My Lords, I too voted by post before the vow was made. However, it is also fair to say that the vow raised an expectation, and if a vow which was made was not honoured then that would be a serious destabilisation of the United Kingdom. With regard to the second point on devolution from the Scottish Parliament, in fairness that appears not in the report itself but in the foreword by the noble Lord, Lord Smith. I seem to recall that when he delivered his report he indicated that those were personal reflections, and those reflections have chimed well with many people. That is why it is incumbent on us within our respective parties to try to make sure that the drive for greater decentralisation and devolution within Scotland is carried forward.

My Lords, the speed with which the Secretary of State for Scotland and others have managed to put together this package is quite remarkable. It is certainly very welcome that the first signs are that the Scottish Government will co-operate in implementing these proposals. In the previous 10 days I have come across a number of people who voted yes in the referendum, who feel now that they had a narrow escape from what could have been a disaster. We could be sitting here discussing an independent Scotland based on oil revenues which are nothing like those anticipated at the time of the referendum. Therefore, is the noble and learned Lord surprised to learn that a lot of people are now realising that we had a very narrow escape? Finally, is there any sign yet that we will get an all-party agreement on a constitutional commission or convention after the election?

My Lords, my noble friend is right to say that we had a very narrow escape. I dread to think what kind of discussions we would be having now if the vote had gone the wrong way on 18 September. There have been indications of support across parties with regard to a constitutional convention, although I do not think that there is any concrete proposal in place, or any plans at the moment to set one up prior to the election. I endorse my noble friend’s comments about the speed involved. I pay particular tribute to officials in many departments of government, not least in the Scotland Office and in my own office. They were given 37 working days. When the pledge was made with the deadline of Burns Night no one had worked out that it was a Sunday, so that de facto reduced the number of days that were available. They did a tremendous amount of work, and I am very conscious too that there is more work to be done.

My Lords, it is a particular pleasure to follow two former Secretaries of State for Scotland in this debate, given the important speeches that they made.

I begin by echoing something that was said by the Moderator in the sermon during the reconciliation service at St Giles’ Cathedral. He pointed out that despite the flaws, which the noble Baroness was quite right to mention, the fact is that the turnout produced an enthusiasm for political discussion and debate in Scotland that we have not seen before. It was 84%; we have not seen a turnout like that since my by-election in 1965. That gives me the chance to say how proud I was that the Scottish Borders was the area that produced the strongest positive no vote in the referendum—apart, of course, from the Orkney Islands, before my noble and learned friend intervenes. However, I discount Orkney because I think that if there had been a yes vote, they would have followed that by voting to go back to Denmark. On the mainland of Scotland, the borders had the highest turnout.

The immediate consequence of the referendum is the appointment of the Smith commission. I am perhaps a little more optimistic about it than many others are. I know that it has been given a tight timetable but my former constituent, the noble Lord, Lord Smith, is an extremely able and patient man. More importantly, I notice that each of the four political parties has appointed to that commission people of good common sense. I include in that the SNP because while it could have produced some wild cards, both John Swinney and Linda Fabiani, who I know from my time in the Scottish Parliament, are sensible people who will work with the others in that commission to try to produce a consensus agreement. It is perfectly obvious that no political party will emerge from that commission with everything that it wants. That cannot be done but if there is good will in that commission, which has certainly got off to a good start, there is no reason why it cannot come up, in a very few weeks’ time, with a package of further measures amounting to the maximum of home rule consistent with common sense.

Going beyond that, we have to look at what happened on the morning after the referendum. The Prime Minister made a great mistake by coming out into Downing Street at seven o’clock in the morning. Nobody, not even the Prime Minister, should be out at seven in the morning making pronouncements on anything, in my view. I am glad that my noble friend Lord Ashdown is not his place because I used to stop him phoning me at 6 am. In fact, I gave a general instruction that nobody was to phone me before 10 am, which is a much more sensible approach. However, it was a disastrous statement that the Prime Minister made at 7 am. Trying to link the immediate issue of further powers to Scotland with the English question was a serious error.

However, we have the report of the McKay commission, which was published some years ago and has been around a long time. It proposed simply that there should be an English, or an English and Welsh, Grand Committee. I see nothing wrong with that. My noble friend Lord Tyler was right to say that it might just be a talking shop but I was a member of the Scottish Grand Committee in my early days, which was a talking shop but quite a good one. We had debates on our own issues and dealt with the early stages of legislation, although at the end of the day the whole House of Commons had a vote. There is no reason why an English Grand Committee could not be composed on the same basis.

Admittedly, in the early days of the Scottish Grand Committee we had conscripted English members to make up the party balance. That was madness; they were usually appointed by the Whips on the basis of their being guilty of misconduct. They would say, “Two days on the Scottish Grand Committee for you if you don’t turn up for the three-line whip tonight”. Eventually, they were abolished. My noble friend Lord Hamilton, who is not in his place, claims not to remember an episode which brought the conscripted members to an end but I remember it. We were having a debate on tourism in Scotland and, to our horror, Mr Archie Hamilton MP got to his feet. This was unheard of, as the conscripted members were not supposed to speak. He began his speech by saying, “I recognise that by intervening in this debate, I run the risk of not being appointed to this committee again”. That was what led to the end of the conscripted members. In its latter years the Scottish Grand Committee, as my noble friend Lord Forsyth will well remember, operated without a government majority. That did not do it any harm. It was a perfectly workable instrument, as I believe an English Grand Committee could be, too, without upsetting the basic nature of our constitution.

In the end, we will have to take a long-term look at our systems of government. I am one of those who strongly support either a constitutional convention or, as the noble Baroness suggested, a royal commission. I do not know which would be the better instrument but it would need to take time. If you count the pre-period of the Campaign for a Scottish Assembly, then the Scottish Constitutional Convention, of which I had the honour to be the joint chairman, took nearly 10 years to come up with the devolution proposals. We cannot even pretend that we got those 100% right. It is not a quick-fix issue. I believe that we have to move in a more federal direction. That is where a replacement for this House—a senate elected by the component parts of the United Kingdom—makes good sense. It needs all parties, including my own, to rethink their policies on this so that we come up with a proposal for a proper United Kingdom Parliament, where the upper House really represents the component parts of the United Kingdom.

