I have secured this debate today because I really hate litter. It disfigures our parks, pavements and streets; it damages our beautiful countryside and harms our environment; it is a disaster for our oceans and waterways; and it costs hundreds of millions of pounds to clear up. It seems to get everywhere—it has even, on occasion, been present in this very Chamber. As I revealed to a shocked audience in a Westminster Hall debate in 2018, I found a discarded Crunchie wrapper just feet away from where I stand now, so it a universal problem that needs tackling.

On a more serious note, one of the most disturbing impacts of litter is on wildlife. The Royal Society for the Prevention of Cruelty to Animals receives hundreds of calls every year reporting the harm done to animals and birds by carelessly discarded items—suffocated by plastic bags, entangled in plastic can holders, trapped in cans or injured by sharp edges—and who could fail to be distressed and moved by the pictures we have seen on our TV screens of marine life choked on plastic or drowned by discarded fishing gear?

Government figures from 2018 indicated that every year more than 150 million tonnes of plastic waste enter the world’s oceans and 1 million birds die from eating it or becoming tangled up in it. There are other figures indicating that the problem may be even worse. The situation is intolerable and we must take action.

Litter problems intensified during lockdown, when dumping food and drink packaging in parks seemed to reach epidemic proportions. I found it depressing to see Oak Hill Park in my constituency strewn day after day with Costa Coffee cups. During lockdown walks, I also noticed that the rubbish at the roadside of the A1 where it passes close to my constituency was appalling—feet deep in some places. I am sure all Members of this House are aware of the grave harm caused by fly-tipping, the most extreme form of littering. It has been a particular problem in St Albans Road in High Barnet but, regrettably, it occurs on many streets and in many open spaces in my constituency. This blight on our communities must be tackled, and I know Ministers are determined to do so.

Change is on the way. In 2017 the Government published England’s first ever national litter strategy, setting out how they planned to deliver the aim of substantially reducing littering within a generation. The Environment Act 2021, which I was privileged to present to this House, paves the way for important action on the matters we are considering in this debate.

First, it will allow digital tracking of waste, providing important new ways to hold to account those responsible for disposing of our rubbish. Secondly, it contains new powers to tackle fly-tipping. In my time as Secretary of State, I was privileged to help set up in 2020 a joint unit bringing together law enforcement agencies, environmental regulators, His Majesty’s Revenue and Customs and the National Crime Agency in the war against fly-tipping and waste crime. Thirdly, the Act will pave the way for extended producer responsibility. EPR is a scheme to ensure that the companies that produce plastic packaging meet the full cost of disposing of it. The goal is to incentivise a reduction in the volume of packaging used and ensure that more of it is recycled. EPR will also create a new income stream to help local councils deal with the cost of disposing of rubbish and tackling litter.

The Department for Environment, Food and Rural Affairs estimates that packaging producers will need to pay around £1.2 billion a year in EPR charges, which will go to councils. I want the Minister to assure the House that that important scheme is on schedule and that it will mean more council staff out clearing up our streets, funded by the companies whose omnipresent packaging makes up such a large proportion of irresponsibly discarded rubbish—especially food outlets. The Government said that they wanted the scheme to start in October. Will that happen? If not, when will it be implemented? A commitment to EPR was made back in 2018. Let us get it done.

I make the same simple point about the deposit return scheme for drinks containers. That is another crucial part of the Environment Act, and it should significantly reduce the number of bottles and cans that are thoughtlessly discarded. I acknowledge that there are complexities here. The mess that the SNP has made of its DRS in Scotland shows that we need to take care and get the scheme right on a technical level. In particular, it is important that we resolve the VAT issue that has arisen, and I hope that the Minister will confirm how the Finance (No. 2) Bill proposes to do that. A deposit return scheme would be popular. It is a manifesto commitment, and many other countries have been operating such schemes for years. DRS projects have been very successful around the world in incentivising a responsible approach to disposing of drinks containers. Let us get this done; let us make DRS happen.

I thank my right hon. Friend—my very good friend—for allowing me to intervene. I seem to recall that when I was a child, which was quite a long time ago now—[Interruption.] You are nodding sagely, Mr Deputy Speaker. One of the things that we used to get extra pocket money for was picking up bottles and taking them back to the store. I seemed to get quite a good income stream from that. It would be very nice if that sort of scheme were reintroduced. Does she agree?

