My hon. Friend is a strong champion for Chelmsford Prison. I believe that she has visited it on almost a dozen occasions, and I know that the staff there are grateful for the close interest she takes. She will forgive me if I am not at this point tempted into making spending announcements—especially in the absence of a Chancellor of the Exchequer at the moment—but I think both sides of the House would agree that it is important that our prison officers and others who work in our prisons in the custodial estate have the support and the tools they need to do their job effectively.

I understand that the suicide rate for boys aged 15 to 17 in custody is about 18 times greater than the rate for their counterparts in the community. Why is that?

The hon. Gentleman highlights an important point that links in with points made by other hon. Members—namely, that those in the cohort of young people in custody are not only the perpetrators of serious crimes but often the victims of crime who in many cases suffer from mental health challenges or a range of other issues. If we overlay that with the constraints of a custodial environment, that is extremely challenging, which is why we are working hard to divert young people and others, where appropriate, away from custody into community sentences and towards the support and medical support they need. Within custody, we are working to improve conditions and ensure that the support is there to drive down the self-harm and suicide rates, but it is also vital that we remain focused on the longer term and on the current Government’s approach to changing the nature of youth custody, where it does have to occur, and moving towards a secure schools model.

I am glad the House has a chance to think about this again. I also remember Rob Marris’s Bill, which I voted against not because I was not sympathetic to the issues but because there was a lot of division among people in my constituency. The question of safeguards came up repeatedly, as I recall.

What has changed since then, as the Assisted Dying Coalition points out, is that the numbers going to Switzerland have virtually doubled. Parliament now finds itself in a position where we can decide to intervene and change the law, or we can accept random prosecutions, interviews under caution and denying assistance to people who seek it.

Contrary to what the hon. Member for Congleton (Fiona Bruce) said, I think we can draw much better conclusions about safeguards on the basis of Canada’s experience. In Canada, assistance is not available to non-residents, and that discourages suicide tourism. Assistance is not available to minors; it is not available to people who have a history of mental illness; and it is not available on the grounds of mental illness, long-term disability or any curable condition. The safeguards include ensuring that none of the legal witnesses or physicians involved has any legal or financial interest in the outcomes of the patient. Consent must be repeatedly expressed, not implied, and consent can be revoked at any time and in any manner. To receive a medically assisted death, patients must be experiencing intolerable suffering and must sign a written request expressing their wish to die. As we have heard, two independent witnesses are required. I would say that those are quite strong safeguards.

We have also heard that the view of the medical profession in this country has changed; I think the hon. Member for Grantham and Stamford (Nick Boles) referred to the Royal College of Physicians, and I know that there will be a poll of the British Medical Association and the Royal College of General Practitioners.

Earlier this year, I had the opportunity to listen to tetraplegic Paul Lamb, who spoke at a humanist event in the House, and I was very moved by the case that this very rational and sane man made. Traditionally, the argument for changing the law is based on the Oregon model, as we have heard, and it generally refers to people who have six months left to live; that was the case with the Marris Bill. I have some difficulty with that, if we are to look at the matter again, because I think there is a problem with being precise about life expectancy. In addition, such a narrow position would not help someone such as Paul Lamb. Paul has been living with his condition for 29 years. He is in intolerable pain that can sometimes only be controlled with very strong medication, which blurs his consciousness and limits his life experiences. He wants the right to choose, if he reaches a stage where he has no quality of life.

We need to focus on quality of life, capacity for life and the rational, sound judgment of a person who makes such a decision. Life expectancy in itself does not tell us anything about suffering. We should be considering assisted dying both in the context of terminal illness and in the context of suffering and a lack of meaningful life. That is especially true when we are talking about progressive conditions, conditions such as locked-in syndrome or intolerable suffering.

Some people have strong views about this subject, and they are influenced by their Church or religious community. Those organisations encourage people to contact MPs, and I understand that it is always going to be like that, but the Supreme Court did ask this place to consider the case for changing the law, and the Court recognised that that was a decision that only Parliament could make. Having listened to Paul Lamb and thought about it again, I think that we should be wondering whether things have moved on since 2015. The poll that was released by the My Death, My Decision group shows that the level of support for a change in the law is now about 88%. I think that is significant, and I am surprised that people would want to ignore that.

