I am sorry, Ms Bardell. We have a newly appointed provost marshal. I am very keen for victims to be at the centre of all the policies as our service families go forward.

It is good to hear that accusations of rape can be taken out of the chain of command, but who will victims be able to raise their concerns with? Will that particular person be properly trained to deal with crimes of that nature?

If there is an allegation of rape, the service personnel can now go to the civilian police; granted, it does not happen that often, because of the institution of the MOD, but they can and do have that option now. The list I gave is all about training the service police and the investigators about what to do properly. A lot of these policies and procedures in the service justice system are now aligned with the civilian justice system, which we hope will increase and maintain the speciality of serving police.

I thank the Minister for that, but I will push her a little further. In the civilian police, there are people specifically trained to deal with such allegations; they do not deal with a wide range of allegations. It would be useful to know that that is the same in the military; that there are people specifically trained to deal only with these types of allegations, and that people would interact with somebody who has that expertise.

There is already a system in place. Victim officers are assigned to cases such as this, but I identified in my report the fact that sometimes they were good and sometimes they were not; there was a training programme to ensure that everyone reached an acceptable level. They are assigned someone to help them through the process.

I thank my hon. Friend for his question. The MOD has had strategies in place for many years around flexible working. I think my right hon. Friend the Member for Bournemouth East (Mr Ellwood) may have been involved with putting those in place, but some of the evidence that we heard was that, while they were available, they were hard to get. Personnel were denied access to these schemes because of operational effectiveness. Their commanding officers were not granting the schemes. One thing we want to look at is the accessibility of these schemes. There is absolutely no point putting policies, strategies and initiatives in place if they do not make a positive impact on the ground. I know that, next week, the Minister will introduce his family strategy, which I will look at with interest. Most women leave the military after returning from maternity leave, which is a problem that needs to be embraced. I am confident that the Minister is trying to do that, particularly around dual-serving couples.

I congratulate the hon. Member on this comprehensive and, at times, quite harrowing report. It is a huge body of work and some of it made for quite difficult reading. I was most disturbed by the tenfold increase in cases of rape and sexual assault on the under-18s. Given the Government response to her report, is she confident that servicewomen are safe from sexual violence in their workplace? Furthermore, given that rape and sexual assault will continue to be dealt with by court martial rather than by civilian courts, will she return to this issue at any future date to see whether there has been any increase in the number of convictions as a result?

I thank the hon. Member for her question. The Secretary of State asked the Defence Committee to visit Harrogate to see what it was doing around support for young servicewomen, and we were quite impressed. The MOD has acknowledged that there is a problem, which is a big step in itself. It is one of our oldest, most male-dominated institutions and it has now recognised and vocalised that there is a problem and is putting plans in place around supporting those women, which is a massive step forward. I was quite pleased with what I saw in Harrogate, and I did go with scrutinising eyes. With regard to serious sexual assault, murder, manslaughter and rape being held within the military service justice system, I am disappointed. To me, the evidence was overwhelming. Over this period, the MOD gave us quite a few streams of evidence and statistics, and, quite frankly, I was not convinced by any of them. The last one seemed to conflate two lots of databases, one of which was about conviction rates. The MOD seemed to be quite happy that it was investigating more and was therefore doing better, but I would say if it is investigating more, it has a problem—and my question would be, if it is investigating more, why are more cases not getting to the courts? That question raises concerns about the investigation process, which the MOD has acknowledged, and it is putting plans in place. The Defence Committee is going to be conducting a review of the MOD’s recommendations and progress on them in a year’s time, and I will continue, if permitted, to pursue this issue.

Q Could you give us examples of situations where individuals might fall out with this six-year limit?

Charles Byrne: In terms of specific examples, I cannot at the moment. I know from the sample size that was taken that there were, I think, 19 individuals or families who fell outside that. I do not have specific examples.

Q Hello, Major. I would like to thank you for your services, and I am horrified at what you have been through. Some critics say the Bill will increase the number of prosecutions and allegations taken to the international criminal courts. Given your experiences and knowledge of the Bill, what is your opinion on that?

Major Campbell: I think that is a false allegation, and I will tell you why. Again, when I wrote to all these people—even internally within the Army—I was told repeatedly that if IHAT was interfered with in any way, the International Criminal Court would swoop in and clamp us in leg irons, and we would all be off to The Hague. Michael Fallon repeated in the Defence Sub-Committee that he had no power to stop such investigations and that, if he were to do so, the ICC would get involved.

I decided to test that theory, and I wrote to the chief prosecutor of the ICC, Ms Bensouda, asking in exasperation whether I, SO71 and SO72 could surrender ourselves to the ICC rather than go through several more appalling years at the hands of the Ministry of Defence. Ms Bensouda responded that our allegation does not fall within her remit, because her job is not to prosecute individual soldiers; her job is to prosecute commanders and policy makers for the most grave crimes. In her orbit, manslaughter, which is what I was accused of, is not a war crime. It is a domestic crime—a regular crime, as opposed to what she would normally deal with. I reported that rejection to the Ministry of Defence, which continued to repeat that the ICC would fall in.

The second point I would make is, what would be so terrible about the ICC being involved? We kept getting told that the ICC has a bit of scrutiny over IHAT and is keeping a very close eye on it. Personally, I do not have a problem with that. Like I said, the ICC was not going to ruin our careers, the ICC was not going to harass our families, and the ICC was not going to go and bully soldiers who had left the Army for a witness statement—not even a suspect’s. The ICC would conduct itself professionally, and it would have no incentive—no financial incentive—to drag things out for years, like Red Snapper, which provided most of the detectives to IHAT, did. Finally, the ICC would probably not use the investigative technique that IHAT used, which was to pay Phil Shiner’s gofer to be the go-between between them and witnesses because IHAT was too scared to go to Iraq.

So regarding the whole spectre of the ICC, first, I do not find it remotely as scary as people make it out to be and, secondly, it is completely false, because I attempted, with my two soldiers, to surrender ourselves in order to spare us another several years of the MOD fannying about, and the offer was refused. So to answer your question, I do not see that as an issue at all.

What I would say, though, is that I think I understand why the Government would be reluctant for the ICC to be involved, because the scrutiny would not be on Tommy Atkins; the scrutiny would be on General Atkins and Minister Atkins. Those are my thoughts on the ICC.

Q Major Campbell, thank you so much for the evidence that you have given us already today. I think that all of us here are sorry to hear of your experience, and I think that the sympathy of all of us is with you.

Clearly, a lot of this is still very raw for you, and you have talked about the MOD dragging it out over the last 17 years. Can you tell me how you think this Bill will actually tackle the MOD’s actions and inactions, which you have been subjected to over the last 17 years?

Major Campbell: Like I said in the previous response, if there was a time limit within which these things can be actioned, then I feel that a higher level of scrutiny and decision making would be necessary to make them work. I also think that the kind of dithering manner in which this process has been carried out to date would be nullified. If there is a time limit within which they have to get on with it, get it done right the first time and get the correct legal advice, I think that would improve matters no end.
