Commons ChamberMy hon. Friend is spot on. There are 1 billion people hungry in today’s world and we are heading for a further increase in population of 2 billion. We should be aware that there is no unlimited cheap, safe food beyond our shores—it was the position of the last Government that there was—so we as a Government absolutely want to see domestic food production increase. We already have a huge task: 30% of the food eaten in this country is imported, but could be produced here.
7. What assessment he has made of the effectiveness of the allocation of direct payments through pillar 1 of the CAP on common land.
We published our assessment of the financial impact of changes to pillar 1 in chapter 7 of our response to the CAP reform consultation. We have held discussions with stakeholders about the future allocation of direct payments in respect of common land. The approach for the new CAP schemes, which begin in 2015, will take account of fairness, the need to minimise administrative burdens and the need to comply with the relevant European legislation.
I thank the Secretary of State for that answer. He will have gazed out on many occasions towards Cleeve common in my constituency. People are concerned that if there is a future prevention of claims for dual use, the funding will not be available to manage the common for purposes of wildlife conservation and indeed businesses. Will my right hon. Friend bear that in mind when he comes to take decisions on these matters?
I am grateful to my hon. Friend for his question. We are aware of the problem of dual use, but it is absolutely our intention that those who have common land should be eligible for new environmental land management schemes, which we shall publish shortly.

Commons ChamberI was Secretary of State for Northern Ireland, so the hon. Gentleman knows that I respect the protocols of devolution. We have regular discussions at ministerial and official level on matters agricultural. He is absolutely right, however, to raise the contrast between what has happened in Northern Ireland, where diseased badgers have not been removed, and the dramatic reduction in southern Ireland.
Will my right hon. Friend update the House on the development of vaccines for badgers and, indeed, cattle?
I raised the issue with Commissioner Borg on my first day back, a week last Monday. We are pressing on with the development of a cattle vaccine but, sadly, it will take some years: we have to develop a vaccine that is valid and works; we have to develop a DIVA test to differentiate between vaccinated cattle and diseased cattle; and we then have to get a legal process. I am afraid that that is going to take at least 10 years.

Commons ChamberAs part of the cull is taking place in my constituency, I thank the Secretary of State for being the first in over a generation to tackle this issue. Does he share my concern at the statement made by the police and crime commissioner for Gloucestershire yesterday opposing the extension of the trial? Does my right hon. Friend agree that it is for the Government and Parliament to decide what should happen, not a publicity-seeking PCC?
Policing issues are not for me. There will be legitimate protests because we live in a democracy and we respect that, but there is a grey line and we do not support obstruction of a policy that was endorsed by both parties in opposition and in government and has been endorsed by this House.

Commons Chamber6. What recent progress has been made on reform of the common agricultural policy.
At the Agriculture and Fisheries Council on 26 June political agreement was reached on the CAP reform regulations. Overall the CAP package does not represent a significant reform, but we substantially improved the Commission’s original proposals and fended off attempts by others to introduce a number of regressive measures. By agreeing to the regulations now, we are able to provide certainty to farmers and paying agencies.
I am grateful to my right hon. Friend for that answer and congratulate him on his work at the council. Will he enlighten the House on what those regressive measures were, because my farmers remain very concerned that they will be worse off as a result of some of the changes compared with their continental competitors?
I am grateful to my hon. Friend for giving me the opportunity to enlighten the House. It was extraordinary that at a very late stage in negotiations the European Parliament made moves to penalise the most efficient dairy processors and reward the least efficient. There were extraordinary moves as late as last Monday night to introduce coupled payments for tobacco, pigs, poultry and cotton. I think the UK played a part, working closely with our allies, and we saw off a number of other regressive measures, such as double funding. I hope that when the detail is worked out with the representatives of the farming unions, they will see that we stood by British farming and stopped a lot of really bad things coming through this reform.