Of course, as the hon. Member for Grantham and Stamford said, we are a democracy. It is our job to wrestle with these decisions, not to rely on the fears of particular groups. It is our job to make sure that we get the safeguards right. It seems to me that the choice is simple. We cannot stop assisted dying; we can only prevent legal assisted dying, which would be open, transparent and open to change and challenge.

As a diligent MP working for her constituency, my hon. Friend raised the particular issue of the Chelmsford courts with me yesterday, and I was pleased to tell her yesterday that Chelmsford Crown court was included in the sites that were fixed last night. We are currently working on, and perhaps might even have fixed, the combined family and county court, and hope that they will be online. I can confirm to my hon. Friend that this incident was not the result of a cyber-attack.

Does the Minister accept that it is not quite fair to characterise this as a single or unusual event, and that her Department has been receiving reports of failures in the criminal justice secure email service for at least six months now?

The hon. Gentleman makes an important point. In fact, there were two separate incidents in relation to the HMCTS-MOJ site: one that occurred on Tuesday night, which was fixed by the weekend; and a separate incident that occurred on Sunday, which we are continuing to work through. The issue he identifies in relation to the secure system is, again, separate and unrelated. Some 75,000 people were affected by that, which is only 12.5%. By Monday, we had restored user access to 40,000 of those people. We restored access to the remainder on Tuesday, and we have dealt with the issue. I hope people will identify that issues are occurring, and HMCTS is working through the night to resolve these issues. As I have mentioned, we hope that they will be fully resolved by tomorrow morning.

I am sure everyone accepts that the Secretary of State acted in good faith, but can he explain to the wider public who do not have a legal background why, when he acted on the advice that the victims had the best chance of success, the Government then spent a small fortune employing a top-notch QC to defend and justify the secrecy provisions that the victims’ case was based on challenging?

Just to explain, there were two cases brought by the victims: one was on the substance of the decision, and one was on rule 25. On the substance of the decision, my Department did not oppose the victims. We stood back, and indeed we did nothing to hinder the victims, as I assured the House on 19 January. On rule 25, I had made it clear that I felt it needed to be changed. I considered that to be a matter for this House and for my Department, rather than that the previous rule was unlawful. I thought it was wrong; I did not think it was unlawful.

My hon. Friend is correct. We are working closely with drone manufacturers to create no-fly zones over prisons and deal with the scourge of contraband entering our prisons.

I can remember a time when a Minister coming before this House after such a serious incident might have had to show a degree of contrition. Since the Justice Secretary mentions staffing levels, can she confirm that G4S has made a profit at HMP Birmingham because it has reduced the number of experienced but more expensive staff and replaced them with cheaper but less experienced officers?

I have been very clear that we need experienced staff. In fact, 80% of staff working for the Prison Service have been with us for five or more years. I am very keen to ensure we retain them—we offer them promotion opportunities. Staffing levels are not set by G4S. They are set by our overall prison policy, which I am changing to ensure they are sufficient. We are investing an extra £100 million a year in staffing to ensure we have the right staffing levels in both private and public sector prisons.

I thank my hon. Friend for his intervention; I could not agree more. The families involved were told only yesterday that arrangements will be made for their legal teams to work with another firm and receive legal aid. Does the Minister think that three days’ notice on this matter is sufficient?

I stress how much I welcome the progress that has been made since I called for the debate. At that time, the families still had no idea whether they would be granted funding at all, even though they applied for exceptional case funding from the Legal Aid Agency in January this year, and the resumed inquest was granted in June. In the meantime, the families also applied to the Home Secretary to seek the use of the Hillsborough funding and administration scheme. The families have been given messages of support all along the way from the former Home Secretary, who is now the Prime Minister, the new Home Secretary and the Justice Secretary. However, those warm words proved to be little else. The legacy of what happened at Hillsborough marked for many a turning point in how the families of those bereaved or injured in large public disasters would be treated. Lord Wills, in speaking to his Public Advocate Bill in the other place, stated that when he met families of those that died in Hillsborough in 2009, one

“message that came through over and over again was that they wanted to find a way to prevent other similarly bereaved families suffering and having to endure in the way they had suffered and endured for 20 years.”—[Official Report, House of Lords, 29 January 2016; Vol. 768, c. 1519-20.]

