I am delighted to bring to the House this debate to consider the process for the consultation on marine licensing applications carried out by the Marine Management Organisation on behalf of the Department for Environment, Food and Rural Affairs. The process has come to my attention in recent years because the way in which it works has led to widespread dismay among my local fishing communities. They have been left out of the consultation process when it comes to considering important decisions that impact on their livelihoods.

The Cornish fishing industry has recently been highlighted on a national scale, not only in the British Academy of Film and Television Arts award-winning short film “Bait”, much of which was filmed in St Austell bay and which stars local Cornishman Ed Rowe, but in the excellent BBC series “Cornwall: This Fishing Life”. The series has highlighted, and brought to national prominence as never before, the highs and lows of the Cornish fishing communities and the tremendous risks involved in one of the most dangerous professions. Of the six episodes that were shown, I would have to say—although I may well be biased—that the first was the best, because it highlighted the thriving harbour of Mevagissey in my mid-Cornwall constituency and the fishermen who fish out of that port, often in under- 10 metre boats, in all weathers and at all times of the year.

Let me provide some important background information on this jewel in the crown of fishing in Cornwall. Mevagissey is the second busiest and fastest-growing fishing port in Cornwall. Mevagissey harbour is home to a fleet of 62 registered fishing vessels and employs 94 full-time fishermen and dozens more who support the fishing industry. Some 75% of the fleet work very close to or within 500 metres of the shore at some point during the year, and many work exclusively close to the shore. An average year sees around £2.5 million-worth of fish landed into Mevagissey. I believe I can say with some accuracy that somewhere in the region of £1 million- worth of that fish is caught within 500 metres of the shore.

The primary fishing industry aside, Mevagissey harbour relies heavily on associated fishing dues and revenues, but it also attracts 800,000 tourists every year, largely because it is a living, thriving fishing port. As Members can imagine, any issue that would impact on the lifeblood of Mevagissey without consultation with the fishermen would be cause for much consternation in the community.

That brings me to the marine licensing consultation process, as carried out by the MMO, and specifically to decisions that were recently taken about mussel farms. Mussel farms, for colleagues who may not know, are made by intertwining heavy rope with large floats in areas of coastal water. Mussels are attracted to the ropes and grow off them, and can then be harvested.

I have nothing at all against mussel farms; in fact, I am a huge fan of that growing sector. Sea farming is a sustainable way to grow and cultivate shellfish, and the mussels that are farmed from St Austell bay are, of course, the finest mussels in the country. However, naturally, the deployment of mussel farms, which can cover vast areas of the sea, can hinder more traditional fishing activities from taking place in that area. So, when a large mussel farm situated in St Austell bay, in an important area for the Mevagissey inshore fishing fleet, appeared—from their point of view—out of the blue, members of the local fishing community were understandably vexed. The Mevagissey Fishermen’s Association contacted the MMO and asked what had gone on.

It turned out that no individual or organisation in Mevagissey had been consulted by the MMO when considering the application for a new mussel farm—not the Mevagissey parish council, the harbour trustees or Mevagissey fishermen, either through their association or individually. Yet fishermen are constantly receiving information from the MMO, so their contact details would have been readily available, and consulting them would not have required a massive time or resource commitment.

It turns out that the MMO did consult some groups—specifically, the Royal Fowey Yacht Club. The club replied that the original location for the mussel farm would have had an adverse effect on recreational boating and sailing, and that led to the farm’s being moved to a place where it became a hindrance to fishermen. I place it on the record that I have nothing against the Royal Fowey Yacht Club. It is a fine establishment, which can be traced as far back as 1880, and whose patron is no other than the Duke of Cornwall. I absolutely respect the club’s right to be consulted on the application, and to raise its concerns regarding the positioning of the new mussel farm.

The MMO does not have a great track record on consultation. Its recent proposals for the catch app have not gone down particularly well with fishermen from Padstow. I ask my hon. Friend to consider, when he makes his approach to the Minister, whether we could look at the catch app and see whether any alternatives to that could better serve many of our fishermen in Cornwall.