Out of the Scottish referendum can come good, and I am more optimistic than perhaps some others in this debate. I wish it well.

My Lords, the noble Lord, Lord McConnell, is right to emphasise how much detailed work went into the constitutional convention proposals, in which he, I and the noble Lord, Lord Robertson, were involved, and the work in terms of the taxation proposals now embodied in the Scotland Act. It is now two and a half years since that Act was passed. That shows the time that it has taken to get them implemented and to get it right. I agree that we should be under no illusion about that. I do not think for a moment that the noble Lord, Lord Smith of Kelvin, is under any illusion as to the challenge he is facing.

On the final point made by the noble Lord, Lord McConnell, about getting on with the powers and using them, he and I did a couple of events during the referendum campaign where we said some of the things that the Scottish Parliament had done. I very much hope that a right and proper debate about the extent of powers will not be used as an excuse for not using the powers that are already there. They should be used to tackle many things in Scotland, including education, health, transport and policing, which are crying out to be addressed.

I wonder whether my noble and learned friend saw the lead story in the Scotsman on Saturday, which began with the sentence:

“The battle lines have been drawn in the fight to shape post-referendum Scotland, as the SNP government yesterday unveiled demands”.

Does he agree that my former constituent, the noble Lord, Lord Smith, will have a difficult time in the few weeks that he has to produce the report? If this commission is approached on battle lines grounds, there is an obligation on those who lost the campaign to recognise that they did lose. There is also an obligation on those who won to recognise that 45% of the population voted the other way. We must hope that what will come out of the Smith commission is the maximum amount of home rule consistent with common sense and that the parties will approach the commission in a constructive and consensus-seeking spirit and not in a battle line way.

I agree with my noble friend that a battle line approach will not be productive. I accept that the time is tight for the noble Lord, Lord Smith of Kelvin. I rather fear, however, that if we were to suggest any slippage the cries of betrayal would be even louder so I think it is important that we do stick to that. However, it is important too that people entering into these talks do so with a view to trying to achieve a lasting outcome. Simply to make a concession, for example, on monetary union, that was going to be made anyway in the context of independence, I do not consider a concession.

My Lords, it is a great pleasure to follow a Welsh voice in this debate about the future of the United Kingdom, which is what the debate is about; it is not just about Scotland. I entirely agree with the concluding words of the noble Lord, Lord Richard, and I shall come back to them in a moment.

One thing that I have found dispiriting about the public debate in Scotland so far is that it has concentrated too much on whether it will be cheaper or more expensive to get out of the union. I think that the noble Lord, Lord Wilson of Tillyorn, is quite right that it is missing the point to argue about £1,000 here or £1,400 there. We all know that divorce is an expensive business, but if it is the right thing to do we must bear the cost. My belief is that it is the wrong thing to do and, therefore, the cost is irrelevant. What we ought to be arguing about—and I welcomed the speech of my noble and learned friend, because he concentrated on this—is the benefits of the union and the concept of a reformed union after a no vote in September. I think that that is the right way to go.

There have been a lot of debates about how long it would take for Scotland to become independent, if there were a yes vote. I do not believe for a second that the nationalist Government are right to say that it can be done in six months; that is preposterous, for the reasons that the noble Lord, Lord Richard, has just spelt out. One cannot sort out the currency, membership of the European Union and defence structures all within six months. An academic said last week that it would take 10 years. That is perhaps a little excessive, but certainly it would take some time and during that awkward period between a yes vote and actual independence Scotland would be in some kind of limbo; we should be clear about that.

However, if there is a no vote, we should be positive about how we move forward on the back of the declaration by the three political parties in Scotland. My great guru in these matters was Jo Grimond, who wrote many years ago:

“I do not like the word devolution as it has come to be called. It implies that power rests at Westminster, from which centre some may be graciously devolved. I would rather begin by assuming that power should rest with the people who entrust it to their representatives to discharge the essential tasks of government. Once we accept that the Scots and the Welsh are nations … we must accord them parliaments which have all the normal powers of government, except for those that they delegate to the United Kingdom government or the EEC”.

It has always seemed to me that that is the better starting point for discussing what should happen after 18 September.

I am glad to say that we have some new converts to the cause of a federal or quasi-federal constitution. Gordon Brown, with all his experience as a former Chancellor and former Prime Minister, wrote a very powerful essay in the New Statesman last week, which states:

“No one can now ignore the basic fact that the United Kingdom is no longer and will never again be the all-powerful centralised unitary state of the constitutional textbooks. With one parliament, two legislative assemblies and a high-powered London authority taking powers from the centre, Britain is not the unitary state we were taught about at school”.

He is right about that. He goes on in the same essay to say:

“The system of sharing across the UK creates a form of equality between the citizens of the four nations that no other group of countries can match for its depth and sophistication and this is arguably the defining characteristic of the Union today”.

These are wise and profound words, of which people in Scotland should take account.

An intriguing, additional argument has been put forward by Alan Riley, professor of law at City University —namely, that the advantage of the UK having a written constitution is that of protection against mission creep from Brussels, which so exercises politicians and press alike. He writes:

“A British version would, like the German law, set out the major institutions of the state, set out principles and enumerate fundamental rights. The British Supreme Court would then be able to police the borders of the union’s jurisdiction”—

that is, the European Union’s jurisdiction—

“in a similar fashion to the German courts”.

Again, I think that that is a powerful argument for looking forward to some form of written constitution and the development of a quasi-federal constitution for our country.

