I asked a specific question. Can the Minister come back, if not today then in writing, about the amount that the Home Office is expending in legal fees in some of the challenges? I think she mentioned that the difference between the cost of the child applications and the amount being charged is about £23 million or £25 million a year. I would be very interested to know how the legal fees per annum compare with that, if possible over the last five years.

I apologise to the noble Lord that I do not have those figures to hand. I also beg to ask the question the other way: I assume the amount that litigants are spending on legal fees is quite significant as well.

My Lords, I agree with the noble Lord, Lord Ponsonby, that this has been a very interesting debate. Part of what has been interesting for me is hearing the differing views on misogyny across the House. This goes to the heart of the difficulties of this issue. The noble Baroness, Lady Jones of Moulsecoomb, asked if my noble friend Lord Wolfson was making prestigious notes. I wondered if he was making prodigious notes, but they might be both prestigious and prodigious—I do not know.

I thank all noble Lords who have taken part. I will restate three important points that I made in my opening remarks, as well as make some further points that were asked about. First, we are still pursuing the commitment that we previously made on data recording. I quote the comments that I made this time last year:

“I advise the House that, on an experimental basis, we will ask”—


not mandate, but ask—

“police forces to identify and record any crimes of violence against the person, including stalking and harassment, as well as sexual offences where the victim perceives it to have been motivated by a hostility based on their sex. As I have said, this can then inform longer-term decisions once we have considered the recommendations made by the Law Commission. We will shortly begin the consultation with the National Police Chiefs’ Council and forces on this with a view to commencing the experimental collection of data from this autumn.”—[Official Report, 17/3/21; col. 371.]

As the noble Lord, Lord Russell of Liverpool, pointed out, that was autumn 2021. I have absolutely voiced my disappointment on that. I am pleased that the wheels are in motion, albeit moving more slowly than I had hoped. We are making some progress.

The second point is that, before the Summer Recess, we will launch the public consultation on a new offence of public sexual harassment. I think that that reinforces the point made by the noble Baroness, Lady Fox.

Thirdly, the Law Commission, having studied this issue and a variety of possible solutions, recommended against making misogyny a hate crime. I am grateful to the noble Baroness, Lady Kennedy of The Shaws, for her points. I know that that is a source of regret for some noble Lords, but we cannot ignore the firm advice of experts that legislating in this way could do more harm to women than good. No one wants that outcome.

The noble Lord, Lord Russell of Liverpool, made an interesting point about Cara McGoogan’s article in the Daily Telegraph. The points that he raised about racism, misogyny and domestic violence within the police are being looked at by the noble Baroness, Lady Casey, and Dame Elish Angiolini. I know that we will get on to Child Q this afternoon when I repeat the Urgent Question. It is not a point that I dismiss at all; we all have to get to grips with the culture of the police.

The noble Baronesses, Lady Fox and Lady Kennedy of The Shaws, talked in different ways about the internet translating into real life. Obviously the online harms Bill is coming up. I do not want to give a complete prequel to that, but in that Bill we will need to consider the balance between free speech and protecting our children, women and girls. The noble Lord, Lord Ponsonby, referred to this and, as a parent, I am glad that my children had grown up by the time these problems began to surface, but I worry for the children, women and girls of the future.

To conclude, we are continuing to explore all options to tackle violence against women and girls and we are taking forward real change to achieve that. I invite the noble Lord to withdraw his amendment and I commend Motion D to the House.

My Lords, this has been an interesting 55 minutes or so. We always seem to be at our finest when we discuss problems that a lot of people seem to agree are insoluble, which is disappointing in a way. It would be nice to talk about problems that are solvable.

I am grateful to all noble Lords who have spoken and to the three men who managed to stand up. Essentially, to some extent I apologise, as I feel I must, on behalf of many of my sex. The attitudes of an awful lot of males are a concern and are shaming. Unless more of us stand up and talk about it, it probably will not go away.

