My hon. Friend makes a fantastic point, and I say again that GPs absolutely underpin our primary care. We all absolutely rely on them, and our measures to create 36,000 additional roles in GP practices will provide them with the additional capacity they need so that they can serve their patients better. That is good for patients, good for primary care and incredibly good value for the taxpayer. It is ludicrous that Labour is proposing to undermine the GP partnership model; that would be a disaster for primary care.

We know that people in work lead happier, healthier lives. However, over 10 million “not fit for work” fit notes were issued last year. Most were repeat fit notes issued without any advice, so we are missing a golden opportunity to give millions of people the support they need to remain in work. That is why we are launching a reform of the fit note process to create a new system in which fit note conversations focus on what people can do, not what they cannot do. As part of this, the Government will consider shifting the responsibility for issuing fit notes away from GPs to reduce the pressures they face and to free up millions of appointments. I thank everyone who has delivered this vital work, and I very much look forward to hearing the results of the call for evidence in due course so that we can reform our welfare system for the sake of our constituents and our GPs.

According to the Association of British HealthTech Industries, it takes, on average, 17 years for lifesaving and life-enhancing technologies to be adopted in the NHS. What steps is my right hon. Friend taking to speed up the adoption of new technologies so that the NHS can save more lives and improve patient outcomes?

I dispute the 17-year figure, as it can vary across innovations. The figure is contested, but my hon. Friend raises an important point. We have a plan to prioritise the acceleration of patient access, thereby ensuring safe, effective and innovative medical technology for patients and the NHS. Our ambition is backed by funding, and we are reforming the medical technology regulatory framework, introducing the innovative devices access pathway pilot and launching frameworks to increase the availability of innovative products for the sake of patients across England and the United Kingdom.

I thank my right hon. Friend the Member for Rossendale and Darwen (Sir Jake Berry) for his speech and for mentioning the word “freedom”. It is really important that we do that. I am not coming at the debate from a libertarian perspective—more of a practical one—but, in essence, I agree very much with the majority of what he said.

As an ex-smoker, I share the Prime Minister’s aim of reducing the prevalence of smoking. I never want to see anyone, especially young people, pick up this dangerous habit. It is therefore with some sadness that I rise to explain why I do not expect to follow him into the Lobby on this vote. My great reservation is that the Bill is impractical and could easily make things worse through unintended consequences. There are 5 million users of vaping products, and there is a substantial risk that restricting the use of vapes will lead to them moving back to smoking, increasing the burden on our health system.

Vaping is recognised by Public Health England as 95% safer than tobacco use. Late last year, a study by Brunel University London revealed that if half the number of adult smokers switched to vaping it would save the NHS more than £500 million a year. The potential restriction on the flavours of vapes, which the Bill gives Ministers the power over, could also have unintended consequences, as stated in the Department of Health and Social Care’s own impact assessment. Restricting vape flavours would mean around three quarters of the 1 million adults who vape could be affected in some way.

A further study, published by Bristol University, considered the impact of removing all flavours on non-smoking young people and adult smokers using vapes as a quit aid. The study found that as a result of the flavour ban, more adults would be at risk of smoking tobacco cigarettes. Flavoured vaping is a smoking cessation tool. I can testify to that from my own experience, having chosen mango flavour over the unpleasant tobacco flavour on offer in the market.

Furthermore, the illicit cigarette share of the market is officially 11%, up from 8% five years before, and has been on an upward trend over the past decade. Far higher levels of illicit produce can be found in constituencies containing less affluent areas. Dangerous, illegal and untaxed nicotine products are also easily and widely available across the country. During a test purchase exercise I attended in my constituency, we found 21 retail outlets selling harmful, illicit or counterfeit cigarettes; illicit prices as low as 35% to 45% of legal prices; illegal vapes available in up to 24 ml tank sizes, when the legal limit is 2 ml; and British packaging and safety requirements on products not followed.

