My right hon. Friend is completely right. They are ruthless about pursuing what they regard as their own interests and disregard any other risk. Indeed, they are very far from being risk-averse, and the west has been far too risk-averse to compete with that. I will come to that later, but I thank my right hon. Friend for reminding us about the Poseidon torpedo, which is a nuclear-tipped torpedo—another escalation in the arms race.

Russia has also been rearming the Serbs in the western Balkans, including the Serb armed forces and the police in the Serb enclave of Bosnia, with the intention of destabilising the fragile peace that NATO achieved 30 years ago. Russia has stepped up its activity and influence in north and central Africa and has even started giving support to Catalan separatists in Spain. Russia uses its diaspora of super-rich Russian kleptocrats to influence western leaders and exploit centres such as the City of London to launder vast wealth for its expatriate clients.

Following the shaming chairmanship of Gazprom assumed by the former German Chancellor Gerhard Schröder, so Russia has now recruited former French Prime Minister François Fillon to become a board director of the massive Russian petrochemicals company Sibur, with its headquarters in Moscow. The Russians must have contempt for us for being so gullible and corruptible. Our unilateral withdrawal from Kabul also vindicates their narrative that the west is weak, pointing out that we failed to stand by our moral principles or our friends.

Closer to home, look at how Gazprom has gradually and quietly reduced the gas supply to Europe, running down Europe’s gas reserves and causing prices to spike, leading to quadrupling gas and electricity prices in the UK. If Putin now chokes off the supply, it would take time and investment to put in place the necessary alternatives, which the Russians will seek to frustrate, as they already have in Algeria. Algeria was in a position to increase its supply of gas to EU, depending on the existing pipeline being upgraded, but a successful Russian influence campaign aimed at Germany and France prevented that from happening. Gazprom is enjoying its best ever year, so Putin can not only threaten western Europe’s energy supplies, but get the west to fund his war against the west.

Moreover, as gas supplies to Germany through Ukraine seem less reliable, so Germany continues to support Nord Stream 2, the pipeline that will bypass Ukraine, strengthening Russia’s hold over both countries immeasurably. At least we have the option of re-exploiting our gas reserves in the North sea. For as long as we require gas in our energy mix, we should be generating our own, not relying on imported gas from Europe.

The hon. Gentleman’s last statement will be very much welcomed by workers in the gas and oil industry, but was it not also remiss of the Government a few years ago not to continue with the gas storage facility in the North sea, which would have provided us with some resilience? We should also have been working with other countries to build up their reserves, to diminish the ability of the Kremlin and Gazprom to blackmail us.

All I can say is, do not start me on the lamentable incoherence of 20 years of UK energy policy, because it is a disgrace, and something that we could have done so much better and that this Government are starting to repair, but it will take some time.

As we made clear earlier, there is considerable concern about the rapidly deteriorating situation in Ukraine, particularly on its frontier. In today’s debate, as has been well introduced by the hon. Member for Harwich and North Essex (Sir Bernard Jenkin), we need to look at that on a much broader spectrum—basically one of a revanchist Russia that is seeking to rewrite the end of the cold war. It is seeking to recreate the Soviet Union; to increase its influence, if not its direct acquisition—I do not think it would rule that out, however—of the former Soviet Republics; and to establish hegemony over the former countries of the Warsaw pact, as well as to keep Finland in a state of neutrality and to have considerable influence in the western Balkans. That is very clear. Most of those countries are members of NATO and of the EU, and some of them are members of both. I think that explains the Kremlin’s enormous hostility to both those institutions, as it seeks to do everything it can to undermine them.

We need to recognise the nature of that threat, to which the hon. Gentleman drew attention very effectively. It is not just a military threat. We talk about the 100,000 troops on the border, and that is significant, although there might be a tendency to overestimate the efficacy of much of Russia’s equipment. Although Russia may be making advances and developments in hypersonics and so on, quite a lot of its other equipment—we see this particularly with its surface fleet—is distinctly substandard. We need a strong evaluation of that, and that would be much easier had Whitehall not dispersed so much of its Russia-watching capability after the fall of the Berlin wall, leaving a great gap. There may be some attempts to recreate that, but I do not think we have anything like the ability we once had to observe and understand what is going on.