The noble Baroness, Lady Kennedy, is a pioneer in this area. I again recommend that all noble Lords read her report. When I started reading the preface, I realised that I was reading a report unlike most others I have read—and, in talking to her before we came in this morning, I discovered why: the noble Baroness wrote it herself and that does show. It is cogent, it is spirited, it is clear in its intent and it communicates brilliantly. So I recommend that more Ministers and noble Lords, when they put their names to a report, should write the preface themselves rather than get somebody else to do it. The noble Baroness’s point that what she is trying to do in her report is focus on egregious, unpleasant, aggressive and harmful actions, not thoughts, is also really important. We all think things that perhaps we should not from time to time. Mercifully, most of us do not act on them—or, if you get to my age, you probably forget them. At my age, the most important thing is to learn new things more quickly than you forget old things.

I take the point made by the noble Baroness, Lady Fox, about women’s freedom. But to suggest in some way that what we propose is potentially to label all men as misogynistic—and to send a message to all women that all men are basically misogynistic—is perhaps, might I suggest, slightly decrying the intelligence and perspicacity of members of the female sex to work out for themselves when something is genuinely misogynistic in a very unpleasant way and when it is less harmful. The noble Baroness is particularly skilled at talking about absolutes and problems. It would be great if we could move on and perhaps focus more on solutions than on the problems that are in the way of trying to find solutions.

My noble friend Lady D’Souza made an excellent point. We need to be careful that the law of unintended consequences does not lead us, in a sense, to suppress when what we are trying to do is liberate. I say to the noble Baroness, Lady Jones, that if she sees that taxi driver again I am sure she will give him a piece of her mind—or will change her accent to talk a bit more like me, so he will think that she is even posher than she really is.

I say to the noble Baroness, Lady Bertin, that it is always good to hear from the Government Back Benches. She made the good point that if you make a commitment, you should be able to keep it. The Minister has been frank and honest about some of the problems the Government have encountered, but I come back to the point I made earlier: this should and would have been foreseeable if they had done the proper analysis much earlier of what was implied by the commitment they were making.

The noble Lord, Lord Paddick, is far more skilled in these details than I am, and in particular on the law of unintended consequences in how one puts laws together and applies them. He makes a very good point but, again, there is the incredible importance of recording misogynistic data, so we actually know what we are talking about instead of just guessing.

The noble Lord, Lord Ponsonby, shared his direct experience as a magistrate and it was very compelling. If it is racially motivated, you have to fess up and say that up front, but if it is equally or more egregious, you do not have to. The fact that it is optional tells you that we are barking slightly up the wrong tree.

Finally, I turn to the noble Baroness’s contribution. What is so frustrating is that we spend so much time talking about all the problems that get in the way of trying to do something about this. We do not hear very much about prospective solutions. To some extent that is what Kit Malthouse invited us to do and committed the Government to doing—trying to find solutions.

On the point about asking police forces to comply with this rather than mandating them, I disagree with asking them. I actually think that we should mandate. Police chiefs are used to having a variety of things mandated by the Home Office, so would not be surprised or shocked. They might not particularly like it if the Home Office did so in this case, but I would strongly encourage the Government to think about doing that.

It is worth reading Hansard to see what happened when the Commons was considering our amendments. The vast majority of time in the early part of that debate was spent on the Newlove amendment, with speakers from all sides of the House, including a considerable number of Conservative Back-Benchers, particularly women. There was also a prominent man, the ex-Secretary of State for Justice, Robert Buckland. He has been intimately involved in helping to develop this amendment. I have also involved the noble and learned Lord, Lord Judge, in thinking through the validity and force of what we are talking about.

There is a growing concern and voice in another place that we need to stop talking about problems; we need to commit to doing solutions. So, for the reason that I feel that the soles of the feet of Kit Malthouse deserve to be subjected to a rather higher temperature than I think he feels at the moment, I would like to test the opinion of the House.

My Lords, I join others in paying tribute to the noble Lord, Lord Russell of Liverpool, and his ongoing determination on this subject. The noble Baroness, Lady Royall, must also be commended as she not only educated me on the whole subject, way back when, but has shown that same tenacity—ditto the noble Baroness, Lady Brinton, who regularly shares her story with us. I join the noble Baroness, Lady Royall, in commending John Clough and others for their untiring campaigning on this. I have met John Clough; he is a truly wonderful man.

