I totally agree with what David Nabarro had to say—I think he is completely right. I think that the best way to control this virus is common-sensical restrictions on person-to-person contact, because it is that person-to-person contact that spreads the virus. That is what we all need to do.

Northern Ireland is suffering from some of the worst covid figures in the UK. Can the Prime Minister follow through on his commitment to give the Northern Ireland Executive the financial firepower to follow the science, do what is necessary to address a deteriorating situation and give businesses the support they need?

Yes, absolutely. The Government are absolutely committed to securing a Canada-style free trade agreement. One of the difficulties we have had in the talks is that, as our negotiator David Frost pointed out, the European Union still has not come to grips with the fact that we will be a sovereign equal, not in the size of our economy but in our democratic mandate. There are, therefore, still one or two sticking points, because it is seeking to tie us to its rules rather than recognising that we will follow our own path. However, I am confident we can overcome those difficulties and secure a free trade agreement, which would be in everyone’s interests. Of course, many preparations that businesses are required to undertake are the same whether or not we have an FTA.

Businesses in Northern Ireland and elsewhere urgently need to see the detail of the border model between Great Britain and Northern Ireland. Previously, the Chancellor of the Duchy of Lancaster promised that that would be published by the end of July. It is desirable that we see the outcome of Joint Committee and future relationship negotiations, but they are not essential for that. Will he therefore give a revised commitment on when we will see that?

Yes. The hon. Gentleman makes a very good point. The Joint Committee should, God willing, meet next Monday in Brussels. I will be seeing Maroš Šefčovič then, as we seek to make progress on those matters. The hon. Gentleman will know that we made more than £200 million available through the trader support service and support for IT to help businesses in Northern Ireland. Even though it has been a subject of contention in this House, the provisions in the United Kingdom Internal Market Bill are there to make sure that Northern Ireland’s businesses do have a guarantee that, whatever happens, they will not be required to have export declarations when goods move from Northern Ireland to Great Britain, because the principle of unfettered access is so important.

The Prime Minister will have support for taking the necessary measures to contain and suppress the virus, but he is receiving a very strong message from both sides of the House today that he does need to revisit the economic support measures, particularly in the light of changed circumstances and bearing in mind the need to look at other creative and innovative solutions. Will he therefore accept that, when the Chancellor made his statement back at the beginning of July, a certain set of planning assumptions were made that now no longer apply with the virus, so it is incumbent on the Government to change course and to change what they are doing to support people as well?

I acknowledge the point that the hon. Gentleman has made, and it is certainly our intention, as we go forward, to do everything we can to protect lives and livelihoods and to put our arms around everyone in this country. No one can deny that the Chancellor has been exceptionally creative and ambitious in the plans that he has set out, and he will continue to apply the maximum possible imagination and creativity in that respect.

I do not accept that it does any of those things. I think we are legislating in a perfectly legal and sensible manner.

I shall go back to the remarks I wish to make as to why it is better that we pay for our own projects rather than doing so with the big discounts on our money through the European Union. The second reason for that is that some of the European schemes required the project to be a marginal one. Part of the terms of giving the money was that it was not a project we would finance for ourselves or not a core, essential project. That did not make a lot of sense. Once that is under United Kingdom control, we will obviously jointly wish to finance the best projects, and of course that will be in full consultation with the devolved Governments around the country.

The third reason that I think we will do better without European Union intrusion is the flagging of these projects. There has been deep resentment in the United Kingdom that whenever a small amount of money came from Europe into a project, it had to show the EU flag but we were not allowed to put a British flag on it to say that all the so-called EU money had actually come from United Kingdom taxpayers. Even worse, we were not even allowed to put a British flag on it to show that a larger proportion of the funding for the scheme had often come directly from the United Kingdom Government. It will be much better when we do not have to false-flag projects in the interest of misleading people about who is actually paying for something.

In this debate on the Bill generally, I know that the Opposition are still very exercised in thinking that these and other powers are illegal because they in some way violate the rules of international law set out in the EU withdrawal agreement. State aid is part of that argument, and these are the two central clauses on state aid. I would like to say that I disagree strongly with my right hon. Friend the Northern Ireland Secretary. I do not think there is any way in which this legislation violates international law. It clearly asserts and upholds United Kingdom law, most notably the sovereignty clause in the European Union (Withdrawal) Act 2018. That Act was a compromise agreement and a halfway house. It was attached to a political agreement to complete a proper negotiation in due course over our future relationship, so it was always rather problematic; because it was like that, it was ambiguous and contradictory. There are perfectly strong clauses in the EU withdrawal agreement and the EU (Withdrawal) Act stating that it is a duty that the single market and customs union of the whole United Kingdom, which expressly includes Northern Ireland, is upheld. That is exactly what this Bill is seeking to do.