The Prime Minister should rightly feel proud of her role in how the Hillsborough families finally got justice, but I am afraid that the systemic problems that these brave families fought against still remain. The current Home Secretary said that funding the Birmingham pub bombing families through the Hillsborough scheme would not be appropriate, but I take real issue with that judgment. Both the Home Secretary and the Prime Minister have cited the way in which the inquests on the 7/7 bombings were funded, even though the scheme that those families used is no longer available, as the Legal Aid, Sentencing and Punishment of Offenders Act 2012 removed it.

The bereaved Birmingham families feel that they were strung along by the Home Secretary on this matter, and ultimately let down. They tell me that she told them that she had written to the Justice Secretary to give her support for exceptional case funding from the Legal Aid Agency. When Julie Hambleton and I approached the Justice Secretary in Birmingham, she seemed to have no knowledge of the case. The families then received a letter from the Justice Secretary saying that neither she nor any politician could influence the outcome from the Legal Aid Agency, which seemed contrary to what they had been told by the Home Secretary.

With three days to go before the process is to begin, the families are informed of an arrangement that has strings attached. They feel they have been misled and fobbed off. I ask the Minister to bear in mind that these are families who lost their sisters, mothers, brothers, daughters and partners. They are just ordinary working-class people who are trying to fight for justice in the face of powerful actors whom they already do not trust. The appalling way in which the funding for their case has been handled pushes them—and, I have to say, me—into really doubting that those in power want to see justice done. As with Hillsborough before, this is a David and Goliath fight.

The former chief coroner, who will chair the resumed inquests, called for parity of funding in inquests where there is state involvement.

My hon. Friend is making a valuable speech. On seeking parity, would it not be useful to know how much public money is being made available to fund the legal costs of the police and other Government agencies in this case, and how that compares with the help for the families?

I agree with my hon. Friend. The former chief coroner, who will chair the resumed inquest, called in his annual report for exactly the same level of parity. Parity of funding means at the rates available to other parties to the resumed inquests. West Midlands police has apparently set aside £1 million so far. Former police officers will be represented through the Police Federation, and Government Departments will no doubt be represented by lawyers from the private sector.

Tonight I ask whether the legal aid for the relatives of the victims of the Birmingham pub bombings is appropriate or sufficient. I accept that it might be appropriate in many circumstances, but Hillsborough gives us a successful model, and there has been no explanation of why that cannot be replicated in this case or, in fact, in future cases of this kind. That is in the gift of the Home Secretary and the Prime Minister.

I want to begin by stating what Her Majesty’s inspector of constabulary for West Midlands police, Wendy Williams, said about the force in her most recent report. She believes that it is

“exceptionally well prepared to face future financial challenges.”

She says that it has “robust management” of its current demand, finances and plans for change, and that it has embarked on an impressive five-year change programme to transform how it intends to deliver policing. In last year’s Valuing the Police programme, which considered how forces met the challenge of the first spending review, West Midlands police was judged to be outstanding. I thank the Labour police and crime commissioner, David Jamieson, our former chief constable, Chris Sims, and our new chief constable, Dave Thompson, for doing such a good job on our behalf.

The Government have suggested that west midlands Labour MPs are wrong to complain that our police are being short-changed. The Minister thinks that West Midlands police is squirrelling away money and sitting on huge reserves. Let us look at the reserves of the largest force in England and Wales outside the Met. Not only does it serve a population of nearly 3 million people and an area of some 348 square miles, but, as HMIC notes, the area served by the West Midlands force faces the most significant challenge of terrorism and extremism outside London—a point alluded to by the hon. Member for Kingston and Surbiton (James Berry). The force is in fact a national lead in the delivery of counter-terrorism.