I do indeed agree. For many years, that kind of scheme was a feature of life in Britain, and I know that many would like to see its return. That is one reason why I have raised it in the debate.

There are other ways in which Government policy could step up the campaign against litter. More could be done to enforce the law in that area. Clearly, financial penalties should be issued only in appropriate and proportionate circumstances, but they are an important tool in the box for achieving the goal of litter reduction. There have been welcome steps forward on enforcement. Fines have been increased and rules clarified to make it more straightforward for councils to issue them. The Government have also changed the law so that if there is evidence of litter being thrown from a car, the registered keeper of the vehicle can be liable for a fine. It is no longer necessary to prove that they were driving the car at the time.

However, there is a strong case for greater use of cameras in enforcement. There are about 11,000 automatic number plate recognition cameras around the country to monitor vehicles and track stolen cars and movements by criminals. Why can we not use them to catch a few litterbugs as well? Prompted by my constituent Phil Little, I raised that in a parliamentary question two years ago. The Minister at the time responded that ANPR cameras are not suitable for use in that way. I find that hard to understand. When the use of cameras can be the basis of fines for so many traffic offences, why not for chucking rubbish of a car window?

I welcome the news that the Department for Transport will soon trial the use of CCTV to capture evidence of people littering or fly-tipping in lay-bys. It is good to know that National Highways is at last looking at whether automatic number plate recognition can be used to catch litter offenders. I also welcome last year’s announcement by the Department for Environment, Food and Rural Affairs of £450,000 for CCTV, ANPR and rapid deployment cameras at hotspots to reduce unlawful dumping of rubbish and to provide evidence to identify the offenders responsible for it. I genuinely welcome the fact that my plea for the use of litter-cams two years ago seems to have been heard, but I emphasise that we need to see tangible progress on the trials and pilot schemes, especially on our road network.

Roadside litter can cause serious accidents, and collecting it can be hazardous. As dedicated campaigners such as John Read of Clean Up Britain point out, there are some truly appalling litter hotspots on our strategic road network. Cameras are part of Mr Read’s 10-point plan to tackle the problem, including greater use of dashcam footage. I too believe that cameras could be a powerful new weapon in the war against litter. Let us start using them.

I come now to action against commonly littered items. I am proud to have been the Secretary of State who extended the plastic bag charging scheme, which has seen their use drop by over 97% in major supermarkets and so must have reduced the number of bags littered, but let us go a step further and ban disposable barbecues as well. They are a fire hazard and can cause injury. It is truly appalling that people simply leave them behind after a day out, and tragic that they are left on some of our most beautiful beaches and our greatest beauty spots. Even a farm in my constituency has had to contend with this problem.

Can we have more concerted action on chewing gum? I welcome the establishment of a chewing gum taskforce, bringing together producers to invest £10 million over five years in cleaning up gum staining and encouraging responsible disposal. The reality is that chucking this stuff away is a truly vile and antisocial thing to do. It does significant damage, including getting matted in the fur or feathers of animals and birds. Can we learn from other countries in taking a really tough approach to the scourge of littered chewing gum?

What will Ministers do to ensure that tobacco companies take responsibility for the fact that cigarettes are by far the most frequently littered item in the country? Even as the number of smokers continues to fall, any litter-picker will tell us that if we look at the ground in more or less any public place on this island, we are likely to spot a cigarette butt somewhere close by.

Another key means of cleaning up Britain and keeping it free of rubbish is behaviour change. Over the years, many of my constituents have told me how important it is to push out effective communications to convince people of the simple message that they must take their little home with them and put it in a bin. I know that Keep Britain Tidy runs some very effective DEFRA-funded campaigns, such as its “Keep it, Bin it” campaign, but can we do more? What about a new litter awareness course, as advocated by Policy Exchange in its “Litterbugs 2.0” paper? The national speed awareness course is widely recognised to play an effective role in changing people’s attitude to speeding by educating them about its consequences. We should consider adopting the model in this context, too.

