Commons ChamberHaving been the Home Secretary who negotiated the original migration and economic development partnership, I find it quite odd to hear some of the comments in this debate, and particularly those appalling ones that run down the country of Rwanda. The partnership with Rwanda was established as a world-leading and innovative way to tackle the challenges caused by the mass migration and displacement of people. It was carefully designed with our friends in the Rwandan Government to do one thing that no one in this House has mentioned today: to raise the international bar on the treatment of asylum seekers and to do so with compassion and support when it comes to their resettlement. Astonishingly, while Members, particularly those on the Opposition Benches, have been talking down the Government of Rwanda for the past 20 months, the country has in fact already supported and resettled 130,000 refugees through schemes established with the UNHCR and through international conventions.
As the hon. Gentleman well knows, there is no time for me to give way.
Effectively, such resettlement schemes involving third countries are the type that we need to deal with the awful, abusive and illegal trade in people smuggling. The awful comments that I have heard thus far about Rwanda and this scheme leave a stain on this House. We have a moral imperative to raise the bar and, effectively, to look at how we can be better as a Government at addressing these issues. When I negotiated and agreed the partnership in April 2022, we all knew that it would face criticisms and legal challenges, and the Government of the day were prepared for that. I said it at the time and in fact we gave some clear statements in the House as to the steps that we would take forward.
A year ago, the High Court found the plans to be lawful. The Court of Appeal ruled against the policy, citing concerns over the issue of refoulement, which are well known. Importantly, as the Supreme Court has since emphasised, the principles of the policy as well as the commitment given by the Rwandan Government to make the partnership work, are all fine and sound, but some operational measures need to go further. The Government have since outlined them both in this Bill and through statements they have made in this House, which would help to make the scheme viable.
It is fair to say that we all bear the scars of this debate, and we heard my right hon. Friend the Member for Newark (Robert Jenrick) speak about that. I do not envy those on the Front Bench right now. We have had a constant merry-go-round of legal challenges—whether through our own domestic courts, or through interference from elsewhere, by which I am referring to rule 39. I have experience of dealing with rule 39! There are organisations, campaigners and lawyers who will do everything possible to frustrate the will of this House and the will of the democratically elected Government, because, at the end of the day, that is what we are. We have to rise against these dogmatic beliefs because, quite frankly, there are too many organisations and individuals who are getting in the way and effectively letting more claims go to the courts.
There are measures, including some from the Nationality and Borders Act 2022, which have not been implemented, including the one-stop shop. They would save the courts a lot of time and effort by bringing forward the single claims that this House voted through, just last year, which meant that repeat claims would not keep on going back to the courts. I say to those on the Front Bench that it is really important that we press on the Government to go backwards in order to go forwards. We need to bring in these measures that have already been passed through Acts of Parliament—dare I say it, there may be more in legislation that has come in since.
I ask the Minister, in responding to the debate, to tell us how the Government will act and prepare for any future challenges that may come through this legislation. How will they stand up to the unmeritorious claims that keep coming through the courts—for example, those based on modern-day slavery, which we have heard about far too much? We put measures in the Nationality and Borders Act to deal with that.
We have seen the summary of the legal advice that the Government have received and read much of the other expert opinion. I seek assurances from the Minister that he and his colleagues are aware of the risk of challenges. How that is mitigated as the Bill passes through the House, in the conventional way, will be crucial. We cannot have more cases bogged down in the courts. Too many of us have worked through that.
We have a major problem with detention in this country, which includes a lack of detention capability. There were plans in the “New Plan for Immigration” to introduce Greek-style reception centres. I press the Minister and the Home Office to work with the Prime Minister and the Treasury to bring forward those sites; otherwise, we will see more Bibby Stockholms and more Wethersfield sites, which frankly are not the answer. Those Greek-style reception centres will help with the fast-tracking of processing claims and the fast-tracking of the removal of individuals who have no right to be in this country. I also press the Minister and the Home Secretary to adopt an integrated approach, so that we can deal with this national issue. The public voted for change and we want to deliver that change for them.
Last week, my hon. Friend the Member for Glasgow Central (Alison Thewliss) compared the Home Secretary with Humpty Dumpty in “Alice in Wonderland”, who uses words to mean just what he chooses them to mean. I wonder if the Prime Minister could be compared with the Red Queen, who believed six impossible things before breakfast: that Brexit has been a success; that Britain is a soft-power superpower; that the Scottish Parliament is the most powerful wee devolved Assembly in the entire world; that we can reach net zero while abandoning net zero policies; that this Bill is actually going to stop irregular arrivals in the United Kingdom; and that his party is actually going to win the next election. Even for those on the Government Benches, that is too unbelievable. They do not think this Bill will work, and they do not think they will win the next election.
The Bill will not work, because it fails under the crushing weight of its own internal contradictions. Rwanda is deemed to be a safe country—desirable even, as a place for asylum seekers to be processed and to remain. The former Home Secretary, the right hon. Member for Witham (Priti Patel) did not take my intervention earlier, but I wanted to ask her this: if Rwanda is such a desirable place to be deported to, why on earth should deportation there be a deterrent? How will that have a deterrent effect, if the Government are saying, “This is a wonderful, safe and secure place for you to go”? Perhaps more people will come to the United Kingdom in the hope of being sent to Rwanda.
The hon. Gentleman must recognise that Rwanda has successfully resettled more than 130,000 people, and that is through international institutions and norms.

