Commons ChamberI would just highlight to the hon. Gentleman that the railways are carrying significantly more passengers. On his privatisation point, privatisation has turned around our railways: after decades of decline under British Rail, we have seen passenger numbers grow from 750 million to 1.7 billion. We have one of the most intensively used, fastest growing and safest railways in Europe. Privatisation is the answer.
The Department is investing up to £780 million to upgrade the east coast main line from 2019. The works are to be completed in the early 2020s and will enable faster, more frequent journeys with more seats. Building upon those works, the east coast main line route study has identified a broad range of investment choices. We are working closely with Transport for the North, Network Rail and High Speed 2 Ltd to assess which enhancements should be taken forward.
In 1990, British Rail ran an express train from King’s Cross to Edinburgh with track cleared of other traffic in 3 hours and 30 minutes, including a two-minute stop at Newcastle. This was less time than planned for HS2, and with some additional four-tracking and two rail flyovers, the east coast main line could run regular 140 mph services in such times, and with the existing stock. Will Ministers look positively at such investment, as first proposed long ago by British Rail?
The key point to make is that we are carrying significantly more passengers on the east coast main line, and this investment will enable it to deliver faster and more frequent journeys with more seats between London and Edinburgh.

Commons ChamberWell, of course, a number of the Scottish ports are trust ports. I have been to the port in Montrose. I am very keen to see ports like that expand and I am working with a local Member of Parliament—a fantastic new Conservative Member of Parliament—to ensure that we provide the support and the opportunities for such ports to grow and develop.
Information on trends in infrastructure costs on the railways are published by the Office of Road and Rail in its UK rail industry financial report, which is found on its website. Spending by Network Rail was £7.3 billion in 2016-17, an increase of half a billion pounds, or 7% in real terms, on the previous year.
Since rail privatisation, the costs of rail infrastructure works have gone through the roof, multiplying several times. The Minister may have seen a recently published analysis showing that electrification, for example, now costs seven times more in real terms—stripping out inflation—than when British Rail electrified the east coast main line. Is it not obvious that we should not only nationalise train operations, but rebuild publicly owned in-house works capacity and save billions for the public purse and for passengers?
I remind the hon. Gentleman that Network Rail is responsible for most railway infrastructure work in this country and it is, of course, in the public sector. He rightly highlights the need for Government to ensure that they get the greatest possible efficiency and value for money from all our infrastructure investments. That is why we have set up a mechanism to benchmark costs across the industry in the most rigorous way possible so that we get full value for money from the record sums that we are investing in our railways— £48 billion over the next five-year period.

Commons ChamberI do not believe that a third runway at Heathrow is necessary or desirable, for all the reasons that have been set out so powerfully by other Members. I shall certainly vote against Heathrow expansion tonight. I entered the Chamber totally opposed to it, and what I have heard has convinced me that it is an absolute and total nonsense,
I do not wish to be wholly negative about the need for airport capacity, especially to serve the capital and the south-east. I have one major and specific alternative proposal to advance, which is serious, sensible and practicable. Let me say first, however, that it is clear that maximum use must be made of existing airport capacity in and around London. Indeed, that was been emphasised in at least one Government policy statement, although another that was published at about the same time mysteriously missed out the reference.
This capacity will, of course, include London Luton airport, whose passenger numbers are rapidly increasing, and where substantial investment is happening now to cope with future demand. Luton airport is a major part of our local economy, and a booming success story. With new parallel taxiways and the coming generation of composite-bodied aircraft, our airport will able to accommodate long-haul flights and millions more passengers. My primary concern today, however, is to propose an expansion of airport capacity to serve not just London and the south-east, but the midlands and beyond.
Very simply, my proposal is to link Birmingham airport to central London with a direct fast electrified rail link. The Great Western line linking Birmingham Snow Hill to Marylebone and Paddington should be electrified, and should include the rail link from Leamington Spa to Birmingham airport. With some modest upgrading and the restoration of a few miles of four tracks on the line and a direct link to Crossrail at the southern end, rapid direct services to and from central London will be possible. Indeed, that could also provide for a rapid rail service between Heathrow and Birmingham, again using Crossrail, in a hub-satellite relationship. That would be useful for Members, who would be able to take the Jubilee line from Westminster to Bond Street and then immediately get on to a train which would take them straight into the heart of Birmingham airport. The airport has a long runway to accommodate large, long-haul aircraft on intercontinental flights, and has at least 50% spare capacity.
Notwithstanding his vision for Birmingham, does my hon. Friend recognise that, according to official Government figures, there will be 40,000 fewer international point-to-point flights from Birmingham in 2040 if Heathrow expansion goes ahead?

