18. Thank you, Mr Speaker—and I apologise for my cold. A business in my constituency was the victim of fraudsters who hacked into Barclays bank’s financial system, stealing £500,000 from its accounts. There seems to be no liability for Barclays to refund my constituent for the loss or for the police to track down the fraudsters, who seem to be Pakistan-based. What are the Government doing to protect local businesses from such fraudsters by making banks responsible, and will the Minister meet me to discuss that case?

I am extremely concerned to hear that. The Government are investing more than £48 million over the next 18 months to bolster capabilities to tackle economic crime through, for instance, the new National Economic Crime Centre, which will increase the number of financial investigators and improve the regional and local response. However, I know that the Minister for Security and Economic Crime, my right hon. Friend the Member for Wyre and Preston North (Mr Wallace), is keen to meet my hon. Friend to discuss that case with her.

It is a pleasure to follow the hon. Member for Enfield, Southgate (Bambos Charalambous). The question being asked by No. 10 and journalists alike seems to be whether it is possible for a Brexiteer such as myself who is half French—une femme qui adore l’Europe, mais pas tellement l’Union européenne—to support the Prime Minister’s withdrawal agreement and political declaration in their current form. I can translate that as “a woman who loves Europe but not so much the European Union”. As a pragmatist, I appreciate that perfection is often the enemy of the good. In fact, I am often heard to say to the perfectionists in my family—of whom there are two—usually in relation to homework and procrastination that “done is better than perfect”. That philosophy holds true for any agreement with the EU to assist as smooth a Brexit as possible.

The Prime Minister’s unequivocal determination to ensure the status of EU citizens in the UK—including my mother, as it happens—is absolutely right. It has also been good to see the drip-feed of confirmation over the past three weeks that other EU countries are putting through legislation to ensure mutual status for British citizens living in those countries if we have to leave in a no-deal environment on 29 March. However, as the Home Secretary has had to demonstrate in the last couple of weeks, we face challenges of illegal migration relating to what constitutes a refugee rather than an economic migrant, and of what our policy choices, which are supported by our electorate, are and can be in the future. These questions have all been very much part of the Brexit debate and conversation. The reason why so many people voted for Brexit was partly to feel that they had a more direct line for their views and voting power to be heard in this policy area. They voted not to close the door but to determine these things for ourselves.

I want to highlight one area of concern beyond the question of the backstop, as mentioned my hon. Friend the Member for Mid Dorset and North Poole (Michael Tomlinson), which is the wider defence and security and canvas. The UK is the leading European military nation in NATO, so I am profoundly concerned that the EU’s intention, as outlined elsewhere in the withdrawal agreement and the political declaration, is to reduce our ability as a third country to act independently in the defence arena and to maintain our current position and commitment.

We must look closely at the proposed post-Brexit relationship with the EU that the Prime Minister plans to negotiate and consider whether we should accept what is clearly beneficial to the EU if that would cause significant detriment to the UK’s defence industry, our control of our own defence and security forces, and how we can ensure independently and with sovereign capability that we can decide what we do for our economic security and that of our constituents in the decades ahead. I am concerned by the short-termist tone of Ministers and the Government when they say that there must be no disruption to daily life, but the proposals leave us with the long-term risk of not having really Brexited or regained our freedom of choice and, indeed, responsibility for our actions. Brexit means having nowhere to hide and no one else to blame.

The language of the political declaration includes “flexible and scalable co-operation” to protect from threats and close work at bilateral levels and within international organisations, which all sounds good. Then, however, the language refers to combined efforts with the EU. We already have a powerful and effective combined effort framework in NATO, with EU countries wrapped up in that security blanket. The most recent treaty published this week between France and Germany—the underlying reason for the EU being to stop battles between those two nations and to try to maintain peace in Europe after such bruising and destructive wars in the last century—highlights France’s continuing need to reassert its position vis-à-vis Germany. Indeed, only yesterday the German Foreign Minister talked again of how an EU army is becoming a reality. That detracts from military effort, financial investment and effective outcomes for all our allies through NATO. We must stand firm in reasserting that NATO can remain the co-operative organisation that provides effective security protection under article 5, and driving through policy to ensure that.

The problems with what the Prime Minister has agreed with the EU risk our ability to protect our defence industry as we believe necessary and beneficial. I remain profoundly concerned that the proposals in the political declaration, off the back of the withdrawal agreement, hold unacceptable risks—although there is always a question of balance of risk—to the United Kingdom’s defence and security flexibility and autonomy, and reduce the benefits to UK plc. Having been a global maritime trading nation for the past 400 years, we should be able to bring that back as our focus as we move towards becoming an independent country once again.