I totally get the sentiment of what the noble Baroness, Lady Royall, and the noble Lord, Lord Russell of Liverpool, are saying. He and I spoke earlier; we reflected on the journey we have come on, since I got into your Lordships’ House almost 10 years ago, in terms of the perception and awareness of and attitudes towards domestic violence, domestic abuse and stalking. While domestic abuse was certainly on the radar, there was a clunking attitude towards dealing with it; stalking is one step behind it, but to say we have gone backwards is just not the case—we have made great progress. However, I acknowledge—I think he sees this—that we have further to go, particularly in training on stalking and domestic abuse. It is a most dreadful crime; the impact on victims can be so dreadful.

I talked at length in Committee about the many actions to address stalking that we are taking through the tackling violence against women and girls strategy. I will not go through them all again, but the Government are totally committed to protecting and supporting the victims of stalking. We are determined to do everything we can to stop perpetrators at the earliest opportunity. On the point of the noble Lord, Lord Russell, that the VAWG strategy does not deal with male victims, I say that it makes it clear that, while the term “violence against women and girls” is used throughout the document, it refers to all victims of the relevant offences, including stalking. I am glad he raised that, as it allows me to clarify it.

The noble Lord also brought up the point that stalking is not only an awful crime but a very complex and multifaceted one. We talked about that earlier as well—the resentful stalker who may go after politicians, the intimacy-seeking stalker, the incompetent stalker and the predatory stalker. They come in all forms. As he said, many are not former partners of their victims, including so-called intimacy seekers and predatory stalkers. Within each category, there is a wide range of different types of stalking behaviour. Therefore, the Government totally acknowledge that the police need to be well informed about the many characteristics of stalking and the stalker to effectively investigate stalking cases. He can rest assured—I know he does—that it is a priority for the Government. I empathise with the aim of this amendment, but it is important to acknowledge the progress that is being made in the work we are doing.

It is vital that the police are provided with the correct materials and training to deal with stalking cases appropriately. That is why, in 2019, the College of Policing released a set of new advice products on stalking for police first responders, call handlers and investigators. These make clear, for example—I say this in response to my noble and learned friend Lord Mackay of Clashfern—the key differences between stalking and harassment. A range of advice and guidance products has been published by the College of Policing for forces to deliver locally to help responders to investigate stalking effectively, understand risks and respond appropriately to stalking cases. I know that training is also available to the police from providers in the charitable and private sectors. The noble Lord, Lord Russell of Liverpool, and I talked earlier about the work of the Suzy Lamplugh Trust, which runs the National Stalking Helpline and has been piloting a new training course for police called “Stalking Matters”.

Within Her Majesty’s Prison and Probation Service, all new probation staff and prison offender managers are required to complete mandatory domestic abuse awareness online learning, which includes a specific module on stalking. The module has recently been updated and rewritten, based on current research, by subject matter and academic experts within HM Prison and Probation Service. A process map has been developed to set out a consistent approach to working with stalking in the probation service, which provides links to relevant support and guidance documents, as well as learning that staff can complete. Furthermore, the stalking practitioner guidance is being finalised; this aims to raise awareness of the nature of, and various risks associated with, stalking. It will also direct practitioners to the support that is available within HM Prison and Probation Service when working with perpetrators of stalking.

When we had an opportunity to speak earlier, the noble Lord, Lord Russell of Liverpool, and I talked about the complexity involved; while the report from Maggie Blyth was excellent, there is complexity in practitioner understanding. I will take that away and we can perhaps discuss it further; there is no point having these things if they are not readily and easily understandable.

I now come to training within the CPS. E-learning modules are available to prosecutors; these cover the stalking and harassment offences, with emphasis on building a strong case, working closely with the police and engaging with victims throughout the legal process. Alongside the online course, elements of stalking and harassment are also covered in tutor-led mandatory training on proactive disclosure and hate crime. This training supports the Crown Prosecution Service’s legal guidance on stalking and harassment and restraining orders, the joint stalking and harassment protocol, and the associated checklist that must be used by police and prosecutors to ensure that they are taking the correct action in stalking cases.

The noble Baroness, Lady Royall, talked about police resources. She will know that we have a substantial police settlement for 2022-23 but her underlying point, I think, is that we have to put it to good use, and that the Government’s priorities need to be reflected in the work that the police do. She and the noble Lord, Lord Russell, also talked about the importance of data, the monitoring of ongoing work and Parliament’s duty to hold the Government to account on the policies that they make.