I find that many people in Scotland on the yes side argue about the advantages historically of the Scots making their mark in the world. That is undeniable—for example, the Jardines and the Mathesons in the Far East. However, they forget that many of the Scottish heroes of whom we are most proud were dependent on mutual support from English organisations. For example, David Livingstone’s remarkable exploits were carried out on behalf of the London Missionary Society, while the Selkirk-born Mungo Park, who died on the River Niger, relied on the support of the African Association in London. This is true of our inventors as well, of whom we are all very proud. Sir Alexander Fleming discovered penicillin but developed its use at St Mary’s Hospital in London. James Watt developed his steam engines in Bristol and Cornwall and John Logie Baird developed his television in Hastings. These people, of whom we are so proud and whom the nationalists talk up, were all dependent on the mutual support of the United Kingdom for the work that they did.

In my first general election manifesto when I was party leader, I called for reform of the House of Lords, but my wording was carefully chosen. I stated:

“The House of Lords should be replaced by a new, democratically chosen, second chamber which includes representatives of the nations and regions of the United Kingdom, and UK members of the European Parliament”.

If you look back to the Bryce commission of 1918, which recommended that a reformed House be indirectly elected by Members of the Commons, here is the possibility of a reformed senate—an upper Chamber of this Parliament—being elected by Members of the Commons, the European Parliament and the devolved Assemblies, and being a real, quasi-federal institution. That is why I welcome what my noble friend Lord Strathclyde had to say about what could happen after 18 September—a coming together of such people into some kind of constitutional convention or commission, in which this House could play a distinguished part in the future.

My Lords, it is a pleasure to follow the noble Lord, Lord McConnell, and I join him in thanking my noble friend Lord Lang for introducing this important debate. I too look forward to the maiden speech of my noble friend Lady Goldie. Having listened dispassionately to her trenchant and witty speeches from the Chair of the Scottish Parliament, I know that she will contribute greatly to our debates here.

In the three years that we have been discussing this matter, the debate has tended to focus on whether Scotland would be better or worse off as an independent country. I would argue that that is not the right question. If to separate off from the United Kingdom and become independent is the right thing to do, surely the cost of doing it is immaterial. The question is whether it is the right thing to do. I would argue that it certainly is not.

I do not know whether other noble Lords have received through their letterboxes this card that I have received, published by the Scottish Government. It is an advertisement for their White Paper, urging people to read it online or borrow it from their local library. It claims that Scotland’s Future—the title of paper—“sets out the facts” on independence. Of course it does nothing of the kind. It sets out, as my noble friend said, a series of wish lists. There is a big difference between a wish list and the actuality. We had an example of this a few weeks ago when the First Minister of Scotland indicated a wish to attend the funeral of Nelson Mandela. He even had his officials call the office of Prince Charles to see if he could get a lift on the plane. That was turned down, possibly on the grounds that he had not been invited—I do not know.

The First Minister has been totally consistent in his view of his own role. In an editorial in the past week, the Scotsman asked:

“How could a Scottish Government visit to a Ryder Cup event in Chicago come to cost almost £470,000? And was it really necessary for First Minister Alex Salmond to stay in the upmarket, £1,200-a-night Peninsula Hotel? … Even making full allowance for various purposes of the visit, was it really essential that the First Minister had 17 bag-carriers, advisers and functionaries?”.

The answer to those questions is yes, it is. He has been utterly consistent. He is already behaving like the head of state of an independent country. Therefore we should not scoff at that. That is what the future holds for us if we go down that particular route.

Professor Gavin McCrone, who served so many Governments as Chief Economic Adviser, has said on the matter of the currency union proposed by the SNP:

“Scotland would have very little influence on monetary policy, and fiscal policy would, in effect, be overseen by the rest of the UK”.

In other words, the Government here and the Bank of England would continue to run the economic policy of Scotland. What sort of phantom independence is that?

When it comes to the European Union, if noble Lords have got as far as page 222 of the White Paper, this paragraph is very revealing. I quote it in full:

“We recognise that specific provisions will need to be included in the EU Treaties as part of the amendment process to ensure the principle of continuity of effect with respect to the terms and conditions of Scotland’s independent EU membership, including detailed considerations around current opt-outs, in particular the rebate, Eurozone, Justice and Home Affairs and the Schengen travel area”.

That is a long wish list, just in one paragraph of page 222, and the fact that the President of the Commission, the Prime Minister of Spain and others have said, “You’re not on”, is entirely unimportant in the Scottish Government’s view.

Noble Lords on these Benches know that my great guru in political life was Jo Grimond. This is what he wrote about the issue, long before we had any form of Scottish Parliament:

“I do not like the word devolution as it has come to be called. It implies that power rests at Westminster, from which centre some may be graciously devolved. I would rather begin by assuming that power should rest with the people who entrust it to their representatives to discharge the essential tasks of government. Once we accept that the Scots and the Welsh are nations, we must accord them parliaments which have all the normal powers of government, except for those that they delegate to the UK government or the EEC”.

That is the right way forward for all the UK political parties after the no vote. We should be concentrating on what needs to be reserved to retain the benefits of the union rather than what more should be devolved.

The big issue that so far has not been properly debated in Scotland is whether we really are content to jettison our whole history in the United Kingdom. We were the home of the enlightenment. We had four universities for our small population when England had only two. We contributed substantially to the growth of empire and Commonwealth through our explorers, missionaries and engineers. A few months ago, I had former President Kenneth Kaunda to lunch here in the dining room. He talked eloquently and passionately about his upbringing in a primary school founded by the Church of Scotland in what was then northern Rhodesia. That was part of our contribution to the Commonwealth as we know it today.

Do we in future retain the glory of our defence forces, which the noble Lord, Lord Lang, mentioned, and with which we fought two world wars? Do we really imagine that persons serving in our Royal Navy, Royal Air Force or regiments would wish to leave those and join some small, independent defence force in Scotland? Do we keep our participation in the British Broadcasting Corporation, or do we have our own SBC—no doubt, as it would have been last week, feeding us on a diet of Eddi Reader murdering Burns’s simple melodies?