The consequences are that people buying unregulated cigarettes and vapes, particularly counterfeit ones, are risking their health greatly. The profits generated are taken by criminals rather than legitimate taxpaying businesses. No excise is paid on these illicit products, illegal distribution networks are deeply embedded into the black market and the dissuasive effect of high taxation is evaded. Although penalties have been increased, the huge disparities between those for tobacco smuggling and those for smuggling drugs will continue to attract criminal gangs, because it is a relatively low-risk form of organised crime. I believe that, sadly, the funding surge for trading standards that was announced earlier in the debate will not be sufficient to tackle those issues.

Furthermore, nothing in the Bill will help the 6.4 million existing smokers. Indeed, by treating heated tobacco products and certain types of vapes in the same way as cigarettes, it decreases the chance that those who smoke will switch to a less dangerous alternative. I would have preferred the Government to focus on the Smokefree 2030 ambition that was aimed at those existing smokers.

Finally, I believe that the Bill is unenforceable and will put undue pressures on legitimate tobacco and vaping retailers. Those points were raised with me recently by shopkeepers at a parliamentary Association of Convenience Stores event. All the shop owners who spoke to me were genuinely concerned about the violence and verbal abuse to which they would potentially be subjected for trying to enforce the age limits set by the Government, and they also felt that they would lose more revenue to shops in their areas selling illegal vapes and cigarettes.

While I believe that the Bill is well intentioned, it risks having an effect that is the reverse of what it is trying to achieve, and that is why I will reluctantly vote against it.

It is a pleasure to serve under your chairmanship, Sir Mark. First, I thank my hon. Friend the Member for Darlington (Peter Gibson) for securing this important debate, which gives me the opportunity to highlight the seriousness of the use of illegal vapes and cigarettes in my constituency.

A week before Christmas, I was accompanied by a team of enforcement officers on a test purchase exercise in Dewsbury town centre. I put on record my thanks to the team for their professionalism and ingenuity. During the exercise, we discovered over 20 retail outlets selling illicit cigarettes and vapes across Dewsbury. Fourteen of them were selling illegal disposable vapes, one of which was on sale for £10—but it was £10 for 3,500 puffs. The maximum legal tank size equates to about 600 puffs, so £10 spent on that product would be equivalent to almost six legal vapes. Unlike a legal vape, however, this one had not had its chemical constituents approved by the Medicines and Healthcare products Regulatory Agency, so we have no idea what was in it.

Here are some further shocking findings from our investigation. That product was the smallest puff size available to purchase that day. Another product, available for £12, promised 4,000 puffs. Another claimed to provide 9,000 puffs for £13. For £17, two disposables claiming to provide 15,000 puffs and 24 ml tank sizes were available. The maximum legal tank size is 2 ml. Almost half the shops that sold these illicit vapes had them on display. They either did not care or did not realise that the products were illegal. The whole exercise was an eye-opener, but there have been several high-profile incidents involving the sale of illicit cigarettes and vapes in Dewsbury. Last October, £100,000-worth of such products were seized by West Yorkshire police and trading standards.

Last July, an independent report found that nearly a fifth by value and volume of the vaping industry appeared to be illicit in 2022 and that almost a third of e-liquid consumed in disposable vapes failed product compliance rules on nicotine concentrations and volume limits. It is clear that the industry finds itself in a challenging position but, in forging a path forward, it is important that we do not lose sight of other key facts. Scientific research indicates that vaping is less dangerous than smoking, with up to 95% fewer harmful chemicals in the emissions. The legal vape industry has had a positive impact on reducing smoking, converting 1.5 million people away from cigarettes. I have given up smoking in the last 12 months, and I used nicotine patches, but I recognise that there are other ways to stop smoking, including legal vapes. From a health benefit point of view, it is important that we recognise that aspect.