That is also tied to integration. The hon. Member described very well the integrating mechanisms within the system—it is very reminiscent of the Soviet system during the cold war—to integrate all areas: cultural life, political life and industrial espionage, so that they work together in a co-ordinated way. If I asked the Minister where in Whitehall was the UK’s integration along those lines—I am not aware of it—I think he would be hard pressed to put his finger on it. What frustrates me enormously is that in the past, we had quite a good record on this. During the second world war, the Political Warfare Executive—headed up, interestingly enough, by Richard Crossman, subsequently a Labour Member of Parliament and Labour Minister—pulled together journalistic and psychological expertise, and it had an extremely effective record.

I want very briefly to relay two conversations that I have had about strategic thinking in Government. One was with a person who is now the former Prime Minister, who said, “Oh, Bernard thinks we should have a strategy, but I think we should remain flexible,” completely misunderstanding what strategy is. The second was with a Minister who is now serving in a very senior capacity in this Government, and who said, “What is our strategy? We think we have to work with NATO.” In this country, we are so far behind understanding what strategy is that we have a very great task in front of us.

I thank the hon. Gentleman. Of course, many people quote Eisenhower as saying that all strategic plans break down on first contact with the enemy. Of course, they forget the next sentence: nevertheless, it is still necessary to plan, and to have a framework.

It is also necessary to look at this issue, as our opponents do, in a broad spectrum to see how all the areas interlink. That is the problem that we faced for some years with industrial espionage, for example, although people are waking up to that to quite a degree. Traditionally, all the way through, there has been industrial espionage by the Russians, and more recently by the Chinese, but there has been a reluctance and a failure to see it in such a way. Many of those who criticise such an approach say, “You are trying to recreate the cold war.” No, we are not. The cold war has already been restarted.

I very much share the concerns expressed by the right hon. Member for Warley (John Spellar), but I very much hope that we maintain minimum recoverable capability in all these fields, because the new capabilities that have been brought in by the integrated review are equally or more important than the reductions in the overall size of the armed forces that we have seen. The big surprise in the review was the announcement of the increase in the warhead cap.

I want to reply very directly to the right hon. Member for Islington North (Jeremy Corbyn). May I remind him that, on 18 July 2016, when he was leader of the Labour party, the Government got through the House the maingate of the renewal of the Trident submarines on a vote of 472 to 117? There is no doubt, therefore, that the strength of consensus in this House does not reflect the views of the then leader of the Labour party.

The hon. Gentleman will recall that that vote was taken about five years later than it should have been because of dithering by his own Government.

I think the coalition had something to do with that. I warned David Cameron about that before we even went into that coalition.

The right hon. Member for Islington North accuses his own country of proliferating weapons of mass destruction, and suggests that we are somehow escalating our numbers, but he does not even mention the fact that, as my right hon. Friend the Member for North Somerset (Dr Fox) said, Russia has—what was it?—6,800 nuclear warheads. They are modernising every single weapons system that they have got. They are in breach of the intermediate-range nuclear forces treaty. That is escalation, and the right hon. Member for Islington North has nothing to say about that whatsoever.

We all know that the British people will support the United Kingdom’s continuous at-sea deterrent for as long as other nuclear weapons states are keeping their weapons and there are other proliferators around. We just need to remind ourselves what extraordinarily good value the continuous at-sea deterrent system actually is. The Library produced a report last month, pointing out that the annual cost of our continuous at-sea deterrent is just 1% of the cost of social security and tax credits—just 1%. So the idea that this is a Rolls-Royce system that we cannot afford is mythical. Nothing could buy us the security and influence that the continuous at-sea deterrent gives us.

The doctrine of deterrence is just as valid as it ever was. Has the right hon. Member for Islington North ever asked himself why major state-on-state warfare stopped in 1945? Well, I can tell him why: it was because nuclear weapons were invented and that kind of warfare became too costly, too destructive, to contemplate. Does he want to go back to that world by getting rid of nuclear weapons altogether? I hope not.

We just need to remind ourselves that our continuous at-sea deterrent can attack any target at any time, so it is always ready to respond to threats. Its location is unknown so it cannot be pre-empted. It does not require to be deployed at a time of international tension and crisis. The technology is tried and tested. It is not in breach of the nuclear non-proliferation treaty; it is completely compliant. It is a sovereign capability, which, if we had to use it, we would. No alternative system could possibly provide all these benefits at such good value, and that is why we should reaffirm our commitment to our nuclear deterrent.

