The public will rightly expect that their protection is the overriding concern when serious offenders are assessed either for release by the Parole Board or, indeed, for transfer to an open prison, a subject on which my right hon. Friend touched. I know from my own time as non-executive director at Her Majesty’s Prison and Probation Service that open prisons can be an extremely important part of an offenders’ rehabilitation, especially at the end of a very long sentence. We have seen recent cases where the current test has clearly not worked effectively. Does my right hon. Friend agree that time in an open prison should always be regarded as a privilege, certainly never an automatic right? Will he confirm that the measures that he has already introduced, and that he is going on to introduce later today, will result in a more cautious approach that will make sure that the public is always safe?

I agree with everything that my hon. Friend said. I do not think that there is a trade-off. In fact the two things go together: we want to protect the public as well as identify those who can be released into open conditions or into society—those who are ready to play the right role, to reintegrate back into society, to work, to look after their families and to stay clean of drugs. All of those things go together. Ultimately, our objective is to protect the public, drive down crime and reduce reoffending.

I have given the hon. Gentleman a written answer detailing these points, but I am happy to write to him again. As I just said—it is crucial to stress this—not only is the backlog falling, but we want to go further. The key measures include legislation to increase magistrates’ sentencing powers; funding, with almost half a billion pounds in the spending review; and increased court capacity, with renewed Nightingale courts where appropriate. Increasingly, the biggest challenge is judicial capacity, but I am pleased to say that we are recruiting more full-time judges and allowing more part-time recorders to sit for more days. Importantly, having launched our £1 million recruitment campaign for our volunteer judiciary, the magistracy, we have had in excess of 20,000 expressions of interest.

Aylesbury Crown court was the first to fully reopen after covid, thanks to the determined leadership of His Honour Judge Francis Sheridan, who steps down as resident judge this month. Will my hon. Friend join me in paying tribute to all the court staff in Aylesbury for their progress in clearing the backlog, and in thanking Judge Sheridan for his constant innovation to make his court more efficient and much more strongly focused on victims?

My hon. Friend, as a former magistrate with much additional knowledge of probation issues, speaks about these matters with huge expertise. I do pay tribute to the resident judge, and indeed to all members of the judiciary. They are, of course, independent from Government, and they have huge responsibilities. As I said during my first appearance at the Dispatch Box, we owe a huge debt to all our judiciary as well as all our clerks and all those who work in our courts for keeping justice going during the pandemic, and we can repay them by taking every possible measure to reduce the backlog.

As a former journalist, I believe strongly and passionately in freedom of the press. We see all too vividly at the moment how important that is with the incredibly brave journalism coming out of Ukraine, yet that freedom has been increasingly threatened in recent years, so I welcome my right hon. Friend’s statement. Will he reassure journalists and the wider public that he will take whatever steps are necessary to uphold freedom of the press and freedom of speech more widely?

I welcome the comments from the Labour Front Bench. We look at a whole range of opportunities for investment in Northern Ireland, to give it the opportunity to attract inward investment and to host international events. That will be a core part of what we are able to do through levelling up, and it is a key thing that the Secretary of State and I have been driving through our city and growth deals to help Northern Ireland and communities in Northern Ireland to attract investment that creates jobs and prosperity, which is the best way to underpin peace.

The Northern Ireland (Ministers, Elections and Petitions of Concern) Act 2022 was specifically designed to improve the sustainability of the Northern Ireland institutions. The benefits include allowing more time and space for the formation of an Executive following an election or the resignation of the First or Deputy First Minister.

I was pleased to serve on the Bill Committee for that legislation, and it is now clear that it was timely, given the recent resignations of Northern Ireland’s First Minister and Deputy First Minister. Can my right hon. Friend assure me that he is emphasising to Northern Ireland’s political parties that they all need to play their part and work together to achieve stable devolved Government?

I continue to speak to a range of stakeholders, including the party leaders in Northern Ireland, about the importance of having a strong, functioning Northern Ireland Executive. A couple of them are in the Chamber now, and I have expressed to them my desire to have a First Minister and Deputy First Minister nominated now and after the May elections.

