That is precisely the case, and now is the time to level that playing field for our producers. We have commitments—I have personally been given commitments—from the main retailers in this country that they will not import meat derived from non-compliant states. I want to hold them to that, because it is only fair to our producers that if they are expected to comply with high welfare standards, as they should be, others have to do the same.

On that wider theme, what would the Minister say about the importation of foie gras? Would he be sympathetic to trying to take measures to prevent the cruel practice that takes place on the continent, with that product then being imported into the UK?

My personal view is that people should not buy foie gras, because of the method of production. It is up to people to make their own decision about what they buy, but unless there is a humane way of producing foie gras, and I am far from convinced that there is, they should make that decision when they decide what to put into their shopping trolley—I suspect that foie gras is rarely put into a shopping trolley—and what they ask people to provide for them. We have taken a view in this country; foie gras is a legal import and therefore there is no constraint that we can place on its importation, but we can ask people to think carefully about what they buy. I hope that that answers the hon. Gentleman’s question.

Let me continue setting out our recent measures: we have set a maximum stocking density for meat chickens that is lower than that required by European regulation; we have made sure that farm inspections are better targeted on the farms more likely to have welfare problems; for the first time, we have welfare standards for game birds; we have delivered a licensing regime to safeguard the welfare of circus animals, and we are working on delivering a ban, as hon. Members know; we are working on proposals to tackle—

I have just given way to the hon. Gentleman and he cannot really have two bites in the same sentence. We are working on proposals to tackle irresponsible dog ownership and to protect the welfare of animals in slaughterhouses; and we have demanded in Europe better protection for animals being transported for long distances, especially horses and unweaned calves—that comes back to a point to which we will return.

Having set out that broad framework, let me move on to the topic that most of this debate is about: live animal exports. I am going to use phrases that are uncannily similar to those used by the hon. Member for Ogmore in expressing the Government’s position and my personal position. I want to see animals slaughtered as near as possible to their point of production, and I would prefer to see a trade in meat or germ plasm to a trade based on live animals, particularly where journeys may result in livestock travelling very long distances across Europe. There are a number of reasons for that. Quite apart from animal welfare, it helps to support our domestic slaughter industry and is simply more sustainable. We should bear that in mind, too.

Local abattoirs, which are a very important issue, were mentioned, as was the fact that we have lost so many. In opposition under the last Government, I was critical of the fact that we lost so many abattoirs under them. The hon. Member for Ogmore is nodding; he probably remembers me saying that. If he does not, the hon. Member for Poplar and Limehouse (Jim Fitzpatrick) probably does.

The lack of abattoirs is becoming a major issue in many areas. I was on the Isle of Wight the other week and the island does not have an abattoir, so any animals that go to slaughter have to cross the Solent. People on the Isle of Wight would like to have an abattoir on the island. They are right to want one and we need to find ways in which we can support a viable alternative to ensure that they have. If we are talking about never moving animals across any waterways, the Isle of Wight will have a problem. Let us bear that in mind when we talk about what constitutes the export of live animals.

Again, I do not want merely to echo the hon. Member for Ogmore—that is a very bad practice—but I must say, in similar terms to those that he used, that the trade in live animals is lawful and we must remember that. There were a number of legal challenges by local and port authorities in the early to mid-1990s, but none was successful. In fact, some of those authorities have had to pay significant damages to exporters as a direct result of their failed attempt to block the trade by direct or indirect means. That is why, although I understand the sentiment expressed, I have a little difficulty dealing with writing campaigns that use postcards, e-mails and the rest of it to tell me that I must ban the live trade when I have no power to do so. It would fundamentally change the basis of free trade within the European Union area if we were to do so. We might want to do that and consensus might form in the EU at some stage, but it is not there at the moment and it is therefore not within my power to make that change.

The hon. Gentleman is right. We must be careful what we wish for because there are sometimes unforeseen consequences. Coming from an area where we have lots of excellent stables producing first-class racehorses, I have to say that the way racehorses are transported is very different from the way the average sheep is transported. Let us understand that as a basic rule of thumb. However, it is not unreasonable to expect every animal that is transported to be transported in proper and appropriate transport. That is what I am determined to ensure.

I thank the hon. Gentleman for giving way to me for the second time. My hon. Friend the Member for Ogmore (Huw Irranca-Davies), who spoke from the Dispatch Box, called for a review to be undertaken to give an MOT, so to speak, to animal exportation. May I refer the Minister to article 3 of EU Regulation 1/2005, which states:

“No person shall transport animals or cause animals to be transported in a way that is likely to cause injury or undue suffering to them.”

