Commons ChamberI was in Bahrain last week, where I met the chair of the independent monitoring committee, who has taken a special interest in some of the cases that have been raised in the UK to make sure that proper human rights are available to those who have been convicted in Bahrain. We still monitor a number of cases, but I urge people to go through that independent process because we are confident that it is genuinely independent and it is making a difference to the administration of justice in Bahrain.

I am grateful for my hon. Friend’s question; no one could be a more determined supporter not only of the rights of Christians in other countries, but of freedom of belief and religion for all, which he champions. The United Kingdom believes that Russia must uphold its obligations under international humanitarian and human rights law, and we call on Russia to release immediately over 70 political prisoners detained in Russia and Crimea. I will ensure that his comments about minority faith prisoners and detainees are conveyed to the Minister responsible.
No one benefits from actions that are contrary to international law. No one benefits from disruption. The only people who benefit are those who can demonstrate a clear and concise response to such aggression in an effort to return the world to a rules-based system, where there will be de-escalation, and collective security for all because it is not provoked by unreasonable actions.

I do not know whether it is appropriate to answer in the terms that the right hon. Gentleman has offered. He poses his own question, which I think will be out there for many others to consider. We remain clearly very attached to Israel as an ally in many respects in terms of defence and security particularly in what is a difficult region, but, as is sometimes the case even with the closest friends, there are areas where we are not only not certain of their course of action but believe it to be fundamentally wrong, and this is one of those. So we must manage that relationship. This provides another opportunity for us to talk further about what will happen in the future, but every time there is something like this, it makes it that bit more difficult to see that something we have all been working on for so long is going to result in the solution we are all seeking. But we will continue to press for that.
Are we mad in continuing to express concern or even condemn and yet expect a different outcome? No, we are not mad because actually we do not expect a different outcome and, by our refusal to act, we make ourselves complicit, don’t we?
My right hon. Friend has experience of government and of relationships with those in the region and understands the background of which he speaks. It does make it all difficult, but we have not all given up on the prospects of a two-state solution, which, as I have said, I do not see an alternative to, and the UK’s determination to keep in contact with all sides in relation to this and press that case is perhaps even more imperative now than it was this morning.

Commons ChamberIt is a constant part of the conversation we have in Iraq and in other places to make sure that as the country moves forward, particularly after a relatively successful election process, all sections of the community are included in future. When we meet Iraqi parliamentarians, as well as Ministers, we stress that a country is not complete unless women are playing a foremost part both in ministerial and civic society life.
In what way is the demand for full freedom and self-determination among the Iraqi people, particularly the people of Kurdistan, illegitimate?
Questions of the constitutional structure of Iraq are not for the United Kingdom. There is regular dialogue between different sections of the community in Iraq about the proper constitutional processes and structures that will help all parts of the community to develop effectively and strongly. It is essential that the new Government recognise the needs of all sections of Iraqi society.

I refer to remarks I made earlier about how we intend to conduct the case and the answers that I can give to the hon. Lady’s questions. We remain of the assessment that a private, rather than public, approach is most likely to result in progress in Nazanin’s case and ultimately, her release, which is all any of us want.
I can answer one or two questions. On diplomatic protection, the FCO is in discussion with Mr Ratcliffe and his legal representatives on the merits of a claim for diplomatic protection. It would be remiss of me to comment any further until these discussions have concluded. I am not making any comments about the charges or anything similar.
As I have said, our ambassador spoke to Mrs Zaghari-Ratcliffe on Sunday. He assured her that we continue to prioritise the case and do everything we can to bring about her release, including requesting consular access, requesting access to medical reports and requesting a temporary furlough so that she can indeed celebrate Gabriella’s birthday with her family.
On the International Military Services issue, we do not share the view that the IMS debt or any other bilateral issue is the reason for Mrs Zaghari-Ratcliffe’s detention. The UK has always been clear, both publicly and in private discussions with Iran, that the two issues are entirely separate, and the Ministry of Foreign Affairs has publicly stated on several occasions that there is no link. We will meet our legal obligations in relation to the debt, and funding to settle the debt was transferred to the High Court several years ago.
Will my right hon. Friend ensure that Foreign Office advice relies on the fact that this experience is a powerful corrective to any notion of dual nationals that they might return to Iran?

