Commons ChamberI pay tribute to the hon. Member for Perth and North Perthshire (Pete Wishart), the Chair of the Scottish Affairs Committee, for bringing forward this debate. It is right for us to celebrate 20 years of devolution. Back in 1997, the Scotland Bill was the first Bill that the new Labour Government brought forward from their manifesto. They promised to bring it in early, and it was the very first Bill to be presented to this House. Then we had the referendum in 1999, which gave a yes vote. That is the only time I have ever voted yes in a Scottish referendum, and it is the only time I am ever likely to do so. That referendum brought us the Scottish Parliament. Donald Dewar, who has always been known as the Father of the House in the Scottish Parliament, said at that time this was not about politics and legislation but about what kind of country we were, how we looked upon ourselves and how we were shown to the rest of the world. I think we should carry that through in this debate and in everything we do when talking about the Scottish Parliament.
I was eight when the Scottish Parliament reconvened in 1999—I am glad that nobody in the House can do maths—but the big question 20 years later has to be whether we now have home rule within the United Kingdom. That is the big question, because for all of us who are devolutionists and not nationalists or Unionists, devolution is a journey. The Calman commission and the Scotland Act 1998 were always a journey and the question has always been about whether the Scottish Parliament should progress and where devolution should go on that journey.
There was lots to celebrate in the first part of the Scottish Parliament in terms of the laws it was able to pass. About 280 laws have been passed since the Parliament came into being, and we should look on that as progress, because there was never any ability in this place to pass anywhere near 280 laws for Scotland in a 20-year period. It is probably accurate to say that 10% of that number could have been passed under the previous arrangements. We have had land reform, feudal law reform, the smoking ban and free personal care for the elderly, as well as proportional representation for local government, which was huge. We have also had world-leading legislation on homelessness as well as more schools, teachers, teaching assistants, nurses and doctors, and the abolition of tuition fees in Scotland. All those things have been better for Scottish life and have cemented the Scottish Parliament as the centre of Scottish politics and the centre of Scottish civic life. Anybody who argues that Westminster is the centre of Scottish politics and civic life has not moved on over the past 20 years, because that can be seen in the way the Scottish Parliament operates.
Now is a good opportunity to reflect on what the Scottish Parliament is delivering. I always thought that the Scottish Parliament should be part of a devolution journey that would provide subsidiarity, and everyone would have a grown-up conversation about the powers that lay at the Westminster Parliament, the EU level, the Scottish Parliament, our local authorities, or even local communities—I firmly believe in the idea of subsidiarity—and about where powers are best placed to lie. I am slightly disappointed that that is not being portrayed by the Scottish Parliament, because all our arguments about powers are never about powers for a purpose, but about powers for where power should lie.
I firmly believe that, since the formation of the Scottish Parliament, Scottish local authorities, which used to be the vanguard of local service provision, have turned into administrative arms of the Scottish Government. That may be by design, or it may be by accident, but we should reflect on that. Councils no longer have the ability to shape the lives of their local services, not only because of significant financial constraints that have been placed on them, both by this place and by the Scottish Parliament, but because they do not have the ability to shape new policies in the way they once did. The Scottish Parliament, certainly in the past 10 years, has sucked up power into Holyrood, rather than being a devolutionist Parliament that moves things back down to local government. Whether a nationalist who believes in independence, a right-wing Conservative who believes in scrapping the Scottish Parliament, or anywhere in between, we should have a discussion about the best place for powers to lie.
Powers are not being used, and it frustrates me that we have not had an honest argument about that. If somebody stands up and says, “We are not using power A because we do not believe that it should be used for the reasons of sorting problem B,” I will argue all day about the principle of that and whether it is the right thing to do, and then the voters can decide. To say that the Scottish Parliament does not have the powers to do something when it does is disingenuous and undermines not just the Scottish Parliament, but the whole Scottish political system and, indeed, our entire civic system.
For example, the Leader of the House was asked a question earlier about the WASPI women, and the Scottish Parliament has the power to do something about that issue. It could look at a whole range of issues. If it so wished, it could set up a commission to look at how to deal with pensioners in Scotland, but it chooses not to use that power. Let us argue about why the Parliament may decide not to choose that or why it wants to choose it, but let us not say that there is no power to do anything about it. Sections 25, 26, 27 and 28 of the Scotland Act 2016 say that the Scottish Parliament has the power to introduce any top-up benefit to any reserved benefit, and pensions are a reserved benefit under section 28.
