I fully understand and respect the sentiments that the hon. Member so powerfully expressed in his remarks. On the timing and the years that have passed since the bishop’s report, for much of that time there were ongoing legal proceedings and, of course, no one wanted to prejudice those for obvious reasons. That accounted for about four years—from 2017 to about May 2021—but about 21 months have passed since then and I agree that the Government response does need to come out quickly. Indeed, since my appointment a couple of months ago I have asked for it to be sped up, and I want to make sure that that happens this spring, following, of course, consultation with the families, which is extremely important. That will include responses to the points that the hon. Member made.

I reiterate that the statutory changes made to the professional standards for policing in 2020 include a duty of co-operation on police officers in relation to inquiries, which, as he has said, is very important. He is right: we do need to get on and respond comprehensively to the bishop’s recommendations, which is what I am working on.

The apology from the police is, of course, welcome, but it would have been far better for them to have done their job properly on that fateful April day, 34 years ago. If they had done so, families of the 97—and, indeed, the whole Liverpool community—would not have gone through the suffering and anguish that they have had to bear over the past 34 years.

Let me say first to my right hon. Friend that I do not think saying vaguely that the Government’s response will be available this spring is good enough: five years on, they must now publish it. Secondly, does my right hon. Friend agree that one of the elements that can be put in place to help families if, sadly, such an event—a tragedy of this sort— happens in the future is the introduction of an independent public advocate, which was promised in the Conservative party manifesto in 2017? Will he give a commitment now that the Home Office will not put any barriers in the way of the work of the Ministry of Justice in introducing such a body?

As I mentioned, for approximately four years following the publication of the report there were ongoing criminal legal proceedings which nobody wanted to prejudice, but, as I have said in the House and as the Home Secretary said yesterday, we do now want to get on and respond quickly and comprehensively to the bishop’s report. As for the introduction of an independent public advocate—a measure being worked on by the Ministry of Justice, as the right hon. Lady said—a public consultation has taken place. The response is being worked on in the usual way, but it is happening at pace.

Q11. Five years ago, my constituent Barry Bednar’s 14-year-old son Breck was brutally raped and murdered. The perpetrator is now serving a 25-year prison sentence. However, in recent months, the victim’s family, including his teenage sister, have received repeated distressing and disturbing communications on Snapchat purporting to be from the perpetrator, graphically recounting the circumstances of the murder. The police have asked Snapchat to provide the data that would help them definitively identify who has been sending those messages—for example, data about the device from which the messages were sent—but Snapchat is referring the police to a mutual legal assistance treaty with the United States, and the police would have to go through a one-year process to get that vital data for their investigation. Does the Prime Minister agree that that is completely unacceptable? Will she join me in calling on Snapchat and other social media companies to promptly co-operate with police inquiries? If they do not do so, does she agree that legislation is required?

The case that my hon. Friend raises is one of great concern, and I know that Members across the House will want to join me in sending our sincerest sympathies to Breck’s family. I would like to take this opportunity to pay tribute to Breck’s mother for her brave and powerful campaigning on the wider issue of internet grooming.

The Ministry of Justice has assured me that it is urgently looking into this issue, and I am sure it will update my hon. Friend as soon as possible. I agree with him; we want social media companies to recognise the responsibility they have and to work with law enforcement agencies. I know that my right hon. Friend the Home Secretary has written to my hon. Friend, to meet him and hear more from the family. It has become increasingly difficult for UK law enforcement to access data containing information on threats to UK public safety if it is held or controlled in other countries. That is why the Government recently legislated—we passed the Crime (Overseas Production Orders) Act 2019, which will give law enforcement agencies the power to obtain electronic data controlled by providers outside the UK where an international agreement is in place. He mentioned the United States; we expect to establish the first such agreement with the United States.

As I said earlier, I have not discussed an extension of article 50 with other leaders around the European Union table. However, the European Union—in the form of the EU Council and the European Commission—has made it clear that it would expect any extension to be on the basis of a clear agreement that there was a plan for achieving the deal. I want to ensure that we can achieve the deal before we get to that point, and if the hon. Lady is worried about uncertainty in the House, it is very simple: vote for the deal.