With respect to my hon. Friend, until we see the make-up of the inquiry process, we will not know the answer to that. I made it very clear that if Israel is not only to undertake its legal obligations for what has happened on its territory but to fulfil its own processes, an international element to the investigation will clearly be one of the most important things, and that should bring the transparent and independent element that the UK and others have called for in order to find out the answers to these questions.
Human rights are constrained and violence exacerbated by a water shortage that the UN says will render Gaza entirely uninhabitable by 2021. Does anyone have a plan?

I hear what the hon. Lady says and recognise her background and achievement in being here. The recognition of a Palestinian state remains open to the United Kingdom, at a time when it is best designed to serve the cause of peace. That will remain the UK’s position.
Why are those of us who have had the chilling experience of entering and leaving the prison camp that is Gaza never really surprised, no matter how grotesque the violence gets?
I do not think we are ever really surprised because the seeds of the conflict are so deep and at times there seems to be little attention given to dealing with them rather than using them in various ways. The inevitable consequence of not dealing effectively with the issues on all sides is what we saw yesterday.

I made clear to the House a moment ago the United Kingdom’s feelings about the death penalty—that the issue is raised, that it is not our policy, and that it is not a policy that we support in any state. We have raised the case of the minors, seeking a situation where they might not be executed. That matter remains very much a matter of concern to the United Kingdom, which is why we talk about it publicly and raise it privately as well.
It was self-evident earlier that Houthi propaganda has been remarkably effective. Is there anything we could learn from that?
I defer to my right hon. Friend in his knowledge of propaganda and how it might be used. I am not sure whose voices are listened to most in relation to this matter. As the Houthi are not a state, because of history, it has been very easy to target the Kingdom of Saudi Arabia in this case. A more comprehensive picture of the conflict would perhaps lead to different conclusions. The conclusion, however, that we all want the conflict to end, so that there can be a durable peace and better security for the people of Yemen, who deserve better governance than they have had for some decades, is a matter of importance to us all.

I thank the right hon. Lady for her comments. I agree that a difficult consensus has been broken. She is right that the international consensus around the status of Jerusalem has been one of the things we have all held on to during a period when the ultimate settlement—the final settlement—has yet to be agreed. It has always been seen as part of the process that, at the end of that negotiated settlement, the status of Jerusalem would be confirmed. The United States has taken a decision about itself and about the location of its embassy. In answer to her final point about the United Kingdom’s position vis-à-vis President Trump and the United States, we make it clear that we disagree with the decision. The Prime Minister has said that it is unhelpful. It is not a decision we would take.
We have now to decide, as the right hon. Lady said, what we do now. The first thing we have done is to co-sponsor a meeting tomorrow at the UN Security Council when this will be discussed. We have co-sponsored that with our European partners because it provides the opportunity to take stock of where we are and how we can move forward. There are two options: one is that we just dwell on this particular decision of the United States, as people will for a while, and just leave it sitting there; and the other is to decide what we do now. It is imperative that we now see the work that the President’s envoys have been doing, which they have shared with a number of partners. That now needs to come forward—more quickly, perhaps, than people anticipated—and then we can see what there is to work on for friends both of Israel and of the Palestinians. The process has to move on. If the process were derailed by this, it would compound the unhelpfulness of the decision. That is what we want to talk about.
The right hon. Lady mentioned our longer-term relationship with the United States, which is very deep: defence, intelligence, security, trade—it covers a multitude of things. It has been in place for centuries and it will go on for centuries, regardless of leadership. We respect an elected President but we know that the relationship with the United States is much deeper, and the United Kingdom will continue to honour that relationship in its many forms.
If the President has a cunning plan which he has not shared with any of his allies, may I invite my right hon. Friend to speculate on what it might be?
If there is, this is a decision that has clearly been welcomed by the Israeli Prime Minister and the state of Israel. There is no doubt that Israel sees the United States as a great friend. There is no surprise to any of us in relation to that, and nor does it change anything particularly markedly in terms of relationships in the region. Perhaps, when proposals come forward, if concessions are needed by the state of Israel in order to make the agreement that we all wish to see which will be supported by all sides, there just might now be an extra area of pressure that can be applied because a friend of Israel has done what the President has done.
I have no inkling of the thinking of the President of the United States. But, as everything in this whole business is used in one way or another, there are just possibly those within the state of Israel who will recognise the limb that the President has gone out on, and perhaps, when push comes to shove, that might be of some assistance. As for us, we are very clear on our position. We disagree with this and we will continue to work with all partners to seek the peace settlement that is so urgently needed.