Will the Minister tell us what progress has been made on plans to use so-called geofencing at roadside litter hotspots, to drive anti-litter messages to the devices of people physically in those locations? Behaviour change messages aimed at commercial drivers, including overseas lorry drivers, are also important. The rubbish that collects around some truck stops shows that driver education is needed. It is also vital to ensure that loads are secured properly, so that rubbish does not blow off and become litter. A constituent of mine, Julian Dench, who came to see me recently to discuss these issues asked that more research be done into who is responsible for littering and why they do it. I ask Ministers what research is being carried out, particularly on how to persuade children and young people not to drop litter.

One only has to walk past some of the schools in my constituency to know that the problem of litter is, I am afraid, sometimes linked to children and young people, although I am sure that the majority would not indulge in this conduct. I therefore welcome the eco-schools programme funded by the Government, which includes litter as well as wider issues around sustainability, waste and recycling. We all know that in recent years, there has been a huge wave of concern about the environment among the younger generation. We must find a way to capitalise on that and explain that one of the most tangible and instant ways in which children and young people can safeguard our environment is to take their litter home and put it in the recycling bin. That is a message that I try to take to all the schools I visit, especially when I receive questions and points from students about plastics pollution in our oceans, as I almost invariably do.

That brings me to the topic of marine litter. As was shown so clearly by the BBC’s “Blue Planet” and, more recently, “Wild Isles” series, we have a plastics crisis in our oceans. We must stop the appalling outflow of plastic and other rubbish into the sea—we cannot let it continue. I know that the Government are putting a huge amount of effort into that goal, and the EPR and DRS schemes I mentioned earlier in my speech should provide further help once they are operational, but much of this problem comes from other countries, so only truly global action will fix it.

I pay tribute to the work that Ministers have done on the international stage on this issue. The UK can truly be said to be a global leader in ocean protection, with 38% of UK waters in marine protected areas. The Government also played a crucial role in establishing the Commonwealth Clean Ocean Alliance to lead international efforts to tackle plastics pollution, and helped secure commitments on protection of the marine environment at last year’s COP15 conference on biodiversity in Montreal. Together with our overseas territories and dependencies, we in this country are responsible for one of the largest marine estates on the planet, and working with those territories we have introduced protection zones covering over 4 million sq km. That is quite an old figure; the current one may be greater. I believe it is reasonable to say that no other country in the world is doing more to stop litter polluting the marine environment.

In conclusion, I pay tribute to the street cleansing staff in Barnet and other areas who are working for councils across the country on the frontline of the battle against litter. So, too, is the army of volunteers who turn out to pick litter in their community. I have had the privilege of joining many such groups over the years, including—to mention just a few—Green Beings High Barnet, the Barnet Society, the Dollis Brookers, the Pymmes BrookERS, and most recently the Barnet residents association. The Great British spring clean and the Great British beach clean see those kinds of groups head out all over the country to tidy up their communities, many of them supported by the high streets community clean-up fund. I thank all those volunteer groups, and I thank Keep Britain Tidy, which does so much to make those litter picks happen.

As I have said many times in this Chamber, all of us who are privileged to serve here should strive to protect the natural environment—few tasks should be more important to any Member of this House—and combating the scourge of litter is an important part of doing that. It can also play a crucial role in levelling up our country and restoring pride in our towns and cities. Litter is an eyesore that blights our communities and damages our global reputation, so let us do everything we can to prevent it, so that we can safeguard this beautiful country that all of us are lucky enough to call home.

My response is that this legislation opens the way for all who have reason to believe that an object owned by their family member is in one of our national institutions. It is not confined to helping people from a particular family background. It really is important for people at all levels to have the chance—the opportunity—to retrieve an item of property that once belonged to one of their relatives. In response to those potential critics that my hon. Friend has mentioned, I think that I would continue to make the case that it is right and proper and fair that if an item was seized by the Nazis, it should be returned to its rightful owners or to their heirs.

May I ask my very good friend whether the Bill has any provision for the people who looted this treasure, took it away and then presumably sold it on, or possibly gave it away, because they were acting illegally? Personally, when I have come across looted churches and mosques, I have been involved in securing that property and making sure that treasures are kept there until someone responsible can take possession of them. I am concerned that these people seem to have got away with just stealing this stuff.

I am grateful to my hon. Friend for that intervention. No, I am afraid that the scope of this Bill is defined and narrow and relates to specific circumstances to enable our national museums to return looted property. However, there are provisions within the criminal justice system and the system of international law that are aimed at bringing to justice those responsible for crimes committed during the Nazi era.