Until we undertake the MOT review that my hon. Friend mentioned, we cannot know whether that regulation is being complied with. I suspect that on almost every occasion undue stress or injury is likely to be caused to the animals concerned. We cannot refute that until a review has been undertaken.

No, I do not agree with the hon. Gentleman. Yes, he is right to read out that article. The legal requirements that the EU sets down for transport have to be in compliance with it. I believe—I will always look to see whether we are right in this belief—that if the legal requirements laid down in the EU welfare and transport legislation are observed, there is a satisfactory level of protection for the animals being transported. It is a highly regulated trade, subject to multiple levels of official controls. There are significant and specific, but I think justified, requirements on the farming and haulage industries. The EU Commission estimates that on average it costs nearly €12,000 to upgrade a vehicle for long journeys, and there are other significant costs.

There is already a regulatory framework. My task is to make sure that movements within this country comply with those regulations, and that we have the framework to make sure that that is the case each and every time. Where it is not the case, as it would appear may have happened recently—I have to couch what I say in careful terms—we take the appropriate actions.

Those controls include the need for all commercial transporters of animals to be authorised. For long journeys, vehicles must be inspected and approved. Drivers must pass a competency test. For long journeys of more than eight hours between member states, transporters must apply for a journey log providing details of the proposed route from point of departure to point of destination. The timings of the journey must be realistic and in line with the maximum journey times and with the compulsory rest periods laid down in the legislation. Once the journey has been completed, the journey log has to be returned and the Animal Health and Veterinary Laboratories Agency, which has been mentioned many times in the debate, checks to make sure that there have been no infringements of the legislation during the course of the completed journey. If there have been infringements, AHVLA will take the appropriate enforcement action.

Somebody—I am afraid I do not remember who—suggested that that was a passive arrangement. It is not. I do not have the power to order my inspectors to inspect French vehicles on French roads or Spanish vehicles on Spanish roads. What I can do is make sure that the UK legislation, which is consistent with European legislation, is enforced rigorously. It must be observed.

One of the first situations I faced after taking up this post was the regrettable events of 12 September at the port of Ramsgate. There were serious consequences, as has been well reported, with 40 animals having to be humanely killed. That led me to look very closely at what could be done to ensure the most rigorous and robust enforcement of the existing legislation in this country, and I am absolutely committed to doing that.

The first thing I did was ask AHVLA to undertake a review of its existing procedures with a view to making the necessary improvements to ensure that, as far as possible—I was asked earlier to give this commitment—the events of 12 September would not be repeated. I have been given the review and accepted its conclusions, the vast majority of which, I am pleased to say, have already been implemented. As I have made plain publicly, and as other Members have said today, essentially I am asking for zero tolerance of lapses in animal welfare standards and rigorous checks on all journeys where there is a risk that we can identify.

The hon. Member for Bristol East (Kerry McCarthy) asked about a fit and proper person test—[Interruption.] She is looking dubious, so obviously I have misrepresented her. I apologise and will let her have the credit anyway, even though it was my hon. Friend the Member for South Thanet who raised the matter. I think that it is crucial to our understanding of what is and is not within the powers. There is no test in those precise terms, but article 10 of the regulation sets out the circumstances in which the competent authority can refuse to grant authorisation. Basically, that is when the applicant has a recent record of serious infringements of laws relating to the protection of animals, and that includes proving that the applicant has appropriate facilities.

If, after authorisation, a transporter authorised in the UK commits offences, we can withdraw their authorisation. With regard to transporters authorised in other member states, we can report them to the equivalent competent authority and it should take action. Independently of that, we can prevent a transporter authorised by another competent authority operating here, but we obviously cannot stop them operating elsewhere. Those are important provisions that will come into effect, and I will use them when someone has been convicted of animal welfare infringements, but I make the point that they have to be convicted in a court of law; I cannot do it on the basis of suspicion or anecdotal evidence.

I enjoyed my visit to Northwich and pay tribute to all who have worked so hard to put the town straight after a difficult time in the floods. We are working with a range of agencies, including the insurance industry, to ensure that floods cause as little disruption to people’s lives as possible.