The legal vaping industry, like any other industry, needs protecting from criminal activity and illegal competition. There must also be a balance between discouraging young people from vaping and continuing to provide a route away from smoking for adults. Getting the regulation wrong could further undermine the Government’s smokefree ambitions and would arguably give a significant boost to the illicit trade. I therefore urge them to carefully consider the implications of any proposed legislation and changes to regulations in the future, and I look forward to hearing the Minister’s response to this important debate.

I thank the hon. Lady for that point, which my hon. Friend the Member for Sleaford and North Hykeham (Dr Johnson) also raised. The 2015 evidence study was indeed conducted by Public Health England. The most recent evidence we have, from 2022, does not give that precise figure; it does emphasise that vaping is safer than smoking, but does not indicate by how much.

As the debate has made clear, despite vaping’s effectiveness as a tool to quit smoking, illegal under-age vape sales are a growing concern for many parents and teachers across the country, and vaping has increased rapidly among under-18s in the past 18 months. The recent rise in teenage users shows that vapes are being used beyond their intended audience. As my right hon. Friend the Member for Romsey and Southampton North (Caroline Nokes) highlighted, there are multiple reasons for that, but whether it is packaging, naming or flavouring, the unintended consequences are clear. As my hon. Friend the Member for Broadland (Jerome Mayhew) pointed out, these consequences are not necessarily easy to deal with, as there may be unintended consequences of doing so—for example, tax increases on vapes might prevent people who want to give up smoking from doing so. There are no easy solutions, so we need to take our time before making further decisions. That is why in April we launched a call for evidence on youth vaping. It closed last month, and officials at the Department have begun to examine the responses. We will set out our response in the autumn.

Other speakers, such as my hon. Friend the Member for Erewash (Maggie Throup) spoke about why it is so important that we consider going further. My hon. Friend the Member for Sleaford and North Hykeham, who speaks with considerable experience, pointed out that this not a party political issue, but a cross-Government matter, with the Department of Health and Social Care dealing with safety, the Department for Education providing advice to children, the Department for Culture, Media and Sport dealing with the role of advertising, and the Department for Environment, Food and Rural Affairs dealing with the disposable products element. To stop children buying vapes, we also need businesses to comply with existing regulations and to abide by the standards we have set. To help enforcement of the regulations, we have teamed up with enforcement agencies to fund a new illicit vaping unit, which will remove products from shelves and at our borders, and stop the sale of vapes to children.

In May, the Prime Minister announced further measures, including closing a loophole that allows industry to give out free samples; increasing education and supporting designated school police liaison officers’ work to keep illegal vapes out of schools; and reviewing the rules on issuing on-the-spot fines to shops selling vapes to under-18s, as well as the rules on selling nicotine-free vapes to under-18s, to ensure that the rules keep pace with how vapes are being used. To respond to a point made by my hon. Friend the Member for Eastbourne (Caroline Ansell), we are also looking at adding lessons on the health risks of vaping as part of the current RSE curriculum review. Those measures will help headteachers and other school leaders to manage vaping on school premises and inform young people about the risks of vaping, with a view to reducing the number of young people who are currently vaping or might be tempted to try it in the future.

As a number of speakers pointed out, we must of course be wary of the environmental impacts, in particular of single-use disposable vapes. Increasing use of these products is leading to their improper disposal. That is why DEFRA is soon to consult on reforming the Waste Electrical and Electronic Equipment Regulations 2013 to ensure that more of this material is properly recycled. We shall continue to work with the sector and industry to help businesses to understand their responsibilities, both to ensure that their environmental obligations are met, and to ensure that products are not marketed to children, are produced to the highest UK standards, and are compliant with our regulations.

I emphasise that until recently our vaping regulations have been effective in keeping rates of vaping among under-18s low, but of course we acknowledge that there are problems and that we have seen an increase in usage, which is why the consultation is about looking into what more we can do.

I welcome the consultation to tackle this problem, but will the Minister confirm that any appropriate measures that the Government take to reduce youth access to vapes will not harm our pragmatic science-led approach to ensuring that adults have access to the full range of alternatives to help them to quit cigarettes for good?

