Ultimately, I would like the planning inspectorate to be redundant and local plans to be sufficiently robust to provide for the planning environment and, if necessary, local planning courts to determine whether there is a clear breach, but we are a little way away from that. In fact, the situation is quite the reverse: Her Majesty’s planning inspectors—I am not criticising them because they are only doing their job within the rules they have been given—are the planning authority for many of our rural areas. That cannot be right.

The hon. Gentleman has talked a good deal about the impact of housing development on rural communities and so on. Does he have the same concern about the drive for green energy, wind turbines and the targets set by Europe? Does he believe that the same consideration should be given to the impact on householders, as the hon. Member for Wycombe (Steve Baker) mentioned in his intervention, so that they may object and a balance can be struck in the countryside between the drive for green energy and the impact on people and the quality of their lives?

With the greatest respect to the hon. Gentleman, I do not want to divert this debate to energy, which is a completely different issue. I have always suggested that energy generation should be subject to the same sort of planning considerations as other industrial development. Although I am strongly supportive of renewable energy, I do not believe that it overrides all other considerations and I believe that such matters are best decided at local level. However, I do not want to derail this debate, which is about more routine planning policy.

Obviously, we try as far as possible to eliminate potential disadvantages. I cannot say that we will be successful across the board, because this is a negotiated settlement. Where possible we try to make sure that we all play to common ground rules, but with local interpretation. It is clear, for instance, that lowland dairy farming in this country is very different from growing olives on a Greek island. Different criteria apply and we want to make sure that we recognise the differences as well as the common basis.

I appreciate the Minister’s understanding of this complex issue. Many farmers who have had to leave their comfort zone and consider doing other things will also be impacted by the CAP changes, so will help be made available to those who wish to diversify?

I am grateful for that question. A lot will depend on the local determination in Northern Ireland for the options under pillar two, which provides the capacity for supporting diversification. The relevant Northern Ireland Minister will have to decide the extent to which voluntary modulation applies and whether the pillar two schemes will be devised to support diversification. The capacity is there and the decision on whether it will happen or not will be a local one.

My hon. Friend makes an important point. In those extreme conditions of very heavy snowfall, with violent winds—in Cumbria, violent easterly winds coming in off the sea and causing the drifting—the sheep did what sheep do, which is to turn their backs to the wind and walk, and they found themselves trapped against walls or obstacles or under drifts. But what compounded that was that our sheep flocks, sadly, are not in good condition—because of the weather, because of events over many months now, because of the fact that, as the hon. Member for Montgomeryshire said, fluke is a real problem at the moment. Many issues have come together in a concatenation that is causing the difficulties that many of our livestock farmers face.

It was a pleasure to have the Minister in my constituency last week so that he could hear at first hand from the farmers in the area what the issues were. He will have heard from the farmers, but also from elected representatives from the Assembly, from Members of Parliament and from Members of the European Parliament, what measures the Northern Ireland Assembly had taken to help to address some of the issues for the farmers in Northern Ireland. Will he be able to use those examples to help other regional bodies, such as the Welsh Assembly and the Scottish Parliament?

It is important that we all learn from one another. The answers will not be the same in every part of the United Kingdom, and the proportional scale of difficulties will be different. We must listen to what each other are doing and hopefully come towards the right solution, but also listen to what the farmers themselves in the constituent parts of the United Kingdom are telling us. Certainly that is what I wanted to do with regard to England. I cannot speak for what happened in Northern Ireland and say whether it was the right solution, and similarly for Wales. I can see what has been done, but it seemed to me that my responsibility was to listen to the farmers and their representatives in England, and to do what they asked me to do so far as I could, in order to mitigate the difficulties that farmers were facing.

Backstreet puppy farms are a problem in the entire United Kingdom. As a Northern Ireland MP, I am also aware of such farms in the Republic of Ireland, with puppies coming through Northern Ireland to the UK and going directly from the Republic of Ireland to the UK mainland. Has the Minister had any discussions about this problem with the Government in the Republic of Ireland, so that the United Kingdom of Great Britain and Northern Ireland together with the Republic of Ireland can address it?

