Commons ChamberAbsolutely; I agree that it is time for change, although I suspect that the new Leader of the House may not be giving his entire support to such proposals as we revert to the Victorian era. I draw to the hon. Gentleman’s attention the fact that the Procedure Committee is looking at electronic voting, and he has until 27 September to submit a request to it.
I noticed that the whole House cheered when the right hon. Gentleman said he had no authority over this matter, but does he recognise the fact that many people see the current voting system as a huge advantage, because it enables us to nab Cabinet Ministers as they come out of the voting Lobby?
I would suggest to the hon. Gentleman that there are ways in which electronic voting can take place and he would still be able to nab a Cabinet Minister. I would also point out to him that Opposition Members often have difficulties in nabbing Cabinet Ministers in the Division Lobby.

Commons ChamberAs usual, the Deputy Leader of the House is making a powerful speech. On his point about the setting up of the Select Committee being a House matter, it has always been my understanding that members of the Executive do not vote on the creation of memberships of Select Committees. Has that now changed?
I thank the hon. Gentleman for that intervention, and I will respond to it later.
It is in all our interests—Government, Opposition, Back Benchers and the House service as a whole—that this matter is resolved in a timely manner with due consideration. I do not seek in any way to pre-empt the work of the Committee, but there are certain principles that it will wish to bear in mind and issues that it will wish to to address. Let me flag up four. First, as Members, we expect to have access to the highest quality of advice. We rely heavily on the expert advice of the Clerk on matters of procedure and constitutional propriety. It goes without saying that the effective functioning of the House relies on the confidence of Members in its senior management and especially in the Clerk of the House as its principal procedural adviser.
Secondly, on a related point, it is vital that the Clerk is, and is seen to be, totally independent and not in any way dependent on the support of political parties or others. Advice must be dispensed without fear or favour. That is why the Clerk is appointed by the sovereign by letters patent and is not an employee of the Commission.
Thirdly, it is important that the House has a decision-making structure that is fit for the substantial challenges that we face, and is transparent. Members and the public must know who is accountable for decisions made.
Finally, any management structure must be cost-effective. Just as the Government have cut the cost of politics, the House has delivered substantial savings to the taxpayer since the last election, meeting its 17% savings target. Any new arrangements should support the efficient and cost-effective delivery of services to Members and to the public.
If the motion is agreed to, I hope that the Select Committee will be able to begin its work rapidly and conclude by the deadline. The Government will seek to ensure that the House has an opportunity to debate the Committee’s conclusions at an early opportunity, so that resulting appointments can be made as rapidly as possible.
In response to the hon. Member for Wellingborough (Mr Bone), the election of Members to the Committee is a matter for the parties.

Commons ChamberI am happy to convey the hon. Gentleman’s concerns to the Department. He might want to know that one of our responsibilities in the Leader of the House’s office is to ensure that best practice in responding to questions is circulated. For instance, we have encouraged Departments not to respond to questions by providing links to websites. We are requiring them to provide the hard figures to make it easier for Members to assess the response.
Does the Deputy Leader of the House agree that we would have fewer parliamentary questions if we had more time to debate important issues, such as the Immigration Bill? One great thing that the coalition Government promised was a business of the House committee, so when will we get it?

Commons ChamberThe hon. Lady rightly highlights that problem in the Chamber today and I hope that it will receive publicity to ensure that people are more widely aware of that scam. I am sure that she has raised the matter with her local trading standards officers to see what action they can take. Thanks to her, we are all aware of the potential problem, and I am sure we will all want to keep an eye out to ensure that our constituents are not affected in the way that hers have been.
There has been an outrageous slur from the Opposition that Liberal Democrat Ministers are not supporting the Prime Minister. If we closed our eyes today, we could hear the Deputy Leader of the House sounding exactly like a Tory Minister. Just to ensure that there is no doubt, will he arrange for the Deputy Prime Minister to make a statement next week that he fully supports the Prime Minister’s desire to roll back green energy regulations?
I am not sure whether the hon. Gentleman had an opportunity to listen to the Deputy Prime Minister on LBC, but he might have found clarification on that point. Perhaps Mrs Bone had an opportunity to listen to that interview and will be able to report back to him. The coalition Government have made it clear that we are committed to being the greenest Government ever, and we will not do that at the expense of the environment or of jobs in the emerging industries. At the same time, however, we are aware of the pressures that people face due to their energy bills. That is why we have legislated, for instance, to ensure that people are offered the lowest tariff, and it is why we have measures in place to address the winter peak in fuel costs, with £135 available to 2 million people.