Commons ChamberUnlike the last Government, we have set up a groceries adjudicator, which answers the hon. Gentleman’s first question. On the second one, he will be pleased to hear that at Saturday’s meeting we agreed that retailers would carry out this testing, which will have meaningful results by the end of the week. Further to that, however, I want these results published on a regular basis—every three months.
May I express my entire confidence in how my right hon. Friend the Secretary of State has dealt with this issue? Does it not raise a further point, however, which is that British farmers are handicapped when trying to compete with food producers from countries that not only do not carry out the appropriate checks, but have much lower animal welfare standards than we do?
My hon. Friend is right. It is a scandal that, despite our egg producers last year conforming to the enriched cages directive, and despite the fact that again this year we were 100% up because we were the first out of the traps to end tethering, some major European countries have still not conformed. I raised that point with Commissioner Borg at our last Council meeting and wrote to him about it last week.

Commons ChamberThe hon. Lady is absolutely right. We want a solution to this conundrum, which is why we have been meeting the ABI regularly and why we are determined to get a good solution. There is no point in rushing into a scheme that will not work. Getting a balance is a difficult conundrum and we are determined to get it right.
I thank the Secretary of State for his statement. He is well aware of the effects flooding has on my constituency. Is it not time to develop a national strategy to ensure that the culverts, ditches, drains and waterways are regularly maintained and cleared? Is it not also very important to stop building houses in flood risk areas? Will he assure me that no inspector appointed by this Government will force councils such as Tewkesbury to build houses where it is inappropriate to do so?
My hon. Friend is absolutely right—making sure all those channels are kept clear is part of the management of them. In recent days, we have seen complete and total saturation of the land and no matter how clear some of the channels have been kept, there has been nowhere for the water to go. He is quite right to mention the channels—several Members have raised that point with me—and I will talk to the Environment Agency about it.

Commons ChamberI thank the hon. Gentleman for his question and I appreciate his knowledge of this subject, as Minister of Finance and Personnel. He makes a very good point, which I have discussed with David Ford, the Minister of Justice. We have agreed that we should work together so that Northern Ireland sentences can be appealed against if considered too lenient.
In the Select Committee’s recent report, we identified as a major problem the fact that a marker had not been developed sufficiently quickly. Has the Secretary of State had any discussions with HMRC about the development of that marker, which would make fuel fraud and laundering far more difficult?
I am grateful to the Chairman of the Select Committee for his question and congratulate him on a very interesting report, which showed that real progress had been made—£250 million lost in forgone revenue down to £70 million, which is a major improvement. He makes a very good point about marking. There is an HMRC strategy and there is also a memorandum of understanding that has been signed with the Irish Revenue Commissioners. We keep in close touch on this matter.

Commons ChamberIn a recent report, the Northern Ireland Affairs Committee highlighted the importance of the work of the Organised Crime Task Force in the fight against fuel and tobacco smuggling, and laundering and counterfeiting. Will the Secretary of State assure the House that the National Crime Agency will play a similar role in the Organised Crime Task Force to that played by the Serious Organised Crime Agency?
I am grateful to my hon. Friend and his Committee for their interesting report, which showed significant progress in bearing down on fuel smuggling. I absolutely reassure him that the intention of the National Crime Agency is to work on the success of SOCA and beef it up, and to bear down on many such crimes, which have an international nature.

Commons ChamberI can reassure the right hon. Gentleman on that. As Secretary of State, I have the right to call a poll when I feel like it; I have an obligation to call a poll when there is a clear indication that there would be a vote for a united Ireland. Given that only 17.4% were in favour of that option, and the fact that I have received hardly any phone calls, e-mails or letters on the issue, I have no intention of calling a poll at the moment. We should concentrate on the economy and on building a shared future; that is the real priority for the people in Northern Ireland.
In addition to what my right hon. Friend the Secretary of State has said about the economy and the many great advantages to all parts of the United Kingdom of being part of the Union, will he confirm that the present level of public expenditure in Northern Ireland could not be sustained under any other constitutional arrangements, regardless of the destination of the Province?
The Chairman of the Select Committee makes a telling point. Public spending per head in Northern Ireland is currently £10,706, which is about 25% higher than it is in England. That is a huge advantage for Northern Ireland. It gives us time to rebalance the economy as well as showing the key role that membership of the UK plays for the people in Northern Ireland.