The union, after the referendum, should use a reformed Upper House here to strengthen it and give it, if you like, a quasi-federal nature, recognising that nearly 10% of those living in Scotland were actually born elsewhere in the United Kingdom, and that nearly 1 million of those born in Scotland now live elsewhere. I am certain that in this debate we should strengthen and emphasise the glory of our interdependence, rather than the bogus independence on offer.

My Lords, I am not sure that I shall join in the thanks to my noble friend Lord Forsyth for arranging that we would have three minutes to speak on this subject, but I agree with the noble Lord, Lord, Foulkes, that he was right to press for a proper debate on it.

The so-called White Paper is full of wishful thinking. It spells out what the SNP would like to happen, not what will happen. There is a fundamental difference between the two. Some of what it would like to happen, I would like as well. For example, it mentions currency union. We have that already. It is a funny kind of independence in which the Bank of England will call the shots in future. On defence, it wants a separate Scotland to stay in NATO, keep all Scotland’s defence establishments and get rid of Trident. It just wishes that that would happen. It wants a separate Scotland to be an “active participant” in the European Union. Not only the Prime Minister of Spain but many others will have views on that matter. There are pages and pages of wishful thinking.

My greatest fear, which is what I want to express today, is that the danger of a vote for independence is that Scotland would become ingrown. That is against the whole of our history. After all, the contribution that Scotland made to the building of empire and Commonwealth was far greater than our population would suggest. The contribution that we made in the First and Second World Wars to the defence of Britain was far greater than our population would suggest. I take pride in that. I want to live in a country that continues that history of a major contribution to the well-being and success of the United Kingdom. I do not wish to live in a country that has its own wee broadcasting corporation feeding us on a continuous diet of “cauld kail het agin”, which I fear is what would happen. That is why I believe that the people of Scotland will vote decisively against this bogus prospectus of a bogus independence.

My Lords, I am certainly cognisant of the strong views that are held about this Act and its operation. One of the clear things emerging from this case is the great need to have clearer guidance for doctors on how to carry out their functions and the tests that are set down in Section 1 of the Abortion Act. I am confident that that will now be addressed. Certainly, the Crown Prosecution Service stands ready to assist in any way to provide that clarity.

Does my noble friend agree that it is very difficult to see how any prosecution under the Abortion Act could take place if no abortion has taken place? Does he accept that gender selection by abortion is wholly repugnant and that therefore we must hope that the General Medical Council will issue ethical guidance on this important matter as soon as possible?

My Lords, I entirely agree with my noble friend that gender selection as a ground for abortion is wholly repugnant. It is quite clear that that is the very strong view of Members of your Lordships’ House. While abortions did not take place in this particular case, attempting to commit a criminal offence—that is, doing something that goes further than just preparing to commit it—is a crime in its own right and it is on that basis that the Crown Prosecution Service looked at the facts of this case. I do not know yet when the General Medical Council will come forward with any revised guidance; I have indicated that I think that it is necessary. However, the Chief Medical Officer will be writing again very shortly to all doctors involved in abortion provision, setting out the Department of Health’s views on sex-selection abortions—making it clear that sex-selection abortions are not acceptable—as well as pre-signing of certificate forms and other relevant issues, highlighting the need for doctors to keep up to date with legal provisions in the Act.

My Lords, we launched our inquiry in February 2012, when it seemed likely that there would be a referendum on independence in Scotland in autumn 2014. Since then this has, of course, been confirmed. We did so because we were concerned that, on what was widely recognised as an issue of momentous consequences not only for the people of Scotland but for the rest of the UK, it was vital that such a vote should be based not only on sentiment and patriotic fervour but on a full understanding of all the implications. At that time, these consequences had simply not been fully analysed, let alone widely exposed to public debate. We did not make the case for or against independence. We did not go into the constitutional or legal issues on the referendum process. We focused entirely on the economic implications, primarily for Scotland, but which are just as important for the rest of the UK as well.

The need for a properly informed debate before the referendum seemed to us to be all the greater as it became clear that if there were a yes vote for independence, it would probably take years to separate the Scottish economy from the rest of the UK and for it to negotiate entry into the EU as a new state. This would cause great economic uncertainty and possibly damage to Scottish businesses in the mean time. In our view, all the key issues and consequences needed to be fully explored beforehand, and not left to negotiations afterwards.

We heard from 44 witnesses in all, including British and Scottish Ministers, academics, trade unions and local authorities, with a wide range of opinions on business, finance and politics. We heard evidence in Glasgow and Edinburgh, a first for the committee. One disappointment was that some Scottish companies from which we would have liked to have taken evidence declined to do so. One witness described there being a possible “climate of fear”, with witnesses having fears about the impact on their business of speaking out. Another disappointment was the First Minister’s declining to give evidence himself before the Committee, much as we pressed him to do so.

I would like to stress yet again that our report is based on the evidence that we received. I thank all our witnesses, and on behalf of the committee express especially warm thanks to our specialist adviser, Dr Angus Armstrong of the National Institute of Economic and Social Research, for his most helpful contribution to our deliberations. As always I thank Bill Sinton, clerk to the committee, and his staff, for the huge amount of work they undertook. I am also most grateful to all my colleagues, who gave a great deal of their time to this inquiry and contributed greatly to the lengthy discussion that we had on the final report.

As our inquiry progressed, it helped to shine increasing light on the economic implications of a yes vote and what they might entail. As we reached the drafting stage of our report, the British and Scottish Governments have each started to publish their own analyses of the various economic implications, which we warmly welcome. Much more needs to be done, however, if the Scottish voters are to make a fully informed choice in October 2014, and the wider British public—and I do mean the wider British public—are to understand the implications for them. As the UK Government say in their response to our report:

“It is crucial that the referendum debate is properly informed”.

