Commons ChamberThe conundrum we are facing is that this is the first time in our history that the establishment and the Government of the day, having decided to have a referendum, have got a result that they disagree with. The Labour party’s 1975 referendum, and the Scottish, Welsh and Northern Irish referendums, all delivered a result that was satisfactory to the establishment and the majority in this House. Today, we face the opposite.
Two weeks ago, I was at the annual general meeting of my local National Farmers Union office, and a lady said to me, “What is it about London—what don’t they get? We voted to leave. Leave means leave.” As a founder member of Vote Leave, I think that we were pretty clear right throughout the campaign about what we wanted—we wanted to take back control. The Government have been pretty clear that they are going to deliver on that.
We wanted to take back control of our money. On my first day at the Department for Environment, Food and Rural Affairs, my Secretary of State’s briefing said that we were handing back £642 million of real money because the Commission, under the ECJ, disliked the manner in which the right hon. Member for Derby South (Margaret Beckett) had implemented the then CAP reform. So there was I, democratically elected and responsible to this democratic House, with nothing I could do about it. This House began from the principle of deciding what taxes were and who was responsible for them, controlling the monarch of the time, and it still has that fundamental role. The people will get back their role of kicking out politicians who raise taxes and spend them badly, because we do not have that at the moment.
We voted to take back control of our laws. I know about that in spades from my time at DEFRA. About 90% of DEFRA’s work is the implementation of European law. I tried manfully in negotiations to work with good allies, but we were outvoted on many occasions, and our farmers are struggling with the latest CAP reform. With many areas of activity competing strongly to be the worst, I would say that the EU’s governance of fishing wins, because it has been a catastrophe. Getting back our powers to control our fishing will restore our marine environments and fish stocks, and bring prosperity and wealth back to our most remote marine communities.
I am listening to what the right hon. Gentleman says about the CAP, but does he believe that post-Brexit—in 2019 and 2020—the UK Government should continue to give support to farmers at the levels they are currently receiving? Does he believe that that money should still go to farmers or not?
Emphatically yes. If the hon. Lady had listened to my speeches during the referendum campaign, she would know that I said, “And, if appropriate, more.” What we will now be able to do is to embrace technology. The EU is becoming the museum of world farming because it is so extraordinarily hostile to technology—and that also applies to fishing.
The hon. Lady has also mentioned immigration—quite rightly. The most angry people I met when I was at DEFRA were the fruit farmers in Essex, Kent and Hereford who had been deprived by the then Home Secretary, now our Prime Minister, who had stopped the seasonal agricultural workers scheme, which brought in 21,250 highly skilled Romanians and Bulgarians before their countries became full members. I worked hard with my right hon. Friend the Member for Chingford and Woodford Green (Mr Duncan Smith) and the then Home Secretary to see how we could work our way around this. The hon. Member for Penistone and Stocksbridge (Angela Smith) is absolutely right—we need a supply of skilled labour to work in our horticultural, fruit-picking and vegetable industry, and also in food processing.
At the other end of the scale, I know an eye surgeon whose family—they are Sufi Muslims—came from the United Provinces of India. She gave me, unprovoked—I have clean hands; she started it—the most extraordinary lecture attacking current immigration policy whereby she has to take less qualified, less skilled, less safe and less experienced eye surgeons because they have European passports, and she cannot choose more skilled and safer ones from Bangalore, Hong Kong or San Diego. I would like us to have the choice of the world’s workers—whether fruit packers or eye surgeons—on a permit scheme. I wholly endorse the comments of my right hon. Friends the Member for Loughborough (Nicky Morgan) and for Surrey Heath (Michael Gove) because it would send out a tremendous signal if we stated here and now that there are very large numbers of EU citizens working in our economy who make an enormous contribution. We should give them, up to a certain date, the right of abode, and from then on move to a permit system.
We said that we would take back control of our ability to trade around the world. SNP Members make a huge fuss about the single market and the customs union. We have to leave the single market if we want to come out from under the cosh of the European Court of Justice. The single market does not exist anyway. My noble Friend Lord Bamford recently gave a very good speech in another place saying that there are 10 standards for brake lights on tractors within the current so-called single market. It is a non-problem. People just punch in the information when they go on the production line.

Commons ChamberI am grateful to the right hon. Gentleman for his question. We have regular discussions with our counterparts across the border. We take information from them and they take information from us, so we are observing with interest the vaccination trial that is taking place over 1.5% of the surface area of Wales.
We learned late last year that the Government would not allow scientific evaluation of the extensions of the pilot culls. Then the independent experts reported that DEFRA had failed to meet its main test for humaneness and now we learn that Ministers have no plans to scientifically evaluate the second phase of the pilot culls, which are due to take place later this year. Is there any valid reason why scientific evaluation of the culls has been abandoned—or is the Secretary of State just allergic to scientific advice?
I welcome the hon. Lady to her post and congratulate her on her new position. I would like to reassure her that it was always our intention, stated right back in 2011, that an independent panel would assess the first year of the pilot culls. We have had some helpful recommendations from the panel, which we are taking on board, but I think she is unfair and underestimates the professionalism of the skilled staff we have in Natural England and the AHVLA, who will continue to monitor the culls this year.

