viscount.

My Lords, I concur in paying tribute to the Minister. His professionalism is illustrative of the finest traditions of this House, and we thank him.

The United Kingdom faces a raft of challenges globally. Engagement on mutual interests while confronting disagreements and upholding our values in a changing world order, where our ability to impact was once greater than it is today, is essential. Therefore, access, and keeping channels open, are critical. The UK does not agree with Russia in multiple areas. Events last year made political dialogue challenging. However, there are opportunities to advance co-operation: in the sciences, the arts, in education and in business-to-business discourse, with Prince Michael of Kent shortly to lead a British delegation to Moscow, to name but a few.

The effectiveness of sanctions is sometimes questioned. While I am an optimist by nature, I do not foresee Russia leaving Crimea any time soon, and eastern Ukraine remains an open wound. The respective chairs of the All-Party Parliamentary Group on Russia and the UK inter-parliamentary group—the IPU—unequivocally countenance no dialogue between parliamentarians at Westminster and in the Duma. Late last week I received an unexpected call from Moscow, informing me that the head of the Duma is poised to extend an invitation. Joint membership with Russia of the Council of Europe is an enabler, thus removing impediments of a practical nature, as costs would be covered.

I note that thus far in 2018-19, the German Bundestag, Italian Senate, Finnish Parliament, Irish Parliament and French Assemblée Nationale have held inter-parliamentary discourse. The time has therefore come when a missing component of the relationship, that of parliamentarians broader than the Council of Europe, should be part of an engagement and possible reset process, while remembering that a bilateral relationship is not a single preserve but the sum of all its parts.

The noble Lord is right: it was not in the last communiqué or the one before that, and it is unlikely to be in the Kigali one because, as he will know, the Commonwealth takes decisions and issues communiqués with unanimity and consensus across all 53 member states. However, as my right honourable friend the Prime Minister illustrated during the plenary session of the London Commonwealth Heads of Government Meeting, there are opportunities specifically to raise these issues, and we will certainly explore opportunities to do the same in Kigali.

My Lords, are the Government aware that the Government of the Maldives are keen to apply for fast-tracked readmittance to the Commonwealth? Given that their engagement on issues is helpful and that there are many other positive reasons, are the Government minded to support their application, ideally to be in place before the CHOGM 2020?

We of course welcome the application from the Maldives, and I have met the Maldives Foreign Minister. Their application is being processed and we all hope that it will be finalised in time for Kigali 2020.

First, suffice it to say that I disagree with the noble Lord. On the issue of our naval assets, I have already said, in response to a question from the noble Baroness, Lady Northover, that I accept that, in the changing environment in which we operate, it is important that we invest more in our defences and in the Navy. Indeed, my right honourable friend the Foreign Secretary also made this point. The noble Lord says that every diplomatic channel has been exhausted. Again, I am very saddened by what he said. I know he has insight and experience, but to my mind it is important that we keep diplomatic channels open: it is only because we have kept diplomatic channels open, working with our European partners, that the JCPOA has continued. While challenges remain on that, we are working with our European partners, through diplomatic channels, to ensure that a mechanism is in place to relieve some of the issues of the sanctions that are felt by the Iranian people.

The noble Lord raised the issue of operations. As I said, we are keeping things under review. I am not going to give chapter and verse from the Dispatch Box on every single movement of every asset of our military, nor would he expect me to do so, with his experience. There was a particular question raised about two of our vessels, which I have answered. We will keep the situation in the Gulf under review. Of course, we are not the only country; we are working in partnership with allies, including our European partners who also have assets in the region. There is one point on which I agree with the noble Lord: in the current climate it is important that we look at providing protection to all commercial vessels passing through the Strait of Hormuz. He suggested a convoy and that seems an inherently sensible proposal. It is being looked at, along with other ways of providing support and security for any vessel passing through there, but we must continue not only to support the vessels but to find a sustainable, peaceful outcome and to place emphasis on diplomatic channels. More than anything else, it is now for Iran to release the vessel “Stena Impero” and ensure that the crew are released. Several nationalities are represented in the crew of this ship, which is owned by the Swedes and flagged by the Brits, and which was in Omani waters. Iran has gone against UNCLOS. It needs to act now and release the vessel.