I turn to the questions about what we should do next. Intergovernmental relations is a big one. I fundamentally agree with the hon. Member for Perth and North Perthshire that intergovernmental relations are used as a cover for people to hide behind, rather as a way of having constructive discussions across Governments. Let us look at whether the Scottish Parliament needs a second Chamber. Let us look at whether the Committee system provides proper scrutiny. Let us take an audit of the powers that are being used and the powers that have not been used. Let us look at whether we should examine the subsidiarity and reflect on what other powers should be considered. Let us look at reform of the UK. Let us look at a federal structure or at the House of Lords or at a senate of the nations and regions that could help deal with some of the big issues. Twenty years on, we should sit and reflect honestly and on a cross-party basis.
Is that not the whole point of the Dunlop review? We have an opportunity to look at how we are working at this end of the country and make the necessary adjustments, so that our Union can work better in this devolved arrangement.
The hon. Gentleman is right, because where devolution goes next is not really a problem for Scotland; it is a problem for England. That is why when we are looking at devolution and where it goes next, we have to look at what England does. We cannot look at this in the context of the United Kingdom without dealing with England. That is why we need a senate of the nations and regions and a proper constitutional convention. What we do not need is a citizens’ assembly that is just a talking shop for how to get to independence. We need a proper, sober assessment 20 years on. Let us celebrate the 20th anniversary of the Scottish Parliament, but let us look to the next 20 years.

It is great to see you in the Chair, Mr Betts. If the hon. Member for Berwickshire, Roxburgh and Selkirk (John Lamont) will allow me to refer to him as the hon. Member for Berwickshire, that might save us a little time.
This is a strange debate, because we have two parties—the Conservatives and the SNP—arguing when they are both culpable for why we are here. Since 2010 the social security system has been completely and utterly discredited by a deliberate narrative from the then coalition Government that welfare was a bad thing. They completely changed the narrative in this place, and indeed in the country, from social security being a safety net to welfare being bad. That is part of the problem we have today.
Between 1997 and 2010, the previous Labour Government created a system that lifted millions of pensioners, and millions and millions of children, out of poverty. We should be incredibly proud of that. Since then, most of that has gone backwards in the name of austerity, which has been a political choice rather than a necessity. Before Conservative Members, if they wish, pop up and go on about the employment statistics, which are welcome, most of the decline in terms of poverty comes from in-work poverty—people actually in work.
Surely it is a good thing that there are now fewer children in workless households than ever before. That is good, isn’t it?
It is a fantastic thing, but it is bad that most of those children are in poverty when they were not before. Social security is a sensitive subject, and we must be careful about the language we use.
I want to reflect on what the Smith commission has done. In response to the 2014 independence referendum, a commission was put in place that allowed all the parties to come together to find consensus about what the next stage of devolution to the Scottish Parliament should be in the devolution journey.
I am glad that Members across the House now extol the virtues of sections 24, 25 and 26 of the Scotland Act 2016, because while the Conservatives and SNP argued about the minutiae of what was not in the Bill, Labour were promoting changes at the Dispatch Box. We proposed amendments to put stuff into the Bill that could have been there, such as my amendment 31. The amendments that went through in the House of Lords gave Scotland the power to create its own social security system. The Scottish Government can top up any reserved benefit and create a new benefit in any devolved area; that is incredibly important. That is why it is so frustrating that the devolved powers have been delayed. I am delighted that the hon. Member for Berwickshire mentioned the WASPI issue, because it is a key aspect of the way the whole issue has been dealt with.

Commons ChamberThe hon. Gentleman also said that the SNP in 1979 withheld consent. It did not withhold consent; it voted with the Conservative Opposition to give the Opposition a one-vote majority, which brought down the Labour Government and ushered in 18 years of Conservative rule.