The force complies with the requirement to hold a general reserve—in its case, about £12 million, which can be compared with figures of about £26 million and £23 million for the Met and West Yorkshire police. Of its remaining reserves, about £10 million is set aside to address redundancy and equal pay, in a force still suffering the fall-out from the “A19” forced retirements. A further £12 million is set aside for the self-funded insurance reserve. I expect the Minister is familiar with the problems of insurance for police vehicles and how most forces hold a reserve to cover this. About £3 million is set aside for the uniforms and protective equipment reserve, which is not a high figure for the second largest force in the country; about £2.1 million for the major incident reserve; and about £18 million for the capital reserve. The Minister will be aware that his officials advised that forces should prepare for a reduction in the capital grant in this year’s settlement. I understand that the capital grant for the west midlands is now about £2.9 million—a cut of about £2 million on previous years.

Like Her Majesty’s inspector of constabulary, I see a force with robust management of demand and finances, and one that has proved to be outstanding in facing up to the challenges that austerity has imposed on it. It is misleading for anyone to suggest that it is sitting on massive reserves, and I invite the Minister to look again at the figures before anyone in the Government is tempted to repeat such a charge.

On the question of the formula, may I invite the Minister to clear up the situation with regard to claims by the Conservative PCC for Northamptonshire that he has been led to expect a transfer of funding from urban forces such as West Midlands police to rural forces such as his? Last week, the Home Secretary did not feel able to tell my hon. Friend the Member for Birmingham, Northfield (Richard Burden) that she was not planning such a transfer of funds. Would the Minister like to take this opportunity to come clean about his intentions?

The hon. Gentleman is citing the figures with which I supplied him, so I will not contradict them. I will give my interpretation of them when I sum up. There is no funding formula change on the books, so nobody can say that they are going to be better or worse off until we come forward with the formula.

It is certainly true that the Minister gave me a glimpse of some of the figures and I am extremely grateful to him for that, but let me reiterate my point: the Conservative PCC said that he had been tipped off that there would be a transfer of funds from urban to rural forces. My constituents want to know why more money is needed to police Surrey and Northamptonshire than to police the west midlands. Why do we get less while they get more?

We could ask the same question about the local government formula, which gives more money to Surrey than to deprived areas such as Durham and my hon. Friend’s area. The suspicion is that this funding formula will also be used to divert money away from Labour areas to Conservative areas.

If we look at past form, we will see that that is certainly the implication. I was interested to hear the hon. Member for South Dorset (Richard Drax) implore the Minister to think again about fair funding, on the basis that a fairer funding arrangement would give the force in Dorset an extra £1.9 million a year. I remind the Minister that, under the same fairer funding formula, the west midlands would get an extra £40 million year. When it comes to the transfer of resources, I hope he will bear that in mind.

The reality is that, far from getting extra funding, over the past five years our force has had to contend with £180 million of cuts—the highest in the country. The workforce has been reduced by 3,000 and the incoming chief constable has been clear that the force will need to reorganise to “cope with the gaps”—those are his words—that it now has to carry. The mistakes in the formula mean that forces are now planning against a one-year rather than four-year profile, which will be a much more difficult challenge. I would like to hear the Minister explain how he thinks the chief constable of West Midlands police is meant to plug those gaps.

I want to be clear that I do not deride the Home Secretary for saying that volunteers with specialist skills in IT or accountancy might be useful in helping to tackle cybercrime. I am curious to know why it is necessary to create a new position of police support volunteer, rather than simply recruiting more special constables with particular skills and expertise. Is that part of a wider volunteer plan?

The answer is very simple. A special constable is an unpaid but warranted officer, the same as a full-time officer. Many people do not want to carry the warrant, but they want to help their local police force. That is why there is a separate category and they are not all specials. If they were, they would all have to be warranted.

I am grateful to the Minister for that response, and perhaps he will show us the consultation that took place to show the support that exists for the new role of police support volunteer. I would welcome the opportunity to have a look at that.

To go back to funding for a second, does the Minister really consider it a triumph for his colleagues the hon. Members for Solihull (Julian Knight) and for Dudley South (Mike Wood) to claim credit for a 4.6% rise in the police precept paid by the taxpayers of the west midlands to make up for the money being given to places such as Surrey and Northamptonshire? Is that how we will be forced to plug the gap—by paying more pounds for fewer police in our area?