I gently say to the hon. Lady that last year we had a general election in which both parties set out what they thought the shape of the Brexit deal should be, and over 80% of voters voted for parties that wanted to leave the EU and leave the single market.

The task before us is to recast our relationship with our nearest neighbours while preserving the bonds of friendship that all of us in this House prize so highly. We need to go about that task with every confidence in our strengths as a nation, as my hon. Friend the Member for Harwich and North Essex rightly reminded us. My right hon. Friend the Member for Mid Sussex brought home the momentous importance of this task, reminding us, with the sense of history we admire so much, that this is one of the most important decisions the House has taken since the war. As he powerfully said, the moment has come for all Members to come together in the national interest.

On defence and security, my hon. Friend the Member for Berwick-upon-Tweed (Anne-Marie Trevelyan) spoke with passion and eloquence—partly in French—et je voudrais dire à mon amie, “Ne t’inquiète pas”. Contrary to Sir Richard Dearlove and Lord Guthrie, that means, “Don’t worry”, because there will be absolutely no impact whatsoever from the withdrawal agreement on our relationship with NATO, our intelligence partnership with the United States or, indeed, our membership of the “Five Eyes”.

Perhaps my right hon. Friend and I will continue in English for everyone else’s pleasure. My concern is not what is in the Dearlove and Guthrie letter, but my assessment of the combination of the political declaration and parts of the withdrawal agreement which, put together, give me—in my own simple understanding—real concerns about the future risk. I would be very grateful if he would sit down with me and look through them in detail because they are genuine concerns. They do not come from anyone else; they are my own assessment.

In answer to the hon. Gentleman’s question, and the question from the hon. Member for Stretford and Urmston (Kate Green), there is no doubt that the only way to curtail such radicalisation is by working with all our international partners, whether in the middle east, Europe or the United States. We have to act together, which is why my right hon. Friend the Home Secretary sits on the Global Internet Forum to ensure that we push those countries together. The United Kingdom’s lead has raised awareness and proved that solid solutions can be delivered.

It is important that we focus our support on the most vulnerable refugees in the region who are fleeing the atrocities in Syria, whatever their nationality. We are more than halfway towards reaching our commitment to resettle 20,000 refugees. As of December, 10,538 refugees had been welcomed in the UK under the scheme. We will continue to work closely with local authorities and devolved Administrations to ensure that we meet our commitments.

Northumberland County Council is providing homes and resettlement family support for 28 Syrian adults and their 41 children, but we currently have no Syrian refugee children as we are short of foster carers to provide the necessary support. Does the Minister agree that we must encourage people who want to support those Syrian children to apply to be foster carers?

I am very grateful to all the local authorities, including Northumberland County Council, that have participated in both the resettlement scheme and the national transfer scheme for unaccompanied asylum-seeking children. Northumberland County Council recently received funding through the controlling migration fund to boost its capacity to look after unaccompanied asylum-seeking children. The Government are reviewing funding arrangements for local authorities that look after unaccompanied asylum-seeking children. In last year’s safeguarding strategy, the Government committed to further boosting fostering capacity, including by commissioning 1,000 training places for foster carers and support workers who are caring for unaccompanied children.

I reassure the hon. Gentleman that we are working very hard to make sure we have a sustainable immigration system both now and going forward. I welcome the fact that there are so many students coming here to study—he will of course be aware that there is no limit on the number of students who can come to this country—but what I really welcome is the number of EU citizens who came to this country not just looking for a job, but with a job to go to.

Serious and organised crime does not respect force boundaries, which is why we organise our response at regional level, giving us the ability to tackle organised crime groups head-on. The Government have invested £140 million in ROCUs since 2013, and last year we announced £40 million of additional funding to enhance ROCU capabilities further in areas such as cyber-crime and undercover work.

I understand my hon. Friend’s concern, but I can assure her that the use of informants is strongly controlled by robust safeguards and independent oversight. We must not shy away from using informants, as their use in certain circumstances is vital in stopping some of the worst in society carrying out their crimes.

The hon. Lady is right that the main carer for elderly people—often it is our parents—tends to be a woman, just as it does for children. One thing that we hope to achieve culturally, rather than through legislation, is to share that responsibility more equally. Certainly she is right that the Government need to give considerable support to the women who do so much of the caring.

