Commons ChamberThat, of course, is entirely a matter for the Welsh Government, but, in practice, that is what they are calling it at the moment.
I thank my hon. Friends the Members for Monmouth (David T. C. Davies) and for Aberconwy (Guto Bebb) for their amendments 12, 13 and 14, and my hon. Friend the Member for Forest of Dean (Mr Harper) for his amendments 17 and 18 and new clause 3. They raise important issues about the provision of cross-border health services in Wales and England, issues which are, of course, vitally important to anyone who lives close to the border—or even not so close, as was pointed out by my hon. Friend the Member for Ceredigion (Mr Williams). Indeed, they are important to anyone who wants world-class health services to be delivered throughout the United Kingdom.
Health is one of the most important services—arguably, the most important service—to be delivered by any Government. We all know that people value the delivery of good health care more than almost every other public service. This is, after all, a service on which we are all likely to call at some stage in our lives. It is therefore essential for any Government to deliver health services which are effective and efficient, and which provide good value for money. In England, the Government will have increased spending on health by about £12.7 billion in cash terms over the lifetime of the current Parliament, delivering an NHS that continues to improve and the health care that people want and deserve. However, none of that would be possible without our front-line NHS teams: the doctors, nurses, and other health care professionals.
As we have heard from Members this evening, the sad fact is that the Labour Government in Cardiff are presiding over a health service in Wales which is declining. My hon. Friend the Member for Monmouth gave some illustrations of that decline. In Wales, Labour has cut the health budget by 8%, despite having been given an extra £1.6 billion in the block grant. The result has been a decline in health services in Wales which is evident for all to see, with unacceptably long waiting times.
The right hon. Gentleman is describing the process for the Barnett floor, which has been well known for several months. He says that some urgent work is being undertaken by government on this issue. Therefore, it would not be an imposition to expect a review to be forthcoming within six months of this Act coming into force.
Well, I can only reiterate the point which I thought the right hon. Gentleman had accepted: that our priority is to address the deficit we inherited from the Labour party at the last election. Nevertheless, the next review is expected to take place in advance of a spending review in 2015 and it is likely to be around the time when this new clause suggests the report should be published. These arrangements ensure that we have a shared understanding of funding levels in Wales, and a process is in place to consider options should further convergence be forecast to resume. It therefore provides a firm basis for proceeding with the new financial powers in the Wales Bill, and I hope that the Plaid Cymru Members will therefore not press new clause 1 to a vote. I also ask hon. Members to support clauses 21 and 22 standing part of the Bill and to support amendment 29.

Commons ChamberMy hon. Friend is entirely right. We have protected the health budget in England, but the Welsh Government have cut their health budget by 8%. That is, to be frank, disgraceful and unsupportable. I suggest to Opposition Members that, rather than being in denial, they should criticise their own colleagues in the Welsh Assembly for their dereliction of duty to patients in Wales.
4. What discussions he has had with the First Minister of Wales in the past six weeks on the implementation of the proposals of the Commission on Devolution in Wales; and if he will make a statement.
The Wales Bill, which I introduced in this House last week, implements most of the recommendations made by the Commission on Devolution in Wales in its first report. I had proposed to discuss the Bill and the commission’s second report with the First Minister on Monday but, sadly, the meeting was postponed.
It is absolutely disgraceful that it has taken the Government one year to respond to the first recommendations of the Silk report. Why does the Secretary of State not get a grip now and bring in the second tranche of recommendations in the new Bill that he has introduced? We have been treading water in Parliament for the past few weeks. There is plenty of legislative time. If the will is there, let us get on with it.
I am surprised to hear that criticism from the right hon. Gentleman, as he knows that we will implement the recommendations of part I of the Silk commission in this Parliament. So far as part II is concerned, he should surely recognise that the recommendations will require significant consideration. Where those recommendations do not require primary legislation, we will look at implementing them in this Parliament, but we clearly cannot guarantee to do that.
May I ask about zero-hours contracts? Does the Secretary of State appreciate that they are exploitative, and no more so than in the care sector, which the Resolution Foundation has said is
“where their use is most entrenched and where their impact on vulnerable workers and care recipients is most worrying”?
Does he not agree that to hear Labour carping about that matter here and voting against an amendment to delete it in Wales is a bit unfortunate? Does it appear at all on his radar, or is he above all this?