I voted remain in the referendum but, just like the right hon. Member for Don Valley (Caroline Flint), I completely accept the result and the fact that I stood on a manifesto committing me to implement it, but the official Opposition have dishonoured their own manifesto with the U-turn that they announced yesterday. Despite its imperfections, I also accept that the currently proposed withdrawal agreement is the best way we have of implementing the referendum result, so the Prime Minister can expect my support in the Division on 12 March. However, if that is not successful, an extension strikes me as unlikely to lead to any change. Given that we have ruled out a referendum, the only remaining way of honouring the referendum result is to make a transition to WTO terms. Should the House not confront that choice now and be prepared to make that decision?

I thank my hon. Friend for the commitment he has given. I say to him, as I have said to others, that it is the case that, when we come to look at the changed withdrawal agreement, it will be necessary for every Member of this House to ask themselves whether they want to honour the result of the referendum and, in honouring the result of the referendum, whether they wish to do so by leaving with a deal. That will be the opportunity available to Members of this House when we bring back a meaningful vote and I hope that Members on both sides of the House will vote for a deal, to leave and to honour the referendum.

The right hon. Gentleman is a fine one to talk about coming together, when it was only last night that he agreed to actually meet me to talk about these issues. Time and again, he has told me to listen to the views of the House. He has just stood up and said that the backstop is not the only issue in the withdrawal agreement, but last night the house voted by a majority to say that the issue that needed to be addressed was the backstop, so he needs to listen to the House and to recognise that. He put forward a proposal last night that referenced the customs union and the single market, but his proposal was rejected by this House. I will tell him what this Government have been doing. Over the past week, we have been getting more teachers into schools, we have been ensuring that we are giving more money to councils and we have won a majority on Brexit. What did he manage? His Brexit plan was voted down, he opposed ending free movement and he will not rule out a second referendum. He has no plan for Brexit, no good plan for our economy and no plan for our country.

Q10. First- time buyer numbers, which collapsed under the last Labour Government, are now at a 10-year high thanks to initiatives such as Help to Buy and the first-time buyer stamp duty cut, but there are still many people in their 20s and 30s who want to buy their own home. Will the Prime Minister join me in asking local authorities to use their existing powers when they grant planning consents to ensure that as many properties as possible are designated as starter homes or discount market sales homes, to help those people in their 20s and 30s to realise the dream of home ownership?

My hon. Friend raises an important issue and points out not only the good news of the 10-year high in the number of first-time buyers but the opportunities available for local authorities to provide for this. We are clear that the planning system has a key role in delivering more affordable homes, and the national planning policy framework, which was revised last year, is central to that. It includes a wider definition of affordable housing, and local authorities are expected to consider the new definition—which includes starter homes and discounted market sales homes—in identifying the types of housing their communities need. There is an expectation that major developments will make a minimum of 10% of homes available for affordable ownership, including starter homes and discounted market sales homes. We have made good progress on first-time buyers, but there is more for us to do and this Government are doing it.

The right hon. Member for Exeter (Mr Bradshaw) is encouraging me not to take so many interventions and to get on with my speech.

We are building a country that works for everyone, but there is much more to do, including: investing in our industrial strategy so that we are creating the jobs of the future in all parts of our country, not just London and the south-east; delivering our long-term plan for the NHS, to which my right hon. Friend the Member for Ludlow (Mr Dunne) has just referred, so that our most precious institution is equipped for the future; tackling the lingering injustices that for too long have blighted the lives of too many people, including women being paid less than men, mental health not being treated with the same seriousness and resource as physical health, a criminal justice system that has poorer outcomes if you are black than if you are white, and an education system that has left white working-class boys as less likely to go to university than anyone else. These are issues that we need to tackle, and the mission of this Government will not stop.

This is a Government building a country that is more prosperous, a country that is fairer and a country that works for everyone. With the confidence of this House, we will go on delivering for Britain, driven by a passionate belief in doing what is right for our country and right for our people, acting not in self-interest but in the national interest. That is the simple mission that has underpinned our approach to the Brexit negotiations.

