On the question of the funding issues, the difficulties and the relative lack of understanding of the challenges that face our region, I agree with the statistics that the hon. Member for Waveney presented. I would also point out that if we take the London effect out of the east, we very quickly see that our region is, by UK and European standards, not nearly as prosperous as some of the initial statistics suggest. I read the House of Commons Library briefing, and one would think it is all fine. Actually, it is not all fine; it is a much more complicated picture than that, but it is not necessarily an easy question to solve. I would also look back historically and reflect that at the end of the last Labour Government we had a Minister for the East of England—I make no secret of my ambition to be the next Barbara Follett.
I have four questions to put to the Minister. As he is not a regional Minister, he may well not be in a good position to answer them, but these are important issues. East West Rail and the Cambridge-Milton Keynes-Oxford arc are absolutely crucial. Without talking too much about my constituency of Cambridge, AstraZeneca’s Discovery Centre—a life sciences cluster that generates over £7 billion turnover and employs over 20,000 people—opened in November and is absolutely key. Can the Minister confirm that the project is on track, and that there is no question of any further delays?
Secondly, Ely junction, as the hon. Member for Waveney mentioned, is absolutely critical to unlocking the freight issues. My third point is that the West Anglia main line is absolutely key to improving links to our regional airport and gateway to the world, which is Stansted.
My final point is on bus funding. There is a critical point coming in the next few weeks, when the covid funding runs out. Bus operators are having to make decisions this week as to which routes will be cut. In my city of Cambridge, that is already happening. What is going on?
In conclusion, slogans may come and go but we need a proper regional policy. Scotland and Wales have the freedoms, but England is getting a rough deal.

Commons ChamberMy hon. Friend raises a very important point: free the leisure centres! Many are being used as vaccination centres now, but, like her, I look forward to the day when they can be used for the purpose for which they were built—as leisure centres. It is important that, should we need a continued vaccination programme, for instance, over the summer and into the autumn, as seems likely, we will have to move to more permanent places or places that are free to be used as vaccination centres over that period. In fact, that has already started to happen. We have already started to move some of our testing and vaccination centres to more semi-permanent sites to free up the original sites that we started with, because we needed things to move incredibly quickly. That is an important consideration. Frankly, it is best done as close to the local area as possible, so it is right that I do not get involved in each individual one. I am absolutely certain that the NHS in Wolverhampton is far better placed to make those sorts of decisions than I am from this Dispatch Box, but I hope that it will keep my hon. Friend informed.
I am afraid that “data not dates” clearly has not worked, because people have quite understandably just focused on the dates. The spring sunshine at the weekend meant that in lovely places such as Cambridge it was very busy. Are the Government now going to make a precautionary adjustment or, with hospital numbers still so high, take a chance and risk running the NHS into the ground?

Commons ChamberI take my right hon. Friend’s views on this very seriously. I would say to everybody in Bournemouth and across the country that the best way they can help their area to go into a lower tier is by exercising personal restraint—not seeing the rules as something to push against but rather acting well within them as much as possible to ensure that this virus does not spread.
The Secretary of State talks a lot about testing and tracing but far less about isolating. The shadow Secretary of State made important points that I do not think the Secretary of State addressed. In my city, a couple of weeks ago, only 14 people had received the £500 payment. The reasons why people are not isolating are complicated, but what has gone wrong with the system? It really is not working, is it?
I am glad to say that thousands of people are receiving the payment. Of course it is aimed at those on the lowest incomes who need the financial support in order to isolate.

Over the next few weeks, hundreds of thousands of students will be returning to universities, which is very, very welcome, but what we are seeing at the moment is each institution having to make its own decisions. Universities UK tells us that most students will be getting in-person teaching, but what advice is the Secretary of State giving to those universities and what support is his Department giving?
We are working very closely with the Department for Education to have a successful and safe return of universities, just as, from today onwards, we are seeing a successful and safe return of schools.