Commons ChamberMay I first associate myself fully with the words of tribute to the late, greatly respected right hon. Member for Wythenshawe and Sale East (Paul Goggins), and to the late Lord Roberts of Conwy?
I am sure that the Secretary of State will agree that reform of the Barnett formula is still an issue about which we are all very concerned. We in Plaid Cymru have campaigned about it for more than 25 years. It is interesting that the Labour party is now in favour of reforming Barnett, which it did nothing about for 13 years. In fact, when it was in government, it denied the existence of the problem. Does the right hon. Gentleman have any views on that issue?
Which does the right hon. Gentleman think is worse—the self-serving preconditions set by the Labour party to block further devolution, or the failure of his Government to propose the full tax-varying powers contained in the cross-party Silk commission recommendations?

Commons ChamberMy hon. Friend is absolutely right that SMEs are the backbone of the Welsh economy, and we are keen to do all we can to encourage them. That is why we have initiated the StartUp loans scheme, which has already lent about £50 million to more than 9,000 new businesses. With effect from this October, working with the Welsh Government, we have announced the scheme’s roll-out to Wales, so that any Welsh entrepreneur with a good idea can come forward and apply for a loan.
The Secretary of State will know that SMEs in Dwyfor Meirionnydd are doing their best to thrive in the face of coalition austerity, as he visited the first ever Meirionnydd day the week before last. I thank him for attending it. However, the economic situation outside London is far different from down here, so why not make the National Insurance Contributions Bill, which is currently going through the House, apply everywhere outside London and south-east England, thereby mirroring a move in the Government’s emergency Budget of 2010?
I did, indeed, enjoy my visit to the Meirionnydd day that the right hon. Gentleman held, and I was very impressed by the positive attitude of SMEs from his constituency. He will know that the national insurance contributions employment allowance will benefit 35,000 businesses across Wales by a total of £50 million, with 20,000 of those businesses being taken out employer national insurance contributions altogether, which I would have thought his constituents welcomed.
Welsh exports were down by just under £1 billion over the past 12 months, which is the biggest fall in any UK nation or English region. What discussions is the Secretary of State having with the Chancellor to ensure that the Welsh producing economy, which is comprised mainly of SMEs, is not paying the price for a growing service and finance economy centred on London and the south-east?
We are anxious to ensure that as many SMEs as possible export. That is a good reason for Welsh SMEs to utilise the services of UK Trade & Investment. UKTI has global reach and is available to every business, including those in Wales. I encourage the right hon. Gentleman to encourage his constituents to seek the services it offers.

Commons ChamberIndeed, all parties in the Assembly have welcomed the announcement. The only exceptions appear to be the hon. Ladies and hon. Gentlemen on the Opposition Benches. It is essential that all parties work together in order to get a referendum as quickly as possible, so that Wales can get the tax-raising powers it needs to give it a competitive edge.
May I thank the right hon. Gentleman for advance sight of his statement? I also congratulate all the members of the Silk commission on the very hard and conscientious work they undertook in the past 12 months or so. I think today’s statement is something we can build on; with a little ambition, we can improve the lot of the people of Wales, rather than look for problems with it. I would like to ask one or two brief questions, however. When will the UK Government set out the clear detail on borrowing limits? Will there be separate borrowing powers from those set aside for funding the M4 relief road without the partial devolving of income tax, and will the borrowing deal to fund the M4 relief road contribute towards an overall borrowing limit?
It is indeed contemplated that further borrowing powers will be conferred on the Assembly Government, although that will depend very much on the income stream that is available to fund that. Certainly, if there were a positive vote in the referendum on income tax, there would be that much more scope. As far as the M4 is concerned, negotiations between the Treasury and the Welsh Government are already well under way to work out the detail of how those powers will be applied.

Commons Chamber5. What recent assessment he has made of the potential costs and benefits of High Speed 2 to Wales.
The Wales Office is committed to ensuring Wales derives the maximum possible benefit from HS2. In addition to improved journey times and extra rail capacity that passengers across the nation will experience, my Department will be working closely with Lord Deighton’s HS2 growth task force to identify further benefits to Wales.
With some spending projections for this vanity project topping £80 billion, will the Secretary of State commit to fighting for a Barnett consequential equivalent for Wales, which could be between £3 billion and £4 billion and make a huge difference to the Welsh rail network? Will he join his predecessor, the right hon. Member for Chesham and Amersham (Mrs Gillan), in pleading this case, as reported today in the Western Mail?

Commons ChamberAs the Secretary of State will know, total pay in Wales has fallen by 8% since 2007, one of the biggest falls in living standards in Europe. The spending review will not help the Welsh economy very much, taking a further £1 billion out of the Welsh economy—and the Labour party has now signed up to that. It is for Ynys Môn to decide whether it wants Labour cuts or Conservative cuts. Which does the Secretary of State think would be appropriate?
I will make no apologies for the way in which the Government have treated the interests of Wales since we came to power. We have seen more infrastructure investment in Wales under this Government than under 13 years of Labour and I am proud of the support we are giving to Welsh families and the Welsh economy.
The IMF—the high priests of austerity—said that the Government should cut less and start spending more on infrastructure projects. The re-announcement of HS2 last week was sort of welcome, but the cost has gone up to £50 billion. Is the Secretary of State satisfied that Wales will not be given the £2.5 billion consequential?