I am grateful to my hon. Friend and neighbour for raising that point. He makes a very good point about the wider concern in the fishing industry about the lack of consultation that often goes on with the MMO. The specific point that he raises regarding the catch app has been raised by many in the fishing industry in Cornwall, and I hope that the Minister will look at it again.

The MMO was right to consult the yacht club. However, the Mevagissey fishermen, who have a legitimate expectation to be able to fish in the area where the new mussel farm was constructed, where they have fished for generations, should also have been consulted, and it was wrong for the MMO not to consult the local fishermen. The MMO did not follow their duty to act fairly when considering the application, by not informing the most affected stakeholders, who make their living in the waters in question.

The fishermen brought this matter to my attention, and on appraising the consultation process for marine licensing, I have found it to be out-of-date and not fit for purpose. I have subsequently been in prolonged correspondence with the MMO, with DEFRA and with previous ministerial colleagues, in order to seek to reform the process and ensure that local fishermen are an integral part of the decision making process.

I believe that there is room to improve the MMO’s consultation process to make it more robust and much more like that for planning applications. Maritime licences can, after all, have an impact on their surroundings just as much as buildings on land can have following a planning application, but at the moment there does not seem to be the same level of structure or clear consultation with statutory consultees for MMO licences as there is for planning applications.

The MMO originally replied that it would consider including local parish councils among the statutory consultees for fishing communities. Again, that would be similar to the process followed for planning applications. Parish councils such as Mevagissey’s are integral parts of their community, are well connected with the local fishing community and harbour, and would, in my mind, be natural consultees. However, that was not followed up, as it was apparently considered to involve too much additional work for the MMO. I would challenge that. Particularly in areas such as Cornwall, which has a unitary council and no district councils, parish councils play an increasingly important role in representing their communities. It surely cannot be beyond the MMO’s ability to consult directly with them.

If, however, the MMO is not prepared to consult parish councils, a fair compromise would be to transfer responsibility in the consultation process for checking with local bodies such as fishermen’s associations from the MMO to the local authority, which is already a statutory consultee. This would accomplish the dual outcomes of taking pressure off the MMO and allowing the local authority, which would presumably have a greater knowledge base, to speak to the right people. If that does not happen, the MMO, in conjunction with the local inshore fisheries conservation authorities, should draw up an up-to-date list of all fishermen’s associations and make them integrated statutory consultees for every licensing application.

There is also scope—I ask the Minister to look at this—for modernising the public notice element of the process, which stipulates only that a small and sparsely worded notice be published in a local newspaper. As we are all aware, the readership of local newspapers is falling as more and more people obtain their news online. This method of giving notice of applications seems outdated. The process could be brought up to date; applications could be circulated online, alongside the existing notice, as part of the MMO’s regular communication with fishing communities. Fishermen also tell me that the MMO’s website is difficult to navigate; even when they know that there is a live licensing application, it is difficult to find it on the website.

In conclusion, I hope I have shown that the MMO licensing consultation needs to be reviewed and significantly changed. The MMO needs to change the process to ensure that groups such as fishermen and parish councils are aware of licensing applications and are consulted on them. It needs to modernise the way it notifies the public about applications, and to improve its website, so that live applications can be easily found.

I hope the Minister will take on board the points I have raised on behalf of my local fishermen. I look forward to going back to Mevagissey and giving the fishermen the good news that we in this place have listened to their concerns, and that the system will be reviewed and changed, so that in future, their views are sought on decisions that directly affect their livelihoods.

I am grateful for the hon. Gentleman’s intervention and appreciate his support for my case. He makes the good point, which I will develop in just a moment, that this is not just a matter of Cornish identity and pride; it has a practical application to ensure that the Government can obtain accurate data through the census that can shape future policy. That is so important.

As I was saying, the Government recognised the Cornish as a national minority in 2014. It is worth recalling the words that the Government released in a statement at the time, saying:

“The decision to recognise the unique identity of the Cornish, now affords them the same status under the European Framework Convention for the Protection of National Minorities as the UK’s other Celtic people, the Scots, the Welsh and the Irish. For the first time the government has recognised the distinctive culture and history of the Cornish.”