We are five months away from Safe To Be Me, the UK’s first ever global LGBT rights conference. Everybody should be free to be themselves, but that is not true in too many parts of the world. We will work with friends and allies across the globe to turn the tide on authoritarianism, spread freedom and end the criminalisation, persecution and violence experienced by far too many LGBT people.

Aylesbury has a sizeable Pakistani diaspora. We have seen excellent campaigns locally and nationally to encourage uptake of vaccines among this community, but in the town’s central wards fewer than half of the people have had the booster so far. What steps is my hon. Friend taking across Government to encourage vaccine take-up among ethnic minority groups, especially those who do not have English as their first language?

My Department has been working across Government to promote vaccine uptake among ethnic minorities. We have worked with trusted local voices such as faith leaders to spread messaging, and we publish key information and advice via community TV and radio stations, translated into a range of languages including Urdu and Punjabi. In May, I met the high commissioner for Pakistan to consider other ways we can reach out to diaspora groups to promote vaccine confidence and uptake. I should say that between April and October 2021, the largest increase in vaccine uptake among the over-50s was in the Pakistani and black ethnic groups.

My hon. Friend makes an important point, highlighting one of the reasons why, when we published our Command Paper in the summer, we said that, as of then, the conditions to trigger article 16 had been met. We are very clear that we do not rule that out. If we have to use article 16, we will, but we are in negotiations with the European Union. The ideal solution for us would be to come to an agreement with the EU, but that has to be one that delivers on the needs of the people of Northern Ireland.

A great strength of being an integral part of the UK is being able to benefit from the excellent trade deals being agreed around the world now that we have left the EU. Clearly, different regions and nations will have different needs from those deals, so what steps is my right hon. Friend taking to ensure that Northern Ireland’s voice is heard in trade negotiations as a means of strengthening its place in the Union?

My hon. Friend is absolutely right: as a Government of the whole United Kingdom, we are committed to ensuring that Northern Ireland’s businesses and consumers have access to and benefit from new trade deals. The Department for International Trade now has an office in Belfast and, just last month, I hosted, with the Secretary of State for International Trade, the Board of Trade in Derry/Londonderry. I look forward to doing more on that. We work with businesses in Northern Ireland and the Northern Ireland Executive to make sure that we can deliver and involve them in these opportunities.

It is a pleasure—although always slightly daunting to follow my hon. Friend the Member for Newbury (Laura Farris)— to speak in this debate. I must start by declaring an interest. I served as a magistrate for 12 years prior to my election and spent almost five years as a member of the Youth Justice Board. It is on the subject of the magistrates and youth courts that I wish to focus my remarks. The proposals for changes to procedures in the magistrates courts strike me as sensible and balanced measures that will, in many respects, simply bring them into the 21st century. The new processes and procedures herald a marked improvement to the way courts run, saving time, improving efficiency and therefore helping to ensure speedier justice.

It is appropriate to echo the remarks of my hon. Friend the Member for Warrington South (Andy Carter) and mention the tremendous achievements in the magistrates courts over the past 18 months. Following the inevitable disruption caused at the start of the pandemic, the magistrates courts were incredibly quick to adapt to new methods to prevent delays to justice. With more than 85% of criminal cases falling entirely within the jurisdiction of the magistrates courts, they are absolutely vital to the overall smooth running of our judicial system. We should not forget that magistrates are volunteers. I pay tribute to them for all their efforts, alongside the staff of Her Majesty’s Courts and Tribunals Service, the legal representatives and other services, such as victim and witness support—the latter also volunteers.

The flexibility and adaptability of those working in the magistrates courts over the past 18 months is a clear demonstration of the capability, readiness and willingness of justices of the peace to embrace change.

I particularly welcome the digitising and streamlining of preliminary pretrial court proceedings via the common platform, the removal of unnecessary courtroom hearings, and the strengthening of links between Crown Court and magistrates courts. Creating the option for online written pleas will enable defendants to sit with their legal adviser at a time of their own choosing and submit the required information via the common platform. That must be preferable to waiting in a courthouse for hours on end for a hearing that will likely last just a few minutes.