The goal of those behind the holocaust went even beyond mass murder and mass killing. The evil men and women responsible also wanted to wipe out all traces of Jewish culture in Europe, and confiscation of property was a significant part of that repulsive project, so returning books and artworks covered by the legislation is not really about their monetary value. It is about restoring to people a tangible physical link with a lost loved one, and it is about the conservation of memories and culture that the Nazis wanted to eliminate.

My Chipping Barnet constituency is home to a number of holocaust survivors. I pay tribute to all of them for their courage and dignity and for the work that so many of them do to recount their stories to try to ensure that we never ever forget what happened. We owe it to them to enable this small recompense—the return of cultural property—to continue.

I am very grateful to the hon. Lady for her support for the agreement. As the Leader of the House said, it is crucial that we see support in all parts of the House for this agreement, which will signal a way forward for the devolved institutions.

The hon. Lady kindly mentioned the Irish Government. I share her sentiment that Minister Flanagan and the Irish Government have played a very important role. Indeed the process was also strongly supported by the US Government, with Senator Gary Hart playing a constructive role throughout, which was much welcomed.

The hon. Lady asked about the differences in the welfare system. The proposal in this agreement, reflecting the Stormont castle agreement back in December, is that the system applicable in GB will apply, but benefits will be topped up by the Northern Ireland Executive drawing on funds from the block grant. Under this agreement, rather than write that all in advance, a fund has been agreed and a panel will be set up to decide how to allocate those funds, but one of the areas to which those funds will be devoted relates to the social sector size criteria.

The hon. Lady asked about the programme for making savings in error and fraud in welfare. I believe that that could save significant amounts of money and the Northern Ireland Executive believe that it will save very substantial amounts of money. The agreement makes it clear that half of any savings resulting from this can be shared by the Northern Ireland Executive and used for whatever purposes they deem appropriate.

The sunset clause is an important part of the legislation that we will consider next week. These are exceptional circumstances; we must urgently take action to enable the Northern Ireland Executive’s finances to be put on a sustainable basis, but there is no justification for the powers to be extended into the future. The key challenge comes in the next year or so, and that is why the sunset clause has been inserted.

In relation to the hon. Lady’s question on the scale of paramilitary activity in Northern Ireland, I direct her to the assessment we published a month or so ago making it clear that, very unfortunately, members of paramilitary organisations in Northern Ireland are extensively involved in a range of criminal activities, such as drug dealing, money laundering and in some cases murder as well.

May I add my thanks to Peter Robinson? I met him first in 1970, when he was an aspiring politician and I was aspiring to be a halfway decent infantry officer. I liked him then. He is honest, he is straight, he knows how to talk to soldiers, and he is in no small part responsible for the decent situation we now have in Northern Ireland. I thank him, with all my colleagues, for what he has done in his work.

I am delighted to associate myself with those comments. Peter has done a huge amount of work for the good of Northern Ireland. He has achieved many things in his long career in public life, and Northern Ireland is the better place for his input into public life and politics there over four decades.

It will not surprise the hon. Gentleman to hear that I am unable to speak for Sinn Féin—no doubt it will provide its own response to the report—but I also take issue with him, because I am not trying to put any spin on the assessment. Today of all days, we need people to read the report and consider it objectively. Yes, there is a great deal in it to be very concerned about, but we need to use it as an opportunity to reflect on how we deal with the problem and on what more needs to be done to ensure that Northern Ireland makes progress. I have acknowledged that the situation is serious and that the task will not be easy, but I think that it is a task that can be achieved. Northern Ireland’s leaders have shown in the past that they are capable of grappling with this very difficult kind of issue.

When I was the intelligence officer in Londonderry, the discipline among paramilitary groups such as the Ulster Defence Association, the Ulster Volunteer Force, the Irish National Liberation Army and the Provisional IRA was hugely effective. The independent reviewers have clearly suggested that the leadership of such organisations are not necessarily in control of what their members are doing. I suggest that our security services should be putting huge efforts into dislocating and separating these maverick members of paramilitary organisations from their leadership, who say that they have nothing to do with the upsurge in violence.

It is certainly clear from the assessment that in many cases the leadership of the various organisations do not control or sanction what their members get up to, but I can assure my hon. Friend that Northern Ireland has an outstanding police service, supported by the intelligence services, and they will pursue crime wherever they find it. They do a fantastic job. They will pursue the individuals responsible for the sorts of crimes outlined in the report with as much vigour and determination as they pursue anyone else involved in wrongdoing in Northern Ireland.