Of course, the police, the CPS and the probation service are operationally independent of government. The noble Lord, Lord Russell, and I discussed earlier the issue of mandating what training they should receive, especially, as I have just set out, when there is so much good work happening already. There is always more to do, but I do not think that the mandating of training is the best way of doing this, given the good work that is going on. There is also a very real risk that, if we were to legislate for one crime type, it might then suggest to law enforcement agencies that it should be prioritised over others. I know that that is not what the noble Lord and the noble Baroness seek. Appropriate training for criminal justice system professionals on tackling stalking is vital, but so too is training on tackling domestic abuse, sexual offences and other crime types. We do not regard these as less important; neither, I know, do the noble Lord or the noble Baroness.

In acknowledging and empathising with the sentiment behind the amendment put forward by the noble Lord, I assure him that the training provided to professionals working with the criminal justice system on stalking is robust and helps to address issues such as early identification of stalking cases—but I also acknowledge that there is more work to be done. I hope that the noble Lord will be content to withdraw his amendment in the knowledge that I have addressed his concerns as far as I can, and acknowledging the work that has been done. I know that we will come back to these matters at a future occasion.

My Lords, I thank the Minister very much for what she said. As usual, she has been thorough and comprehensive. She said what I would have expected her to say, and I thank her for that. I understand that there is a certain point beyond which she is unable to go; I will come back to that in a minute.

I thank the noble Baroness, Lady Brinton, for reminding us—and me—that stalking affects a very large number of men, as well as women. It is easy to forget that, as there has been so much focus on violence against women and girls. The noble Baroness, Lady Royall, reminded us that we are at about our 10-year anniversary of trying to get Her Majesty’s Government to focus on this and acknowledge that it will not go away. As the noble and learned Lord, Lord Mackay, said, it ain’t getting better, it is getting worse, and we do not completely understand why this is so badly the case.

The noble Lord, Lord Paddick, was able to remind us from his own experience that guidance is not enough, in and of itself. The noble Baroness, Lady Newlove, reminded us of the role of champions such as Laura Richards, and others, who have been speaking up very effectively for the many victims—giving them a voice, trying to make us understand how they feel and what they have gone through. As she said, stalking is insidious. I suspect that, by the law of averages, we all probably know somebody who has been stalked, albeit that it is probably not a subject that we would readily raise around the dinner table. I suspect that, if we spoke to such people who we know—if they were prepared to open up about what their experience was like—and listened to them and watched the look in their eyes as they spoke about it, it would be pretty wrenching; that is the reality of it.

The noble and learned Lord, Lord Mackay, made a very good point about the judiciary, with which I absolutely agree; the judiciary needs training just as much as the rest of us. However, for the judiciary to be able to exercise its duties properly, it is incredibly important that among all the different bodies charged with identifying when a case of stalking is serious enough to become the subject of a prosecution, the way that this is pursued and the case is put together, by people who know what they are doing, is as watertight as it is humanly possible to be. However well intended and well trained, if a judge is faced with a prosecution case that, frankly, is not watertight, then, however strongly he or she may feel that an injustice is being done, if the case being put forward is inadequate, the law must follow its duty, possibly deciding not in favour of the victim—and it would not be the victim’s fault. That is the essence of what we are trying to avoid; it is going on and it will continue to go on until we really grasp it.

I will not detain your Lordships. I had hoped that we would do this in 30 minutes, but we will do it in under 45 minutes. I thank the Minister again for what she said, and the noble Lord, Lord Coaker. There is a huge focus on the inputs in many of these interactions from the Front Bench: there is a long list of money for this, an initiative for that, this service having this and that service having that. To come back to the issue of data, in the future I would like to hear less about inputs and more about outputs. We need the evidence that these input are actually working and making a difference. I know we will come back to this subject, but I genuinely believe that, until and unless all the different bodies dealing with these distraught victims, who come to the police perhaps after 100 instances of insidious stalking, are equipped with the knowledge and experience they need to really grab hold of it and give victims some justice, it will continue to haunt us and, indeed, stalk us. I beg leave to withdraw the amendment.

I thank the Minister very much for that helpful response. I would like clarification on how we are going to proceed. Does she agree that the police forces currently recording crimes such as misogyny are doing so slightly differently in each case, because each police force has decided to interpret it in its own way? What the Minister’s department is about do to with the National Police Chiefs’ Council is to look at the different ways different police forces currently collect this data. I imagine she will also work with the Law Commission to take into account its evidence taken on sex and gender and its interim recommendations. Therefore, she will come out with a clarification of the guidance to be given to all police forces in England and Wales.