The Independent Food Aid Network oversees the work of many food banks, and I listened carefully to the Secretary of State’s comments about volunteering. That organisation is worried about the closure of community centres and churches. Will he reassure it that its valuable work and volunteers will be covered by the guidance?

Commons ChamberI am really pleased that my right hon. Friend has driven forward, and is holding us—and, in turn, the NHS—to account for delivery of this vital agenda; it is incredibly important to get this right. The number of people with learning disabilities and/or autism who are in in-patient settings is falling, but not as fast as I would like. We have a clear commitment in the long-term plan to bring it down by half. As she says, there is a target to bring it down by the end of March. The Minister for Care has done a huge amount of work to drive this forward, and we will do everything we can to ensure that all these people, who are some of the most vulnerable in the country, get the best support they can in the right setting. I welcome my right hon. Friend’s scrutiny.

Commons ChamberI can assure my hon. Friend, who has campaigned long and hard on the issue of access to Kuvan, that we are working on that as well. I hope very much that we can come to a positive conclusion.
The system did finally work, but did it not take far too long, and is it not time to introduce transparency into this opaque system, particularly when the Americans are waiting to pounce on our pharmaceutical industry?
The NHS is off the table in trade talks and pharmaceutical pricing is off the table. Transparency over pharmaceutical pricing would not benefit this country at all because we get the best deals in the world because we can keep them confidential, so it is a slight surprise to hear a Labour Member argue for what would effectively lead to higher prices for drugs in the NHS. Instead, we will protect the NHS.

Commons ChamberThe assurance I can give is that, ahead of 29 March, we put in place the measures that are necessary to ensure that the hon. Gentleman’s constituent and others get the medicines they need, and we have taken forward those proposals and that work ahead of an exit from the European Union on 31 October.
The Secretary of State will be aware of the expert evidence, including from the BioIndustry Association, warning that, although we may be able to stockpile the bog-standard drugs, it will be very difficult to do so for specialist treatments. What guarantees can he give that we will have access to those specialist medicines?
Ahead of 29 March, we managed to put in place a full programme to ensure access to drugs. Of course, the approach is not just about ensuring stockpiles—there are adequate stockpiles for so many medicines all the time—but is about ensuring the flow of materials and finished drugs across the channel via ferries and, where necessary, aircraft.

Commons ChamberLast week, the chief executive of the Association of the British Pharmaceutical Industry warned that even associate membership of the European Medicines Agency would not do for our life sciences sector, so can the Secretary of State tell us how much longer we will have to wait and how much more we will have to pay for new medicines if we are outside the European medicines market?
We will not have to wait longer; we will ensure that we get the best medicines to the people of Britain long after we are members of the European Union, as we did before we were members of the European Union.

Commons ChamberI thoroughly enjoyed my visit to Stirling, where I saw on the ground the leadership my hon. Friend has shown in making sure that Stirling is a fully connected, future-facing city. He has lobbied me endlessly to make sure that we can get the strongest possible connectivity, including full-fibre connectivity, in Stirling. He is doing a sterling job.
We are studying those recommendations closely. That report by the Lords Select Committee was one of the best reports by a Lords Select Committee I have ever read, so we are taking it extremely seriously.

Commons ChamberIt is all very well the right hon. Gentleman’s adopting an abrasive tone, but the truth is that the Data Protection Bill currently before Parliament is all about strengthening enforcement and strengthening people’s right to consent. I did not intend to get partisan, but the powers that we were left by the Labour party are the powers that are being used at the moment, and I want those powers strengthened.
If, in the light of the evidence from this investigation, we need to further strengthen those powers, I am willing to consider that, but I am not willing to take a lecture from somebody who left the data protection powers in need of the update that we are driving through.
We strongly support the provision of music and arts in schools, and I firmly believe in the importance of investing in creative schools for the future. I am meeting my right hon. Friend the Secretary of State for Education next month to discuss music and arts in education.
Cambridgeshire Music hub does a great job for Cambridgeshire schools, but many still struggle—so much so that long-established local music shop Millers Music last year felt moved to donate 21 free pianos to local schools. More than 270 groups applied, leading Simon Pollard, the managing director, to say:
“This overwhelming response to the giveaway only served to highlight the lack of funding for music in the curriculum.”
It was a tremendous gesture, but are random acts of generosity really the way to sustain our creative industries in the future?
I welcome the generosity of that group and of many others, but the hon. Gentleman is right—it is not all down to local generosity, welcome as that must be. We have invested over £400 million in music provision through music education hubs, and we continue to invest at the rate of £75 million a year.

