Commons ChamberI very much agree with the hon. Gentleman about the importance of international students, including their importance as an export for our economy. He will be pleased to learn that there is no cap on the number of international students who can come to the UK, and that the number who came last year reached a record high. As for fast-track access for certain countries, we constantly keep that under review.
My constituent Ken Macharia is under threat of removal back to Kenya, where he will not be able to live openly as a gay man. In the month of Pride, it cannot be right for us to deny him the right to be who he is. More importantly, however, does the Home Secretary agree that Ken’s sexuality should not be the issue? He came here to qualify as a mechanical engineer, and he therefore has skills that we urgently need for our economy. Should we not be letting him stay for that reason, irrespective of his sexuality?
I understand why my hon. Friend has raised this case, and I can assure him that the Home Office is taking it very seriously. He will, perhaps, appreciate that I cannot comment on an individual case, especially if it involves an application for a judicial review, but I can reassure him that in cases of this type, at the heart of decision making is the welfare of the individual concerned.

Commons ChamberFor all the concern that is being expressed by colleagues on both sides of the House, is the Home Secretary aware of a single Interior Minister or security agency chief around the whole EU who actually wants to reduce the level of co-operation that the UK currently has with the EU and the countries within it?
My hon. Friend makes a very good point. In all my discussions with Interior Ministers on security co-operation, I have not come across a single one who wants to reduce security co-operation. Every single one understands the mutual benefit that comes about through continued co-operation and information exchange.
The deal that the UK has reached with the EU will provide for the broadest and most comprehensive security relationship that the EU has ever had with another country. This agreement allows for our relationship to include various important areas of co-operation: continuing to work closely together on law enforcement and criminal justice; keeping people safe in the UK, across Europe and around the world through exchanging information on criminals and tackling terrorism; ensuring that we can investigate and prosecute those suspected of serious crime and terrorism; supporting international efforts to prevent money laundering and counter-terrorist financing; and combating new and evolving threats such as cyber-security. It also allows for joint working on wider security issues including asylum and illegal migration.
The declaration sets out that we should carry on sharing significant data and processes such as passenger name records, so that we can continue disrupting criminal networks involved in terrorism, serious crime and modern slavery; DNA, fingerprint and vehicle registration data, ensuring that law enforcement agencies can quickly investigate and prosecute criminals and terrorists; fast-track extradition to bring criminals to justice quickly where they have committed a crime; and continued co-operation with Europol and Eurojust.
Again, a very important point has been raised by one of my colleagues. I absolutely make that commitment. My hon. Friend is quite right to raise it, because we have to recognise that as we move from the current system of freedom of movement, in which there is virtually no bureaucracy to speak of, to a system under which we will require visas for every worker, we must keep an eye on the paperwork and bureaucratic requirements and keep the system as simple and light-touch as possible. That applies not just to larger employers, such as hospitals or NHS trusts, but to the smaller employers that may be looking for skills but perhaps taking only one or two people a year, and we should keep that in our minds as well.
This is not just about doctors and nurses of course; in my constituency, an awful lot of those involved in agriculture and tourism are concerned to ensure that a seasonal workforce continues to be readily available. Will the Home Secretary reassure us that there is a mechanism in his plans to allow that sort of migration so that the needs of those very important industries in Somerset can be met?
I can give my hon. Friend that assurance. He will know that we have announced a pilot for the seasonal agricultural workers scheme, which we are starting early next year, working with my right hon. Friend the Secretary of State for Environment, Food and Rural Affairs. The purpose of the pilot is to make sure that we look carefully at how we can continue to meet the needs of that very important sector.

Commons ChamberEmergency services around the UK know how brave and expert our cave rescue services are in the way they support emergency services in this country. Does the Home Secretary share my admiration for two of my constituents who were involved in the Thai cave rescue, along with the other two British rescuers, who did such brilliant work to bring those 12 boys and their coach out alive last week?
I am very happy to join my hon. Friend in commending the courage and bravery shown by those cave rescuers in saving lives: Robert Harper, Chris Jewell, Jason Mallison and Tim Acton. This whole House commends them.

