My Lords, the noble Lord brings up a number of areas. He is absolutely right to bring up the subject of civil liberties in terms of identity cards, because that was one of the concerns about them in the first instance. The Prevent strategy aims to protect people against the threat of radicalisation, not to punish them. In my previous role in communities and local government, I was aware of some fantastic community work, much of it led by the Church, which is helping people to come together to discuss those areas that unite communities rather than divide them.

My Lords, for the life of me, I do not understand why the Government have set their mind so firmly against the idea of having an identity card or identity document. It is common practice in many parts of the world. If the Government, in their rush to Brexit, wish to control immigration, it seems to me that the most obvious thing they should do is to have some form of common identification to show that people are United Kingdom citizens.

My Lords, all the questions that have come to me in this House have been on the protection of children. The top priority, certainly of this Government and I hope of the French Government, should be to protect the vulnerable. We have put £10 million into a child refugee fund solely dedicated to separated and unaccompanied children. I pay tribute to the work of the FTDA in France, to which we have also contributed, in identifying victims of exploitation and trafficking, because that is a particularly vulnerable area at this point in time.

I will certainly take that back. My noble friend has spoken about this before. I assure him and indeed all noble Lords on this point, which has been raised before: before invoking that particular article, it is important that the terms of negotiation are determined and we know exactly what position we are negotiating from. One important thing to retain in all this is that it is clear that the citizens of the United Kingdom as one nation voted to leave the European Union. That is a fact. We need to ensure that we secure the best possible arrangements across the board. I am sure that the protection of the rights of those who live in the UK as EU nationals and those British nationals who live in the EU will be at the heart of those discussions, both from our perspective and from those of our European partners.

My Lords, when the Minister was speaking a moment ago, he said we must get the agreement of member Governments. I am slightly worried as to whether the negotiation—because that is what it is going to be—about EU citizens living here and our citizens living in the EU can take place at a European level, or whether we are not going to have to negotiate with each member state of the EU separately about their arrangements for continuing to receive our citizens and for our citizens to continue to live there. In other words, will we not have to have separate negotiations with Spain, France and each other country individually, and are we not likely to get different receptions depending on which country we are negotiating with? If so, how on earth are the Government going to do it?

My understanding, and I think I am clear on this, is that the negotiations we will have across the range of different areas regarding the single market, trading arrangements and so on will be with the EU. We continue to be part of the EU and will continue to have those discussions once we have established our negotiating criteria with the EU.

I do not share the noble Baroness’s view that backs were turned. Indeed, there were specific outcomes from the special session. As the noble Baroness will be aware, the British Government led on action against drugs, in light of new laws on psychoactive substances, and we got some real outcomes on that. Also, while I know that the noble Baroness was disappointed on issues of both drugs health policy and human rights, the UK Government again led both the European Union and 29 other Governments in making a statement to ensure that there will be substantial outcomes from that session.

Is the Minister aware—I am sure he is not—that I find myself at a total loss to understand the Government’s policy towards the use of medicinal cannabis? Is he further aware that there is now a mass of medical evidence to show that, in certain cases, it can be useful and helpful? Is he also aware that, in relation to the legalisation of medicinal cannabis, Germany, Spain, Italy, Austria, the Netherlands, Canada, Israel, Mexico, the Czech Republic, Portugal and 24 states in the United States of America have all agreed that the medical evidence is strong and that medicinal cannabis ought to be authorised? Why on earth do the Government not accept the evidence and do the same?

The Government do follow the evidence. I am sure that the noble Lord is aware that a clear regime is in place, administered by the Medicines and Healthcare products Regulatory Agency, to enable medicines, including those containing controlled drugs, to be developed. I understand that Sativex is the cannabis-containing medicine that is authorised in the UK.