Commons ChamberThat is an excellent suggestion, and I will take it back to colleagues in Government to look at how we can develop it.
The Scottish National party’s position is that the refugees are welcome and that we should do everything in our power to offer sanctuary to people who need it. On that basis, and further to the question from the hon. Member for Twickenham (Munira Wilson), I note that the conflict has regional implications and that some of us are already starting to hear from constituents and business owners who have contracts in Belarus and elsewhere who want to flee Putin’s aggression. What routes are already open to them and will the kind of announcement that the Home Secretary has made today be extended to other countries in the region?
The routes are published on gov.uk, so the hon. Gentleman can see them, and I have outlined them this afternoon. In its response, the whole United Kingdom stands shoulder to shoulder with the people of Ukraine. As I have said several times in the House, that means an effort across the whole country to provide support and accommodation, and discussions are under way with the devolved Administrations.

Commons ChamberI think I have spoken in this House a few times about bilateral returns agreements and the difficulties with getting them. I state again for the record that I have today put on the table another offer to my French counterpart, Minister Darmanin, that I am very happy to discuss returns agreements with him in the usual sense, but also to look at family reunions and unaccompanied asylum-seeking children. We do not want children—kids—and family members in the hands of traffickers. Having established routes and working with our partners to establish returns agreements is absolutely the right thing to do.
I have stated many times with regard to EU countries that the matter sits with the Commission; it is a Commission competence. There is a great deal of frustration among EU member states about the issue, which is why I continue to pursue my discussions with the European Commissioner for Home Affairs.
I hope that the Home Secretary can confirm that there is no such thing as an illegal asylum seeker. Seeking asylum is a human right. When she says that people should seek asylum in the first safe country that they come to, I hope that she will confirm that that is an aspect of the Government’s hostile environment policy, not a legal or treaty requirement under any international obligation.
On top of all that, at what point can the UK ever be the first safe country, given that this island is surrounded by water? What are the routes by which the United Kingdom could be the first safe country in which a displaced asylum seeker arrived?
The hon. Gentleman misses a fundamental point about the asylum system and the whole issue of people who come to the country who are not genuine asylum seekers—who are masquerading as asylum seekers.
We do know it, actually. There are many cases.
There also has to be a recognition—this shows how detached the hon. Gentleman is from the real world—that we cannot have a policy that we can accommodate everyone. Let me play back a bit of EU rhetoric and language to him with the concept of burden share, which is why we seek to work with our counterparts, co-operate with other countries and continue to work in a constructive manner on returns agreements. We also seek to change our laws so that individuals are not constantly using the appeals process and the UK legal aid system to frustrate the Government’s ability to remove people from our country who have no legal basis to stay.
I really think that the hon. Gentleman misses the point, particularly at a time when we know that there is a major global migration crisis. We have to find collective solutions to the problem, not just take the ideological approach that he is taking.

Our plan will increase the fairness of our system so that we can better protect those who are in need of genuine asylum. That is absolutely right, and it is important that we have that fair principle. However, it will also do something that I sense does not interest the Labour party: it will deter illegal entry to the UK, and, importantly, will break the business model of the smuggling gangs and protect the lives of those whom they are endangering.
I will not give way. [Interruption.] I have been very generous in taking interventions, and I would like to make some progress.
It is important to reflect on the fact that, when it comes to anyone claiming asylum in the UK—this is established in long-standing legislation—we have a statutory duty in relation to accommodation, subsistence, cash and transportation. The system, as I have already mentioned to the hon. Member for Bermondsey and Old Southwark (Neil Coyle), is currently costing the taxpayer more than £1 billion a year. It is right that we look to reform the system, and not just to make it efficient but to ensure that we do the right thing. The very principle of seeking refuge has clearly been undermined by those who are paying to travel through safe countries and then claiming asylum in the UK. As my hon. Friend the Member for North East Bedfordshire (Richard Fuller) said, many of those are economic migrants and not just those fleeing persecution. People should be claiming asylum in the first safe country that they reach and not using the UK as a destination of choice. That is why our intention is to work—