The Government and many others hope that there will be a last-minute agreement, because it is quite easy to deal with all the outstanding legal issues in a comprehensive agreement. I am a bit sceptical that that is going to happen, because I see no evidence of good faith in negotiations by the European Union, and I think that, were there to be a breakdown, there would be a second legal argument that there had not been good faith. That is another reason why there is no sense in which we are seeking to break an international agreement, let alone the law.

I am very pleased that the Government are taking crystal clear powers to provide state aid and investment in projects. I hope the Government will also, ere long, issue a very strong statement of the United Kingdom’s state aid policy that should cover this and other matters. We owe it to the international community to have a strong, clear and independent state aid policy that is perfectly compliant with the World Trade Organisation rules on this matter, because we wish to be a global trader with more free trade agreements outside the European Union space. In that respect, we can probably do better than the European Union, because there have been a number of important cases where the European Union has been found to be in violation of state aid rules by the World Trade Organisation, and perhaps an independent Britain can do a bit better.

Is the right hon. Gentleman aware of the comments emerging from Speaker Pelosi and others in the United States stressing that if there is any breach of the protocol in the withdrawal agreement—a threat to the Good Friday agreement—there will be no prospect of a trade deal with the United States? Is that not the fundamental flaw in the analysis of those pursuing a hard Brexit?

We now have a different range of voices from Northern Ireland in this Parliament and I want to make a few things clear at the outset. The majority of people in Northern Ireland voted to remain. They also supported the wrongly maligned backstop and they now pragmatically recognise the need for the protocol, despite its challenges. To be very clear, the majority of people and businesses in Northern Ireland do not want the Government to break international law on their behalf.

Northern Ireland only works on the basis of sharing and interdependence. The problem with any form of hard Brexit is that it requires some form of interface between the UK and the single market and customs union. The protocol is the inevitable consequence of a hard Brexit, in order to address the particular circumstances of Northern Ireland and to protect the Good Friday agreement. We are working off decisions taken here in the UK, not something that the European Union has foisted upon us.

Indeed, I am deeply concerned that the Prime Minister and the Government are twisting and distorting the meaning of the Good Friday agreement for their own political ends. The principle of consent is certainly one major component of the Good Friday agreement, and it is entrenched in the withdrawal agreement, so the Union is not up for grabs in this situation. That is a matter for the people of Northern Ireland to determine in due course. The Good Friday agreement is, in fact, a broad range of relationships across our islands.

The protocol is, in effect, the bare minimum to avoid a hard border on the island of Ireland. If we default on that, we risk a return of some form of border in that context. The European Union is entitled to protect the integrity of the single market and customs union, and that will create a fresh form of tension.

It is pragmatically easier to manage an interface down the Irish sea than across the land border. We are talking about seven air and sea crossings versus 270 land crossings, and the number of daily movements on the island far outweighs the number across the Irish sea. However, we must do all we can to reduce that interface to a minimum—to make it a dotted line. The way to achieve that is through building trust and good faith with the European Union and by working through the mechanisms of the withdrawal agreement—the Joint Committee and, if necessary, the arbitration mechanism—rather than circumventing it. We need to define what flexibilities and modalities we can.

Through their action, the Government are risking having no future relationship with the European Union. That brings huge consequences for the UK economy and makes the impact of the Northern Ireland protocol down the Irish sea even more stark. I support a trade deal with the United States, which is the dream of many Brexiteers who are forgoing the relationship with the European Union. I am not sure that they are picking up that that is a complete dead end if the Good Friday agreement is compromised by this Parliament.

Today’s statement sets out the brutal reality of Brexit for the GB to European Union interface but does not address Northern Ireland. We do not have the luxury of a phased roll-out—things have to be in place for 1 January—so can the right hon. Gentleman give us a firm commitment that there will be at least the same level of detail as that published today before the end of this month for the Northern Ireland protocol, given that we have at least five different regulatory checks that have to be put in place?