My Lords, I was particularly pleased to hear the commitment by the Minister to ongoing interaction with the Government in Tehran: that is very helpful. I have two questions. What is felt about where all this is heading? Is there a sense about what messages the Iranians are sending by their actions? If so, what are they, particularly in relation to the JCPOA? It would also be helpful if the Minister would confirm that these are EU-related sanctions. Intriguingly, if Brexit does indeed occur on 31 October, would the Gibraltarians legitimately enforce EU sanctions? What would happen if, on 1 November, we have left the European Union? Would the Gibraltarians be compelled to return the vessel anyway?

On the final, very practical question, my understanding is that we will be ensuring that there is no gap in enforcing sanctions, but that will require an agreement with our European partners. As I have said repeatedly on this issue of sanctions, it is absolutely inevitable and right that we continue to operate a co-ordinated sanctions strategy with our partners in Europe after we have left the European Union. Not doing so would mean that we would be unable—indeed, our European partners would be unable—to apply sanctions effectively. The noble Viscount asked a very practical question. It is certainly our intention that this will be the process, but it will require agreement between the European Union and the United Kingdom to ensure that there is no gap after we leave the EU.

My Lords, I am sure that the noble Baroness will recognise that when you take up responsibility as a Minister of the Crown, you are bound by the duties and responsibilities of that office, including by the Official Secrets Act, and that you should seek to discharge your duties in that manner. The noble Baroness is quite right to raise the issue of who is responsible. I am not going to speculate on that. The inquiry will be thorough and, if there is evidence of criminality, at that stage the police will be involved. We need to ensure that we get to the bottom of this to restore the confidence that Ministers have in the diplomatic telegrams that we receive, and so that our diplomats can continue to report in the exemplary and candid manner they do.

My Lords, this event is of course to be deplored. Is it recognised that blockchain might have a role to play in moving forward, utilising users’ parameters? What assessment has been made of the whole question of secure communications generally, and what processes have been considered to ensure that our embassies and consulates are secure, following events at the Saudi consulate in Istanbul?

Finally, do the Government agree that these simple actions, including ending harassment and intimidation of innocent civilians, would send a strong signal to the international community that Zimbabwe is on a very different path: genuinely committed to embracing democratic institutions and values; becoming a responsible member of the international community; taking steps, not one of which requires outside assistance? Can the Minister assure us that the UK sanctions regime that will apply should the UK leave the EU without a deal will truly match the measures taken by the USA and others?

My Lords, may I leave the House with no doubt whatever that sanctions which achieve their purpose are an essential tool in the arsenal?

I have studied, albeit some weeks ago, the individuals on the proscribed sanctions list, and I was initially surprised that Russians listed do not appear in a list under “Russia”. This is confusing, as they appear under Ukraine sovereignty, so Russians listed may be missed by observers. However, I place on record the courteous and informative manner in which the sanctions unit in the Treasury responds to information requests.

I was intending to speak in a more substantive way on the specifics before us on Russian sanctions, but points have been articulated by the Minister that stand on the record. This leads me to more questions than answers. The question in my mind is: where do we go from here? What are the sanctions to accomplish, and by when? What accompanying engagement is planned? Many suggest, including within this building, that sanctions without engagement could become self-defeating and lead nowhere. Do the Government believe that co-operation is more likely to come from engagement and if so, what form is that engagement taking—or are the Government of the view that the sanctions regime in isolation is the cure to all ills? I have heard it said by a trusted friend in Moscow that sanctions are mostly hurting the more fair-minded, Western-orientated Russians who support democracy, free trade and the rule of law. That cannot be good.

The Minister will be aware that a United Kingdom unilateral sanctions policy could place us at a trade disadvantage with other countries post Brexit, especially those within the European Union. While government should not necessarily be bound by such, I would expect Her Majesty’s Government to have reflected heavily upon the deliverables behind unilateral policies. It would therefore be reassuring to hear this evening that a commitment to review the policy regularly, supported by multilateral engagement, is intrinsic to this process.

There is one regrettable reality. Today is Victory Day, the solemn remembrance day of the sacrifice that the Russian people, including Ukrainians, made in the Second World War. It is a shame that people forget that we were once on the same side. That said, I was delighted that the Deputy Leader of this House, the noble Earl, Lord Howe, representing the United Kingdom Government and accompanied by the noble Lord, Lord West, were present today at the Soviet War Memorial and contributed to marking the anniversary of the Allied victory over fascism.