Similarly, I believe that permitting an allocation decision to be made online or in the absence of the defendant, in the appropriate circumstances, will enable courts to progress cases and avoid unnecessary delays. This is especially welcome for indictable-only offences, where the appearance in the magistrates court is no more than a formality.

I am aware that there are concerns about ensuring that defendants will be properly equipped to make decisions about their cases if they are not physically in a courthouse. I share those concerns, so I am therefore very pleased that there will be safeguards to ensure that defendants have the right advice and support and, crucially, that a full court hearing will always be available when needed and considered to be in the interests of justice. I am grateful to Ministers in the Ministry of Justice for reassuring me already that especial care will be paid to particularly vulnerable defendants and to children.

The introduction of a new automatic online conviction and standard statutory penalty procedure is a further positive step. It has long struck me as disproportionate for someone to come to court if they have not paid for a rail ticket or have fished with an unlicensed rod. An online process that does not require the involvement of a magistrate seems a much more appropriate way of dealing with such cases. Of course, it will be necessary to ensure that only very low-level offences of such a type take place without direct judicial oversight, and I am pleased that the addition of any further offences to the mechanism would need to be explicitly agreed by Parliament.

The decision to abolish local justice areas makes further good sense. The current system can result in arbitrary borders that prevent a magistrate from sitting in a court just a few miles from their home if it happens to be in a different LJA. The proposals in this Bill will mean that work and people can be distributed according to need and availability. One consequence will be the ability for closer working between Crown Court and magistrates courts. That greater alignment of different branches of the judicial family is undoubtedly another positive step.

However, a few questions arise from the proposals to scrap LJAs. At present, each area has its own bench chairman, deputies, chair of youth court and so on—magistrates who volunteer to take on leadership and pastoral roles. It would be helpful to learn a little more from the Minister about how those functions will be carried out in future, and to have reassurance that magistrates will still have a degree of agency over decisions and practices affecting them directly. We also know that local areas can see different patterns of crime, distinct from one another. Until now, magistrates courts have been able to reflect that in their sentencing, so I am keen to hear from the Minister about how specific local factors will be reflected henceforth.

Of course, magistrates courts can only function well when there are enough magistrates to sit in them. The number of those on the bench has fallen dramatically in recent years. I am pleased the Government are now attempting to recruit more people to the magistracy, but it is important that magistrates represent all walks of life, all ages and all backgrounds, and I wonder whether the Minister might tell the House a little about how he hopes that might be achieved in the years ahead.

There are relatively few clauses in this Bill affecting the youth courts. There are provisions regarding the transfer of cases when a young person reaches the age of 18, but I will use this opportunity to repeat to the Minister and his colleagues in the Department my call for young people to be dealt with by the courts according to the age at which they committed their offence, rather than their age when they first appear in court, which is the current process.

I was pleased to introduce a ten-minute rule Bill on this subject last February that received support from across the House, including from some very learned and distinguished hon. Members. As I said then, it would be a relatively simple change to make in legislation, because in many respects, it does no more than correct an anomaly. For those affected, however, its effect would be profound because of the different sentencing options that are uniquely available in the youth jurisdiction. Such a change would enable young people to put their mistakes behind them and make a constructive contribution to our society. It would put more emphasis on preventing reoffending, which is key to reducing the number of victims of crime—something that we all wish to see.

The number of such cases may not be high, but they have a massive impact on the young people concerned. I heard only this week about the case of a boy who was arrested at 16 and is still waiting for his first court appearance three and a half years later, now he is nearly 20. That cannot be right, so I hope that as the Bill progresses through Parliament, Ministers will consider whether this could be the appropriate time and place to bring about a change that is supported throughout the justice system.

Much of our debate on the Bill has focused on measures that relate to judicial review. They are certainly very important, but we should not overlook the other positive steps that are being taken to improve our justice system. I am grateful to have had the opportunity to highlight the Government’s strong and sensible changes to magistrates courts’ proceedings, which I am confident will bring benefits to defendants, witnesses, lawyers, court staff and magistrates themselves, as well as to victims of crime. That is why I am pleased to support the Bill.