Commons ChamberI thank the hon. Gentleman for his question. He is a doughty campaigner on many issues and has had great success with some of them. I am pleased that the issues he mentions are very much on the Government’s agenda. Once we have hit the threshold to allow people to earn £10,000 before they pay any income tax, the Liberal Democrats would like to push the matter further, and the Government as a whole might like to do so as well. He raises the specific issue of national insurance contributions, and I am sure that he would support the Government’s initiative to reduce those in relation to employers. I can assure him that I have just read his early-day motion, and fantastic it is too.
The Deputy Leader of the House is demonstrating that he could be Leader of the House by filling in for him today. Could this be extended so that other deputies could take over for a day? Perhaps the Deputy Prime Minister could take over for a day; may I suggest 1 April?
I thank the hon. Gentleman. It was all going so well until the last phrase. In fact, I misheard it so I will just stick with the first part. I think it is entirely appropriate for deputies to take over on the occasions when they are required to do so. I was rather expecting my shadow, the hon. Member for Penistone and Stocksbridge (Angela Smith), to take over for today as well; I am not quite sure what happened there.

Commons ChamberClearly, the Government will not withdraw the Bill. It has been made very clear over the past couple of days that the Government will bring forward an amendment on Report to address the significant issue that charities have raised with us. We hope to come to a conclusion that they think is satisfactory.
Does the Deputy Leader of the House agree that a more important reform with regard to amendments would be to allow Members on both sides a free vote in Committee and to not subject them to whipping? Would that not produce better legislation?

I thank the hon. Gentleman for gently throwing the gauntlet back at me and I look forward to receiving that report, to which we will give considerable attention on publication. He also referred to the importance of pre-legislative scrutiny and said that it should be central to the business of Government. I agree, but there will always be circumstances in which that is not possible due to timing.
To some extent, the hon. Member for Wellingborough shared the apocalyptic vision of our failing democracy. I am glad that he explained why he had been sleeping with the hon. Member for Dunfermline and West Fife (Thomas Docherty). I welcome the Sunday columnist’s suggestion that the hon. Member for Wellingborough might be a Liberal Democrat plant, campaigning on behalf of the Liberal Democrats within the Conservative party by pushing an agenda that includes restoring the death penalty. I congratulate him on his commitment to raising such issues and on trumping the Government in securing time to highlight things that he wants to address. He referred to the Committee of Selection. The Procedure Committee is looking at elections to that body.
I am delighted that I can do anything to help the Liberal Democrat party, because it needs help. Is the hon. Member for Dunfermline and West Fife (Thomas Docherty) right? Have the Government dropped the idea of bringing in a House business committee? Why are we still in the third year of the Parliament? I reckon it is the fourth year.
I thank the hon. Gentleman for that intervention. If he looks at the evidence the Leader of the House gave to the Committee chaired by the hon. Member for Nottingham North, he will see that the Government have accepted that we were unable to deliver the commitment within three years set out in the coalition programme. Part of the explanation for that is that the tests to which I referred, which the hon. Member for Nottingham North says will be met in the report he will soon publish, have not been met by any proposals so far.
The right hon. Member for Oldham West and Royton shared the significant concerns about the House business committee not being delivered. I am sure that he will welcome the fact that explanatory statements will be provided for amendments. I agree that they are essential for Members to understand what is happening in this place. He will also welcome the “Good Law” initiative, which seeks to make laws clearer, so that Members will be able to understand them more easily. I am sorry that the hon. Member for Kettering (Mr Hollobone) was able to make only a short contribution, but I welcome what he said on e-petitions. The Government are willing to look at them and ensure that the House has responsibility for them. E-petitions are under active consideration. I thank the hon. Member for Dunfermline and West Fife for his support—I think—for some proposals that the Government are putting forward.

Commons ChamberThis is an outrageous slur from the Opposition. This Government make everyone aware as soon as possible: we need only buy the newspapers or put on the television and we know in advance. Is this not an outrageous slur?
I thank my hon. Friend for his comments. He will be aware that my right hon. Friend the Leader of the House has regularly reminded Ministers, including members of the Cabinet, that it is important that they come to the House to make ministerial statements here first.

I thank the hon. Gentleman for that intervention. He may or may not be referring to something that I was about to say, which is that what the Government propose is not necessarily a radical departure. I understand that remand prisoners, people in prison for contempt of court and fine defaulters held in prison are eligible to vote. The principle is already established that some prisoners are entitled to vote.