Emily Davison was a child of Northumberland and is buried in Morpeth, 6 miles from where I live. The town is in full bunting celebration this week to remember her and her bravery in stepping out, because she felt she had no other way to be heard, to try to reach the King on Epsom racecourse, where she lost her life.

The challenge is that bravery is still required to stand as a female politician. Too many people say to me, “Gosh, you’re very brave to be in politics.” I do not feel brave. Mostly, I feel very loud and noisy: I have stuff to say, I want to say it and I have this extraordinary place in which to share my beliefs. Can the Home Secretary give us confidence that we will get the police force and the Crown Prosecution Service to work more effectively to protect us and all those who follow us in politics from attacks? I have received personal attacks that have not been followed up, whereas colleagues have found police forces in other parts of the country more effective.

My hon. Friend is absolutely right. I hope it is taken as a central theme of the message I am putting out today that we will do more to ensure that women who participate in elections are protected. The Law Commission is reviewing whether there is a parity of approach to offline and online offences, as we believe should be the case. If an additional piece of law is needed to ensure that electoral candidates get additional protection, we will put one in place. I will review what my hon. Friend has said to see if there is any additional help I can give her.

I congratulate my hon. Friend on the work he is doing on that commission and the work he has done around health. One of the complexities with such a debate on autism relates to the Department that should be answering. I do not think I am giving away any state secrets by saying that I received a phone call from the Government asking, “Which Department do you think should reply to your debate?” I do not blame the Government for that—having been a Minister, I understand how Government works—but one of the key problems is the difficulty in ensuring that services are joined up across the Department of Health and Social Care, the Ministry of Justice, the Attorney General’s Office, the Home Office, the Department for Work and Pensions and the Department for Education. All those things play into each other. Even though today’s debate is specifically about the criminal justice system, it is inevitable that other issues play into it.

Does the hon. Gentleman think it might be worth the Government considering, with Cabinet Office oversight, the creation of something like the covenant and veterans board? That would ensure that every Department had someone absolutely focused on the issue. Autism affects every Department and how we make reforms. Such a board could drive the agenda much more comprehensively through the system.

I think that is an excellent suggestion. In my experience in government, to get Departments working together and to make progress we have to bring Ministers together, not just officials. Those Ministers have to understand and be passionately committed to making the change. It is possible to make significant change simply by ensuring that Ministers are brought together. When I was a Minister, I attempted a joint project with another Minister, and the only way we could get it done was by ensuring that we met regularly. We told our officials, “You will do this, even though it is not currently in the Department’s culture. We are both telling you to do it, and you will work together to do it.” The hon. Lady’s suggestion is excellent, and I hope that the Minister will take it on board. Even if he cannot commit to doing it this afternoon, I hope he will commit to taking it away and discussing it with his colleagues.

Will the Home Secretary tell the House what we are doing to support schools to identify when the dark web is accessed through apps that are free to download? This is how some of our most vulnerable children are accessing footage of ISIS beheadings and other disturbing imagery, which is fuelled by extremists who are trying to get new recruits.

My hon. Friend is right to raise these real concerns about online access, which is why the Department for Education and the Home Office work together on campaigns such as Cyber Aware to bring good computer hygiene and caution into the classroom so that children are not exploited online. It is also why the Government invest in the Prevent programme to make sure that the people doing this are brought to justice and that the online space is not the dangerous place it could be.

I fear the hon. Gentleman may have strayed into the wrong debate. We have shown our commitment clearly through our work on the vulnerable person resettlement scheme and by taking firm action so that children and vulnerable adults come to this country quickly, while dealing with safeguarding and the best interests of the child. I will take no lectures from the hon. Gentleman.

I commend the Minister for the huge effort he and his team at the Home Office have put in. I have a specific question from the many people in Northumberland who are keen to help. They have shown a real willingness to be a part of the scheme to bring in the most vulnerable children who need protection. How can they become foster carers and ensure that they are able to take all children in need, as well as the many children in Northumberland who already need a home?

The Children’s Minister, my hon. Friend the Member for Crewe and Nantwich (Edward Timpson) is sitting alongside me on the Government Front Bench. He and I recognise that there is a further opportunity to encourage people to come forward to become foster parents. It takes about nine months to train as a foster parent. On teenagers and issues of specific vulnerability, if people can come forward to their local councils and say that they want to become a foster parent, that would do an awful lot to assist not just with the implementation of this scheme but with ensuring vulnerable children in this country receive the love, care and assistance we all want them to receive.