Commons ChamberI will come on to discuss the pilots in a moment, but the good thing about them is that all the local authorities involved, including Suffolk, will now be able to experiment and see what they can do to help raise those local rates by having more incentives for businesses and attracting more businesses to the area. One clever way of getting more revenue is by getting more businesses into the area.
As we look at the resources of local authorities, we need to start looking at creating a whole system of local government finance that will be fit for the future. The current formula for financial allocations had served local areas well over the years, but a world of constant change, with big shifts in demographics, lifestyles and technology, demands an updated and much more responsive way of distributing funding. That is why there are questions over the fairness of the current system, which is why I was pleased to launch a formal consultation on a review of councils’ relative needs and resources in December. That closed recently and I am grateful to everyone who responded. This was not just a paper exercise; we have an unparalleled opportunity here to be really bold and ambitious; to consider, with the sector, where the most up-to-date data and evidence lead us, and to create a new system that gives councils the confidence to fully grasp the opportunities and challenges that lie ahead. We aim to introduce this new approach in 2020-21.
That is also when the latest phase of our business rates retention programme will get under way. It is a programme that gives local authorities powerful incentives to grow their local economies, and so far it has been a resounding success. Councils will keep some £2.4 billion more of their business rates next year alone; this a significant revenue stream, on top of their core settlement funding.
The retention of business rates is indeed a huge opportunity for councils such as Somerset’s, which was so disappointed not to be part of the business rates retention trial. Will the Secretary of State reassure us that all that he has learnt from his review of the funding formulas will be applied to how business rates retention is baselined, so that county council areas with smaller economies are not disadvantaged by the retention of business rates when it is introduced in full?
Yes, I can give my hon. Friend that reassurance. I shall say more about how the system is going to work in a moment.
Our aim is to go further and for local authorities to retain 75% of business rates from 2020-21, as we work towards 100% retention. With that in mind, in December I announced an expansion of the 100% retention pilots that have proved so popular. More than 200 authorities came forward to bid for the new 100% business rates retention pilots that we are going to run in 2018-19. I was pleased to respond to that enthusiasm by doubling the number of initial pilots to 10, covering some 89 authorities. The 10 that we have selected, taken alongside the existing pilots, give a geographic spread to help us to see how well the system works across a broad range of areas and circumstances. The pilot areas will keep 100% of the growth in their business rates if they expand their local economies—that is double what they can keep now. There will also be opportunities for others to get involved, with a further bidding round for pilots in 2019-20, which will open in due course.

Commons ChamberThe hon. Lady is right to raise the importance of affordable housing and having the right mix of housing everywhere, including Bristol. We are currently working with the Mayor of the west of England and the Mayor of Bristol on a housing deal which, if it happened, would include a significant portion of affordable housing.
Green-belt protections around Bristol and Bath are displacing housing targets beyond the green belt into Somerset. Should the councils unable to build enough houses be required to deliver transport and infrastructure plans that will service the commuting needs of new Somerset residents needing to travel through the protected green belt on their way to work?
We want to help all councils meet their local housing need, and that includes helping with their plans as they develop them, but also giving them more options other than looking at the green belt, as we did in the recent draft plan that was published earlier this month, and helping with infrastructure, which means the £5 billion housing infrastructure fund.
This Government have done much to improve bus facilities throughout the country, especially in the new metro mayor areas where we have extended bus franchising. If the hon. Lady has particular issues, the Department for Transport is the policy lead, and I would be happy to pass her questions on to my right hon. Friend the Secretary of State for Transport.
The affordability of a house is not just what it costs to buy or rent each month but what it costs to live in it thereafter. May I therefore encourage the Secretary of State to set the highest energy efficiency standards possible for new houses so that they can be cheap both to own and to operate?

