Commons ChamberEvery one of the 65 million or so people in these four nations who has a mobile phone, tablet, iPad or Alexa-enabled device is a potential target for hostile nations seeking to damage our cyber-security, but the National Cyber Force budget amounts to 10p a month for each of those citizens. What representations has the Minister made to the Chancellor to raise that budget to a more reasonable level?
I have some exposure to this, having been Chief Secretary to the Treasury. Of all the budgets, the agencies’ budgets have increased more than most, if not the most. Significant funding has been put into the National Cyber Force as part of the cyber corridor in the north-west. There are sometimes limits to how much detail one gives on some of those budgets, but I am happy to interact with the Intelligence and Security Committee to provide any reassurance the House needs that significant funding is being provided on our resilience and our national cyber-response. That builds on a number of points raised this morning, including our work on the skills needed as part of that resilience and the situation centre in which we have invested.

Commons ChamberI do welcome that announcement. As the Energy Minister, my right hon. Friend the Member for Chelsea and Fulham (Greg Hands), said, the backing for tidal steam power is opening up a new chapter for Britain’s coastal communities and advancing the possibilities for Britain’s marine energy sector to play a significant role in delivering the UK’s green energy revolution.
A large number of small and medium-sized enterprises play a crucial role in the UK’s supply chain and many rely on imports from the European Union to keep that supply chain going. Such businesses were let down badly last year when import controls were introduced on the other side of the channel; what guarantees can the Minister give that when the UK starts to impose import controls in January the needs of small businesses will be kept in mind?
We are working in collaboration across the United Kingdom: I joined a call with the First Ministers, including the First Minister of Scotland, to discuss supply chain issues. We have also brought in expertise such as Sir Dave Lewis, former chief executive of Tesco, to work with us. How we maintain the resilience of our supply chains involves shared issues that we are working together on across the UK.

Commons ChamberI have just given way and addressed my right hon. Friend’s points head on. Let me, in turn, address head on the points raised by the shadow Chancellor, the hon. Member for Leeds West (Rachel Reeves).
In the shadow Chancellor’s speech, she said that she opposed the levy despite, as a number of Members pointed out, the previous Labour Government taking a similar approach in 2002-03, because she supports taxing wealth. The problem with that is that only a broad-based tax base, such as income tax, VAT or national insurance contributions, can raise the sums needed for such a significant investment. Again, that was a point made by critics of the Government, including my good friend, my hon. Friend the Member for Wycombe (Mr Baker). It could not be raised by taxes on wealth. Currently £6 billion is raised from inheritance tax, £8.7 billion from capital gains tax and £12.3 billion from property transaction tax. Indeed, that case was demolished by the Chair of the Treasury Committee, my right hon. Friend the Member for Central Devon (Mel Stride), as well as by my hon. Friends the Members for Dudley South (Mike Wood) and for Thirsk and Malton (Kevin Hollinrake), who highlighted that to raise the revenue required requires a broad-based approach.
On the subject of cases being demolished, one of the cases that the right hon. Gentleman’s colleagues have made great deal of play of today is that of the fictional Yusuf in the Government’s own document. According to the Government, Yusuf’s care home costs are £700 a week. They claim that under the current system they would have had to spend £293,000 before they reached the current cap. The Minister will be aware—I hope he can count—that in order to spend £293,000 at £700 a week—
What percentage of people going into a care home have any chance of still being alive in nine years’ time?
One of the features of the Dilnot proposals—Dilnot has been very frank about this—is that his costs ramp up over time. That is why the initial funding is £5.4 billion, but obviously, the social care element will increase. I will come to the case put forward by SNP Members, who seem bizarrely not to want the Union dividend that is offered and to not be seeking that additional funding. Let me finish on the Opposition amendment—