As we enter the next stage of that process, I have made it clear that I want to engage with colleagues across the House. The question now is whether the Labour leadership will rise to the occasion, but I fear the answer is no. As the Labour leader himself has indicated, Brexit is the biggest issue that the House and the country have faced for generations. It demands responsible leadership and pragmatic statesmanship from senior politicians. The Leader of the Opposition, as yet, has shown neither. His failure to set out a clear and consistent alternative solution to the Brexit question is the third reason that this House should comprehensively reject this motion.

The shadow Brexit Secretary has described Labour’s position on Brexit as one of “constructive ambiguity”. I think that the shadow Trade Secretary called it something slightly more succinct but definitely not parliamentary, and I therefore cannot repeat it. I call it not being straight with the British people. For more than two years, the Leader of the Opposition has been either unable or unwilling to share anything other than vague aspirations, empty slogans and ideas with no grounding in reality. When the President of the European Commission said that Labour’s Brexit ambitions would be impossible for the European Commission to agree to, the right hon. Gentleman simply shrugged and said, “That’s his view. I have a different view.”

Last night, just for a moment, I thought the Leader of the Opposition might surprise us all, because he told this House that it was not enough to vote against the withdrawal agreement and that

“we also have to be for something.”—[Official Report, 15 January 2019; Vol. 652, c. 1109.]

Surely that was the moment. That was the point at which, after months of demanding that I stand aside and make way for him, he was going to reveal his alternative. We waited, but nothing came.

The Leader of the Opposition still faces both ways on whether Labour would keep freedom of movement, and he will not even be drawn on the most basic point of all. In PMQs, I referred to the fact that on Sunday, when challenged on whether he would campaign to leave the European Union if there were a general election, he refused to answer that question five times, and he has refused to answer that question in response to Members of this House today. The Government have no doubts about our position. Under this Government, the United Kingdom will leave the European Union and we will respect the decision of the people.

The Prime Minister is quite right to point out the yawning chasm at the heart of Labour’s policy, but the problem is that she also said that we need to come up with a constructive alternative. Speaking to colleagues around the House, it strikes me powerfully that there is one element of the currently proposed deal that, if changed, would make it much more likely to pass: the backstop. Would the Prime Minister therefore consider contacting European Commission officials in the coming days and over the weekend to ask them to make legally binding changes to that backstop, which would mean that the deal would then have a very good chance of passing this House?

No, what I am saying to the hon. Lady—many Members of this House from across the country will also be receiving such responses—is that people are making the point that they voted in the referendum and that they expect Parliament to deliver on the result of the referendum rather than having a second vote.

In the Prime Minister’s statement earlier, in relation to the backstop, she made it clear that she had listened to the views of the House. That is a mark of true leadership, and she has done exactly the right thing. However, she will also acknowledge that, following the Attorney General’s statement last week, many Members of the House, on both sides of the Chamber, have concerns about the legally binding nature of the backstop and the fact that we require European Union consent to get out of it. Does she therefore agree that any changes to the arrangements that are designed to reassure the House must be legally enforceable?

I am well aware of the concerns of the House about the legal enforceability of this issue. What people have been saying is that they want to ensure that the backstop can be brought to an end, and there are various ways in which we can do that. What we will be discussing with the European Union is the whole question of how we can do that in a way that gives sufficient reassurance and confidence to Members of this House that they will not be faced with a situation where they have one aspect of this, which is under one determination, and another aspect, which is less secure. It is about giving that confidence to Members of this House that we will be negotiating.

What was discussed was the importance of ensuring that economic development benefits all people, including those who currently feel that they are not benefiting from it and obviously including disabled people. A number of events around the margins of the G20 also addressed a number of these issues.

The Prime Minister mentioned in her statement the importance of securing free trade deals around the world, yet some Members of this House are proposing the so-called Norway-plus option—membership of the single market and the EU customs union, most likely with a backstop. Does she agree that that would prevent free trade deals from being done, that we would still be paying money in and that there would be unlimited free movement, and will she join me in saying that would be an extremely bad choice for our country?

I am happy to confirm what my hon. Friend has said. That option would indeed mean that we would continue to pay and would have to accept free movement; the Norway-plus model also has the issue of the customs union. We have negotiated a deal that is right for the United Kingdom.