My Lords, I thank all noble Lords for their contributions to this debate, which has been excellent. I can categorically attest to the fact that the noble Lord, Lord Kennedy, is not a misogynist. The noble Baroness, Lady Bull, talked about how the behaviour of parents has almost a direct correlation with how their children might behave when they grow up. The noble Baroness, Lady Burt, talked about the trans community; the noble Lord, Lord Paddick, might have looked at my notes because the words I have written in response to her remarks are almost identical to what he said: that hate crime laws in England and Wales protect identity characteristics such as race, religion or sexual orientation, or groups such as trans or disabled people.

I thank noble Lords for all their comments, including the very thoughtful comments of my noble friend Lord Young of Cookham. The noble Lord, Lord Kennedy, talked about the abuse of parliamentarians—it is horrific to see the comments that people have made—much of which is misogynistic. The opening gambit of the noble Lord, Lord Russell, was the tragic case of Kellie Sutton, which shows two things, one mentioned by the noble Lord, Lord Paddick. It shows the failure to include domestic abuse in the MAPPA arrangements and the need for more effective use of Clare’s Law; the Bill remedies that, as it puts the guidance on a statutory footing. Noble Lords have talked about police forces that record misogyny. The noble Lord, Lord Paddick, rightly pointed out that those which record misogyny also record misandry.

I will be quite clear about the Government’s position on hate crime. All crimes that are motivated by hatred are totally unacceptable and have no place in this society. That is why, in 2018, as part of our updating of the Government’s hate crime action plan, we asked the Law Commission to undertake a review of current hate crime legislation, including considering whether other protected characteristics such as sex, gender and age should be included. We asked it to review both the adequacy and the parity of protection offered by the law relating to hate crime and to make recommendations for reform. This review began in 2019; over the course of that year and last, the Law Commission tried to meet as many people as possible who had an interest in this area of law, organising events across England and Wales to gather views and, of course, evidence, which the noble Lord so often talks about.

The noble Lords, Lord Paddick, Lord Kennedy and Lord Lucas, stressed the importance of data in our considerations. The noble Baroness, Lady Jones, asked about opening a debate with the police; I am sure that, following the Law Commission’s findings, such a debate will be opened up. However, we have specifically asked the commission to consider the current range of offences, aggravating factors and sentencing, and to make recommendations on the most appropriate models to ensure that the criminal law provides consistent and effective protection from conduct motivated by hatred towards protected groups or characteristics.

The review also took account of the existing range of protected characteristics, identifying any gaps in the scope of protection currently offered under the law and making recommendations to promote a consistent approach. The consultation to support the review closed on Christmas Eve of last year. That consultation focused on whether sex or gender should be added to hate crime laws, noting that misogyny by itself might introduce inconsistency to hate crime laws—as the noble Lord, Lord Paddick, also pointed out.

We will respond to the review when it is completed. Given the range and depth of the work undertaken by the Law Commission, we do not think it would be appropriate to prejudice the outcome of its work, including by issuing guidance or requiring the collection of statistics along the lines proposed by the amendment. As I have said, the noble Lord rightly wants to see evidence-based policy. The work of the Law Commission will add significantly to that evidence base. I hope the noble Lord will agree that we should allow it to complete that work rather than pre-empting it. We will consider what changes need to be made once we have had the opportunity to fully consider the Law Commission’s final recommendations. On the basis of these comments, I hope that the noble Lord will be happy to withdraw his amendment.

My Lords, I thank everybody who took part in this wide-ranging debate. I thought it was appropriate for it to be introduced by a member of the weaker sex, but I thank everybody of whatever sex for their contributions. I thank my colleague in the other place, Stella Creasy. She and I had the pleasure of spending quite a bit of time together at the Council of Europe in Strasbourg, where I got to know her. She has been a doughty champion of trying to get misogyny recognised as a rather pervasive element in modern society and I applaud her for her efforts, which have been supported across the Chamber in another place.