That is the balance we have to create. We do not want unintended consequences whereby we reduce the use of vapes in under-18s but also stop their use among those who are quitting smoking. We know from our evidence that vaping is much safer than smoking. For those communities, very often in deprived areas, where there are higher rates of smoking, we do not want the cost of vapes to be prohibitive and for people not to switch to them instead of smoking.

Our current laws protect children by restricting the sale of vapes to over-18s and limiting nicotine content, and there are regulations on refill bottles, tank sizes, labelling requirements and advertising restrictions. It is important that we remember that regulations are in place, and it is important that they are enforced.

Out of that, I can pick one thing we agree on: the importance of helping people to live independently at home for longer and social care as a part of that. I say to the hon. Lady, as I said a moment ago, that we have not cut a penny of funding from our commitments to adult social care, both on adult social reform and on the historic £7.5 billion of adult social care funding announced in the autumn statement. We are forging ahead with our reforms, with the workforce at their heart, because the workforce is crucial, hand in hand with the digitisation of social care, improving data, joining up health and social care, and supporting unpaid carers.

We have the lowest smoking rate on record in England, down from 21% in 2010 to 13% now, partly because we have introduced minimum excise tax on cheap cigarettes and double duty on cigarettes, but we know we have to go further. That is why we recently announced significant new funding to help a million smokers quit, through swap to stop, and introduced a new financial incentive for pregnant women. We are also consulting on new pack inserts, similar to those in Canada.

As someone who was able to quit smoking using nicotine patches, following the advice at last year’s Emley show, I welcome the measures announced by the Minister earlier this month to help us achieve our Smokefree 2030 target. Does the Minister agree that, in order to help even more people quit, we should continue to pursue harm reduction strategies such as swap to stop? That will ensure that we maintain our position as a world leader in public health.

I absolutely agree with my hon. Friend and congratulate him on quitting. The swap to stop scheme that we are rolling out nationally, which is the first of its kind in the world, is based on strong local evidence. We know it works from local pilots, which is why we are rolling it out at scale.

We made very significant progress on this in the Budget immediately following the general election, as the hon. Lady will know. That has removed this problem for the vast majority of doctors who serve in the NHS. I am very glad that we were able to make that progress. I am always happy to look at suggestions from the unions and others, but I am glad to say that we have made a good deal of progress on this one.

Despite the recent rise in infection rates, covid-related deaths and hospital admissions remain low across my constituency. Surge vaccinations and testing have been effectively rolled out in high-risk areas, and pop-up vaccination centres, such as the Darby and Joan Club in Clayton West, are doing a fantastic job. Given that, can my right hon. Friend assure the people of Dewsbury, Mirfield, Kirkburton and Denby Dale that there will be no need to introduce local restrictions in the future?

I am grateful for the hon. Gentleman’s question, and I will certainly look at that specific example, if he is able to give me the details. The data that will be published at 2 pm for his sustainability and transformation partnership will show that vaccination levels for the over-80s are now over 75%, which is an improvement, but they need to go even further, so I will happily take a look at that. Of course, the recent large vaccination site opened at Network House, Wembley will also help with that.

Frontline nurses, doctors and care staff in Dewsbury, Mirfield, Kirkburton and Denby Dale have done an amazing job during this pandemic, working long hours under immense pressure, and it is only right that they have been included in the first phase of the vaccinations. Could my hon. Friend confirm the percentage take-up rate of vaccinations for NHS and care home staff?

I agree with my hon. Friend. The fantastic NHS staff have stepped up in the most challenging of circumstances, and it is imperative that they are part of this first phase of the vaccination programme.

A significant milestone was achieved last week, as my hon. Friend will have heard me say earlier: we have now gone into every eligible care home of older adults to offer their staff and residents their first dose of the vaccine. This is testament to our remarkable care home staff and NHS workers. I urge all social care and front- line health care workers to take up the vaccine when it is offered to them. The recent large vaccination centre for my hon. Friend’s constituency is the Spectrum Community Health CIC in Wakefield, which staff can also access. We continue to make progress with staff, and our aim is to offer to each and every member of staff that vaccination by the middle of February.

