Lords ChamberMy Lords, I should also have acknowledged the important point that the noble Lord, Lord Berkeley, made—that it is vital that we maintain and re-establish public confidence in public inquiries and in our political institutions as such. One of the biggest problems, which we all share, is the extent of public and media cynicism about the political process in this country. This inquiry is working with great care. Again, I stress that this is an independent inquiry—the Government are not in charge. The four active members of the Chilcot inquiry group are those who are responsible for what emerges, although of course a great deal of negotiation has gone on about the extent of publication. That is a very important part of ensuring that this is not in any sense a whitewashing inquiry.
On a previous occasion I was criticised by one or two noble Lords for suggesting that the Franks inquiry on the Falklands War was not entirely thorough or rigorous. I went back to the review that I had written in International Affairs on the publication of the Franks inquiry to demonstrate why I still hold that opinion. This inquiry is very thoroughgoing. It is being conducted by a number of people whom I personally trust and respect, and who are unlikely to be defenders of the “secret establishment”, so to speak. We very much hope that the report will appear before the end of the year; the Prime Minister has said that publicly. We are doing all we can—with a number of very hard-working officials, who are themselves doing all they can—to complete the final stages of the process of clearing these very difficult and delicate documents so that we can send out the second stages of the Maxwellisation process to those who will be named in the report. We will then move on from that to the presentation of the report to the Prime Minister and, we hope, to publication as soon as possible.
My Lords, given the complexity of the process and the point that the noble Lord, Lord Owen, made, that we should not publish it in the new year, would it not be best to wait until after the election, when a Labour Government are in power?
My Lords, we want to publish as soon as we can, and before we descend into the election campaign.

Lords ChamberMy Lords, I make the same request to the noble Lord, Lord True. Amendment 280, which was moved but later withdrawn by the noble Earl, Lord Caithness, proposes that there should be a right of appeal in case something is not quite right. We must always take the charitable view that if someone cannot pay back what they owe, there may be a reason for that other than intent. We ought to allow room for exceptions in certain circumstances.
My Lords, I take up the cue provided by the noble Lord, Lord Grocott—I think we are within sight of a relatively limited Act that would command consensus all round the House. However, this proposed new clause would take us beyond the possibility of consensus at present. I think it would be appropriate if the noble Lord, Lord True, would withdraw the amendment. Certainly, I think that a number of us may wish to look at this particularly complex additional matter, but it is important to make some limited progress. I see that the noble Lord, Lord Hunt, nods his head. That may be the best way forward.

Grand CommitteeMy Lords, the question of constitutional change is one that we will continue to argue over, and the definition of what is constitutional and is not constitutional is something that evolves through debate and argument in Parliament as well as in academic seminars. Most of us think that we know what is constitutional when we see it, but sometimes we disagree with each other.
The Minister describes how exemplary the Government have been about the House of Lords Reform Bill, although they were was in a great hurry to do the other Bills. Would it be right to conclude that the Government will abide by the rules when that does not bother people in the recent past, but that if it was the past they will not call it constitutional?
My Lords, the Government, as I hear the Leader of this House say frequently, are strongly committed to the process of House of Lords reform. We will bring a Bill before the House and we look forward to the welcome that it will receive from the House’s resident constitutional experts.

Lords ChamberMy Lords, with nine clauses to deal with, worrying about a very small traffic island seems on the face of it to be a bit excessive, but I recognise that there is concern about the current situation in Parliament Square, the overkill that SOCPA applied to it and the question of what we put in place as we remove SOCPA. On the problem that we are trying to address and the harm that we are trying to remove, I say to the noble Lord, Lord Rosser, that the democracy encampment actually produced a considerable amount of harm to Parliament Square Garden. The garden, which should be there for the enjoyment of all, is still fenced off, as the noble Lord well knows, and not only tents but some semi-permanent structures now obstruct the pavement.
I also recognise that this is part of a much wider discussion that we need to have, not just on the Bill but about the future of Parliament Square and of this part of Westminster as a whole. We had a useful debate on this on Friday, to which one or two Members here contributed. I recommend that those who were not here on Friday read Hansard. The debate raised some much wider questions to which I hope this Chamber will return, and which I hope that Members of both Houses and the authorities of the Abbey and the Supreme Court will address.