As hon. Members can imagine, there was much celebration and dancing in the streets of Cornish towns and villages at this announcement. We may have even consumed a pasty or two to celebrate. At last—what every Cornish man and woman had known in their hearts for generations was now officially recognised and declared by the Government. However, we stand here today—more than four years later—and wonder what all the fuss was about. We ask ourselves, what did this mean?

It is worth noting at this point that the Government have in many ways been very supportive of Cornwall in recent times. We are seeing record levels of investment in our transport infrastructure, and Cornwall remains the only rural county to have been given a devolution deal by the Government. However, when it comes to the specific matter of recognition of the Cornish as a people, there is still a great deal to do. Sadly, despite the recognition afforded by the European framework convention and embraced in words by the UK Government, the Government have been criticised by the Council of Europe for not doing enough to address the cultural needs of communities in Cornwall. There have been warm words but little action.

The Council of Europe’s Advisory Committee on the Framework Convention for the Protection of National Minorities visited the United Kingdom in March 2016 to assess how the UK Government and other public bodies were complying with the articles of the convention. It published an opinion document in early 2017 that was very critical of the UK Government and their failure to act on the articles of the convention. One of the key proposals in the report to address this shortcoming was the inclusion in the 2021 census of a Cornish tick box for national identity.

The purpose of the census is clear and in many ways simple; it is designed to give an accurate picture of the demographic and social changes within the UK. I celebrate with the Scottish who were identified on the census form in the 2001 census, along with the English and the Northern Irish, of course. The process was, however, flawed because there was no provision for the Welsh. The matter was corrected for Wales in 2011, when 66% of people in Wales chose to identity as Welsh. Imagine the outrage today if the Scottish or Welsh were omitted from the next census. As I highlighted earlier, the Government’s statement in 2014 said that the Cornish would now be afforded the same recognition as our Celtic cousins, yet on this simplest and most basic of things—the ability for people to declare themselves as Cornish in the census—the Government are falling short.

I am sitting not a million miles away from the Under-Secretary of State for Exiting the European Union, my hon. Friend the Member for Wycombe (Mr Baker), who is an exiled Cornishman. There are many people outside Cornwall who have moved away, but who were born in Cornwall and would probably like to be able to tick the box on the census. Has my hon. Friend the Member for St Austell and Newquay (Steve Double) considered that?

I am grateful to my Cornish colleague for that intervention and for pointing out the hon. Member for Wycombe, who in fact attended the same school as me in Cornwall, so we have a great deal in common. He makes a very good point. This is not just about people currently living in Cornwall; it is about the right and opportunity for people across the country who count themselves Cornish—maybe by birth; maybe by ancestry—to identify themselves as Cornish.

The point has been made that there is the option under “Other” in the census to write “Cornish” as one’s nationality. In fact, in 2011 a staggering 73,000 Cornish men and women chose to do so. I should declare an interest in saying that I was one of those 73,000 people. An interesting comparison is worth noting. Those 73,000 people represent about 14% of the residents of Cornwall. That is the same percentage of Welsh residents who wrote “Welsh” under the “Other” option in the 2001 census. In 2001, the inclusion of a specific tick box for “Welsh” increased the percentage of people identifying as Welsh from 14% to 66%. I am convinced that if a tick box was provided, we would see a similar increase in the percentage of people choosing Cornish as their identity. A dropdown menu provision for “Other” is not good enough.

Recognition by way of a tick box will not only satisfy those of us in the far west but enhance the accuracy of the census by allowing the many thousands of Cornish men and women from across the UK—the Cornish diaspora—to know that they can declare their Cornish identity. Gleaning accurate data is surely what the census is all about. We need to know how each nationality within the UK is faring: it is a crucial part of the exercise. We need the census to throw up the relevant and accurate data that can shape future policy for every group identified within the UK.