As my hon. Friend the Member for Kirkcaldy and Cowdenbeath (Lesley Laird) rightly said from the Front Bench, we are here because we are currently stuck with two nationalist Governments, one here in London and one at Holyrood in Edinburgh. She was also right to quote John Smith, who lived in my constituency and was the best Prime Minister this country never had. He did say—I am happy to quote it again for the record—that we had two parties sawing away at the legs that supported the Union. He said that then, but it is actually more relevant today.
Let me tell the House why we have two parties sawing away at the legs of the Union, and let me start with the Conservative party. I have made the contention today, and will make it tonight, that the Conservative party is as big a threat to the Union, whether it be Wales, Ireland or Scotland, as any nationalist party in Wales, Ireland or Scotland, and let me say why. The Conservatives bet the farm on an EU referendum and had the arrogance to think they could win it, but they lost it, having put no plans in place for what would happen beyond that.
In 2014, on the steps of Downing Street, the very same person who gambled the farm, the former Prime Minister, David Cameron, as the sun was rising over London, and before all the votes in the independence referendum had even been counted, declared his intention to introduce English votes for English laws, a completely unnecessary procedure in this House that has failed miserably. In that regard, I agree wholeheartedly with the hon. Member for Perth and North Perthshire (Pete Wishart), who has railed against EVEL for many years, despite having supported it previously. That kind of thing goes straight to the heart of how the Conservative party is undermining the Union.
What about the continued and unnecessary austerity? It is a political choice to have austerity as a policy central to government, but it has not worked. It has trebled the national debt to nearly £2 trillion and we still have a deficit—the Government promised to wipe it by 2015, but I am not even sure they will wipe it by the projected 2022-23; it may be decades beyond that. Then there was the creation of a hostile environment, not just for migrants coming to contribute to this country, but for anybody in this country who happened to be in the unfortunate circumstances of claiming social security.
Then we have Ministers being dragged to the House by urgent questions to explain why they had to cheat on votes in the House to get policies through last week. I am sorry I was unable to ask a question in the urgent question. I would have asked what the Government would have done had the Opposition broken a pairing deal last week with someone on maternity leave on the Government Benches and won that vote. The Government would be dragging us all back here as quickly as possible to have that vote again.
On a point of information—perhaps the hon. Gentleman was not here for the urgent question—there have been 66 breaches in pairing arrangements, 52 of which were by Opposition parties, not the Government side.
I was not here for the urgent question, so I cannot clarify those figures, but I can say that in my eight years in the House the Opposition have won three votes, so breaking those pairing arrangements has obviously not affected the operation of Parliament, and I do think it important to maintain the pairing arrangements.
Then we get on to the way the Government have dealt with the Brexit process in terms of devolution. It has not been the Secretary of State for Scotland’s finest hour. I am sure that if we could wind the clock back to April, May or June and have those debates again, the Government would have dealt with it differently. We had promise after promise at the Dispatch Box from the Secretary of State, and all those promises were wiped aside. I intervened on the hon. Member for Stirling (Stephen Kerr) at least nine times, if not more—maybe he can tell us during his contribution—to ask when it was all going to happen, what his objections were and how they were going to resolve those devolution problems, and I am still waiting to hear the answers. I look forward to him telling us when I intervene on him during his speech later.
Then we have a Government in chaos, with resignation after resignation after resignation: the Secretary of State in charge of the negotiations to take us out of the EU, gone; the worst Foreign Secretary in history, gone; and all just a few parliamentary weeks away from having to agree the final EU deal.
Then we have the question of a hard Brexit. Everyone is going, “What’s a hard Brexit? What’s a soft Brexit?” However, when we look at what the Government are doing, we are hurtling towards a no deal Brexit. The Government put together—cobbled together after two years—what they now affectionately call the Chequers agreement. The following week, they undermined that very same agreement by accepting amendments to the Trade Bill and the customs Bill that have driven a horse and coaches—a “corse and hoaches” if you have been drinking the same whisky as the Minister who opened the debate—right through that agreement. Not only did those changes undermine the agreement, but the EU had already ruled out the agreement in its original form. We are heading for a hard or no deal Brexit, and all that is happening in the Government at the moment is that people are trying to fight for the keys to No. 10, rather than for what is in this country’s interests.