It is with a heavy heart that I stand to speak in this debate, as I am one of our Home Secretary’s most ardent supporters. Our nation is lucky indeed to have someone so entirely committed to protecting our citizens and doing all in her power to make our Home Office functions work as effectively as possible. However, I have been more than a little bemused by this proposal that the UK sign up by 31 December 2015 to reciprocal data-sharing of our DNA, fingerprint and vehicle registration databases with EU member states that have already signed up to Prüm.

I was under the impression before I came to the House that we had opted out of all police and criminal justice measures, including the Prüm decisions, agreed before the Lisbon treaty. There was a good deal of noise about this last year when, in the run-up to 1 December 2014, the British Government declared that we would rejoin 35 measures in the national interest—I am led to understand that that number would have been smaller had we not been in coalition—but we did not seek to rejoin Prüm. It seems that the reason for not opening up our databases to fellow EU states was not one of national interest or protection of our citizens’ data from different police jurisdictions, but simply that we would have been fined because we could not have built the computer system in time for the deadline and so would have been at risk of infraction.

I commend that decision on financial prudence grounds, as well as data protection ones, but I am bemused because I remember the Home Secretary saying the European Court of Justice should not have the final say over matters such as criminal law and that Her Majesty’s Government should be able to renegotiate such arrangements as they saw fit. That is why I have been confused. While there is an opportunity, the window for which closes on 31 December, for us to sign up to Prüm, we could just as easily not sign up now to taking us into Prüm under the Lisbon treaty framework, with the attendant risk of putting our most personal biometric data and its management under ECJ jurisdiction. We could instead build our own portal and allow other countries—including those outwith the EU, not just EU countries—to access our DNA and fingerprint records under our own legal framework and control. The fact is that criminals and those wishing the British people harm come from all over the world, not simply from EU countries.

I accept that there might well be biometric data on foreign criminals in EU databases, as we have in ours, but surely it would be more sensible to build a database that we use to assist police forces around the world, with whom bilateral agreements already in place could be enhanced by such data-sharing. I am not against the concept of sharing data in and of itself, but the safeguards for those who could be wrongly identified and pursued by foreign police forces must be absolutely watertight.

I commend Ministers for the detailed specifications set out in the command paper about when a positive hit on a biometric should be progressed for handing over personal information. The fact that only the biometrics of adults convicted of recordable offences should be shared is a good safeguard. In the UK, however, we also hold the biometric data of juveniles convicted of recordable offences, of those arrested and charged but not convicted of many serious offences and of those whose cases have not yet been concluded. Again, my concern remains that while we intend to safeguard most of the UK data held from view by EU states through Prüm, we risk ECJ jurisdiction over our citizens’ data—as was said earlier, the lines are moving—when there are other options available to Great Britain’s police forces for accessing other countries’ records when trying to track down criminals.

The command paper states that of the 15% of crimes committed by foreigners, half are by EU citizens, and the other half are not. I know that every police force, anywhere in the world, will always want more tools to help them fight crime and solve serious offences. I was more than a little concerned by the shadow Home Secretary’s comments that security will trump civil liberties. I am afraid that that is not a view that I hold. There must be points at which we in this House determine the security of our citizens’ most personal biometric data, which must not be put at risk. We must retain complete control of our data records.

As a member of the Public Accounts Committee, I am also concerned at a practical level that the proposed cost of £13 million to build this portal to access British DNA, fingerprint and vehicle registration data is quite likely to be an underestimate. Since I was elected, I have sat in hearings week after week to listen to the justifications of Departments as to why IT projects have not gone according to plan or budget. The reality is that any new IT programme is fraught with challenges, but to build one that will need so many safeguards will undoubtedly be the cause of many problems, delays and unexpected cost increases.

I do not suggest that we should not be trying to build a portal of some kind to assist international law enforcers in the medium term to gain faster access to data, just as we see the benefits of accessing the data within other EU states, but I am not convinced that giving the green light to do this under pressure from states signed up to Prüm that are keen to get into our databases is the way forward.

I hope that Ministers will be able to assuage my anxieties on these matters for my constituents. I thank the Minister for giving me time to discuss these matters in detail last week. We have choices in how we go about increasing our biometric data sharing with other nations. I am simply unable to see why a rush to sign up to Prüm before new year’s eve is out is the right way to go. I will continue to listen to the debate and to Ministers’ honourable and considered positions on Prüm in the hope that my fears for both IT costs and potential failures will be proved wrong. I hope the Government will see that criminality extends beyond a few EU states in the complex global network that we all live in today.