This issue is not just about the current generation—it is about our future and the protection and nurturing of our unique Cornish identity, culture and heritage. As I highlighted, over 73,000 people registered as Cornish in 2011. Thousands more would have done so if the option had been as straightforward as it is for the other nationalities. What is so telling is that among the young people of Cornwall—our schoolchildren—a clear and rapidly growing number now identify themselves as Cornish. Any argument that there is no demand to identify as Cornish, or that it is a fad of a bygone era, is erroneous. Our young people are proud to be Cornish and deserve the right to be able to say so in future. In fact, there is a growing movement within Cornwall to celebrate our unique identity and culture that is the strongest it has been for many, many years.

I understand the concerns of the Office for National Statistics—and I suspect the Government also—that if it allows a tick box for the Cornish in the next census, it will be overwhelmed with hundreds of other groups calling for their identity to be formally recognised in this way. I appreciate that this is a genuine concern. However, there is a very simple answer. The Cornish are the only nationality recognised by the Government under the framework convention who do not have the option of a tick box in the census—who are not recognised in this way. No other group can make that claim. In that regard, the case for the Cornish is unique. No one else can make the case for inclusion in the way that the Cornish can.

I am very grateful to be backed in this call by all six of Cornwall’s MPs, by Cornwall Council, and by a whole raft of organisations from across Cornwall. I am calling on the Government to back our campaign for a Cornish tick box in the 2021 census and thereby take an important step towards fulfilling their responsibilities under the framework convention. In finishing, there is one simple thing left to be said: Kernow bys vyken—Cornwall forever.

I am grateful for my hon. Friend’s intervention; she makes a very good point. At the heart of this problem is the quality control on building sites. Too often, subcontractors are used and there is not the level of management oversight of the quality of their workmanship that there has been in the past and that we need to see today.

I have been seeking to assist a couple in my constituency who had obvious and serious problems with their new-build house. They first discovered the serious defects with their newly built property eight weeks after taking possession. Four years later, they are still fighting their case. They purchased their brand new house for £395,000. The most recent estimate of the cost of rectifying all the faults and defects comes to £325,000. That is truly shocking, and it is surely a sign of the complete failure of the inspection regime. The level of defect is such that somebody must have known about the problems before completion.

My hon. Friend is making a powerful point. Is he aware of an organisation in my constituency called Casa Snaggers? It is an independent snagging company based in Launceston. Does he think that it might help to resolve issues of the sort faced by the couple in St Austell?

I thank my hon. Friend and Cornish neighbour for that intervention. I have heard of that company, and getting an independent inspection of a new property before signing the completion papers is one way to address the issue.

It is a pleasure to serve under your chairmanship, Mr McCabe. I congratulate my Cornish colleague, my hon. Friend the Member for St Ives (Derek Thomas), on tabling this important debate. I agree wholeheartedly with everything that he and my hon. Friend the Member for South East Cornwall (Mrs Murray) have said in the debate. In view of the time restraints, I will not repeat everything that has been said that I wholeheartedly agree with; I will pull out a few of the main points that I believe are worth reinforcing.

It is clear, and I am sure we all agree, that food security is increasingly becoming one of the most important issues that the country will face. As we have heard, the increasing population in our country and globally, the rapid growth of the middle classes in developing countries, and world security issues mean that food security for the UK will become very important. Climate change will also increasingly be a factor. I recently visited Kenya and saw for myself the impact that the changing climate is having on food production in that part of the world. When all those things are put together, it is clear that we will not be able to rely as certainly on food imported into the country as we have in recent decades.

That is why I believe it is important for us to do all we can as a country to become as self-sufficient as possible in food production. Various figures are bandied around, but I believe the most reliable is that we currently produce about 65% of the food we need. We need that figure to go up. It is unlikely ever to be 100%, and I am not sure we would ever want it to be, but we certainly need it to move nearer to that.

The food supply chain is a complex matter, but our farmers and, as other hon. Members have been saying, our fishermen are at its very foundation. We need to do all we can to support them. I should probably declare an interest at this point, by saying that I married a farmer’s daughter 30 years ago this year and that at the moment her father, my father-in-law, is still—in his mid-80s—to be found every day in the fields on his farm on the Isles of Scilly; and a great inspiration he is. Our farmers are facing some of the most challenging times that they have faced for many generations. We have already talked about the downward pressure on prices both from supermarkets in the UK and from global markets. The increasing costs and bureaucracy in farming are making it harder than ever for farms to remain viable and sustainable businesses. We need to understand those challenges and do everything we can to give support, and to address them.