Everyone in this House, to a person, will absolutely agree that there should be no hard border between Northern Ireland and the Republic of Ireland. However, the Government have set red lines in the Brexit process that make that completely and utterly unachievable, which undermines the fabric of the United Kingdom. I keep asking Ministers this question, but I cannot get an answer, so it would be interesting to hear an answer from the Scottish Conservative MPs this evening. If the Government can argue, with the red lines that they have set, that they will no longer require any kind of border equipment on the border between Northern Ireland and the Republic of Ireland, if the UK and the Republic of Ireland are in two different trade and customs arrangements, how could they possibly argue, in the event of another independence referendum, that we would require a border between Scotland and England?
That is an extraordinary comment. We will see what happens come 29 March 2019 or after the transition period. I just do not think that the right hon. Gentleman can achieve what he wants to achieve with the Government’s current negotiating position.
The Scottish Conservative leader Ruth Davidson promised during the 2017 snap general election that, if Scottish Conservative MPs were sent to Westminster, they would stand against the Prime Minister’s hard Brexit and deliver what would be in Scotland’s best possible interests—[Hon. Members: “She never said that.”] Well, if she did not say that, perhaps the Scottish Conservative MPs can tell me what she did say. Ruth Davidson stands up day after day, week after week, to rail against her own Government here at Westminster, while the 13 Scottish Conservative MPs loyally traipse into the Lobby to put through the hard Brexit and everything else that is upsetting for Scotland.
I have already given way to the hon. Gentleman, and “one opportunity” means “one opportunity”.
Last week, every single vote in this House on Monday and Tuesday on the customs Bill and the Trade Bill was passed with a majority fewer than the number of Scottish Conservative MPs. If they did what they promised to do, we would be in a much better position. That is why they are undermining the Union.
Let me quickly go on to why the SNP is undermining the Union. It does not want the Union; it wants independence for Scotland. The SNP’s proposals for Scottish independence are now in this growth commission report, which has been fundamentally torn apart by anyone who has ever read it who does not want independence. This morning, the hon. Member for North East Somerset (Mr Rees-Mogg) talked about a no deal Brexit potentially meaning 50 years of austerity in the UK, but the growth commission report promises 25 years of austerity.
Well, the British Transport police, as my hon. Friend the Member for Ochil and South Perthshire (Luke Graham) rightly says, is the example that immediately springs to mind.
The delivery of broadband is another example, as I said. We should never have devolved the delivery of broadband to the Scottish Government. They were given the responsibility of delivering broadband in Scotland by Broadband Delivery UK, and the result is mayhem. We are so far behind other parts of the United Kingdom on the delivery of broadband because we allowed the Scottish Government to get involved in the first place. We can see the problems with the situation that has arisen, which makes it unclear who is responsible. Broadband is a good example of this. When anything good happens in Scotland, Scottish Government Ministers will turn up and get their photographs taken, but when anything goes wrong in Scotland, it is suddenly all reserved—they point at us and say, “Oh, it’s reserved; you should deal with it.” These kinds of games go on all the time. It is insidious and makes it all the easier for the nationalists, in that space of confusion, with their ideology of grievance and division, to do just that. We must avoid that by improving our system and machinery of governance.
Now—one minute! [Laughter.] I have one minute. The best bit’s to come. UK Government Departments should be unafraid to fly their colours in Scotland, to proudly hoist the Union flag above their offices every single day of the year, not just on the Queen’s birthday, and to tell the people of Scotland, loudly and proudly, that their United Kingdom Government is serving them. It would show people clearly that Scotland has two Governments and that both are working to deliver vital public services to them, even if they need to work more closely together.
It may seem somewhat controversial, but this debate about the intergovernmental relations in the UK will continue until we address the machinery we need to make the Governments of this country work more closely together. Ironically, I turn to the White Paper on the future relationship between the United Kingdom and the European Union. I got as far as chapter 4, where I read details about how the different Governments, Departments and Parliaments could work together for the benefit of the people. With no small sense of irony, I advise the Government to read chapter 4 on page 84 —many people never got to page 84, I am sure, but I did. It talks about how arrangements could be put in place by which Governments could work together. It is a very interesting chapter. I refer in particular to paragraph 2. The institutional arrangements it proposes are practical and flexible and would create a dialogue and mechanisms for resolving disputes and the accountability and mutual constructive tension necessary for us to get the best government possible for the people of our country.
