Lords ChamberMy Lords, I apologise; I should have declared my interests earlier as a chair of a multi-academy trust and a trustee of the Education Policy Institute. It is not particularly helpful—I agree with a number of points that have been made—for us to argue in this Chamber about the success or failure of one type of school, but I support the noble Lord, Lord Knight. Other research I have seen recently says that MATs have done an excellent job at turning around schools that were previously failing. More than seven out of 10 academies, which had taken over schools that were formerly failing and underperforming as local authority-maintained schools, were rated by Ofsted as good or outstanding at their next inspection.
My Lords, very briefly, when my noble friend replies, could she explain to us how the matters that have been discussed proceed from the last Conservative Party manifesto and how they emanate from Conservatism, which abhors nationalisation and delights in diversity?

Lords ChamberWill Members of Parliament receive a briefing from the Department for Education about the implications, constituency by constituency, of this remarkable announcement today and the good news that it brings to every constituency in the country? I also want to ask my noble friend about independent schools, which the noble Baroness, Lady Garden, touched on. Will my noble friend confirm that the Government remain as fully committed now as they ever have been to securing the closer involvement of independent schools in co-operation with schools in the maintained sector? What individual independent schools can do varies so much depending on their size, their resources and the facilities that they have to share with the state sector. It also all has to be on a reciprocal basis. Is this not the underlying intention and aim of the Government today, just as it has been in the past? Finally, would my noble friend agree that it is always worth noting, when charitable status is mentioned, that independent schools give more in means-tested bursaries than they receive in benefit from their charitable status?
The answer to my noble friend’s first question is yes, there will be detail by school and by constituency. I entirely agree with what he says about independent schools. We had of course an event yesterday about independent and state schools working more closely together. Interestingly, that afternoon I went to visit an independent school close to one of my academies and was struck by the willingness of the head teacher there—who himself was state-educated, and the first in his family to go to university—and his school to engage with our state school.
There has been some lack of awareness in the past, which I hope has been partially solved by the Schools Together website, which now has more than 1,000 examples of schools and the independent sector working together. Fantastic examples include both King’s, Wimbledon and the York Independent State School Partnership, where all schools in York—I think it is three independents and 10 state schools—work closely together. We are dedicated to ensuring that every part of our school system, whether independent or state, works quite closely together and it is clear to me, having had detailed discussions with the Independent Schools Council, that it is determined to do that.

Lords ChamberTo ask Her Majesty’s Government whether they have plans to enable more children in care to obtain places in state and independent boarding schools.
My Lords, I am extremely grateful to my noble friend for this Question, as it is a subject close to my heart. We are very keen to encourage more local authorities to consider boarding for vulnerable children. This summer we launched the Boarding School Partnerships service, very ably chaired by Colin Morrison, the former chair of the Royal National Children’s Foundation, and this service operates jointly with the boarding schools sector and charities to help local authorities collaborate with charities to place vulnerable children in state and independent boarding schools.
Does my noble friend agree that children in care can benefit greatly from a boarding education where they are suited to it? Is it not the case that many local councils once recognised this, with some 10,000 placements being arranged in the late 1960s?
I agree entirely with my noble friend that boarding can have great benefits for the right children, and we want to see more vulnerable children able to access it. My noble friend is quite right that boarding was more common at one time. Boarding school, with its 24/7 level of pastoral care, can be particularly suitable for vulnerable children, and that is why we are encouraging its use more widely and why we have set up the Boarding School Partnerships.

Lords ChamberOne reason why it has become difficult to recruit teachers is the strength in the economy. The best way to recruit more teachers might be to have a Labour Government, who would wreck the economy and therefore dramatically improve unemployment rates and increase our chances of employing teachers. We live in a highly competitive economy. In many parts of the country, we have full employment. Difficulty in recruitment is not exclusive to teaching or to this country. However, we are not complacent; we are investing a great deal of time in a more regional approach to teacher recruitment and in changing our approaches to advertising and marketing, with schools working together in different regions on a much more sophisticated approach to recruitment.
Are the Government continuing to improve the arrangements under which teachers are initially trained?
Yes. As I think my noble friend knows, we have substantially increased the proportion of teachers trained in schools—it has now risen to 56% of initial teacher training. As I said in answer to the noble Earl, Lord Listowel, we are continuing to look at improving initial teacher training.

