(Urgent Question): To ask the Prime Minister if he will make a statement on the publication of the European Union (Withdrawal Agreement) Bill and his letter of 19 October to the European Council seeking an extension to the period provided under article 50.
Notice of the withdrawal agreement Bill was given to the House on Saturday. The Bill was handed to the House yesterday, as agreed with the House authorities. It will be introduced for First Reading at the start of the main business today. Publication of the withdrawal agreement Bill is therefore now being delayed by the Leader of the Opposition, because he has tabled this urgent question requesting publication of the withdrawal agreement Bill—genius.
The withdrawal agreement Bill could not be finalised until the European Council on Thursday 17 October, and then there followed an historic meeting of this House on Saturday 19 October. It has been introduced on the following sitting day, and, as you said a moment ago in response to a point of order, Mr Speaker, what could be sooner than the next sitting day? The sooner that this urgent question and the next urgent question are concluded, the sooner it will be available to Members.
In respect of the Prime Minister’s letter to President Tusk of 19 October, that was sent in compliance with section 1 of the Benn Act. The President of the European Council has accepted the request as valid and indicated that he is considering it and consulting member states.
I do admire the Secretary of State for keeping a straight face while he gave that answer, and I am very grateful to you for granting this urgent question, Mr Speaker.
The Prime Minister has not deigned to grace us with his presence today, but I am reassured that, despite his pledge, he is not to be found anywhere in a ditch. I welcome the fact that the Prime Minister has sent a letter over the weekend to the EU President Donald Tusk to comply with the European Union (Withdrawal) (No. 2) Act 2019. As we have come to expect with this Prime Minister, this has been done with posturing and attempts to distract, but despite having told the British public over and over again that he would never do it, the letter has in fact been sent. Not only is the request legally necessary and prevents us crashing out of the EU with no deal, but the extension allows this House the space to scrutinise the Prime Minister’s Brexit deal. I pay tribute to all those Members who have worked hard to ensure that a no-deal Brexit is ruled out, and I will continue to work across the House to ensure that this continues to be the case.
The European Commission has confirmed today that Brussels is now considering the terms of an extension. Can the Secretary of State tell the House when he expects any extension to be granted? Can he categorically rule out the absolutely ridiculous reports yesterday that Conservative MPs are trying to amend the law to jail Members of Parliament alleged to have colluded with foreign powers? Does he, like me, fear for the hon. Member for Shrewsbury and Atcham (Daniel Kawczynski), who is telling everyone who will listen that he is trying to collude with the Polish and Hungarian Governments to veto any possibility of article 50 extensions?
This type of nonsense is doing nobody any good at all. If the Prime Minister wants to get his deal through, he should bring forward the withdrawal agreement Bill for scrutiny. Will he also bring forward an economic impact assessment, which has so far not seen the light of day? And will he allow this House ample time to scrutinise what this deal means to the communities that we all represent?
I can tell the House what has been ditched—the right hon. Gentleman’s manifesto, with him moving from the commitment he gave to respect the referendum result to one that is now characterised by dither and delay. The Leader of the Opposition questions the letter from the Prime Minister. What the Prime Minister made clear was that we would abide by the law, and Lord Pannick, among many others, has confirmed that the Prime Minister has done so, so there is no question as to the commitment from him. Of course, the Leader of the Opposition disagrees with the action, but the position of the Prime Minister and his commitment to leaving on 31 October will not surprise any Members either of this House or of the European Council.
The Leader of the Opposition talks about collusion. In this House, we want to collude with the British public to respect the referendum result and to get Brexit done. When he talks about delay, he should answer this question: he wants a second referendum, as we know the shadow Brexit Secretary does, but how long is that going to take? How long will the primary legislation take? How long will the Electoral Commission requirements take? How long will he leave the House in purgatory? He gave a commitment that if we went past 31 October, there would be a general election, and yet on the “Andrew Marr” programme on Sunday, the shadow Brexit Secretary said that he wanted a further delay to have a second referendum. When will the Leader of the Opposition accept the Prime Minister’s challenge? When will he have a general election? Or are we to have, as the shadow Brexit Secretary said, more dither, more delay and more shirking of his responsibilities?