I am sorry to hear that the hon. Lady has been subject to abuse that has led, as I understand from her question, to somebody being charged or to action being taken against an individual. If we are to have good, healthy debate in this country on matters of policy and politics—there will be strong disagreements and strong views held—it is very important that we conduct our discussions in a way that does not lead to abuse. We need to conduct discussions in a respectful manner.

The Prime Minister has been clear today that a second referendum is not on the table because we must respect the views of the 17.5 million who voted to leave, but is there another reason why it is inappropriate to have another referendum with remain on the agenda: it would prejudice our negotiations by creating an incentive for the European Union to give us an extremely bad deal?

My hon. Friend is absolutely right not only that we owe it to the 17.4 million people who voted to leave the European Union, but that it needs to be very clear to the European Union that we will be leaving and that there is no question of that second referendum. That was why I was surprised that the shadow Foreign Secretary has said today that, if there were a second referendum under Labour’s proposal, remain could be on the ballot. That is going back on the vote that people gave in 2016.

The European Union’s negotiating position on the Irish backstop appears to imply that the only way it can believe we could avoid a hard border is by maintaining a customs union. Does the Prime Minister join me in rejecting that premise? There are two ways to avoid it: one was outlined in July’s White Paper; and the second is evident from studying the Swiss-French border, which crosses the customs union—there are different arrangements on the single market—where there is pretty much no infrastructure on most A-roads, barring a little French sign and a single camera of a kind seen on most high streets.

I do believe there is a way to ensure that we avoid a hard border between Northern Ireland and Ireland, and it is by having an arrangement with the European Union on frictionless trade—that is a customs arrangement that does not include us as part of the customs union.

Q7. When it comes to Brexit, the joint statement of 8 December last year said that“nothing is agreed until everything is agreed”.Does the Prime Minister agree that this means that the payment of the £39 billion exit payment and the Northern Irish backstop are dependent on agreeing satisfactory final-state trade arrangements? Does she also agree that payment of that money should be locked into the legally binding withdrawal agreement, which also requires those final-state trade agreements to be fully agreed and implemented by 31 December 2020 in a form acceptable to this House?

We are very clear that we need to have a link between the future relationship and the withdrawal agreement, but we are a country that honours our obligations. We believe in the rule of law, and therefore we believe in abiding by our legal obligations. However, my hon. Friend is right that the specific offer was made in the spirit of our desire to reach a deal with the European Union and on the basis, as the EU itself has said, that nothing is agreed until everything is agreed. Without a deal, the position changes.

First, may I say to the hon. Lady how very good it is to see her in her place in this House? [Hon. Members: “Hear, hear.”] And I know from the response that that view is shared across the whole of this House.

The hon. Lady raised an issue to do with the NHS and Ormskirk hospital. As she will know, we are putting extra funding into the national health service: £20 billion a year in real terms by 2023-24. We will have funding available not just to build sites but, as she says, to improve current and existing facilities across the country. On Ormskirk hospital, I understand the Northern England Clinical Senate has issued a report making proposals around the provision of emergency services there. No decisions have been made—that is a matter, of course, for the NHS—but as we look to the long-term plan, I want NHS clinicians to come forward with the best proposals for patients and to take account of local interests such as those the hon. Lady has raised.

Q10. Around the world Christians are facing a rising tide of persecution and violence. Does the Prime Minister share my concern at this trend and at particular cases such as those of Sunil Saleem, a Christian man who was beaten to death at a hospital in Lahore in Pakistan, or 33 women in Eritrea who were imprisoned simply for praying? In this country we rightly protect religious freedoms; will my right hon. Friend step up efforts to get other countries to similarly respect religious freedoms?

As a Government we stand with persecuted Christians all over the world and will continue to support them. It is hard to comprehend that today we still see people being attacked and murdered because of their Christianity, but we must reaffirm our determination to stand up for the freedom of people of all religions and beliefs and for them to be able to practise their beliefs in peace and security. I am very pleased that I have been able to appoint the noble Lord Ahmad as the Government’s special envoy on freedom of religion or belief, and he will certainly be doing what my hon. Friend suggests: working with other countries to encourage them to recognise the importance of allowing people to have the freedom to practise their religion and beliefs in peace and security.

Separate bodies are not required to ensure that the Government are delivering high environmental standards. The Government are committed to them and the hon. Lady will see us continuing to be so.