I turn to some of the main issues and, given the time available, can only highlight the key ones. Some are already much clearer than when we embarked on our report. For example, it became apparent during our inquiry, not least because of the exchanges that we had with the President of EU Commission, President Barroso, and then of the UK Government’s own analysis, that in the event of a yes vote Scotland would become an entirely new state and that the continuing UK would retain the rights and obligations of the UK as it currently stands. This is important particularly in the context of the EU, but, for Scotland, it would also apply to many other international bodies and treaties. Indeed, it was during our visit to Scotland that the Scottish Government’s claim to have legal advice to the contrary was blown apart.

Given the complexities in particular of negotiations with the EU and the need for unanimity of all member states in the EU in accepting a new member, it must be extremely unlikely that these negotiations would be completed by the spring of 2016, as some hope, and there is no certainty of outcome. Meanwhile, there would among other things be great uncertainty for Scottish companies operating internationally, for inward investment to Scotland and for other sectors of the Scottish economy.

One particular impact is on international trade. Most of our business witnesses spoke of the importance of being within the EU. One particular advantage was stressed by some chief executives of Scottish-based international companies, who spoke of the benefits of international trading deals done by the EU for their companies. The significance of this is underlined by the launch of the negotiations for an EU-US trade agreement at the recent G8 summit.

I turn next to currency choices. Our analysis is very similar to that of the UK Government. After some toing and froing, the Scottish Government seem to have settled for continuing to use sterling in a sterling currency union. The UK Government state in their Scotland Analysis document:

“A formal … currency union is very different to the current arrangements and would be a profound economic change for both states … the economic rationale for the UK to agree to enter a formal sterling union with a separate state is not clear”.

We in our report are even more specific, as we state:

“A monetary union as advocated by the Scottish Government would require robust and credible limits on borrowing and indebtedness by both member states. So far the Eurozone has found this problem intractable”—

a point acknowledged also by the UK Government in their document. We continue:

“We believe that it would be difficult for any such agreements to be made binding in all circumstances”.

On Bank of England and monetary policy, again our report and the Government’s analysis are similar. The Government’s conclusion is that,

“the economic rationale for the UK to agree to enter a formal sterling union with a separate state is not clear”,

and that it is likely that economic and fiscal plans of a separate Scottish state would be subject to rigorous oversight by continuing UK authorities. We agree with that but are rather more direct. We do not see how the UK Government could extend central banking services to an independent Scotland, since the UK Government would lack control over its tax and spending policies. Crucially, we argued that this, along with the continued use of sterling by an independent Scotland in monetary union with the rest of the UK, could only come about, if at all, on terms agreed by the UK Government and that—a point to which I will return—arrangements should be clear before the referendum. We add that,

“the proposal for the Scottish Government to exert some influence over the Bank of England, let alone the rest of the UK exchequer, is devoid of precedent and entirely fanciful”.

I note that in his letter to me, the Chief Secretary to the Treasury quotes the Chancellor of the Exchequer as saying that,

“it is highly unlikely that the rest of the UK would agree to enter into a formal sterling currency union with an independent Scotland”.

We entirely agree with that and believe that it should be confirmed before the referendum.

I turn now to the other paper that the UK Government have so far produced, published last month, on financial services and banking. Time prevents me from going into detail—others may wish to do so—but, again, we are in broad agreement. We agree on the significance of Scotland’s financial sector to its economy and the fact that 90% of its customers are located in the rest of the UK; on the need for a separate Scottish financial regulator for an independent Scotland, adding to compliance costs and complexity for Scottish financial institutions; and on the fact that the assets of the whole UK banking sector, including Scotland’s banks, are around 492% of total UK GDP whereas, by contrast, Scottish banks would have assets totalling around 1,254% of an independent Scotland’s GDP, with all the implications for financial shocks such as we have experienced in recent years.

All of these are key considerations for the Scottish electorate. As the Chief Secretary points out, that proportion of GDP is massively greater than was the case with Iceland, Ireland and Cyprus. The problems that would face Scottish banks, savers and depositors in the event of a financial crisis in an independent Scotland could be immense and need to be thought through in advance. We await government papers on assets and liabilities in defence, all of which are substantially covered in our report.

On North Sea oil and gas, there is a broad equivalence between Scotland’s gain on North Sea oil revenues and what it would lose from abolition of the Barnett formula. I notice that the noble Lord, Lord Barnett, is in his place, and this is interesting for many of us in your Lordships’ House who have been arguing, one way or another, that the Barnett formula needs to be resolved in the near future. An independent Scotland, curiously, would resolve the question, although we would still have to worry about it if the independence vote did not say yes. However, that is not an answer to the Scottish issues. One of our witnesses, Professor McCrone, said that, on the expected geographical division, which we in our committee accept, about 90% of revenues would accrue to an independent Scotland. On the other hand, there is substantial volatility in oil prices, uncertainty over future oil revenues and the need to deal with substantial North Sea oil decommissioning costs. It is no long-term panacea.

Division of assets and liabilities will be complex, including for PFI and public sector pensions. Indeed, the subject of pensions as a whole needs detailed consideration, including the need for a Scottish pension regulator for private sector pensions, a pension protection fund and a separate financial services compensation scheme for Scottish financial institutions. An independent Scotland will need to handle the difficult questions of the ensuing public sector debate as a consequence of looking at the division of assets and liabilities, with volatile tax revenue, the loss of risk-sharing with the rest of the UK and no record of issuing debt to global lenders. Those are all issues that the Scottish Government will need to spell out for the comfort of the Scottish electorate before the referendum.

I turn next to defence, which is an absolutely key issue, particularly for the rest of the UK. We were disappointed that Defence Ministers refused to give evidence to us and we had to rely on others. We are particularly grateful to the noble Lord, Lord West, who gave some very compelling evidence to our committee. The UK Government’s position is that it is for the Scottish Government to set out for the Scottish people how the defence of an independent Scotland would be arranged and, for the rest of the UK, the UK Government cannot prenegotiate the deals of independence ahead of the referendum. We certainly recognise the security aspects and are clear that any post-referendum negotiation would be huge, lengthy and complex on defence issues. We are also clear that the defence implications, not least cost, are immense for the rest of the UK, and we hope that substantial contingency planning is already under way in the Ministry of Defence. Others may wish to comment on defence in greater detail today. I certainly welcome the fact that the Government are planning a detailed paper on shared defence and security services, and I hope that it will cover the issues that we have raised, on which we have so far not had a proper government response.

