I wanted to come to that point in the course of my response. On access to public funds, our position is that the MIR will prevent migrant partners from accessing public funds until they achieve settlement, when they would be entitled to access public funds should they be needed. They are not entitled to public funds on arrival, as has been said and acknowledged, but if they are destitute or at risk of destitution, if there are reasons relating to the welfare of a child, or if there are exceptional circumstances, that dynamic changes. Where we allow access, the applicant is likely to move to the 10-year route to settlement. That is where access to public funds is relevant.
The minimum income requirement has not been increased in line with inflation or real wages since its introduction, nor has it been adjusted in the light of rising numbers of migrants using the route. In that context, we have reviewed the threshold and taken the decision to raise it to match the level of income needed for someone to come here as a skilled worker—as Members will be aware, that is £38,700 per year—which ensures that migration policy is supportive of our wider ambition for the UK to be a high-wage, high-productivity, high-skill economy. That is the basis on which the level has been determined.
On the issue of consultation with the Migration Advisory Committee, we considered previous advice and evidence provided by the MAC regarding net fiscal contributions and access to benefits when we made the decision. We did not seek further advice from the MAC before making the decision to increase the MIR.
I will give way briefly; I am conscious that there are a few more points to respond to.
Why did the Minister not ask the Migration Advisory Committee for its views?
Over recent months we have commissioned work from the Migration Advisory Committee on several fronts, including currently on the undergraduate route and to carry out a fuller review of the immigration salary list. There are, then, ongoing workstreams with the MAC. To make requests of it to consider areas of migration policy is within the gift of Ministers. We will keep that position under review, as we do with the entirety of our immigration system and the policy levers available to Government.
One key element that has not been reflected in the debate is the fact that we have recognised the need to allow families the time to plan effectively and to make arrangements to meet the relevant income requirement. That is why we are implementing the increase incrementally, and why it has not been applied retrospectively. The first increase, to £29,000, came into force on 11 April. A second planned increase will take the threshold to £34,500, with a third rise to at least £38,700 taking place by early 2025. That is one of two key areas of the policy that have not been given an airing today, along with consideration of the fact that the changes have not been applied retrospectively.
The other policy area to mention is the fact that we will continue to grant permission when to do otherwise would breach an applicant’s article 8 right—the right to family life under the European convention on human rights. Such an assessment involves considering whether there are insurmountable obstacles to family life between the applicant, their partner and their children continuing outside the UK. Caseworkers consider those factors as part of the decision-making process, to ensure that we get the right decisions in individual cases and that due and proper regard is given to all relevant circumstances.
I am always happy to debate the intricacies of our policies, but the reality is that net migration is too high. This Government have a policy to bring the numbers down by 300,000 in the way that I have described. A number of changes are now in motion, having been developed and announced, but after giving people time to adjust to them in advance of their coming into force. I believe we have a responsibility to reduce the numbers, and that is what our plan is designed to achieve, but the change is not retrospective and is being introduced incrementally, while the article 8 opportunity remains in the application process for people to be able to set out their circumstances so that the right decisions can be made in individual cases.

It is a pleasure to serve under your chairmanship, Sir Gary. I thank colleagues across the House for their contributions to the debate, and I particularly thank the Petitions Committee and my hon. Friend the Member for Carshalton and Wallington (Elliot Colburn) for facilitating it. I thank the petitioners who have gone about collecting signatures to get a debate in Parliament; I am very grateful to them for their interest and efforts.
It is important that we come together regularly to debate these matters, and that there is proper scrutiny of the Government’s work in this area. This debate follows on from what I would argue was quite extensive questioning during Work and Pensions questions in the House today. There is no doubt that issues including reforming assessment processes, the role of medical evidence in decision making and other such aspects of the system are vital to the Government and to people across our society, including disabled people and people with long-term health conditions. I am pleased to be able to say something about the current situation, the steps the Government are taking to improve matters, and our quite extensive reform plans, some of which we touched on at DWP questions. I would argue that significant work is already under way.