Yes, I give the assurance that, at this stage, our initial assessment is that, for Uber customers, the stolen information is not the sort that would allow direct financial crime. People just need to make sure that they do not respond to phishing emails and that they follow NSCS guidance.
Uber’s scandalous disregard for the rights of the millions of people who have entrusted it with their personal data shows that we need stronger protection. There was a suggestion in yesterday’s Budget that there will be a centre for data ethics. Can the Minister shed some light on the centre’s relationship with the Information Commissioner’s Office to ensure that we can deal with these over-mighty companies in the way that my hon. Friend the Member for Ilford North (Wes Streeting) suggested?
This is an important subject. The Information Commissioner, of course, is the regulator, and we think that there is a broader question to ensure that the modern use of data is both innovative and follows a decent set of ethics, which is what the proposed centre is all about.
It normally says at the start of a Minister’s speech in response to an Adjournment debate, “Let me start by thanking the hon. Member for securing this important debate,” and this time I really mean it, because this is an important subject. Although the hon. Member for Cambridge (Daniel Zeichner) and I sit on opposite sides of the House, we have a similar interest in the subject and want to go in a similar direction in terms of the data protection regime that applies in the UK. We also share a common understanding of the value of data in a digital economy.
That does not surprise me, because the hon. Gentleman is not only an expert in his own right, but as MP for Cambridge he represents one of the most data-rich constituencies in the country. It is very good to see continuing investment in tech companies in Cambridge, including after 23 June. In fact, one of the biggest foreign investments in any British company ever was the investment in ARM Holdings based in Cambridge in July this year. That was a vote of confidence in British tech post-referendum, and since then we have seen investment decisions intrinsically based on the strength of our data systems, by companies such as Google, Facebook, Apple, Microsoft, IBM and others, all of whom have made significant investment decisions into the UK post-Brexit. We have been clear that the general data protection regulation will apply in the UK from May 2018. We fully expect still to be in the EU at that point. That is why we have announced that we will ensure that the GDPR will apply in the UK from then.
The information rights landscape has evolved rapidly in the past decade, as the hon. Gentleman set out. The ability to collect, share and process data is critical to success in today’s digital global society. It is right to update our data protection regime not only because we will still be in the EU, but because it is time to update it, given the enormous changes that have taken place.
We were clear in the negotiations on the GDPR that any new data protection legislation needs to meet the need for high standards of protection for individuals’ personal data while not placing disproportionate burdens on businesses and organisations. The UK was successful in negotiating a more risk-based approach to the GDPR, allowing for greater flexibility in relation to the regulation’s mandatory requirements, such as on data protection impact assessments and data protection officers. We want a scheme that works effectively, protects data and is flexible to ensure that our data economy thrives. Therefore, we were successful in negotiating a reduction in some of the red tape and bureaucracy for ordinary businesses whose primary activities are not data processing but who have data that need to be protected. We succeeded in the negotiations to give greater discretion to the UK’s Information Commissioner in the way it enforces breaches of the regulation.
The new rules will strengthen rights and empower individuals to have more control over their personal data, for example, by providing individuals with greater access to their personal data and information on how their data are being used, and a new right to data portability, making it easier to transfer personal data between service providers. In addition, the GDPR provides important new safeguards, including new fines of up to 4% of an organisation’s annual global turnover, or €20 million, in the most serious cases of breaches of the regulation. Therefore, this is an important call to action for businesses to offer individuals assurances that their data are protected.
