The ministerial code clearly states that former Ministers require advice from the Advisory Committee on Business Appointments prior to announcing any new business appointments. ACOBA is unable to report on its advice retrospectively after a new post has been made public. Can the Minister explain why he gave different advice to the House during his response to the urgent question on Monday? Was it just a mistake, or have the rules conveniently been changed in the space of a week?

The hon. Gentleman has made his point very clear. ACOBA is coming to its determination and it will consider all the evidence in the round. It is important that it does so without my prejudicing its decision by passing comment.

To ask the Prime Minister if she will make a statement on the operation of the Advisory Committee on Business Appointments and the ministerial code in the light of the appointment of the right hon. Member for Tatton (Mr Osborne) to the editorship of the Evening Standard.

I am very grateful indeed to the hon. Member for Denton and Reddish (Andrew Gwynne) for bringing this matter to the attention of the House. Let me take the opportunity to set out the Government’s position.

The ministerial code requires that former Ministers must seek advice from the independent Advisory Committee on Business Appointments about any appointments or employment that they wish to take up within two years of leaving office. My right hon. Friend the Member for Tatton (Mr Osborne) left his role in the Government in July last year. Information on advice given to him regarding previous appointments has been published on the committee’s website.

I understand that the application for the particular role mentioned by the hon. Gentleman, at the Evening Standard, was received by the committee on 13 March and is currently being considered. When the committee has fully considered the application, it will convey its advice directly to my right hon. Friend, and that advice will be made public on its website. Until the advice is made public, this is a confidential process between the committee and my right hon. Friend, although it is no doubt a matter of significant interest to the House.

Thank you for granting the urgent question, Mr Speaker. I will seek to adhere to your wish for me not to refer to a particular right hon. or hon. Member, but to deal with the underlying issue.

As we saw in the media over the weekend, this is a matter of great concern. My question was addressed to the Prime Minister, and not—with respect—to the Minister. I appreciate his commitment to ensuring that more is done in future to prevent a repeat of the most recent incident, but many Members on both sides of the House are likely to treat such comments with scepticism.

The current rules relating to business appointments were established to counter suspicion that the decisions and statements of serving Ministers might be influenced by a hope for future rewards in the form of a job offer or other monetary gains. Disregarding those rules deeply undermines public trust in the democratic process, in the work of a Member of Parliament, and in the House itself. It does a disservice to those Members who respect the trust placed in them by their constituents, who spend every hour of their day fighting for their constituents’ interests, and who ensure that proper attention to the representative role of an MP is given, as a vocation to public service should require.

In 2012, an inquiry into the Advisory Committee on Business Appointments suggested that it should be replaced by a new conflicts of interest and ethics commissioner, but the Government provided assurances that the current system and the ministerial code was robust enough to prevent behaviour or actions that might at worst bring this House into disrepute, or further the tragic low standing this profession is sadly held in. Yet I am forced here today to ask the Government again how they will address another case and to ask them to give assurances that the current system has not provided yet another opportunity for a conflict of interest to be exploited. To hold one outside interest is perhaps defensible, but to hold several time-consuming outside commitments that have a deep overlap with the political role of what is supposed to be a full-time commitment as a Member of this House is impossible to defend.

Will the Minister confirm what action the Government intend to take against ex-Ministers who appear to be in breach of the ministerial code on their failure to seek advice from ACOBA before accepting an appointment? Will he reconsider his Government’s response to the 2012 review into ACOBA and provide a stronger system that is able to command the confidence of this House and the public, because it is what we deserve?

I have to say that I can see why the hon. Gentleman took this excuse to drag himself away from the shadow Cabinet awayday. I know he will be missing it with every cell in his body, and that is why I will give him a short answer so that he can return as quickly as possible.

As the hon. Gentleman rightly said, much has already been done in this important area. The Prime Minister revised the ministerial code when she took office. It is a matter of high concern to her, and that is why, appended to the ministerial code for the first time, is advice to Ministers on leaving office to seek the advice and assurances, or approbation—or indeed censure—of the independent Advisory Committee on Business Appointments, or ACOBA.

The important thing to say about that process is that it is independent. I hope the hon. Gentleman will not mind, therefore, if I do not make any comment about this particular case, because ACOBA is considering it and it would be wrong for me to prejudice its decision by saying, one way or another, what my view or the Government’s view was—not that we have a view until we have received the independent advice from the independent committee.