Lords ChamberI entirely agree with the noble Baroness. The evidence is clear: although we have had a dramatic increase in the quality of early years provision—it has risen from 69% to 93% rated good or outstanding by Ofsted since 2010—those attached to schools are the best. That is why we have been encouraging primary schools to open nurseries, and we will continue to do so through our free school process. She makes a very good point about bilingual nursery staff. Through our recruitment drive for teachers, we are working with the Spanish Government to recruit teachers from Spain. We are looking at whether we can work with France and Germany, and I will certainly take her point back to the teams.
How are primary schools responding to the Government’s encouragement to open more nurseries?
Generally, well. It was only a few rounds ago that we allowed primary free school applications to include nurseries, and a considerable proportion of them have now come with nurseries. As I said, that is something that we are keen to encourage: any opening of primary schools should come with nurseries attached.

Lords ChamberI am grateful to the noble Lord for his comments. What we are seeing through the multi-academy trust system is that a group of schools working together can employ one much more highly qualified accountant rather than each individual school having someone who often really struggles with the accounts, takes a very long time and would rather not do it. We are seeing a huge number of MATs achieving substantial savings in purchasing. One study said that primary schools working together in MATs was resulting in a saving of £146 per annum per pupil. I think it is self-evident that this is working, and we have plenty of examples. I would be happy for any noble Lord who is interested in this to attend a teach-in to hear about it in much greater detail.
I would like to ask my noble friend about the more than 25,000 responses that have come in to the consultation exercise. Have they come from all parts of the country to provide an indication of how people feel in different areas? Have comments come from all those most closely involved in and concerned about education—namely head teachers, teachers, governors and parents themselves? Is the Minister able to give any indication at this stage whether there is clear evidence that, overall, a positive view was being taken in the country of the principle of the basic idea of a national funding formula?
My noble friend makes a very good point. We have had a very wide response from all areas of the country. It is clear, particularly in those areas of the country that historically feel that they have been underfunded—we have discussed here before the vast differences in funding per pupil that can occur between two schools not that far apart—that this news will be welcomed by schools, despite what some Peers have said. It will be very welcome to move to a system that is not a postcode lottery and not based on very out-of-date information. I am certain that this will be welcomed by schools.

Lords ChamberI do not think that time will permit me to respond to that speech. I can only repeat what I said: that schools that run themselves efficiently have ample resources for a broad curriculum. I invite the noble Lord to go on to the department’s website and watch a clip by Sir Mike Wilkins about the curriculum-led financial planning at Outwood Grange. Academically, this is one of the most successful and, financially, one of our most efficient multi-academy trusts.
Will not the production of a national funding formula assist the progress of our education system in a substantial manner?

Lords ChamberWe will be responding in due course on the recommendations and will, of course, focus very much on opportunity areas—to take the noble Baroness’s point about the situation outside London. I agree entirely with the conclusions. The Sutton Trust tells us that the 7% of the population educated privately gets nearly 60% of the top jobs in this country. We have to do better than that. I will be delighted to meet with the noble Baroness.
Will my noble friend agree that a useful contribution to assisting low-income families could be made through the provision of large numbers of free places at independent schools under partnership arrangements between the Government and schools themselves?
As my noble friend knows, we are very keen to encourage partnership arrangements between independent schools and the state sector, and we are in active discussions with them about that. We are considering all the proposals we have had—some 7,000—as a result of our consultation document, and we will react to those shortly.