My Lords, I thank the Minister for his introduction to these SIs. I admit that a quote came to mind from an old trade union colleague, who used to say every year when he negotiated with his truck driver companies, “It’s déjà vu all over again”. The Minister has previously addressed many of the issues that we have raised today, as we heard from the noble Baroness, Lady Northover.

I want to come back to the specific issue of human rights, because, as the Minister acknowledged before, we placed human rights at the centre of the Sanctions and Anti-Money Laundering Act, and we in this House were responsible for raising the Magnitsky clause, which was adopted in that Act. When we discussed the last group of SIs, the Minister explained that it was the Government’s intention that,

“national sanctions in relation to human rights will be brought forward, but we will need to design and draft a statutory instrument to ensure that associated processes and structures are in place”.—[Official Report, 1/5/19; col. 1035.]

The simple fact is that we need a clear timetable from the Government. When will this be completed? What are the impediments to drafts being brought forward? It is a critical part of our foreign policy. When we come to address the specific issues raised by the SIs, I shall ask: will we extend sanctions to cover the kind of human rights abuses that the Magnitsky clause is specifically designed to address? I hope that the Minister will be able to give us a more specific commitment, rather than just say, “when time allows”, or another vague reference to the future.

On Syria, I read with interest this morning the Joint Committee’s report. I have not had a huge amount of time to study it, but I want to pick up on some of the Government’s responses, particularly to the second question on the grounds for existing licensing derogation. During consideration of the Bill in Committee, the Minister was able to facilitate a range of meetings with NGOs over that precise issue. I am very keen to hear not only how he believes that the Government have addressed the concerns of the Joint Committee but whether they have consulted with the NGOs we met before when considering the draft Bill. This is important, because we are talking about humanitarian support getting through to those most in need. I hope that the Minister will be able to address that.

Not only are we discussing these specific SIs but we are looking at the impact and effectiveness of our sanctions policies and regimes. I completely agree with the noble Baroness, Lady Northover, that we need assurance. I know that the Minister keeps talking about our co-ordinated approach, working with our close allies and that we “will continue to ensure”, but sanctions conducted simply by one country will not have an impact. They work because of collective action and because we work in solidarity. I hope that he will answer specifically the questions raised by the noble Baroness, Lady Northover, about the review dates, how we work in conjunction and, where there is an extension or a change, how we will co-ordinate that activity. What mechanisms does the FCO envisage to do that?

On Syria, I hope that the Minister will take the opportunity to update the House on what we are trying to do to achieve a ceasefire to halt the killings on all sides, and what progress we are making towards a negotiated political settlement under UN auspices.

I want to raise a specific issue relating to the effectiveness of sanctions: media reports that President Assad’s niece has been studying in the United Kingdom for a number of years. That raises questions about the effectiveness of sanctions and the ability of UK government agencies to implement them. Can the Minister tell us what discussions he has had with Home Office colleagues about President Assad’s niece, such as how she gained entry, what clearance was given and whether any consideration is being given to stopping something similar happening again?

As I have said already, in our diplomatic relations we have been clear that Taiwan is not an independent country. That is not a new position. It has been sustained over a number of years. The position of the United Kingdom, not just that of the Foreign and Commonwealth Office, is that Taiwan is an important partner; for example, we continue to have a strong trading relationship, as the noble Lord, Lord Collins said. On the more general point about our relationship with China, China is an important strategic partner, but we do not shy away from raising important issues, including human rights. A recent example is what I said during the Human Rights Council: that where we see freedom of religion or human rights being abused, we will stand up for those who are being persecuted. We do just that with China and other member states.

My Lords, is there any suggestion that China penalises any active trading partner of Taiwan for having a relationship with both states?

We already have a stated position on Taiwan, and we continue to enjoy strong trading relations. That means that at times there are disagreements. As I have already said, we have disagreements on important human rights issues. Those disagreements are there. We air them at times privately, but there are occasions when we do so publicly. However, we continue to enjoy a strong strategic partnership with China.

My Lords, I am sure that, like all of us, my noble friend heard the shadow Minister’s words about the support for the position across your Lordships’ House. It is important that, wherever we are in the world, we get behind the interim President, most importantly because he is the representative voice of the people of Venezuela. As I have already indicated, we are seeing a small glimmer of hope in the access provided to the International Committee of the Red Cross, but clearly much more needs to be done.

Would the Minister agree that Russia becomes more assertive with failing western diplomacy and when it perceives weakness? If strength is the answer, how will our policy towards Venezuela be sharpened to counter the Russian presence?