In a press statement issued earlier this year outlining the £120 million of additional funding that would be made available for flood defence work, the Secretary of State mentioned Derby. Some 2,000 households in Chester Green and Darley Abbey are at risk of flooding. The city council has an excellent scheme of flood defence works. Can he outline the percentage that would be expected from the city council to get those works under way?

That is an interesting question. Yes, I will look at that in detail. At the moment, the NFU is probably thinking of carrying on in the two areas where it has put in such a lot of work and preparation, but I am open to looking at other areas. We want to pull off two pilots that show that this system, in a bigger area and with a more efficient system of culling, does work and does reduce TB.

Ministers constantly lecture us about the need for their counter-productive austerity measures, so how can the Secretary of State justify earmarking £250,000 for post-mortems on dead badgers following the cull? Is that not a colossal waste of money and an example of an omnivore-shambles?

I start by expressing my sympathy for the Minister tonight. It can never be much fun doing the late night Adjournment debate, and I am fairly sure that this is not an issue dear to his heart.

This is the first time that world vegan day has been marked in Parliament. The chefs have also done a sterling job, with vegan dishes in the main restaurants on the parliamentary estate every day this week. Earlier today, the Vegan Society event was swamped by MPs and staff lured there by the promise of free vegan cupcakes. The cakes came courtesy of the award-winning Ms Cupcake, who has just won contracts to supply her cakes to the Olympics and Paralympics, not because her cakes are vegan but because they are delicious.

As a vegan of nearly 20 years’ standing, I am very fortunate to represent a seat in Bristol, because it not only plays host to the largest vegan fayre in Europe each year but has some great restaurants and shops catering for vegans, such as Cafe Kino, Cafe Maitreya, Wild Oats, Better Foods and the Sweetmart. I am pleased to be joined tonight by my vegan comrades, my hon. Friends the Members for Derby North (Chris Williamson) and for Kilmarnock and Loudoun (Cathy Jamieson). We are apparently the largest vegan caucus in the world.

In response to a survey by the Department for Environment, Food and Rural Affairs in 2007 on public behaviour and attitudes towards the environment, about 2% of respondents said that they were vegan. The number of converts is growing. The former fast-food lover Bill Clinton has adopted a vegan diet for health reasons, saying that previously he had been playing Russian roulette with his health, and last week both Ozzy Osbourne—the man who used to bite the heads off bats—and Russell Brand announced that they had decided to become vegan after watching the film “Forks Over Knives”. Other celebrity vegans include Joaquin Phoenix, Alicia Silverstone, Ellen DeGeneres, Carl Lewis, Woody Harrelson, Bryan Adams, Chrissie Hynde, Alanis Morissette, Benjamin Zephaniah and even Mike Tyson—so when people say to me, “You don’t look like a vegan”, I am not quite sure what they mean.

A vegan diet means not eating meat, fish, dairy, eggs or products derived from them. Ethical vegans also avoid wearing leather, wool and silk, and buying or using products that are tested on animals or contain animal products. I think that it is a personal choice how far people want to take it, and some vegans are much stricter than others, which is fine.

Among the many prejudices against vegans is the belief that they are always preaching to others and trying to convert them. I do not think that is true; we are incredibly tolerant. We are always polite when others ask, “Don’t you ever get tempted by a bacon sandwich?”—as the Whip did to me only a moment ago—and we always pretend that we have never heard anyone tell the “Spock from Star Trek vegan/Vulcan” joke before, even though we hear it practically every day. In fact, most vegans I know are rather coy about explaining why they are vegan, mostly because the question tends to be asked when we are sitting a dinner table full of meat eaters, and it seems rather impolite to answer. However, seeing as we are not at a dinner party now, here is the ethical case, the health case and the environmental case for being vegan.

If people are vegetarians for ethical reasons—because they believe that killing and eating animals is wrong—they really ought to be vegan, too. The average human eats more than 11,000 animals in his or her lifetime, but millions of calves and chicks are also killed every year as “waste products” of milk and egg production. I confess that, for me, it took a long time for the penny to drop that cows are not constant milk-producing machines. Just like every other animal, including human females, cows produce milk only to nurse their young. The dairy industry means artificially forcing loads more milk out of cows—10 to 20 times more than they need to feed their calves, with their huge udders causing painful mastitis and lameness—and taking their calves away early, or, in the case of male dairy calves, which are useless to the dairy industry, either shooting them at birth or exporting them live to the rest of the EU for the veal trade. The average lifespan of a dairy cow is six years, compared with a natural lifespan of 20 to 25 years. Some 100,000 male calves a year are deemed a surplus by-product on Britain’s dairy farms because they cannot give birth or produce milk. An undercover investigation by the Bristol-based vegetarian campaign Viva! showed a calf taken from its mother and shot in the head at Halewood Gate dairy farm near Bristol, which supplies milk for Cadbury—something that was reported in The Sun of all places.