This leads me to my final point. There is general agreement that this will be a momentous decision for the people of Scotland, but it is not so well recognised that this will also be a momentous decision for the rest of the UK. There are huge implications for the rest of the UK—over 90% of those affected.

This excellent report is full of questions, some of which are directed to the UK Government—but mainly they are directed to the Scottish Government. As they have known for two years that they will have a referendum, does not the noble Lord find it extraordinary that these questions have not yet been approached?

I cannot speak for my committee as a whole—although I suspect I am doing so—but that exact point occurred to us as we went through all the evidence. Many of the responses that we were getting, or not getting, did not deal with the points that I am raising now. I put my emphasis on the UK Government’s position today because we are in the UK Government’s Parliament, but I hope that many of the issues that we have raised—and, incidentally, that have been raised by Scottish business and some Scottish local authorities, such as the Glasgow City Council—will get a better answer than we have had so far.

As I was saying, we have spelt out many of the consequences of Scottish independence in our report. On defence in particular, there are potentially huge cost implications. Also included are such major issues as the division of assets and liabilities, negotiations on sterling and monetary policy, and so on. That is all very well. On the other hand, so much hinges on the subsequent negotiations. It is not enough, it seems to us, to leave it to those advocating independence to make the case, as the Chief Secretary to the Treasury has argued. He argued the case on our questions on the need to have the negotiations clarified as follows:

“The UK Government believes that people in Scotland will vote to remain part of the United Kingdom and therefore is not making plans for Scottish separation from the UK. This is not complacency but rather based on a strong belief that the UK works, and works well. Scotland contributes to, and benefits from being part of the UK”.

He goes on to say:

“It is for those advocating independence to set out a clear and well evidenced case to people in Scotland about what the implications of leaving the UK would mean for them—including some of the unavoidable choices that will have to be made”.

We do not think that that is a sufficient response because, in fact, the implications for the rest of the UK are very substantial as well. That is why we have argued the particular point that I stress now. We have argued in our report that:

“Scotland needs and deserves a fully informed debate, based on fact and free from rancour, well before the referendum vote”.

It continues with the following key point:

“To help bring it about the Scottish and British Governments should be more open about how they see the outcome of negotiations after a ‘Yes’ vote; each should indicate the ‘red lines’ of its negotiating stance on such crucial issues as currency, defence, division of assets and debts and negotiations with the EU before the referendum so that voters can make an informed choice”.

I regard this as a critical point. The debate is becoming much clearer and better informed, particularly since we took evidence and completed our report. The UK Government have produced very helpful and detailed analyses of some key issues and we look forward to more. However, there is still this issue about not discussing the negotiations in advance of the referendum. One argument has been that that should wait until after the negotiations, but one problem is that could make it very easy for many of the people intending to vote in the referendum to vote “yes”, on the assumption that all the negotiations would take place afterwards and that there would then be a second vote afterwards, once they were completed. That is not satisfactory and it is not the way it should operate. That is why we have urged—

My Lords, Scotland Office Ministers and officials are working closely with the Foreign and Commonwealth Office, the Department for International Development and the David Livingstone 200 partnership to assist with a programme of celebrations to mark the 200th anniversary of Dr Livingstone’s birth. As part of the wider programme, the Scotland Office will host a commemorative reception at Dover House, which will follow on from a service that will be held in Westminster Abbey on 19 March, the actual 200th anniversary of Dr Livingstone’s birth.

My Lords, I thank my noble friend most warmly for that Answer. Is he aware that, in view of David Livingstone’s reputation as a missionary, an explorer and, above all, a campaigner against the slave trade, commemorations will take place next month in Zambia, Tanzania and especially in Malawi? Will he tell the House whether there are any activities planned in Scotland itself, apart from the excellent news that the museum at Blantyre will be revamped by the National Trust?

My Lords, my noble friend is absolutely right to pay tribute to Dr Livingstone. It is significant that in the post-colonial age some of the place names associated with David Livingstone, such as Blantyre and the name Livingstone itself, have remained. That speaks volumes about the contribution that he made and the standing in which he is still held. For example, in Zambia there is a programme called Livingstone 2013, in which the British High Commission has been very actively involved. My noble friend also asks about Scotland. The National Museum of Scotland has a special commemorative exhibition, which has run since November until April this year. There will be events on the day. My right honourable friend the Secretary of State for International Development is planning a flagship event at Abercrombie House in East Kilbride, the offices of the Department for International Development, on 18 March and, very interestingly, a time capsule is proposed, linking children from Malawi and Scotland, which will be Skype-linked on 19 March.

I think that that has reinforced the point.

I also want to raise the question of 16 and 17 year-olds, as I have done on a number of occasions. I do not think that people have realised—and certainly the Scottish Government have not realised—the practical problems of identifying and putting these 16 and 17 year-olds on the register. It has been estimated that there may only be a few thousand who are ultimately eligible to vote. We should ask the Scottish Government to tell us how they are going to do this. It has already been made clear that they will have to undertake and fund it; we should ask them how they are going to carry it out.

Finally, one particular problem is that there is so much preoccupation with the referendum by the Scottish Government, the First Minister and Deputy First Minister, by members of the Scottish Cabinet and SNP Members of the Scottish Parliament—they are so preoccupied with the run-up to it and winning it—that other areas that we have devolved to them are being ignored. The health service is not being properly supervised and problems have already been raised. Some of our Labour colleagues in the Scottish Parliament have brought up these concerns. In education, housing, and social work, problems have been raised that are not being properly addressed. We should say to Members of the Scottish Parliament, and particularly to the Scottish Government, that a whole series of very important matters has been devolved to them and they should not let their preoccupation with the referendum and with trying to win it take their attention away from doing a good job in the areas already devolved.

