Commons ChamberThe commitments I gave and references I made in my statement in relation to workers’ rights are of course looking to what we would do in the situation where we have left the European Union. We want to continue to enhance workers’ rights. As a Government we are already enhancing workers’ rights—for example, through the work we have done with the Taylor review and the response to the Taylor report. The Government have a commitment to enhance workers’ rights. The commitment that I have given is for those who are concerned that the European Union might in future take steps forward in relation to workers’ rights and, if we were not a member of the European Union, we would not automatically be responding to that. What I have said is that when standards change in the European Union, we would ensure that Parliament would have a vote on whether this United Kingdom would follow that or not.
This House has already voted against no deal and it has already voted against the Prime Minister’s agreement. The process outlined today is indicative of the Prime Minister’s shocking inability to take the very difficult decision that has to be taken, which is simply that the best way to serve the national interest is to accept that in the end the only way to get her deal over the line is to offer in return a confirmative public vote. That is the only way in which this House will accept her deal. The offer is on the table—will she accept it?
I responded to the issue of a confirmatory vote, second referendum or people’s vote earlier in response to a number of other questions. I respect the way in which the hon. Lady has been a campaigner for this issue and has been consistent in that, but the best way to ensure that we get a deal through this House is to do what we are doing, which is working with the European Union to find the changes that this House indicated were such that with them it would be willing to support a deal.

Commons ChamberWe are indeed. We have ramped up our preparations. We are continuing our preparations for no deal. We are engaging not just with Government Departments but with the devolved Administrations and with the Northern Ireland civil service. We are engaging with local authorities up and down the country, and obviously working with businesses and those who would need to make alterations to their operations in the event of no deal. We continue to ramp up those preparations.
We hear a lot about the reasons, or the assumed reasons, why people voted to leave the EU, but one thing I am sure about: the people of this country are demanding effective leadership on this issue and they feel absolutely that they are not getting it from anywhere—anywhere—on the political landscape. If the Prime Minister’s attempts to keep her party together by getting the ERG on board fail, will she accept, at that point, the need to build a consensus properly across the House, and that the easiest way, potentially, of reaching that consensus will be to get her deal over the line, as it stands now, by accepting the case for putting it to the people for ratification?
The hon. Lady and I have a different view in relation to a second referendum, as I have expressed earlier. I think it is important that we deliver on the referendum that took place in 2016, but it is also important that as we do that, we do it in a way that obviously needs to command support from this House. I want to see support from across this House. I think that a strong show of support for a deal across the whole House will be important as we move forward into dealing with the legislation, and for other reasons too. I naturally want my colleagues and our confidence and supply partners to support the deal, but, as I say, I look to having a deal that I can bring back that will command strong support across the House.

Commons ChamberMy hon. Friend raises an important point. We should consider those businesses, those employers and the constituents who are employed by them. Indeed I will move quickly. It is clear now from the EU, and once the withdrawal agreement has had the agreement of this House, we can sit down and start the work of putting the future relationship in place such that it is there at the end of the implementation period and there is a smooth and orderly exit for businesses and their employees in this country.
In May 2012, the Government asked the people of Sheffield to vote in a referendum on whether they wanted a city Mayor. Sheffield rejected that proposal by 65%, but the Government went on to impose a mayoral model three years later. Why is it right for the Government to ignore the wishes of the people in one referendum but to say that they will abide by the wishes of the people in another?

Commons ChamberI understand the concern that my hon. Friend expresses about business. Business wants certainty. Business wants the deal. Business welcomed the deal when we negotiated it and I think that it still takes that approach. My hon. Friend referred to what have been called indicative votes—a number of motions that could be brought before the House. I have no plans for indicative votes. I say to him and other Members that it is necessary for the House to reflect on what Members want in terms of their responsibility to come to a decision on this matter. At the moment, there are a number of views in the House: some want to stay in the EU, some want to go for a second referendum, some would support no deal and some would support looking at other arrangements. As I said, any of those arrangements would require a withdrawal agreement, because they would require us to make clear the basis on which we are withdrawing from the European Union.
Last week, the Prime Minister admonished Jean-Claude Juncker for his use of the word “nebulous”. Many Members would take issue with her use of the word “meaningful” because there is nothing meaningful about a vote that forces Members to choose between her deal and no deal. When will the Prime Minister stop digging, start listening and build a consensus with Members across the House to get us out of this mess?
It was always going to be the case, whenever the vote came before the House, that Members would have a decision on whether to support the deal that had been negotiated with the European Union, with the consequences that failure to support it would bring. That is the same whenever that vote is taken.