Gentleman is asking me to stray into areas that are not my responsibility, but I pay tribute to him and his friends on the Northern Ireland Affairs Committee, who rapidly produced a report making a convincing case for the change. I would like to put on the record that it was a team effort. My right hon. Friend the Minister of State worked closely with the hon. Member for East Antrim (Sammy Wilson) and with the Minister for Enterprise, Trade and Investment, Arlene Foster. The key person was the Chancellor, who saw the need for the change following his visit, took a real personal interest and pushed it through.
I thank the Secretary of State, and indeed the Chancellor of the Exchequer, for taking swift and timely action on air passenger duty in Northern Ireland. When will the Secretary of State consider giving the Northern Ireland Assembly the power to set the level of corporation tax?
I am grateful to my hon. Friend for leading the Northern Ireland Affairs Committee and for getting the report through. I announced two weeks ago that a ministerial working group would be set up, chaired by my hon. Friend the Exchequer Secretary to the Treasury, and it hopes to meet in early November.

Commons ChamberLet me begin by congratulating the hon. Member for Gedling (Vernon Coaker) on his appointment to a difficult and important position. I warmly welcome his view that we should approach Northern Ireland issues in a bipartisan manner. He is sitting next to the right hon. Member for Neath (Mr Hain). The right hon. Gentleman, the right hon. Member for Torfaen (Paul Murphy) and the right hon. Member for St Helens South and Whiston (Mr Woodward)—who are also present—all played a distinguished part in bringing Northern Ireland to where it is now, continuing work which, in fairness, began under Sir John Major, whose role is often forgotten. I very much hope that we shall continue to work closely with one another. We met privately on Monday, and we have talked today. My door is always open, and I hope that we shall discuss these matters together.
The hon. Gentleman asked about the chronology. I wrote to the Finucane family within weeks—on 28 June last year—asking to meet them. I met Mrs Finucane in November last year, and I think I was the first Secretary of State to meet her since the right hon. Member for Neath met her in 2006. I said then that we had inherited an impasse. We entirely respected the position of the Labour Government, who had committed themselves to a public inquiry, but the right hon. Member for Torfaen had introduced the Inquiries Act 2005, and there appeared to be a jam. We wanted to unlock that jam, and we went into the process in a genuinely open-minded way.
On 11 November last year I issued a written ministerial statement, which the hon. Gentleman will have read, setting out various criteria against which we would make a judgment and inviting representations. It was a very open process, and we took representations. We were still in discussion with the family at the end of the two months, and we extended the period for a further two months. Until yesterday, I last saw Mrs Finucane in Washington on St Patrick’s day. I gave her an assurance that we wanted to come to a conclusion and resolve the impasse, but we could not do so during the Assembly election period. I promised that that would happen soon after.
It has taken longer, however. This has not been an easy issue to resolve, but what we have done is incredibly bold. We believe that by inviting the family to Downing street so that the Prime Minister can make an apology in person, we have moved the whole argument on.
The original justification for a public inquiry was, bluntly, to put the British Government on the spot and to prove that collusion had happened. We have accepted Stevens and Cory, and by making this bold apology—the Prime Minister made it in a full and frank manner, and I have repeated it today on the Floor of the House—we believe we have created an opportunity to move the argument on.
The question now is how do we get to the truth. That was clearly stated towards the end of today’s Prime Minister’s questions. As we have made clear in the build-up to this statement, we firmly believe that costly open-ended inquiries are not necessarily the best way to get to the truth. Speed is also an issue. Past inquiries have taken a long time. The hon. Member for Gedling mentioned Smithwick. That offers a classic example of the trouble we can get into with an inquiry. It had to be extended. The new Government tried to get an interim report in June and to limit the process to November, but it looks as though they will have to extend that.
What we have done is radical and bold. We have made a full apology, and we now have an opportunity to put in place a new process. There are 1 million documents and there will be more than 9,000 witness statements. That is where the truth lies, and we want to get the truth out. I hope that, on reflection, the hon. Gentleman will come round to agreeing that our approach is novel, bold and brave. It will cost approximately £1.5 million. The main offices will be in London, but obviously that is up to Sir Desmond, and he will certainly be visiting Belfast.
I met Sir Desmond this morning. I have appointed him, and his letter of appointment will be in the Library. He is very keen to get going and to meet the family. How he relates to the family and others is entirely up to him. He can invite people to attend. He does not have the power to demand that witnesses attend, but he will have powers—real powers, I hope—to get access to a huge archive of data. That is where the truth lies—we know the truth is in there—and we now all have an interest in getting to the truth.
The hon. Gentleman also asked about the past. As he knows, that is, sadly, a fraught issue. The Minister of State and I have been holding talks since we came into office last June; we have talked to all the political parties and to numerous interest groups. I know about the debate in the Assembly this week. Sadly, as the hon. Gentleman will find out when he goes there on Thursday, there is no consensus on the past. He mentioned the Historical Enquiries Team, which is looking into 3,268 deaths. We are very supportive of it and have always supported it, and we know that it is giving extraordinarily high levels of satisfaction to the families who have so far received reports, but oversight of it is a devolved responsibility, so the hon. Gentleman should discuss funding issues with the Northern Ireland Justice Minister, David Ford.
The Government in Westminster do not own the past. The solution to the past lies very much in the hands of local politicians. We will help to facilitate things, however. I will continue our talks and I will make further statements on our approach soon.
I thank the Secretary of State for providing me with early sight of the statement, and I agree with him that accepting that there was collusion is not in itself enough, and that we need to get to the truth of who did what. If that is established, will he confirm that any necessary prosecutions will go ahead? Although it is totally right that we praise the quality of the people who served in the security forces in the past and the outstanding way in which they carry out their work now, we must find out the truth in order to protect the image of those people, who deservedly have a high reputation.
I do not believe that it was necessary to spend so much money on past inquiries. It was the Prime Minister’s response to the Saville inquiry that satisfied people in Northern Ireland. Since then, we have had inquiries that were, perhaps, expensive and that did not reach the truth. I therefore support the Secretary of State’s decision and agree that what is important is not how we get to the truth, but actually getting to the truth.
I am grateful to the Select Committee Chairman for his support for what we propose to do. Decisions on prosecutions are entirely in the hands of the local Director of Public Prosecutions, so if this review reveals information that justifies the DPP taking action, that is entirely down to him. As I am sure the Chairman knows, on seeing the Stevens papers the previous DPP found that not enough cases met the threshold requirements. I entirely endorse the Chairman’s comments on getting to the truth so that we can honour the vast majority of those who worked in the security forces, bravely defending law and order and democracy. That is exactly what we want to do. There is no offence of collusion, so we need to get to the detail, and I am confident Sir Desmond will do so.