I will conclude.
I am grateful for the support for that statement, if for nothing else I have said.
It is understandable in Scotland, where the political climate can sometimes be quite poisonous, for people to feel intimidated and harassed, rather than to engage in debate. Much is said and done under the guise of robust debate that falls squarely into the category of bullying, so fear is understandable, but I call upon Her Majesty’s Government not to flinch. They must face up to that culture firmly and fairly. I believe they shall. They should be proud and loud about their activities in Scotland. We should not submit to the bullying and provocations of the nationalists. We should not surrender our country. Under no circumstances would that bring about a flourishing Union that can be a boon to the peoples of this country for generations to come, which is what we need now more than ever before.

Commons ChamberIt is a great pleasure to speak in this debate and to follow the hon. Member for Stirling (Stephen Kerr).
At one minute past midnight this morning, the SNP Chief Whip, the hon. Member for Glasgow North (Patrick Grady), no doubt still up late celebrating England’s win in the World cup, tweeted: breaking news, this is the very first debate we will have in Parliament on the claim of right. He obviously forgot that he had a debate on the claim of right, in his very own name, on 9 September 2016 in Westminster Hall.
I agree with many colleagues across the House that I would rather be speaking here this evening on issues relevant to my constituents and my constituency. The dilution of local policing across Scotland is showing a crime spree of house breaking and car breaking in my constituency. There is a GP crisis in my constituency. People cannot sign up to GPs. They are on waiting lists and are being kicked out of surgeries. People are waiting up to two years for operations when they used to wait only 12 weeks. The train service is in meltdown and we have an economy the Secretary of State was right to say is sluggish.
After all the debates we have had since 2016, and everything in between, we still have no answers to the big questions about what an independent Scotland would look like. We have had a Growth Commission paper that is as big an act of fiction as the original White Paper. I agree with the claim of right. The shadow Secretary of State was right. Labour invented this process and drove it on back in the late 1980s. The late great Jimmy Hood, if he were still alive today, would be championing bringing back the Scottish constitutional convention so we could resolve some of these issues—wouldn’t that be a bundle of fun, with 50-odd Scottish MPs on that particular body?
The claim of right states:
“We, gathered as the Scottish Constitutional Convention, do hereby acknowledge the sovereign right of the Scottish people to determine the form of Government”.
The Scottish people have determined their own form of government. They determined to vote in 1997 for a Labour Government who promised to bring a referendum on a Scottish Parliament. They voted overwhelmingly to deliver that Scottish Parliament with tax-raising powers in the yes-yes vote. In the ballot box since then, they have delivered their sovereign will in choosing what they want to be achieved in terms of Governments and what they want to happen. Interestingly, they also do this at the ballot box for local government elections and lots of other elections.
I get so frustrated about these kinds of debates because it is about the sovereign will of the Scottish people for the Scottish National party, but only when it suits. The sovereign will of the Scottish people was to deliver a Scottish Parliament and stay in the United Kingdom. It was also the sovereign will of the Scottish people to deliver a Scottish Parliament where the Scottish National party does not have a majority, and that Scottish Parliament—if it is the sovereign will of the Scottish people—has over the last few years voted against the Government on fracking, cuts to the national health service, Highlands and Islands Enterprise, council funding, the Offensive Behaviour at Football and Threatening Communications (Scotland) Act 2012, failing educational standards and local government cuts. And what has the sovereign will of the Scottish people received in return? Nothing from the Scottish Parliament—disregard the Scottish parliamentary votes; these did not happen; turn the other way; do not implement the will of the Scottish Parliament, which is the will of the Scottish people.
Let me say why it is frustrating that it is about the sovereign will of the Scottish people only when it suits the SNP. Look at local government: it has been completely and utterly diminished, demoralised and demolished by significant cuts from the Scottish Government, who have passed on 9% or 10% grant cuts from this place and doubled and trebled them for local government.
Does the hon. Gentleman also agree that the 11 years of the SNP Government of Edinburgh has created a highly centralised state? The power grab that has gone on in Scotland is a grab to the centre by the SNP Government.