My Lords, when my noble friend Lord Forsyth began his speech he said to my noble friend the Minister that if he were on a charge of murder he would happily employ my noble friend as his defence counsel. I hope my noble friend is honing his skills because they may be needed. I get the impression that my noble friend Lord Forsyth has a completely unhealthy obsession with the First Minister of Scotland, and it is not one that I share. It may go back to the fact that they were at university together, but I thought that his otherwise powerful speech was spoilt by too many references to one individual of whom we should not be afraid.

I am certainly not obsessed with the First Minister but I think it is legitimate to point out that when my noble friend talks about the Scottish Parliament and so on, we all know that the Scottish Parliament is completely dominated by the First Minister. None of the members of the SNP is able to say a word but by his leave. So it is important to realise that, when we think we are devolving power to the Scottish Parliament, we are talking about giving power to Alex Salmond because he calls the shots.

My noble friend has just repeated the point I am trying to make—that he is totally obsessed by one individual. I agree with the noble Lord, Lord Browne, who pointed out that, whether we like it or not, the SNP secured the democratic mandate and this order enables it to carry that out and to hold the referendum. For that reason I support the order.

There are lessons to be learnt from the mistake—the misjudgment—that has been made to keep postponing the process to 2014. This has been mentioned by several other speakers. It is important to notice the difference between this situation and the one in Quebec: during the two years that we have been debating this issue, the support for independence has been going down, not up. This is extremely significant. I suggest that the reason it has been going down is that, quite apart from the 35 questions from the CBI which the noble Lord, Lord Nickson, referred to, there have been three major issues on which the Scottish Government have been found wanting. One already referred to is the legal advice—or rather lack of it—on joining the European Union.

I remember the SNP campaigning very strongly on independence in Europe—in other words, it was not only going to join the European Union, it was also going to sign up to the euro. That has suddenly disappeared: I cannot think why. The SNP is no longer advocating joining the euro. That uncertainty about the relationship of a future independent Scotland with the European Union—on which there was an interesting, long interview this morning on Radio 4—is one of the reasons why support has slowly withered away. The second reason, which is related to it—

Will my noble friend give way? He has helpfully reminded me that there is another implication of that slogan, of course, because just as you can be independent in Europe you can be independent in the United Kingdom. What you are not is separate, which reinforces the points that we made earlier on.

Indeed, I was going on to say that one of the other uncertainties that has been exposed during this prolonged debate is the question of what currency would be used. If the euro is out, and we are not having a separate Scottish pound because we are going to rely on the Bank of England, what sort of independence is that? So the second bit of unravelling has been on the whole issue of the financing of an independent Scotland.

The third—which has also been mentioned by others so I will not go into detail—is on Trident and the defence role of an independent Scotland. My party and I have long been opposed to the replacement of the Trident system—in fact we were opposed to the initial replacement of Polaris by Trident. That is at least a position of principle, even if people disagree with it. What is unacceptable is for the SNP to say, “We want rid of Trident, but we are quite happy if it goes to Devonport or Barrow-in-Furness or somewhere else”. That is not a credible position. Nor is the position, as the noble Lord, Lord Reid, pointed out earlier, of saying, “We would like to join NATO because that makes people feel comfortable, but we will not accept any of the obligations of joining”.

For all these reasons, the longer the debate has gone on—and I have argued before that that was a mistake because people would become bored by it and the uncertainty would not be good for Scotland nor for investment in Scotland—the more the support for independence has declined.

Among those of us who campaigned in the 1980s and 1990s for the restoration of the Scottish Parliament, there was an unspoken assumption that, if we got a Scottish Parliament and a Scottish Government, then the future Scottish Government and the future UK Government would collaborate in the interests of the people of Scotland. Indeed, it is fair to say that, in the first years of devolution, that did happen. Of course there were disagreements occasionally between the two Governments but basically they were both pursuing the best interests of the people of Scotland. I think the biggest single reason why support for independence has declined is that that does not appear to be the position of the SNP Government. Their position is not, “What can we do together with the UK Government to better the life of the people of Scotland?” It is rather, “What can we do to promote the SNP?”. That is a very different position.

During the Olympic Games, the Scottish Government hired the Army and Navy Club in London, at a cost of £400,000 of our taxpayers’ money, to entertain athletes and others visiting the Games: in fact, very few people went. They could have had Dover House for nothing—a substantial building, right in the centre of London, well known—but of course it belonged to the UK Government, so it did not suit the ideal of the SNP. That is a trivial example of what I am saying—that the motivation throughout has been what is in the best interests of the SNP.

I end with the question that everybody else has been raising about the decision on respecting the judgment of the Electoral Commission. Why is the SNP not willing to say now that it will accept that judgment? It is because it wants to promote the interests of the SNP. The more people realise this, the more the support for independence will continue to decline.

I support this order. I am not complacent about the outcome but I am confident that, because of this constant shifting of position by the Scottish Government, in the end people will say that they do not want to make that leap in the dark.

My Lords, every voice that we have heard so far has been a unionist voice. I realise that I may be in a small minority—perhaps even a minority of one—in this Chamber in wishing the people of Scotland well in their quest for independence; none the less, I wish to see a new relationship between the nations of these islands: a new partnership of free and equal self-governing nations co-operating with each other and with partners in the European Union and the wider world.

Today’s debate has involved a series of attacks on the SNP in general and on Alex Salmond in particular, as was mentioned by the noble Lord, Lord Steel of Aikwood, a moment ago. It may well cross the minds of noble Lords that it is a little strange that this House—one of the two Houses of the UK Parliament—does not have any voices from Scotland that represent nationalist aspirations, which is, after all, the driving force behind the forthcoming independence referendum.