I could not find the result as I listened to the closing remarks of the hon. Member for Kingston upon Hull East (Karl Turner), but I think the Brexit Party received substantially more votes than the margin of his majority—do correct me if I am wrong—so he was saved, if you like, by a split in the Brexit vote. I hope that he will reflect on how little his voters respected the Labour party’s position on Brexit.

Mr Deputy Speaker, I congratulate you on your sudden elevation, and may I also congratulate Mr Speaker on his election? I also congratulate the Prime Minister not just on achieving a stunning outturn to a difficult election, but on striking such a sensible and moderate tone at the moment of victory. He humbly accepted the responsibility, and his comments were far from the triumphalism that he might have indulged in and that, in fact, is not part of his character.

There has been much speculation about the long-term significance of this result. Is 2019 going to be like a 1945, 1979 or 1997 watershed? It is far too soon to be certain about that, but it is rightly the Government’s ambition to make it a watershed by changing the nature of the Conservative party, with its new intake and the new constituencies that we represent, ensuring that we deliver in constituencies that have not been represented by the Conservative party for a very long time, if ever.

It is certain, however, that this is a watershed moment in our relationship with the European Union. I still hear among many of the comments a reluctance, perhaps, from the Opposition parties to accept this, but the election result represents a substantial consolidation of what was decided in the referendum. Incidentally, the effect of leaving the European Union will be far less about economic and social matters. It is far more significant in terms of its political and constitutional intent. It is about the intent of the British people and a signal of our national determination to be a self-confident country, to take control of our own affairs, to make our own laws, and to navigate our own way in the world, as the sixth largest economy in the world is perfectly capable of doing. Yes, there will be problems of transition, but most countries are not in the EU and they are absolutely fine. We will find our way out of the European Union probably in a manner that most people in this country will not even notice in terms of immediate policy effects, but they will understand that they voted for us to be a self-governing nation.

The election converted the direct mandate of the 2016 vote to leave into a clear representative mandate, and that was always going to have to happen, because direct democracy does not sit comfortably in our system of representative government. This election represented that transition: not just to leave the EU in principle, but a mandate to deliver the deal negotiated by my right hon. Friend the Prime Minister. The election decided how we are going to leave the EU, as set out in our manifesto.

Incidentally, we are leaving with a deal. It is quite extraordinary that a narrative is developing that we will somehow leave without a deal in a year’s time. We might leave without a free trade agreement, and the Prime Minister has made it absolutely clear that we are leaving at the end of 2020 come what may, but that puts us in a far stronger negotiating position than we would be in if our hands were still being cuffed by a House of Commons determined to inflict defeat on the Government at any cost and to subvert the referendum result and the election result. We are now in a position to negotiate more effectively than we have ever negotiated before and, with the experience of the previous negotiation, is it not apparent that there has been a sea change in the attitude of the other members of the European Union? They want to get this done. They are not against free trade. They are not in favour of protection for its own sake. They are not in favour of inflicting some kind of vengeance Brexit on the United Kingdom. They will want their exporters to benefit just as much as our exporters will benefit, and we are in a strong position to achieve that.

In this election, people also voted for this rather mobile concept of “one nation”. Actually, one nation, as somebody recently reminded me, was a term coined not by Disraeli but by Baldwin. Disraeli talked about the two nations—the rich and the poor—but Baldwin fused it into a political philosophy about forging one nation, so that the divide does not exist. My right hon. Friend was right to emphasise that that has always been the role of successful Conservative Governments. In fact, poverty has generally declined under the Conservatives, and inequality tends to increase under Labour Governments, because they try to tax people too much and, in the end, the taxes fall on those least able to pay.