Is there not anxiety on the part of the demonstrators that if they do not have permanent structures they will not be able to come back the next day and demonstrate? They are worried that if they demonstrate only during the day and then go home, the next day the police will say, “You can’t come here”. They are probably trying, in a clumsy way, to establish a right. I quite agree that these structures are ugly but that right is a crucial one to protect, and we should not worry too much about the structures.
My Lords, there is no evidence for what the noble Lord has just suggested. We are talking about proportionality in a whole range of different ways here. Parliament Square, Old Palace Yard and the area around them, as some noble Lords were saying on Friday, ought to be a great democratic space to be enjoyed by a large number of people, not just those who come to visit Parliament or those who wish to make their views well known—loudly known—but also tourists and those substantial numbers of people who pass through Parliament Square every day on their way to and from work. It is a transient population that is obstructed by those who wish to be here permanently. Some of those structures are semi-permanent. I think that the noble Lord will agree that if the Aldwych—to take where he and I used to work as an example—had a similarly permanent encampment, there would be real problems of obstruction of the footway and so on.
The question that we are dealing with is: how best to arrange Parliament Square for the enjoyment, and the presence, of the maximum number of people under shared rules for all who come. This is a very large area. The intention of this part of the Bill is to give much greater clarity to protestors, public and the police as to what is and is not acceptable in Parliament Square. As I said on Friday, overnight protests and vigils are clearly one sort of acceptable behaviour. Being there for a year at a time—or, in the case of Brian Haw, several years—is a different sort of presence. It begins to obstruct the rights of others. I am sure that the noble Lord is familiar with John Stuart Mill and On Liberty, and the question of how one’s liberty has not to obstruct the rights of others. The maximum number of people in the democracy encampment was, I think, nearly 150. Brian Haw’s group has always been a mere handful. So we are trading off different rights. That is the purpose of this place.
I therefore say to the noble Lord, Lord Campbell-Savours, that scrutiny of this is taking place in a wider context, not simply today. We discussed this on Friday and there is, indeed, another Private Member’s Bill. This will continue to be a large set of issues.
The noble Baroness, Lady Miller, asked whether the policeman was a mind-reader. No, certainly not. Before anyone can commit an offence under these provisions, they must first be issued with a direction to stop: a warning. It is acceptable to issue a warning to someone you see carrying their sleeping bag and various other things that they should not put it down and spend several nights on it. That is what is intended in this clause.
The noble Baroness talks about fears of domestic extremists. I do not particularly want to go down that road beyond saying that I recall that when I once turned up to speak to the Campaign for the Accountability of US Bases in Britain at RAF Menwith Hill, it was remarkable how quickly the MoD policeman appeared to recognise who I was—my name and everything else. Perhaps I am on the list, too. We do not need to go too far into that for the moment.
These amendments rightly test the replacement for SOCPA. The Government’s view is that getting rid of SOCPA and replacing it with measures that existed before—as far as demonstrators are concerned, the previously operating Public Order Acts—is the right response. There is a trade-off between different users, as I have already said. However, there is a clear consensus on all sides of this Chamber after five years of debate that Parliament Square should be fully developed as a democratic space and that we should be discussing with the Palace authorities, the Abbey, the Supreme Court and others how to use it better. That discussion is rather wider than the Bill goes and needs to be continued elsewhere.
The question of Abingdon Green was raised briefly. There are particular problems because Abingdon Green is private, not public, property. Noble Lords will be aware of the many subtleties of who is directly responsible for which bit of the various facilities around here. There are risks of hybridity if we apply this Bill to Abingdon Green. However, we understand the practical challenges in terms of applying these various remedies. The Government will therefore additionally discuss with the House authorities the benefits of moving an amendment on Report to make provision for a power of seizure to be attached to Royal Parks regulations, which apply to Abingdon Green, to support the position that we have taken for effective enforcement of GLA and Westminster City Council by-laws.
My Lords, this debate has ranged a little more widely than the Bill under consideration and has raised some large questions about the future of Parliament Square. I start by declaring two personal interests. First, I live in a world heritage site in Saltaire and have therefore spent considerable time dealing with the legislation on world heritage sites. Secondly, I was, many years ago, a chorister across the road at the abbey and still have links to it. Indeed, I give occasional singing tours of the abbey for charity. I am conscious that the two halves of this world heritage site are, alone among world heritage sites in this country—and on the absolute outer edge of UNESCO regulations—divided by a main road.