It is important that the Executive give proper consideration to those and all other assets of a similar nature, but it would not be right for me to prejudge what sale proposals the Executive might develop. Each asset will be considered in relation to the provision in the agreement’s financial annexe.

I add my voice to those who are congratulating my right hon. Friend, her team and everyone involved in getting agreement at Stormont House? It is fantastic.

I am pleased that there is to be a new historical investigations unit. Will my right hon. Friend reassure the House that the investigation will continue into what happened to the late Captain Robert Nairac GC and where his body might be located?

I reiterate my sympathies and condolences to Robert Nairac’s friends and family, who must feel the pain of their loss even after so many years. Of course, a process is already in place for seeking the remains of the disappeared, and I do not think it would necessarily be impacted on by the HIU’s work. However, as part of the implementation process, we will work out how it will interact with existing bodies.

I thank my hon. Friend for his kind words about the achievement of this agreement. There were many people who said a Conservative-led Government could not do this kind of thing. Well, they have been proved wrong.

I certainly give the hon. Gentleman the reassurance that I will continue to be very strongly involved with the parties, the Irish Government and Dr Haass, as well as with friends across the Atlantic who have taken a close interest in the process. I thank the hon. Gentleman for his kind words about my involvement and that of the Prime Minister.

The hon. Gentleman is right to raise the issue of implementation. Even had there been full agreement on new year’s eve, there would still be a lot of work ahead to turn Dr Haass’s proposals into legislation and into new institutions operating on the ground. The UK Government, the Northern Ireland Office, officials and I are very keen to work on the practical implementation process. Not least because of our current responsibilities in relation to parading, we are very keen and eager to input into the process of implementing any agreement if, as I hope, it can be agreed between the parties.

Speaking as someone who has lost friends, and not just soldiers, in Northern Ireland—as have so many friends who represent Northern Ireland constituencies—how can my right hon. Friend balance the competing claims of the requirement to find out what happened to so many people who were cruelly murdered and the requirement to encourage people to come forward, perhaps with limited liability, so that we can find out what happened to the many people who have simply disappeared in Northern Ireland?

Clearly, those matters were at the heart of the work of the political parties and Dr Haass. My hon. Friend will be aware that the idea that was floated of a general amnesty was almost universally rejected. The current proposals include a limited immunity, whereby to encourage people to take part in the truth recovery process, their representations and statements would not be admissible in subsequent criminal proceedings. That is not to say that subsequent criminal proceedings could not go ahead on the basis of other evidence. It was clear from what was said by pretty much all the political parties and the public reaction to the statement of the Attorney-General that the option of prosecution must be kept alive. The proposals that are on the table do not seek to take that option away.

Obviously, and thankfully, the Army was not called in to support the PSNI. May I ask my right hon. Friend whether there remains an infantry unit in theatre that could do such a role if required?

The hon. Gentleman is right. We should not forget everything that has been achieved by the peace process. He is also right that there is no excuse for violence, regardless of social background. It is important to recognise that although there are problems with sectarian division in Northern Ireland, there are many people who no longer share those sectarian views and have left them behind. We need to ensure that that becomes more broadly based across the community.

The House is still in shock about the death of the prison officer David Black. The second incident on 30 December sends us again into shock. It is an appalling regression to what might have happened in the past, and let us hope that we can get a grip on it. May I ask my right hon. Friend whether there has been evidence of weapons either being seen or used in the riots in Belfast?

As I said in my statement, in one incident shots were fired at the police. My understanding is that the rounds were blank, but I am afraid that there is a ballistic threat in relation to these riots.

Attack planning by these terrorist groupings continues. The level of threat in Northern Ireland remains at “severe”. These groups possess lethal intent and we remain vigilant. The Police Service of Northern Ireland and its partners are working strategically to tackle the threat, to keep the people of Northern Ireland safe and secure.

In view of the continuing activities of the IRA under a new guise—the “new IRA”, and indeed the Continuity IRA—can my right hon. Friend assure me that she has done as much as humanly possible to identify long-term hides of weapons?