This election result was not about those who made the biggest promises. If the party that won the election was always the one that made the biggest promises, we would never win an election. The fact is that some of the Labour party’s promises, as my hon. Friend the Member for East Worthing and Shoreham (Tim Loughton) was saying earlier, were irresponsible. They were not credible, and they looked cynical. Those kinds of promises do not work. People vote for a track record. There has never been a Labour Government that did not leave office with a higher rate of unemployment than they inherited from their Conservative predecessors. That is a fact, and people remember that. The election reflected the fact that common sense prevailed over the temptation to allow extravagance that the nation could not afford and over a continuation of the institution-breaking paralysis that a hung Parliament had inflicted on the Government at this particular juncture in our history.

This election result is a defeat for the idea that we should somehow move to a more proportional voting system. The advantage of our voting system is that it distils a decision so that hung Parliaments are rare. This election demonstrated that the nation does not like hung Parliaments. It likes decisive government. The nightmare possibility of a continuing state of paralysis encouraged people to vote tactically and make a judgment about how they wanted the political deadlock to be broken. They did not want it to be left to a lot of politicians on lists filling smoke-filled rooms and stitching things up for themselves. It was not just that period of government that was unpopular, because the coalition between 2010 and 2015 turned out not to be very popular in the end.

I welcome the Gracious Speech. The withdrawal agreement represents a compromise Brexit, which we now all must live with, and all can do so because it is a good compromise. There has been much speculation about the European Research Group, which I do emphasise is primarily a research group, and about whether we should rename ourselves the “manifesto support group” because we are not at loggerheads with the Prime Minister. We are not holding him to ransom. We supported his deal before the election. It was remainers who were trying to destroy his Government before the election, and they will now hopefully lay down their arms and sue for peace, because this has been resolved. That is what our voters expect.

I am just as interested in the proposals in this Queen’s Speech for a constitution, democracy and rights commission, which will have a large agenda after a period of constitutional strain in which so many of the norms and conventions of our constitutional settlement were just simply thrown aside in the battle over Brexit. The Select Committee on Public Administration and Constitutional Affairs, which I chaired before the election, has looked at electoral law, the Fixed-term Parliaments Act 2011, the role of the Electoral Commission—maybe we should look more at that role—constituency boundaries, the royal prerogative and the Supreme Court judgment, alongside the nature of our civil service. I am pleased the Prime Minister is considering how the effectiveness of Whitehall can be improved.

Now we have a mandate and a majority to address all these matters, we need a careful and consensual approach so that we do not make the mistake of previous changes, like the Fixed-term Parliaments Act. That Act was a rather grubby deal to try to cement the coalition into office, and it had all sorts of unintended consequences. We must legislate on the constitution very carefully to avoid making such mistakes in future.

The hon. Gentleman mentions the redistribution of boundaries. There was a strong feeling in the previous Parliament that it would be a huge mistake to reduce the number of Members of Parliament and the number of constituencies from 650 to 600. Does he think that ought to be revisited?

I certainly do. On Second Reading of the Parliamentary Constituencies (Amendment) Bill, the private Member’s Bill introduced in the last Parliament, I spoke in favour of the compromise that seemed to be emerging for a variation of 7.5% instead of 5%, so as not to corral constituencies into artificial shapes, and for 650 seats instead of 600. Overwhelmingly, the objective should be to re-establish consensus on boundaries through the usual channels. Boundaries should not have become a politicised issue. We could not get any boundary changes through because it had been politicised—another clumsy mistake by the coalition Government.

We have to recognise that this cavalier fiddling with the constitution and this period of paralysis have left the public with much less confidence in our political institutions. There has always been cynicism about politics, but never about Parliament as an institution. The public were becoming very jaundiced about Parliament as an institution, and this majority Government is an opportunity for all sides to recognise what the rules are and to make this place work for the benefit of our constituents, whether we are in opposition or in government.

I also welcome the emphasis on the national health service in Her Majesty’s Gracious Speech. I was at a roundtable at Conservative conference a couple of years ago to discuss the staffing crisis in the NHS—this was before the staffing crisis had moved up the political agenda—and I asked who is accountable for workforce planning in the NHS. A variety of opinions came from the various professional bodies around the table and, actually, some of us persuaded the Secretary of State for Health and Social Care that he should make himself accountable.

We then got an interim people plan for NHS England that was extraordinarily thin on numbers and analysis, so I welcome the breakthrough into numbers that appeared in our manifesto. I am a little sceptical about how easy it will be to achieve 50,000 more nurses, and I immediately pressed the Secretary of State to explain exactly what 50,000 more nurses means and how it will be achieved. That is yet to be fleshed out in hard policy detail, but we have set ourselves the challenge and we have to deliver it.