First, I refer to the answer I gave earlier about the universal nature of the package. Another such area that my hon. Friend did not mention is the fishing sector, which was particularly impacted not only through its supply of the restaurant trade but through its exports, which were also hit. We have listened to concerns there and put in some additional support. But the best way we will support businesses, whether in the wedding sector or elsewhere, is by getting the virus down. That is why we have taken the comprehensive measures that we have for the next four weeks. That is the best way to be able to open up these sectors and get the people who have been furloughed or supported through the self-employed scheme on to the job support scheme, where they will then qualify for the furlough bonus, which will be further support that is available.
For all the Minister’s sweet talking, the simple fact is that nearly eight months after the first lockdown was imposed, millions of self-employed people and small businesses are still being excluded from Government support. He has spoken approvingly today of comments from a recent Public Accounts Committee report, so may I draw his attention to the Committee’s 20th report of this Session, unanimously agreed by a Committee with a Conservative majority?
The report says:
“The Committee is disappointed that, so long after the beginning of the pandemic, HMRC has still not made sufficient use of its data to identify small businesses which have been left out of previous support packages, and therefore maximise taxpayer eligibility for grant support.”
Can the Minister not accept that the Committee’s disappointment reflects a view widely held among all parties in the House and that it is time for the excluded 3 million to be supported by actions, not just words?
I am somewhat surprised that the hon. Gentleman talks of actions when, as a result of our ability to operate UK-wide, we have been able to support nearly 1 million jobs in Scotland. Some 65,000 businesses in Scotland have benefited from the UK Government loan schemes and, as of 31 August, 242,600 employments were furloughed, at a take-up rate of 10%. Significant support has been offered to businesses in Scotland, as indeed it has been to businesses throughout the UK. It is odd that the hon. Gentleman talks about actions and ignores the nearly 1 million jobs that have been supported as a result of the actions that the UK Government have taken.

Commons ChamberAs a point of principle, HMRC always seeks to collect the tax that it is due. One of the areas of innovation—I will come on to such areas as Making Tax Digital—is about making that easier for HMRC, but I appreciate that the right hon. Gentleman is making a point more about fraud than error. The underlying principle is that HMRC always looks to collect the tax that it is due, but if he has a specific point on a constituency basis, I know that my right hon. Friend the Financial Secretary to the Treasury will always be keen to discuss it with him, because he has a zeal for cracking down on any such practice.
The Government have done much to squeeze the tax gap: by ensuring that companies increasingly pay their way; by cracking down on offshore avoidance and evasion; by tackling tax avoidance schemes; by helping people to get their taxes right first time; and by investing in HMRC’s toolbox. If one looks at the actions being taken in terms of large businesses, they will see that there is an exceptional level of scrutiny. At any one time, HMRC is engaged with half the UK’s largest businesses and we have introduced specific measures to shape behaviours. For example, the diverted profits tax was introduced in 2015 to ensure that multinational companies pay UK tax in line with their UK activities. Under our rules, those companies either declare the correct amount of profits in the UK and pay the full amount of corporation tax on them, or they risk being charged a higher amount of diverted profits tax at a rate of 25%. It raises tax directly through encouraging changes in groups’ behaviour that, in turn, leads to increased tax receipts.
The Chief Secretary quoted a figure of 25% as a potential penalty. Will he tell us how much has been raised from those penalties so far? Has anyone been penalised as a result of failing to fall into line with this new incentive?
It is always good, 10 days into the job, to get specific challenging questions on the detail, but to answer that question—and I do not want to tempt hon. Members who usually come with in detailed questions such as that—the tax has raised £5 billion in additional revenue. On this occasion, I can satisfy the House, but I do not want to tempt fate with too many colleagues on this outing.
It is interesting that attitudes in large companies are changing. I am sure that there will be Members who will want them to change further, but since 2013 the proportion of large businesses agreeing that tax avoidance is acceptable has more than halved, moving from 45% to 21%. There is clearly more to do, but that shows a change in attitude within many large companies.