First, I want to put the assessments in context, because when we debate these matters it is vital to set out why the Government think assessments are important. We use functional assessments to help to determine entitlement to disability benefits. Each benefit has its own assessment criteria to ensure that people receive the right level of support. All our assessments are currently carried out by healthcare professionals with clinical experience. We recognise that assessments can be a difficult experience, so we are committed to improving our assessments and acting on feedback from claimants and stakeholders. We want to make the journey time and the overall experience as good as it can be. Why would any Government not want to ensure that? Where paper-based assessments can be carried out, because there is the required evidence, that should and does happen.
Diversifying the assessment channels is an important step that has been taken in recent years. There is the opportunity for people to have a face-to-face assessment, if that is right for them and if that is what they wish to have, but there are other people who would like a telephone or virtual assessment. It is right that those routes be available to people, so that they have some involvement and choice, but of course it is important that there should be the backstop that if somebody wants a face-to-face assessment, they can have one. That came up a lot in the debate. The changes that I have outlined have come about in recent times, but they are certainly not the end of the journey; that is why we have an ambitious reform agenda, with long-term transformation at its heart, to go alongside the positive steps that we are taking now to help us reach our goals.
There has been quite a bit of debate about informal observations, which were raised by my hon. Friend the Member for Carshalton and Wallington, by the hon. Members for Warrington North (Charlotte Nichols) and for Chesham and Amersham (Sarah Green), and by other colleagues, so let me address the issue directly. Informal observations are important to the consultation, as they can reveal abilities and limitations that are not mentioned in the claimant questionnaire, in the supporting evidence, or in the history taking in the consultation. They may also show discrepancies between a claimant’s reported and actual needs. Health professionals are trained to treat claimants fairly and with respect. They are professional clinicians who use their skills in history taking, informal observation and examination to provide the DWP with an impartial, independent and factual assessment.
Of course, we want every report to reflect a high-quality, functional assessment that the Department can use to make benefit-entitlement decisions, and we do not want reports to be of an unacceptable standard. We have set for providers a threshold for unacceptable reports, above which there are performance guarantees. The DWP audits a statistically valid sample of assessment reports to ensure that the standards that the Department expects are met. Let me be clear: healthcare professionals should be clear and open about that when they assess people. If colleagues have examples where they do not believe that that has been the case, I am keen to hear them so that my officials and I can look at them carefully.
Earlier this year, we published the health and disability White Paper, which set out how we will transform the disability benefits system over the coming years. Our reforms will help more disabled people to start, stay and succeed in work without worrying about being reassessed and losing their benefits—that jeopardy that is most definitely out there. I regularly have conversations with people who want to try work, and have perhaps even identified an opportunity that they might like to have a go at, but they fear it not working out, losing their benefit entitlement, and then having to go back through reapplication and reassessment in the hope of re-establishing their benefit entitlement. That cannot be right. That is why it is crucial that the Government take forward the legislative reform that we are determined to make happen.
More widely, we intend to achieve our ambitious aims by improving the benefits system, so that it focuses far more on what people can do, rather than cannot do; by stepping up our employment support for disabled people and people with health conditions; and by ensuring that people can access the right support at the right time, and have a better overall experience when they apply for and then receive health and disability benefits. Fundamentally, it is not right that people should be written off, but of course in any civilised society there must be a safety net, whereby support is available for people when work is just not a realistic prospect or appropriate for them. It is with that principle in mind that we move forward with our reforms.
We developed the proposals through extensive engagement with disabled people, disabled people’s organisations, charities, GPs and healthcare professionals, businesses and other experts. As our work progresses, we will keep those voices at the heart of how we deliver our reforms. In fact, that engagement is ongoing, and we are beginning to progress the various work streams in the reform model. To pick up on a point made earlier, I reassure the House that people’s lived experience will be heard in that work, which will have stakeholder input, because fundamentally we want to get this right. I want the process to be inclusive, to make sure that we unlock people’s potential, to ensure that they are not written off, and to provide employment support to help people into work when that is right and appropriate for them. We want to unlock the ambition and aspiration that we know is out there among many disabled people and people with health conditions.
