May I congratulate the Government on convening the summit and on its success? It is, as the Secretary of State said, a considerable achievement to get the US, the EU and China to agree a communiqué. It was good to have access to the frontier models that the summit agreed. Having future summits, in six months’ time, is also an important step forward.

As the Secretary of State said, the summit focused principally on frontier AI, but it is vital that we can deal with the here-and-now risks of the AI being deployed already. In the White Paper that they published in March, the Government said that they expected to legislate to have regulators pay

“due regard to the principles”

of that White Paper, but such a Bill was missing from the King’s Speech. Meanwhile, in the US, a very extensive executive order has been issued, and the EU is finalising its Artificial Intelligence Act.

Will the Secretary of State think again, in publishing the response to the White Paper, about taking this final opportunity before a general election to ensure that the good intentions and practice of the Government are not inadvertently left behind, with other jurisdictions’ legislation preceding our own and other people setting the rules rather than the United Kingdom setting a framework for the world?

I thank my right hon. Friend for his important question. I think it is right that we do not rush to legislate, because we need to understand properly the risks that we are facing. That is why we have been investing in bringing on board the correct experts, both into Government and into the taskforce that will now morph into the institute. It is why we have also committed not just ourselves but our international partners to producing the “state of the science” reports, so that we can stay up to date with those risks.

Absolutely, we will eventually have to legislate, but as we said in the White Paper that we published earlier this year, we do not need to rush to do that; we need to get the timing right to ensure that we have the right solutions to match those problems. There is a lot that we can do without legislation. We demonstrated that last week by convening the world for collective action to secure pre-model deployment testing, to ensure that we work together to get a better handle on the risks, and to encourage partners such as America to go further, on which we have seen us and them acting in lockstep.

Science does not recognise borders, and everyone wins when the best UK scientists can work with the best in the EU and around the world, so this is a huge and positive announcement and has been greeted with delight and relief not just by the science community in the UK, but across Europe and beyond.

My Select Committee, the members of which are in the Chamber, will examine the deal in detail, but may I congratulate the Secretary of State, her Minister and the whole of the Government on what seems to be a shrewd agreement that, for example, allows us to win grants even beyond our own financial contribution? Will she confirm that Horizon funding is available not just to academic institutions, but for innovation by British industry? Has she consulted formally the UK Atomic Energy Authority, which runs our fusion programme, about not participating in Euratom and, if so, what is its view? Does she agree that, with the reputation of British science as high as it is, with the science budget doubling as it has over the past 10 years to £20 billion a year by next year, and with now the opportunities of rejoining Horizon opening up, this is a golden opportunity for the UK to advance our status as a science superpower?

I could not agree more with my right hon. Friend, the Chair of the Select Committee. I am delighted that he has welcomed this announcement today. In relation to his comments on Euratom, we did consult widely the sector and the UK AEA, which has welcomed this publicly, along with many stakeholders, including the business community, which will also benefit from this announcement today.

In line with your advice, Madam Deputy Speaker, I will address my new clause and the amendment in my name specifically, and I will also touch on the amendments tabled by my hon. Friend the Member for Christchurch (Sir Christopher Chope). I will not rehearse the reasons for the Bill. We have had a substantial debate on Second Reading and in Committee, and I hope it may be possible to say more on Third Reading.

New clause 1 would require the Secretary of State to issue guidance to the police about the new offence proposed in the Bill, and that guidance must include, but is not limited to, guidance on the defence of reasonable conduct that is already contained in the Public Order Act 1986.

During our debate in Committee, some Members were understandably concerned that the perpetrator of an act of deliberate harassment of a person on the grounds of their sex could escape the consequences of their actions by asserting that they thought their behaviour was reasonable. Some Members thought there was a risk that the police might be put off from taking the offence seriously, because of that potential defence. In fact, in the Public Order Act, reasonableness is not in the eye of the accused. Simply saying that behaviour that was intentionally designed to cause alarm or distress was reasonable does not provide a “get out of jail” card. Having clear guidance on this point would ensure that the matter is crystal clear to the police and all the authorities.

The proposed requirement for statutory guidance therefore provides that clarity, but it is not limited to that; the guidance can include other matters, should that prove desirable in future. The guidance would be addressed to the police, as is obvious from the terms of the new clause, but in practice its use would be wider than that, and would include the Crown Prosecution Service. That is because statutory guidance, once issued, is in practice taken by all parties to be authoritative. Indeed, there is no point in having separate guidance for the police, the CPS and any other body.