The Chequers agreement delivers on the referendum result and lays the foundations for future trade. Anyone who truly has the nation’s interests at heart should support it. However, when it comes to the negotiations, does the Prime Minister agree that nothing is agreed until everything is agreed, and that we will therefore not sign a £39 billion cheque until we get some assurance that the Chequers agreement, or something very similar to it, will be agreed to?

It was the European Union that used the phrase

“nothing is agreed until everything is agreed”.

The Government have been clear that when we come to finalise the withdrawal agreement we need not only sufficient detail on the future relationship, but a linkage between the two. It is a package. They are not separate issues.

As I said earlier in response to a question, of course if there is a suggestion of criminal activity, it will be a matter for the police as to any investigation that would be undertaken. The question whether or not electoral laws have been met is of course a matter for the Electoral Commission, but as the right hon. Gentleman might recall, from the police’s point of view, they have operational independence, and it is not for politicians to tell the police what to investigate.

The Prime Minister referred in her statement to malign state influence. Presumably, that would include Russia shooting down flight MH17, invading a neighbouring country, sponsoring its client state to commit a chemical attack and interfering in foreign elections. Does the Prime Minister intend at the European Council at the end of June to press our European partners to strengthen and expand the range of economic sanctions that we have imposed against Russia?

I have already raised with European partners whether the European Council in June should look not just to the question of the sanctions in relation to the Crimea and Minsk agreements, but also to whether we should look further. Indeed, there are some issues that have arisen in relation to Crimea where I think that we should be looking at whether some further sanctions are required.

What we are talking about in relation to what has happened in Syria is the use of chemical weapons. Chemical weapons are prohibited—they are illegal—yet we see a Syrian regime that has continued to use those chemical weapons over a number of years. It is important that the international community has come together and said that we will not accept this use of chemical weapons. We must return to a situation in which people accept that the use of chemical weapons is prohibited. We have taken this position to alleviate the humanitarian suffering that comes from the use of chemical weapons, and we continue to support the work that will be necessary to ensure the continued prohibition of the use of these weapons.

I commend the Prime Minister for her calm and well-calibrated response to this situation. Some Opposition Members have questioned the decision to proceed without a vote. Does she agree there are circumstances in which we need to act without a prior vote? If the speed of military or diplomatic movements on the ground make it impossible, if the disclosure of intelligence to the House would make it impossible for the House to make a decision, or if such disclosure would give adversaries a sense of the scope, scale and timing of what is going to happen—if one or more of those conditions applies, it is neither reasonable nor necessary to seek the House’s consent first.

My hon. Friend speaks appropriately about the need to ensure, when one is looking at taking action, that that action can be effective, that nothing is done that reduces the effectiveness of that action, that the action is taken on the basis of intelligence—not all intelligence is able to be made available to everyone—and that we respect and recognise the need to maintain the security and safety of our armed forces personnel.

The hon. Gentleman talks about funding for local councils. Of course, we have heard in the announcements by my right hon. Friend the Secretary of State for Housing, Communities and Local Government that more money is going into local councils over the next couple of years. If the hon. Gentleman worries about what is happening at local council level, he ought to look at the figures that have come out today, which show very clearly that if you live in an area where the council is run by the Labour party, you pay £100 more than under the Conservatives.

Q10. Will the Prime Minister join me in welcoming the recent figures that show that last year the number of first-time home buyers hit a 10-year record high of 359,000? Does she agree that last year’s stamp duty cut and the extension of Help to Buy played an important part in that? Does she agree that promoting home ownership, as Margaret Thatcher did, will remain a central part of the Government’s policy?

I am very happy to confirm to my hon. Friend that promoting home ownership remains a central part of this Government’s policy. We are also introducing a number of measures that will help people who rent their properties. I am pleased, as he said, that the number of first-time buyers has reached its highest level for—he said 10 years, but I think it is 11 years. Of course it is important that we provide funding for Help to Buy, but that cut in stamp duty was also important. The Labour party sometimes talks about homes, but which party was it that voted against that cut in stamp duty? The Labour party.