The beef, lamb and pork sourced in the United Kingdom follows a strict traceability system. Farmers in the United Kingdom have experienced a marked decrease in their incomes over the past 12 months. Can the Minister confirm that costs accrued as a result of the horsemeat scandal will not be passed on to farmers or farming organisations?

I hope that no costs will be directly apportioned to farmers, but the hon. Gentleman makes a serious point about the assurance schemes we have in this country, and not only those relating to the traceability of our meat, but the various assurances placed on top of that through schemes. I think that we have every reason to be proud of the quality of meat in this country, particularly cut meat, some of which is the best in the world. Of course, farmers in his part of the country play a leading role in providing that quality meat.

I can certainly confirm that. The 2006 Act provides a duty of care to animals, which includes welfare provisions. We will rigorously enforce those measures to ensure that the welfare of farmed animals is maintained.

One of the greatest problems for dairy farmers is the retention and disposal of slurry, especially in poor weather conditions. What steps is the Minister taking to help to ensure that farmers can dispose of slurry in the poor conditions we face.

Members are being very inventive in their use of questions today. This is a real issue: many of us find it frustrating that slurry disposal is dictated by date rather than good husbandry practice. As the hon. Gentleman may know, I have extended the period for spreading slurry in England to the greatest extent I can within the regulations. I cannot do more than that, but we are working with the industry to find the best possible ways of helping farmers to dispose of slurry, which they cannot currently spread on wet fields.

The hon. Gentleman chairs the Science and Technology Committee, which I know will want to look at this issue in more detail. I invite it, however, to look at the totality of spend in this area, not all of which goes through the Forestry Commission—there are other heads. I hope that the hon. Gentleman will look at that spend, as I am sure he will, and come to an objective view about how much is being spent on this important matter.

On Friday 26 October, the consultation, which I mentioned, closed. It demonstrated overwhelming support for import and movement restrictions, and on Monday 29 October, my right hon. Friend the Secretary of State announced a ban on the movement of ash from anywhere that is not a designated pest-free area—I should point out that nowhere is labelled a designated pest-free area. There is now a criminal offence, carrying a maximum fine of £5,000.

On 24 October—during the consultation period—Chalara was confirmed in the wider environment in East Anglia. The trees had no apparent connections to nurseries. Since that finding, the Government have taken action on an unprecedented scale to tackle the problem. At the beginning of November, we initiated a rapid survey of the whole of Great Britain. More than 500 people worked around the clock to survey 2,500 10 km squares for signs of disease. That massive undertaking was completed by 7 November, and gave us an initial picture of the distribution of ash dieback caused by Chalara. We have also received valuable intelligence from organisations including the Country Land and Business Association and the Woodland Trust, which has mobilised its members to look for signs of the disease.

The Northern Ireland Assembly has adopted additional safeguards to ensure that there is no infiltration of ash plants. It has adopted a “Fortress Northern Ireland” approach—in other words, nothing gets in and nothing gets out. Perhaps that has happened in the past, but even with those strict rules and legislation, there is an outbreak in Leitrim in the Republic of Ireland. Will the Minister confirm and assure the House that every step is being taken to stop ash dieback in the whole of the United Kingdom of Great Britain and Northern Ireland, and that there is direct consultation with the Northern Ireland Assembly, the Scottish Parliament and the Welsh Assembly?

I can indeed confirm that. Ministers or officials from all three Administrations have been involved in every one of our consultation meetings on the subject. We want to ensure that they have access to all the information we have, and that we have all the information they have. I ought to mention that we have been working closely with the Government of the Republic of Ireland, because we obviously need to co-ordinate our efforts to ensure that we understand how to treat cases, and particularly those in the wider environment, and how to preserve as far as possible the whole of the British Isles as a disease-resistant or disease-free area.