There is massive extra capacity at Birmingham, and that seems likely to expand in the future. There is a railway station actually in the airport, linked via Leamington Spa to the main Great Western line. It is not a remote parkway station, but can provide direct rail travel right into the airport, much as happens at Gatwick. With 125-mph electrified trains, non-stop on the main route, journeys would take less than an hour from central London, and would be convenient and easy with no train changes required.
I have consulted, and have been advised by, experienced railway engineers who, like me, are convinced that this scheme would be perfectly practicable and inexpensive to build. I have also discussed the scheme with Paul Kehoe, who was recently chief executive of Birmingham airport, and is an old friend who was formerly airport director at Luton. He, too, considers the scheme to be eminently feasible and perfectly practicable. Many Members rightly believe that we should seek to develop our regional economy economies, with more emphasis on regional airports. I believe that developing Birmingham airport will meet that challenge too, while also making a potentially massive contribution to south-east aviation needs.
I urge Ministers to give serious consideration to what I propose, and to think again about Heathrow expansion.

Commons ChamberMy hon. Friend is absolutely right. The real frustration is that this is a consequence of major investment programmes and the delivery at the end of those programmes has gone wrong. The thing I find most frustrating about all this, and I absolutely feel for every single passenger who has waited for a cancelled train in the past week—I get the train every day, and I am as fed up with this as everyone else—is that this is the consequence of a change that resulted from a massive investment programme in the railways. We should now be seeing the fruit of that investment programme. We are not yet seeing it, and we have to make sure that we see it pretty quickly.
I have thousands of constituents who commute daily from Leagrave and Luton stations and who are suffering from recent service failures—I have a sheaf of their complaints in my hand. Is it not the reality that GTR has consistently sought to squeeze more passengers on to too few trains and has employed insufficient drivers in the interest of profits, at the expense of passengers? When are the Government going to accept the grotesque failure of private franchising?
I absolutely understand the pressures on the hon. Gentleman’s line. Part of the objective of this upgrade is to deliver longer trains and more trains, and it is a huge frustration to me that that has not happened. We have to make sure it happens as quickly as possible.

Commons ChamberWhen I am ready to update the House, I will of course come back to do so in person. The Committee recommended that the Government progress with their work, and it made a number of very helpful and constructive suggestions about elements to be included within that work. I remain absolutely of the view that airport expansion is necessary for the economy of this country. The important thing is that we deliver it in the best possible way for local communities.
May I suggest to the Secretary of State that a much cheaper and more practicable alternative to the Heathrow third runway would be to use the considerable spare capacity and long runway at Birmingham airport by electrifying and upgrading the Chiltern railway line and linking it to Crossrail? This would provide for a fast, direct, non-stop shuttle service between central London and Birmingham airport and would help to solve the south-east airport capacity problem. Will he give serious consideration to this proposal?
Of course the arrival of HS2, with projected future growth in passenger numbers at our airports, will provide an alternative and will provide for a bit of competition between airports, which is no bad thing. The hon. Gentleman is right about that, but I do not think it is either one or the other.

Commons ChamberThe issue remains twofold. The Mayor of London’s business plan for the Southeastern franchise provided virtually no new investment at all. There was a handful of extra services on the Nunhead line, and the rest of it was on a wing and a prayer. I think that the new franchise document specifying improvements for passengers will deliver, not just in London but across the whole of the Kent and south-eastern area, because this is not a London franchise.
May I remind the Secretary of State of a previous experience with public-private partnership on the railways—namely that in the London underground? It was forced on the Mayor of London and Transport for London, who resisted it very strongly. The scheme collapsed in disorder, very expensively. Tube Lines and Metronet—the two private companies involved—stuffed their pockets with money before it collapsed back into the public sector. Is that not going to happen again with this scheme?
I remind the hon. Gentleman that that problem happened when Labour was in power, which proves that they are not good at setting up contracting arrangements.