This is far from the only occasion when guidance is formally issued and addressed to one particular audience, rather than being proliferated to multiple actors. For example, statutory guidance within the Stalking Protection Act 2019 is formally issued to the police, but was drawn up in consultation with other statutory partners, including the Crown Prosecution Service. I envisage and hope that the Minister will be able to confirm that the same approach will be taken in this case, and that the CPS would be involved in drawing up the guidance to which my new clause refers.

It seems to me, reflecting on the debate we had in Committee, that an amendment that guidance must be issued and must include, inter alia, statutory requirements on the interpretation of reasonable conduct, is a pragmatic and practical way of responding to the points made in the debate. I am delighted that new clause 1 has attracted widespread support, including that of the Government, whose assistance in drafting it I grateful acknowledge.

With the leave of the House, I will briefly thank all those who have aided the passage of the Bill.

I start by thanking my constituents who, over the years, have shared with me their experiences and encouraged me to bring forward this legislation, supported by campaigning groups from across the country.

To turn those intentions into prospective legislation, one requires advice and support. I am grateful to officials and Ministers in the Home Office, including the former Home Secretary, my right hon. Friend the Member for Witham (Priti Patel), and the current Home Secretary and her ministerial team.

My hon. Friend the Member for Derbyshire Dales (Miss Dines), who has seen the Bill through its previous stages, is indisposed today. I want to put on record my thanks to her and to my right hon. Friend the Minister for very ably picking up the brief today and responding during the Report stage. I am grateful to him for that.

I thank the excellent Clerks of the House. In particular, I would like to single out the Clerk responsible for private Members’ Bills, Anne-Marie Griffiths, who does a tremendous job, supported by her very able colleagues. We are grateful for the advice that she has given.

Finally, I thank the no less able Whips on both sides, in particular my hon. Friend the Member for Castle Point (Rebecca Harris). She has developed a reputation for sensing the mood of the House. In a House that can sometimes be a forum for contention, my hon. Friend has great skill in being able to bring us together on occasions such as this one.

Having put on record my thanks, I commend the Bill to the House.

I am grateful to the hon. Gentleman for his work in crafting this proposal, and I repeat the commitment to continue to work together as the draft clauses become clauses that are laid before the House. The procedures of this House allow substantial debate of those clauses in Committee and on Report. I agree with his assessment. It is not the case that every regulation proposed by the European Union is ideal and well suited to our circumstances. From my experience in European Councils, there is a process that tries to apply a set of rules in many different countries and economies that may not actually be the best for the UK economy. The procedure that the hon. Gentleman has given us the ability to discuss today provides this House with a means by which to consider what the best form of regulation is, suited to our circumstances and respecting the sovereignty of this House and this Parliament.

I am grateful to my hon. Friend for his question. He will see that one of the differences between our approach to industrial strategy and policy—it is important to note that industry, for this purpose, means the services sector as well as manufacturing—and previous approaches is that our approach will not be about simply addressing the needs of incumbents; we want to make Britain the best, the most competitive and the most contestable place for business to locate. I would be grateful if my hon. Friend contributed to it. I think that he will find that it is music to his ears.

Surely, one of the Secretary of State’s priorities should be the steel industry. Is he aware that Noel Village foundry in Doncaster is being badly affected by reductions in the steel industry supply chain? Will he ask his Department to give urgent advice to the company to see whether anything can be done to prevent it from going into administration, even at this late stage?

I am happy to meet the right hon. Lady about this, but I can give her some news on steel that I think she will welcome. I can announce today that the Government are going to publish their demand for steel, through public sector bodies, to 2020; that will be 3 million tonnes. We are updating the procurement guidelines for steel to include the health service and local authorities and to drop the previous threshold of £10 million for which those guidelines apply. That will be good for the steel industry generally and for all firms within it.

I certainly do, and my hon. Friend is right to point out the wave of benefits across the economy, one example of which was given by the hon. Member for Middlesbrough South and East Cleveland (Tom Blenkinsop). The consequences of such positive news extend to other important sectors. That is why it is important that we should be active and vigorous in attracting these investments.

This is an extremely welcome announcement, but there is a worry that it could be an isolated deal, rather than a clear strategy for the regions. When the situation is contrasted with the redundancies announced by DB Cargo UK in Doncaster, with Brexit being cited as one of the reasons, does it not point to why it is so important for the Government to conduct regional impact assessments of Brexit, and to publish them to demonstrate that there is a clearly though out strategy that will reflect the needs of regions, as well as sectors?

It is nice to hear the right hon. Lady being able to speak from the Back Benches; she does so compellingly. As colleagues who know my interests in these matters would expect me to say, I believe that our regions, towns, cities and counties have an important role to play in our industrial strategy. I do not know whether she has been elected to the new Business, Energy and Industrial Strategy Committee, but I am sure she will be able to attend its sittings, because I hope that we will be discussing precisely this during the next few weeks.