It is a pleasure, Mr Streeter, to see you in the Chair this morning. I congratulate the hon. Member for Wolverhampton North East (Emma Reynolds) on securing this important debate.
I echo what the hon. Member for Wellingborough (Mr Bone) said about the excellent work done on human trafficking by the now retired Member for Totnes, Sir Anthony Steen. He was, it will be agreed, a colourful figure—he was often frank and occasionally unguarded in his comments—but he deserves to be remembered for his excellent work on raising the profile of the matter and for establishing the Human Trafficking Foundation. I also support what the hon. Gentleman said about the need for better training for officers and others engaged in dealing with the problem, and the need for guardians to support children through the unpleasant and doubtless un-nerving process of going through the courts.
We know that human trafficking is a big problem, but it is fair to say that the scale of it is a little hard to determine. The United Nations estimates that 70,000 new victims arrive in Europe each year and stay a couple of years; that compares with a total population working in the sex industry of something in the order of 140,000. The market as a whole is said to be worth €2.4 billion a year. A substantial amount of money is being spent on this horrific trade—or service, if I can put it that way. The Association of Chief Police Officers estimates that an estimated 30,000 sex workers in the UK have been trafficked into the country, coming principally from China, Thailand and other parts of south-east Asia, and from eastern Europe.
That report was fairly controversial in that it extrapolated from interviews with women who were working in brothels in London a national figure of 2,600 victims of sex trafficking. All one can know for certain is that those women would have been under huge pressure not to confirm the way in which they had arrived in the UK, which makes it difficult to establish how many victims there are other than it is a very large number. What is certain, however, is the number of convictions. Since the Sexual Offences Act 2003 came into force in January 2004, 46 men and women have been convicted and jailed for transporting willing sex workers—I am sure that we could argue about what constitutes a willing sex worker and discuss the economic pressure that they may have been under to come willingly to the UK for such a purpose—and 59 people have been convicted of transporting women who were forced to work in the sex industry. What is also clear is the excellent work that the POPPY project is doing and the number of women that it has been able to help. In the past six and a half years, it has helped and supported around 500 women.
Hon. Members who have local newspapers—as Members of Parliament, we all follow our local newspapers carefully—will be aware that the newspaper group, Newsquest, has been actively trying to ensure that no local papers carry ads publicising such services, and I commend such work.
What makes this issue even harder to resolve is the conflict that exists between trying to establish whether someone has been trafficked here or whether they have come here of their own volition. Hon. Members will be familiar with the research that was published by Dr. Nick Mai of London Metropolitan university—again, we have to read between the lines of the responses that were given—in which he conducted detailed interviews with 100 migrant sex workers in the UK. He astonishingly states that for the majority of people, working in the industry was a way to avoid the exploitative working conditions that they had experienced in their previous non-sexual jobs. I take that with a pinch of salt because such people are working in an industry that is illegal and on the margins, and their status in the country is uncertain. The suggestion that they come here to work in such an industry because it provides better working conditions than the ones that they might have experienced before requires some scrutiny, but that is what his research apparently found. That makes it harder for authorities such as the UK Border Agency to err on the side of thinking that people have made a conscious choice to come to the UK for this purpose rather than erring on the side of assuming that people have been trafficked, which is what we want. Such an attitude is also adopted in relation to children who are, all too often, treated as criminals rather than people who have fallen foul of trafficking.
Members will be familiar with the concerns expressed by the anti-trafficking monitoring group about trafficked children who have gone into care and subsequently gone missing. The review into 390 cases of suspected trafficked victims handled by the UK authorities gave some quite alarming statistics about how many of those victims subsequently disappeared.
In theory, the national referral mechanism, to which other hon. Members have referred, allows the police and social workers to refer suspected cases to the appropriate authorities, but again there is legitimate concern that the people who are being referred are being treated as part of an immigration issue rather than as a crime issue, or as victims of trafficking who require support. If the police are succeeding in identifying people who are responsible for human trafficking, it is not being followed through in terms of the number of convictions. For example, only five people were convicted of human trafficking for sexual exploitation in the first six months of this year compared with a figure in the low 30s in previous years. Therefore, we are not seeing many successful prosecutions.
Will the Minister give us an update—I know that this is not his brief—on what the Crown Prosecution Service is doing to improve its prosecution policy in relation to these cases, and does he believe that it will be successful?
In conclusion, I will refer to the UK opt out of the EU directive, which was clearly a controversial decision by the coalition. The coalition has been criticised by many campaigning groups for not signing up to the directive, and I must say that I have some sympathy with the concerns that have been expressed. I know that the Government will consider the impact of the directive, and I strongly hope that if they decide that the directive will help to address the issue of human trafficking, they will not be put off adopting it simply because it is prefixed with the word “EU”. If the directive is effective at tackling the issue, it is incumbent on us as a Government to support it.

It is difficult when we have a room of lawyers, but interventions are supposed to be short.
May I apologise to the hon. Gentleman for not giving way earlier? I was not aware that he was rising until I caught sight of him in the corner of my eye. He makes a valid point, and I was going to come on to financial contributions and to what extent people should be willing to contribute to support their case. I am interested to hear what the Minister has to say. The hon. Gentleman is right in relation to Mr van Hoogstraten: he was eventually acquitted in the criminal case. As I understand it, however, he was found guilty in a civil case, although he has stated that he will not be handing over a single penny in relation to the outcome of that case. The hon. Gentleman has raised important points for the Minister to respond to.
On the CPS, if cases are adjourned unnecessarily, costs are incurred, and there may be scope for improving on that. Clearly, this would not assist the legal profession, but it would be interesting to hear from the Minister what success he is having in stopping cases going to court through the use of virtual courts, and the extent to which they can contribute to the process. As someone who is not legally qualified, in any shape or form, I hope that my few comments still inform today’s debate, and that we hear some convincing responses from the Minister shortly.
My point is not directly related to the debate, but I would like to raise a point with the Minister about legal aid, particularly the availability of legal aid to British citizens in foreign countries and the extent to which the Government are able to publicise its availability.
Order. It does not help when the hon. Gentleman starts by saying that his point is not relevant to the debate.
