That this House has considered the effect of recent court judgments on the cost of motor insurance.
It is a pleasure to serve under your chairmanship today, Ms Bardell. I would also like to warmly welcome the Under-Secretary of State for Transport, my hon. Friend the Member for Copeland (Trudy Harrison), to her role. I am sure that she is going to be a great success.
Today, I want to make the case for the removal of the EU rules contained in the European Court of Justice judgment in the case of Damijan Vnuk v. Zava rovalnica Triglav d.d. I would like to thank my constituent Robert Rams and the Motor Insurers’ Bureau for alerting me to this problem and providing some very helpful briefing information.
Mr Vnuk was the victim of an accident involving a reversing tractor inside a barn in a farmyard in Slovenia. He took his compensation claim to the European Court of Justice. In the United Kingdom, an incident of this nature would be covered by our compulsory employer’s liability insurance regime, but not all EU member states have such a scheme to protect employees in the workplace. In its 2014 judgment, the ECJ therefore shoehorned Mr Vnuk’s compensation claim into the EU’s motor insurance law. In doing so, it extended the scope of compulsory motor insurance to accidents on private land involving a very broad range of vehicles—essentially, anything with wheels and a motor that does not run on rails, no matter where it is used or for what purpose. This is manifestly different from the compulsory motor insurance requirement in the Road Traffic Act 1988, which applies to vehicles that are permitted to be used on our streets and roads.
The UK’s approach to compulsory motor insurance has been consistent since the 1930s. It is proportionate and it works. However, Vnuk had direct effect in EU law, and that means that it forms part of the retained EU law imported on to our domestic statute book via the European Union (Withdrawal) Act 2018. As a result of cases in the UK courts, such as Lewis v. Tindale, the UK’s compensation fund for people injured by uninsured drivers is now obliged to pay out in the circumstances covered by the Vnuk judgment.
The UK compensation fund is run by the Motor Insurers’ Bureau, and every driver who takes to our roads funds the scheme through their motor insurance premiums. The combined effect of the Vnuk and Lewis cases and the 2018 Act is that the scheme is now having to bear very significant costs for which it was never designed, and motorists are left picking up the bill. Let us be clear about what we are talking about here: accidents on private land, in private gardens, in farmer’s fields, on golf courses, inside supermarkets, in banks or in offices—the list is long. These are places where what has happened, or even the fact that anything occurred at all, will often be difficult to establish with any clarity, and that gives rise to worrying opportunities for fraud. The extension of compulsory insurance to motor sport is a further side effect of the case.
My right hon. Friend is making an excellent case, and unfortunately this Chamber cannot legislate. However, is she aware that salvation is perhaps on its way from our hon. Friend the Member for Wellingborough (Mr Bone)? He has a Bill before the House, the Motor Vehicle (Compulsory Insurance) Bill, the Second Reading of which is on 22 October, which should deal with the very point that she is making.
I am aware of the Bill introduced by my hon. Friend the Member for Wellingborough (Mr Bone). I will come to it in a moment and I hope it has the potential to solve the problem. The trouble is, can we get it through Parliament?
The extension to motorsports is problematic for many reasons. For many people who enjoy participating in motorsports the costs of the new requirement—even assuming they can get the compulsory cover, which must be doubtful in some cases—will be very high. I understand that motorsports organisations and many participants in those sports have raised serious concerns about the judgment and asked for it to be removed from UK law. Although of course we can have a legitimate debate on the potential extension of compulsory insurance and compensation schemes to new scenarios, there can be no justification for leaving drivers to shoulder the whole cost by artificially forcing these new liabilities into our existing motor insurance scheme.
The sums at stake are very large. The Government Actuary’s Department has estimated that total annual costs could rise to more than £2 billion, which would mean roughly an extra £50 on the insurance premium of every motorist in the United Kingdom. That will hit hardworking people who may be struggling to make ends meet.
Of course, £50 is an average, so a disproportionate increase in premiums is likely to fall on groups such as young drivers, who already pay more because they constitute a higher risk during their first years on the road. Businesses with fleets of vehicles will be hit hard at a time when they may be struggling already to recover from the effects of lockdown, and motorists in parts of the north of England, where in some cases premiums are higher, could also end up paying more, which would work against the Government’s laudable levelling-up aspirations.

Commons ChamberI am in regular touch with the National Farmers Union—indeed, I spoke to its representatives only today. Throughout the process of negotiating our new relationship with the European Union, and our trade agreements with the rest of the world, there will be strong engagement from the Departments for Environment, Food and Rural Affairs and for International Trade, and from the Government as a whole, with farmers and other stakeholders on those crucial matters.