I start by addressing the issues raised by this Bill and Part 3 of the Police and Social Responsibility Bill, which I hope will reach the noble Lord, Lord Cormack, in one week’s time rather than two if we are able to make progress in Committee next Thursday. The Government have set out their commitment to restoring the rights to non-violent protest, and have therefore brought forward the repeal of Sections 132 to 138 of the Serious Organised Crime and Police Act. We agree that Sections 132 to 138 impose unnecessary restrictions on the right to peaceful protest around Parliament, and that they have had a chilling effect on that right, which has contributed in some quarters to a breakdown in trust between the Government, the police and those who wish to protest. We recognise that we are talking about striking the right balance. However, I am very happy to hear the consensus across the Chamber—and, I am sure, in the other place—that it is important to maintain the right to peaceful protest.
I shall just throw in a small amount of history, since I was heavily criticised over answering a question about sessional orders and have done a little research. In the 17th century this Chamber assumed that noble Lords had the right, under all circumstances, to come to this Chamber and that spaces should be cleared for them. Having looked at the book just published on the Lords in the 17th and 18th centuries, the degree of arrogance with which the Lords then assumed that the right of access could be enforced is not one that would be appropriate to our modern Chamber. In the 1780s, after the Gordon riots, a battalion was encamped in St James’s Park for some months in order to maintain the right of access to Parliament. That is not the sort of thing, I suggest, that we now wish to repeat.
The Government are therefore making it clear that Sections 132 to 138 have not prevented the abuse of our public spaces by a determined few to the detriment of the enjoyment of those spaces by the wider public. I think we are talking about a maximum of 150 in the democracy encampment and fewer than double figures in the Brian Haw encampment. However, in striking a balance we are also bringing forward a package of measures in the Police Reform and Social Responsibility Bill to ensure that everyone else is able to access the square equally and to enjoy its amenities. There are, after all, others who come to Parliament Square for a number of reasons: as tourists, to see the Houses of Parliament and Big Ben; as a cultural experience in visiting this world heritage site; and as an educational experience for those interested in the democracy process, by seeing where Parliament is situated.
I am happy to say that discussions have been under way between the Dean and Chapter across the road and the authorities here about joint visits by school parties and others to the abbey and to the Palace of Westminster—and, incidentally, extending to the Supreme Court, while there will be discussions in the summer of whether that could also include Buckingham Palace—to bring people to this central area of English history. That also raises questions about how easy they find it to get from one part to another.
We all witnessed the occupation of Parliament Square Gardens by the democracy village encampment during the summer, which prevented members of public and visitors using and enjoying the garden. The courts have said that Parliament Square Gardens is not a suitable area to be used for any sort of encampment. The High Court has also said:
“Parliament Square Gardens is not a suitable location for prolonged camping; such camping is incompatible with the function, lawful use and character of”,
Parliament Square Gardens and,
“is also inconsistent with proper management of the area as a whole. Members of the public have been and would be precluded from using the area occupied; the area in question is the area nearest to an important entrance to the Houses of Parliament”.
The noble Baroness, Lady Trumpington, asked whether we could tell campers of sites to which they might legitimately go. One has to say that they can legitimately go to authorised campsites. It is no more legitimate under general law to move to encamp in Green Park, St James’s Park, Westminster Abbey churchyard or elsewhere than it is to camp on Parliament Square itself.
What were the permissions given during the royal wedding for people to camp across from Westminster Abbey and all around Parliament Square? Was there a special dispensation given by the police or was an announcement made about that?
They were not only there but on The Mall, as I attempted to walk at speed from the Cabinet Office to Tothill Street the day before the royal wedding and it took me nearly 20 minutes. I am well aware that policing is by consent and discretion in this country. On special occasions, as in the run-up to a royal wedding, we accept obstruction of the footpath for a limited period. That is what happened then. On whether obstruction of the footpath for extended periods is also acceptable, we are absolutely talking about the balance between the very small number of people who have occupied Parliament Square Gardens and the footpath adjoining it and the very large number of people who come through.
We all welcome that very large number of people. I have had an office on the West Front for some years and I am used to hearing people singing hymns, or hundreds of schoolchildren producing a substantial number of decibels as they cheerily march past, and a whole range of other demonstrations. I do not mind that noise as it comes through; I much prefer it to the more regular noise of the heavy traffic. That is part of what Parliament should be about. We shall return to the exact question of the measures which are now proposed to replace SOCPA next Thursday. I say simply that those measures are to have a small controlled area in which certain activities—erecting tents and the unauthorised use of loudhailers—are prohibited.