The noble Lord, Lord Young—with his usual erudition and from his commanding height—laid out just how extensive the Law Commission’s interim report is. I, too, waded through 40-odd pages, and I confess that I did not look at about 500 footnotes in detail, but it is very impressive and goes very deep. What comes out of it very clearly is that the case for the prosecution is proven: misogyny is something that actually exists, is tangible and has a very unpleasant effect on a lot of people. However, finding out that it is bad is the easy bit; the difficult bit, which is what the Law Commission is trying to do now, is translating that knowledge—that truth—into legislation in a form that will have a materially beneficial effect on the very large number of victims of misogyny. That is the difficult piece to try to get right. Frankly, the more data that we have to help us try to understand how to do that effectively, the better.

My noble friend Lady Bull laid out some of the international context. This is not something that takes place only in our disunited kingdom, it is an international syndrome and a shameful one. The existence of gender-based hostility is a fact of life and it has probably always been with us from Neolithic times. The noble Baroness, Lady Burt, quite rightly made the point that we must have the right information. I am to some extent agnostic on the technical issues of sex versus gender and all the rest of it. That is not a battle that I am going to fight. I do not feel qualified to do so, but I am quite sure that the Law Commission will look at that in detail as it is looking at all the other elements.

The noble Baroness, Lady Jones, talked about the pervasiveness of misogyny, based in part, I suspect, on her own experience and that of others that she has seen. It is shameful. She also made an extremely good point about the value of really good police domestic abuse training. I do not know to what extent there is a template for best practice and what good really looks like. I suspect that, as ever, some police forces are doing it infinitely better than others. Can the Minister tell us how much knowledge the Home Office has of where best practice is in existence or being evolved and, if so, what is it doing, or what does it aspire to do, to try to make sure that that is applied everywhere, not just in those police forces that are ahead of the game?

The noble Lord, Lord Lucas, talked about the importance of enhanced information, but he rightly made the point, as a lawyer, that hate crime is a difficult and very sensitive area, and data really will be king. Like the noble Baroness, Lady Donaghy, I saw the reports about the way in which female athletes have been tormented and abused because they cannot go to the normal stadia and places to exercise. It is absolutely deplorable that one should be trying to do what one loves and has a passion for—indeed, what one may be representing one’s country for—and is subject to abuse on the street. I cannot even imagine what that would be like. I hope that if I witnessed someone doing something like that, I would give them a piece of my mind—not that they would probably take much notice.

The noble Baroness, Lady Donaghy, also pointed out that misogyny is a recruiting tool for hate groups. In doing research for this debate, I went down one particular rabbit hole that I found on the internet: a very bizarre male forum in which feminism is regarded as the root of many of modern society’s ills and as a conspiracy to belittle men and reduce their role. It was eye-closing, rather than eye-opening, to try to read it, but it exists and we cannot ignore it. We have to try to do something about it.

The noble Lord, Lord Paddick, quite rightly, with his extensive experience, laid out some of the heffalump traps that exist legally and in the way in which the police might try to apply this. He knows far more about it than I do, but I would defer to the Law Commission to try to work its way through some of the complexities that he outlined. I probably agree that they do not necessarily need to be in primary legislation; that is not the object of this probing amendment.

The noble Lord, Lord Kennedy, again, referred to the importance of data and the role of social media. Like him, I greatly look forward to the arrival of our new colleague: his friend and mine, Vernon Coaker. When he arrives, he will be a sterling addition to your Lordships’ House. I also—since I am married to one—agree with the noble Lord on the very important role of powerful women.

The Minister quite rightly mentioned the pervasive influence of the home that one is fortunate or unfortunate enough to grow up in, and how that influences one’s views. We both have shared history in the importance of timely, accurate and informative data. I think we all agree that although we know this is here, we still do not really understand its full complexity, how to record it accurately or how to respond to it. I hope that the Law Commission will come up with some answers, but the pandemic has acted like a pressure cooker on an awful lot of what is going on. Many women and children are suffering unspeakable oppression at the moment and I am very conscious that, while it is neat and tidy to say that we will wait for the Law Commission findings to come out, there is a feeling among most of us who have spoken that it would be good to do as much as we can in the interim to acknowledge that this is a live and shameful issue, rather than just sit on our hands hoping that the Law Commission will pull a rabbit out of the hat.