I am grateful to the hon. Gentleman for drawing an appropriate distinction between the border operating model between GB and the EU and the Northern Ireland protocol, and it is the case that more detail will be published later this month. Indeed, the Specialised Committee is meeting later this week in order to refine that.

Exactly six months from today, the Northern Ireland protocol will sadly come into operation. The Government have already recognised that it will involve checks and infrastructure with regard to regulation, which the Prime Minister knows is different from customs. The business community is desperately seeking answers as to how the processes will work in detail. Will he commit to providing that clarity before the end of the summer?

It is very clear from the existing text of the protocol that Northern Ireland is, and remains, a part of the customs territory of the United Kingdom. There should be unfettered access between all parts of the United Kingdom, and that is what we are going to ensure.

My hon. Friend is absolutely right. In the speech to which some hon. Members referred earlier, I made the point that we needed to disperse decision making in the civil service, and one of the locations I suggested we should think about locating more key decision makers was east Lancashire.

From addressing nuclear proliferation to countering terrorism, there is a need to build and sustain relationships with European allies and, indeed, to secure a future relationship deal on policing and security co-operation. So how do the Government plan to reconcile David Frost’s role as National Security Adviser with his role as Brexit negotiator, in which he is currently engaging in brinkmanship, and indeed the risk of no deal at the end of the year?

Businesses in Leicestershire and elsewhere will have the opportunity to secure access to an additional £50 million of Government support in order to ensure that they can export effectively not just into the EU but beyond. It is also the case that intense engagement with businesses is being conducted by Her Majesty’s Revenue and Customs, the Department for Business, Energy and Industrial Strategy and others.

The Northern Ireland protocol is there to protect the Good Friday Agreement in all its parts, but it is right that we do all we can to minimise the impact down the Irish sea. Does the Minister recognise that in the event that we fail to secure a deal with the European Union and the Government opt to trade on their own terms, the impact of that border down the Irish sea will be more severe, with businesses and households facing more costs?

It is the case of course that we wish to secure a deal, and a deal would be in everyone’s interests, but the purpose of the Northern Ireland protocol, as the hon. Gentleman rightly reminds us, is to uphold the Belfast/Good Friday agreement in all its elements. Critical to that is that we all recognise that under the protocol, Northern Ireland remains not only part of the UK politically, but also part of the UK customs territory. Unfettered access is a right that all parties agree should be maintained.

The armed forces covenant is an important piece of work that has brought us on a long way, but it is clear to me that we need to strengthen it. In the Queen’s Speech, this Government committed to enshrining the armed forces covenant in law so that no individual, or their family, can be disadvantaged because of their service. We are going to bring that in during this Parliament, and it will strengthen the armed forces covenant further. I sincerely hope that there is not a single local authority in this country that has not signed up to it.

I concur with the Minister’s original statement and look forward to the roll-out of the military covenant in Northern Ireland, but I do take issue with his answer to the former Chair of the Defence Committee. In doing so, I challenge the narrative of vexatious claims being made against veterans, particularly in relation to Northern Ireland. It undermines the criminal justice system in Northern Ireland, which has the ability to weed out such claims; I do not even believe that examples have been cited. Can I urge the Minister to reflect on what may well be an unintended consequence of the road he is going down? Tens of thousands of people served with great honour and distinction in Northern Ireland, upholding the rule of law. If we end up putting in place some sort of measure to give unnecessary protection and warp the rule of law, that may end up de-legitimising and undermining the integrity of their service, which they are rightly very proud of.

I reassure the hon. Gentleman that I tread with the utmost care when it comes to dealing with the very bloody, very difficult and very emotional scenarios surrounding historical prosecutions. There is absolutely no Minister or individual in my position, from the Prime Minister downwards, who would ever accept that those who serve in uniform commit crimes and we do not hold them to account. Under my watch, that will never happen. But we are going to ensure that the balance and fairness in this process are restored so that those who have served their country and done nothing wrong can retire from their military service in peace. It is a challenge, but this Government are not going to run from that. We are going to meet that challenge. The hon. Gentleman will know of the many, many servicemen and women and veterans, and their families, who have been dragged through a totally unacceptable process for many years. This process is about fairness and about justice, not only for them but for people in Afghanistan, Iraq and Northern Ireland. I urge him to work with us in the weeks ahead as we tread carefully down this path.