This country is doing a significant amount. Could it do more in the face of the crisis? Of course, it could do more in the face of the crisis, but is it working diplomatically? Yes; it is at the heart of the diplomatic efforts. Is it working on security? Yes; we have boats and ships in the Mediterranean seeking to stop people. We have people trying to clamp down on the people smugglers. We announced a new £10 million fund just last month—the debate proceeded as if it had not even happened—from the Department for International Development to help identify children at risk who have come to the European Union. That £10 million will be spent on helping to identify children at risk. We are dispatching the Independent Anti-slavery Commissioner, Kevin Hyland, to visit the particular reception centres referred to as the hot spots with child protection officers and come back and give us a report.

I have listened to what the noble Lord has said about how well the Prime Minister and the Government are behaving. Do I take it that it is the Government’s position that they will not take any of the children who are identified by Interpol as being loose in Europe? Yes or no?

The noble Lord presses me to say yes or no. I am about to give him a yes-or-no answer, which is to say, no. We have a principled objection. The people most at risk are in the region. That is why we have doubled the amount of aid we are giving, which was already 227% of our fair share, from £1.1 billion to £2.3 billion. We did it because we wanted to help, as we are helping—keeping 223,000 people in schools, providing 2 million bits of medical assistance, and helping 600,000 with livelihoods and medical care there in the region, because we believe we can do that. We believe that we should not be doing anything that encourages one child to make that perilous journey, where they fall into the hands of the criminal gangs and put their lives at risk to cross those seas to get to Europe. We want the action to be taking place there. That is our principled objection to this amendment. The noble Lord may disagree on that but we are clear where we stand.

I hope the House will recognise, and that the noble Lord, Lord Dubs, will recognise when he responds to this debate, that the Government are not immune to the argument that has been put forward. We are not doing nothing in the crisis; we are doing a great deal more than any other country in the world to respond to the initiative that is happening. We will go on doing so, not because of the amendment but because it is the right thing to do. I will be very grateful if the noble Lord will do two things when he winds up. First, will he comment on my analysis of the numbers and the vulnerability? Secondly, will he say something about other countries in Europe which are not doing a fraction of what this country is doing?

The right reverend Prelate the Bishop of Chelmsford talked about the generosity of British people. I work with Richard Harrington, whom we have appointed as a Minister, by the way, to look after the Syrian vulnerable persons relocation scheme, and I know that every day he has a battle to persuade local authorities to take the children we already have coming through that scheme. The right reverend Prelate the Bishop of Rochester, in a previous debate, undertook to write to other dioceses to encourage them and their local authorities to come forward and offer spaces.

We currently have an 8,000 shortfall in the number of foster parents required, so all the offers to provide foster care are welcome. We desperately need those places for young people everywhere but there is no surfeit of people registered as foster parents waiting to take people in. As I say, there is a shortfall of some 8,000 that we definitely need to fill. I hope that the noble Lord will respond to the points I made about local authority capacity, and what other countries are doing, and to the questions I raised about the numbers and how they have been arrived at by Save the Children, and consider withdrawing his amendment.

The Minister said in his initial Answer that Sir Peter Hendy would look into, among other things, the “affordability” of the project. If funding is not an issue, what on earth is he going to look into?

I must say to noble Lords that I am very impressed by my popularity on the last day of term. The noble Lord nevertheless raises an important point. I mentioned affordability because of course challenges have arisen. That is why it is important to allow Sir Peter to look into all elements of the challenges that have arisen around Network Rail. As I have said already, we will return to this issue in the autumn.

My Lords, I cannot support these amendments, not because I challenge the sincerity of those who wish to encourage wider debate about drugs and the value of criminalising or decriminalising them, but because I think this is the wrong Bill at the wrong time to try to bolt on this wider debate. There is a real mischief that needs to be dealt with now: the mischief of so-called legal highs, which, tragically too often, are lethal highs. Many families are grieving in this country because youngsters, in particular, have taken these substances and died as a result. The mischief that needs remedying as soon as possible is the spread of so-called head shops and other such shops in many of our major cities around the country. We are just getting into the serious music festival season. Many of those festivals will have the equivalent of head shops on open display. There is real confusion among many vulnerable, naive youngsters, who assume that, because there are head shops or stands at music festivals selling these substances, they must be medically safe.