Surely the Prime Minister realises that this House must be given a reasonable period in which to reflect on the vote and take its decision. The new year is too late— 7 January is just 14 days before the all-important deadline. Surely the vote must come before this House before the end of next week.
As I said earlier, we will obviously be working hard in relation to the negotiations. I am sure hon. Members of this House, as a number have indicated, would want to make sure that we are putting our case in the most forceful way.

Commons ChamberNo, this is a commitment on both sides to the future relationship that we will now be negotiating into legal text. As my right hon. Friend will I am sure recognise, there is a linkage between the withdrawal agreement and this political declaration that makes clear the importance of both sides putting their best endeavours into ensuring that this future relationship is negotiated in legal text and available by the end of December 2020.
The political declaration contains some interesting additions from last week’s draft, including paragraph 54, which states:
“The Parties also agree to consider addressing social security coordination in the light of future movement of persons.”
That sounds as though EU nationals working in the UK under the terms of the agreement could continue claiming benefits from our benefits system. Can the Prime Minister clarify?
This is in relation to some very specific issues, which I am happy to write to the hon. Lady about.

Commons ChamberWe are, of course, as is my hon. Friend, deeply disappointed and concerned at today’s verdict, and I realise how difficult and distressing this is both for Matthew Hedges and for his family. We are raising the matter with the Emirates authorities at the highest level. My right hon. Friend the Foreign Secretary is urgently seeking a call with the Foreign Minister, Abdullah bin Zayed. During his visit to the UAE on 12 November, he raised the issue with both Crown Prince Mohammed bin Zayed and the Foreign Minister. I can assure my hon. Friend and other Members that the Foreign Office will remain in close contact with Matthew, his family and his lawyer. We will continue to do all we can to support them as they consider the next steps, and we will continue to press this matter at the highest level with the Emirates.
I first send my deepest condolences to Claire Throssell, the hon. Lady’s constituent, and pay tribute to the fantastic work that she does as an ambassador for Women’s Aid. We are committed to transforming the response to domestic violence. The consultation that took place in the spring received more than 3,200 responses, which shows the degree of concern that people have over this issue of domestic violence and the recognition of the need to look carefully at the legislation on this. I understand that the Home Office will be publishing a response to the consultation together with the draft Domestic Abuse Bill later this Session.

Commons ChamberYes. The backstop for Northern Ireland will be part of the protocol that is attached to the withdrawal agreement, and the withdrawal agreement would have the status of a treaty.
Earlier this year, this House voted to stay in the European Medicines Agency, with all that means for the rest of the relationship with the EU. Can I take it, from the Prime Minister’s statement that 95% of the deal is agreed, that we are indeed staying in the EMA?
The 95% relates to the withdrawal agreement. We have agreed much of the structure and scope of the future partnership. Staying in the European Medicines Agency is one of the proposals we put forward as part of the plan that came out after the Chequers meeting, our proposals for the future. That is part of the future partnership, not the withdrawal agreement.

Commons ChamberIf we look at the two areas of goods and services, what is very clear is that those who will be trading with the European Union will continue to operate according to that rulebook in the European Union. Where we need to ensure we have that flexibility—particularly to protect one of the key areas for London, which is the City of London as a global financial centre providing a significant proportion of the debt and equity that underpins business across the European Union, with the risks that that entails here in the United Kingdom—it is right that we have regulatory co-operation with others, but that we are able to have rather more flexibility on services. That will be good for London.
The Prime Minister has today presented her position on the negotiating position decided at Chequers as an evolution of her Mansion House statement. Most Members believe there will have to be a further evolution of that position before the House will agree a deal. On that basis, does the Prime Minister agree that it is crucial to keep business in all parts of the economy—services and manufacturing—at the heart of the negotiating process?

Commons ChamberIt is obvious that the Prime Minister sees a US trade deal as something of a priority, so will she guarantee that there will be no sacrifice of either the interests of UK farmers or our animal welfare and environmental standards in order to secure such a deal?
The United States has expressed interest in a trade deal with us—so have a number of other countries around the world, such as Australia and others—but as I have said, and as the Environment Secretary and others have said, we remain committed to high animal welfare and environmental standards.