We are repeatedly advised that crime has fallen and therefore, by implication, the Government’s cuts are justified. I assume that the Minister does not dispute the claims of the Office for National Statistics that crime rose by 6% nationally for the year ending September 2015, and that violence against the person rose by 13%. I do not dispute that some types of crime have fallen, but I am not interested in trying to manipulate the figures to mislead anyone. Is it not important that the Government give a full picture and come clean on what the figures actually mean?

Does the hon. Gentleman concede that that report stated that there had been an increase in the recording of crime, and that the reporting and recording of crime have improved a great deal, which explains some of the rise that has been seen?

I concede that the report actually said that certain types of sexual offences were being reported differently, which accounted for the rise in that area. The report also clearly pointed out that violence against the person had risen by 13%, and I hope that the hon. Gentleman accepts that. As I said, we need clarity on the figures rather than using them to try to paint a picture that may be misleading.

There is one more point I would like to make. As I indicated earlier, the West Midlands force faces the most significant challenge of terrorism and extremism outside London, and we recently suffered a spate of gun crime in parts of Birmingham. The chief constable is set to increase the number of armed officers, and I understand that that is in line with Home Office advice. West Midlands police has about 260 armed officers, and an uplift in line with Home Office thinking would mean a further 130 officers. Where will the funding for those additional armed police officers come from, and where will the personnel come from? Will the force be expected to recruit additional officers, or will those engaged in neighbourhood policing or response policing be required to transfer to those new duties, further depleting those available for existing police tasks?

It is not bluff and bluster that we need today, but honest answers to legitimate questions and queries from people such as myself, who are genuinely worried that the formula, the funding and the rhetoric do not match the heroic efforts of West Midlands police to meet the demands of the community that it seeks to serve.

I totally agree with the hon. Gentleman. That is exactly what was going on. We were to have the formula wrapped up going into the spending review, but what we are in store for is exactly what has happened in local government funding. We did not get a fair local government funding formula: we have a skewed formula that moves resources from the most deprived communities in this country to—lo and behold!—the more wealthy parts, which are represented by Conservatives.

In local government funding, just by chance—hon. Members should not ask me how this has happened— 85% of the gainers happened to be in Conservative seats. I suspect that that is what was going on with the police funding formula. The Government had not reckoned with the PCC for Devon and Cornwall, who questioned the process.

We must also put the formula against the other things that the Government and their previous incarnation, the coalition, have done to policing in this country.

Like me, I am sure my hon. Friend recognises that the Minister is a pretty straightforward guy. Given that we have ended up in this situation and that we have been unable to resolve it—it will be four years before police forces can plan a long-term budget—would not the fair thing be to remove any doubt or suspicion and subject the formula to independent scrutiny? In that way, we could all be absolutely certain that it was fair.

I agree with my hon. Friend—I will come back to that in a minute—but the real issue is that what was envisaged is exactly what we have seen in local government. Under the new formula, the resources would not have been devolved to the areas that needed them, but the blame for the cuts would have been. The Government have used that formula for many years now.

May I welcome the hon. Member for Rotherham (Sarah Champion) to the Dispatch Box? I think she may be there for some time, because she delivered a much better speech than those delivered by the shadow Policing Minister and the shadow Home Secretary last week.

I agreed with some of the hon. Lady’s comments, particularly her closing remarks about how this country and the police deserve a fair funding formula. The reason that did not happen under 13 years of Labour, and probably even before that, is that it is very difficult to achieve. As I have previously said from this Dispatch Box, there is no doubt that there will be winners and losers if we change the formula. As the Home Affairs Committee has said, however, the existing formula is opaque and we desperately need to change it—and fairly.

In a moment. I just want to make a little progress and then I promise that I will give way, because I am going to refer to the west midlands at length.

It is fair to say that policing is undergoing continuous change and that it has changed considerably even in the past five years. The National Audit Office has rightly indicated that the way in which we are making the reporting of crimes more effective and accurate should not be used in an attempt to say that crime has suddenly risen. Since 2010, for lots of different reasons, there has been a reduction in crime, but there have been some increases in the reporting figures in the past year. We accept that and are looking at it very carefully, but the NAO made a specific point. In some areas, it is absolutely brilliant that more people have the confidence to come forward to report crimes such as sexual abuse and domestic violence, which historically have not been reported as much as we would have liked and have probably not been treated as correctly as we would have wanted by police forces around the country. I think that most people would accept that.

