My Lords, I rise as a Member without notes. I want to make one point to the Senior Deputy Speaker about this report, which I understand and support. It is not so much about enforcement, mentioned by my noble friend, as about how it is going to be monitored. Will the Procedure and Privileges Committee conduct a review of how it seems to be working out in practice so that if any further amendments need to be made, they can be brought back to the House?
I fully support the recommendation as a member of the Procedure Committee. In my 14 years in the House, I have heard many wonderful speeches from across the House and one or two that have tested the patience of the House. We all have people on our Benches who have done that, I am afraid. I am very much of the view that if we stick to the rules and procedures, it helps the House. I note the point that colleagues have made about going further. I am sure the committee will keep those things under review because this is something that never stops. Things will change and improve. This is a good report that makes welcome changes, and I fully endorse it.

Lords ChamberMy Lords, that is one of the reasons why I support what has been said by the noble Lord, Lord Baker, and the noble and learned Lord, Lord Judge. This is not just about a particular Bill; it is about the way we do business. As I am just about to finish my first parliamentary year in this House, and, as other noble Lords have said, a situation of this kind has not arisen before, I would not like to think that this would set a precedent in any way for the way in which the House considers its business in future. When it comes to what I might call negotiating leverage, one day is a derisory offer to the House; with no disrespect to the Minister, that is not good enough. There is great merit in not agreeing to allow a date for Third Reading to be set at this stage.
My Lords, it is quite clear that the Bill has been badly received across the whole House. Whole chunks of it have been taken out and it is in a very poor state, and it is clear that it should not have come here at all because it had not been put together properly. I am sure the Minister has heard that; it is not the first time that these views have been expressed. We will have a new Government in September, and then it will be up to the Prime Minister. This Bill may disappear completely—we do not know.
I have been part of the usual channels now for 13 months, and I hope still to be here in September—in one or other part of the usual channels. I will spend my summer working with colleagues in other parts of the House to ensure that the points raised by colleagues are fully understood by the Government, so that we can work together, bring things back and have a system that everyone is happy with. The Minister has heard how dissatisfied the House is. I am sorry, but I think that is important.
One thing I have learned as Opposition Chief Whip is that the forthcoming business can change from day to day, never mind what is going to happen in September. Particularly in March and April, the forthcoming business was changing literally every day. The fact that it is listed for September does not necessarily mean that it will happen then. We do not know. We will have those discussions then.
As the noble and learned Lord, Lord Judge, has mentioned, we have the other protection of his Motion. I am sure that if Third Reading is tabled and he is unhappy with it, his Motion will be tabled for the House to consider. There are many barriers in place to make sure that the House can make its views known if it is unhappy. I am sure the Minister has heard how unhappy the House is.
Before the noble Lord responds, can I just say that in respect of the Lord Speaker’s duties and the issues regarding school-age children and other matters, nothing is unexpected in this new draft of the Companion? I offer my full support to the Senior Deputy Speaker, and I hope the House can now quickly agree this report. We have important business to discuss today.
My Lords, I welcome the Senior Deputy Speaker’s Motion to approve the report and the idea that the online version should, at any moment, be the most up-to-date version. Can I ask one quick question about paragraph 8? If a Member withdraws her or his Question before the day it is due to be asked, does that Member lose their right to ask the set number of Questions in each year? Is that withdrawn Question counted as one of the number you are allowed to ask in any given year?

Lords ChamberMy Lords, I agree with the noble Lord, Lord Norton, that it does not have to be agreed by Parliament, but the Cabinet Manual is a really interesting document. I remember when it came out; other noble Lords might remember it as well. I believe it was triggered and inspired by the then Government and the then Cabinet Secretary, who is a Member of this House. It is a pity that he is not here because he could play a big part in the short debate that we are having on this question.
For those who have never seen it, it was a fascinating document because it encapsulated the conventions that had existed for many years but had never been codified in any way. It was very useful. I feel very sorry, incidentally, that, for a debate such as this, the noble Lord, Lord Hennessy of Nympsfield, is not here to take part. Our debates would be hugely enriched by having him here; of course, he coined one of the phrases of recent times, the “good chaps theory of government”. Many of the things that we have been discussing have illustrated ways in which people feel that we are departing from that theory and we are discovering that our constitution is capable of being abused. I do not want to go back over history, but we would not have had the discussion that we had about Clause 3 and references to the Miller case without that being an obvious example, and there are others.
Of course, this will not be pressed to a Division tonight, but a great deal more attention should be paid to the Cabinet Manual. I am rather unclear as to how it could be revised and who would be involved in doing it. A noble Lord said earlier that we were talking about where power lies in our constitution. When I visited a school recently, I recommended that the students read the Cabinet Manual, or at least have it to hand, because if they wanted to understand our constitution, that was an essential part of it. The sixth-formers looked at me rather blankly and I do not blame them in the slightest. That does not mean to say that I was wrong, because it still is very important. I am not sure how it could be updated, but it would be a very good thing. It is rather like when Gandhi was asked what he thought of civilisation in Britain and he replied, “Well, I think it would be a very good thing.”
Nevertheless, I support the spirit of the amendment and I would be interested to know whether we are going to come back to this on Report. If so, I hope to play a modest part in the debate at that stage.
I just want to say how much I enjoyed my noble friend’s speech. I very much agree with his points and those of the noble Lord, Lord Norton of Louth. The Cabinet Manual is an important document. It is a government document, not a parliamentary one, but we need to ensure that it is used properly and respected. That is a very important point to make.