The PSNI and its partners, including the Garda Siochana, are focused on suppressing terrorist activity. They are absolutely determined to keep people in Northern Ireland safe and secure. That means combating the efforts the terrorists are making to access weaponry, whether by seeking to import them, steal them or access hides from the past. This is an important priority for the PSNI, and it has the full support of Her Majesty’s Government in the brilliant work it does on these matters.

I can reassure the hon. Gentleman that the Government remain vigilant on the terrorist threat; we are taking it extremely seriously. As he will see as my remarks conclude, we believe that tackling the terrorist threat effectively requires not just a security response, but a wider strategy designed to choke off any potential support for the so-called “dissident groupings”. I think there is widespread acceptance that securing a prosperous Northern Ireland and breaking down sectarian barriers is also an important way to respond in order to eliminate the terrorist threat on a long-term basis. As I say, I will come back to that subject later.

The threat level in Northern Ireland remains “severe”, meaning that an attack is highly likely. No alteration has been made to that Security Service assessment, although, as the right hon. Member for Belfast North recognised, the threat level in Great Britain has been adjusted. We remain vigilant in both Northern Ireland and Great Britain, because the terrorists have capability and they have lethal intent. This year has seen 22 national security attacks in Northern Ireland. Although some may have lacked sophistication, they all had the potential to be deadly. Many involved crude pipe bombs, primarily used to target PSNI officers or their families. The right hon. Gentleman highlighted an attack in his constituency, and another particularly reckless attack was the abandonment of a large improvised explosive device containing more than 600 lb of home-made explosive near the Irish border at Newry—the device was successfully defused, but if it had detonated, it could have led to a significant loss of life. Terrorists continue to seek access to funding and weaponry, and they have been undertaking training as well as targeting. Both republican and loyalist groupings are still involved in a range of criminal activities—mention has been made of this—to fund their activities and individual lifestyles.

Is it possible for my right hon. Friend to say publicly where the main sources of funding for terrorism are coming from?

My hon. Friend will appreciate that there is a limit to what can be said publicly, but there can be no doubt that these criminal activities are playing a significant part in funding terrorist activities.

The republican and loyalist groupings also continue to carry out paramilitary-style assaults on members of their own community. Such attacks are sickening and show a complete disregard for the victims and their families. Terrorists also seek to capitalise on any instances of public disorder or unrest. During rioting in north Belfast on 12 July a number of shots were fired at police officers. That should be considered as nothing less than the attempted murder of police officers, who were there simply to uphold the law and protect people from all parts of the community. I would like to assure the right hon. Member for Belfast North that the PSNI gives the highest priority to protecting the safety of its officers. Indeed, one way in which the £200 million that the UK Government allocated as additional spending to counter the terrorist threat is being deployed is in enabling the PSNI to enhance measures to protect its officers. Measures to protect police officers are, of course, kept under constant review by the PSNI. The Chief Constable takes all the steps he can to protect his officers from the terror threat they face, while retaining his firm commitment to community policing.

The right hon. Gentleman emphasised the importance of the home protection scheme. As he said, the Northern Ireland Office has important responsibilities in relation to the scheme, and we keep those under constant review, too. Our scheme exists to protect people in certain occupations or positions in public life who are assessed to be under “substantial” or “severe” threat. The Minister of State considers other applications where an individual is assessed to be under a real or immediate threat, under our obligations under article 2 of the European convention on human rights. The PSNI also runs the criminal threats scheme and home security aid scheme, in addition to the Northern Ireland Office’s programme. A range of security measures are provided depending on the threat in each case—I am afraid that it would not be appropriate for me to go into detail.

I am certain that in making decisions on personal protection weapons, the PSNI will have careful regard to the security issues relating to not just present members of the Prison Service but to former members. I am confident that we have a process that is rigorous in assessing those risks and I am sure that they are taken into account by the PSNI. My hon. Friend the Minister of State will also consider them in the appeals process.

May I remind the House that it is not just about police officers and prison officers? Sometimes people work more indirectly for the Prison Service or military; they might be a civilian driver, educate the children of people who work there or provide a service, such as cleaning an establishment. Those people are under threat, too, more often than we realise.

I am confident that the PSNI will carefully consider the risks associated with anyone who applies for permission to have a personal protection weapon, whether they carry out the roles described by my hon. Friend or are involved directly in the Prison Service or PSNI.