I congratulate the right hon. Member for Carshalton and Wallington (Tom Brake) on securing this debate.

There are some very serious issues to discuss and to bring into the public domain, but I think we need to keep a sense of proportion. I agree with the hon. Member for Ilford South (Mike Gapes) that Russia has not changed its character fundamentally since the days of the Tsar. It has always been somewhat paranoid about the outside world and aggressively defensive, and we see the same characteristics today. However, to describe, as he put it, “the kind of tweets put out by the Russian embassy” in the same terms as the threat we faced during the cold war is to get things a little out of proportion. There are serious issues to discuss, but we should do so responsibly. I want to explain what I mean.

The hon. Gentleman clearly does not understand that Russia, all the way through, has a full-spectrum response. During the cold war, it had all the stuff in the cultural areas and hard power. Has he noticed the size of the recent exercises conducted by Russia in the Baltic? Russia does not see this as different. It is part of a full-spectrum approach.

I completely agree with the right hon. Gentleman, but the fact is that today’s Russia is a shadow of the power that was the former Soviet Union.

I pay tribute to the longest-serving member of PACAC, or whatever name it had in previous Parliaments. The hon. Gentleman has been an enormous fund of institutional memory on that Committee, and that is extremely useful. During our inquiry, he pointed out that his party already has a form of elections for its delegates that provides for the complexity of providing gender balance. Some of the objections that have been raised to say that we cannot do this are therefore clearly confounded by the experience of his party.

I think it would be a mistake to say that this episode has brought shame on our country. The hon. Gentleman is right to make comparisons with other countries that do things better. However, the Rules Committee made it clear that people might have misunderstood the confusion of roles that we have in this House whereby the Prime Minister is also leader of the governing party and sits as a parliamentarian. The more classical separation of powers that is expected does not exist in our constitution. That is not a matter of shame for us, but we are now a little behind the times. We should be demonstrating how, in our procedures, we expect the best, and the most open and democratic, practices to be adopted—not from the age of deference but the age of popular democracy.

I, too, commend the Chairman and the Committee for this report. I confess to finding it strange that the Prime Minister should have sought, in a fit of pique, to exclude troublemakers from the delegation to the Council of Europe, because in my time as a Whip we thought that was one of its purposes. Why does the Chairman think that the Prime Minister did not heed the unfortunate experience of Tony Blair and Robin Cook when they disastrously tried to intervene to change the chairmanships of the Transport and Foreign Affairs Committees? Can he explain this case of prime ministerial hubris without any regard to the inevitable arrival of nemesis?

Without straying too much into Greek terminology, I think that what Prime Ministers have they tend to want to keep and not give up. There was perhaps a failure of imagination about the effect of what people wanted to do, but that has provided this House with an opportunity to review, to debate, and, I hope, in due course to decide on how to make sure that we bring our procedures into the democratic age.

If I may say so, it is a privilege to follow such a powerful speech about the spread of weapons. The whole House respects my hon. Friend’s extraordinary devotion to his work on arms control for the Quadripartite Committee. He approaches his subject with a passion and knowledge that is probably unrivalled in either House of Parliament.

If I may, however, I would like to respond, perhaps impertinently, to my hon. Friend’s implied rebuke to the Government for their helping to persuade the European Union to lift the arms embargo on the supply of weapons to the Syrian National Council—the least unrespectable part, if I may put it that way, of the Syrian opposition, which we would want to be properly represented in the peace negotiation or peace settlement that we are all striving to achieve. I support the Government in seeking to redress the extraordinary imbalance affecting the more reasonable forces involved in this extraordinarily bloody and complex conflict.

NATO should be agonising over this whole issue because it will have to pick up the pieces of a spreading war and conflagration that almost inevitably will occur unless the United States, Russia and the other major powers in the region—including, perhaps, even Iran—start to sit around a table and work out how to contain the conflict.