The hon. Gentleman makes a broader point about employment outside this House and about outside interests. He will know that his colleagues and Conservative Members who sit on the Committee on Standards in Public Life will be looking at this matter again. It is of ongoing concern to the public, and has been for many years, and it is something that the House will have to grapple with in the years ahead. That is why I welcome the Committee looking at it again, and no doubt this will return to the House later.

The hon. Gentleman also makes a wider point about vocation, and I would like to address that directly, as it is very important. In my experience—I am sure in his as well—almost all Members on both sides of this House, no matter whether they are in opposition or on the Government Benches, come to this place because they believe in public service. That should inform their decisions not just about their own interests, but about the wider interests of democracy and the representative system. I am sure that all Members will, in the way they deport themselves in this discussion today, bear that in mind.

I commend everything that my hon. Friend’s friend has done in his previous role, and I know that he will bring that expertise, in due course, to the people of the west midlands. Although councils and all public bodies cannot choose according to geographical criteria, what they can and must do is take into account the social value of their procurement policies, which is why there is considerable latitude for them to have a similar approach to the one that his friend conducted at Waitrose.

Ministers have talked a great deal about linking apprenticeships to public procurement contracts, which is a sensible use of public funds to meet both the skills agenda and to help to narrow inequality in society. However, the Government’s own Social Mobility Commission confirmed last week that only 10% of new apprenticeships are taken up by those from low-income families. Given the Cabinet Office’s unique place to promote this agenda, what is the Minister doing to tackle this unacceptable situation?

The hon. Gentleman raises a completely just point. The whole purpose behind our apprenticeship programme is to give opportunities to people who would not otherwise have them. That is why the 3 million target that we have across the economy is so important. The public sector will contribute a significant proportion of that, and I am responsible for the civil service component. We are doing very well on the civil service apprenticeship numbers. Two weeks ago, we launched a set of standards that will apply to some of the civil service apprenticeships. I hope that, in time, we will be able to fulfil exactly the aspiration that we both have in ensuring that that helps social mobility.

I will indeed join with my hon. Friend. His commitment to the cause is well known, as is the commitment of my hon. Friend the Minister for the constitution, who has really taken this on as something that he wants to achieve in his post. For survivors of domestic abuse, voting is more than just a cross on a ballot paper; it is a renewed statement of the freedom that is rightfully theirs.

Let us take the Minister back to the boundary review, because interestingly the Government payroll is not being cut in this process. Ministers should therefore listen to the Members sitting behind them, such as the hon. Member for Shipley (Philip Davies), who has said:

“We are talking about reducing the number of people we elect at the ballot box, whilst stuffing the House of Lords with yet more people”.

If this is really not a partisan process, and in view of Brexit and the fact that we are removing 73 MEPs, is it not now time to have a fresh review, based on having 650 seats in this place?

I wonder whether the hon. Gentleman will start as he means to go on. I see that he has five Members on the Opposition Front-Bench, compared with our very modest two, which shows how we can cut the cost of politics just by being in power.

We have done some partial work, as my hon. Friend suggests. It is in the nature of the work that we are doing that there is not sufficiently good-quality understanding of public sector land, and that is why we are seeking to make it better. Despite that, we delivered 100,000 homes on public sector land in the previous Parliament, and we aspire to build 150,000 in this one. I shall provide him with further details as and when we discover them.

I welcome the Minister to his post. He will know that in 2010 a report said that the changes to the civil service—the regionalisation of the civil service—would require political leadership. We have seen a reduction in the size of the estate in London but an increase in the number of top officials and civil servants in London. Under his tenure, will we finally see that political leadership and the regions actually having a voice?

I thank the hon. Gentleman for his kind comments. In my previous ministerial post, it was a great pleasure for me to work with civil servants, especially in Yorkshire, including senior civil servants working there. I saw myself how it is possible to have senior civil servants around the country. I completely agree that the more we can get senior positions of all kinds around the country, the better we will be able to serve the people whom we were elected to serve.

I was going to come on to that, so I shall do so now that the hon. Gentleman has prompted me. There have been long and deep discussions about this. Our estimate is that no more than 700 nurses will be affected by the time the new rules are in place, which is a different number from that given by the Royal College of Nursing, whose number we do not recognise. It is small challenge given the scale of the workforce and one that we will surmount at the time, but we must see it within the broader policy of reducing immigration to this country from the hundreds of thousands to the tens of thousands—a policy that has broad support across the House and certainly in the country at large. It would be wrong for the largest employer in the country—one of the largest employers in the world—to exempt itself from that overall ambition.