I am glad to have taken that intervention, because it goes to the point—[Interruption.] People can start shouting, “Better Together!”, but I am going to stand up for the people of Scotland and my constituency, because I disagree fundamentally with what the leader of the SNP, the right hon. Member for Ross, Skye and Lochaber (Ian Blackford), said during his speech. He does not speak for the people of Scotland. We are entitled to have a different viewpoint. The hon. Member for Stirling (Stephen Kerr) is right, because this Chamber, when the Scotland Act 2016 was given its Third Reading and Royal Assent, delivered one of the most powerful Parliaments in the world, but it is the most centralist Parliament in the world. Local government no longer exists in Scotland. It is merely an administrative arm of the Scottish Government.
Look at what we have seen today. An SNP leader of the City of Edinburgh Council wants to be given the powers to deliver a tourist tax in Edinburgh that would help hard-pressed Edinburgh Council ratepayers with all the issues that they are currently going through, and the Cabinet Secretary slaps him down on Twitter and essentially says, “No.” Where is the sovereign will of the Edinburgh people who put Adam McVey in as leader of the council under the single transferable vote system? I do not want an SNP majority-led Edinburgh Council—I want a Labour majority-led council or a Labour council majority in a coalition—but that is what the people delivered. That is the sovereign will of the people who went to the ballot box. I think that we have to reflect—I say this very publicly—on what happened in Aberdeen, when voters went to the ballot box and delivered the numbers in Aberdeen to give us what we have there. There is an incredibly centralist Government and that is why it is the sovereign will of the Scottish people only when it suits.
Let me turn to what the sovereign will of the Scottish people is actually delivering. Again, that only suits the SNP when it suits its case. The SNP refused to back a people’s vote in a referendum on the final deal from the European Union. There will be lots of different views across this Chamber—in fact, there are lots of different views among Labour Members about whether we should have a people’s vote. However, the principle for me is that, if we believe in the sovereign will of the Scottish people, why not back an additional vote for the Scottish people and people across the UK to decide on the final Brexit deal that the UK Government bring back, and then let the sovereign will of the Scottish people decide? No. The SNP reluctantly fudges it and says, “Maybe we would back it, maybe we won’t, but only if independence is on the table as part of it.” It is only the sovereign will of the Scottish people when it suits.
I simply say, on the sovereign will of the Scottish people and the convention, that it is written down. It is being delivered. It has been delivered and everything that will be delivered in the future, in terms of the sovereign will of the Scottish people, will happen at the ballot box when the people of Scotland go to vote. That is exactly what they have done. Before SNP Members start jumping up and down and saying, “What about the Brexit referendum?”, the rules of the game are as follows. There was a UK-wide referendum. People voted to leave. We are part of the United Kingdom. I hope that we do not leave. I always say, “If we leave the European Union”—I will do everything in my power to try to stop it, and if I cannot stop it, I will do everything in my power to try to soften it, but we are where we are. We cannot pick and choose votes when it suits us to pick and choose.

Commons ChamberThank you for allowing me to say a few words in this setting, Mr Speaker. I wish to make it clear that, despite whatever else I may say in this speech, I support this Bill wholeheartedly and I wish it to be a success. Uppermost in my mind when considering the Bill are the ramifications of there not being a Bill. I think about the choice the British people made to leave the EU and I respect it. We made a commitment to act on that instruction and act on it we shall—we will honour that vote. Those who choose to disregard the vote of the British people must answer to the British people. My constituency voted to remain in the EU, but I know that my constituents are democrats who expect me, as their elected Member of Parliament, to ensure that their best interests are served in the light of the outcome and that the result is upheld. Many businesses and individuals in my Stirling constituency are ready to make the best of Brexit.
The hon. Gentleman is running through the start of the speech he made in Committee, during which I asked him four times to outline how he feels clause 11 is deficient and how he would like that sorted out. Would he like to take this opportunity to tell us?
I thank the hon. Gentleman for remembering my speeches, which makes him very favourable in my sight. I shall come to clause 11, but first I wish to make it clear that the people and businesses of Stirling—the individuals who live in my constituency—want us to make the best of Brexit. All we hear from other parties, as we heard from the First Minister of Scotland yesterday, is an unmitigated diet of doom and gloom. The fact is that, as was disclosed in an esteemed social attitudes survey that was released last week, there are really no differences between the electorates in Scotland and England when it comes to what they want the Government to get on with doing. They want the best possible Brexit, and a smooth Brexit that will work for all the people of this country.