We were right to question whether there might be a case for sending arms into Syria to try to redress the imbalance, because the regime is already using a massive stockpile of weapons. Russian-trained pilots are flying Russian aircraft, dropping Russian munitions and firing Russian shells out of Russian guns at civilians all over Syria. I find it very difficult to tolerate the idea that the Russians should be able to do whatever they want in their bloody way in that country, while the west sits idly by doing nothing. It is not just the Russians, as extremist Sunni factions, too, are being armed by Qatari and Saudi interests, which are pouring weapons into the Syrian conflagration.

The danger is not that our sitting back and doing nothing will mean that nothing happens or that the pre-2010 stasis will reassert itself as Assad reasserts his power. The danger is that this conflagration will grow and grow and grow. I therefore think the Government are right to try to redress the political balance and to tempt the Americans into entering this crisis—otherwise, NATO will finish up having to pick up the pieces in a very much more active and perhaps unfortunate way than we would wish.

That brings us back to our subject, Madam Deputy Speaker—I hear you heaving a sigh of relief—which is the question, “What is NATO in our modern age?” I thought that my right hon. Friend the Member for North East Hampshire (Mr Arbuthnot), the Chairman of the Defence Select Committee, was right when he said that NATO has become a coalition of the willing—an organisation or a military alliance from which a coalition of the willing can be drawn. I do not rebuke the Minister for representing the Government at this debate because NATO is a political alliance that represents the foreign policy of this country, albeit backed by national military capability, pledged in co-operation to support the objectives of that political alliance.

Why is NATO still needed? I hope that I have just exposed one possible reason—to prevent war and to contain conflict. The reason NATO seems to be redundant and out of date to so many of our citizens today is that it has been so successful—the most successful military alliance in modern history—at containing, deterring and preventing conflict so that our continent feels perhaps deceptively safe from foreign conflict. NATO not only won the cold war, but keeps the peace. People should not forget the adage “If you want peace, prepare for war”, as that is what NATO is about.

Deterrence is the watchword—preventing wars rather than fighting them. That is why we spend money on defence—not to use the military capability in hot conflict, but so that we do not have to use the capability at all. Its use is pacific. That is one of the reasons the nuclear deterrent lies at the heart of NATO military doctrine. It is the relationship between the future of NATO and the continuation of our own nuclear deterrent that I shall explore briefly this afternoon.

There are three NATO nuclear powers: France, Britain and the United States. What threatens the future of NATO today is not just apathy or the parsimony of its member Governments’ defence budgets, and neither is it ignorance about its vital role. NATO is not going to be abolished suddenly. Nobody is going to make a decision at some NATO summit that NATO has had its day and will be wound up. The great danger is that NATO withers. I put it to the House that, with the war fatigue following Iraq and Afghanistan and the lack of appetite for NATO to play its deterrent peacekeeping and stabilisation role across the world, NATO is already withering. The collapse of key components of NATO is another danger, as is the uncertainty and the question mark that still exists over the continuation of our own nuclear deterrent. In fact, that is a threat to the continuation of NATO.

With the greatest respect to those who advocate European Union alternatives or supplements to NATO, I say that without NATO European defence is sunk. NATO has been doing European defence and security and it is doing European defence and security: there is no substitute or alternative to NATO.

We have left a question mark about the vital part of NATO’s capability. Our nuclear deterrent is pledged to the defence of NATO and our NATO allies. The Government have conducted a study into possible alternatives to the Trident nuclear deterrent. Now is not the time to go into great detail about that, except to say that we understand that it has exposed the truth: that there is no viable or cheaper alternative to our nuclear deterrent. Trident is the only viable nuclear deterrent on offer to the United Kingdom.

I am most grateful to be speaking under your chairmanship, Mr Brady. I will endeavour to be briefer than some hon. Members have been this afternoon.

We are discussing the trigger for a referendum in the Bill. It is worth pointing out the undercurrent in this debate: some people are speaking because they do not think that there have been enough referendums and others are speaking because they do not want referendums. The official Opposition have got into a bit of trouble with their amendment. My right hon. Friend the Member for Charnwood (Mr Dorrell) had some fun at their expense, because they tried to present a set of amendments as pro-referendum when their record on referendums is rather lamentable—perhaps as lamentable as ours when we have been in government.

I will not give way, because my point was not designed to provoke the Opposition and I want to press on. The Opposition’s inability to answer the question of how the proposals would help to get a referendum meant that they fell into the trap that was set for them by my right hon. Friend the Member for Charnwood.