Commons ChamberI just quoted from the IMC report showing that these problems will not be resolved by one simple solution. They have to be resolved on the ground by working with local people at the closest level. That means down to community groups and local politicians. It is not for us to lay down the law from Westminster. That is now in local hands.
Will the Secretary of State give us some guidance on the extent to which the police and his office are getting co-operation from all communities in identifying those responsible for the ongoing terrorist activities on both sides of the divide?
I am grateful to the Chairman of the Northern Ireland Affairs Committee. The police are conducting a review and a serious investigation into the disturbances last week, and it would be wrong to pre-empt what they discover. However, once we have the information from the police, we will make further decisions.

Commons ChamberI have to say that I regret the shadow Secretary of State’s tone. I made it quite clear in my statement that there were criticisms of state agencies, and on his basic question—if there was a question—of why Mrs Nelson was not protected, I made it quite clear that there were analyses of her security status by the RUC and she was twice deemed not to be at risk. However, the key point is that she did not ask for protection.
It is not for me, who read the report overnight, or the right hon. Gentleman, who has had a shorter time than I had to read it, to second-guess this enormous work. What comes out quite clearly from this very lengthy report is that there were omissions, and that if they had not happened, the risk to Mrs Nelson would have been reduced. However, the report is quite clear that, sadly:
“There is nothing that any organisation can do that will infallibly prevent a murder. What can be reasonably looked for is a reduction in the risk.”
It is the fact that we did not reduce the risk—his Government was in charge at the time—for which I have apologised on behalf of the British state.
May I thank the Secretary of State for advance sight of the report and his statement? Does he agree that anybody who has had the privilege of meeting the excellent police officers who protect people in Northern Ireland against vicious terrorist attacks will know that they are the most professional and dedicated people anybody could ever wish to see?
With regard to the criticisms of the RUC, is the Secretary of State now satisfied as far as he can be that measures are in place for anybody who might be perceived to be in danger in Northern Ireland, given the worrying terrorist threat that still exists?
I am very grateful to the Chairman of the Northern Ireland Affairs Committee for the tone of his question. As the report makes quite clear, all the main agencies have now been changed. We are confident that the home protection scheme offers a completely different type of protection from that described in the report.