I have to make progress because I know there is a long speakers’ list.
Clauses 21 to 26 on data will increase transparency and help to manage risk and market volatility more effectively, and clause 27 will help protect UK producers from unfair trading practices. The Bill enables us to make progress on our new multi-species livestock information programme. That addition to the Bill that was debated in the previous Parliament will support a game-changing initiative to strengthen biosecurity through traceability, and help to strengthen consumer confidence in the quality and safety of the food that reaches the supermarket shelf. Parts 4 and 5 include new UK-wide provisions on fertiliser and organic products, and on reform of agriculture tenancies in England and Wales. Many of those provisions will benefit farmers in every corner of our United Kingdom, delivering a fairer and more modern agriculture system.
The Bill includes new powers for the devolved Administrations in Wales and Northern Ireland, which they requested to enable them to bring forward new agriculture policy. We fully respect the fact that agriculture is a devolved matter, and we have worked closely with the devolved Administrations on this Bill. I thank them for the collaborative approach that they adopted. Where clauses cover devolved matters, we will of course seek the appropriate legislative consent motions.
Crucially, this Bill fully recognises the importance of food production and food security. In response to concerns expressed in this House, and beyond, about the previous version of the Bill, clause 17 places a duty on Ministers to report regularly on food security to Parliament. The Government are committed to boosting the best of British, and to championing our iconic produce on the global stage. Our manifesto commits us to maintaining and defending our high standards of food safety, animal welfare, and environmental protection as we embark on our trade negotiations with countries around the world.
We will give our farmers unfailing support as their businesses adapt to the bold and radical programme of change that this Bill ushers in, so that they can maintain and enhance the high standards that are the backbone of their success, play their part in tackling climate change and giving nature the space to recover, and continue their vital work of feeding the nation. I urge the House to back this historic change to agriculture policy in this country. Together we can seize this opportunity to deliver a better future for British farming, and I commend the Bill to the House.

That this House has considered the Government’s 2017 litter strategy and roadside litter.
I am delighted to serve under your chairmanship, Mr Davies. I welcome the presence of the Under-Secretary of State for Environment, Food and Rural Affairs, my hon. Friend the Member for Suffolk Coastal (Dr Coffey), who takes litter-related matters very seriously.
In his foreword to the 2017 litter strategy, my right hon. Friend the Member for South Holland and The Deepings (Mr Hayes) stated that roadside litter
“harms our economic prospects and stifles communal wellbeing.”
As well as damaging our quality of life, roadside litter and debris can put lives at risk if they blow into the road and damage the vision of passing drivers. Page 55 of the 2017 strategy acknowledged:
“The current situation is unacceptable. Our roads and highways are the gateways to our towns and cities, and yet verges, traffic islands, and roadside paths are often marred by unsightly litter. Local authorities will need to improve their own cleaning and work more effectively with neighbouring authorities and Highways England to keep such places consistently clean”.
Discarded litter is a scar on our countryside and more needs to be done to bring home to motorists how unacceptable the practice is. Does my right hon. Friend agree that deterrent sentencing is an answer, and that in the worst cases the court should have the power to endorse the licence of a littering motorist?
I agree with my right hon. Friend. We need to ensure that people know that it is a criminal offence. The courts should be tough in imposing punishments on those who cause that scar on our countryside, as he describes it.
I applied for this debate after a similar conversation with my constituent Mr Nick Spall, who contacted me to complain about litter and debris piling up along the approach roads linking the M25 with the South Mimms turn-off. He had particular concerns about the connection with St Albans Road leading south towards High Barnet, which is just outside my constituency of Chipping Barnet. He pointed out:
“Visitors to the UK will be surprised and disappointed that this cannot be kept under control at such a visible and prominent location.”
I raised that complaint with Highways England, which told me that Hertsmere Borough Council was responsible for litter clearance on the roads concerned. Hertsmere Borough Council informed me that the general area was litter-picked on a weekly basis, but that several sections could not be safely accessed without traffic management measures, and that they could take place only if Hertfordshire County Council had road closures planned.
That illustrates the first key issue I wish to raise with the Minister. If we are to tackle the litter that we can see through our car or bus windows every day, we need to address the problem of divided responsibilities and introduce clearer lines of accountability. That point was made by Peter Silverman of the Clean Highways campaign, and I would like to take this opportunity to thank him for the briefing he provided for the debate and for his determined work to highlight these important matters.