I congratulate the hon. Member for Strangford (Jim Shannon) not only on securing this debate on an important subject but on the admirably balanced way in which he presented information to the House. I am glad that he finished by stressing the importance of country sports, particularly shooting, to the economy and the conservation of our landscape. He said that he was a regular shooter, and he is not alone. He is one of 480,000 people who regularly shoot live quarry. I am just glad that I do not appear to be his quarry today: I think his targets are elsewhere.

The hon. Gentleman is absolutely right to stress that this is a complex issue—it is not a question of black and white. He is concerned to make sure that health and safety and wildlife issues are paramount, just as he is keen to make sure that the opportunities for sport and relaxation persist both in his part of the country and across the country. There are lots of interrelated interests that we have to balance.

I shall try to deal with some of the points made by the hon. Gentleman. He mentioned in particular the recent report by the Food Standards Agency. I am grateful to the hon. Member for Carmarthen West and South Pembrokeshire (Simon Hart) for his intervention, which highlighted the point that the hon. Gentleman was making. Let us be clear: lead is not a terribly good food additive. It is a dangerous substance; it is toxic. We do not want people to eat it. I remember something from my own history. As you will know, Mr Deputy Speaker, Somerset is known for drinking cider, and a study undertaken many decades ago discovered that the practice of making cider, which is acidic, in vats lined with lead, was probably not the best way to secure the public health of the county of Somerset. Eventually, we stopped using lead lining for the vats—historically, lead had been used for that purpose—and our public health improved as a consequence.

It is important that the Food Standards Agency does its work and highlights any concerns that it may have. People who are very high consumers of game birds, if such people exist, should be aware that they may be exposed to a risk. However, we should stress that people would have to eat an awful lot of pheasant or duck on a daily basis to get near the dangerous level. It is important that we stress that it is not dangerous to consume lead shot game occasionally, which is what most people would do, despite the hon. Gentleman’s exhortations to eat wildfowl more frequently, especially wildfowl that he personally has shot. For most of us, wildfowl is a limited part of our diet.

Reducing lead exposure remains a high priority for the Government. We, like successive Governments, want to reduce exposure to lead wherever possible, for both humans and wildlife. That is why I am keen, as is the hon. Gentleman, to wait for John Swift and his team in the Lead Ammunition Group to report in spring 2013. They have been looking at the key risks to wildlife from lead ammunition and the levels of those risks, and they intend to explore possible solutions if those risks prove to be significant. They will also report on the options for managing the risk to human health from the increased exposure to lead as a result of using lead ammunition, if measures need to be taken. I am confident that the group will take a balanced and measured view on the basis of evidence. That is why I am looking forward to that report. I think the hon. Gentleman shares that view and is concerned that there may have been early misrepresentations of what is likely to emerge.

The hon. Gentleman titled his debate “The EU directive on lead shot”. May I reassure him that the Government are not aware of any proposals for an EU directive on lead shot? Should one be forthcoming, of course we will look carefully at any proposal to ban lead shot. We will carefully assess whether there is clear evidence of a genuine risk and, if there is, whether any proposal to control the risk is appropriate and proportionate. Again, I will look to the Lead Ammunition Group’s report to inform our position. I repeat that there is no immediate prospect of an EU directive on lead shot. There are various activities within the European Union that are relevant to lead, but not in the form that the hon. Gentleman is concerned about. There may be some misunderstanding about that.

The concerns that we have are about the EU’s attitude to lead in general. As parliamentarians concerned about the impact of Europe, we are worried that the EU may try to introduce regulations on that. We are greatly encouraged to hear the Minister say that that will not happen.

I believe that to be the case. There is a European regulation for the registration, evaluation, authorisation and restriction of chemicals. We know that Sweden has indicated its intention to bring forward by April next year a proposal to restrict the use of lead and lead compounds in consumer products, but that does not include lead shot within its scope. There may be an informal view that Sweden would wish to extend that, but that is not on the table at present. I hope I can reassure the hon. Gentleman, but obviously we will watch carefully and if proposals come forward, we will look at them on their merits in due course.