Commons ChamberOn a point of order, Mr Speaker. I am very grateful to you, the House of Commons staff, and everybody who has put themselves out and given up their time for the debate today. It has been a very important debate, and an exceptional moment for our country and our Parliament. Alas, the opportunity for a meaningful vote has effectively been passed up, because the meaningful vote has been voided of meaning, but I wish the House to know that I am not daunted or dismayed by this result. It became likely once it was obvious that the amendment from my right hon. Friend the Member for West Dorset (Sir Oliver Letwin) was going to remain on the Order Paper. I continue in the very strong belief that the best thing for the UK and the whole of Europe is for us to leave with this new deal on 31 October.
To anticipate the questions that will come from the Opposition, I will not negotiate a delay with the EU; neither does the law compel me to. I will tell our friends and colleagues in the EU exactly what I have told everyone in the 88 days in which I have served as Prime Minister: further delay would be bad for this country, bad for our European Union, and bad for democracy. Next week, the Government will introduce the legislation needed for us to leave the EU with our new deal on 31 October, and I hope that our European Union colleagues and friends will not be attracted, as those on the Opposition Benches—or rather, I should say, the Opposition Front Bench—are, by delay; I do not think that they will be. Then, I hope that hon. Members, faced with a choice on our new deal for the UK and the European Union, will change their mind—because it was pretty close today—and support this deal in overwhelming numbers.
Since I became Prime Minister, I have said that we must get on, and get Brexit done on 31 October, so that this country can move on. That policy remains unchanged. No delays! I will continue to do all I can to get Brexit done on 31 October, and I continue to commend this excellent deal to the House.
Further to that point of order, Mr Speaker. I welcome today’s vote. Parliament has clearly spoken. [Interruption.]
Order. The Prime Minister was heard. [Interruption.] Yes, he was; do not argue the toss with the Chair. I am telling you what the situation is, and everybody can detect that the Prime Minister was heard. The Leader of the Opposition will be heard, too. It is as simple and unarguable as that.
I welcome today’s vote. It is an emphatic decision by this House, which has declined to back the Prime Minister’s deal today and clearly voted to stop a no-deal crash-out from the European Union. The Prime Minister must now comply with the law. He can no longer use the threat of a no-deal crash-out to blackmail Members to support his sell-out deal. Labour is not prepared to sell out the communities that we represent. We are not prepared to sell out their future, and we believe that ultimately the people must have the final say on Brexit, which actually only the Labour party is offering.
Today is an historic day for Parliament, because it has said that it will not be blackmailed by a Prime Minister who is apparently prepared, once again, to defy a law passed by this Parliament. I invite him to think very carefully about the remarks he just made about refusing, apparently, to apply for the extension that the European Union (Withdrawal) (No. 2) Act requires him to do.
Further to that point of order, Mr Speaker. I think all of us in this House are aware of the responsibilities that we have. This is a crisis that we are in. I am thankful that the House has voted the way it has done on the amendment this afternoon. There is a clear expression from this House that we cannot crash out on 31 October.
Mr Speaker, I want to ask you what we can do to make sure that the Prime Minister respects the law of the land, that the Prime Minister respects the Benn Act and sends a letter to the European Council seeking that extension. I wonder what we can do to make sure that the Government do not bring forward a Bill until that extension, as they have been instructed, is delivered on. If there is any failure on the part of a Prime Minister who thinks he is above the law, well, Prime Minister, you will find yourself in court.

Commons ChamberOn a point of order, Mr Speaker. It is disappointing that no solution has won a majority this evening, but I remind the House that the Prime Minister’s unacceptable deal has been overwhelmingly rejected three times. The margin of defeat for one of the options tonight was very narrow indeed, and the Prime Minister’s deal has been rejected by very large majorities on three occasions. If it is good enough for the Prime Minister to have three chances at her deal, I suggest that possibly the House should have a chance to consider again the options that we had before us today in a debate on Wednesday, so that the House can succeed where the Prime Minister has failed, in presenting a credible economic relationship with Europe for the future that prevents us from crashing out with no deal.

(Urgent Question): To ask the Prime Minister if she will make a statement on progress made in achieving legal changes to the EU withdrawal agreement and the timetable for approval in this House through a meaningful vote.
