Commons ChamberI will come to that in a second—it will become clear in the next section of my speech—but I can tell the hon. Gentleman that the Bill is about giving people choices. If people want, as many will, to carry on driving their existing vehicles in the traditional way, that is absolutely fine and no one is going to try to stop them. To be very clear, the hon. Gentleman can carry on driving for as long as he wants to and is safe to, and no one is going to try to stop him. Certainly, I am not going to try—I wouldn’t dare.
On the legal concerns—this will address the point about the driving test, too—the Bill redefines our legal relationship with road transport. As soon as someone turns on a self-driving feature, legal responsibility for how the car drives will transfer to an authorised self-driving entity, or ASDE—not a very catchy acronym, admittedly, but that is what they are called. That could be a manufacturer or a software developer but, crucially, it will not be the human driver, who will assume a new status. As a user in charge, they will still need to ensure that the car is roadworthy, and they will need to reassume control if necessary. That answers the hon. Gentleman’s question: someone will still need to be in possession of a full driving licence and able to reassume control of the vehicle if required, but they will be protected by law from any offences while the car is driving itself.
Some journeys, either in private cars or on self-driving transport, will be fully automated, and a human will never need to take control; they will be, in essence, a passenger. My hon. Friend the Member for North East Bedfordshire (Richard Fuller) mentioned the example of Waymo cars in the US. Those are operated as taxis, with no driver present, and the human is never expected to take control; it is classed as a “no user in charge” journey. In those circumstances, someone would not need a driving licence, because they would never be expected to drive the car, in the same way we are not expected to drive a taxi or private hire vehicle. Those legal concepts will have a seismic impact.
This is the future, and it is both quite exciting and quite scary. We have to get our heads around it and make sure that we get this right. On what the Secretary of State has just been describing, is it basically the difference between someone taking a taxi and driving their own car? If there is an accident in a taxi, the taxi company is responsible, not the passenger.
If someone is using a vehicle for a “no user in charge” journey for which they are, in effect, the passenger and there is an accident, it will be totally the responsibility, in all circumstances, of the person operating the vehicle. Where someone who is driving the car for part of the time switches on the self-driving features and something happens while those features are activated, that will be not their responsibility but that of the manufacturer or the software developer. If someone is in control of the vehicle and the self-driving features are not activated, they retain responsibility.
One of the things that we will have to do is educate people about the difference, and we are being clear to manufacturers that there is a big difference between a self-driving feature and driver assistance. Under driver assistance, the driver is still fully legally responsible for the vehicle, but with some technological help; when the self-driving features are activated, they no longer have legal responsibility.
Is there not potential for a legal conflict between a driver who says, “I was in self-driving mode,” and a company that says, “No, it was switched off”? Does the Secretary of State see that it might be very difficult to establish what happened in such circumstances?
Potentially, but that is exactly why the earlier question about data is very important. These vehicles generate a huge amount of data and one part of the authorisation process will be making sure that that data is properly managed and there is proper access to it by the investigators of any potential accident and the insurance industry to establish exactly what has happened in such circumstances.

Commons ChamberMy right hon. Friend makes a very good point about what we should prioritise when funding roads. He should know that one of the important changes I have made is to make sure that our active travel team is focused on delivering cycling and walking schemes that increase choice, rather than focusing on driving people out of their cars. I hope he will welcome that important change.
The Secretary of State says that his party is not anti-motorist, but it is clearly anti-public transport. We Liberal Democrats are not anti-motorist either, but we are unequivocally pro-public transport. Rail produces 76% less carbon dioxide emissions than the equivalent road journey, and each freight train removes up to 76 lorries from our roads. The decision to scrap the northern leg of HS2 will lead to up to half a million more lorry journeys up and down the country, resulting in a lot more congestion in our towns and cities. Is the Secretary of State not concerned that freight that would have gone on to the railway will now be forced on to the roads, increasing our carbon emissions and congestion?
I do not agree with the hon. Lady’s characterisation of our view on public transport. First, we have already put in a significant amount of extra money this year and, from the savings, still more is going into our bus system. Our £2 bus fare cap is making it much easier and cheaper for people to use public transport. Twice as many journeys are made by bus than by rail. She should also know that HS2 spending was crowding out other important investments. One of the things we are now able to fund is the £600 million project at Ely junction that will increase capacity for both passengers and freight to the important port of Felixstowe.

Commons ChamberI thank my hon. Friend for that comment. Again, he is a colleague who has been raising these issues on a regular basis. It is important to recognise that this is an opportunity for people to respond accordingly. He referred to the opportunity for the unions to agree a new rest-day working contract. What is disappointing is the cynical way in which they behaved. ASLEF agreed that rest-day working contract and then immediately said it would take action short of a strike and withdrew any co-operation at all. I hope that they will respond to the decision in the right way. It is an opportunity to reset those relationships and do what we are all supposed to do, which is to deliver a better railway for the passengers who use it. I hope that they take that opportunity. If they do, they will find a willing partner in me.
Rail companies across the country are failing rail customers with fare hikes, cancellations and delays. Great Western Railway, whose line I use between Bath and London, is no better. Between July and October 2022, it saw an increase of 179% in delay compensation claims compared with the previous year. The Government have promised to fix the system and create Great British Railways in law. When will they?
I am familiar with the GWR service as I use it frequently. There have been a number of problems on the western route, which, to be fair, are often caused not by GWR but by Network Rail. However, I accept that that inconveniences passengers just the same. That is partly why we are bringing track and train together under GBR. I will continue having that focus on performance. In fact, I am seeing Network Rail’s leadership team this afternoon, and one thing we will be talking about is its performance on the western route. I will raise the hon. Lady’s specific concerns with it.