As I have said, we believe that the trial has been positive so far, but it would not be appropriate for me to pre-judge the results before they have been properly assessed.

By way of further reassurance on this issue, clause 80 secures the same outcome as amendment 11, by inserting a new section 21I into the Aviation Security Act 1982, which will require the CAA to provide aviation security advice to airports, airlines and other groups. That would, if the CAA considers it to be appropriate, include advice on security checks on passengers wearing religious clothing. Therefore, although amendment 11 has provided a valuable opportunity for the House to discuss the matter, the Bill already provides for the outcome that it seeks. The Government will continue to engage with both the Commission and other member states with a view to finding a long-term solution to this important issue.

Let me turn to an outcomes-focused risk-based security regime. I welcome the words of support in principle for that direction of travel which we heard from the hon. Member for Barrow and Furness (John Woodcock). We have put together a joint Department for Transport-CAA team with the relevant skills and knowledge to develop, trial and implement the new regulatory regime. We have consulted stakeholders and hosted several interactive events with industry to explain our position. A range of trials will be carried out applying the new regulatory approach. We are conscious of the importance of retaining staff, if we can, when the posts are transferred from the Department for Transport to the CAA. We are working to ensure that we retain those staff when the posts are transferred.

The hon. Gentleman has made points about secondments in the past. We do not see a major difference being made to the retention of staff when a secondment ends, although we certainly do not rule that out as part of our strategy for retaining expertise. To respond to the points that the shadow Minister made, we agree that we are talking about a significant change to aviation security. To respond to the hon. Member for Blackley and Broughton (Graham Stringer), we believe that this move could reduce costs for industry, but that is certainly not the driving factor. The paramount priority must be to ensure that aviation security remains robust at all times. I believe that moving to a more outcomes-focused and risk-based approach could well enable us to deliver higher standards than apply currently, as we will be giving the airport industry more opportunity to develop innovative ways to deliver security outcomes and apply principles of continuous improvement. We are absolutely certain that we must in no way allow the security standards applied currently to slip. We are confident that that will not happen with an OFRB approach, and we believe that the reforms we are proposing could make passengers in the air even more secure than they are today.

Training is crucial, and we have to ensure that it is as good as it possibly can be. Speaking as someone who has been involved in such security matters, I can tell my right hon. Friend that the real problem is that people lose focus if they do the job for a long time. Training can help with that. We must ensure that our training is good and that it includes keeping a focus on the job when it can sometimes become repetitive and boring.

My hon. Friend makes a good point with which I completely agree. He also made an important point earlier, which is that some variation in the way security is delivered in different airports can assist in maintaining the highest standards of security, because it injects a further element of unpredictability, which can help us frustrate the evil intentions of those who would do us harm.

In addition, we also see an advantage to the aviation industry of moving to a system that it can run more efficiently and, we hope, in a more passenger-friendly way. When we respond to the consultation on such security, we intend to provide as much detail as possible about how the new approach will work. I cannot support the proposal in new clause 3 for the Secretary of State to be obliged to require the approval of each House before such measures could come into force. I fear that that would slow down reform and could jeopardise our ability to respond swiftly to security threats. The Secretary of State intends to take forward the reformed approach to aviation security under powers in part II of the Aviation Security Act 1982.

Part II gives the Secretary of State the power to give directions to industry for the purpose of protecting civil aviation against acts of violence. The Secretary of State's decision-making powers do not require the approval of Parliament before they can come into force. Changing that as proposed by the new clause could damage our ability to keep passengers secure. Directions from the Secretary of State often contain security-sensitive information which, if widely disclosed, could be used by people who mean to do us harm. Obtaining the approval of the House via secondary legislation inevitably takes time, even with the most efficient business managers in charge of Parliament’s agenda. Aviation directions sometimes have to be made quickly to respond to new threats—in some cases, within a matter of hours or days. For example, swift action had to be taken in response to the liquid bomb plot. If it had been necessary to recall Parliament so that the matters could be debated by both Houses it would have been impossible to respond effectively.

The House will also recall the printer bomb plot in October 2010, when it was necessary to place emergency restrictions on air cargo very swiftly. If the Secretary of State had not been able quickly to ban certain consignments, it could have left us exposed to similar attacks. I am sure that the Opposition would not want that, so I hope that they will consider withdrawing the new clause.