My hon. Friend, as the Chair of the Northern Ireland Affairs Committee, raises an important point about what reassurance can be given through the withdrawal agreement Bill to colleagues across the House to address some of these issues. I stand ready to discuss that with him, as I have offered to do with the shadow spokesman and others in the House, subject to the withdrawal agreement Bill proceeding, during its passage.
I remind the Chair of the Select Committee—of course he is very aware of this—that operationally these are issues that apply at the end of the implementation period, not when the withdrawal agreement is ratified, so there will be time for much more consultation with businesses in Northern Ireland to address the very legitimate questions that have been raised. Although it sometimes feels a bit longer, it was only last Thursday that the agreement was reached with the EU, and of course there are questions about what are often quite complex and technical arrangements pertaining to customs. Those are legitimate questions, and I stand ready to discuss them with businesses in Northern Ireland and also with my hon. Friend.
The Prime Minister had one job—to sort the Northern Ireland backstop—and he has made a pig’s ear of it. He has taken the parts of the backstop that many of his own colleagues and many in the Unionist community in Northern Ireland found unacceptable and put them centre stage, and he claims that to be a success. I and my SNP colleagues welcome anything that gives Northern Ireland businesses free access to markets in the Republic of Ireland. What is not acceptable is that our businesses in Scotland are then put deliberately at a competitive disadvantage.
What is worse is that the Prime Minister has attempted to do this not only without the consent of Northern Ireland but, as is now clear, against the almost unanimous opposition of all the communities of Northern Ireland, without any prior consultation even with the businesses that will have to live with the consequences of what he has done. Can the Secretary of State confirm reports that he has said that even people in Northern Ireland selling stuff on eBay to Great Britain will have to complete customs declarations? Did he say that or was he wrongly quoted in the Irish press?
Can the Secretary of State explain why it is a good idea for Northern Ireland to have closer customs links and trade links with the Republic of Ireland, but it is a bad idea for Scotland, Wales and England to have the same links? Can he tell us what assessment he or anyone in government has made about the economic impact on businesses in other parts of the United Kingdom, which will be left at a disadvantage compared with those in Northern Ireland? Finally, given that, in the view of Unionist politicians on both sides of the House, the deal potentially undermines the long-term future of Northern Ireland in the United Kingdom, if the Prime Minister is prepared to play fast and loose with one of the founding principles of his party, why should anyone trust the reassurances he gives us on an NHS about which he quite clearly could not care less?
The hon. Gentleman asks some legitimate questions, but I think he finished with an unfair suggestion. The Prime Minister was always told that he would not be able to renegotiate a deal or replace the backstop and that he could not change a word of the withdrawal agreement, but he achieved those things and deserves to be commended for doing so.
The hon. Gentleman started by saying that the Prime Minister had one job, but when Members passed the Benn legislation, many of them were saying that the Prime Minister’s job was avoiding no deal. By voting against the withdrawal agreement and the programme motion, the hon. Gentleman has made no deal much more likely.
The clear message that I get from businesses in Scotland —certainly those that I speak to, alongside my hon. Friends—is that they want the clarity and certainty of a deal, and to move forward. They want one step of changes through the implementation period, not two. That is why so many businesses across Scotland want us to get on with this. Fishing communities in particular want us to take control of our independent coastal waters once again.
When the hon. Gentleman referred to eBay, I was not sure whether he was talking about my comments or those of another Secretary of State, but if he was asking whether I have commented on that issue, no, I have not. Another Cabinet member might have made such comments, and I will be happy to clarify that. The impact of no deal, and the ongoing uncertainty of not resolving this issue, is clearly having a negative impact on business. Even business leaders who supported the remain campaign, such as Sir Stuart Rose, are now saying, “Let’s get this done. Let’s get Brexit done. Let’s get on to the future trade agreement and move the country forward.” I hope that the hon. Gentleman will think again and enable the programme motion to go through.

As well as the unsigned letter that the Prime Minister refused even to grace with his name, he sent another letter, signed in his own name, saying, in effect, “Dear Donald, please ignore the first letter I’ve sent you. I sent it only to comply with an Act of Parliament.” If the purpose of that second letter was not to deliberately attempt to frustrate an Act of this Parliament, what on earth was the second letter for?
As I have said in response to several questions, the Prime Minister is entitled to express his view, and that should not come as a surprise to the hon. Gentleman. The Prime Minister has complied with the law, and leading legal figures such as Lord Pannick accept that he has done so. In addition, he has set out his view, as he is entitled to do.

Commons ChamberMy hon. Friend is absolutely right. Before the reshuffle, I met the ABP and others looking at these issues, and their preparations are well advanced. He will also know that the Government have allocated additional funding for those ports, and he will be aware that, although in this place a huge amount of the debate tends to focus on Dover because of the vehicle flow through it, in terms of the containers and value of goods, the other ports are actually more significant.
The Yellowhammer report that the Government are determined to hide from us warns of delays of up to two and a half days at ports, freight target capacity being reduced by between 40% and 60% and, in terms, medical supplies being vulnerable to severe extended delays. The Government tried to pretend that that was an old report, but that was not true. It is dated August 2019. They also tried to pretend that it represented the very worst case scenario, but that is not true either. It is a reasonable worst case scenario: not the most likely, but likely enough to need to be planned for. When will the Government accept that all the trade organisations, professional bodies and people who understand the industry who are saying that no deal will be a disaster are right, and that it is this Government who are wrong?
There is an oddity within the hon. Gentleman’s question. He accuses us of hiding the Yellowhammer documentation, yet it is shared with the Scottish Government as part of our internal working to prepare for no deal. We are not hiding it; in government we prepare documents and on that basis we put in place funding and other measures to tackle them. In fact, the Public Accounts Committee, among others, would be the first to criticise us if that detailed preparation was not taking place.
Will the Government give absolutely unreserved and unrestricted permission to the Governments of Scotland and Wales to publish that report in full today: yes or no?