As negotiations are ongoing and at a critical stage, I am here to update the House on the latest developments. My right hon. Friend the Prime Minister spoke to President Juncker by phone yesterday evening, teams will continue to talk throughout today and the Government will make a statement later today updating the House on the progress of discussions. As previously understood, the Attorney General’s legal analysis will be updated following the outcome of negotiations, and he will publish his legal analysis of any document produced and negotiated with the EU and present it to the House before it meets tomorrow.
Clearly, I cannot pre-empt the outcome of these sensitive and urgent discussions, and I am sure the House understands that I am not able to share details or engage in speculation about talks that are still ongoing, but I can assure it that, as soon as the negotiations have concluded, it will be updated. The meaningful vote will take place tomorrow and the motion will be tabled today ahead of that debate. The House will then face a fundamental choice: back the Brexit deal or risk a delay that would mean months more spent arguing about Brexit and prolonging the current uncertainty—uncertainty that would do nothing but pass control to Brussels and increase the risks.
It is incumbent on the House to deliver on the will of the British people and to provide certainty. Tomorrow, right hon. and hon. Members will have the opportunity to do just that in a meaningful vote fully informed by the Government’s legal analysis. I believe that the right hon. Gentleman the Leader of the Opposition and every hon. Member in the House should take that opportunity to move forward and provide certainty.
This is a Government in chaos and a country in chaos because of this mess. I left my office at 20 past 3. At that time, Downing Street was unable to confirm who would be responding to my urgent question. It seems that the WhatsApp group, a lottery or something has chosen the hon. Member for Worcester (Mr Walker) to reply to the House, when my question was to the Prime Minister.
We find out from journalists and the Irish Government that the Prime Minister is apparently heading to Strasbourg this evening, or not heading to Strasbourg this evening, hours before a meaningful vote is due. The Prime Minister was clear and categorical on 26 February. She said:
“I want to reassure the House by making three further commitments. First, we will hold a second meaningful vote by Tuesday 12 March at the latest”—
there are still 24 hours to go, so who knows? She also committed to a vote on no deal by 13 March and a vote on whether to extend article 50 by 14 March. She then concluded:
“They are commitments I am making as Prime Minister, and I will stick by them”—[Official Report, 26 February 2019; Vol. 655, c. 166-7.]
This is a matter of trust. Time and again, the Prime Minister has failed to negotiate, failed to compromise and delayed and delayed. After three months, she has not achieved one single change to her deal. As we have often said, she has simply run down the clock, leaving us with a choice between her deal and the chaos of leaving the EU without any agreement. It was a bad deal in December, when it was first tabled; it was a bad deal in January, when it was rejected by the largest parliamentary margin by which any Government has ever been defeated; and it is still a bad deal today, 11 March.
These shambolic negotiations and endless delays are having real-life consequences in workplaces across the country: businesses are holding back on investment, jobs have been lost, workplaces are closing, workers fear for their jobs and the national health service and public services are having to spend millions of pounds preparing for a no-deal outcome, which the House has already clearly rejected.
Can the Prime Minister, I mean the Minister—I am sorry that the Prime Minister cannot be here, apparently—tell us what changes the Government have got to the backstop and when the Attorney General will publish his apparently new legal advice, or is it that, after three months of delay, nothing has changed? Given that they whipped their MPs to vote for the amendment in the name of the hon. Member for Altrincham and Sale West (Sir Graham Brady), which said the deal could only be supported with changes to the backstop, will the Prime Minister be voting against her own deal if no changes have been secured?
Will the Minister confirm that we will, absolutely, have the meaningful vote tomorrow, and that it will not be delayed yet again? Will we also have the vote to rule out no deal on 13 March, and the vote on extending article 50 on 15 March, as promised? If the deal is rejected again tomorrow, will the Prime Minister shift her red lines, and show that she is not just willing to meet Members, but willing to compromise with them as well?
This chaos cannot go on for much longer. The fate of people’s workplaces, jobs and businesses is at stake as the Government fail to negotiate and there is simply dither after dither, and then further delay. It is time for answers.
The right hon. Gentleman talks about further delay. I have confirmed to him that there will be a meaningful vote in the House tomorrow. I have explained that negotiations are ongoing, and the Government are seeking legally binding changes that will address the concerns that have been raised in the House.