Commons Chamber6. What discussions he has had with Ministers in the Welsh Government who have partial responsibility for justice and law and order.
I have meetings with Ministers in the Welsh Government on a wide range of issues, including justice and law and order, although they are of course not devolved.
I will wish the Secretary of State a happy St David’s day on St David’s day and not today.
There is an all-Wales legal circuit, four excellent police forces and an all-Wales probation trust. It is high time that we devolved justice and policing to Wales. The Secretary of State will know that there is a huge clamour of enthusiasm for this move. I hope he will join it.
I understand that Plaid Cymru has made its submission to the Silk commission, which will no doubt consider those proposals. It will report in spring next year. The Government have shown our commitment to devolution of policing by creating the office of police and crime commissioner, which brings policing as close as possible to the policed public.
I heartily disagree with the Secretary of State on that—police and crime commissioners are nothing of the sort—but the obvious point is that laws in Wales are diverging naturally from those in England, including in administrative law, family law and criminal law. It is high time that the legislature in Wales had its own system. Otherwise, it will probably be the only legislature in the world without such a system.

Commons ChamberThe hon. Gentleman will know that Swansea made a bid for super-connected status, which was considered. Newport got super-connected status, which I am sure is welcomed by the people of Newport. He will know that a business case has to be made. He was very much to the fore in the business case for the electrification of the railway line to Swansea, and I hope he will play a similar role with regard to super-connected status.

Commons ChamberI commend the hon. Gentleman for the work he has done in seeking to obtain new nuclear on Anglesey. He knows that I have always been anxious to work closely with him on all aspects of nuclear generation on Anglesey and of course I am prepared to meet him, because he has raised a very important point.
As the Secretary of State knows, Wales is very well placed for energy generation and the Swansea bay tidal lagoon project plans to offer educational services to the university in Swansea to foster skills in green energy creation. Will he commend the project and those similar to it for their commitment to creating jobs and local expertise in Wales?
The right hon. Gentleman makes an important point. Green energy presents enormous opportunities to Wales and I commend the project he mentions. We now have the green investment bank, which has just been launched today. It will provide the most enormous opportunity to leverage investment into that important future sector.
I thank the Secretary of State for being so positive. He knows that renewable energy generation in Wales increased by 58% between 2004 and 2010 and employs hundreds of people, including in the solar panel industry in mid-Wales, and of course we have seen the developments on Ynys Môn, the energy island. Does he agree that now is perhaps the time for us in Wales to showcase our skills, our resources and our prospects to the rest of the world at a green energy summit? If he is so minded, would it not be a good thing to place that summit in the enterprise zone at Trawsfynydd?
Actually, I had not thought of that, but it is an excellent idea that we should take further. I was speaking to the leader of Gwynedd council, Councillor Dyfed Edwards, the other day and discussed the important enterprise zone at Trawsfynydd. Let us explore the prospects of a summit at Trawsfynydd.

Commons ChamberI warmly associate myself and my colleagues with the right hon. Gentleman’s remarks regarding Dyfed-Powys police and all the emergency services which are looking for little April Jones. I also congratulate the Secretary of State and the Under-Secretary on their appointments.
What assessment has the right hon. Gentleman made of the loss to Wales of inward investment since the disappearance of the Welsh Development Agency brand? Who has the last word on inward investment—this Government or the Government in Wales?
It is clear, as the right hon. Gentleman says, that Wales needs a strong brand in order to promote itself around the world. It is clear also that although economic development is devolved to the Assembly Government, it needs to have the leverage that it will get from UKTI. That is why I am encouraging the Welsh Government to work closely with UKTI.
What discussions have the UK Government had with the Welsh Government about the establishment of a dedicated trade promotion agency, either sitting within the Welsh Government or as a private sector vehicle, as recommended by the Welsh Affairs Committee back in February?