Let us deal with the real concerns that lead shot may harm our wildlife. We are clear that ingesting lead is probably not good for birds, animals or humans. It is important that we ensure that the right steps are taken to conserve our wild birds, particularly our water bird species. It is not yet entirely clear what risks the use of lead shot might pose for the conservation of our wild birds, but the existing restrictions on its use need to be respected, as the hon. Gentleman pointed out.

The research that the Department for Environment, Food and Rural Affairs commissioned from the Wildfowl and Wetlands Trust in 2010, to which the hon. Gentleman drew attention, highlighted some concerns about compliance with the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999. I entirely accept his point about the provenance of any lead appearing in the ducks, but the fact is that 70% of the ducks examined were found to have been shot with lead, which is a cause for concern. Even advocates of hunting game recognise that any clear evidence of non-compliance is a matter for concern. We will be looking at that carefully, but we will also take into account the points he has make, because it seems to me that some of them are balanced and valid.

I stress again what I think the hon. Gentleman was at pains to say throughout his contribution: what we need is balance. We must weigh up the arguments and the evidence, and not in isolation. We must look at matters in the round. I think that at the heart of the debate there is more that unites the various interests than divides them. We all want to see healthy wildlife, a well-managed countryside, thriving communities and a sustainable rural economy. Therefore, we need to ensure that the evidence is looked at carefully by the experts in the lead ammunition group and that we understand the risks so that we can respond in a measured and sensible way. That is why the Government will not rush to any premature conclusions. We will look at the evidence and will not move to any snap judgements. We will evaluate the results of John Swift’s report and consider the evidence it adduces and its recommendations in due course.

I can give an absolute assurance that we understand the importance of shooting, both in the rural economy and as a form of relaxation that the hon. Gentleman and many other people in the country enjoy—it is not simply an economic matter—so we will balance that with the need to protect our wildlife and ensure that its health is preserved, as is the health of the wider population. We will consider the evidence and base our judgments on what strikes us as the best balance between wildlife conservation, supporting traditional jobs and industries, enhancing sustainable economic group and, of course, doing what is best for our health.

I am grateful to the hon. Gentleman for securing the debate and for the points he raised. We will certainly take careful note of the points he raised on behalf of his constituents and of a much wider constituency across the country. This has been a most valuable debate and I am grateful to have had the opportunity to set out the Government’s case.

I congratulate the right hon. Member for Belfast North (Mr Dodds) on securing the debate and on the way that he introduced it. We are fully aware of the strong views held on all sides of the argument, but he has expressed his view on behalf of his party extremely well. I am also pleased that he has the support of his colleagues who intervened—the hon. Members for East Londonderry (Mr Campbell), for South Antrim (Dr McCrea) and for Upper Bann (David Simpson). The matter of allowances for elected Members who do not take their seats has always been controversial. I hope that the right hon. Gentleman will forgive me if I cover the same history that he mentioned in his remarks, but it is crucial to our understanding of where we are in relation to allowances.

The matter was first raised by Sinn Fein in 1997 with the then Speaker, now Baroness Boothroyd, who clearly and explicitly upheld the long-standing convention that Members who did not take their seats should not have access to the House’s facilities on the grounds that the House does not permit what she described as “associate membership.” That decision was subsequently upheld by her successor as Speaker, now Lord Martin of Springburn, following the 2001 election.

In December 2001, the House debated and agreed a motion to permit elected Members who had not taken their seats to have access to the House’s facilities, including allowances, to support them in their representative work on behalf of their constituents. On 8 February 2006, a similar decision was taken on representative money, to which the right hon. Gentleman referred and which is analogous to Short money. That resolution provides for the payment of

“expenses wholly, exclusively and necessarily incurred for the employment of staff and related support”

to parties represented by elected Members who choose not to take their seats, and by statutory requirement, political parties whose Members do not take their seats are not eligible to receive policy development grants. As the right hon. Gentleman has pointed out, Members who do not take their seats cannot have parliamentary duties; none the less, they are the elected representatives of their constituents and have representative duties in which the provision of allowances is intended to support them, on the basis that the House previously agreed.