As I indicated in the previous debate on the statement, my right hon. Friend the Home Secretary is looking at the question of the tier 1 investor visa and its operation. The hon. Gentleman refers to some of the specific work that we have been doing. As he will know, we have already taken, and are taking, some steps that are world-leading in relation to some of the registers and their transparency, particularly in relation to property. Of course, we continue to look at any further steps we can take in this area.

I would like to make just a little more progress.

We have given our law enforcement agencies new powers in the Criminal Finances Act 2017, and we will table an amendment to the Sanctions and Anti-Money Laundering Bill to ensure that the UK cannot be a home for those who trade illicit finance or commit human rights abuses.

Crucially, because this threat from Russia is an attack on the whole international rules-based system and the collective security of the UK and its allies, we must continue to work closely with all our international partners—including through the new security partnership we want to build with the European Union as part of our new relationship after we have left. As I said in my speech in Munich, when we leave the EU, it is right that the UK will pursue an independent foreign policy, but around the world the interests that we will seek to project and defend will continue to be rooted in our shared values. Nowhere is this more true than in standing up to Russia’s hostile actions and refuting its attempts to undermine the international rules-based order.

As President Macron said on Friday, Russia’s actions in Salisbury were an act of

“aggression against the …sovereignty of an ally…which demands a reaction.”

As I set out in my statement earlier, the EU and its member states have already taken some immediate actions, including withdrawing the EU’s ambassador from Moscow. As I announced today, 18 countries have announced their intention to expel more than 100 Russian intelligence officers, including 15 EU member states as well as the US, Canada, and Ukraine. I repeat that, as I said earlier, this is the largest collective expulsion of Russian intelligence officers in history.

If the Kremlin’s goal is to divide and intimidate the western alliance, its efforts have spectacularly backfired. Today’s actions by our allies clearly demonstrate that we all stand shoulder to shoulder in sending the strongest signal to the Kremlin that Russia cannot continue to flout international law and threaten our security. As I argued at last week’s European Council, we must reappraise how our collective efforts can best tackle the challenge that Russia poses. But we must and will proceed on a rigorous and legally sound basis, which is why the Council mandated Foreign Ministers to consider how best to proceed and to report back ahead of the next Council.

Given the catalogue of outrages that the Prime Minister has outlined, could she confirm to the House that the measures to be considered by Foreign Ministers in due course will include the possibility of sanctions either against the wider Russian economy or against individuals close to the Putin regime?

We have asked Foreign Ministers to look at what steps they think it is important for us to take. We, as the UK, have already been at the forefront of the economic sanctions that have been put in place in relation to Russia following the illegal annexation of Crimea, and of course the European Council will want to be looking at those sanctions for the future.

I congratulate the Prime Minister on the progress that was made last week, and on once again confounding the naysayers and the doom-mongers. I also welcome the comment in her statement about the need for clarity on the terms of the final trade agreement by October. How can we avoid the risk that we end up signing a legally binding exit agreement before we sign a legally binding final-state free trade agreement, given that nothing is agreed until everything is agreed?

There is a legal difference between those agreements. It is not possible legally to sign the new free trade agreement until we are outside the European Union, whereas of course the withdrawal agreement will have to go through Parliament and through the European Parliament before we leave the European Union. As I have said—my hon. Friend alluded to this —it is important that we have sufficient detail, and agreed detail, on that future relationship, so that everyone knows what it will be at the time at which they are asked to look at the withdrawal agreement.

The Prime Minister was right to point out that this is simply the latest act by a criminal rogue state. We remember the Malaysia Airlines jet that was shot down, the invasion of Crimea and the support for the murderous regime in Syria. I fully support her position, and I am horrified by the statement that has been read out on behalf of the Leader of the Opposition’s spokesman. I should like to add my voice to those who have asked the Prime Minister to look quickly and seriously at financial sanctions for individuals closely associated with the Putin regime, as well as for the wider Russian economy.

Recent reports have suggested that the European Commission is asking that we enter into certain limited, legally-binding agreements in relation to bits of our exit in isolation. Will the Prime Minister confirm that it remains the Government’s policy that nothing is agreed until everything is agreed, and that we will therefore only enter into a legally-binding agreement in relation to the entire exit agreement, not just parts of it?