I spoke yesterday to the chief constable of Hertfordshire, Andy Bliss, who leads for the police service on these issues, and the police are adamant that there is a real need for this legislation as soon as possible. So let there be a wider debate around the big issues of evidence, prohibition and legalising or not legalising drugs, but we need to deal now, laser-like, with this real and present mischief. Any attempt to make this Bill into a wider debate will dilute, probably defer and possibly damage our intent to deal with this real and present mischief. Although there is a need for this wider debate, I hope that it will not destroy the laser-like focus of this Bill, which deals with a real and imminent problem.

The specific terms of the amendment are:

“The Secretary of State shall commission an independent evidence-based review of the effectiveness of the Misuse of Drugs Act … and the implementation of the Act”,

and,

“The Secretary of State shall lay a copy of a report of the review before both Houses of Parliament within one year”.

Is the noble Lord saying that he approves of the amendment but does not think that it should be linked to the passage of this Act? If so, I would be grateful if he clarified that he is in favour now of an independent review of the way in which the Misuse of Drugs Act is actually operating.

Certainly, I am not against such a review. It is for those who wish to make the case for it to put it forward and to find a mechanism for it to take place. I would very happily give evidence to such a review or assist in any way I could. The point I am making today is that, at the very least, there would be a 12-month delay, probably longer, and there is a pressing need to get legislation now to do something about the production, supply and distribution of these so-called legal highs, which, as I said, are lethal highs on some occasions and are killing young people.

May I just finish this point? On the whole, the suggestion that in your Lordships’ House it is better to have a thorough debate in Committee, give the Minister a chance to reflect and then come back on Report if necessary has a great deal to commend it. This afternoon, we have on the Bench to reply to this debate my noble friend Lord Bates. He may prove me wrong this afternoon, but I regard him as an exemplary Minister who has proved on many occasions that he truly listens to debate in your Lordships’ House and often comes back with genuine recognition and concession. I very much hope that he will listen to the debate this afternoon in that exemplary fashion and reply accordingly.

I have heard a whisper that there could be an attempt to divide your Lordships’ House this afternoon. I very much hope that that will not happen because this is a profoundly serious matter—literally a matter of life and death for some people. It is crucial that we should have full and thorough debate. It is through that that we have earned our reputation for scrutiny, critical examination and the improvement of legislation. We have a chance to do that in this Bill, which, like every Bill, is far from perfect and is certainly capable of improvement.

I conclude by saying that I believe the point made by the noble Lord, Lord Condon: we are seeking to tackle a specific issue and the Bill is tackling that issue. We should take no steps that would frustrate that, and certainly not frustrate it at this early stage.

I hear what he says about the relationship between the Bill and the general proposition in the amendment moved by the noble Lord, Lord Paddick, that there should be an independent review of the operation of the Misuse of Drugs Act. Does the noble Lord support that?

I think I actually said that it is quite common in the legal highs market for legal high sellers— and there is more than one way of selling it—to send out samples of new psychoactive substances to existing customers and literally use human beings as guinea pigs, with no consideration of the consequences. I do not think that implies that everybody is doing that; it is saying that it is not uncommon for that to be the situation.

The evidence also shows how far behind the market we currently are. Substances were being banned following parliamentary debate earlier this year, when it had been known that sellers were sending out to potential customers samples likely to be toxic three years previously.

I wish to quote the Home Affairs Select Committee report, to which I referred earlier. I realise that some have already challenged this statement but it is set out in the Home Affairs Select Committee report. The report states:

“England and Wales has almost the lowest recorded level of drug use in the adult population since measurement began in 1996. Individuals reporting use of any drug in the last year fell significantly from 11.1% in 1996 to 8.9% in 2011–12. There was also a substantial fall in the use of cannabis from 9.5% in 1996 to 6.9% in 2011–12”.