Lords ChamberTo ask Her Majesty’s Government what plans they have to promote the increased consumption of school milk.
My Lords, this Government recognise the vital importance of pupils being healthy and well nourished. We already encourage the consumption of dairy products as part of a balanced diet through school funding legislation and guidance. Under the school food standards, milk must be available during school hours and offered free to disadvantaged pupils. In addition, schools and childcare settings receive over £70 million a year of funding through the EU and nursery milk schemes.
Is it not the case that milk can play a conspicuous part in helping to combat obesity among children and the decay of their teeth—problems, sadly, that are increasing in our country today? Is there not more that can be done by the Government, schools themselves and interested organisations to get regular, increased consumption of milk in schools, so that children gain the health benefits that it brings?

To ask Her Majesty’s Government what assessment they have made of the Independent Schools Council’s proposal to create 10,000 free places at independent schools funded jointly with the Government.
My Lords, we welcome the positive way in which the Independent Schools Council has responded to the consultation document Schools that Work for Everyone by putting forward a number of proposals for ways in which the independent schools sector can achieve the aim of improving access for families to good school places. The consultation period closed on Monday this week. We are considering all the responses received and will publish our response in due course.
My Lords, I declare my interest as a former general secretary of the Independent Schools Council and current president of the Independent Schools Association, one of the council’s constituent bodies. Has my noble friend the Minister noted that the proposals contain plans that are specifically designed to assist social mobility by providing large numbers of new places across the age range based on need and need alone, at no extra cost to the Government? This is not a repetition of the assisted places scheme. Does my noble friend agree that this new constructive plan for partnership with the state could well represent the best way in which most independent schools can assist the Government’s agenda for education reform, since so many of them are small and lack the financial resources to invest in the academies programme?
I thank my noble friend for pointing out those particular aspects of the ISC’s proposals. I have no doubt that its proposals are extremely well intentioned. We know that many, probably most, independent schools do valuable work with state schools and that is very welcome—87% of ISC members are engaged in some kind of partnership with the state sector. But we believe that many can do more, although we are also clear that the expectations that we place on the sector must be realistic, proportionate and practicable.

Lords ChamberThe law specifically prevents the Secretary of State dictating how much time schools should spend on PE or indeed on any other subject; that is entirely a matter for them. I do not believe we have a figure for how many schools are meeting the recommendation, but we anticipate that most of them are. On participation, it is clear that the sport premium has had quite a substantial impact on primary schools. Some 87% are reporting that it has led to a substantial increase in the number of activities engaged in, including extracurricular activities, and there has been a 50% increase in the number of specialist PE teachers teaching in primary schools.
In a recent Written Answer I was told that school playing fields are subject to strong statutory protections. However, have not sales of school playing fields been increasing in recent years? Is that compatible with the strategy for child health and well-being for which the Question asked?
My noble friend makes an extremely good point. I am the Minister who signs off on playing field disposals, and we feel strongly that this should not happen except where absolutely necessary. We have a very rigorous process in place, and most disposals occur where schools have either closed or merged—a lot of them involve very small bits around playing field land. We are very clear that we will not allow playing fields to be disposed of unless it is absolutely necessary.

To ask Her Majesty’s Government what plans they have to ensure that independent schools are fully involved in the development of improved arrangements for teacher training.
My Lords, independent schools are a significant and valued part of the teacher training system, and we are committed to ensuring that they can help to raise standards of teacher training even further. Five independent schools are already designated as teaching schools. Furthermore, we are working with the Independent Schools Council to establish the first school-led training provider for modern foreign languages in Sheffield, with strong involvement from independent schools with expertise in the subject.
My Lords, that is immensely encouraging. Is not it the case that independent schools are particularly well placed to help to train specialist teachers in subjects such as foreign languages and sciences? Following what my noble friend said, will he give every possible encouragement to cross-sector partnership in teacher training, so that the skills and experience of the independent sector can be harnessed to the full for the benefit of the education system as a whole?
I agree with my noble friend’s comments. We very much welcome the sharing of expertise between schools across the sector. I am encouraged to see teacher training partnerships working, for instance, in the Crispin School Academy, which is working with a number of independent schools, such as King’s Bruton, Millfield and Taunton. The modern foreign languages project to which I referred will give trainees the opportunity to work in schools in both sectors that have outstanding modern languages departments. In addition to the five independent teaching schools to which I referred, more than 150 independent schools are members of teaching school alliances, including a number of special schools.