On that basis, I thank everybody who has taken part. I thank the Minister for listening so politely and answering as I expected she might, but I hope that she and her colleagues will consider whether more could be done, given the circumstances that so many of these women and children are in, to try to send some message to police forces about the benefits that other police forces which have trialled this are having from it, and to encourage them to look at it seriously. In the meantime, I beg leave to withdraw the amendment.

I thank the Minister for her very full reply. I asked whether the approach of my noble friend Lord Anderson of Ipswich in 2016 to the scrutiny of the Investigatory Powers Act, as it went through both Houses, might not be a model to follow. In our meeting last week, the Minister discussed with myself and those of us who are sceptical about the use of child CHIS for evidence the requirement for this. To convince us, she was kind enough to indicate that the 17 cases that we know of through IPCO produced a result that was deemed, in the balance of all things, positive and justified the use of those cases. In the absence of that sort of evidence, those of us whose primary concern is the best interests of the child are understandably very cautious and a little sceptical. We are willing to be convinced but we need the evidence to be convinced, please.

My Lords, I was about to clarify that we are talking about Amendment 1, but the noble Lord, Lord Dubs, and indeed the Deputy Speaker, have now clarified that.

The noble Lord’s amendment seeks to remove the declaratory status aspect of Clause 6 so that it would provide for children in care and care leavers who have their right of free movement removed by the Bill to obtain indefinite leave to remain—or settled status—under the EU settlement scheme, where they applied to the scheme or a local authority did so on their behalf. It would do this regardless of how long the child or young person had been continuously resident in the UK. There is absolutely no difference of view on the importance of protecting the rights of children in care and care leavers as we end free movement—just as we are seeking to do where all vulnerable groups are concerned.

I set out in earlier debates on this provision the extensive support that the Home Office is providing to local authorities to ensure that those children and young people, as well as any other vulnerable groups, get UK immigration status under the EU settlement scheme, and the secure evidence of that status which the scheme provides. This includes grant funding to organisations across the UK of up to £17 million over the period 2019-20, to support this and other vulnerable and at-risk groups in applying to the scheme. I am pleased to say that the Home Office announced last week that the number of organisations funded for this work would increase from 57 to 72. That includes local authorities and local government associations as well as charities.

I made it crystal clear in the earlier debates that, in line with the withdrawal agreement, where a person eligible for settled status under the EU settlement scheme has reasonable grounds for missing the 30 June 2021 deadline, they will be given a further opportunity to apply. I have also made it clear that those reasonable grounds will include where a parent, guardian or local authority does not apply on behalf of a child. Therefore, if a child in care or care leaver does miss the deadline, they can still obtain lawful status in the UK.

In light of views expressed in this House in our earlier debates on this issue, the Government do not object to Amendment 1. We will see how the other place regards Clause 6 as so amended.

I say to the right reverend Prelate that that is the only way to go. Knife crime problems are not caused by any one source and there is no magic area where we can deploy interventions. It has got to be a multiagency, public health approach, as the right reverend Prelate says.

I most wholeheartedly agree with my noble friend. I can even cite examples, although I will not at the Dispatch Box, where I have seen people whose lives have literally been turned around by their engagement in sport, rather than activity that will lead to a life of crime.

It is not a question of not being particularly interested. As I said to the noble Baroness, Lady Hamwee, there is information sharing between the Home Office and local authorities. I imagine that it is management information, as opposed to publishable figures, but I can confirm that to the noble Lord.

My Lords, in her response to the noble Baroness, Lady Lister, the Minister said that several Governments have applied the same rules. She might be interested to know that a very distinguished noble friend and fellow Cross-Bencher sitting not a million miles away from me muttered in my direction, “One of the definitions of insanity is doing the same wrong thing again and again”.

I come back to the point of children being denied free school meals. In all conscience, how can any Home Office official or Minister say that that is the right thing to do? In what way does it promote integration? And what on earth have those children done wrong?

The point I made did not uphold the noble Lord’s point that doing the same thing over again and expecting a different result is the definition of insanity but that successive Governments have accepted that, if you do not have right of residency, NRPF should apply. On free school meals, a pupil or their parent must be in receipt of any of the qualifying benefits, including asylum support, and must make a claim to the school for free school meals. It is not that a child would not have access, but that they must satisfy the criteria. Decisions over whether immigrants or refugees have recourse to public funds and/or receive asylum support are made by the Home Office.

I will. I will not give him an adequate response, but I will tell him why; if that is okay.