My hon. Friend is right. It was reflected in the joint report published in December that nothing is agreed until everything is agreed. The negotiations that are now taking place are to put greater detail into the definition of the implementation period, and we expect to do that by the March European Council. Alongside side that, the negotiations will look at the legal basis of the withdrawal agreement. Of course, both the withdrawal agreement and the implementation Bill will have to come to this Parliament for agreement in due course. At that stage, I would expect to have the future relationship set out in a way that means people are able to look at the whole package when they come to make that decision.

The right hon. Gentleman is right about the importance of the talks to restore a devolved Administration in Northern Ireland. I am happy to confirm that we will not be looking at a joint authority. He will be aware that the Belfast agreement includes certain responsibilities in relation to the Government of the Republic of Ireland in north-south co-ordination, but the focus for us all should be on trying to ensure that we can resolve the current differences and see that devolved Administration reasserted in Northern Ireland. That is what would be best for the people of Northern Ireland.

Q7. By refusing even to discuss free trade, does the Prime Minister agree that the European Commission is damaging the employment and economic interests of its own member states? For example, by endangering jobs in the German car industry, for which the UK is the largest export market. Will she call on other European Heads of Government to prevail on the European Commission to end this act of wanton economic self-harm and to start free trade talks, which are so clearly in the interests of everybody?

As my hon. Friend will know, my right hon. Friend the Secretary of State for Exiting the European Union was recently back in Brussels for a further round of negotiations. Those negotiations have been productive and constructive, but of course we want to see the discussions moving on to the future relationship. What the Government have done over the summer, and will be continuing to do, is to publish a set of position papers that set out options and ideas for how that deep and special partnership can be taken forward. My hon. Friend is absolutely right that this is not just a question of what suits the United Kingdom; it is actually in the interests of the European Union to have that good, deep and special partnership.

As I have said, the material is being tested. The results of those tests will be—[Interruption.] The information that the fire service and police are able to give publicly they will give; this is part of the criminal investigation. [Interruption.] It is. Hon. Members may shake their heads, but let me make this point: they want to ensure that if there are criminal charges to be brought, those charges are indeed brought, and we must therefore ensure that we give the police the opportunity to do the job that they undertake and that nothing we do prejudices that.

I welcome the Prime Minister’s commitment to the publication of an early interim report. After the Croydon tram crash last year, the Rail Accident Investigation Branch published two interim reports within three months, which identified the immediate cause of the crash and so action could be taken. Will she assure the House that a similar approach will be taken with this interim report?

I thank my hon. Friend for that. It was very important that interim reports came out quickly in relation to the Croydon inquiry. I can confirm that I fully expect the judge to bring out an interim report. May I say to the hon. Member for Peterborough (Fiona Onasanya) that I am sorry I did not answer her first question about the judge? I would expect within the next few days to be able to announce the name of the judge. We very much want to ensure that when the judge takes charge of this inquiry people feel, as I said earlier, that they can have full confidence in it, and so we are taking steps to ensure that that is the case.

I want to ensure, and this Government want to ensure, good-quality education at every age and every stage for children in this country. That is why we are looking at improving the number of good school places. The hon. Lady talks about my record speaking louder than words, so let me point out that I was very proud as chairman of an education authority in London in the 1990s to introduce nursery school places for every three and four-year-old whose parent wanted them.

Q2. The Prime Minister laid out a clear and bold plan for Brexit in her speech last week. Hon. Members quite rightly want an opportunity to scrutinise the plan. Does the Prime Minister agree that the best way of facilitating that scrutiny would be a Government White Paper laying out our vision for a global Britain based on free trade in goods and services that will be to the benefit of us and other European countries?

My hon. Friend raises the question of parliamentary scrutiny. I have made clear, as have senior Ministers, that we will ensure that Parliament has every opportunity to carry out such scrutiny as we go through this process. I set out that bold plan for a global Britain last week. I recognise that there is an appetite in the House to see it set out in a White Paper—I have heard my hon. Friend’s question, and my right hon. Friend the Member for Broxtowe (Anna Soubry) asked a question in the same vein last week—and I can confirm that our plan will be set out in a White Paper published for the House.