That does not mean there is not still a problem, but the area where things have been going in the wrong direction, as identified in the report of the expert panel, has been as a result of the emergence of new psychoactive substances. The explosion of new psychoactive substances in the last few years is a unique phenomenon which warrants specific legislation. Some 670,000 young people in the UK were thought to have experimented with new psychoactive substances by 2013, and this is leading to an increase in deaths. To my knowledge, no new psychoactive substance which has been referred to the Advisory Council on the Misuse of Drugs has been found to be safe.

We are not in agreement with this group of amendments, which will delay the introduction of key parts of this Bill, including the blanket ban, when the need for action to address the growing issue of new psychoactive substances, including through education, prevention and treatment, is now.

As the noble Lord well knows, this was discussed very seriously after the 2011 riots in the capital and elsewhere in the country. It came forward from the chief constables, not the mayor. It was a policing-led proposal but it is something that there ought be political oversight of, and that is the reason why the Home Secretary is putting through these requests for additional information and scrutiny of the decision.

My Lords, I wonder if the Minister could help me and perhaps help the House a little. Has the prospective Conservative candidate for Uxbridge actually ordered two water cannon or not? I am not clear about that and I would be grateful if the Minister could help us. Secondly, can he tell us that if the prospective Conservative candidate for Uxbridge purports to order two water cannon, the Home Secretary will veto it?

This decision was taken by Sir Bernard Hogan-Howe, the current Commissioner of the Metropolitan Police. The Met decided to proceed with acquiring three water cannon because, I am told, although they cost £870,000 apiece it was able to get them for £30,000 and thought it was a reasonable decision to take at the time. However, that is something that the Met is answerable for. What the Home Secretary and the Home Office are answerable for is whether the decision should be taken to allow them to be deployed in the UK.

This is a devolved matter in Northern Ireland. An inquiry is ongoing at present, chaired by Sir Anthony Hart. We are of course open to the devolved Administration making approaches, but at the moment this is for England and Wales.

My Lords, the Minister said that so far there have been 150 nominations for the post of chair of this inquiry. Could he tell us a little more about this? Is it really going to be decided by nomination? Is the chair to be picked from the people who have been nominated? Have they nominated themselves? What organisations nominated them? It seems to me that in an affair of this sort the discretion of the Home Secretary in choosing the chair is extraordinarily important and should not be eaten into.

We opened this up after the initial appointments of the two chairmen because they did not command confidence. Some people have responded and come forward directly, while a number of representations have been made on behalf of others by Members of your Lordships’ House. We wanted to broaden the net as widely as possible so as to allow people to come forward, and then of course to go through the due diligence aspect of their backgrounds to ensure an appropriate shortlist. Then, most crucially, before the shortlist is made public, the first people to see it will be the survivors’ groups themselves to ensure that we have their confidence in the individuals concerned.

I obviously acknowledge the fact that we both voted for the Maastricht treaty. We were both in another place at the time and were part of the Government who did that. I recognise that that was the right thing to do, but the reality is that the pass was sold on this in the 2009 signing of the Lisbon treaty. That is, we have to live in the real world, as we are now, and keep our borders safe. It was good that the opt-in on justice and home affairs was negotiated to be included by the previous Government, but it was this Government who actually took it and have exercised it in this regard.

But does the noble Lord not recognise that if in fact we went back to a system of bilateral arrangements between this country and other countries concerning extradition, the process would be longer, more difficult and more expensive than operating the European arrest warrant?

The noble Lord is absolutely right. Let us imagine the process just in relation to the original Question and what it would mean for negotiations with the Republic of Ireland: we would be back to the bad old days of highly politicised extradition proceedings. We do not want to go down that route; that is why we have taken the decision that we have.