Ultimately, our aims will go a significant way towards reducing unnecessary reassessments and the duplication of information provided to the DWP, which is a change that I think we can all welcome. We will achieve that by legislating to remove the work capability assessment, so that there is only one health and disability assessment: the PIP assessment. That will mean that there will be no need to be found unable to work, or to be found to have limited capability for work and work-related activities, to get additional income-related support for a disability or health condition, and there will not be any of the negative connotations around people having to prove that they are unfit for work.
On a point that was raised by me, and by my hon. Friend the Member for Lewisham, Deptford (Vicky Foxcroft), what will happen to people who are too unwell to work but not disabled, and therefore not eligible for PIP? The Minister’s proposal seems to be that they will not get any help at all, but I cannot imagine that that is what he intends.
The right hon. Member will be aware that the Government have set out that there will be transitional cash protection. There was the statistical release that we undertook to make available, which has now been published. We are carefully working through what the reform model means, and how individuals can best be supported to ensure that we unlock the potential to work where that is right and appropriate for people. As I say, it is important that the transitional protection be in place as we move to the new system.
There was a question about timescales for reform. We will seek to legislate for the reform in the next Parliament; we will then roll it out in a safe, stable way, and bring about the change incrementally and gradually, area by area, to ensure that we get this right. These are live discussions as we workshop and work through specific aspects of the reforms.
I am conscious that the Chair of the Work and Pensions Committee raised quite a lot of questions; I will answer as many of them as I can. If there is anything that I miss, I will gladly follow up with the Committee.

The cost of living payments have made a vital contribution to millions of families in supporting people through the current crisis and I welcome the contribution they have made. However, the need for them does reflect, particularly following the removal of the £20 a week uplift from universal credit, the historically low headline level of benefits—at the moment, in real terms, the lowest for 40 years. What consideration are the Minister and his colleagues in the Department giving to consolidating those occasional one-off payments into the mainstream benefits— universal credit and the rest—so that people can budget with confidence, week by week?
The right hon. Gentleman will recognise that my right hon. Friend the Secretary of State has his annual review of benefits and pension levels, where all matters are properly considered in the usual way. Decisions are made and announced through those formal processes. It is worth saying in relation to disability spending more generally that in 2027-28 total disability spending is forecast to be over £41.6 billion higher in real terms compared with 2010. We are spending very significant sums of money on support for disabled people. We also have those cost of living packages of support in place for them. We will continue to be on the side of helping people through this difficult time, supporting where we can and cushioning the impacts of those challenges. Again, I invite Opposition Members to join the support for the overarching mission of this Government, which is to get inflation down and to relieve those pressures.

Commons ChamberI really appreciate my right hon. Friend highlighting the concerns raised with her by her constituent. I know she supports the fundamental change we are determined to bring about, whereby we will focus more on what people can do. We will remove what is a structural barrier to work: the impediment that means people feel prevented from trying work because of the fear that if it does not work out they will lose their entitlement and have to go back through a re-application and reassessment processes. I hope she will welcome the steps we are taking, for example to link expert assessors with particular conditions to help us to get decisions right first time, as well as the commitment we have made to reduce the assessment burden more generally.
The experiences of the constituent of the right hon. Member for Chipping Barnet (Theresa Villiers) are, unfortunately, far too common. The assessments disabled people go through often go badly wrong and the great majority of appeals against refusal succeed. It all causes immense and unnecessary anxiety for disabled people. The Select Committee on Work and Pensions recommended that all assessments should be recorded to help put things right. The assessment providers all support that recommendation. Will the Minister give the House an assurance that he will give that recommendation very serious and sympathetic consideration?