The Policing Minister has said that achieving a fair funding formula is incredibly complex, and he has acknowledged that it is beyond the competence of his civil servants. The hon. Member for South Dorset (Richard Drax) has said that he is seeking fair funding, as are the rest of us. Given the difficulties, doubts and suspicions, will the Minister give a commitment that any future fair funding formula will be subject to proper independent scrutiny and analysis, so that we can all have confidence in it?

It is a pleasure, Ms Buck, to serve under your chairmanship. May I clarify a couple of points with the Minster? First, I notice that the explanatory notes say that we are doing some of this because a few months ago, in July, the Government got it wrong. Is the Minister absolutely confident that he has got it right on this occasion, at least in terms of what he is trying to do? If he can offer any explanation about what he got wrong back in July, people would be interested to know.

Secondly, there are widows who could lose out under these arrangements and end up either with no state pension or a small amount of money. Will the Minister say more about how many people we are talking about and what estimates he has made? It would be a terrible pity to see this go through and find out afterwards that the Government were not sure about their figures.

On the question of divorcees, what is the rationale for saying that divorced women can no longer rely on their former spouse’s national insurance record? That is quite a big change, which could discriminate against a number of women. Will the Minister offer advice about how many people we are talking about and what led him to that conclusion?

Finally, I understand that under these transitional arrangements there will be some protection for spouses and civil partners, but not for people who cohabit. Given that, under all the other social security legislation, if people are cohabiting that counts towards their entitlement, why has the Minister decided to pick on that particular group in relation to pensions? I am not sure why we are not opposing this, but before we have a vote it would be helpful to know how many people we are talking about. This seems to be a whole series of regulations. I did not get a single figure from the Minister during his two-minute explanation to the Committee on how many people are affected by what he is planning to get through today.

My thanks to the three contributors to the debate. I will try to address as many of their questions as possible. I will start by clarifying a point in the argument about women who might have no entitlement to pension. Under the transitional arrangements, a woman may still inherit a proportion of her late spouse’s additional state pension or half of his protected payment, depending on when he reached state pension age.

I was asked why my Department has left it until now to introduce these measures. I hope the Committee will appreciate that time is needed to develop legislation underpinning the new state pension, and to secure parliamentary time for debating and making the necessary legislation. It has been suggested that Government should do more to inform those affected by the changes to entitlement. The Government are always looking for the channels and media that work best. People sometimes assume that direct mail is the right approach, but experience has shown that is not necessarily the case. We have undertaken direct mail exercises in the past, and evidence suggests that other communication channels can be as or more effective.

My Department conducted a test in 2014 issuing 6,000 personalised letters with the aim of encouraging people to ask for a state pension statement, and only 79 requests for a statement resulted from that mailshot.

I am sorry to state the obvious but, other than writing letters, there are social media, emails, articles in newspapers and other publications. There are a variety; I list only some of them. Sadly, the hon. Gentleman does not seem to have moved into the 21st century and still seems to think that everybody should get a letter through their letterbox. Times have moved on and he needs to move with them.

The point, which the Minister may have missed, is that if his Department has genuinely been given information about data protection and that has limited the number of letters it can send to people, what information has he had about emails and social media? He can stand there and pretend he is in the 21st century, but how many emails and other examples of social media has he used with individual people and what data-protection advice did he get before he did so?

I do not think anyone in the Committee would expect me to give precise numbers about how many emails have been sent out by a specific Department. If I may remind the hon. Gentleman, his original question was what are the forms of communication. That is the question I answered. If he now wishes to change the question and say he wants specific numbers, because he is not happy with the answer I gave, I think the Committee will be sympathetic to the response that I cannot give the precise number of emails that have been sent out.

Fortunately, the ideas from the cross-party group of Lancashire MPs came before the end of the consultation, so they formed part of it. Along with the evidence of the Home Affairs Committee and other things that have come forward, that is part of the reason for the delay. The misuse of the data—clearly in the wrong place—is the catalyst that created the situation, but we were already listening. I think that is the best way to go forward.