Hens are forced to lay 20 times as many eggs as is natural for them. Male chicks are useless to the egg industry. Millions of day-old chicks are killed, with many thrown alive into mincers—known as “homogenisers”. This also happens in free-range and organic systems, despite their claims to be cruelty-free. I have previously raised with the Minister my concern that, having made progress in areas such as banning battery cages, this country is now moving to embrace industrial-scale intensive farming, with the Nocton dairy mega-farm, housing thousands of cows in something that resembles a multi-storey car park, and the huge pig farm planned in Foston, Derbyshire, with more than 20,000 pigs and piglets. I know the Minister’s views on that well, so I will touch on it only in passing.

Does my hon. Friend agree that the case for eating less meat or becoming vegan is reinforced by the fact that major companies are buying up vast tracts of land in developing nations to grow grain for animals, displacing subsistence farmers from their land? When 2 billion people on this planet are going hungry every night, would it not be better to use the food that we produce more efficiently by feeding it directly to human beings, rather than to animals, which is an inefficient way of using land?

The hon. Lady is saying something from a sedentary position—I will need to get this on the record, Mr Speaker—about cows on top of each other. There is no such question. The proposal at Nocton, which is now dead as a proposal anyway, did not involve a multi-storey facility. It does not do the cause any good to exaggerate like that.

I hope I can answer some of her questions. As she said, some of them have strayed a little from my brief. I think many of the answers are in the Foresight report, which was the Government’s chief scientific adviser published in January this year. That is all about the future of food and farming. It looks not just at the UK, but at the global demand and supply for food over the next 30 or 40 years up to 2050. We are having this debate on the day after the 7 billionth person was born on this planet; it is quite right to think about the security of our food supply across the globe.

There is no doubt that, as the Foresight report made clear, the current food system is consuming the world’s natural resources at an unsustainable rate. I agree with the hon. Lady about that. At this rate we will continue to degrade our environment, compromise the world’s capacity to produce food in the future, and contribute to climate change and further destruction of our biodiversity.

The status quo is not an option, which is why we in DEFRA have put the importance of sustainable food and farming at the forefront of what we are doing. It is the first priority of our business plan. It underpins everything. We are looking at the food chain in its entirety, with the aim of helping to secure an environmentally sustainable and healthy supply of food and creating the conditions for the agri-food sector to succeed. The Foresight report—this is relevant to one of the hon. Lady’s questions—highlighted the significance of dietary changes to the sustainability of our food supply, given that, as the hon. Lady rightly said, some foods require more resources for their production than others. We all need to play our part.

The most important people in all this are consumers. As the hon. Lady suggested, they can best be helped to make the choices that they want to make when they are receiving consistent messages about what constitutes a sustainable balanced diet, and, indeed, what the products that they are purchasing contain. By providing a robust evidence base, we can work closely with a wide range of partners to try to ensure that they are given that information.

The issue of diet is complex. Across the world, cultural, social and religious factors influence the make-up of what we eat. The Government do not believe that we should undermine those influences. We see value in encouraging people to think carefully about the environmental impact of the food they eat. Groups such as the Vegan Society provide information for consumers and help to increase their knowledge. However, we also need to recognise that a vegan diet is not for everyone.

I must tell the hon. Lady that I was a bit confused about whether she was advocating veganism, was concerned about animal welfare, or was simply recommending a balanced diet involving a lower proportion of processed meat—with which recommendation, incidentally, I would entirely agree. We know that there are recommendations suggesting that people should not eat too much processed meat. However, that is a long stretch from the more extreme position of a vegan, which, as the hon. Lady said, means eating absolutely no products of animal origin. There is a great difference between the two positions. The Government recommend a balanced diet. We are not going to tell people what or what not to eat; we want people to be given information that will enable them to make informed choices.

The hon. Lady raised the issue of food labelling. As she knows, we are committed to improving it: that has been one of our prominent policies both in opposition and in government. As she also knows, there is currently no definition in law of the term “vegan”, and labelling products as vegan is entirely voluntary. However, if such labelling is used, consumers are protected by the law, because it is illegal to mislead them through false or misleading labelling. A new European Union regulation on the provision of food information to consumers will be published in the next few months, and will then enter into force in all member states. It covers the rules for general food and nutrition labelling, and requires the European Commission to draft a set of measures governing use of the terms “vegetarian” and “vegan”. I hope that that reassures that the hon. Lady that the issue is being, and will continue to be, addressed.

