T10. Residents and organisations in my constituency will welcome the Government’s decision to update the law relating to scrap metal. When will the necessary amendments to the Legal Aid, Sentencing and Punishment of Offenders Bill be brought forward?

It is the Government’s view that justice should be done, and that is best done by judges taking into consideration the circumstances of every individual case. There will be circumstances in which Parliament has made clear its views in legislation. As a former Parliamentary Private Secretary to the Home Secretary, the hon. Gentleman will well understand that. He will also well understand the potential for miscarriages of justice if this place chooses so to tie the hands of judges that they are not able to exercise justice in the individual cases that come before them.

There are a lot of noises off about this Government’s sentencing policy, but is not the reality that the simple aim of that policy is to reduce reoffending and to protect the public, and that nothing more need be said?

Before any decision is made to withdraw legal aid for families dealing with special educational needs tribunals, will my right hon. and hon. Friends work with the Department for Education, particularly in the light of its proposed Green Paper on the reform of SEN procedure, to ensure that the families of children with SEN get all the help and support that they deserve?

I detected a degree of contradiction in how the hon. Gentleman presented his question. He does not want to go as far as we would on the rehabilitation of offenders, but then asks us to go the distance. That is exactly what we will do. It would be wholly short-sighted to cut our capacity to deliver rehabilitation of offenders, and that is why we will enable a system that gets the whole country—including the voluntary, not-for-profit and the private sectors, as well as the existing state services—to work together to deliver effective rehabilitation of offenders and effect a step change in the delivery of what is a critical public service.

8. What recent discussions he has had with ministerial colleagues on the provision of training for prison service staff on the management of offenders with mental health conditions.