As we are all aware, there has been a much wider debate on allowances over the past year. The Committee on Standards in Public Life recognised when it reported in November that the decisions on allowances for elected Members who did not take their seats were political, as the right hon. Gentleman pointed out. The previous Government promoted the arrangements specifically—it would appear—to support the political process in Northern Ireland and to encourage Sinn Fein to play a greater role in mainstream politics.

The right hon. Gentleman brought up the position adopted by parties in previous debates and before the general election. There are Members who have always opposed the decisions on the grounds that all MPs elected to serve at Westminster should carry out their full duties in representing their constituents, and that includes participating in the business of the House. They have always seen this as primarily a House of Commons issue and agreed with Speaker Boothroyd at the time on “associate membership” of the House. He also said that some Members have always taken the view that the matter should be subject to a free vote—that is, it is for individual Members rather than the parties.

Since the decisions were taken, circumstances in Northern Ireland have changed considerably. We have a new devolutionary settlement, which is at the heart of the peace process. Northern Ireland is now firmly set on the political path, with Sinn Fein Members playing a full role in the Assembly. Though dissident republicans continue to try to undermine those who are committed to the political process, there is no question—I hope and pray—of a return to the troubled decades of violence. As a result, it is time for us to look again at the issue. It is clear that there are real and strongly felt issues of principle under discussion.

The Belfast agreement is clear: Northern Ireland is, and will remain, part of the United Kingdom until or unless a majority of the people of Northern Ireland vote otherwise. Sinn Fein has accepted the consent principle set out in the agreement, and there is therefore no good reason why its Members should not take their seats at Westminster. Whatever arguments were made in 2001 and 2006, they were made in a different political context. Northern Ireland has moved on. The principle for the future must be that all elected Members should take their seats and play as full a role as possible as Members of the House.

The Deputy Leader of the House clearly indicated that there would be a change. I am reminded of a book that I studied at school—“Animal Farm”. It said:

“All animals are equal, but some are more equal than others.”

It is time that all the animals on the farm were equal, and Sinn Fein has to be equal to the rest of us. If we are accountable to a process as democrats, Sinn Fein is equally subject to it. Reassurance from the Deputy Leader of the House is good news, but can he give us a time scale on how this will work?

I am grateful to the hon. Gentleman for his comments. I cannot set out a clear timetable, but if he listens to what I have to say in my later comments, I hope that he will be reassured that the Government take the matter very seriously.

My right hon. Friend the Prime Minister already made his position clear, although not, I suspect, as clear as the right hon. Member for Belfast North would wish. In answering the question from the hon. Member for South Antrim on Wednesday on allowances, he stated:

“My views about this issue are on the record, and they have not changed. I would like to see if we can make the argument. There is not a case for Sinn Fein Members not to take their seats. I think that at the moment we let them off the hook, so I would like to re-examine the argument and see if we can find a new way of doing this.”—[Official Report, 23 June 2010; Vol. 512, c. 291.]

In addition to the changes in Northern Ireland, there have also been shifts in the parliamentary landscape that will need to be considered. The creation of IPSA was an essential step in cleaning up politics by bringing to an end the discredited system of self-regulation. Allowances, as my right hon. Friend the Leader of the House said, are, of course, now a matter for IPSA, not for the House. However, the right hon. Member for Belfast North is correct in what he said about IPSA’s approach; I understand that it intends to observe the status quo by continuing to pay allowances, but not salaries, to Members who do not take their seats. Last Wednesday, IPSA set out its position as follows:

“a Government motion passed through the House of Commons in 2001 established the position that MPs who do not take the oath may claim expenses related to their Parliamentary business. IPSA regards itself as obliged to follow these motions and intends to do so unless the House decides otherwise.”

A question was raised on how IPSA interprets those decisions in terms of the criteria applied to individual expenses claims. I assume and hope that IPSA will apply exactly the same criteria to a claim from a Sinn Fein Member as it would to any other Member of the House.