I am always grateful for the opportunity to hear from the Chairman of the Work and Pensions Committee. It is important to recognise that both the Minister for Employment, my hon. Friend the Member for Hexham (Guy Opperman), and I are set to appear before the Committee next week. What I will not do this afternoon is make specific commitments, but I can say—I have said this regularly now, including in the many conversations we have had with disabled people and various stakeholders that we want to work constructively to get the reforms right. This is the biggest set of welfare reforms for over a decade, so I am very willing to consider all views about how we can improve processes. Of course, people are able to make recordings of assessments at the moment, but we should look at that. I am very willing to do that, and to come back to the Committee formally.

There are very welcome measures in the White Paper, although a lot of the detail is still missing. The work capability assessment is to be scrapped, starting in three or four years’ time, and replaced with
“a new personalised health conditionality approach”
to assess entitlement to what the Minister just referred to as the “health top-up” in universal credit. That sounds like a new assessment of some kind. Can he tell us what it means?
I suspect that these issues will come up when I appear before the Select Committee along with my hon. Friend the Minister for Employment in a few weeks’ time. I look forward to that opportunity to delve into these reforms in some detail. The detail of our proposed approach needs to be worked through. I am clear that stakeholder engagement, working with disabled people and hearing views from this House will help to inform that. I want people to feel that they can engage with the programmes announced in the Budget, as well as with the existing provision. That will happen on a voluntary basis, but we need to move the reform forward in a pragmatic way. We will say more about it as we move forward with implementation.

Commons ChamberI am grateful to the right hon. Gentleman for his intervention. I would be happy to meet him to discuss those issues further. I am determined that Ministers will have constructive working relationships with colleagues across Parliament, and with third sector organisations and international organisations pertinent to this work, to ensure that we deliver the best outcomes possible. I would be happy to have a conversation with him about the particular point that he has raised.
We also made similar changes to universal credit and employment and support allowance in April this year.
One particular Bill reflects positively on the cross-party constructive work that has gone on. The hon. Member for West Lancashire (Rosie Cooper) brought the British Sign Language Bill to Parliament and worked constructively with Ministers to deliver it, including with my right hon. Friends the Members for Suffolk Coastal (Dr Coffey) and for Norwich North. The Bill passed into law earlier this year and will recognise BSL as a language of England, Wales and Scotland in its own right. It is also supported by a duty on the Secretary of State for Work and Pensions to regularly report on what each relevant Government Department has done to promote or facilitate the use of British Sign Language in its communications with the public.
We laid regulations in the summer to allow more health- care professionals to certify fit notes in addition to doctors. Nurses, occupational therapists, pharmacists and physiotherapists can all legally certify fit notes, reducing the pressure on NHS doctors, particularly GPs. This followed legislative changes in the spring, which removed the need for fit notes to be signed in ink.
On World Mental Health Day in October, we announced the expansion of a joint programme by DWP, DHSC and NHS England—with expenditure of £122 million—to expand the provision of employment advisers in improving access to psychological therapy services across England.
I am conscious that I need to make a bit of progress, but I will gladly give way to the right hon. Gentleman.
As the Minister is running through the things that the Government are doing, can he clarify what their intentions are on the national disability strategy? That was stuck in the courts in January. Do the Government intend to move that forward and, if so, when?
I will get to that very point. It is one that I want to reflect on briefly in my remarks. I will get there and I hope that the right hon. Gentleman will welcome what I have to say.
This voluntary service will recruit an additional 700 employment advisers to support people with common mental health conditions to improve their mental health, while also helping them to stay in or find work.
A key priority for this Government is increasing disability employment and reducing the disability employment gap. We have heard strong representations for that important objective across the House this afternoon. The Government have a range of programmes and initiatives that are supporting disabled people and those with health conditions to start, stay and succeed in work. This includes disability employment advisers providing specialist expertise and upskilling work coaches in our Jobcentres. The schemes include Access to Work and Disability Confident; and employment programmes such as local supported employment, where we are working in partnership with local authorities to support adults with autism and learning disabilities.