Farming is viable in this country only because of the significant subsidies that farmers receive, but I think we need to be clear.

Does my hon. Friend share my disappointment that there was nothing in the EU negotiation about reform of the common agricultural policy or the common fisheries policy?

Absolutely—I agree wholeheartedly. It is a point that I want to come on to. I am very disappointed that there is nothing in the renegotiation in our relationship with the EU on seeking to reform either the common agricultural policy or the common fisheries policy. I believe that they are things that need to be reformed, and that is one reason why I am quite likely to vote to leave the EU. We need to recover our own powers over those aspects for this country and not to be so reliant on the EU for them.

We also need to be clear that the subsidies paid to our farmers are, in effect, subsidising not farmers but British households. They are there to keep food prices down. We need to kill the myth that somehow farmers are subsidy junkies. They receive those subsidies only because of the downward pressure on prices. Virtually every farmer I know and speak to would say that they would rather have a fair and sustainable price for the food they produce than to be so reliant on subsidies.

In the recent crisis involving milk prices, we saw that the British consumer is willing to pay a bit more when they know that a product is local and the farmer will receive a fairer price for that product. That is particularly true in Cornwall. The Cornish brand for locally produced food is incredibly strong; there is a very strong feeling in Cornwall that people are willing to pay a bit more if they know that something is Cornish and that local farmers are getting a fairer price for it. The Government would do well to push that further. We have already talked about better labelling for locally produced food. The Red Tractor scheme has been mentioned. That is a very good label, but we need to do more to promote such schemes so that the British consumer can know for certain that they are buying local food.

I am sure that my hon. Friend the Member for St Ives did not intend the debate to become dominated by the issue of TB, but we cannot avoid the subject. When I go out and speak to local farmers in my constituency and ask them, “What is your No. 1 concern that you would like the Government to do something about?”, the most common response is, “Address the issue of bovine TB.” I congratulate the Government on the steps they have already taken to address the issue, despite strong opposition, but I firmly believe that we need to allow those who live off the land to manage the countryside. They know best, and I encourage my hon. Friend the Minister and the Government to press ahead and do everything they can to rid our farms of that awful disease. I can assure him of my full support in any steps he takes to do that. We need to make no bones about it. Again, as we have heard, this is not about just saving a few badgers. Hundreds of cattle are slaughtered every week as a direct or indirect result of TB. We must address the impact that that is having on the sustainability of locally produced food.

To sum up, we need to do everything we can to support British farmers. I know that I do not have to twist the Minister’s arm to do that, but I encourage him to take the clear message back to Government that we want to see a very strong positive message from the Government about supporting British farmers and getting behind them in every way we can.

I was aware of that survey. It raises the point that if the policy is to be continued—clearly, I hope it will be reviewed—there needs to be much greater clarity for headteachers on what constitutes exceptional circumstances. That especially needs to be applied to Ofsted, because I am hearing from headteachers that when they make a judgment call that they believe they are allowed to make and authorise the absence, those decisions are then queried at best, and perhaps criticised in other cases, by Ofsted. Parents want a constructive relationship with the school, where together they can decide what is right and best for the child.

My final point is on the policy’s economic impact. I was disturbed to learn that no economic impact assessment was made before the policy was introduced. In fact, when the matter was brought before Parliament in March 2013 by way of a statutory instrument, the explanatory note stated:

“An impact assessment has not been provided for this instrument as no impact on businesses or civil society organisations is foreseen.”

Unfortunately, that simply is not the case. The impact of the policy on the tourist industry, particularly in Cornwall, has been significant, as it has elsewhere in the country. Many tourist-related businesses are reporting a significant drop in revenue in the shoulder months of May, June and September, which used to be times when many families would come to towns such as Newquay to stay.

I have been contacted by the Federation of Small Businesses, which has highlighted the concerns of many hoteliers, retailers and businesses that are affected by the six-week period. Has my hon. Friend been contacted by the FSB?
