I very much agree with my hon. Friend. It is a difficult moment for many, and I will come on specifically to some of the issues involving EU nationals that were not resolved by our discussions in Committee.

As we move into this next stage, I would urge the Government not to overinterpret their mandate in the general election. Yes, they have clearly secured an overwhelming majority of seats, but not of votes. Most people in this country voted for parties that did not support the principle of getting Brexit done at any price. As the Prime Minister observed, many of those who voted for him and colleagues had lent him their vote. I hope, and I sense, that part of the different tone—the subdued mood of those on the Government Benches—was a dawning realisation that they may find it hard to deliver on the high expectations that they have created over the last three and a half years. The Prime Minister has talked about bringing the country together—the Minister echoed that—and we all share the hope after the divisions promoted by the debates of the last three years. However, I have to say that it will need a different approach from the one we have seen over the last couple of days. It needs open ears and a willingness to reach out.

I understand why the Government rejected some of the amendments that we and other opposition parties tabled, but not all. Many were simply restoring previous Government commitments and others were to improve the Bill; none was to frustrate Brexit. In the short debate on the Bill in Committee, we as an Opposition pressed five main issues that in our view reflect the serious problems with both the withdrawal agreement and the way in which the Government have chosen to implement it. Over 100 amendments were tabled in Committee, but not a word of the Bill has changed, and we will therefore be voting against its Third Reading today.

Our first issue with the Bill is that, despite all of Parliament’s efforts to avoid a no-deal Brexit last year, it introduces a trapdoor to no deal at the end of December 2020—something that the Brexit Secretary appeared quite relaxed about in his reported comments following yesterday’s discussion with Ursula von der Leyen. Other Conservative Members over the last couple of days have expressed total confidence—total confidence—in the Government’s ability to secure trade and security deals by the December deadline, citing the EU’s commitment to use its best endeavours and good faith to agree a future trade treaty. That good faith was evident from Mrs von der Leyen yesterday, but I hope Members have also heard her warning, which was echoed by the right hon. Member for Gainsborough (Sir Edward Leigh), that it would be impossible to reach a comprehensive trade deal by the end of 2020.

I hope Members will reflect on whether it really is wise for the Government to have added clause 33, barring Ministers from extending the implementation period. Of course, this is just a gimmick, and with their majority, the Government could at any point repeal that clause and negotiate a short extension. However, whatever our views on these issues, we should all be concerned that this Bill removes any role for Parliament in shaping that decision, so if the Government have not concluded and ratified an agreement with the EU on our future relationship, the supposed sovereignty reclaimed for this Parliament will be meaningless. We will have no say on whether we crash out on World Trade Organisation terms, even if the Government are days away from securing an agreement with the EU.

It occurs to me, as I listen to the hon. Gentleman, that foreign policy is often common ground between successive Governments of different parties. I wonder if it has occurred to his party to take such an approach here: to recognise that the political declaration on the future relationship is now agreed between the EU and UK, and to get behind it as the Labour party, so that there can be absolutely no doubt in the mind of the Commission that where we want to go as a nation is the landing ground that is now common territory between both negotiating parties. Does he not agree that that way we could go forward as one United Kingdom and succeed?

I will come on to my observations on how we could have gone forward much more successfully as one country in delivering on the mandate of the referendum in 2016, but I think—this reflects the comment made earlier by the right hon. Member for Gainsborough—that the whole problem with the way in which Conservative Members talk about the ease of moving forward, because we are starting from a point of convergence, is that the objective of this Government is to seek divergence, and that is precisely why these negotiations will be so difficult.

I am sorry to say that my hon. Friend’s account is essentially correct. At the time I considered it implausible because my direct experience is that civil servants are extraordinarily careful to uphold the impartiality of the civil service. We must proceed with great caution in this matter, but I have heard him raise the issue. We need to be very careful not to take this forward in an inappropriate way, but he has reminded me of something that I heard. It would be quite extraordinary if it turned out that such a thing had happened.

I did not say it was correct. I said that the account that it was put to me is correct. It was put to me, and I considered it an extraordinary allegation—I still consider it an extraordinary allegation. [Interruption.] To be absolutely clear, I said it was correct that the allegation was put to me. I did not in any way seek to confirm the truth of it. What I would say is that we need to proceed with great caution, because it is essential that we continue to uphold and support the impartiality of the civil service.

As we have said many times, we conduct a wide range of analysis to support our negotiating position as we proceed through this process.

To reply to the hon. Member for Sheffield Central (Paul Blomfield), I reassure him that we will comply scrupulously with the motion, working with the Chair of the Select Committee. We will ensure that we comply with the confidentiality requirements of the motion and that the House is satisfied. He asked me about future analysis and the reassurance that I gave yesterday stands. We will ensure that, at the time of the meaningful vote, the House is appropriately equipped with the analysis that it needs to make a decision.

I just want to be absolutely clear: the papers that we are talking about today are a work in progress and, in discussion with the Chair of the Select Committee, they will be released in full. And given that they are a work in progress and the suggestion is that we should therefore be looking to the final documents as the crucial guidance to this House, will they be released when they are completed?

I heard what the hon. Gentleman said the first time, but the commitments that we are giving are that we will comply scrupulously with this motion and that we will make available to both Houses analysis at the time of the meaningful vote. That is the commitment into which we are entering, but I have heard his request for a continuous evolving analysis. What we have said is that we will not give a continuous rolling commentary on our analysis. We will proceed to ensure that the national interest is protected. We made a commitment to provide Parliament with the appropriate analysis it needs to make a decision on the final deal at the time that we vote, in the way that is set out in the written ministerial statement that we laid.