As a Government, we are committed to supporting all people with a disability to lead fulfilled, independent lives. That is a mission that the Prime Minister, the Chancellor, the Secretary of State and I are determined to deliver on. We are delivering a wide range of actions that will positively impact the everyday lives of disabled people—from education to transport, from housing to leisure. We are also committed to challenging unhelpful perceptions of disabled people—all changes that can make a big difference and all changes that feed into enabling disabled people to thrive.
The latest disability employment figures show an increase of 240,000 on the year and an overall increase of 2 million in work since the same quarter in 2013. Our improving lives strategy set out the Government’s goal to see 1 million more disabled people in work between 2017 and 2027, in line with the 2017 manifesto commitment. The figures released for quarter 1 2022 showed that, between quarter 1 2017 and quarter 1 2022, the number of disabled people in employment increased by 1.3 million, meaning that the goal was met after only five years. Our goal to reduce the disability employment gap remains. We will continue to galvanise action across Government and outside Government to ensure that we are ambitious about the employment of disabled people and people with health conditions. It was to that end that, last week, I went to the Jobcentre in Stratford to learn more about the initiative that we are rolling out across the country to deliver additional work coach time. That is designed specifically to help support people into work, where possible, meeting those individual needs and widening the access and availability of work coach support, which is very welcome.
Returning to the theme of innovation, assistive technology is key to our ambition for the UK to be the most accessible place to live and work. We are taking vital first steps towards our overall aim to make our country the most accessible place in the world to live and to work with technology. Advances in technology aimed at increasing disabled people’s participation in society can result in trickle-down benefits for wider society. Some advances can be especially beneficial for disabled people, as I heard about at an excellent event that was held in Parliament only last week.
To capitalise on the many advances in technology, we need to translate what is cross-party political enthusiasm and the Government’s overarching policy commitments into well-designed, evidence-based, and funded initiatives. As a first step to achieve that, we are carrying out an ATech needs assessment. That will explore the needs, demands and impacts on the lives of disabled people and help us to better understand the market capacity for procuring and providing ATech.
Also on the theme of innovation, businesses have an important role to play. Important partnerships have been formed with our disability and access ambassadors. These are senior business leaders who use their influential status to push forward improvements to the accessibility and quality of services and facilities for disabled people. New ambassadors were appointed in July 2021 and in January 2022. In total, they cover 19 private sector industries, from advertising to housing. I am committed to working with these ambassadors to shine a light on their sectors to ensure that disabled people have increased opportunities to participate in a modern, inclusive British society. I thank the ambassadors for all the good work that they do.
I now wish to briefly touch on a few of the points raised by my colleagues here, mindful of the wide variety points that have been raised during the debate. On the point about inclusive and cumulative impact assessments of social security policies on disabled people, in line with the public sector equality duty, the Government carefully consider the equality impacts of policies on those shared and protected characteristics. That is in line with both their legal obligations and their strong commitment to fairness.
On the cost of living, we have had many debates about the comprehensive support that is being provided by this Government to help to address the pressing challenges that many families across the country understandably feel at the present time. That help and support should be seen in the round. As I am responsible for overseeing this, I know that the current latest batch of cost of living payments are being made at the present time. That is welcome support and, no doubt, we will have the opportunity to talk more about cost of living support in the debates that we will have in the weeks and months ahead.
On energy, the warm home discount scheme currently provides around 3 million low-income and vulnerable households across Great Britain with a £150 rebate off their winter energy bill. We have extended the scheme to 2025-26, expanded the scheme to support 800,000 more households and reformed the scheme in England and Wales to provide more rebates automatically and better target households that are in fuel poverty.
On the national disability strategy and the court judgment, what I can say at this stage is that the UK Government strongly disagree with the UN inquiry’s findings and we were disappointed with the NDS ruling, which we are appealing. We continue to be fully committed to the convention and will be publishing our response shortly.