Lords ChamberWe need to get this in context. Related-party transactions are permitted and often related parties will provide services much cheaper than anybody else. In 2013-14 we identified only 13 cases in which either goods were not supplied at cost or it could not be verified that they were supplied at cost. They totalled under £500,000, which compares with the total academies revenue budget of £50 billion.
How many poorly performing schools have now been taken over by academy sponsors with a proven track record of success? How successful have academies been in recruiting good teachers?
We now have getting on for 2,000 sponsored academies. Last year, primary sponsored academies which have been open for two years improved their results by more than double those of local authority maintained schools. The benefits of academy status include the ability to employ teachers from a wide variety of backgrounds and to pay them appropriately.

Do they not face considerable pressures at the moment and require additional support in dealing with them? Secondly, does my noble friend agree that a responsible Government must have the power to intervene where local authorities are clearly failing?
I agree entirely with my noble friend that rural schools face certain pressures. We are absolutely determined that no school—particularly rural schools—will be left behind. Our national funding formula will, for the first time, provide many rural schools with more support than it has in the past. We are proposing both a lump sum and a sparsity factor for rural schools. As I said, we will have a fund of £10 million to help them explore the academisation. We will have people working with them and will do all we can to help them. We believe that rural schools working together may be able to afford, for instance, a language teacher, which on their own they would be unable to do. On my noble friend’s second point, we accept that where we have underperformance—wherever it is, whether in the local authority or elsewhere—we must have powers to intervene.

Lords ChamberI have seen that report. The issue is purely technical, based on different year-ends for schools and for the department, which will not be an issue this year because of methodology. I also saw the Audit Commission’s 2014 report, which found 200 cases of fraud in local authority-maintained schools in the previous year. Given that I walked into the Department for Education in 2010 to find a department completely financially out of control after 13 years of Labour government, I do not take lessons from the party opposite.
My Lords, there has been considerable concern about poorly performing primary schools. How many have been taken over by academy sponsors and with what results?
There are 960 primary sponsored academies open as of April this year, many of which previously suffered from chronic underperformance. In 2015, the percentage of pupils in sponsored primary academies achieving the expected level in reading, writing and maths at the end of key stage 2 rose by four percentage points to 71%. Results in primary sponsored academies open for two years have improved on average by 10 percentage points since opening—more than double the improvement in local authority-maintained schools over the same period.

It is well documented that music helps not only the cultural development of pupils but in matters such as working together in teams when they work in orchestras and choirs. I shall take back the noble Lord’s point and make sure that it is looked at.
Does my noble friend agree that arts and music have long been at the centre of partnership schemes between independent and state schools, schemes which are now increasing in number as a result of the recent Schools Together website launch?
I do. It is true that of the approximately 2,000 independent schools, nearly 800 of them are engaged in activities with state schools—of course, many of those which are not are very small. It is something which should be encouraged and we are doing everything we can to do so.

Lords ChamberMy Lords, the noble Baroness is quite right that we have paid an extra £33 million to small schools to enable them to engage in this programme. It was always intended as transitional funding to help schools put their service on a sustainable footing and we believe that that has been done.
My Lords, in view of the widespread desire to help our milk producers and of the nutritional benefits, has the time come to consider reintroducing compulsory milk in our schools, which helped to make so many of us healthy?