Commons ChamberMay I also pay tribute to David Cairns on behalf of the Select Committee on Northern Ireland Affairs? I had the honour of working with him on a number of Committees and always found him to be extremely efficient and courteous.
All Members will recall the show of paramilitary strength by men in balaclavas over the Easter period, which brings shame to Northern Ireland. Will the Secretary of State give an update on what is being done to pursue those who obviously have common cause with those who were threatening violence?
I thank the Chairman of the Select Committee for his remarks. As he will have seen over the weekend, the police investigation into those shocking scenes at Easter took its course, and in one case charges were laid against Marian McGlinchey. I took the decision to revoke her licence as she was charged under the Terrorism Act 2000. I spoke to the chief constable this morning. The police investigations continue, and I am confident that the PSNI will bring further charges when there is sufficient evidence.

Commons ChamberMay I thank the Secretary of State for the advance copy of his statement, and on behalf of the Northern Ireland Affairs Committee join him in condemning this evil and cowardly murder? I do not believe that those people have any legitimate political aims, but, if they do, is it not worth drawing a parallel and reminding them that a murderous campaign by the IRA made any change in the jurisdiction and constitutional position of Northern Ireland less, rather than more, likely?
I am grateful to the Chairman of the Select Committee for his comments and for the Committee’s support on this issue. We are quite clear that there are now mechanisms for everyone in Northern Ireland to pursue their legitimate political ambitions by peaceful, democratic means. There is absolutely no excuse, and no place for violence that is in theory for a political cause.

Commons ChamberCan the Secretary of State confirm that, if the situation were, regrettably, to get worse in Northern Ireland, either immediately or over the course of the next few years, those extra resources would come from the UK Government, rather than from the money already allocated to Northern Ireland?
We are absolutely clear about that. It was part of the settlement made by the previous Government that, should there be a deterioration in the security position in Northern Ireland, the Government of the United Kingdom would be prepared to accept a bid, on security grounds, for resources from the contingency reserve. I repeat that emphatically today. I said that to the Justice Minister when I spoke to him this morning.

Commons ChamberWe have been absolutely clear that we will stand by Northern Ireland. We will do what is necessary to bear down on that threat, but the first port of call is for the Justice Minister and the Chief Constable to negotiate with the Executive on the very substantial allocation of public money that has been granted to them in the spending round.
The Select Committee on Northern Ireland met the assistant commissioner of the Garda two days ago, and he assured us that in spite of the financial difficulties in Ireland they would continue to police the border, in particular, in the same way. He said that there would be absolutely no reduction in their efforts. Can the Secretary of State give us the same assurance today?
Emphatically yes. We have exceptional co-operation with the Garda, and I should like to congratulate them on their seizure of a significant amount of armaments at Dunleer woods in County Louth. Emphatically yes: we will work extremely closely with them and match their effort.

Commons ChamberI also pay tribute to the work of the shadow Secretary of State when he was in office, and I particularly thank the shadow Minister of State for the very courteous way in which he treated me while I shadowed him for a number of years.
Given the pressures of historical inquiries and the inevitable budgetary pressures that all public sector workers and departments are facing, is the right hon. Gentleman satisfied that the PSNI has adequate resources to counter the threats we face—not only from dissident republicans, but from any terrorists in Northern Ireland?
I am grateful for the comments of the Chairman of the Select Committee. We will stand by Northern Ireland, and we will do what is right. As for police numbers, we know that there could always be more—there is not a chief constable in the United Kingdom who would not like more—but I am in regular contact with the local Justice Minister, the Chief Constable and those who are bearing down on dissidents, and we will ensure that we do the right thing by Northern Ireland.