Commons ChamberI am sure that my hon. Friend is aware that the competition will be open and fair. I cannot comment on individual bids, but I am sure that he will make his voice heard. It is right that from autumn 2019 we will issue new blue and gold passports, which have always been the UK’s colours of choice for our passports. It is absolutely right that after we leave the European Union, we return to deciding the colour of passports that we want, not that the European Union wants.
Our thoughts are with Claire following the terrible tragedy that she has been through. We recognise that we need to provide support for the victims of domestic violence. As the hon. Lady suggested in her question, there are many aspects to this issue. Before my right hon. Friend the Home Secretary brings forward legislation, she will be issuing a consultation, because we want to ensure that we listen to all those who have been affected so that we deal with all aspects of this particular issue. The Government are committed to working not only to support the victims of domestic violence, but to ensure that we end violence against women and girls.

Commons ChamberI think everybody is now looking very clearly at the timetable that has already been set. Donald Tusk, the President of the European Council, has expressed the view that we need to accelerate the progress because we need to get the agreement in place and the arrangements negotiated very speedily. We will be leaving on 29 March 2019.
Will the Prime Minister give a simple answer to a simple question? Will the working time directive be transposed and embedded into British law—yes or no?
The European Union (Withdrawal) Bill brings the workers’ rights that are currently in EU law into UK law, which is why that sort of thing is a bit rich coming from Labour MPs who voted against bringing them into UK law.

Commons ChamberI am very happy to give my hon. Friend that reassurance. As I said when I was at the European Council, the free flow of data is important for us in relation to operations, in particular building a digital single market. Another point that I and others made is that we should look at the digital market as not just being about the European Union. Actually, this is a global issue. We need to ensure that the work is done on a global basis.
The Prime Minister talks a great deal about an implementation deal. We all know that we will be withdrawing in March 2019. There is no disagreement on the divorce deal. The free trade deal, however, may take some time to negotiate. Does the Prime Minister accept—this is what business needs to hear—that a transition deal may help to deal with the finer detail and the final conclusion of the trade negotiation, and therefore will not be so much of an implementation but a proper transition?
Both sides recognise that the timetable was set out in the Lisbon treaty, which does indeed refer to the future relationship. The withdrawal agreement can only be considered and agreed taking account of the future relationship. It is important that we negotiate that future relationship, so we have both the withdrawal agreement and the future partnership, and the implementation period then is a practical implementation period.
The hon. Lady looks as if she does not believe that that is possible. The point is that we start these negotiations on a completely different basis from any other third country. We start on the basis that we are already trading with the other member states of the European Union on the basis of rules and regulations, and when we leave we will have taken those EU regulations, EU law and the EU acquis, into UK law.

Commons ChamberMy hon. Friend has raised a very important issue, and I know that it is one that he particularly cares about. Of course, it is through the national living wage that we are making sure that pay is fair in all sectors, including in social care. On the specific point he has raised, the Department of Health and other relevant Departments are looking at this issue very carefully, because they want to ensure that enforcement protects low-paid workers in a fair and proportionate manner. We have invested more money in social care—as he will know, there was £2 billion extra in the Budget. We do need to look at this issue on a longer-term basis, but I can assure him that Departments are looking carefully at the specific issues that he has raised.
Q14. Does the Prime Minister think, like her Brexit Secretary, that it will be simple to deliver a free trade deal with the European Union?
The Brexit Secretary and I have both said over the past few months that a comprehensive trade agreement will be not just possible but easier than for other third countries negotiating trade deals, precisely because at the moment we are operating on the same basis as other countries in the European Union. Therefore, we are not negotiating from the same position as Canada and other countries from outside the European Union. So yes, I think we can achieve that comprehensive free trade agreement, and it will be good for the United Kingdom and good for the European Union.

Commons ChamberWhat I say to those manufacturers is that I hope they will work with the Government to ensure that we understand the needs of every part of industry in this country as we go forward into the negotiation on the comprehensive free trade agreement. We want to see a tariff-free ability to trade with the European Union, and we will be considering the views and interests of British industry as we do that.
The Prime Minister has twice this afternoon responded to questions about the skills challenges that will be created as a result of the reform of freedom of movement by referring to the reform of technical education, but of course the economy will have much greater needs, such as new dentists, doctors, vets and other professionals. On that basis, will she guarantee the funding necessary to ensure that our schools, colleges and universities will be able to meet the skills challenges of a post-Brexit world?
I have been very clear that we do need to meet those skills challenges; that is why we are bringing in the reforms. The hon. Lady refers to issues within the national health service, but one of the important steps that the Government have taken is to remove the caps on the number of people who can train as staff in the national health service.