To ask Her Majesty’s Government whether they plan to preserve the A-level examination in Polish.
My Lords—or Moi szlachetni Panowie—we remain committed to securing the future of the existing range of language qualifications, including the Polish A-level. We are therefore continuing to work closely with relevant organisations and others to explore how best to enable these qualifications to be offered in future years.
Polish is the second most spoken language in our country. Deep historic ties exist between Great Britain and Poland. Is not the number of candidates sitting A-level Polish increasing, not falling, as is sometimes alleged? Does my noble friend agree that the Conservative Party has given an unambiguous commitment to preserve the Polish A-level exam? Does he also agree that the highly respected Polish Educational Society has put forward effective solutions to the small number of practical difficulties—such as the need to recruit more senior examiners—that have been raised by the AQA and Ofqual?
Not only are A-levels increasing, but the number of entrants over the last five years for GCSE Polish has gone up by 50%. I agree entirely with my noble friend’s sentiments. We have given a clear commitment. We are determined to ensure that these courses continue. They are very important to us as a trading nation and an outward-facing country, but as my noble friend says they are also particularly important for communities to enable their children to engage with their rich cultural history.

Lords ChamberWe are concerned about the point my noble friend makes and about isolated communities, which is an area that Louise Casey has been asked to look at to see how we can improve integration. We are very active in our whole-school approach to making sure that children are brought up to understand enough about the different religions and beliefs in this country that they can be prepared for life in modern Britain.
Will my noble friend ensure that independent schools that intend to become members of one of the independent schools associations do not have registration procedures that are unduly burdensome, while at the same time providing for the full inspection that is required?

There is no question that that is the case. About half of free schools are in the most deprived areas in the country. In the last five rounds, 93% of them have been in areas where there was a forecast shortage of places and a large number of our top academy sponsors, who are particularly focused on underprivileged children, have entered the free school movement.

To ask Her Majesty’s Government what steps they are taking to promote the teaching of classics in schools.
My Lords, we believe that classics can form a key part of a well rounded education or, to put it in words that I am sure my noble friend will understand, fundamentum disciplinae universae. We are providing £0.5 million to fund training for non-specialist teachers of classics in state secondary schools, led by Professor Pelling of Oxford University. From this September, maintained primary schools must teach a modern or ancient language to seven to 11 year-olds. In secondaries, achievement of an A to C grade in an ancient language GCSE counts towards the English baccalaureate.
Floreant literae humaniores. Is my noble friend absolutely confident that enough is being done to increase the number of classics teachers in response to the very welcome surge in interest in state schools? Does he agree that partnership in classics teaching between independent and state schools is already flourishing and that the right way to increase it is by voluntary agreement, supported and encouraged by government, and not by government compulsion, as the party opposite now proposes?
My Lords, ITT places for classics are up 25% and we have increased the bursaryship for classics and modern foreign languages. I fully agree with my noble friend that the classics are a fruitful subject for partnership. I am sure that he will be pleased to hear that we announced a fortnight ago a number of independent/state school partnerships, including one for Latin involving Thomas’s Kensington in collaboration with three state primary schools, with a further three language partnerships. I wholeheartedly agree that such partnerships should grow from voluntary initiatives, such as these ISSP programmes, and not be forced by government.

To ask Her Majesty’s Government what assessment they have made of the level of public support for an open access scheme to independent schools.
My Lords, we have made no assessment of public support for the open access scheme. We want all pupils, regardless of the type of school they attend or their background, to receive a high-quality education. We are delighted that the independent sector is so willing to engage with the state sector, as it does on a number of fronts such as independent state school partnerships and bursaryships, but we want to spend taxpayers’ money in the state school sector. With that money, through our education reforms, we are transforming the state school system to ensure that every pupil has the opportunity they deserve.
I thank my noble friend and, in doing so, declare my interest as president of the Independent Schools Association and of the Council for Independent Education. Does my noble friend not agree that wider access to independent schools could make a powerful contribution to the greater social mobility that we all want? Has he noted that within the independent sector itself, where more than a third of families now pay reduced fees, among heads and teachers there is considerable enthusiasm for more open access, which need involve no increase in public spending? In 1940, Churchill said that the advantages of the public schools should be extended on a far broader basis. Is it not time that we got on with it?
My Lords, I know that my noble friend is passionate about social mobility through education and I look forward to the Independent State Schools Partnerships conference next Monday, at which we are both speaking—a conference designed to promote partnerships between independent and state schools. As he said, the independent sector has a long history of increasing social mobility through bursaryships, scholarships and collaboration. In 2013, it provided more than £300 million worth of assistance, benefiting 40,000 children, and we absolutely applaud this. However, our priority is to invest our resources in making sure that all state schools provide an excellent education for their pupils, which in the end will be the greatest means of achieving much higher levels of social mobility, which I know all noble Lords wish to see. Our reforms are particularly focused on poorer children through, for instance, our pupil premium and Ofsted’s focus on the progress that pupil premium pupils make.