My Lords, the noble Lord, Lord Alton, has vividly set out the case that enough is enough. The horrendous number of deaths and casualties, the displaced and the lack of access to drinking water are an absolute catastrophe. As the Minister so rightly once said at the Dispatch Box, one death is one death too many.

The Saudi-led coalition’s goals remain elusive, and, while conditions on the ground deteriorate, with the humanitarian situation worsening and disease spreading, the Houthis are more entrenched, with Iranian influence growing. Good-faith negotiations on long-term political and security arrangements, with support from Secretary Pompeo for UN-sponsored talks, are welcome, but it is concerning that the December confidence-building measures contained in the Stockholm agreement for a ceasefire in the port city of Hodeidah, along with an end to the siege of Ta’izz and prisoner exchanges, faltered. Some suggest that consideration of moving forward with a more detailed road map might have been usefully addressed to assist the Stockholm process advancing.

UN special envoy Griffiths has cultivated a relationship of trust with the Houthis, which is a major asset. It will require herculean Houdini-like abilities for the United States to express itself as an ally of Saudi Arabia and in parallel manage Iran, when the Administration’s agenda is to instigate regime change in Tehran. The United Kingdom’s reputation is also tarnished by the continued supply of arms to Saudi Arabia, defying comprehension. More particularly than ever, our future policy should be to play our cards as an honest broker.

Reputational damage is enhanced when we do not take account of Germany, Spain and Denmark, supported by the European Parliament, encouraging the suspension of the supply of arms to Saudi Arabia. Is the US requesting us to continue with that supply of arms? Did I understand correctly that Foreign Secretary Hunt had requested that Germany continue the supply of weaponry and spare parts? If that was the case, by what reasoning was this request made? The Minister should offer a robust explanation of why the United Kingdom continues with this practice.

It would appear that the UK-Saudi relationship is to be placed in the spotlight, with Channel 4’s “Dispatches” airing this evening. To state that the Saudis’ continuing bombardment is an image disaster for Saudi Arabia would be an understatement. I suspect that Saudi Arabia will stop the air strikes only when the United States indicates that continuation will adversely affect the relationship between the two countries.

Then there is the question of Iran. If it is believed that Iran is part of the solution to the misery and it believes it can contribute, then engagement with that country is mandatory; however, if you think that Iran is part of the problem, a solution must be arrived at. I am pleased to observe that the Iranian political attaché has taken an interest in our proceedings by attending this debate.

With their military takeover in 2014, the Houthis are under the influence of Iran, but the report of the International Relations Committee concludes only that,

“it is known that there is some relationship between the Houthis and Iran”.

It continues that it was a matter,

“of academic difference as to the degree of that control, but our assessment is that the Houthis are very independent minded”—

and so it went on. Iran is often figure-pointed as the origin of the supply of missiles. The report noted that when the Houthis captured Sanaa they assumed control of Yemen’s stock of missiles, which included weaponry from the former Soviet Union and North Korea. How certain is the Minister about the reports that the missile attacks on Riyadh emanate from Iranian supplies?

I applaud Foreign Secretary Hunt’s past visit to Tehran and the talks conducted in Muscat. The committee’s report drew attention to Iran being in the sphere of influence but did not refer to E4 meetings with Iran about Yemen. It is important to Iran that it does not consider itself neglected. The UK has more experience than most in the affairs of the Middle East and we should not compromise our continuing ability to engage, now and in the future, with the two regional powers. Will the UK provide a draft of a statement at an upcoming meeting in Jordan, and will the Minister confirm that he anticipates it being couched in balanced and neutral terms?

Mr Griffiths, to whom participants and observers have paid tribute, has not yet visited Tehran, I believe. He might wish to consider doing so, particularly as Iranian influence in Yemen is growing significantly. This becomes more critical as Shiites in other countries embrace the Houthi cause as part of what they see as a larger struggle against Sunni predominance. With all that said, as the report rightly points out, it is for Yemenis to determine their political future. Peace must be restored but not imposed.

On a more personal note, I remember well my visits to Yemen over the years. It is a beautiful country, reminiscent to me of Arabia of old. This whole affair is tragic, and another example of where the innocent suffer with diplomacy faltering. An outcome that would not be in the interests of the West but has been seen elsewhere in the region is for additional external players to weigh in.