The Minister will know that as things stand, West Midlands police could lose £28 million of his indicative budget. Can he give us an assurance today that nothing on that scale will occur? Will anyone be held responsible for the blunder and the delay in informing the Minister, or are officials, like Ministers, increasingly immune from responsibility for their actions?

My right hon. Friend is quite right about that. I will mention some of the specific demands on West Midlands police in a little while, but he is absolutely right to draw attention to counter-terrorism work.

In addition to the issue of council tax, the west midlands is also hit doubly hard by how formula damping works. In brutal terms, such damping prevents the region from receiving the funding allocation that the national formula says we need. This year, West Midlands police will receive £43 million less than the Government’s own formula says is required.

As my hon. Friend says, under the existing system we are being robbed of £43 million that we should receive. In the past, the Minister has recognised that that is wrong. The Minister will not want to comment too much on his future plans today because of the ongoing consultation, but does my hon. Friend agree that at the very least we need an assurance that we will not lose, as has been speculated, a further £20 million under the plans that the Minister is going to put into action?

My hon. Friend is right on both points. First, the impact of formula damping is a problem. Everyone seems to recognise that, but then nothing is done about it, so I hope that the Minister will reassure us on that. Secondly—I hope that the Minister will say something about this as well—the current consultation is also important, because some of the scenarios could hit the west midlands very hard indeed. I will say something about that in a little while. Suffice it to say that, if the funding was increased by just £10 million to compensate for the formula damping problem, that would still leave West Midlands police hit three times as hard as any other force, but we could recruit 450 additional police officers. Instead, £43 million is given to other forces. I understand the problems when formulae change and the effects have to be smoothed, but the reality is that other forces will get more funding than the Government’s formula says they need and West Midlands police will get less.

At this point, I want to note that in the individual force assessments for handling austerity, Her Majesty’s inspectorate of constabulary rated West Midlands police as outstanding. Credit for that is due first, and most importantly, to the officers and staff of West Midlands police. It is also important to mention the contributions of the late Bob Jones, the former police and crime commissioner, and David Jamieson, the current PCC, as well as that of Chief Constable Chris Sims, who will soon be retiring—we should thank him for his work during his time in the west midlands.

It is important that policy makers listen to people such as those I have just mentioned, because they are not crying wolf; they are raising legitimate concerns about the sustainability of the police service in the west midlands. Were the existing formula regime to continue, the force would expect to lose a further £100 million over the coming years. That would mean that a further 2,500 officers, police community support officers and staff would be set to go. At the end of the decade, West Midlands police would be expected to be smaller than when it was established back in 1974. In a moment, I will give more detail about the demands facing the force, which were mentioned by my right hon. Friend the Member for Warley (Mr Spellar), but for now I will simply say that crime is often more complex and sophisticated now than it was in the ’70s. Will the Minister tell us what the Government are doing to ensure that West Midlands police gets a fair deal to halt the huge drop in officer numbers that it is facing?

Given the categorical unfairness of the existing regime, I think that many colleagues present, from both the Government and the Opposition, were encouraged when the Government finally announced a review of the current formula. That should have been good news. The problem is that the Home Office has refused to publish any detailed exemplifications or impact assessments using its proposed models. We are already seeing the Government’s attempt to have an open discussion, which they say they wanted, starting to unravel. How can anybody offer an informed judgment to the consultation without the full information? As was reported in The Guardian at the weekend, even attempts to get figures via a freedom of information request have been rejected.

Thanks to the revelations published by the same newspaper, forces may still have time to review the implications of the new formula just before the consultation closes next Wednesday. Early analysis of the modelling suggests that there are several serious concerns about the Home Office’s approach that are likely to disadvantage our region even more. Based on modelling of the new funding formula by the Police and Crime Commissioners Treasurers’ Society, West Midlands police could lose more than 25% of its current funding. That is on top of the existing 40% cut, to which my hon. Friend the Member for Birmingham, Selly Oak (Steve McCabe) alluded. Before the end of the decade, that could leave the force with a budget smaller than the fixed costs for the officers it already has.