In the end, we will achieve a sustainable workforce in this country only if we do all we can to ensure that those who are British and have grown up here and want to work in the NHS have the opportunity to do so. That is why it is important that we widen and open the avenues into working in the NHS, as the hon. Member for Bristol South suggested, over the next few years, in order to meet the challenge to which the hon. Member for Strangford alluded.

I want to quickly run through the other issues raised by my hon. Friend the Member for Hendon. On master vendors, he has a specific issue regarding some constituents with whom he has been dealing, but I understand that master vendors are managed under a series of arrangements with the Crown Commercial Service. Officials will meet with that organisation soon to discuss the overall issues around master vendors. It is for individual trusts to make such purchasing decisions, but I understand the issue he has raised and the terms in which he put it, and I will ensure that it is investigated properly.

My hon. Friend identified two areas involving agencies and fraud. Fraud is of course unacceptable, and the NHS has quite good systems for identifying it. Given the scale of the NHS, I find it surprising—it is entirely to the credit of those who work in the NHS—that fraud makes up such a tiny proportion of the excessive costs in the NHS.

On the revalidation of locum doctors, for which the General Medical Council is responsible, some doctors find it difficult to gather all the required supporting information needed for revalidation due to the peripatetic nature of the work. To help with that, specific guidance is available for both the doctors and their employers via NHS England and NHS Employers. Locum doctors are part of a larger issue about agency spend and foreign workers working in the NHS. I imagine that the three organisations will come together in the next few years to produce a more stable situation.

Let me turn to the remaining points of the hon. Member for Bristol South. On the stability of the system, I hope and anticipate that one product of the general election is that the system will be broadly stable over the next five years. We intend to continue with the current structure of the NHS. There will be some small changes, such as that identified by my right hon. Friend the Secretary of State last week concerning the NHS Trust Development Authority and Monitor, but we are broadly content with how the system is set up. We must now proceed to ensure that it works.

The shadow Minister made a point about structures and fragmentation. There will always be a genuine dilemma here, because one can approach any system and say that change can be achieved by altering structures, but changing structures can lead to the same outcome. That has been the story of the NHS since its inception. It would be a mistake to think—the hon. Member for Bristol South and the shadow Minister were not suggesting this—that a structural change would somehow produce the outcomes that we all want. The priority is to ensure that the system’s wiring works correctly—that everyone’s interests are aligned and that the incentives are correct—so that people want to sit around the table and come to a considered decision, which can too often not be the case when there is an adversarial relationship between providers, producers and purchasers. That is why I hope that the system’s stability over the next five years will allow us to focus on the significant challenges mentioned by the shadow Minister.

When discussing competition rules, we often talk of public versus private, but two public parts of the NHS can also compete. Another NHS trust might have the tender for providing a service in another area and an integrated care organisation might want to bring that back in-house.

Absolutely. There are examples of that all over the country, but there are also examples of people working together in what might be considered competitive situations, so it is about ensuring that we copy the best and delete the worst.

Before I turn to the shadow Minister’s comments, I want to reflect on the contribution of the hon. Member for Angus (Mike Weir). The SNP spokesperson on health, the hon. Member for Central Ayrshire (Dr Whitford), has used a constructive tone in the Chamber so far, bringing some of her expert experiences as a clinician and also the experiences from Scotland. It is nice to be able to sit here and hear the experiences of people in Northern Ireland and in Scotland, and it would have been nice to have heard from Wales in this debate. Indeed, we do not yet properly learn from the best in Scotland, which would be all to our good, let alone the best in America or India.

The £22 billion in savings is an estimate not from the King’s Fund but from NHS England. It formed part of its plan, devised at the end of last year and some years in the making, which identified £30 billion of additional money that needs to be put into the service over the next five years. It stated that £22 billion could be generated internally—that was Simon Stevens’ estimate—which leaves an £8 billion shortfall. That is what we are pledged to provide. None the less, he, like everyone in the Chamber, has correctly seen that £22 billion is a large number and one that will take a great deal of intellectual and moral work to deliver. I welcome the tone with which everyone has approached this challenge in the debate.