Commons ChamberOf course, we join all the tributes that have been paid to everybody affected by this terrible attack. It is the third terrorist attack since the UK terror threat level was reduced in November. Is the Home Secretary considering the use of the terror threat scale and whether the criteria and circumstances around the raising and lowering of the threat level should be reviewed?
The hon. Gentleman will know that the terror threat level is independent of the Home Secretary and the Home Office. It is set by a joint terrorism analysis centre assessment. The threat level is substantial. On that basis, we all continue to be vigilant, to monitor the situation and to engage with our intelligence and security services and take the relevant advice.

Friend is absolutely right about celebrating our common humanity, the diversity of our great country, and the people who have taken to the streets and expressed their views in a balanced, proportionate and peaceful way. When it comes to our police, I absolutely stand with them. They showed great courage and determination over the weekend.
We will overlook the irony of the Home Secretary saying that mass gatherings are unlawful, while hundreds of us are required to gather here in Westminster. I wonder if she believes that the hostile immigration environment, indefinite detention, no recourse to public funds, destitution and no family reunion for unaccompanied minors sends a message that black lives matter to this Government?

Commons ChamberMy hon. Friend makes a valid point. We are ending discrimination, obviously. We are open for business and we are open to all countries and to all nationalities when it comes to immigration through the points-based system.
Will these rules undo the injustice of the tier 5 rules that are currently stopping supply priests from Africa getting short-term visas in the summer months, thereby denying Christian and other communities the opportunity for worship in the summer?
As has been outlined, it is pretty clear that the points-based system is open and firm, but fair. Importantly, it ends discrimination that has existed for too long in our immigration system.

Commons ChamberI thank my hon. Friend for his question. The hurricanes have been devastating, and I have seen their effect across our overseas territory. I can absolutely give the House an assurance that we are not just supporting the overseas territories; we are now working with them on the recovery and the rebuilding efforts, in addition to the relief efforts.
What progress is being made on the commitment that the Government made at the world humanitarian summit last year to increase spending on disaster risk reduction? How is that being implemented and in what countries is disaster risk reduction spending increasing?
The hon. Gentleman is right to point that out in terms of the grand bargain and the humanitarian work that Britain leads on around the world. He asks about progress. I can let the House know that enormous progress has been made directly with the humanitarian agencies that we work with, through the funding that we are putting in place. We are making sure that the grand bargain commitments are part of the funding performance that we now put in place with regard to the reform agenda.

Commons ChamberI agree with the right hon. Gentleman about the great work of Comic Relief and how it raises so much money for all the domestic and international causes. I did not see the footage to which he refers, but as we have touched on already in these exchanges, Africa has a bright future—there is no doubt about that—in terms of its population, economic development and prosperity, and we must focus on those things.
We join in passing on birthday wishes to the Secretary of State. Will she explain how DFID is helping local partners to deliver humanitarian aid in response to the east African crisis, and how is that helping the Department to make progress towards the target, agreed at last year’s world humanitarian summit, that 25% of humanitarian aid should be delivered through local partners by 2020?
The hon. Gentleman asks a very important question. Following the world humanitarian summit, we have been leading the charge—working with others in the system, including the head of the Office for the Co-ordination of Humanitarian Affairs, Stephen O’Brien—on how to get better efficiencies and improve ways of working, which are crucial. The east African crisis has shown how we can deliver aid more effectively through our partnership working, but also how we can reform our ways of working, which we need to improve continually.