Commons ChamberAgain, I come first to the hon. Lady’s last point: how will this conflict come to an end? This conflict will come to an end when both sides are brought together by people who make it clear that there is no military solution to it, and that there has to be a political one. That is what the United Kingdom has sought to do for many months, through meetings with appropriate parties here in London, in New York and in the region. We share her frustrations because, like others, we can see the impact.
I will comment on one or two of the hon. Lady’s other perfectly proper remarks. First, the key test for our continued arms exports to Saudi Arabia in relation to international humanitarian law is whether there is a clear risk that the items that are subject to the licence might be used in a serious violation of international humanitarian law. That situation is kept under careful and continual review, and, like all other aspects of the United Kingdom’s arms control policy, it is subject to rigorous examination here and by the law.
Secondly, the hon. Lady is right to raise the question of access, as we have done. The restrictions on access do not mean that our work now is meaningless, as she indicated; I am sure that she does not mean that. We are working through partners who are there on the ground, but distribution is, of course, harder. That is the case not just in coalition-controlled areas, but in Houthi-controlled areas; I have to remind the House that there are two sides to this.
Lastly, I will deal again with the subject of arms exports, because I know that it is fundamental. I related this to the hon. Member for East Dunbartonshire (Jo Swinson) the other week, and I shall do the same thing again; I do not mean to be harsh about it. If we thought that our not sending support to our allies—who are facing attacks on their own soil, from missiles imported into ungoverned space, where they are trying to support an elected Government against the insurgency—would send the right signal in the region and would prove to be of any use, it would be a course of action, but I do not believe that that is the case. I do not believe that if we were to take that action, it would not fundamentally undermine a number of other regional issues and make our allies wonder, when they faced an attack on their Heathrow, whether we were making the right judgments. We have to pursue other means of bringing the conflict to an end, and that is what we seek to do.
Yemen is subject to restrictions brought in by the coalition parties following the attack by a Houthi missile on Riyadh, and because of the smuggling of arms and weapons that has threatened the coalition in the UAE and Saudi Arabia for some time. I am not sure that the nomenclature adds a great deal, but that is the reality of the situation.

Commons ChamberNo, I do not think the Chancellor was informed, because it never became a policy, or had the chance to become a policy, to fund the Israeli Defence Forces in the Golan Heights. Secondly, as I said a moment ago, as far as the ministerial code is concerned, the Prime Minister has seen the Secretary of State, who has explained and apologised again for not informing people beforehand. The Prime Minister regards the matter as closed, but she is looking to tighten up the ministerial code to make it very clear what the process should be. Do I have full confidence in my right hon. Friend? Of course I do.
When I met the Israeli Deputy Prime Minister, he stormed out of the meeting. The Secretary of State got a much more cordial reception. Is it just because she is a lady?
I am not sure if it is appropriate for me to answer on either how my right hon. Friend was treated or the reception for the Secretary of State for International Development, but I am quite sure that both meetings were perfectly proper and appropriate.

My hon. Friend is slightly tempting me to use a type of language and to go down a route that might be more appropriate from the Back Benches than at the Dispatch Box. He makes his point well, but we all understand that the President recognises the responsibility that he bears on behalf of many, and that he will continue to listen to partners in relation to defence and security. We will continue to look at all opportunities to do that, particularly in relation to this agreement.
Is it the availability of intelligence that has prompted the Government of Israel to support the President’s assessment?
If it was, we do not comment on intelligence matters anyway. None the less, I will say that there are many different voices in Israel as well on this particular agreement. There is no alternative agreement being put forward. I am not aware of an alternative JCPOA being put forward by any powers, and I remain of the view, as do the UK Government, that this agreement does the job that it is designed to do. It does not close our eyes to other things that need to be dealt with, and Israel has genuine concerns about Iranian activity in the region. Those concerns stand whether or not the agreement goes forward, but they are easier to deal with if we keep this agreement in place.

I think my right hon. Friend is referring to some work done by the EU. The EU has not sought compensation from the state of Israel in relation to that, and no decision has been taken on any further action.

Commons ChamberI am glad. I have heard the mantra repeated again and again: despite having voted to remain, Members accept the will of the electorate. But when the mask slips, as it did during the speech of my right hon. Friend the Member for Broxtowe (Anna Soubry)—
Of course she is entitled to her view, but when that mask slipped, it was cheered on the other side. Do those Members really accept the will of the voters, or is this actually a ruse to thwart Brexit?