Commons ChamberThe Civil Aviation Authority is making all preparations necessary if it needs to return to operating as a body in the form that it used to be in. However, it is the Government’s policy and our intent to remain part of EASA. There is no reason not to: countries inside and outside the European Union are part of it, and we supply a substantial proportion of its expertise. The leadership of EASA wants us to stay, and I am confident that, as we get through the process of negotiation, that is where we will end up.
In September 2016, the Government published a rail freight strategy setting out a vision for how the freight industry can grow. During control period 5, the Department is investing £235 million to improve the capacity of the network. Further funding for investment in the network will be available in control period 6.
I thank the Minister for his answer, but is the reality not that only a small proportion of freight in Britain is carried by rail, and that it has been declining? By contrast, a third of all freight in Germany is transported by rail, and in the US the figure is 50%. To achieve a substantial modal shift in freight from road to rail, is it not essential to introduce a much bigger programme—a major programme—of investment in rail freight capacity starting very soon?
We share the hon. Gentleman’s ambition to support modal shift. The Government are always interested in hearing about ambitious schemes that would encourage that. As he will know, we recently launched a call for ideas for market-led proposals that will enhance the railway, and I encourage him to take part in that.

Commons ChamberI do not propose to speak for quite as long as my hon. Friend the Member for Gillingham and Rainham (Rehman Chishti) but, of course, he has worked very hard on this issue through his private Member’s Bill, so I will whistle through my comments, many of which have been made already.
The Bill rightly covers all modes of transport, but I will confine my comments to aircraft. I spent much of my working life in aircraft engineering. I joined the Royal Air Force before moving to British Airways, where I spent more than 25 years in the industry. My hon. Friend the Member for Scarborough and Whitby (Mr Goodwill) talked about people who have an irrational fear of flying and, although I have 25 years in the industry and have flown hundreds of times as an engineer, I am somewhat frightened of flying, too. I have spent far too long thinking about what could go wrong when I am in the air.
I am most interested in the hon. Gentleman’s concern about flying. I enjoy flying but my wife will not fly, so I do understand. The hon. Member for Scarborough and Whitby (Mr Goodwill) talked about the danger per mile flown. If it were the danger per hour flown, I suspect the figures for motor travel and for flying might be a bit closer.
The hon. Gentleman might be right. I did some research on the likelihood of having an accident in an aeroplane, which is why I know that my fear is irrational. Taking probability out of it, a person would have to fly every day for 15,000 years to guarantee themselves on accident. I know that, but it does not stop my thinking about it when I hit a bit of turbulence or when I come in to land.
The first commercial flight was more than 100 years ago and, of course, this year we celebrate 100 years of the Royal Air Force. Across the world, aircraft have clocked up millions of flying hours, and lessons are constantly learned to ensure that our aircraft are as safe as possible. The last thing we need is people on the ground making what can sometimes be a dangerous form of travel even more dangerous than it needs to be.
I am not a pilot, but I know that aircraft are at their most vulnerable during take-off and landing, with by far the majority of incidents occurring during final descent and landing, so it will come as no surprise that the majority of fatalities in aircraft also happen at that time.
There is an airport on the edge of my constituency and an approach flightpath over residential areas and a school in my constituency, so this Bill is particularly relevant and important to my constituents. Aviation accidents are extremely rare and, as I have said, a person would have to fly every day for 15,000 years to guarantee themselves a crash, and we need to make sure we keep it that way. A recent report published by Boeing revealed that 48% of incidents that resulted in a fatality happened during take-off or landing. It is therefore imperative that pilots are not subjected to any unnecessary distractions while trying to land an aircraft.
If someone is foolish enough to shine a laser at an aircraft, it will have the most impact when the aircraft is coming in to land, which is the worst possible time for a pilot. I am reasonably sure that most people do not give that a second thought—why would they? Most people are not stupid enough to think it is clever to shine a light at a pilot as they come in to land. But not everyone is sensible, which is why we have to legislate. I know this has been referred to two or three times, but according to the British Airline Pilots Association there are an average of three to four reported laser attacks on aircraft daily. That simply cannot be allowed to continue.
We are talking about someone shining a laser pen at an aircraft, perhaps an Airbus A380, which could carry more than 500 passengers. Let us imagine someone shining a laser pen towards the flight deck just as the aircraft is on its final approach—the results could be catastrophic. Laser illuminations can startle and distract, and in some circumstances may result in temporary vision interference, including flash blindness, after-image exposure and glare. I do not want to labour these points, as they have already been made, but according to the Civil Aviation Authority there has been a 70% increase in laser incidents since 2009. BAPLA surveyed its members in September 2017 and reported that 50% of pilots had experienced a laser attack in the previous 12 months, with 15% having experienced three or more.
Public Health England recommends that unqualified and untrained members of the public should not have access to lasers in excess of 1 milliwatt. However, it is easy to purchase lasers far in excess of that; a basic internet search showed that I could purchase a 200 milliwatt laser for as little as £30. The existing regulation, under the Air Navigation Order, states that a person must not “recklessly or negligently” endanger an aircraft. Evidencing and proving the endangerment of an aircraft is a difficult task for police officers, so the Bill is to be welcomed, because it will now make it an offence to “direct or shine” a laser beam that dazzles or distracts a driver, pilot or otherwise when a vehicle is “moving” or “ready to move”.
My only criticism is that this does not go far enough. Someone cannot endanger hundreds of lives on an aircraft, and potentially hundreds more on the ground, by accident. There are no mitigating circumstances. It is not a misunderstanding; this crime is premeditated, and perpetrators should be treated like the criminals they are. We know it will be difficult to catch someone in the act of endangering a vehicle, but in the event that we do and they are found guilty they will now face a maximum jail sentence of five years, an unlimited fine or both. That is to be welcomed. It is a step in the right direction. I do not think it goes far enough, but I am otherwise content with this Bill.