The Government’s promotion of advice on a balanced diet applies to vegetarians and vegans as well as to those who eat much more livestock products. A well-planned diet based on anything can be healthy as long as it contains the right balance of foods. The main issue that we face is, of course, obesity, which is a leading cause of serious diseases such as type 2 diabetes, heart disease and cancer. It also costs the national health service £5 billion a year. The Government’s recently published document “Healthy lives, healthy people: a call to action on obesity in England” sets out how obesity will be tackled in the new public health and NHS systems, and the role that partners can play. Obesity is a serious problem, and it is the responsibility of individuals to change their behaviour to benefit their health. Most of us are eating or drinking more than we need to, and we are not active enough. Being overweight or obese is a consequence of eating more calories than we need.

The Minister says that diet and avoiding obesity are the responsibility of individuals. Does he not accept that companies such as McDonald’s ruthlessly and specifically target young children in order to force on them a diet that is wholly unhealthy and contributes considerably to the obesity crisis that the nation is currently experiencing?

No, I do not accept that. The hon. Member for Bristol East reeled off a list of vegan organisations, businesses and retailers in Bristol. They all have a right to advertise their wares as long as they are selling something that is lawful. I do not believe that it is for Government to tell them they should not do so.

What matters is that we encourage people to reduce the amount of calories they consume, in whatever form. As part of the Government’s ongoing Change4Life campaign, we are encouraging people to make the key simple changes: eat more fruit and vegetables; cut down on fatty foods, particularly unsaturated fats; reduce calorie consumption; and, of course, be more active.

I cannot confirm the location of pilots yet because the industry has not made such proposals to me. It is important to define pilot areas with boundaries so that the perturbation effect can be minimised.

I think that the Secretary of State has a curious way of showing her love for badgers and her desire to protect them—by introducing a new blood sport. I hope that the pro-blood sport influences on the Government Front Bench are not behind this decision. Does she accept that culling badgers will not solve this problem? The scientific evidence suggests that it will actually increase the likelihood of bovine TB. Bad husbandry can be a reason for the spread of bovine TB, too, so will she explain to the House why she is rejecting the scientific evidence suggesting that a cull will not work?

Nature conservation includes the controlled reduction of species in nature. I am sure that the hon. Gentleman would give me that as a fact. I beg to differ, however, on the science. The randomised badger culling trial showed in the initial period that if the badger population is controlled within a confined area under controlled conditions, the population is reduced and a significant reduction in TB breakdown of herds can be achieved. The subsequent outworking of that trial shows that that benefit lasts.

I am grateful for my hon. Friend’s thanks to the officials in my Department, who have worked extremely hard, and to those in the MMO, who have worked tirelessly. However, fishermen in her area and many others up the east coast should be grateful to the MPs concerned, who have lobbied me very hard on those issues. My hon. Friend is absolutely right. There is a three-phase approach to dealing with this problem. First, we want to keep fishermen in business, which involves swapping quota where we can and working on a short-term basis so that they can continue to fish. Secondly, we need to look at the recommendations of the sustainable access to inshore fisheries project, which has come up with some really good suggestions on which we want to consult widely. Thirdly, however, the CFP is in desperate need of reform. The door is open to the kind of reforms that would be appreciated, I believe, on both sides of the House. I want to work with my hon. Friend and other Members who represent fisheries communities to ensure that we have a CFP that is fit for purpose for our times.

The coalition Government are committed to achieving high standards of animal welfare and are working through the detail of several policies to ensure that we accomplish this.

Does the Minister’s refusal to name a date for the abolition of beak trimming not demonstrate the Government’s failure to prioritise animal welfare?

That is complete nonsense. As the hon. Gentleman should know, the date is already enshrined in law. The question is whether we seek to change that. To suggest that I have not set a date is nonsense, because his Government set that date. But we are considering representations, as did my predecessor, about whether to change that date. One of the underlying factors, not just on this but throughout animal welfare, is the advice of the Farm Animal Welfare Council, which is the body set up to advise the Government, and I think the cross-party view is that it is a very worthy organisation. We take its views strongly into account as we consider this matter.