Commons ChamberMy hon. Friend is right. As I mentioned, I have visited the region several times, meeting many refugees who have experienced nothing but trauma on their journeys. The whole House should commend the host countries that are doing tremendous work, and I pay particular tribute to the Governments of Jordan and Lebanon for their outstanding contributions. Through last year’s London Syria conference and the forthcoming Brussels conference, we are giving those host countries every ounce of support, in terms of our pledges and our work to ensure that they can support refugee communities in a sustainable way and to help bring peace and stability to the region.
I thank the Secretary of State for advance sight of her statement; it is always welcome to see her at the Dispatch Box. As the Disasters Emergency Committee today launched an appeal on the famine in east Africa, it may be helpful to hear at some point what DFID is doing in response to that.
I recognise the role that DFID plays in responding to the humanitarian situation—something it can do because it meets the 0.7% aid target. Given that the official development assistance budget is being spread more thinly across Departments, is the Secretary of State confident that DFID has the necessary resources? Will she confirm the Government’s commitment to the aid target, not least because that will encourage others to follow suit and fulfil the pledges that have been made?
Daesh’s activities are causing massive displacement across the region, so what steps is the Secretary of State taking to ensure adequate provision for the humanitarian response in the countries that border Iraq and Syria? What support is she able to provide to local civil society, particularly the Churches and faith-based organisations that are often best placed to respond quickly to those in need? Aid for the formal refugee camps is welcome, but what support is being provided to those not in formal camps, particularly in Lebanon?
On the response in Syria, we have repeatedly asked, “If we can drop bombs, why can we not drop bread?” What lessons can be learned from the drone delivery trials in Nepal and Tanzania? What discussions are being had with the US about the joint precision airdrop system? Displacement does not just happen to border countries. The UK needs to commit to taking its fair share of refugees; 20,000 over five years is not a fair share, nor is 350 children under the Dubs scheme. If ODA money is to be used by other Departments, the Home Office can use it for the first year of resettlement.
The former Prime Minister said that UK military involvement in Syria would cut off the head of the snake. Where is the evidence that that has happened? A humanitarian response is the right thing to do, and not only to make us safer; as long as people in Syria and Iraq live with the consequences of UK military adventurism, we have a responsibility to help clean up the mess.

Commons ChamberMy hon. Friend makes an important point. Our priority, of course, is emergency aid—food assistance and water. We are also asking others to step up, particularly donors. We are calling on all sides that are involved in the conflict to end the fighting, because we need long-term political solutions if we going to end the current crisis.
The famine declared in South Sudan is the first anywhere in the world for six years. Last night the all-party Sudan and South Sudan group launched its report on the need for peace in the wider region. How is the Secretary of State’s Department responding specifically to these crises? Will she confirm that she will defend the aid budget so that it focuses on those in desperate need and is not subject to smash-and-grab raids by the Foreign Secretary to support diplomatic empowerment funds?
It is important that we recognise the state of the world right now. We are seeing four crises—four famines—around the world. We are in an unprecedented time. This is the first time we have seen this situation since the last certified famine in 2000. I do not see it as an issue about how we spend money across Government Departments; it is about how the UK shows global leadership when it comes to times of humanitarian crisis in the world. The British Government are leading the world right now, calling on others to step up, but also saving lives and changing lives at this critical time.

Commons ChamberMy right hon. Friend is absolutely right to highlight the plight of persecuted Christians, especially in the context of Aleppo and Syria. She asks what we can do. This is not just a matter for DFID; the whole Government must speak out on the issue and constantly make it clear that the persecution of minorities and religious groups is totally unacceptable. That is the right thing to do. We also need to make that case within the international community and work collaboratively with donor countries and other countries across the world.
Following the announcement during the Christmas recess that DFID would be piloting the use of drones to deliver medical supplies in Tanzania and to map weather damage in Nepal, what discussions has the Secretary of State had with Ministers in the Ministry of Defence about how drone technology could be used to deliver aid or assess humanitarian need in Aleppo and other parts of Syria?
The hon. Gentleman is right to highlight the fact that we have been innovating and looking at new technology in relation to aid provision via drones. A lot of work is taking place in that space, and we have had a number of debates in the House about other ways of delivering humanitarian assistance, particularly in besieged areas. In the specific context of besieged areas in Syria, work is taking place and there have been discussions. I can assure the House that we are actively pursuing this issue, not just in DFID but across the Government.

Commons ChamberI thank my hon. Friend. She is absolutely right. We have the watchdog, the Independent Commission for Aid Impact. As the lead Government Department, leading on overspend, we ensure that the money going across Government Departments through this cross-government strategy is spent on the right priorities. It will be spent in the right way.
I welcome both the Government and the Opposition spokespersons to their posts. Will the Secretary of State confirm that, contrary to what the Defence Secretary told the “Today” programme, it does matter what budget conflict and security spending comes from? Will she guarantee that the Ministry of Defence will not raid the DFID budget, which should be spent on helping the poorest people around the world?
As the world is changing, so must our approach to aid. That is why we have a cross-Government strategy to ensure that official development assistance meets Government priorities while also recognising and tackling the global challenges that we face. DFID will continue to be a leader when it comes to accountability and transparency, and that will, of course, apply to my colleagues throughout the Government as well.