The Bill is a necessary enabling measure. No one in this House wants to put our country and British businesses through a cliff-edge Brexit. The idea that there are Members who do is often repeated, but it is just not true. We want a smooth Brexit and a working statute book at the end of it. I repeat that, and I do not apologise for repeating it.
I will try for the sixth time over two debates to get the hon. Gentleman to answer this question. I ask him to please not say that he is coming on to it, when he never comes on to it. What is deficient in clause 11? What would he like to see changed in order to make it a clause that is not deficient? Does he stand by what he said in the previous debate, that he expects the Government to come forward with amendments before it goes to the other place?
I am going to disappoint the hon. Gentleman—I will come on to that last point. What I believe should exist in clause 11 is the subject matter of the agreement that is reached between the UK Government and the devolved Administrations, in terms of UK frameworks in particular. We all accept that it is necessary that there are UK frameworks.
There is the soul of a nationalist. The hon. Gentleman manages to take any issue and to make it into a grotesque grievance, which does not even exist. The fact is that the Government are going to extraordinary lengths to achieve the necessary level of consensus and agreement by which clause 11 can be amended so that it is fit for purpose. I support that, but it does not take one iota away from the fact that I am intensely disappointed. I ask the Ministers again to tell us about the status of the negotiations and where we are on the agreement. If there is an agreement, no one will say any louder, “Where is the amendment that we were promised from the Government?” [Interruption.] I am saying it now; I just said it. The Government gave undertakings that the Bill would be amended at the stage before it left this place to go to the House of Lords.
I am not going to ask the hon. Gentleman for the seventh time, but will he tell the House what mechanism he and his Scottish Conservative MP colleagues would have in this House if the Government do not amend the Bill in the House of Lords?

Commons ChamberIn my opinion, divergence brought about by devolution enriches the fabric of the Union, but the divergence we are talking about could, in a very real sense, undermine the integrity of the United Kingdom’s common market.
I have had emails from constituents that regularly begin with the words: “I believe that Brexit should strengthen devolution for Scotland, not weaken it.” Many other Members will have had similar emails. I want my constituents to know that that is exactly my position. I want a Brexit that strengthens the democracy of our country and strengthens the devolution settlement for Scotland. I ask Ministers, in the summing up at some point tonight, to make it clear again that the Bill guarantees the existing devolution settlement and the existing powers of the Scottish Parliament and promises that there will be more powers to come.
In regard to the tone and manner in which this issue is discussed and debated, I wish to pay tribute—SNP Members will not be surprised to hear me say this—to Ruth Davidson, Professor Adam Tomkins and others, who have worked as honest brokers in this process, by working with the Scottish and UK Governments to bring them together to build consensus. I believe consensus is vital for the new constitutional settlement we need to reach.
I welcome the recent change of tone from the Scottish Government, especially from the First Minister. When she came out of Downing Street on her last visit to London, I thought she had some very positive things to say. As a Scot, I welcome that: I welcome the fact that the First Minister of my country is willing to be a positive contributor, rather than a simply a detractor.
I want take this opportunity to express my full confidence in the approach and style of the First Secretary of State and the Secretary of State for Scotland, who are leading the UK Government in the very important talks with the Scottish Government. I have great confidence that there will come out of the discussions an agreement that will be sustainable because it will be built on consensus. Consensus is not gained by shouting matches or feigned indignation—we see quite a lot of feigned indignation in this place—and all I would say is thank goodness the SNP leadership in Edinburgh has more maturity than some of the MPs it sends to London. I remain hopeful, and I am optimistic.
I was just about to deal with the hon. Gentleman’s previous intervention, but I will sit down.
I was about to ask the hon. Gentleman when he was going to talk about the deficiencies in clause 11 and what he would do to sort them out.
I will say this much: it is not that I do not understand people’s concerns about clause 11, because I share some of those concerns. As the intergovernmental discussions progress and the Bill returns to this House, as it will, before it goes to the other place, it is very much my hope that there will be some greater detail in clause 11 to help all hon. Members to have a degree of confidence in its intent.