Commons ChamberAs it is nearly a decade since the current needs assessment formula was looked at thoroughly, we are currently undertaking a fair funding review to consider how to introduce a more up-to-date, more transparent and fairer formula.
I warmly welcome the review that the Secretary of State has announced. I share his enthusiasm for it, and that of councils in Somerset. What will be its likely structure, and what is the minimum time that it may take to complete?
As my hon. Friend will know, I was in Somerset only last week, helping to launch the excellent election manifesto for that great county, and fair funding was one of the issues that came up. Our plan is that the new formula will determine the baseline funding allocations as we implement the 100% business rates retention programme planned for 2019-20.

Commons ChamberThe hon. Gentleman may not be aware that although the better care fund picks up over time, it has already kicked in. I think it represents £105 million this year, and it rises next year and in the following years. However, he makes an important point; I listen carefully to what he says, especially given that he is Chair of the Select Committee that oversees my Department. I hope he will agree that as the better care fund comes in and builds up, it will start to make a bigger difference.
Will the Secretary of State confirm that all additional funds that have been and will be committed for the purposes of adult social care will be allocated according to the needs-based formula, not the existing local government formula, so that things such as sparsity of population and a deteriorating demographic will truly be taken into account?
I can confirm that the way in which the funding has been allocated overall is based on relative needs. I have mentioned, for example, the new £240 million fund that the settlement sets up for adult social care. That is all based on need as well.
My hon. Friend has been a passionate advocate of ensuring that we think of all parts of our country, including the more rural parts, that face particular challenges. I have had many constructive discussions with him and will continue to do so. He has often highlighted that we must make sure that those needs-based formulae, whether for adult social care or for funding for local authorities more generally, are updated and modern. That is something that I am attempting to do.
I can confirm that that is exactly the kind of thing that we need to look at more closely. If my hon. Friend allows me to, I will give a bit more detail about the kinds of things that I am keen to ensure are covered by the review.
I have been privileged to hear the views of colleagues from across the House, many of whom have direct experience of service in local government. Various themes have emerged. Foremost among them is the need to ensure that the formula works for all local authorities, wherever they are. Rural councils in particular have unique needs that must be met, and councils have been clear that they want to see action sooner, rather than later. I am happy to confirm what we have previously said on the issue. We will make the changes to the fastest possible parliamentary timetable, and we aim to implement new baselines for every authority in 2019-20, following Royal Assent of the Local Government Finance Bill, the necessary secondary legislation and the completion of the fair funding review. I will update the House as soon as I have further details to share.
I acknowledge that my right hon. Friend said that this will happen in the fastest time that the parliamentary process will allow. May I invite him to be a little clearer on when he anticipates that means the review will have been completed and committed to?
Again, I thank my hon. Friend for the role he has played in making sure that this issue is looked at properly. As he will know, the commitment we have made on business rates retention, which we want to start in the financial year 2019-20, means that there will be a requirement to have the proper baseline set for all local authorities before that system can be properly brought in. I hope that that gives him some comfort on the timing that is necessary given that the two things—the fair funding review and the business rates retention plan—are very much interlinked. There will be various staging posts on the way. As always, I am more than happy to sit down with him to take him through those and discuss this further.

Is it not an outrage that union officials can conduct union business on public time? Will the Secretary of State confirm that the first year of the Government’s controls on facility time in the civil service has seen a saving of £17 million?
I should emphasise that point: we are saving £17 million a year because of the transparency we have introduced into the civil service. It will no doubt have a similar impact on the rest of the public sector.
There are nurses, teachers and other public servants being paid a salary by the taxpayer while working for their union under the banner of facility time. There is no transparency around how much time they spend on union work and no controls in place to ensure that the taxpayer is getting value for money. It is a situation that most ordinary Britons, including many dedicated public servants I have spoken to, find absolutely baffling. That is why civil service Departments are already required to publish information about the use of facility time by their staff. The Bill allows the Government to make regulations extending that to all public sector employers. It will include information about an employer’s spending on trade union duties and activities and about how many of its union representatives spend a specified percentage of their time on their union role. We have already made considerable savings for the taxpayer by requiring Departments to publish this information, as we have just heard from my hon. Friend the Member for Wells (James Heappey). However, if transparency alone does not lead to further savings, the Bill also grants Ministers the power to set a cap on the time and money spent on facility time.