Yesterday, I had the pleasure of meeting the Prime Minister at the Al-Hikmah vaccination centre to highlight the importance of people from local communities accepting the offer of a vaccine. What message could my right hon. Friend give to the people of Dewsbury, Mirfield, Kirkburton and Denby Dale who may be thinking twice about having an inoculation when given the opportunity?

I would say to everybody that they should listen to the my hon. Friend, their local representative, and to all those who have looked at the impact of the vaccine. We can see that it saves lives and that it is safe to take. We can see that the rumours that have spread on the internet are just that—they are rumours, not facts. I would listen to local faith leaders too, from churches, mosques and synagogues right across the country, who are all uniting to say that we should take the jab when it is our turn. It is the right thing for you and it is the right thing for your community.

There are a couple of areas relating to how we continue to fight the virus that will benefit from some further consideration, and I urge those on the Front Bench to take another look at them and refine the current arrangements and regulations.

In my maiden speech some months ago, I highlighted the heroic efforts of our doctors, nurses, paramedics and NHS support staff in responding to the pandemic. As each day passes, my admiration for them grows even more—for their professionalism, dedication and resilience during these trying times.

At present, local NHS staff are battling with rising bed occupancy at Dewsbury Hospital and Huddersfield Royal Infirmary and with fluctuating staffing levels. Sickness, the requirement to self-isolate, burnout due to the very demanding nature of their work and poor staffing levels have seen wards badly hit. Having spoken to fellow Members, I also understand that this is a big issue affecting hospitals outside my constituency such as, for example, Pinderfields Hospital, Leeds General Infirmary and St James’s Hospital.

In my local Mid Yorkshire Hospitals NHS Trust, at times up to 20% of junior doctors in medical specialities have not been at work, through no fault of their own.  That has the effect of increasing the pressure on those who remain on duty. It is not my intention to be alarmist, but having listened to NHS leaders and those on the frontline, it is clear to me that staffing levels are at risk of being stretched too thin, and the pressure is likely only to increase.

Meanwhile, there many third-year student nurses and fourth-year medical students in universities; they made a large difference in the first wave of the pandemic and could be called on again. A four-week placement of such students in hospitals could alleviate some of the pressures. After speaking to local NHS leaders, I know that they are keen to discuss that idea with the Government. I ask the Minister to consider seriously this temporary measure to help to release the pressure on our local hospitals and to support our amazing teams of doctors and nurses.

It is crucial to ensure that all our children get the education that they need at this time. The second thing that I ask those on the Front Bench to look at again is the guidance relating to school attendance of children with extremely clinically vulnerable parents—an issue that has come to light in my constituency. Although extremely clinically vulnerable children can, rightly, attend school remotely, the current guidance compels extremely clinically vulnerable parents—who may, for example, have a weak immune system—to send their children to school or potentially face a fine.

The parents are in a tough and worrying position, juggling concerns about their own physical and financial health while being required to send their child to school and risk bringing home an infection. The situation could easily be remedied by allowing such pupils to study remotely. In these rare circumstances, schools and colleges are seeking to be as compassionate as possible, but they feel restricted as to how lenient they can be. I hope the Government will consider taking another look at the guidance.

It is not all doom and gloom, though, and there is much to be optimistic about. Rumour has it that there may be several vaccines on the way. The introduction of rapid testing should also help to control the virus until we are in a position to fully roll out a vaccine in the new year, which I hope will mean that we can all get back to some kind of normality.

In summary, I ask that the Minister and the Secretary of State consider my request to release nursing students to help our local hospitals, and that the Department for Education looks at the issue I raised regarding clinically vulnerable parents having to send their children to school during the pandemic.