We are talking about trust, or the lack of trust, and that issue is keeping us from working out a satisfactory agreement. Steps must be taken to underpin the trust that needs to exist on both sides—the UK Government and the devolved Administrations. The UK Government will have to demonstrate trustworthiness in the way that the Bill is amended, as it must be, and the Scottish Government will have to show trustworthiness by committing themselves to the outcome of these talks to the extent that they will publicly state their support for the passage of a legislative consent motion in the Scottish Parliament. To me, that is what trust looks like.
There are, as we have discussed, either 109 or 111 powers. The Public Administration and Constitutional Affairs Committee report lists 111. There is an issue of trust that we need to address to underpin any eventual agreement. The point is that the Bill will need to be amended. Those amendments will need to reflect where the powers will eventually rest, and whether they will go straight to the devolved Administrations on the day we leave the European Union, or if some will be subject to mutual agreements—memorandums of understanding—that will create the frameworks to support the functioning of the UK’s internal market. I hope very much that the Government will bring forward some detail to add light with regard to those issues.
Like many of his colleagues, the hon. Gentleman is therefore admitting that clause 11 is deficient. He is almost but not quite telling us how he might fix it, but even so he is going to vote in favour of it this evening.
Yes, and that is no surprise, because I sit on the Conservative side—the Government side—of the House of Commons. I believe and trust in the Government. I believe that Ministers will deliver on a settlement. I do not know why that is such a surprise to Opposition Members.
In common with other colleagues who have spoken today, I expect there to be amendments, and when those amendments come to the House in due course, it will be because everyone involved in this process, including the UK Government and the devolved Administrations—the Scottish Government are my immediate interest—will have put on an adult head because there is so much at stake for our country. I happen to think that one of the most positive contributing factors to the change of climate has been the Scottish Affairs Committee’s excellent report, which is a step in the right direction.
On a point of order, Sir David. I am slightly confused about the process in this Chamber. The hon. Gentleman is making a fine speech, but he keeps talking about amendments that will result in him supporting the Bill. Have you been notified of the Government tabling any amendments to clause 11?

The reality is that the power to legislate in this area belongs with the Scottish Parliament.
As I have said, instead of treating such issues as political ping-pong balls, where there are elements reserved for Westminster, elements that are at Holyrood level and elements that require the intervention of a local authority, would it not be better if we worked together? Problems can be passed between Holyrood and Westminster without resolution, or we can take responsibility as lawmakers to work together for a solution. I believe in creating partnerships to achieve things, rather than issuing press releases as a display of political virility. Activity and achievement are not the same thing in politics. There is much to do in Scotland.
I congratulate the hon. Gentleman on securing his first debate in this Chamber and on his election. He talks about working together, so was he as astonished as I was when the Scottish Nationalist Government in Edinburgh voted against lifting the public sector pay cap in Scotland while SNP Members here voted to lift it in Westminster? If so, could the UK and Scottish Governments work together to lift the public sector pay cap?
Contradictions between what the SNP does in the Scottish Parliament and what it says here are quite common.
The Scottish Parliament has powers to do so much good, but some of those powers remain unused. The tax-raising powers that the Scottish Parliament has had since its inception, which were agreed to at the referendum in 1997, remain in their box, unused. I do not believe in higher taxes, but there have been a few parties that might have some small representation in the Scottish Parliament that do. The SNP has the full right to use those powers, so when we hear talk decrying the funding settlement, we should remember that the Scottish Government have the power to vary the tax rate and to raise their own money.
Newer powers, on speed limits and air passenger duty, also remain unused, but we will see what the future holds in respect of those powers. All these powers are weapons in the arsenal, and let us not forget that they were brought forward by a Conservative Government looking out for the interests of the people of Scotland.
Just because we have our own powerhouse Parliament in Edinburgh does not mean that our Parliament in London should be less of a force for good in Scotland. The UK Parliament is still as much of a Scottish Parliament as it has been since the Act of Union in 1707. Scotland is one land with two Parliaments. We deserve our voice to be heard here and we deserve our Government—the UK Government—to work in our interests. Action taken by the Exchequer to work with the oil industry, to ensure that the full force of the UK economy can come to the assistance of the regional economy of Aberdeen, is an example of our working together as a United Kingdom.