Commons ChamberIn Wales, an increasingly onerous planning and building regulations system is developing. Both planning and building regulations are key to the development of new housing and, at a time when England is relaxing that regime, the Welsh Assembly Government are making it more oppressive.
I am rather disappointed that there will be no Welsh Grand Committee on Monday; I do not know whether it is to do with alarm clocks or whatever else. There will be plenty of other opportunities for debating such matters on the Floor of the House in due course and that could have been a good first debate.
The construction industry employs 100,000 people in Wales. Will the Minister please make representations so that renovations are not subject to VAT? The problem is that new build is not subject to it but renovations are, and the vast majority of renovations are carried out by small and medium-sized firms.
I understand that the Welsh Government and the Treasury are currently discussing the whole issue of the Barnett formula and the housing revenue account subsidy scheme. That has been done away with in England, and never existed in Scotland or Northern Ireland. It cost Wales £73 million last year—money that could have been put to good use repairing council homes. Will he please further these discussions?

Commons ChamberBut this retroactive policy has shattered business confidence in Wales. We are set for advances in the green economy, but who will invest when moneys can be wiped out at the mere flick of a pen in Whitehall? It is simply not good enough, and the Under-Secretary should realise that we are considering a key industry in Wales.
I hear what the Under-Secretary says, but can he guarantee that this sort of mess will not happen again and that we can further develop green technology in Wales, where we are well placed to do that, in my constituency and throughout Wales? We need to develop those industries, so will he assure the House that we will not again have this kind of mess, which undermines confidence in the whole sector?

Commons ChamberYes, the issue of Peacocks is of great concern not just to Wales, but to the whole of the United Kingdom. Some 10,000 people are employed by Peacocks. Already my right hon. Friend the Secretary of State has been in communication with the Secretary of State for Business, Innovation and Skills to discuss the issue. I understand that the Welsh Minister for Business, Enterprise, Technology and Science has also been in communication with the Minister of State, Department for Business, Innovation and Skills, the hon. Member for Hertford and Stortford (Mr Prisk).
Figures published yesterday by the TUC, based on Office for Budget Responsibility figures, estimate that between now and 2017 a further 40,000 public sector jobs will be lost in Wales. What is the Minister’s Department doing to stem those losses, and generally, what is the Department doing to assist the economy of Wales?
The right hon. Gentleman is right. The OBR figures project a loss of public sector jobs. At the same time the OBR figures predict that there will be a gain of some 1.7 million private sector jobs during the same period. My Department is strongly engaged with the Department for Business, Innovation and Skills and working closely to do all we can to ensure that the private sector grows in Wales.
The Secretary of State and the Minister have heard the awful news about Peacocks. Surely billions of pounds of taxpayers’ money was not pumped into the banks so that those same banks could now pull the plug on companies such as Peacocks. Will the Minister and his right hon. Friend do everything they can to save the company? It is important for the whole UK, but vital for jobs in Wales.
The right hon. Gentleman makes a very important point, which is quite correct. He will understand, I am sure, that these are early days in this unfortunate saga. All I can do is assure him that our Department is liaising closely with the Department for Business, Innovation and Skills to do all we can to ensure that those jobs, if possible, can be saved.

Commons Chamber1. What discussions she has had with ministerial colleagues and Ministers in the Welsh Government on the effects of fuel prices on (a) rural and (b) urban areas in Wales; and if she will make a statement.
My right hon. Friend the Secretary of State and I have regular discussions with ministerial colleagues and the Welsh Government on a range of issues, including the effects of fuel prices in Wales. The Government are addressing the rising cost of fuel through the abolition of the fuel tax escalator, the introduction of the fair fuel stabiliser and a cut in fuel duty announced at the Budget earlier this year.
I thank the Minister for that response. Will he impress upon the Secretary of State the need to push the Government to introduce a true fuel duty stabiliser that would trigger an annual reduction in the pump price, as the so-called fair fuel stabiliser announced in the March Budget does not go anywhere near far enough? The volatility in petrol prices means businesses cannot budget, as was noted yesterday by the Federation of Small Businesses in its submission for the autumn statement.
I hear what the right hon. Gentleman says, but I must point out to him that the tax measures we have taken have resulted in petrol prices being approximately 6p per litre lower than they would have been had that escalator not been scrapped. Even taking VAT into account, fuel prices are approximately 3p per litre lower than they would have been.
Further to that response, may I ask the Minister about a slightly different matter? What support are the UK Government providing for the use of electric cars? There are hardly any charging points all in Wales. There is not even one per constituency. What is being done to encourage that?

