Friend in congratulating the Open University on securing that lead role in the Institute of Coding, which is an important new initiative to get universities to work closely with business to develop specialist coding skills. The Government are investing £84 million to deliver a comprehensive programme to improve the teaching of the computing curriculum, and we look forward to working closely with the university and the institute.
Obviously I know no more details of the case than those that the hon. Gentleman has just described, but, like many Members, I have immigration casework in my constituency, so I am familiar with the type of problem that he describes. If he would like to write to me after these exchanges to set out the details, I will discuss the matter with my right hon. Friend the Home Secretary, and the relevant Minister will certainly meet him.

Commons ChamberIn 2014, Keith Cochrane was appointed to the joint management board of the Scotland Office to advise on strategic and operational issues in that Department and on the efficient delivery of ministerial priorities. As well as that, Mr Cochrane was a member of the Government’s network of non-executive directors. According to media reports, a Government source described Mr Cochrane as having undertaken, since he joined that board and that network,
“a significant programme of engagement with Lead NEDs from across UK Government departments.”
The source also said:
“Since Keith Cochrane’s appointment the visibility of the Non-Executive Board Members has increased considerably, especially across Government.”
Not only was Mr Cochrane a key adviser to the Secretary of State for Scotland and others across Whitehall, but during his three-year term as a management director and non-executive director in Government he was also on Carillion’s board, and he was latterly its chief executive officer. The long and short of it is that Mr Cochrane advised on Government policy while Carillion was being offered large and lucrative contracts in Scotland and throughout the UK. For many at home watching our proceedings, it will look like just another example of the cosy cabal that the Government are routinely guilty of entertaining.
It has been suggested that Mr Cochrane asked the Government to consider a bail-out for Carillion. As a high-level adviser to Ministers and to Whitehall, Mr Cochrane enjoyed premium access that would simply be unavailable to someone from any other company. Small business owners who face lost contracts, unpaid bills and the prospect of having to lay off staff never had the kind of access to or voice at the Government table that Mr Cochrane had. Unlike him, they will not receive £750,000 in pay while their company goes under, or £300 for every high-level meeting with Ministers.
I welcome today’s announcement that Keith Cochrane will step aside temporarily, but will the Minister tell the House whether the Government will renew his membership of the joint management board and the network of non-executive directors when his three-year term expires this year? Will the Government provide details of the number of meetings Mr Cochrane had with Ministers responsible for issuing contracts to Carillion and of whether he ever raised the prospect of a bail-out of Carillion with Ministers or Whitehall officials?

Commons ChamberOrder. The trouble with these answers is that they are too long.
My position on this issue is clear: I voted in support of same-sex marriage in England and Wales and, like the Secretary of State and the Prime Minister, I hope that this can be extended to Northern Ireland in future. I believe marriage should be a common right across the UK. However, the fundamental position remains that same-sex marriage is a devolved issue in Northern Ireland.
If my husband and I stick to our plans to retire one day to his home town in Northern Ireland, upon my death, my better half would lose a husband in every sense of the word. The registry confirms that no reference to the marriage will be included on any certificate issued and my husband would be recorded simply as a surviving civil partner—years of marriage wiped out by the stroke of a pen. Does the Minister agree that, if the Democratic Unionist party is so keen on having no regulatory divergence from the UK, this is a good place to start?
I very much sympathise with this issue and share the frustration encapsulated in the letter to which the hon. Gentleman refers. However, this is not the time to be unpicking the devolution settlement on this issue. It is, rightly, an issue for a future Executive to return to and look at. We hope that the Executive can be brought back to do that and deal with many other important issues.

Commons ChamberI absolutely agree with my hon. Friend. Connectivity is at the heart of the proposal that the five cross-border local authorities have brought forward in the borderlands package. My hon. Friend will be aware that the original intention for the roll-out of broadband in Scotland was to focus on the south of Scotland but, in their centralising way, the SNP Scottish Government put a stop to that.
I very much accept the point that the hon. Gentleman makes. It is not good enough for RBS to say that people can rely on internet and mobile banking when so many people in Scotland do not have access to the internet or effective mobile services. When I meet the Royal Bank tomorrow, I will convey the concerns—I think from across the House—about its programme of closures.

Commons ChamberI am endeavouring to raise the tone of this debate, and obviously I am not succeeding with certain Opposition Members.
My final suggestion goes to the heart of what clause 11 is about. I mentioned that, in previous discussions about devolution, there has always been a Silk commission or a Calman commission. There has always been a body that has deliberated, drawn out the more controversial politics and tried to make the discussion more objective. I wonder whether there is a case for the Government convening some kind of standing commission, under the scrutiny of a joint group of parliamentarians, to dispassionately look through the powers returning from the EU that intersect with the devolved Parliaments and Assemblies in order to determine what powers should lie where, both immediately as we leave the European Union and in the longer term.
At the moment, I am afraid my criticism of clause 11, as it stands, is that it does not give any assurance about process or much assurance about consultation, time limits or sun-setting. It just sets out this static proposal.
Will the hon. Gentleman give way?
Does the hon. Gentleman agree that the danger of clause 11 is that it seeks to replace Scotland’s relationship with the EU with Scotland’s relationship with the UK? It is important for the Government to set the tone on how they intend to proceed on an equal basis with the devolved Governments.
The hon. Gentleman is, of course, absolutely right. I will address some of those issues. He is spot on that there is an imbalance in how everything is repatriated. The repatriation of the powers is the central feature that concerns us.
Devolution is an elegant solution. Devolution in this country is asymmetric, with the different Parliaments and Assemblies having different powers. The United Kingdom is a complex constitutional nation, and we have designed devolution to meet the demands of a complex, multi-nation United Kingdom. We therefore muck around with the basic premises and principles of devolution at our peril, which is why clause 11 presents such a clear danger and threat that it must be amended.
It is also important to say that Scotland did not vote to leave the European Union. Every single local authority area in Scotland voted to remain in the European Union. I now have constituents who are very concerned about the chaotic cluelessness at the heart of the negotiations and discussions about taking this country out of the European Union. The Scottish Parliament has become collateral in all those conversations and discussions. There is real concern about how our Parliament will operate and about the powers it has the right to expect and to progress with.

3. What recent discussions he has had with his Cabinet colleagues on the public sector pay cap.
I hold regular discussions with my Cabinet colleagues on a wide range of matters of importance to Scotland. The Scottish Government are responsible for Scottish Government pay.
I thank the Secretary of State for that answer and I want to give him another opportunity to clarify his view on the reported comments of the Chancellor of the Exchequer at the weekend. Does he agree that public sector workers are overpaid?
The hon. Gentleman will have seen what the Chancellor said on Sunday: he said that there are areas in the public service where recruitment and retention are becoming an issue and areas of the country where public sector wages and private sector wages are getting out of kilter in the other direction. It is important that we have a discussion on those issues.