Commons ChamberWe are talking closely with the Welsh farming community, as are Members on both sides of the House. The Prime Minister was at the Royal Welsh Show last year as part of that engagement. The hon. Gentleman will know that the National Farmers Union in Wales, and indeed across the United Kingdom, has made it clear that the best way of supporting farmers is by backing the deal.
The Prime Minister has promised that her discussions with the devolved nations and the Opposition parties will be without preconditions, so clearly she will not refuse even to discuss the prospect of extending article 50, because that would be a precondition; she will not refuse even to discuss the prospect of taking no deal off the table, because that would be a precondition; and she will not refuse even to discuss the possibility of giving the people another say, because that would be a precondition. Can the Secretary of State therefore confirm on the record that all those topics will be available for discussion, in honour of the Prime Minister’s promise that there will be no preconditions?
The Prime Minister was clear in her statement to the House on Monday that there are no preconditions. That is why she is engaging not just with the devolved Administrations; today I will be joining her for meetings with trade union leaders as part of that engagement. As the hon. Gentleman will know, the extension of article 50 is not a unilateral decision—it requires the consent of the other 27 member states. However, the main issue, and in fact, probably the only precondition that one could apply, is the fact that we need to honour the referendum result, and that is what the Prime Minister is committed to doing.
The Prime Minister was very clear in her statement to the House that there were no preconditions. She has been equally clear in a letter to my right hon. Friend the Member for Ross, Skye and Lochaber (Ian Blackford) that there are preconditions. The Secretary of State, and indeed the Prime Minister, will be becoming only too well aware that within probably a fairly short time the UK Government will be bombarding Scotland with promises about how much they love us, how equal a partner we are, and how much they want us to stay. Can I suggest to the Secretary of State that if he expects the people of Scotland to be conned by those false promises again in 2019, he should at the very least make sure that his Prime Minister stops breaking the promises she made to the people of Scotland last week?
Let me just say very gently to the hon. Gentleman that the con is to have a referendum and then say that one will not honour the result. We had a referendum on independence in Scotland. The Scottish people spoke very clearly in that. I suspect that one of the reasons for that was that the trading relationship within the United Kingdom is the most economically beneficial to them. Having taken that decision, the next referendum was on a UK-wide basis, and it needs to be respected on that basis.

The Prime Minister changed her policy on whether we should leave the European Union. She changed her policy on no deal being better than a bad deal. She changed her policy on this being the best possible deal when she went off to try to get a better one. Is the Secretary of State here instead of the Prime Minister because the Prime Minister has finally realised what we all realised a long time ago, which is that she has lost the plot, that she is no longer in control of these negotiations and that she should be packing her bags and going?
The reality is that the Prime Minister was committed to respecting the referendum result, and that is what she has done. She set out a manifesto commitment to honour the referendum result, and that is what she has done. She has been consistent in both.

Commons ChamberFirst, I warmly congratulate my hon. and learned Friend the Member for Edinburgh South West (Joanna Cherry) and her colleagues on this thoroughly deserved and epoch-making victory. May I gently advise the Secretary of State that it is not a good look for a Minister and a Government who claim to abide by the rule of law to seek to impugn the motives of the winners in a serious court case, or to appear to agree with colleagues who want to impugn the professionalism and integrity of the court that has delivered the verdict?
The Secretary of State has confirmed that the judgment does not change the law but clarifies it, and that it does not change Government policy. Does it change the Government’s understanding of the law? He has carefully avoided the question that has been asked twice, which I will ask a third time: how much has this cost the British taxpayer? Was that money spent because the Government were badly advised and thought they could win, or was it spent criminally negligently by a Government who knew they were going to lose and continued to spend our money just for the hell of it?
I have answered the question about the money several times. The Court judgment was reached just today, so not all the costs associated with the case will have accrued as yet. We will need to work that out in the normal way. The hon. and learned Member for Edinburgh South West (Joanna Cherry) will know about that from her time practising at the Bar. Again, I have already answered the question about respecting the process. We respect the Court’s decision, but the facts of the matter do not change, and they are that this Government are committed to honouring the referendum, we will ensure that we leave on 29 March next year, and we have absolutely no intention of revoking article 50.

Commons ChamberThere are a number of things that can be taken advantage of. We can use the flexibilities we have in terms of assessments with shorter timescales so that we can prioritise UK drugs that are bespoke to the UK market. There will be opportunities as part of this, as well as our working closely with European colleagues.