I will say two things in response to the right hon. Gentleman. First, tackling the question of the precept and the relative level of the council tax base is a long-term issue. It raises fundamental questions about how much it is legitimate to raise locally, as opposed to being dependent on central Government grants, when funding local government and other local services. That brings with it issues of how to compensate for particular levels of deprivation and so on, but he is right that it is a vital discussion, which goes beyond police funding.

In relation to this debate, however, we are where we are. We have a lower council tax base and are disproportionately dependent on central Government grants. Unless central Government formulae recognise that and respond to it, we will not be able to move forward.

I am grateful to my hon. Friend for giving way again. It does not really matter whether someone thinks that the precept should rise or not; the reality is that the Government have locked in a system that requires a referendum before it can rise, which is part of their intention to limit the rise. This is surely a spurious argument.

That is saying perhaps a little more bluntly what I meant when I said that we are where we are. The Government must listen to the implications of their own policies.

My hon. Friend mentioned referendums. Let us say that we in the west midlands decided that, as the Government will not change their mind, despite our low council tax precept and so on, we should have a referendum. Where would that funding come from? It would come from the police budget, and we would lose even more as a consequence.

I congratulate the hon. Member for Birmingham, Northfield (Richard Burden) on securing the debate and on his contribution to it.

Every area of the UK feels a connection with and a debt of gratitude to its police services. They keep us safe day in, day out, in overt and sometimes covert ways. They are part of the glue that holds our society together. In my constituency I know my local police by first name, where their beats are and even some of their hobbies—I have to reveal that a few are fellow cyclists. I am sure that most, if not all hon. Members can echo such sentiments and experiences.

My latest briefing from the local police found that the level of high-impact crimes such as burglary has been cut dramatically. Officially, as of last spring, the previous three-year period had seen a 10% drop in crime in our area. Police are doing more, sometimes with less, but always, it seems, more efficiently and intelligently. This Government are all about good husbandry of resources—we understand that the money is everyone’s, not ever the Government’s.

We are undergoing a review of the police funding formula. As was the case with schools, we have had to wait a decade or more for a review. The social make-up of our country has changed markedly over that period. However, such reviews always throw up worst-case scenarios, and a lot of stories in the Birmingham media involve the possible direction of the review based on those worst-case scenarios. Understandably, therefore, I have received several letters from constituents concerned about future police funding in the west midlands, and I have held informal discussions with senior local police to gauge their views. The overwhelming response is that we do not want to see the fantastic work done by our police in bringing crime down to be damaged by any misallocation of resources.

We have particular challenges in the west midlands, which should carry extra weight in any funding allocation. We face acute challenges in combating radicalisation, child exploitation and female genital mutilation. On a straight population model, it is easy to see how Ministers might look at West Midlands police funding as a potential area for future efficiencies. However, I am encouraged to read in the Home Office consultation document that basing the funding model on per head of population has in effect been ruled out. In addition, I welcome the part of the document that acknowledges that funding based purely on police activity “may skew the results”.

We are not helped in our cause by the office of the police and crime commissioner, which has overseen the expenditure of some £30 million on its headquarters and holds more than £100 million in reserves according to some estimates. The PCC also employs seven people in a public relations capacity, compared with an average among all the other PCC areas of two. To be fair to the police and crime commissioner, however, he is planning to apportion a substantial slice of those hefty reserves on front-line policing and recruitment in the near future.

The West Midlands force has also been slow in weaning itself off central Government financing. It relies on central Government for some 87% of its financing, and over time the proportion drawn from the precept has not increased by the level that it should have. The socioeconomic challenges that we face, however, should give real pause for thought before any substantial cuts to central Government financing are undertaken; and I am confident that we will be listened to and that no such cuts will be made. Furthermore, West Midlands police should be allowed to show how the force will redress the funding balance between the precept and central Government.

That is a matter for local decision makers—just as it is a matter for them that they have not increased the precept over previous years. The hon. Gentleman used the word “spurious” before, but frankly the only spurious argument put forward so far has been that used by Opposition Members—that the referendum costs would be so prohibitive that one could never actually happen. If the argument is that a precept increase would spark a level of council tax sufficient to require a referendum automatically, I suggest that it would be up to the local decision makers, councillors and politicians to put the strong case for why—which is, in effect, that the West Midlands force is playing catch-up.