On personal independence payment appeals and work capability assessments, since PIP was introduced, we have made 4.5 million decisions, and only 4% of those have been changed after tribunal hearings. For employment and support allowance, there have been 3.3 million completed WCAs on ESA claims between October 2013 and December 2021, 3% have gone to complete an appeal of a fit-for-work decision and 2% have been overturned. But I am not complacent. I am determined that we will do everything we can to ensure that we focus on quality decision making and that decisions are got right first time.
There were also, rightly, comments made about Access to Work, which is a very effective scheme in enabling people to access employment opportunities and to sustain that employment. Access to Work developed the health adjustment passport, which has been rolled out across Jobcentre Plus. To support the transition from education into employment, Access to Work has delivered a passport pilot in universities. Both have received positive feedback and we are keen to go further. That is an area that I am looking closely at. Again, if colleagues have any observations or ideas, I would be keen to hear them so that I can reflect on them as part of my consideration.
The hon. Member for Rutherglen and Hamilton West (Margaret Ferrier) raised the issue of taxi and private hire drivers and disability access, particularly for individuals who are blind. Under the Equality Act 2010, private hire drivers and taxis have a duty to carry guide dogs and assistance dogs at no extra cost to the passenger. On accessible transport more generally, officials will deliver a review of the Public Service Vehicles Accessibility Regulations 2000 by the end of 2023, which will ensure that future decisions on accessibility standards are based on an updated understanding of passenger needs.
I also want to touch on hate crime, a subject that came across strongly in a number of the contributions. Speaking as someone who was a former policing Minister and victims Minister, this is an area that I feel very strongly about, as I think we all do. We must come together as one House of Commons and as a society in calling out hate crime wherever we see it, in whatever form it takes. The UK Government have asked the Law Commission to review existing criminal law for harmful communications both online and offline. Following the Law Commission’s final report, the Government are taking forward the recommended harmful communications, false communications and threatening communications offences through the Online Safety Bill.
In my role as the Minister for Disabled People, Health and Work, I am committed to driving forward the disability agenda across Government, tackling the barriers that disabled people face.
Is the Minister going to come back to the subject of the national disability strategy and tell us what the Government’s intentions are on that?
I could speak at some length on that, but I think I will write to the right hon. Gentleman as Chairman of the Committee and provide him with an update on where we are in relation to that particular point. I think that is the best way of addressing that question.
I assure the House that I will continue to work with ministerial colleagues across Government, especially as convener and new chairman of the ministerial disability champions, who were appointed in summer 2020 at the request of the then Prime Minister to help to drive progress across Government to help to improve the lives of disabled people. That commitment remains. The ministerial disability champions meet regularly throughout the year. They act as personal leads within their respective Departments, encouraging joined-up working across Departments and committing to championing disabled people.
I am keen to look at, consider and try to advance particular projects that colleagues and wider society feel would be beneficial in improving things for disabled people. I will also continue to meet with disabled people, disabled people’s organisations and disability charities across the UK, so many of whom are inspirational with the work that they do and in the example that they set.
Ensuring the voices of disabled people are heard is a priority for this Government. We continue to work closely with disabled people and disabled people’s organisations to ensure we hear from the full diversity of the community. Only this week I have met the Disability Charities Consortium, Disability Benefits Consortium and DPO Forum England to discuss issues impacting the lives of disabled people. I hope that that reassures the House about my determination, commitment and willingness to engage thoroughly and extensively. No one person has a monopoly on good ideas about the next steps we should take.
The disability unit runs multiple stakeholder networks to support and supplement Government engagement with disabled people and their organisations. Departments across Government also have their own networks specific to their policy focus. The unit is currently considering how we can strengthen our engagement with the sector even further. We stay cognisant of opportunities to consult and co-create with the sector in designing and delivering impactful policies to improve disabled people’s lives, which is our ultimate aim.
Ahead of this year’s UN International Day of Persons with Disabilities, I wish to emphasise our ongoing commitment to drive forward inclusion for disabled people at all levels of British society and continue to be global leaders in the disability space. I know that that is a firm commitment that we share across this House.