Commons Chamber9. What recent representations she has received from tourism operators in Wales on Government financing for tourism promotion.
My right hon. Friend the Secretary of State and I have met representatives of the Welsh Tourism Alliance and North Wales Tourism to discuss a range of issues affecting the tourism industry, and we have both visited a number of tourism-related businesses across Wales in the last year.
As the Minister will know, the tourism sector in Wales is extremely important for the economy of Wales. He will also know that a large part of the sector comprises small and medium-sized enterprises—such firms employ about 90% of the people of Wales. What initiatives is he pursuing to expand this all-important sector?
The right hon. Gentleman is entirely right. The Welsh tourism industry is worth some £3.5 billion to the Welsh economy. Responsibility for promoting tourism in Wales resides with the Welsh Assembly Government, of course, but VisitBritain has established a new £100 million overseas tourism marketing fund, with £50 million being provided by the Department for Culture, Media and Sport. That marketing programme is due to launch to consumers this month and aims to deliver an extra 4 million visitors to the UK, many of whom will, of course, visit Wales.
I thank the Minister for that reply, but may I press him on one point? He and the Secretary of State were lobbied on the need for a cut in value added tax on tourism services so that we can compete fairly with our friends in Ireland and France, for example. Please will they engage with the Treasury on this matter?

Commons ChamberYes, I agree that broadband is extremely important for rural communities. Indeed, it is arguably more important in the countryside than in our towns and cities. It enables people to run businesses from rural locations with no competitive disadvantage, and farmers in particular urgently need broadband to file their returns.
Although I appreciate and welcome the announcement of the broadband pilot, bizarrely made at Wrexham and not in the House, I represent the Pwllheli area among other parts of west Wales and I have no doubt that it was to due to pressure from the Deputy First Minister. Can the Minister tell me precisely which areas of my constituency will be included in the pilot and which will not?
The right hon. Gentleman gives the pilot a rather strange welcome—a rather curmudgeonly one, I would suggest. As he knows, the rural area around Pwllheli is intended to be included in the pilot, from which we hope to gain important knowledge on the further roll-out of broadband across Wales.
The economic renewal plan in Wales set out to provide high-speed links to all businesses by 2015 and all houses by 2020, and as the Minister knows, under the “Wi-fi Wales” initiative, there are plans to enable free wireless connection to all publicly owned buildings in Wales. What support will the Minister and the Secretary of State give to those plans? There is currently huge criticism of the Wales Office, but if they get stuck in on that, they might silence some of their critics.
It is fairly clear that the right hon. Gentleman does not keep in touch with his colleagues in the Assembly, because very recently, my right hon. Friend the Secretary of State and I hosted a trilateral meeting between the Deputy First Minister and the Minister with responsibility for broadband via video link from the Wales Office in Gwydyr house. We are fully engaged in this process, and it is quite wrong for the right hon. Gentleman to suggest that we are not.

Commons ChamberI remind the hon. Gentleman that the cuts are necessary entirely as a result of the Labour party’s incompetent management of the economy. I reiterate that the chief constable of North Wales has sufficient confidence in his force to say that it will continue to protect the public and provide a service in which the public can be confident.

Commons Chamber1. Whether she has had discussions with the Secretary of State for Justice on the likely effects on Wales of her Department’s proposed programme of court closures.
My right hon. Friend the Secretary of State and I are fully engaged with our colleagues at the Ministry of Justice on these proposals. We both met the Under-Secretary of State for Justice, my hon. Friend the Member for Huntingdon (Mr Djanogly), in September and further meetings have been arranged.
May I make the point that since the hon. Gentleman and his colleague have been in post, we have lost the investment in St Athan, we have lost the investment in the south Wales railway line, we have lost jobs in Newport and we have lost the north Wales prison? What on earth are they doing for Wales?
It is in fact inaccurate to say that we have lost either St Athan or the north Wales prison. I would have thought, frankly, that the hon. Gentleman, as a lawyer, would be more concerned about the administration of justice. That is the primary concern of our Department and of the Ministry of Justice.

The private sector is the key to future growth in Wales, which is why yesterday’s Budget announced a major package of corporation tax reform that is aimed at making Britain—and, of course, Wales—one of the most competitive parts of the G20. In particular, the exemption of up to £5,000 of employer national insurance contributions for each of the first 10 employees, which applies outside London and the south-east, will be of benefit to Wales.
May I associate myself with the condolences expressed to the family of the late Lord Walker and also congratulate the right hon. Lady and the hon. Gentleman on their appointment to their posts?
Yesterday, there was a recognition by the Government of the need to grow economies outside the south-east of England. We have argued long and hard about the overheating of the south-east and its cost to the north of England and Wales. Will the Minister consider the idea of either regionalising corporation tax according to gross value added or devolving it altogether to the Welsh Assembly so that the needs of business can be met and real support provided for it?
I am glad to hear that the hon. Gentleman welcomes the announcements in yesterday’s Budget. The announcement of the exemption of up to £5,000 of national insurance contributions for new employment outside London and the south-east will certainly be of benefit; to that extent, it is a major departure, which I am sure that the entire House will welcome.