Commons ChamberI am very grateful to my right hon. Friend for her words. She is absolutely right. This is a sad tale of an airline that has been struggling for years. A lot of effort has been put in by many people to try to keep it afloat. It is a real disappointment that they were not able to succeed. She is absolutely right about the Brexit issue. If we want another example, it is only a few weeks since Air France and KLM spent hundreds of millions of pounds on a stake in Virgin Atlantic. Those are not the actions of commercial organisations that believe that Brexit is destroying the British aviation sector. Those who suggest it are simply talking down our country and that is not acceptable. I am therefore very grateful to her for what she says. She is absolutely right. I give her an assurance that the Government will do everything we can to support the sector, to support the people who lost out as a result of Monarch’s collapse, and to continue to ensure we have a strong sector for the future.
As the MP for Luton North, I represent many of those who have lost their jobs, and I have to say that, had the company been in public ownership—with proper transparency and accountability to Parliament—I suspect that this would not have happened. [Interruption.]
My concern is that, when the company collapsed, the assets had almost all disappeared, so there was very little financial value in the assets of the company. Was this to benefit shareholders and owners, and how much money has the state effectively paid out that the owners and shareholders should have been accountable for?
The hon. Gentleman is right that the airline did not have the assets at the end—airlines today do not own their planes but lease them. One reason it is difficult to continue to operate an airline like this is that the planes are the property of the lease companies, which take them back immediately afterwards. We clearly have to look at whether there is a better way of doing things, but it is not easy.
It would be relatively easy for an airline abroad that is owed money simply to impound an airliner and make it impossible for us to get people back, so these are not straightforward issues. But is the hon. Gentleman really suggesting that we go back to a time when the state owned everything? Do we want the state to own British Airways, easyJet, Jet2 and Thomas Cook? It is nonsense. Even the most socialist Labour Government of the past would never have suggested that the state own every holiday airline. It is a sign of how extreme its policies have become that anybody on its Benches can seriously suggest it.