Lords ChamberThe noble Baroness is quite right that we cannot make the comparison, for the reasons that she states. I am delighted that she found my Answer helpful; we are always here to be as helpful as we can. I do not seek to use the independent sector as a stick to beat the state sector, but I personally find it quite shocking that 7% of the population go to private schools yet they take more than half the top jobs and more than 40% of the places in our top universities. That is a level of social immobility that I am sure we are all determined to change, without wishing in any way to knock either the state or independent sector.
I agree entirely that all pupils should receive a broad and balanced curriculum. The noble Baroness has vast experience of the performing arts. In their contributions to the “Best Eight” measure, there will be plenty of opportunity for schools to make a showing on a broad and balanced basis with subjects such as drama and music.
Would my noble friend agree that it is important to bear in mind that more than one-third of pupils in independent schools pay reduced fees? Would not that proportion be even larger if the Labour Party had not abolished Margaret Thatcher’s marvellous assisted places scheme?
I am fully aware that the independent sector provides bursaries of £300 million a year to pupils whose parents might otherwise not be able to afford to send them there, and that there are many examples of independent/state school partnerships. More than 90% of the Independent Schools Council members, 1,100 of them, support activities such as co-sponsorship of academies, or sponsorship—34 schools do that, while 388 schools provide specific lessons or other educational activities to state school pupils. Our ambition in this Government is to support all state schools and to improve their performance.

Lords ChamberThe noble Lord implies that casual equals laissez-faire; we do not accept that. As I said, we accept that most schools should do what all good schools do, which is to have an active programme of promoting their children’s interest, including drugs education, which they must be taught about in science classes anyway. Often, the best way to engage those pupils with those difficult issues, such as forced marriages or gangs, is not for teachers to do that—they often will not open up to their teachers—but for outside agencies and charities with skilled people in those difficult areas to talk to them about that.
My Lords, will my noble friend confirm that the overwhelming majority of free schools have been rated good or outstanding in Ofsted inspections? How does that compare with the performance of schools as a whole?

Lords ChamberCan my noble friend tell the House what the Government are doing to ensure that children in alternative provision have support and education to a standard that is on a par with that in mainstream schools?
We are focusing intensely on alternative provision providers. This Government have sent a very clear message that we expect alternative provision education to be equivalent to that in mainstream schools. There is no doubt that alternative provision in this country is extremely erratic. I am delighted to see that we have a number of alternative provision providers coming through in the new free school applications, and I expect that a number of them will be approved. A number of alternative provision providers are converting to academies. We have some excellent alternative provision providers. We have also asked Ofsted to look specifically at alternative provision through a thematic inspection process.

Lords ChamberWe are offering grants—all this is available on our website—to help sponsors to turn round failing and underperforming schools. In its November 2012 report, the National Audit Office rightly acknowledged the extraordinary success of the academy programme. We make no apology for spending money on a programme that is proven to drive up standards and make long-term improvements. We want as many schools as possible to take advantage of the significant benefits of academy status.
Can my noble friend tell the House how successful the Government have been in working with independent schools in expanding their marvellous academies programme?