Our overarching objective of COP26 is to keep within reach the goal of limiting average global temperature rises to 1.5 °C. To achieve that, we have been asking countries to set out ambitious emissions reduction commitments and to come forward with adaptation plans, and asking developed countries to deliver on their climate finance promises and for us collectively to reach agreement on the outstanding elements of the Paris rulebook.

My hon. Friend raises an important point. Science and innovation are crucial to tackling climate change and delivering green growth. Innovation will be discussed at the world leaders’ summit at COP26. On 9 November, we will provide a particular focus on discussing and indeed showcasing science and innovation’s role in tackling climate change.

Along with the national and global policy objectives of COP26, many local voluntary organisations are already raising awareness of the impact of climate change, including Climate Action Wendover, in my constituency. Does my right hon. Friend agree that the work that such organisations do is important in helping people to understand that the only way to reach net zero is by everyone changing the way they behave, at home, at work and in their local community?

The right hon. Lady should check her facts, because Chevening is funded by a charity—not a penny of taxpayers’ money.

The most disastrous thing for the energy bills of hard-working people across the country would be to follow Labour’s plan to nationalise the energy companies, which the CBI says would cost as much as £2,000 in bills. This Government are the ones taking action to take the country forward, with a plan for the NHS and a plan for covid, and our plan is working: employment up, job vacancies up and wages up. If we had listened to the Labour party, we would never have come out of lockdown. We are the ones taking the difficult decisions and getting on with the job, and our plan is working.

Q3. Last week, members of the armed forces parliamentary scheme from across the House attended our excellent Defence Academy. What is striking is the number of service personnel from overseas who come to the UK to benefit from its world-class professional defence and security education. Does my right hon. Friend agree that this is a further illustration that, far from being a fifth wheel on the carriage, the UK is at the heart of ensuring global security, and that the AUKUS pact is one of the best ways to meet emerging threats, particularly in the South China sea?

My hon. Friend is bang on. The AUKUS partnership is incredibly important for our security. It builds on what we said in the integrated review about promoting stability in the Indo-Pacific. It builds on our free trade agreement negotiations, including the comprehensive and progressive agreement for trans-Pacific partnership. It builds on our membership, as a dialogue partner, of the Association of Southeast Asian Nations—the first new member in more than 20 years. It will provide huge opportunities for jobs and businesses here at home, as part of the levelling-up agenda.

I am afraid the hon. Gentleman is running down the UK’s efforts, as well as what the summit achieved, which is 1 billion more vaccines, on top of the 1 billion that G7 countries have already committed to distributing around the world. This is only six months after these vaccines were invented—it is an astonishing thing! He attacks the performance of Britain and the people of the UK, but let me remind him that we in this country are responsible for one-third of the 1.5 billion vaccines that have been distributed around the world. When will he get that into his head? That is a fantastic record, on top of the 1.6 billion that we have been contributing to that COVAX roll-out. I think the people of this country should be immensely proud of the Carbis Bay declaration and the vaccines contribution that we are making. We are working as fast and as hard as we can, while still getting vaccines into the arms of our own people in this country, and that is absolutely right.

Communiqués from the G7 and NATO summits speak of increasing challenges and threats from China, be they military build- up, cyber-attacks, human rights abuses, or the belt and road initiative. Will my right hon. Friend reassure the House that the common values and commitment that we and our partners have to democracy and the rules-based international order will result in the G7 and NATO tackling the malign actions of the Chinese Communist party, whatever form those take?

Yes. Nobody at either the G7 or NATO wants to get into a new cold war with China, but on the other hand they see that the opportunities we have to trade more and engage with China must be matched by firmness in our collective dealings with it, particularly when it comes to the Uyghurs, as colleagues have mentioned several times, and when it comes to navigation in the South China sea, and the freedoms and rights of the people of Hong Kong.