The right hon. Gentleman speaks of chaos. We all remember his advice to the Government, on day one after the referendum, to trigger article 50 immediately. I think that we can be very clear that this process would be no safer in his hands. He talks about investment. He and his party will have the opportunity to vote to secure and unlock investment tomorrow by backing the deal, and they will do so fully informed by the Government’s legal analysis. He asked about the timetable for the publication of the Attorney General’s advice, and I can confirm that that advice will be published before the House sits tomorrow.

Commons ChamberOn a point of order, Mr Speaker. Tonight’s vote shows that there is no majority for the Prime Minister’s course of action in dealing with Brexit. Yet again, her Government have been defeated. The Government cannot keep on ignoring Parliament or ploughing on towards 29 March without a coherent plan. She cannot keep on just running down the clock and hoping that something will turn up that will save the day and save her face.
It is surprising that the Prime Minister is not even here to hear the result of this vote. I was going to ask her to come to the Dispatch Box now to admit that her strategy has failed and bring forward to the House a coherent plan that can deal with the stresses and anxieties that so many people all over this country are feeling, so that we can make some progress together, bring people together and prevent the catastrophe of a no-deal exit on 29 March. It is surprising that the Prime Minister is not here. Is there some way by which you could encourage her to return to the Dispatch Box and tell us what her plan is?
It is not obligatory for the Prime Minister to be present on this occasion. Other representatives of the Treasury Bench are here, and if the Secretary of State for Exiting the European Union wants to take to the Dispatch Box, it is open to him to do so, but he is not obliged to do so.

I would like to wish you, Mr Speaker, and all the House a happy new year.
In a tone that I am sure will reflect the year ahead, may I join the Leader of the Opposition in wishing you, Mr Speaker, and colleagues across the House a happy new year?
As the House will be aware, the Prime Minister today launched a new 10-year plan for the NHS, allocating an extra £20.5 billion a year in funding. I am therefore responding to this question on her behalf. I am sure colleagues across the House recognise the importance of the NHS plan.
As confirmed by the Leader of the House in her business statement before the Christmas recess, this Wednesday the House will debate a business motion relating to section 13(1)(b) of the European Union (Withdrawal) Act 2018. That will be followed by the main debate on section 13(1)(b), which will continue on Thursday 10 January and, subject to the will of the House, Friday 11 January. Discussions are taking place through the usual channels as to the proposed length of that debate and the date of the vote, but ultimately it will be a decision for this House, through the business motion, which will be voted on this Wednesday. Debate will also take place in the House of Lords on Wednesday 9, Thursday 10 and Monday 14 January.
The decision to postpone the debate last year was not taken lightly. Over the two years of negotiations, the Prime Minister won hard-fought battles—most importantly, to agree a bespoke deal, rather than the flawed off-the-shelf options initially offered. But it was clear from the three days of debate held in this House that it was not going to pass the deal and that further reassurances should be sought, particularly on the issue of the backstop.
Following December’s European Council, a series of conclusions were published that went further than the EU had ever gone previously in trying to address the concerns of this House. Over Christmas, the Prime Minister was in contact with a number of her European counterparts on the further legal and political assurances that Parliament needs on the backstop. She has been in touch with the Taoiseach, and indeed British and Irish Government officials have been in contact over the past week. Securing the additional reassurance that Parliament needs remains our priority, and leaders remain in contact. Leaving the EU with the deal that has been agreed is in the interests of both sides.
When the debate begins on Wednesday, the Government will make clear for the House what has been achieved since the vote was deferred last year. As I said when I spoke in the debate on 4 December, the deal will enable us to deliver a fair, skills-based immigration system and to have control over our fisheries policy and agricultural policies—
Unlike the Scottish National party, which wants to retain the European approach. We will have our own trade policy for the first time in more than three decades, and there will be an end to sending vast sums of money to the EU. It is a good deal, it is the only deal, and I believe that it is the right deal, in offering certainty for this country.
Thank you, Mr Speaker, for granting this urgent question. With less than three months until we reach the article 50 deadline, there can be no more hiding and no more running away. This issue will define Britain’s future and should not be decided by the internal machinations of the Conservative party. This House and this country deserve much better.