Friend and I will be in total agreement that it would be a huge change in the whole debate if we could establish some form of polymerase chain reaction technology using DNA where we could identify and differentiate diseased and healthy cattle and, above all, diseased and healthy badgers. We are pressing on with that—we have done a lot of work with Warwick university—because I do think this would change the whole debate, and if we could target culling, it would be so much better and so much quicker and make it more effective.
For the sake of the record of the House, can the Secretary of State be clear about the decision relating to the roll-out of the culls? Is the roll-out cancelled or is it scheduled for a further date, and if so, when will the culls be rolled out?
I am very happy to clarify that, but I thought I made it clear in the statement. What we are saying is that there are clear lessons to be learned from the panel report, and clear lessons in practical terms that we learned from the cull companies, so sensibly we are continuing with the existing two pilots so we can perfect this system of removing diseased wildlife. Once we are happy we have got that system perfected, we will look to a further roll-out. The original intention was to have 10 areas, and we have over 30 expressions of interest from around the country. [Interruption.] Those chuntering on the Opposition Front Bench should not underestimate the desperation in cattle areas and the frustration that we cannot go faster. It is clear from the panel report that we need to perfect this particular method of removing diseased badgers before rolling out further. However, it is emphatically our decision to roll out further once the technique is perfected.

2. What changes he plans to make to policy on bovine TB; and if he will make a statement.
We published our draft strategy for achieving officially bovine tuberculosis-free status for England in July 2013 for consultation. The final version, which we will publish shortly, will outline our comprehensive plan for tackling the scourge of bovine TB in England.
I am sure the Secretary of State agrees with me that if the report confirms that a significant number of badgers—well above the recommended 5% limit—took more than five minutes to die, that would be a very serious matter because it would prove that the cull was inhumane. In that circumstance, would he not think it vital to reconsider the policy and to abandon absolutely any plans for rolling out culling later in the year?
I received the panel’s report only recently. I am considering it, and I will come back to the House in due course, when it has been fully considered.

Will the Secretary of State clarify how the remarks he made on allowing ancient woodland to be lost to development meet the spirit of his Department’s forestry policy statement which states categorically:“Protection of our trees, woods and forests, especially our ancient woodland, is our top priority”?
I am absolutely delighted to be able to reassure the hon. Lady and the hon. Members for Huddersfield (Mr Sheerman) and for Bristol East (Kerry McCarthy) that the idea that biodiversity offsetting could be used as a means of imposing unwanted houses on ancient woodland is an absolute travesty. It is absolutely clear: all along we have always said that should we bring in offsetting—I made this clear to the all-party group—all the current protections of the planning regime and all the mitigation hierarchy remain. Only at the very last moment could offsetting be considered, and we have always said that some assets will be too precious to offset and—[Interruption.] Exactly, and that might well be ancient woodland.
The hon. Lady should look at examples of offsetting in countries like Australia, where there has been an 80% shift of planning applications away from fragile environments. Used properly, therefore, biodiversity offsetting could be a tremendous tool to protect those ancient woodlands which she and I value. As someone who has planted an arboretum over recent years, the idea that I am going to trash ancient woodlands is an absolute outrage to me personally.

Commons ChamberThank you, Mr Speaker. My hon. Friend raises a vital point—we need a dynamic, productive and successful dairy industry. We will not have a dairy industry if we do not tackle that bacterium, and if we do not do what every other sensible country has done when there is a reservoir of disease in cattle and a reservoir of disease in wildlife.
The estimate last October was that there were 4,300 badgers in Somerset. The estimate this week is 1,450. Is it the Secretary of State who has moved the goalposts, and not the badgers? Has he not scored a massive own goal in pursuing this misguided cull?
I do not know whether the hon. Lady saw my comments. I stated something that was screamingly obvious: badgers are wild animals that live in an environment in which their numbers are impacted by weather and disease. She should reflect on this. I can report to the House that some of the animals we have shot have been desperately sick—in the final stages of disease—which is why we are completely determined to see the pilot culls through, and why we will pursue measures that the previous Government ducked. We are dealing with a bacterium that affects cattle and wildlife, and ultimately human beings. We will address that bacterium in a rigorous and logical manner.

Commons ChamberT6. In response to the recent statement on the badger cull in the House of Lords, the noble Lord Krebs urged Ministers to gather together scientific experts and rethink the Government’s strategy altogether. Why does the Secretary of State not do just that?
We have been over this ground on several occasions during the last few days. We are absolutely clear about the fact that the scientific analysis of the trials conducted by the Government that the hon. Lady supported show a 28% reduction in the culled area. That is the information that we are going on, because it is scientifically based.

Commons ChamberI entirely endorse my hon. Friend’s commendation of the NFU. It would have been quite wrong to go ahead when it was not confident of reaching the 70% target and could have made the position worse.
I was discussing the DIVA test with my senior scientists this morning, and we are determined to go full bore on it. There is agreement throughout the House that in an ideal world we would have a vaccine and a DIVA test, and we could then go to the Commission. I am keen that we look at the new technological developments as soon as we can.
How many discussions has the Secretary of State already had with European colleagues and the Commission to lobby for the DIVA test and cattle vaccination to be rolled out in the UK?
We have been in regular discussions with the European Commission, which is very supportive of our position. Only recently DG-SANCO—the directorate-general for health and consumers—stated:
“There is no scientific evidence to demonstrate that badger vaccination will reduce the incidence of TB in cattle. However there is considerable evidence to support the removal of badgers in order to improve the TB status of both badgers and cattle.
UK politicians must accept their responsibility to their own farmers and taxpayers as well as to the rest of the EU and commit to a long-term strategy that is not dependent on elections.”