I welcome the hon. Gentleman’s support for free trade. He is absolutely right that as we leave the EU we will be looking for opportunities to develop flexible trading relationships around the world that suit the United Kingdom. Given the strength of our economy, I believe that we can go out there and be a global leader in free trade, and I welcome his support for that.

Last Wednesday, seven people tragically died and 50 were injured in a tram accident in Croydon. I am sure that the whole House will join the Prime Minister, the Leader of the Opposition and the leader of the SNP in extending our heartfelt condolences to the bereaved families. Three investigations—by British Transport Police, the Office of Rail and Road, and the Rail Accident Investigation Branch—are under way. Will the Prime Minister assure the House and the families that any recommendations to improve safety on trams in Croydon and across the country that are made by those investigations will be rapidly implemented by the Government?

I join my hon. Friend in once again sending our condolences to the families and friends of the seven people who died in this terrible incident, in expressing our sympathies for those injured and affected, and in thanking our emergency services. It is important that we allow these investigations to continue and that they can come up with recommendations in due course; we will, of course, look very seriously at them. We can never be complacent about safety and security regarding such issues, so we need to make sure that if there are lessons to be learned, they are indeed learned.

My hon. Friend raises an important point. Many internet service providers, for example, offer services here but they are predominantly based in other countries. That is why the Government have been progressing, and continue to progress, discussions with the United States’ authorities about the whole question of the circumstances under which warrants issued lawfully in the United Kingdom can be exercised in the United States. We have always asserted territorial jurisdiction of those warrants under the Regulation of Investigatory Powers Act 2000. In fact, the previous Labour Government, who introduced RIPA, also established that territorial jurisdiction. It has never been tested, but we are putting that discussion with the United States into place.

The Home Secretary recently met my constituent Barry Bednar, whose 14-year-old son Breck was groomed online and, tragically, murdered. Could she explain to the House how the provisions in the Bill will help to prevent a repetition of Breck’s tragic murder?

My hon. Friend has represented his constituents very well in that matter, and it was an absolutely tragic case. I know the enormous distress that has been caused to Breck’s parents, not just by the initial grooming of their son and its sad consequences, but by other actions that have taken place since in relation to the case. What we are doing in this legislation is important, because it will ensure that the authorities, the agencies, law enforcement and the police will have the powers to enable them better to investigate incidents such as that which led to Breck’s sad death.

Part 1 of the Bill responds to recommendations by David Anderson and others by restricting the use of powers outside the legislation to undertake equipment interference. Where the police or the security and intelligence agencies wish to interfere with a computer or a smartphone to obtain vital evidence and intelligence, a warrant under the Bill will be required. As I have indicated, the Bill also responds to the recommendations of the Intelligence and Security Committee and places a statutory bar on the making of requests, in the absence of a warrant, to other countries to intercept the communications of a person in the UK. There can be no suggestion that the security and intelligence agencies could use their international relationships to avoid the safeguards in the Bill. In answer to a couple of questions earlier I referred to the territorial jurisdiction of the Bill. For the avoidance of doubt, I clarify that I meant, of course, the extraterritorial jurisdiction of the Bill.

The House will know that interception—the obtaining of the contents of a communication, by, for example, listening to a telephone call or reading the contents of an email—is one of the most sensitive and intrusive capabilities available to law enforcement and to the security and intelligence agencies. It is also one of the most valuable, and over the past decade, interception in some form has played a part in every top-priority MI5 investigation. The Bill restricts that power to only a handful of agencies and allows for warrants to be issued only where they are necessary and proportionate for the prevention or detection of serious crime, in the interests of national security or in the interests of the economic wellbeing of the United Kingdom, where that is linked to national security.

Authorising warrants is one of the most important means by which I, the Foreign Secretary and the Northern Ireland Secretary hold law enforcement and the security and intelligence agencies to account for their actions. In turn, we are accountable to the House and, through its elected representatives, to the public.

Part 2 of the Bill will introduce an important new safeguard. As now, a Secretary of State will need to be satisfied that activity is necessary and proportionate before a warrant can be issued, but, in future, it will not be possible to issue a warrant until the decision to issue it has been formally approved by a judicial commissioner. That will place a double lock on the authorisation of warrants. It will preserve that vital element of democratic accountability, but it will, for the first time, introduce independent judicial authorisation.