A month ago, the Prime Minister shamefully pulled the meaningful vote, promising to do everything possible to secure assurances from the EU on the temporary nature of the backstop. Now the time has come for the Prime Minister to tell the House exactly what legal assurances she has been given by EU leaders. She achieved nothing at the December summit, but now surely she has plenty to update us on. Although I am delighted to see the Brexit Secretary here today, it is the Prime Minister who should be here to answer these questions. She suggested that a breakthrough had been secured last week. She is not here because she is busy promoting “Project Fear.” It is all hot air.
There also seems to be confusion about exactly what the Prime Minister is demanding from EU leaders. The Leader of the House promised “legal reassurances”, but yesterday the Prime Minister told the BBC:
“We’re not asking for anything new”.
Can the Secretary of State clear this up and tell the House exactly what is being requested, because this morning Ministers in his own Department did not seem to have a clue? When asked what the PM was demanding, the Brexit Minister had to concede that he did not know, but he reassured the whole world by saying that he was “an important person”, so that is all right.
I fear that the reason so many members of the Cabinet are in the dark is that there is nothing to know. If that is the case, what guarantees do we have from the Secretary of State that, faced with yet another humiliating defeat, the Prime Minister will not just run away? Can he do what the Prime Minister should be doing here today by confirming the timetable for the meaningful vote and providing what we have not received so far: a cast-iron promise that it will not be reneged on yet again?
The Government are trying to run down the clock in an attempt to blackmail this House and the country into supporting a botched deal. The Prime Minister has refused to work with the majority over the past few months, in a desperate attempt to spark life into what is actually a Frankenstein’s monster of a deal. Now we are told that, if we do not support the deal, the Government are prepared to push our whole economy off the cliff edge. To prove this, preparations for no deal are now under way.
The Transport Secretary, who has a PhD in incompetence in running Ministries, has awarded a shipping contract to a company that does not have any ships. Even today, we see the farce of lorries being lined up to stage a fake traffic jam in Kent to pretend to the EU that the Government are ready for a no deal—a stunt that the Road Haulage Association describes as “window dressing” and that one of the drivers describes as a “complete waste of time.” The Government are fooling nobody. These shambolic preparations are too little, too late.
The reality is that there is no majority in this House to support no deal. Why will the Government not face up to this truth and stop wasting our time and our money? The Prime Minister should be here updating MPs on what progress she has achieved, if any. Instead, she is continuing her approach, as before Christmas, of ducking scrutiny and dodging accountability. We will hold this Government to account for their incompetence.
Based on the lack of content in that, it is good to know that the Leader of the Opposition had a good break over Christmas. He talks about colleagues not knowing. What they do not know is what Labour’s plan is. However, what they do know is that it is riddled with contradiction. Labour say they want to remain in a customs union, yet they also say that they intend to have an independent trade policy, even though the EU has made it clear that that is an area of EU competence. They say they want to be in the internal market but, at the same time, end free movement, even though the two are contradictory.
The shadow Business Secretary says that he does not want to rule out the option of a second referendum, yet the shadow Education Secretary says that that would be a betrayal of the democracy of the main referendum vote. Page 24 of Labour’s manifesto said that they would respect the referendum result; now they seem to have a policy to go back on that. So the confusion we have is as to what the Leader of the Opposition actually believes. He started out saying in interviews that we could not stop Brexit, yet his shadow Brexit Secretary says that they can.
I am pleased that the Leader of the Opposition started his remarks by seeming to upgrade me. Last time he said that my role is purely ceremonial. Now he seems to welcome me to my post. Yet he seems to suggest that the NHS 10-year plan, with an extra £20.5 billion of investment, is in some way “Project Fear.” Well, we are used to “Project Fear” on the NHS; it is “Project Fear” that we see from the Opposition on a regular basis.
The reality is that the right hon. Gentleman opposes the preparations for no deal, which any responsible Government need to make, while at the same time saying that he will vote against the deal. It is that internal machination in the Labour party that he needs to address, and nothing in his contribution to the House today sought to clarify that. It is now time he became clear. Does he maintain the position in the manifesto, that Labour will respect the referendum result, or does he agree with his shadow Brexit Secretary and want a second referendum?