I fully understand that the SNP has stuck resolutely to a policy of not putting forward nominations officially in the party name—as indeed did my party, Plaid Cymru, until five years ago. The experiences that my party suffered at the hands of a former Prime Minister may well have persuaded the SNP, which might be sympathetic to securing a voice in this Chamber, not to bother pursuing the matter. Noble Lords may well wish to ponder on the acceptability of a system whereby the leader of one party—albeit a Prime Minister—can determine whether another party, with MPs in the House of Commons, can be denied a voice in one of the two Chambers of the British Parliament.

My Lords, the noble Lord, Lord Wigley, whom I am very pleased to call a friend, said that his would probably be the only voice advocating independence. Mine appears to be the only English voice in this debate today. We have heard two from Wales and the rest from Scotland. I particularly wanted to take part because this is not a Scottish issue. This is an issue that affects the whole United Kingdom. As I have said in this House before, we all have varied backgrounds, and it is very difficult to isolate the pure Scottish from the pure English. I consider my identity as English, and yet the background of my family is Scottish for centuries. My elder son lives in Scotland with a Scottish wife, and my two grandchildren go to school in Edinburgh. My son considers himself Scottish, so Scottish indeed that he acted as the election agent for the daughter of the noble Lord, Lord Steel—because he has gone Lib Dem—in a recent election.

Yes, indeed, successfully. That, of course, in its simple way illustrates the fact that within this Chamber and within this country, there are very few of us who can say that we are wholly this, that or the other. It is therefore important that there be English voices in this debate. After all, England is by far the largest country in the union, and we will all be affected for generations to come if, on the anniversary of Bannockburn, the Scottish people vote to sever their links with the United Kingdom.

My noble friend Lord Forsyth made an absolutely splendid speech. He has been taken to task by one or two people for being too personal. I would like to dissociate myself from personal attacks but also to agree with the substance of what he said. I know Alex Salmond very well. I met him on the first day that he came into the other place. Quite by chance, my wife and I and our family found ourselves for successive years taking holidays on the beautiful island of Colonsay at the same time as Alex Salmond, and having many an agreeable conversation at the bar. He is an engaging man. Personally, he has many delightful qualities. However, he is one of the two most skilful politicians in the United Kingdom at the moment, the other being Boris Johnson. We underestimate his political skill, dexterity and ability at our peril. We must take him very seriously, and we cannot assume that the referendum will go the way that most of us in this Chamber would like it to go.

As I listened to my noble friend Lord Forsyth, and as he was almost convincing himself that he was wrong not to press this to a Division, so he was almost convincing me. Of course I accept his judgment and I will not attempt to divide the House. However, the agreement that was negotiated was not so much an agreement as a capitulation. The Prime Minister, for whom I have high regard, and the Secretary of State for Scotland had Mr Salmond running rings around them. They conceded far too much. It is a great pity that the Parliament of the United Kingdom in its two Houses will not have a greater say in these crucial decisions that will be taken. The Scottish Parliament will be judge and jury when it comes to deciding the question.

We all know what the question to the Scottish people is. It could be framed in the simple terms, “Do you wish to leave the United Kingdom?”. However, what is being proposed at the moment is certainly, as has been said, a leading question. It invites the answer that Mr Salmond would like. That is why over these next months—we have less than two years—it is important that the series of papers that has been referred to is produced not only by the British Government but by the cross-party alliance that is being spearheaded in Scotland by Mr Darling—an admirable choice, I believe. It must be spelt out to the Scottish people, whose decision this ultimately is—I am not one of those who advocates every citizen in the United Kingdom having a vote—just what they will be losing and what they will be leaving.

I was delighted that the question of the votes of Scottish service men and women, who serve our country, often in extremely dangerous circumstances, was brought up in this debate. They of all people, wherever they are temporarily domiciled, must have the opportunity to cast a vote on the future of the country for which they are prepared on a daily basis to lay down their lives.

It is going to be an extremely interesting and, I hope we can say, good-humoured period. However, the stakes are extremely high. The noble Lord, Lord McConnell, pointed to the dangers of bitterness creeping in. Of course, he did so with his background knowledge—knowledge that we all have—that of all wars, the bitterest are always civil wars. This will be a civil war of words, to a degree. It is crucially important that we try to keep it good-humoured. That is why, although it is right to talk about the political skills of our opponents, we do not seek to denigrate them personally as individuals.

I very much hope that there will be an opportunity during the coming 18 months for those of us who have Scottish links, Scottish roots and Scottish branches of our family to play a part in this debate. We need to say to the people of Scotland, “You are a fundamental and integral part of the United Kingdom, and we need you because we need each other”. The United Kingdom is far more than the sum of its individual parts, and there is no individual part that has made a greater contribution to our history and success as a nation than Scotland. We do not want to lose that.

There is no point in resurrecting all the arguments over devolution. I remember them well because I was in the House of Commons when the very first Scottish National Party Member, Donald Stewart of the Western Isles, came—he was a lovely man. I saw all this, and took part in debates in the early 1970s and throughout that decade. Big mistakes were made by both major political parties. The biggest mistake made by the Conservative Party was neglecting to recognise the reality of the first devolution vote. It failed because it did not clear a parliamentary hurdle but it indicated aspirations in the Scottish people. During those 18 years, I was one of a group who went to see Mrs Thatcher, as she then was, to beg that something be done: perhaps we should start having the Scottish Grand Committee sitting in Scotland regularly and frequently; or there should be a consultative assembly of Scottish local authorities. Sadly, she did not want to listen. That was a great mistake.

I will never forget travelling up to Scotland on the sleeper and having a dram or two with Donald Dewar in 1996. I said, “What would have happened, Donald, if we had done that in 1979 or 1980?”. “You’d have shot our fox”, he said, “but it’s far too late now”. We are, as they say, where we are. We have a United Kingdom. There are cracks and fractures and it is our duty collectively to repair them. I am sorry that the order is phrased as it is. I am sorry that so many concessions have been made, but those of us who believe in the United Kingdom all have a duty to fight for its integrity in the year ahead.