The Secretary of State has been consistent in stressing the importance of parliamentary scrutiny and oversight of the Brexit process. We have done this willingly to ensure that the parliamentary process is followed. I endorse the actions that we have taken, as I accept collective responsibility regarding the point that was raised earlier.

Finally, as I reiterated yesterday, the people of this country on 23 June 2016 took the decision to leave the European Union. The purpose of the analysis that we have conducted is not to question that decision—which this House voted to respect when it supported triggering article 50—but to ensure that we have the best possible outcome for the British people. We are accepting this motion today on the exceptional basis of the poor reporting of a leak.

That is simply not the case. As I have not hesitated to say several times, the economic analysis does not show the country being worse off; it shows the country being better off under all circumstances. It shows GDP growing—

The shadow Minister says it is nonsense, but I can assure him that it is not. The economic analysis shows GDP increasing in all circumstances. The point of the Government’s policy must be to carry through faithfully the decision of the British people and to do so in a way that proves these doom-mongers and naysayers wrong.

Of course I have read it—it is here in my hand. I have read it but I have not gone back and done his homework for him to check and mark his work.

I make two points to my right hon. and learned Friend. First, as I said, it would be a constitutional innovation to begin putting statements of policy for negotiations in legislation. That is a good reason not to accept the new clause. The second point—[Interruption.] He says that it is not a good reason. He is the Father of the House and he has occupied many of the great offices of state. I would be interested to know when, in his long and distinguished career, he accepted that principle in legislation.

As a responsible Government, we are going to go through the process of making sure that our country is ready to leave the EU without a deal if that proves necessary. We will take the steps to be prepared, as a responsible Government should.

However, this Bill cannot pre-empt the negotiations by putting things into statute before they have been agreed. The Government intend the UK to leave the EU on 29 March 2019, and that is why we intend to put that on the face of the Bill, but we have always been clear that we will bring forward whatever legislation is necessary to implement the agreement we strike with the EU, which is why yesterday my right hon. Friend the Secretary of State announced the Withdrawal Agreement and Implementation Bill, which we will introduce once Parliament has had a chance to vote on the final deal.

This Government take their responsibilities seriously and are committed to ensuring that the UK exits the EU with certainty, continuity and control. It makes no sense to legislate for one piece of legislation on the face of another, and I therefore ask the right hon. Member for Normanton, Pontefract and Castleford not to press her amendment to a vote. With that, I recommend that clause 1 stand part of the Bill.

I am pleased to speak to amendments 43, 44 and 45, which would give Parliament control over the length and basic terms of the transitional arrangements and allow Parliament to set the clock on the sunset clauses. These are the first of many amendments tabled by the Opposition that we will consider over the next few weeks, all of which have one purpose, which is to improve the Bill. Frankly, it is not helpful when Ministers—and, indeed, the Prime Minister over the weekend—seek to characterise scrutiny and accountability in this House as an attempt to thwart Brexit. It is not. We accept that the British people voted to leave the European Union. It might have been a close vote, but it was a clear vote. That is why we voted to trigger article 50. Whether we leave the European Union is not a matter for debate, but how we do so is crucial for the future of our country. The British people voted to pull out, but they did not vote to lose out. They look to Parliament to secure the best deal, and that includes not stumbling over a cliff edge in March 2019.

Whether in relation to new clause 49 or to the Government’s amendments, closing down the opportunity for effective transitional arrangements is deeply self-harming.

I believe that the Labour party wants to have a smooth transition to a good quality future relationship, but I draw to the hon. Gentleman’s attention what the Prime Minister said in her Florence speech:

“Neither is the European Union legally able to conclude an agreement with the UK as an external partner while it is itself still part of the European Union.”

My point is that we need to become a third country before we can conclude the kind of future relationship that I think the hon. Gentleman would like us to have.

I do not disagree with the Minister. It is precisely our point that, during the transitional period, we cannot disable the role of the Court of Justice of the European Union, otherwise we will not achieve the arrangement that we apparently both seek.

I thank my hon. Friend for that intervention, which echoes many reports I have received from the food banks in my constituency. The desperate level of hardship that we are talking about needs to be understood in the House. We understand that food banks provide a weekly food parcel, but when I recently spoke to colleagues at the S2 Food Bank in Sheffield, they pointed out that they were now receiving demand for food parcels containing cold food that would not require heating as people did not have enough money not only for food but for basic fuel supplies. People are living in houses or flats illuminated by candles and eating cold food provided by food banks. That is desperate hardship.

I am deeply troubled by some of the substance of this debate. The hon. Gentleman will know that the Government argue that nobody should go without essentials as a result of a sanction, and that they should receive hardship payments. Can he imagine why the evidence on the ground that he is presenting falls so far short of the Government’s obvious intent?

I thank the hon. Gentleman for his intervention and I will come to that point; often a part of the communications breakdown is people’s lack of awareness of the hardship payments that they are entitled to. The Government have to deal with precisely that issue as part of the challenge.

In the time I have left, I want to stress the inhumane nature of some of the sanctioning I have referred to. It is clear that, if claimants do not understand agreements, they will not keep them and sanctioning will not have its desired effect as a deterrent against non-jobseeking.