Commons ChamberHS2 is a transformational project, and the Government remain fully committed to building the line from Euston to Manchester. HS2 is being delivered in stages, with cost estimates published for each phase of the programme. We remain transparent on the emerging cost position of HS2, and we publish six-monthly reports to Parliament. The recent announcement will clearly require us to work through adjustments for certain phases, and we will provide updated estimates in due course, including through those six-monthly reports.
Tens of thousands of jobs and billions of pounds in economic growth depend on building HS2. The National Audit Office has noted that the decision to delay HS2 by another two years will increase the costs of the project yet again. The Institution of Civil Engineers says that delaying HS2 could make the building process
“more difficult as construction firms shift their focus to other countries.”
Is it not time that the Government came clean with the public that HS2 is happening, and stopped the dither and delay that will only cost the taxpayer more money?

Commons ChamberThe good news for the hon. Gentleman is that we have made progress on that, and we are hoping to set out what will happen on that publicly in the very near future. He does not have too long to wait and I hope he will have news that he will welcome.
Network Rail has said that 278 miles of track must be electrified every year to reach net zero. Last year, the Government added only 1.4 miles of newly electrified track, including Bath, and we are still waiting for electrification. To meet our net zero targets, will the Secretary of State commit to electrifying all new railway lines?
The hon. Lady will know that we have electrified 1,200 miles of the rail network in Great Britain since 2010, and that work continues. We clearly think that electrifying the rail network is important for our net zero commitments, and we will continue to make progress. I hope she will welcome that.

Friend for her question and for her work when she was Home Secretary to strengthen the law to enable us to deal with those who cause disruption on our transport network. I would be delighted to meet her and the leader of Essex County Council to talk about those important road projects.
Research from the Campaign for Better Transport suggests that the Government are so far behind on their electrification plans that rolling stock leasing companies are being forced to destroy electric units that they cannot use. At the same time, the Government continue to introduce new diesel trains—more not zero than net zero. Will the Government ensure that they order no more diesel trains and get on with electrification?

Commons ChamberI speak today as the chair of the all-party parliamentary group on eating disorders and I want to highlight the anxiety felt by many of those with an eating disorder about one specific aspect of the obesity strategy: calorie labelling on menus. Obesity causes serious health problems and there is no doubt that far too many people in this country do not have a healthy weight. I add my unequivocal support to the Government’s aim of addressing obesity, but obesity has to be considered as one side of our complex relationship with food. It is a form of disordered eating and therefore cannot be separated from other forms of disordered eating and cannot be dealt with in isolation. Calorie labelling on menus will not only be ineffective in tackling obesity, but will actively damage those with an eating disorder.
Studies show that there is only a small body of low-quality evidence supporting the suggestion that calorie counts on menus lead to a reduction in calories purchased. While there is limited evidence that calorie labelling will support the public in losing weight, there is convincing evidence that it would harm people with an eating disorder. About 1.25 million people in the UK have an eating disorder, and the 2019 health survey found that 16% of all adults aged 16 or over screened positive for a possible eating disorder. Over the pandemic, the charity Beat has reported a 173% increase in demand for eating disorder support, and research shows that individuals with anorexia and bulimia are more likely to order food with significantly fewer calories when presented with a menu including calorie counts. Those with binge eating disorder are more likely to order food with significantly more calories.
Many people with eating disorders also live with obesity. Up to 30% of people seeking weight management services would meet the diagnostic criteria for binge eating disorder. Clearly, a reductionist approach to nutrition means that the obesity strategy risks harming some of the very people it is designed to support.
I am sympathetic to the point the hon. Lady is making, and she will know from my intervention that I think the evidence with respect to calories and out-of-home labelling is quite weak. Is labelling on products purchased in supermarkets also a problem for those with eating disorders? I ask that genuinely; I do not know the answer. Can she furnish that information?
I am particularly concerned about calorie labelling in restaurants. People who suffer from eating disorders are isolated and fearful of contact with others because they are thinking continuously about what they are going to eat or drink. Going out to a restaurant gets them through that step, and it is often a significant step towards recovery. As I say, my particular concern is labelling on restaurant menus.
In response to the survey on calorie labelling conducted by Beat, one respondent said:
“My eating disorder thrives off calorie counting and knowing all the calories in everything. I would feel compelled to look at calorie labels”
in restaurants and
“I would feel embarrassed asking for a different menu. Please don’t do it. Please.”
The Mental Health Minister has been extremely generous with her time, listening to the all-party parliamentary group’s concerns about the plan to mandate calorie labelling on menus. The APPG is grateful for her interest in improving early access to eating disorder treatment. However, I must repeat my plea to the Government to look again at this element of the obesity strategy.
Addressing obesity and tackling eating disorders should not be in competition. We must tackle them together. I look forward to working with the Minister to develop an obesity strategy that successfully addresses the obesity epidemic, but does not harm people with other forms of eating disorder.