The hon. Gentleman asked a series of questions about the implementation of the GDPR. We now need to press ahead with implementation. It will become directly applicable in UK law on 25 May 2018, but a lot of preparatory work needs to be done in the meantime, both in government and by businesses throughout the country. We are now working on the overall approach and the details of that implementation. Details of any new legislation in this area will be made in due course and announced in the normal way, but I can tell him that we are considering these matters in great detail as we speak.
It is important for businesses and organisations to prepare now for the new standards of data processing. A lot of work has already taken place, but there is much for businesses to do to ensure that their processes and practices are aligned with the GDPR. The Information Commissioner is providing regular updates on the steps that organisations and individuals should take to prepare for the new legal framework and will continue to provide guidance over the next few months. We plan to consult with stakeholders on key measures where we have the opportunity to apply flexibilities, which the hon. Gentleman mentioned, in the regulation to maximise and to protect our domestic interests and to get the balance right between delivering the protection that people need and ensuring that the regulation operates in a way that ensures that the UK’s data economy can be highly successful. For example, one measure will be on what the age of consent should be for children who wish to access information services. We want a data protection framework that works best for the UK and meets our needs. Those consultations will be forthcoming.
The hon. Gentleman also asked about the issue of adequacy and the need for our data protection regime to be interoperable with data regimes around the world. It is a question of our data relationship not only with the European Union, but with other countries, too, because the data economy is truly global. We have made progress in our argument within the EU that data localisation rules are not appropriate. That is a live issue in the EU at the moment. There is also work to be done between now and 2018 to make sure that we achieve a coherent data protection regime and that data flows with the EU are not interrupted after we leave. The Government are considering all options for the most beneficial way of ensuring that the UK’s data protection regime continues to build a culture of data confidence and trust that safeguards citizens and supports businesses in a global data economy.
Without having been able to prejudge the publication of consultations and of legislative plans, I hope that I can reassure the hon. Gentleman and the tech industry in the UK that we are doing all we can to ensure that our future data standards are of the very highest quality, including their international links, and that we get the balance right between ensuring the high levels of protection that individuals and companies need and ought to expect with the appropriate levels of flexibility to make sure that our data economy can be one of the strongest in the world.
The Minister is making a deft response and I am listening closely to him. Could he say more about the impact of the Investigatory Powers Act 2016, which has been raised, and the difficulty that it might present to achieving an adequacy agreement?
I was about to come on to that issue, which was raised in the Digital Economy Bill Committee. The Bill includes important data-sharing arrangements, supported by the Labour Government in Wales, to improve public services and other things by ensuring that data are appropriately shared. Those sharing arrangements will still be protected by the data protection regime. The Bill is drafted according to the current law, which is the Data Protection Act. It is not possible to draft legislation in anticipation of future legislation; that is not how the body of legislation works. If and when legislation is proposed to amend an existing system such as the Data Protection Act, one would expect it to include an amendment to the Digital Economy Bill, should this Parliament enact it, in order to make it consistent. That is how legislation is made in the UK. It is neither possible nor logically sensible to legislate in anticipation of future legislation, even if we fully expect it to come into force. All of the existing statute and the Digital Economy Bill, which is currently before the other place, are drafted with reference to the existing regime because the Bill will come into force before the expected future regime comes into existence in 2018.
That explanation may have been more convoluted than it needed to be, but I hope it shows why the Bill—and, indeed, other recent legislation—is drafted in that way. I have heard the complaints, but they simply miss the point of how legislation is made and framed. I hope that that answers the hon. Gentleman’s question and that he is reassured that we are working to implement a modern and effective data protection framework, fit for purpose for the digital age. I welcome his input.