Commons ChamberI thank the shadow Secretary of State for his opening comments. He asked a number of questions. First, on the lessons for prisons, he played a huge part in ensuring that prisons were devolved. It is not for me to make judgments today about the comments in the tribunal’s report. I have a meeting with the devolved Minister, David Ford, on Monday, and I will go through those recommendations with him. The same applies to the right hon. Gentleman’s questions about Maghaberry. There are 70 separated prisoners in Maghaberry at the moment, which is an enormous contrast with the concentration of 500 prisoners in the Maze in 1997. Again, however, if there are lessons to be drawn from today’s report, they are to be drawn by the devolved Minister and those who work under him, and then put into practice.
On collusion, the right hon. Gentleman quite rightly pointed out that there is a contrast between Judge Cory’s definition, which ran to 765 words, and the shorter version, which Lord MacLean came up with. For the benefit of the House, let me read the concise definition of collusion that Lord MacLean came up with in the report:
“For our part we consider that the essence of collusion is an agreement or arrangement between individuals or organisations, including government departments, to achieve an unlawful or improper purpose. The purpose may also be fraudulent or underhand”.
That is a good distillation of what Judge Cory was aiming at. We have to take the definition given by the tribunal in the report, and the report was quite clear: there was no collusion in this case.
The right hon. Gentleman asked about the Finucane case. As with the last time he raised the issue, I have written to the Finucane family. He wrestled with the problem when he was in office, and although I am fully aware of the difficulties and sensitivities associated with the case, it is right that I talk to the family first, before deciding how we proceed further.
The right hon. Gentleman then talked about the past. He quite rightly contrasted the £30 million spent on the one death that we are discussing today and the £34 million that was the original budget, over six years, for the HET, which is looking into 3,268 deaths. My view is that this asymmetrical approach to the past, with an extraordinary intensity of effort put into a small number of cases, is not fair and is invidious. I hope that we will get the same reaction today that we had to Saville—that it was an effort well spent—but for the future, as the right hon. Gentleman knows, there is no consensus on how we handle the past.
The right hon. Gentleman called for submissions reacting to the Eames-Bradley report, which he received in October and which, in fairness to us, we published in the summer. I am listening to parties in this House across the board, and the Minister of State and I are going round Northern Ireland talking to numerous people and groups. Sadly, however, as he saw from those replies to Eames-Bradley, there is just no consensus. It is not for us, as the Westminster Government, to impose one; rather, it is our task to try to find a way forward in close collaboration with local politicians and local groups. That is how we intend to approach the past.
I, too, thank the Secretary of State for advance sight of his statement and the report. While acknowledging the mistakes that have been made—mistakes that are highlighted in the report—I join him in paying tribute to the many prison officers who have worked against a background that has not been seen on the mainland or in many other countries. Indeed, 29 prison officers lost their lives—28 of them outside the prison, which shows the danger that they faced as they went about their work.
Does the Secretary of State agree that this report, and the Saville report on Bloody Sunday, highlight the waste involved in the years of the troubles, and the waste that terrorism brings in terms of lost lives and wasted opportunities? Does the report not point to the fact that the way forward for Northern Ireland must surely be through peace and democracy?
It is difficult to bring closure when there have been so many deaths in Northern Ireland, but relatives involved with Bloody Sunday, and now those involved with the Billy Wright report, have received some form of closure. There are, however, many crimes, including Omagh, that have not been properly investigated or been the subject of such a report. Will the Secretary of State tell us what he intends to do about that?
I thank the Chairman of the Northern Ireland Affairs Committee for his comments, and commend the Committee for the work that it does for Northern Ireland. He is absolutely right to say that the more we go into the details of these cases, the more apparent the traumatic waste of the troubles becomes. We would like to work with him and his Committee as we seek a way forward on handling the past.
On the question of Omagh, I shall be having a meeting with the relatives affected by that appalling atrocity reasonably soon. As I said earlier, it is our intention to talk to as many people as we can over the coming months, to see whether we can find a means of handling the past that attracts broad support.