The noble Lord, Lord Rosser, asked why the charge was set below cost recovery levels. I think I have answered that. He asked why the estimate in 2015 of £800 per person is so different from what we have now. It is because in 2015 it was just that, an estimate. We can now give an actual figure, given that people actually use the health service. The noble Lord also asked why we decided to double it on the basis of Department of Health and Social Care analysis. He will know that we made a commitment before the 2017 general election to triple the surcharge. We have not; we have doubled it. It was because we had made a manifesto commitment that we did not consult on the issue.

The noble Lord also asked about EU citizens. We are in the process of negotiating reciprocal healthcare arrangements with the EU. We have reached agreement on citizens’ rights that will protect EU citizens and their family members who are resident in the UK by the end of the planned implementation period on 31 December 2020. We have made it clear that the immigration health surcharge will not apply where EU citizens make immigration applications during the implementation period after the UK leaves the EU. We will set out our plans for the future border and immigration system in a White Paper later this year, which, noble Lords will work out, has not long left. Another noble Lord asked that question. I will not pre-empt or trail the White Paper with further detail at this stage.

We have been through the double taxation argument. I do not think that the noble Lords who asked about it agree with me, but I have made the point that the charge is fair not only to migrants but to UK national and permanent residents who have or will make a greater contribution to the NHS over their working life.

The noble Lord, Lord Paddick, and the noble Baroness, Lady Jones, talked about the compliant environment. This is nothing to do with the compliant environment. The charge is intended to ensure that temporary legal migrants make a fair contribution to the cost of their healthcare in the UK. In contrast, the compliant environment is a suite of compliance, deterrence and data-sharing measures that form part of our overall approach to deterring and tackling illegal migration and protecting public services.

The noble Baroness, Lady Lister, asked why children do not feature in the impact assessment. This is because it is at a macro level rather than an individual level. I know she does not like that answer but individuals are fully catered for in the system of fee waivers and exemptions, and a child is as likely to need healthcare as an adult.

I take the noble Baroness’s point because in everything we do with law, we have to consider the rights of the child. That is a basic requirement on the Government. It may be implied, it may not be, but I entirely take the noble Baroness’s point.

The noble Lord, Lord Rosser, asked me about undocumented children having to make four applications over 10 years at over £10,000. These applicants fall within the scope of specified human rights applications for which fee waivers are available—we have gone over that point—but, of course, parents may apply for the fee waiver for the child.

We have produced the policy on equalities assessment and will provide it to Peers who have spoken in this debate and place a copy in the House Library. I cannot stand at the Dispatch Box and say that it includes children. I suspect from what the noble Baroness says that it does not, so I go back to my previous point.

The noble Baroness asked about the chief inspector’s report and when it will be published. The immigration fees and the surcharge are obviously two separate things. The Government made a manifesto commitment to increase the surcharge and it is important that we deliver on that.

The noble Baroness also asked about the proportion of applicants receiving a waiver—this goes to the point made by the noble Lord, Lord Russell of Liverpool—but we have not published that information. However, we are reviewing the process because, as time goes on, these issues necessarily become more complex. I know that does not answer entirely the point made by the noble Lord, Lord Russell, and the noble Baroness, Lady Lister, but we will be reviewing that.

On the point I made that in the impact assessment there is a reference to the Government considering options for families who are experiencing hardship, what options are the Government considering and where are they in their thinking?

I cannot give the noble Lord any more information on that at this point but I am sure it will be released in due course. He also asked about the Coram freedom of information request. The first response was based on management information from a live database which is subject to variations as the year progresses. The second was not answered because of a policy to release only published information. Government departments often do not release information if it is not published information, although I have given management information with caveats before. The Government are seeking to resolve this issue.

Does the Minister accept that it is extraordinarily difficult for us to try to work out the effects and the effectiveness of the fee-waiver system in the absence of any reliable or up-to-date data? How can the Government make decisions about it if they do not have the data? If they do have the data, please can they share it with us?

We do not share management information data because it is purely that—management information. As I understand it, we are seeking to resolve this issue with Coram Children’s Legal Centre, and when we do I will be happy to write to the noble Lord with the outcome.

I hope that noble Lords are satisfied with my response, although I suspect they are not, and that the noble Lord will feel happy to withdraw his amendment.