Commons ChamberI would not want to test your patience, Madam Deputy Speaker, or indeed your largesse, by ranging widely across the provisions of the other aspects of the Vehicle Technology and Aviation Bill, but the hon. Gentleman is right to point out that, as I said earlier, these measures had their origin—their genesis—in that Bill. We will bring further measures to the House: the Queen’s Speech makes it clear, for example, that we will address the issues of autonomous and electric vehicles, which the hon. Gentleman debated, alongside the Opposition spokesman, the hon. Member for Middlesbrough (Andy McDonald), and others, in the Committee that I mentioned. Further measures will be presented, and—not wishing to test your generosity any further, Madam Deputy Speaker—I think I will leave it at that.
In this new Parliament, many of the measures that I described as essential will be introduced, and this ATOL reform is one of them. I hope that our debate today will match the convivial and consensual spirit of our discussions in the Bill Committee to which the hon. Member for Kilmarnock and Loudoun (Alan Brown) alluded. We made progress on both sides of that Committee, and I hope that it continues. I think it fair to say that those discussions demonstrated that there was really
“no difference of principle between the Government and the Opposition on this matter.”—[Official Report, Vehicle Technology and Aviation Public Bill Committee, 21 March 2017; c. 25.]
Those are not my words, but the words of the hon. Member for Birmingham, Northfield (Richard Burden), who also played a useful role in the Committee.
I very much agreed with the Minister’s earlier philosophical comments about the appropriateness of Government regulation in matters such as this. I am sure that many holidaymakers will feel more secure when the Bill has been passed, knowing that they will not be left stranded abroad with no means of getting back. May I ask whether the Minister has consulted closely with the airlines, particularly those that fly planes from London Luton airport with holiday packages?
I will come to that later, because the hon. Gentleman is right to draw attention to the role of the airlines in all this. As he will know, they are covered by other licensing arrangements, but I will address the specific points that he has made. As ever, he has made a case for his Luton constituents, and particularly for Luton airport, which I know is in his constituency.
The hon. Lady will know that that, too, was raised in our discussions on what was originally known as the modern transport Bill—or at least apocryphally known as such—and became the Vehicle Technology and Aviation Bill. She will also know—because of her keen interest in transport matters and her enthusiasm to take those matters further with an election, to which I will not refer more than obliquely—that we are consulting on those matters; the consultation has finished and we will bring our conclusions to the House and elsewhere very shortly. However, she is right to say—I am happy to put this on the record—that that is a matter of some concern. Existing legislation provides some protection. For example, if a drone were interfering with military aircraft or a secure site, existing legislation would cover that to some degree, but there is a case to do more, which is why we have consulted on the matter. I know that she will give the results of the consultation and our response to it her close attention, as she always does.
Let me move on; as I said, I do not want to prolong this exciting speech too much. As I said, the scheme also acts to compensate consumers who might be caught up in a failure. I have talked about the fund which is administered by the CAA to ensure that consumers are returned home, and since the 1990s the ATOL scheme has been the primary method by which the UK travel sector provides insolvency protection under the UK and Europe package travel regimes. Today the scheme protects over 20 million people each year, giving peace of mind to holidaymakers in Luton and elsewhere.
It is reported in the notes that between 1998 and 2009 the proportion of ATOL sales fell from 90% of leisure flights to just 50%. That is a substantial drop in just 11 years. Were some passengers affected by not being covered during that period?
As I said at the beginning of my remarks, the purpose of this Bill is to ensure that ATOL remains fit for purpose. The hon. Gentleman is right that the way people travel, the means by which they book their holidays, and the organisations they use to do so are changing. That is why we must look again at ATOL: not because it has not worked or because its principles are not right, but because it needs to reflect those changes. This Bill is the first step in doing so. Anticipating—although not impertinently—what the shadow Secretary of State might ask me, it is also true to say that this Bill is just that: a first step that creates a framework that will allow us to update ATOL.
Further steps will be required, which might come through regulation or further review of the appropriateness of what we are putting into place today. The hon. Gentleman raised that point when we debated these matters briefly before, and I have no doubt that he will want to press me on it again today, but there is an absolute acknowledgement that this is a rapidly moving marketplace that will require rapidity in our response.