I will revert to that later. The great danger of the European constitution was that it was explicitly and legally autochthonous. It derived its authority from itself and its own roots. At least the Lisbon treaty reverted to the principle that authority comes from the member states, but it contains the important and dangerous declaration about not only the primacy of EU law, but the EU’s constitutional supremacy over the constitutions of member states. That means our Parliament. I therefore fail to understand how anyone can say that there is no threat from the EU to the sovereignty of this House. That lot over there signed a treaty, without a referendum, that created such a threat. That has given rise to a demand for clarification about the sovereignty of Parliament in some form.

Many of my colleagues—I have talked to them in the Lobbies as well as hearing one or two speaking today—think that clause 18 is not the fight to have. If I may paraphrase my hon. Friend the Member for Daventry (Chris Heaton-Harris), he said that other clauses were much more important. It is not an either/or. It is suggested that somehow a referendum would be a panacea. People seem to think that as soon as we have a referendum—preferably an in or out referendum—we will be able to settle the issue.

The truth is that we may one day quite soon have a referendum on the European Union. It might be on the question of an additional treaty or power, and it might turn into a referendum on in or out. But the actual fact of a referendum will not solve anything. Instead, it will throw into flux the question of our membership of the EU, and the Government of the day will have to decide how to use that referendum to negotiate a new relationship with the EU. We will not stop the trains running through the tunnels and cancel all the flights and the trading. We will still have to have a relationship with the European Union.

Suppose that we wanted to take back control over our trade and to exit the customs union. We would need to have a renegotiation, sector by sector, of every part of the British economy’s trading relationship with the EU. The point about a customs union is that there are no barriers—it is a single trading area. If we were to elect to have a separate trading area—to leave the single market—but we wanted to continue to trade with that market, we would need a trade agreement, so we would need to negotiate one. Immediately, we would need renegotiation.

We constantly hear it said, “Oh, if you Eurosceptics want to leave the European Union, why not be completely honest about it?” The pro-Euros—the people who are dedicated to the annihilation of the sovereignty and independence of this country—always put the issue as a binary question and, to an extent, they are right. It would be a self-fulfilling prophecy—a referendum would become a matter of leave or stay. If we are not sovereign in this Parliament while this country is a member of the EU, the only option is to jettison all the treaties and Acts, so we have very little flexibility.

What we as a Parliament need, in those circumstances, is the ability to negotiate partially, to pick and choose from a menu of options. But that would require Ministers to be able to legislate to suspend this EU instrument or that EU instrument. For example, they would need to be able to suspend EU City regulation so that we can get our competitiveness back. The Prime Minister’s remarks on Monday, about his pro-jobs agenda and a flexible labour market, are another example. The coalition also says that it wants to renegotiate the working time directive to recreate the competitiveness of the British labour market. So Ministers would need the option of passing an Act of Parliament to suspend the application of certain EU instruments, but the question is whether that option will be available to them.

A little earlier, the beef ban was mentioned. I was a humble Parliamentary Private Secretary in the Scottish Office at the time, and we had a lot of discussion about how it could possibly be legal for the EU not just to ban the import of beef into other member states, but to ban the export of British beef from the UK to third-party countries. We were banned from exporting to anywhere, and there was some discussion about whether we could suspend the effect of that legal instrument to stop the EU preventing us from exporting our beef to other countries. The advice was, “Oh no, Minister. You can’t do that because it would put us in breach of the European treaties, infraction proceedings will be taken against us in the European Court of Justice and we will be found to have broken the law. Minister, I must advise you not to break the law, as otherwise you will be personally liable.” Do Members get the point? Ministers have to obey the law and accept legal advice. Unless we sort out the sovereignty of Parliament and make it explicit that Parliament can suspend European Community law in selected circumstances, Ministers will not be in a position to exercise the freedom that Parliament has given them.

Did the hon. Gentleman seek alternative legal advice, which is often the sensible thing when getting that sort of advice in government, as I know from experience?

We sought alternative legal advice and were assured that, in all probability, the domestic British courts would uphold Parliament’s sovereignty and ability to suspend those legal enactments. But that is the point. We might have it now, but will we have it in the future?
